Expresses the sense of Congress that: (1) the Obama Administration should immediately withdraw the Department of Labor (DOL) notice of proposed rulemaking to rescind the Form LM-2 (labor organization financial disclosure report); (2) DOL should rededicate itself to enforce the Labor-Management Reporting and Disclosure Act of 1959 and not weaken disclosures provided for in the Form LM-2 regulation; and (3) all Americans are encouraged to share their thoughts on the financial disclosure of labor organizations through the comment process on this rule which closes on May 21, 2009.

Border Sovereignty and Protection Act - Amends the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 to require that: (1) at least 350 miles of fencing along the southwest border be two layers of reinforced fencing separated by a Border Patrol access road; (2) such work shall be completed within one year of enactment of this Act; and (3) fencing existing as of April 1, 2009, shall not be considered in meeting the mileage requirement. Gives the Department of Homeland Security (DHS) full authority, concurrent with that of the Department of Justice, to investigate violations of the Controlled Substances Act or the Controlled Substances Import and Export Act. Amends the federal criminal code to provide for a fine and/or at least 15 years imprisonment for firearms smuggling in connection with a crime of violence or drug trafficking. Makes a state or local subdivision ineligible for state criminal alien assistance program (SCAAP) funding if such state or subdivision: (1) has in effect any law, policy, or procedure prohibiting or restricting communication with the Immigration and Naturalization Service or other government entity regarding an individual's citizenship or immigration status; or (2) prohibits state or local law enforcement officials from gathering information regarding an individual's citizenship or immigration status. Sets forth provisions regarding the expedited removal of: (1) inadmissible arriving aliens; and (2) criminal aliens. Makes the basic pilot employment verification (E-Verify) program permanent. Sets forth the following E-Verify compliance schedule: (1) one year from enactment of this Act for federal agencies, federal contractors, and employers of more than 250 persons; (2) two years from enactment for employers of 100 or more persons; (3) three years from enactment for employers of 30 or more persons; and (4) four years from enactment for all employers.

Savings Recovery Act of 2009 - Amends title II (Old Age, Survivors, and Disability Insurance) of the Social Security Act to increase the monthly exempt amount for individuals who have employment income and who have not reached full retirement age between 2008 and 2010. Amends the Internal Revenue Code to: (1) exclude from the gross income of noncorporate taxpayers in 2009 and 2010 dividend income and gain from the sale or exchange of capital assets; (2) increase the limit on the tax deduction for losses from the sale or exchange of capital assets; (3) allow a tax credit for contributions to a qualified tuition program; (4) eliminate the marriage penalty in income limitations for individual retirement account (IRA) contributions; (5) increase the dollar limitation on contributions, including catch-up contributions, to IRAs; and (6) extend through 2012 the suspension of of minimum withdrawal requirements from pension plans. Amends the Employee Retirement Income Security Act of 1974 (ERISA) to provide special rules in 2009 and 2010 for valuation of assets in defined benefit pension plans.

Green Jobs Improvement Act - Amends the Workforce Investment Act of 1998 to make nonunion training programs eligible for federal funding under the energy efficiency and renewable energy worker training program (Green Jobs program). Applies certain worker protections and nondiscrimination requirements to such programs.

Taxpayer Conscience Protection Act of 2009 - Directs each state that makes a Medicaid payment from federal funds during the fiscal year for any items or services furnished by an abortion provider to: (1) report to the Secretary of Health and Human Services on all such payments; and (2) publish the report on a public Internet website of the state. Requires an annual report to specified congressional committees on such reports, which shall also be published on a public Internet website of the Department of Health and Human Services.

Directs the President pro tempore of the Senate and the Speaker of the House of Representatives to make appropriate arrangements for the award of a single gold medal in honor of the Women Airforce Service Pilots (WASP) collectively, in honor of their pioneering military service and exemplary record, which forged revolutionary reform in the U.S. Armed Forces. Expresses the sense of Congress that the Smithsonian Institution shall make the medal available for display elsewhere, particularly at other locations associated with the WASP.

Amends the Emergency Economic Stabilization Act of 2008 (EESA) to grant any financial institution that has received or receives a direct capital investment under the Troubled Asset Relief Program (TARP) the right to repay it immediately. Requires the Secretary of the Treasury to accept such a payment unconditionally.

Commends the crew of the Maersk Alabama and Captain Richard Phillips, who selflessly placed himself in harm's way to protect his crew. Recognizes the U.S. Navy, the crews of the USS Bainbridge, Boxer, Halyburton, and Patrol Squadron (VP) 8 for their role in the rescue. Congratulates the Navy SEALs on the scene for their decisive action that resulted in the rescue of Captain Phillips. Joins all Americans in expressing great relief that the crew has returned home safely.

Birthright Citizenship Act of 2009 - Amends the Immigration and Nationality Act to consider a person born in the United States "subject to the jurisdiction" of the United States for citizenship at birth purposes if the person is born in the United States of parents, one of whom is: (1) a U.S. citizen or national; (2) a lawful permanent resident alien whose residence is in the United States; or (3) an alien performing active service in the U.S. Armed Forces.

Expresses: (1) concern over the threat posed by nuclear, chemical, and biological weapons and related delivery systems in the hands of states that sponsor terrorism, such as Iran; and (2) support for the deployment of U.S. missile defense assets in Europe to address the growing missile threat posed by rogue regimes. Urges the President to expedite the deployment of components of an operational U.S. missile defense system in Europe. Requests the President to report annually to Congress on steps taken to move forward with such deployment. States that the United States shall continue its support for the missile defense of key allies against attacks by rogue regimes.

Constitutional Amendment - States that the liberty of parents to direct the upbringing and education of their children is a fundamental right. States that neither the United States nor any state shall infringe upon this right without demonstrating that its governmental interest as applied to the person is of the highest order and not otherwise served. Provides that no treaty may be adopted nor shall any source of international law be employed to supersede, modify, interpret, or apply to the rights guaranteed by this amendment.

Expresses the sense of the House of Representatives that North Korea should: (1) stop hostile rhetoric and activity towards the Republic of Korea and engage in mutual dialogue to enhance inter-Korean relations; (2) abandon its nuclear weapons and nuclear programs and return to the Non-Proliferation Treaty (NPT); and (3) comply with U.N. Security Council Resolution 1718.

Makes miscellaneous and technical amendments to the Higher Education Act of 1965 (the Act). Amends the Higher Education Opportunity Act to make the date of such Act's enactment August 14, 2008, the effective date of its revisions to the general definition of institutions of higher education (IHEs). Amends the Act to consider foreign public or private nonprofit nursing schools which were participating in the Act's Federal Family Education Loan (FFEL) program on August 13, 2008, as continuing to be eligible to participate in such program. Excludes Howard University, which receives assistance under the Act of March 2, 1867, from eligibility for capacity-building grants to Predominantly Black Institutions under title III of the Act. Increases amounts authorized and appropriated in FY2013 and FY2015 for increases in the maximum Pell Grant award. Revises the FFEL default reduction program to allow guaranty agencies to assign rehabilitated loans to the Secretary of Education until October 2011, if they have not been able to sell the loans to eligible lenders and the Secretary determines that market conditions unduly limit their ability to do so. Requires the removal of adverse information concerning such rehabilitated loans from a borrower's credit history. Prohibits eligible FFEL lenders from offering inducements to any individuals or entities in order to secure FFEL applicants. (Currently, IHEs and their employees may not be offered such inducements.) Authorizes the Secretary to purchase, or enter into forward commitments to purchase, rehabilitated FFELs that eligible lenders purchased under the FFEL default reduction program from October 2003 through June 2010, provided such purchase does not result in any net cost to the federal government. Conditions the purchase of such loans on the agreement of lenders to use the funds from such purchases to originate new federal loans to students or to purchase rehabilitated loans under the default reduction program. States that, beginning with the 20009-2010 school year, the expected family contribution, used in determining a student's eligibility for federal student aid, shall be zero for students who are eligible for Pell grants and whose parent or guardian was killed while performing military service in Iraq or Afghanistan after September 11, 2001. Delays the implementation of the EZ FAFSA (Free Application for Federal Student Aid), a simplified format for use in applying for federal student aid, until the 2010-2011 school year. Delays from July 1, 2009, to July 1, 2010, the implementation of the Competitive Loan Auction Pilot program, under which biennial auctions are to be held in each state allowing prequalified lenders to compete for the exclusive right to make FFEL program PLUS loans at all IHEs within the state.

Medical Economic Deferment for Students (MEDS) Act - Amends the Higher Education Act of 1965 with respect to the meaning of economic hardship under the Federal Family Education Loan or Perkins Loan and related loan insurance programs. Considers borrowers under such programs to be suffering economic hardship if they are working full-time, have a federal educational debt burden equal to at least 20% of their adjusted gross income, and the difference between their adjusted gross income minus such debt burden is less than 220% of the greater of: (1) the annual earnings of an minimum wage earner; or (2) 150% of the poverty line applicable to their family size.

Amends the Consumer Product Safety Improvement Act of 2008 to exempt off-highway vehicles from children's product lead limits. Defines "off-highway vehicle" as: (1) any motorized vehicle designed to travel on two, three, or four wheels and having a seat designed to be straddled by the operator and handlebars for steering control; and (2) a snowmobile. Allows the Consumer Product Safety Commission (CPSC) to exempt a specific product or material from the limits if it finds that lead in the product or material will not result in the absorption of lead (under current law, of any lead) into the human body, taking into account normal and reasonably foreseeable use and abuse of the product by a child.

Directs the Secretary of the Treasury to: (1) pursue every legal means to stay or recoup incentive bonuses and retention payments paid by American International Group, Inc. (AIG) to its executives and employees after September 16, 2008; (2) prohibit payments or other federal assistance to AIG unless current AIG executives and employees return to the Treasury any incentive bonuses and retention payments paid to them after September 16, 2008; and (3) require any financial institution that has received any assistance under the Troubled Asset Relief Program (TARP) and that has not repaid such assistance in full within two weeks after the enactment of this Act to submit to the Secretary for approval plans for making any incentive bonuses or retention payments to its executives or employees and any contracts that require such payments.

Affirmation of the United States Record on the Armenian Genocide Resolution - Calls upon the President: (1) to ensure that U.S. foreign policy reflects appropriate understanding and sensitivity concerning issues related to human rights, ethnic cleansing, and genocide documented in the U.S. record relating to the Armenian Genocide and the consequences of the failure to realize a just resolution; and (2) in the President's annual message commemorating the Armenian Genocide, to characterize the systematic and deliberate annihilation of 1.5 million Armenians as genocide and to recall the proud history of U.S. intervention in opposition to the Armenian Genocide.

Comprehensive Immunosuppressive Drug Coverage for Kidney Transplant Patients Act of 2009 - Amends SSA title II (Old Age, Survivors and Disability Insurance) (OASDI) to: (1) continue entitlement to prescription drugs used in immunosuppressive therapy furnished to an individual who receives a kidney transplant for which payment is made under Medicare; and (2) extend Medicare secondary payer requirements for end stage renal disease (ESRD) beneficiaries. Amends title XVIII (Medicare ) of SSA to apply special rules to kidney transplant recipients receiving additional coverage for immunosuppressive drugs. Deems such individual to be enrolled under Medicare part B and makes the individual responsible for the full amount of the applicable premiums. Applies deductible and coinsurance requirements to the provision of such drugs. Amends the Public Health Service Act, the Employee Retirement Income Security Act of 1974 (ERISA), and the Internal Revenue Code to set forth requirements for group health plans to provide coverage of immunosuppressive drugs for kidney transplant patients.

Peremptory Challenge Act of 2009 - Amends the federal judicial code to require: (1) reassignment to another appropriate judicial officer of any civil or criminal case to be tried in a federal district court, the United States Court of Federal Claims, or a bankruptcy court if all parties on one side file a reassignment request within 20 days (with certain exceptions) after initial assignment of a judicial officer; and (2) the chief judge of the court of appeals for the circuit in which the case is to be tried, or another judge designated by the chief judge, to determine any question arising as to which parties should be grouped together as a side for such purpose.

Homebuyer Tax Credit Act of 2009 - Amends the Internal Revenue Code to replace the current tax credit for first-time homebuyers with a one-time credit for 10% of the purchase price of a principal residence, up to $15,000. Requires repayment of credit amounts if the taxpayer sells or fails to occupy the residence within 24 months after the date of purchase.

Medal of Honor Commemorative Coin Act of 2009 - Directs the Secretary of the Treasury to mint and issue $5 gold coins and $1 silver coins emblematic of the design selected by the Secretary, after consultation with the Boards of the Congressional Medal of Honor Society and the Congressional Medal of Honor Foundation, in honor of the distinguished service of the American military men and women who have been Medal of Honor recipients. Limits the period for coin issuance to calendar year 2011. Imposes a surcharge of $35 per coin for the $5 coin and $10 per coin for the $1 coin, to be distributed to the Congressional Medal of Honor Foundation to help finance educational, scholarship, and outreach programs of the Foundation.

Federal Reserve Transparency Act of 2009 - Repeals the authority of the Comptroller General to carry out an onsite examination of an open insured bank or bank holding company only if the appropriate federal regulatory agency has consented in writing. (Retains the authority of the Comptroller General to audit a federal agency.) Directs the Comptroller General to complete, before the end of 2010, an audit of the Board of Governors of the Federal Reserve System and of the federal reserve banks, followed by a detailed report to Congress.

Iran Threat Reduction Act of 2009 - Amends the Iran Freedom Support Act to maintain specified U.S. sanctions with respect to Iran until the President certifies to the appropriate congressional committees that Iran has verifiably dismantled its weapons of mass destruction programs and ceased its support for international terrorism. Amends the Iran Sanctions Act of 1996 to: (1) include transshipment among sanctionable activities; and (2) exclude from the United States an alien who is a senior government official of a foreign government or a corporate principal or significant shareholder of a foreign person involved in proliferation activities relating to Iran. Expands: (1) the scope of sanctionable "persons" to include any business organization and any foreign subsidiary or affiliate; and (2) the definition of "petroleum resources" to include petroleum byproducts, oil or liquefied natural gas or liquefied natural gas tankers, and products used to construct or maintain pipelines used to transport oil or compressed or liquefied natural gas. Prohibits, with a discretionary waiver, U.S. importation of Iranian products other than information materials. Subjects an entity to penalties for violations of certain sanctions committed by a subsidiary established by such entity outside of the United States that would be subject to prohibitions if committed inside the United States or by a U.S. person. Authorizes the President to impose sanctions on principal executive officers of sanctioned persons. Amends the Iran, North Korea, and Syria Nonproliferation Act to include within the scope of such Act persons involved in the transshipment of certain goods, services, or technology. Prohibits service module payments to the Russian Aviation and Space Agency. Sets forth provisions regarding divestment from Iran's energy sector. Amends the Internal Revenue Code to: (1) deny a foreign tax credit to a taxpayer engaged in business activity with Iran that is prohibited by U.S. law; and (2) set forth income tax provisions respecting a foreign corporation engaged in business activity with Iran that is prohibited by U.S. law. Establishes the Compensation for Former United States Hostages in Iran Fund. Identifies claims to be paid. Establishes restrictions on nuclear cooperation with a country that is assisting the nuclear program of, or transferring advanced conventional weapons or missiles to, Iran.

Syria Accountability and Liberation Act - Maintains U.S. restrictions against Syria until the President certifies that Syria: (1) has ceased support for terrorism; (2) has dismantled biological, chemical, or nuclear weapons programs and has committed to combat their proliferation; (3) respects the boundaries and sovereignty of all neighboring countries; and (4) upholds human rights and civil liberties. Imposes specified trade, assistance, admissions, and military sanctions, as appropriate, on persons or countries that transfer goods or technology contributing to Syria's biological, chemical, nuclear, or advanced conventional weapons programs. Imposes specified sanctions aimed at Syria's energy sector. Sets forth diplomatic measures intended to isolate the government of Syria. Authorizes the President to provide assistance to support a democratic transition in Syria.

5-Star Generals Commemorative Coin Act - Requires the Secretary of the Treasury to mint and issue $5 gold coins, $1 silver coins, and half-dollar clad coins in recognition of five United States Army Five-Star Generals: George Marshall, Douglas MacArthur, Dwight Eisenhower, Henry "Hap" Arnold, and Omar Bradley, alumni of the United States Army Command and General Staff College, Fort Leavenworth, Kansas. Requires the design of the coins to include portraits of the generals. Restricts the issuance of such coins to calendar 2013. Requires specified surcharges in the sale of such coins, which shall be paid promptly to the Command and General Staff College Foundation to help finance its support of the College.

Secret Ballot Protection Act - Amends the National Labor Relations Act to make it an unfair labor practice for: (1) an employer to recognize or bargain collectively with a labor organization that has not been selected by a majority of the employees in a secret ballot election conducted by the National Labor Relations Board; and (2) a labor organization to cause or attempt to cause an employer to recognize or bargain collectively with a representative that has not been selected in such manner.

Declares that Congress: (1) focuses on learning more about senior care and being prepared to manage the needs of our aging population; (2) recognizes caregiving as a profession; (3) supports the efforts of family caregivers nationwide by encouraging individuals to provide care to family, friends, and neighbors; (4) fosters a private home care industry environment that supports enterprise to provide accessible and affordable caregiving services to seniors while providing standardized training to paid caregivers that offers opportunity for their continued growth and development; (5) studies alternatives to make caregiving even more accessible and affordable; (6) examines and continues to fund current federal programs which address the accessibility and affordability needs of seniors and their family caregivers; and (7) encourages the Secretary of Health and Human Services to continue working to educate people on the impact of aging and the importance of knowing the options available to meet seniors' personal needs.
