Medicaid Reentry Act of 2021 This bill allows Medicaid payment for medical services furnished to an incarcerated individual during the 30-day period preceding the individual's release. The Medicaid and Children's Health Insurance Program (CHIP) Payment and Access Commission must report on specified information relating to the accessibility and quality of health care for incarcerated individuals, including the impact of the bill's changes.

This bill directs the Health Resources and Services Administration (HRSA) to carry out a loan repayment program for certain specialty medicine physicians who provide care in rural communities with shortages of such physicians. Physicians must agree to a period of obligated service and, for each year of such service, HRSA must pay one-sixth of the principal payment and interest on eligible loans up to a maximum cap of $250,000.

Rights for the Transportation Security Administration Workforce Act of 2021 or the Rights for the TSA Workforce Act of 2021 This bill modifies the workplace rights, protections, and benefits applicable to Transportation Security Administration (TSA) personnel. Specifically, the bill within 180 days, eliminates personnel authorities of the Department of Homeland Security (DHS) and the Department of Transportation governing the conditions of employment for TSA employees, thus making TSA employees subject to the personnel management system applicable to other federal employees; sets forth transition rules that protect the pay rates, leave rights, and other rights of TSA employees; and requires DHS to consult with the labor organization certified by the Federal Labor Relations Authority to carry out the conversion of such positions. The bill also directs the TSA to consult with public and private entities associated with the Federal Air Marshal Service to address concerns regarding federal air marshals, including mental health and suicide rates; prohibits TSA employees from using or installing the social media video application TikTok on U.S. government-issued mobile devices; requires DHS to prioritize the hiring of veterans, including disabled veterans; and directs the TSA to ensure its employees are provided proper guidance regarding prevention and protections against the coronavirus (i.e., the virus that causes COVID-19).

No Taxpayer Funding for Abortion and Abortion Insurance Full Disclosure Act of 2021 This bill modifies provisions relating to federal funding for, and health insurance coverage of, abortions. Specifically, the bill prohibits the use of federal funds for abortions or for health coverage that includes abortions. Such restrictions extend to the use of funds in the budget of the District of Columbia. Additionally, abortions may not be provided in a federal health care facility or by a federal employee. Historically, language has been included in annual appropriations bills for the Department of Health and Human Services (HHS) that prohibits the use of federal funds for abortions—such language is commonly referred to as the Hyde Amendment. Similar language is also frequently included in appropriations bills for other federal agencies and the District of Columbia. The bill makes these restrictions permanent and extends the restrictions to all federal funds (rather than specific agencies). The bill's restrictions regarding the use of federal funds do not apply in cases of rape, incest, or where a physical disorder, injury, or illness endangers a woman's life unless an abortion is performed. The Hyde Amendment provides the same exceptions. The bill also prohibits qualified health plans from including coverage for abortions. Currently, qualified health plans may cover abortion, but the portion of the premium attributable to abortion coverage is not eligible for subsidies.

Research Investment to Spark the Economy Act of 2021 or the RISE Act of 2021 This bill authorizes the Departments of Agriculture, Commerce, Defense, Education, Energy, the Interior, Health and Human Services, and Transportation, National Aeronautics and Space Administration (NASA), National Science Foundation, and Environmental Protection Agency to provide support for research regarding COVID-19 (i.e., coronavirus disease 2019) or research disrupted by the COVID-19 pandemic. Support may be used to provide supplemental funding to extend the duration of a grant to a research institution, national laboratory, or individual that was awarded prior to the enactment of this bill, or to expand the purposes of such a grant as specified; issue awards to research the effects of the current pandemic and potential future pandemics; and provide flexibility on awards to account for facility closures or other limitations during the COVID-19 public health emergency. Agencies must provide the support as rapidly as possible. Provided funds shall remain available through FY2021.

Reinforcing Impaired Driving Education Act of 2021 or the RIDE Act of 2021 This bill requires the National Highway Traffic Safety Administration to establish a two-year pilot program to create and study the effects of a public marketing campaign to raise awareness on driving while under the influence of prescription and over-the-counter medications. The program shall be implemented in states or territories that are most affected by the opioid epidemic.

Pre-existing Conditions Protection Act of 2021 This bill reestablishes requirements for private health insurance plans with respect to preexisting conditions, guaranteed enrollment, and discrimination based on health-related factors if they are repealed by another law. In such event, the bill prohibits private health insurance plans from (1) limiting or excluding benefits covering preexisting conditions; (2) denying enrollment to employers or individual applicants, subject to specified limits; (3) establishing rules for eligibility based on an individual's health status; or (4) requiring an individual to a pay higher premium than similarly situated individuals enrolled in the plan based the individual's health status. The bill also prohibits plans from collecting genetic information in connection with issuing health insurance and provides requirements for workplace wellness programs connected to health insurance.

Closing Loopholes for Orphan Drugs Act This bill revises the 340B Drug Pricing Program, which currently requires drug manufacturers to discount orphan drugs (i.e., drugs for rare conditions) for certain entities covered by the program. The bill discounts orphan drugs that are not being used to treat rare conditions for all entities covered by the program.

Coronavirus Assistance for American Families Act This bill provides individual taxpayers with additional recovery rebates in 2021. The amount of such rebates is $1,400 per individual ($2,800 for married individuals filing joint tax returns) and $1,400 for each dependent of the taxpayer. The rebate is phased out for individuals whose adjusted gross income exceeds $75,000 ($150,000 for joint returns). To be eligible for the rebate, taxpayers must include a valid Social Security account number on their tax returns. The bill directs the Department of the Treasury to conduct a public awareness campaign to inform taxpayers of the availability of the rebate.

Block, Report, And Suspend Suspicious Shipments Act of 2021 This bill creates additional requirements for drug manufacturers and distributors who discover a suspicious order for controlled substances. In addition to reporting the suspicious order to the Drug Enforcement Administration (DEA), a manufacturer or distributor must also exercise due diligence and decline to fill the order. The DEA must issue regulations specifying the indicators that give rise to a suspicious order.

Ensuring Survivor Benefits during COVID-19 Act of 2021 This bill requires the Department of Veterans Affairs to get a medical opinion to determine if a service-connected disability was the principal or contributory cause of death in situations where a veteran's death certificate identifies COVID-19 (i.e., coronavirus disease 2019) as the principal or contributory cause of death, the certificate does not clearly identify any of the veteran's service-connected disabilities as the principal or contributory cause of death, and a claim for dependency and indemnity compensation is filed with respect to the veteran.

Vaccinate Americans, Not Terrorists Act This bill prohibits federal entities from administering COVID-19 (i.e., coronavirus disease 2019) vaccines to prisoners at the United States Naval Station in Guantanamo Bay, Cuba, until certain conditions are met. Specifically, federal entities may not vaccinate any prisoners if there are outstanding requests from states, tribal nations, and territories for vaccines or other COVID-19 relief; or members of the Armed Forces or reserve components who intend to get the COVID-19 vaccine and have yet to receive it.

Ghost Army Congressional Gold Medal Act This bill directs the Speaker of the House of Representatives and the President pro tempore of the Senate to award a Congressional Gold Medal to the 23rd Headquarters Special Troops and the 3133rd Signal Service Company, known as the Ghost Army , collectively, in recognition of its service during World War II.

Heartbeat Protection Act of 2021 This bill makes it a crime for a physician to knowingly perform an abortion (1) without determining whether the fetus has a detectable heartbeat, (2) without informing the mother of the results, or (3) after determining that a fetus has a detectable heartbeat. It provides an exception for an abortion that is necessary to save the life of a mother whose life is endangered by a physical (but not psychological or emotional) disorder, illness, or condition. A physician who performs a prohibited abortion is subject to criminal penalties—a fine, up to five years in prison, or both. A woman who undergoes a prohibited abortion may not be prosecuted for violating or conspiring to violate the provisions of this bill.

Just and Unifying Solutions To Invigorate Communities Everywhere Act of 2021 or the JUSTICE Act This bill addresses policies and issues regarding policing practices and law enforcement accountability. The bill funds state and local grants, incentivizes state and local reporting on the use of certain policing practices, creates new federal offenses for certain misconduct, and establishes best practices and training requirements. The bill funds state and local grants, including to support the use of body-worn cameras, to implement information sharing systems for disciplinary records of law enforcement officers, and to prohibit officers from engaging in sexual acts under color of the law. Further, it requires state and local governments that receive grants under the Edward Byrne Memorial Justice Assistance Grant program to report information related to use-of-force incidents and the use of no-knock warrants. At the federal level, the bill establishes new criminal offenses related to falsifying police reports and engaging in sexual acts under color of law. The bill directs the Department of Justice to develop training on de-escalation tactics, behavioral health crises, alternatives to the use of force, and the duty to intervene when another officer uses excessive force. Finally, the bill establishes and funds the National Criminal Justice Commission. Among other tasks, the commission must develop best practices for policing tactics and procedures.

COVID-19 Mine Worker Protection Act This bill requires the Department of Labor to issue health and safety standards to protect coal miners from occupational exposure to COVID-19 (i.e., coronavirus disease 2019). Labor shall provide for emergency standards within seven days of this bill's enactment, and such emergency standards shall be in force until permanent standards are promulgated. Labor shall also collect data to track and investigate cases of exposure to COVID-19 among coal miners.

Promoting Cross-b order Energy Infrastructure Act This bill establishes a new process for approving the construction and operation of energy infrastructure across an international border of the United States and replaces the existing process established under specified executive orders. Specifically, this bill requires a person to obtain a certificate of crossing before constructing, connecting, operating, or maintaining a border-crossing facility for the import or export of oil, natural gas, or electricity across an international border. A certificate must be obtained from the Federal Energy Regulatory Commission (FERC) for a facility consisting of oil or natural gas pipelines or the Department of Energy (DOE) for an electric transmission facility. As a condition of issuing a certificate, DOE must require that an electric transmission facility be constructed, connected, operated, or maintained consistent with specified policies and standards. FERC and DOE must meet a deadline for issuing a certificate as set forth by this bill. The bill also requires FERC to meet a deadline for approving applications to import or export natural gas to or from Canada or Mexico.

Suicide Training and Awareness Nationally Delivered for Universal Prevention Act of 20 21 or the STANDUP Act of 2021 This bill requires state, tribal, and local educational agencies that receive grant funding for priority mental-health needs, including through the Project AWARE State Education Agency Grant Program, to establish and implement evidence-based suicide awareness and prevention training policies. In addition, the Substance Abuse and Mental Health Services Administration, in coordination with the Department of Education and Bureau of Indian Education, must provide educational agencies with best practices for these trainings.

Born-Alive Abortion Survivors Protection Act This bill establishes requirements for the degree of care a health care practitioner must provide in the case of a child born alive following an abortion or attempted abortion. Specifically, a health care practitioner who is present must (1) exercise the same degree of care as would reasonably be provided to any other child born alive at the same gestational age, and (2) ensure the child is immediately admitted to a hospital. Additionally, a health care practitioner or other employee who has knowledge of a failure to comply with the degree-of-care requirements must immediately report such failure to law enforcement. A health care practitioner who fails to provide the required degree of care, or a health care practitioner or other employee who fails to report such failure, is subject to criminal penalties—a fine, up to five years in prison, or both. An individual who intentionally kills or attempts to kill a child born alive is subject to prosecution for murder. The bill bars the criminal prosecution of a mother of a child born alive under this bill and allows her to bring a civil action against a health care practitioner or other employee for violations.

Dismemberment Abortion Ban Act of 2021 This bill restricts the performance of dismemberment abortions. It defines the term dismemberment abortion . Specifically, the bill prohibits a physician from knowingly performing a dismemberment abortion. It provides an exception for a dismemberment abortion that is necessary to save the life of a mother whose life is endangered by a physical disorder, illness, or condition. The bill establishes criminal penalties—a fine, a prison term of up to two years, or both—for a physician who performs a prohibited dismemberment abortion. It also authorizes civil remedies for a woman or parent of a minor who undergoes a dismemberment abortion. A woman who undergoes a dismemberment abortion may not be prosecuted or held civilly liable.

Protecting Our Wealth of Energy Resources Act or the POWER Act This bill requires the President and federal agencies to obtain the approval of Congress before prohibiting or substantially delaying certain new energy or mineral leases or permits on federal lands, including oil and gas leases, coal leases, hard rock leases, or critical minerals leases. In addition, the President and agencies must obtain the approval of Congress before withdrawing certain federal lands from mineral and geothermal leasing activities.

Dignity for Aborted Children Act This bill sets out requirements for the disposition of human fetal tissue from an abortion. Specifically, it requires abortion providers to obtain a patient's informed consent for one of two specified methods of disposition. First, patients may choose to retain possession of the tissue. A patient may choose to transfer the tissue to an entity that provides interment or cremation services. Second, in cases where the tissue is expelled on the provider’s premises, the patient may elect to release the tissue to the provider. Providers must ensure any tissue released to them is interred or cremated within seven days of the procedure in a manner consistent with state law regarding the disposal of human remains. Abortion providers must report annually about these requirements and other specified information. The bill provides civil or criminal penalties for violations of disposal, informed consent, and reporting requirements.

Defund Planned Parenthood Act of 2021 This bill restricts federal funding for Planned Parenthood Federation of America Inc. or any of its affiliates or clinics for one year. Specifically, it prohibits funding those entities unless they certify that the affiliates and clinics will not perform, and will not provide funds to entities that perform, abortions during that year. If the certification requirement is not met, the Department of Health and Human Services and the Department of Agriculture must recoup any federal assistance received by those entities. However, the bill's funding restriction does not apply to abortions performed in cases of rape or incest or when necessary to resolve a physical condition that endangers a woman's life. The bill also provides additional funding for community health centers for the one-year period. These funds are subject to the same abortion-related restrictions and exceptions.

This bill authorizes the use of the Capitol rotunda on February 3, 2021, for a memorial service honoring Officer Brian Sicknick of the U.S. Capitol Police. The memorial service shall include Officer Sicknick's lying in honor in the rotunda, and the Architect of the Capitol shall place a plaque in honor of Officer Sicknick near the Capitol steps. The Sergeant at Arms of the House of Representatives and the Sergeant at Arms and Doorkeeper of the Senate must make arrangements for funeral services in the Capitol for Officer Sicknick, including payments for travel expenses of immediate family members and the attendance of Members of Congress. The bill also requires that any funds received by the Capitol Police Board in response to the attack on the U.S. Capitol on January 6, 2021, be deposited into the United States Capitol Police Memorial Fund.

Apprenticeship Hubs Across America Act of 2021 This bill requires the Department of Labor to implement a program to award grants to workforce intermediaries (certain national, regional, state, or local entities that facilitate the establishment of registered apprenticeship programs) to enable them to engage a variety of stakeholders to support, develop, and implement registered apprenticeship programs.

21st Century Energy Workforce Act This bill directs the Department of Energy (DOE) to establish a National Center for Excellence for the 21st Century Workforce Advisory Board to foster strategic vision, guidance, and networks for the energy industry. The purpose of the board is to (1) support and develop training and science education programs, (2) align apprenticeship programs and industry certifications to further develop succession planning in the energy sector, (3) integrate educational standards to develop foundational skills for elementary and secondary education and postsecondary education to create a pipeline between education and career, and (4) support the replication of existing model energy curricula. DOE shall also establish a pilot program to award grants to eligible entities for job training programs that lead to an industry-recognized credential.

Gabriella Miller Kids First Research Act 2.0 This bill modifies funding for a pediatric disease research initiative within the National Institutes of Health (NIH). Currently, this initiative receives funding through FY2023 from the 10-Year Pediatric Research Initiative Fund. This bill directs certain penalties assessed by the Securities and Exchange Commission against pharmaceutical companies for specified violations to that fund. In making allocations from the fund, the NIH must prioritize pediatric research that does not duplicate existing research activities.

Immunization Infrastructure Modernization Act of 2021 This bill directs the Department of Health and Human Services (HHS) to take actions to improve data sharing and other aspects of immunization information systems. These are confidential, population-based databases that maintain a record of vaccine administrations. Specifically, HHS must develop a strategy and plan to improve these systems, including systems supported by the Centers for Disease Control and Prevention; designate data and technology standards for use in these systems; and award grants to health departments and other government agencies to improve their systems. As a condition of receiving the grants, recipients must use the designated standards. However, HHS may waive this condition in some circumstances. HHS must also report to Congress on these activities.

Support And Value Expectant Moms and Babies Act of 2021 or the SAVE Moms and Babies Act of 2021 This bill prohibits the Food and Drug Administration (FDA) from approving any new drug (either as a brand-name drug or a generic) intended to terminate a pregnancy and imposes additional restrictions on such drugs that are already approved. Under the bill, an already-approved drug intended to terminate a pregnancy may be dispensed to a patient only with a prescription. Furthermore, the FDA may not approve any labeling change that would authorize (1) using the drug after 70 days of gestation, or (2) dispensing the drug by any means other than in-person administration by the prescribing health care practitioner. The FDA must also impose additional restrictions on such already-approved drugs, including by (1) requiring the prescribing health care practitioner to receive a special certification, (2) prohibiting the practitioner to also act as the dispensing pharmacist, and (3) requiring the practitioner to have the ability to provide surgical intervention to the patient. The bill also rescinds any investigational use exemption already granted to such a drug if the bill would have prohibited the FDA from granting the exemption. (Currently, the FDA may grant an exemption to certain market approval requirements if a drug is intended solely for use in safety and effectiveness investigations.)

National Apprenticeship Act of 2021 This bill provides statutory authority for the registered apprenticeship program within the Department of Labor, provides for related grant programs, and contains related provisions. The bill provides statutory authority for the Office of Apprenticeship (OA) within Labor. The OA's responsibilities include (1) supporting the development of apprenticeship models; (2) recognizing qualified state apprenticeship agencies, and operating apprenticeship offices in states without a recognized agency; (3) providing technical assistance to state agencies; (4) periodically updating requirements for each occupation in the apprenticeship program and determining whether to approve new occupations for the program; (5) promoting greater diversity in the national apprenticeship system; and (6) awarding grants provided under this bill. The bill also establishes in statute the responsibilities of state apprenticeship agencies and offices, including (1) providing technical assistance to stakeholders, (2) resolving complaints, (3) establishing state performance goals, and (4) including in its written plan a description of how its apprenticeship programs align with the skills needs of the state's employers. The OA shall enter into an agreement with the Department of Education to promote the integration and alignment of apprenticeship programs with secondary, postsecondary, and adult education. The OA shall award grants to eligible entities to (1) expand national apprenticeship system programs, including by expanding pre-apprenticeship and youth apprenticeship programs; (2) encourage employer participation; and (3) strengthen alignment between the apprenticeship system and education providers. The bill provides statutory authority for criteria for various programs, including (1) quality standards for apprenticeships, (2) requirements for apprenticeship agreements between a program sponsor and an apprentice, and (3) acceptable uses for grant funds awarded under this bill.

Saving America's Mines Act This bill bars the President, the Department of the Interior, or the Department of Agriculture from declaring a moratorium on or reversing any existing lease, permit, or claim, for the mining and extraction of any critical mineral or common varieties of sand, stone, and gravel on National Forest System or Bureau of Land Management land unless specifically authorized by statute or upon the lessee, permittee, or claimant's failure to comply with any of the provisions of its agreement.

Health Care Fairness for Military Families Act of 2021 This bill modifies the extension of dependent coverage under TRICARE by allowing a dependent under the age of 26 to be covered without an additional premium. Additionally, the bill authorizes such coverage of dependents without a premium regardless of whether they are eligible to enroll in an employer sponsored plan.

Protection of Women and Girls in Sports Act of 2021 This bill makes it a violation of federal law for a recipient of federal funds who operates, sponsors, or facilitates athletic programs or activities to permit a person whose sex is male to participate in an athletic program or activity that is designated for women or girls. The bill specifies that sex shall be recognized based solely on a person's reproductive biology and genetics at birth.

Access Technology Affordability Act of 2021 This bill allows a refundable tax credit equal to the amounts paid for qualified access technology for use by a blind individual who is the taxpayer, the taxpayer's spouse, or a dependent of the taxpayer. Qualified access technology is hardware, software, or other information technology with the primary function of converting or adapting information that is visually represented into forms or formats useable by blind individuals. The credit is limited to (1) costs that are not compensated by insurance or otherwise, and (2) an aggregate amount of $2,000 per blind individual in any period of three consecutive taxable years. The credit must be adjusted for inflation after 2021 and terminates after 2026.

Protecting American Resources, Innovation, and Sovereignty Act or the PARIS Act This bill requires the President to submit a report to Congress prior to taking certain actions under the Paris Agreement, and it gives Congress the authority to block such actions. The bill also prohibits any legal cause of action in U.S. courts pursuant to the Paris Agreement. Prior to establishing or revising a climate change-related action (referred to under the agreement as a nationally determined contribution or NDC), the President must submit a detailed report to Congress that includes information such as how the NDC will impact the level of total global emissions. If any action proposed in this report results in increased costs of energy or manufacturing, the report must include specific policy measures to prevent (1) job displacement, (2) reduced global competitiveness of U.S. goods, and (3) leaked emissions that may occur as a result of the proposed action. Congress may block the NDC by enacting a joint resolution of disapproval within 60 days of the President submitting this report.

This resolution supports the recognition of January 22 each year as the Day of Tears in the United States and encourages citizens to lower their flags to half-staff to memorialize the unborn.

No Taxpayer Funding for Paris Climate Agreement Act This bill prohibits the use of any funds to take action providing for the United States to become a party to the Paris Agreement.
