Review to Ensure High Quality Cost-Effective Training for Border Patrol Agents Act of 2005 - Requires the Comptroller General to review and report to Congress on the basic training provided by U.S. Customs and Border Protection to Border Patrol agents to ensure that this training is being conducted as efficiently and cost-effectively as possible.

Haiti Economic Recovery Opportunity Act - Amends the Caribbean Basin Economic Recovery Act to provide, beginning on October 1, 2004, and for each of the seven succeeding one-year periods, duty-free treatment for apparel items wholly assembled or knit-to-shape in Haiti (without regard to the country of origin of the fabrics, components, or yarns) if the President certifies to Congress that Haiti: (1) has established or is progressing toward specified political, economic, and social reforms; (2) does not engage in activities that undermine U.S. security or foreign policy; (3) does not engage in gross violations of human rights or activities in support of international terrorism; and (4) is meeting specified enforcement conditions aimed at preventing tariff or quota avoidance, customs evasion, unlawful transshipment, or false information or false document use in order to obtain such preferential treatment. Applies such provisions to goods entered or withdrawn from a warehouse for consumption on or after October 1, 2004, including a retroactive application to certain warehouse entries or withdrawals made between such date and the date of enactment of this Act.

Hurricane Katrina Recovery, Reclamation. Restoration, Reconstruction and Reunion Act of 2005 - Hurricane Katrina Victim Restoration Fund of 2005 - Provides for the determination of eligibility for compensation for any individual (or relatives of a deceased individual) who sustained economic or noneconomic losses as a result of Hurricane Katrina so that the individual (or relatives) are restored as nearly as possible to their condition before Hurricane Katrina. Directs the Administrator of the Environmental Protection Agency to develop a Comprehensive Environmental Sampling and Toxicity Assessment Plan. Provides for federal and state government to notify hurricane survivors of health risks they may face upon returning to their domiciles. Provides for the offer of alternative land and/or housing as compensation to residents whose homes or businesses have been destroyed or terminally compromised. Revises the TANF Emergency Response and Recovery Act of 2005 to provide for reimbursement of states for Temporary Assistance to Needy Families (TANF) benefits provided under part A of title IV of the Social Security Act to families from other states affected by Hurricane Katrina. Sets forth requirements relating to emergency extended unemployment compensation. Requires the Secretary of Health and Human Services to establish a program of emergency health coverage continuation relief. Sets forth housing and education requirements. Displaced Citizens Voter Protection Provisions of 2005 - Prescribes requirements for the protection of voting rights of Katrina evacuees. Prescribes requirements for: (1) regulatory relief for financial services; and (2) disaster loans and small business relief. Amends the Internal Revenue Code to provide for: (1) a tax credit for an eligible homebuyer who purchases a principal residence in the Hurricane Katrina disaster area; (2) an increase in the housing credit dollar amount; and (3) tax-exempt bonds for qualified Gulf Coast recovery projects. Hurricane Katrina Bankruptcy Relief and Community Protection Act of 2005 - Amends the federal bankruptcy code to exempt victims of natural disasters, including small businesses, from certain requirements for debtors seeking relief. Directs the Director of the Federal Emergency Management Agency (FEMA) to establish a temporary flood insurance buy-in program. Expresses the sense of Congress that the President should present, within six months, a plan to eradicate poverty in the United States by 2015.

Community Cancer Care Preservation Act of 2005 - Amends title XVIII (Medicare) of the Social Security Act to subject to quarterly reconciliation any payments to physicians for drugs or biologicals made according to average sales price payment methodology in order to assure that they do not exceed or fall short of the actual average sales price during any preceding period. Requires the Secretary of Health and Human Services to review all such payments in the preceding quarter and compare them to the verified average sales price reported by the manufacturer for such quarter. Removes prompt pay discounts from the calculation of the manufacturer's average sales price. Extends through December 31, 2006, the current demonstration project to identify and assess oncology services that positively affect cancer outcomes. Requires the Secretary to make an additional 2% for drug administration services payment to physicians for overhead and related costs. Directs the Secretary to develop indicators for the evaluation of the quality of oncology services provided in the physician office setting. Requires the Director of the National Cancer Institute to develop a strategic plan to increase the number of cancer patients who enroll in clinical trials.

Food Allergy and Anaphylaxis Management Act of 2005 - Requires the Secretary of Health and Human Services to develop and make available to local educational agencies a voluntary policy to manage the risk of food allergy and anaphylaxis in schools. Directs that such policy address: (1) a parental obligation to provide the school with information regarding a student's food allergy and anaphylaxis; (2) communication strategies between schools and emergency medical services; (3) strategies to reduce the risk of exposure in classrooms and common areas; (4) food allergy management training of school personnel; (5) authorization of school personnel to administer epinephrine when the school nurse is not immediately available; and (6) creation of an individual health care plan tailored to each child's risk for anaphylaxis.

Pension Benefits Protection Act of 2005 - Amends the Employee Retirement Income Security Act of 1974 (ERISA) and the Internal Revenue Code with respect to pension benefits of employees in defined benefit plans. Directs the Secretary of the Treasury to apply Code provisions regarding continued accrual of benefits beyond normal retirement age under a defined benefit plan, which prohibit certain discrimination based on age, without regard to the portion of the preamble to a specified Treasury Decision which relates to allocation of interest adjustments through normal retirement age under a cash balance plan. Prohibits forced conversions of certain defined benefit plan participants to cash balance plans, and other such plans that are hybrids of defined benefit and defined contribution plans, by plan amendments which: (1) change the way the accrued benefits to participants or beneficiaries are expressed; and (2) reduce the rate of future benefit accrual of one or more participants. Requires employers, at the time such amendment takes effect, to provide employees who have attained 40 years of age or 10 years of service with certain notices and an election upon retirement to receive benefits as determined either under the plan in effect at time of retirement or under the plan in effect immediately before the plan amendment. Sets forth a formula to determine when a plan amendment adopted by a large (100 or more participants) defined benefit plan shall be treated as wearing away accrued benefits.

Nursery and Tropical Fruit Producer Hurricane Relief Act - Directs the Secretary of Agriculture to use necessary Commodity Credit Corporation (CCC) funds to make emergency financial assistance available to: (1) commercial ornamental nursery and fernery producers in a disaster county for eligible inventory losses due to Hurricane Dennis, Katrina, or Rita; and (2) tropical fruit producers in a disaster county who have suffered a loss of 35 percent or more relative to expected production, due to any of those hurricanes. Provides for the calculation of losses and payments. Directs the Secretary to use necessary CCC funds to make emergency financial assistance to commercial ornamental nursery and fernery producers in a disaster county to help cover debris removal and associated costs due to any of those hurricanes. Amends the: (1) Agricultural Credit Act of 1978 to include a producer of nursery or fernery crops within the term "agricultural producer" for purposes of its emergency conservation program; and (2) Farm Security and Rural Investment Act of 2002 to include nursery growers that produce field- or container-grown trees within the term "eligible orchardist" for purposes of its tree assistance program. Designates amounts provided under this Act as an emergency requirement under the FY2006 Concurrent Budget Resolution.

Children's Gasoline Burn Prevention Act - Directs the Consumer Product Safety Commission to promulgate final child-resistance product safety standards for closures on portable gasoline containers intended for use by consumers. Prescribes criteria for such standards.

National Police Athletic League (PAL) Youth Enrichment Reauthorization Act of 2005 - Amends the National Police Athletic League Youth Enrichment Act of 2000 to: (1) rename the Police Athletic League the Police Athletic/Activities League (PAL); (2) reauthorize grants under the Act through 2010; (3) decrease the number of programs that PAL chapters receiving grant funds are required to create or expand from four to two; and (4) allow PAL chapters to use grants funds for programs to provide character development and leadership training.

Department of Homeland Security Reform Act of 2005 - Amends the Homeland Security Act of 2002 to require the Secretary of Homeland Security, acting through the Under Secretary for Policy (established by this Act), to conduct Quadrennial Homeland Security Reviews of the Department of Homeland Security (DHS). Establishes in DHS an Office of Intelligence and Analysis headed by a presidentially appointed Chief Intelligence Officer. Transfers to the Chief Intelligence Officer the functions, personnel, assets, and liabilities of the Directorate for Information Analysis and Infrastructure Protection, hereby abolished. Directs the Secretary to establish: (1) the Intelligence Through Employees Generating Resources for Analytical Leadership (INTEGRAL) Program; and (2) an intra-agency task force to study unclassified but security-relevant information. Redesignates the Directorate of Emergency Preparedness and Response as the Directorate of Preparedness and Response (DPR). Amends the Homeland Security Act of 2002 to establish a presidentially appointed Assistant Secretary for Preparedness, who shall perform the functions of the current Office for State and Local Government Coordination and Preparedness, with primary responsibility for the preparedness of the United States for acts of terrorism. Gives the Under Secretary of Preparedness and Response primary responsibility for oversight and coordination with state, local, and regional authorities in the National Capital Region. Establishes in the DPR a presidentially appointed Military Liaison to coordinate DPR activities with the efforts of the Secretary of Defense. Amends the Homeland Security Act of 2002 to eliminate the Office for State and Local Government Coordination and Preparedness, the Office for Domestic Preparedness, and the Office of National Capital Region Coordination (transferring its functions to the DPR). Establishes the Director (who shall be an Assistant Secretary in the DPR) and Deputy Director of the Federal Emergency Management Agency (FEMA). Establishes in the DPR a Chief Medical Officer, who shall also be an Assistant Secretary. Declares the sense of Congress urging merger in DHS of the Bureau of Customs and Border Protection (CPB) and the U.S. Immigration and Customs Enforcement (ICE). Grants the DHS privacy officer authority to conduct investigations. Eliminates the Under Secretary for Management and tranfers its functions to the Secretary. Requires the Chief Financial Officer, the Chief Information Officer, and the Chief Human Capital Officer to exercise joint authority, with the component agency heads, over their respective counterparts in the DHS component agencies and entities. Establishes a Business Transformation Officer, who shall develop an overarching management integration strategy for DHS. Outlines whistleblower protections for DHS employees and other covered individuals. Tribal Homeland Security Act - Establishes within DHS the Office of Tribal Security. Establishes in the DPR a National Cybersecurity Office, headed by an Assistant Secretary for Cybersecurity and Telecommunications, as well as an Assistant Secretary for Physical Infrastructure Security, both appointed by the President. Secure Handling of Ammonium Nitrate Act of 2005 - Authorizes the Secretary to regulate the handling and purchase of ammonium nitrate to prevent its misappropriation or use in an act of terrorism.

Federal Response to Energy Emergencies Act of 2005 - Declares unlawful: (1) unconscionable pricing of gasoline, oil, natural gas, and petroleum distillates during emergencies; (2) intentional reporting of false price information concerning wholesale prices of such products; and (3) market manipulation regarding the purchase or sale at wholesale of such products. Authorizes the President to declare a federal energy emergency upon finding that the national health, safety, welfare, or economic well-being is at risk because of an actual or imminent shortage of such products due to a disruption of the national distribution system, or significant pricing anomalies in national or regional energy markets for the products. Empowers the Federal Trade Commission (FTC) and State Attorneys General to enforce this Act. Sets forth civil and criminal penalties for violations of this Act. Requires fines and penalties collected under this Act to be deposited in a separate fund in the treasury to be known as the Consumer Relief Trust Fund to provide assistance under the Low Income Home Energy Assistance Program. Directs the FTC to facilitate price transparency in wholesale markets for the sale of crude oil and essential petroleum products. Instructs the FTC to transmit a confidential report to Congress on the potential impact on domestic prices of crude oil, residual fuel oil, and refined petroleum products that would result from the disruption for periods of one week, one year, and five years, respectively. Directs the Secretary of Energy and the Energy Information Administration to review and report to Congress on expenditures and activities undertaken by certain size companies to protect the energy supply system from terrorist attacks, international supply disruptions, and natural disasters, and ensure a stable and reasonably priced supply of such products to consumers in the United States. Requires such report to assess the companies' preparations for the forecasted period of more frequent and more intense hurricane activity in the Gulf of Mexico and other vulnerable coastal areas.

Medicare Informed Choice Act of 2005 - Amends title XVIII (Medicare) of the Social Security Act to: (1) provide for an extended period of open enrollment during all of 2006 without late enrollment penalty; (2) give Medicare beneficiaries the opportunity to make a one-time change in prescription drug plan enrollment at any point in 2006; and (3) provide protection from loss of employment-based retiree health coverage upon enrollment for Medicare prescription drug benefit, including a Medicare Advantage-Prescription Drug benefit, during 2006.

American Evacuation Planning Act - Amends the Homeland Security Act to include among the functions of the Federal Emergency Management Agency leading and supporting the Nation in a comprehensive, risk-based emergency management program of preparing communities and individuals, particularly those with special needs, for evacuation from a major disaster by coordinating with state and local governments in preparing or improving community evacuation plans and encouraging individuals to establish a personal plan.

Establishes within the Office of Inspector General of the Department of Homeland Security the Special Office of the Inspector General for Natural Disaster Response and Reconstruction. Requires the Special Office to conduct, supervise, and coordinate audits and investigations of the treatment, handling, and expenditure of federal funds by any organization providing relief, assistance, or reconstruction related to Hurricane Katrina, and of the programs, operations, and contracts carried out utilizing such funds.

Establishes in the legislative branch a bipartisan Katrina Commission to: (1) examine and report upon the federal, state, and local response to the devastation wrought by Hurricane Katrina in the Gulf Region of Louisiana, Mississippi, Alabama, and other affected areas; (2) evaluate and report on the information developed by all relevant governmental agencies related to Hurricane Katrina before it struck the United States and in the days and weeks following; (3) make a complete accounting of the circumstances surrounding the approach of Hurricane Katrina to the Gulf states, and the extent of the Government's preparedness for and response to it; (4) examine planning necessary for future cataclysmic events that will require a significant marshaling of federal resources, mitigation, response, and recovery to avoid significant loss of life; (5) analyze whether any decisions differed with respect to response and recovery for different communities and what problems occurred as a result of a lack of a common plan, communication structure, and centralized command structure; and (6) investigate and report to the President and Congress on immediate corrective measures that can be taken to prevent problems with federal response to future cataclysmic events.

Fair Wages for Hurricane Victims Act - Reinstates the application of the wage requirements of the Davis-Bacon Act to all federal contracts in counties affected by Hurricane Katrina, notwithstanding the President's proclamation dated September 8, 2005, or any other provision of law.

Amends the Internal Revenue Code to exempt from the penalty for premature distributions from an individual retirement plan a distribution to an individual residing in an area declared as a federal disaster area due to hurricanes, floods, or other natural disasters occurring in 2004 or thereafter if such distribution is made within six months after the date of the disaster declaration.

Ease Our Soldiers' Minds Act - Amends the Servicemembers Civil Relief Act to direct the Secretary of the military department concerned to notify creditors of individuals entering into or serving in military service of the rights and benefits afforded to such individuals by such Act. Requires the same notification to consumer reporting agencies.

HRIFA Improvement Act of 2005 - Amends the Haitian Refugee Immigration Fairness Act of 1998 to: (1) include document fraud among the grounds of inadmissibility which shall not preclude an otherwise qualifying Haitian alien from permanent resident status adjustment; and (2) provide that determinations with respect to children shall be made using the age of an individual as of the date of enactment of this Act. Permits new status adjustment applications to be filed for a limited time period. Directs the Secretary of Homeland Security to establish procedures for reopening status adjustment applications based upon the amendments made by this Act.

Minority Diabetes Initiative Act - Amends the Public Health Service Act to allow the Secretary of Health and Human Services to make grants to public and nonprofit private health care providers for the purpose of providing treatment for diabetes in minority communities. Conditions grants on the recipient agreeing to provide: (1) services in the languages most appropriate for, and with consideration for the cultural backgrounds of, service recipients; (2) outreach activities; and (3) offsite information on diabetes.

Cancer Testing, Education, Screening, and Treatment Act - Amends the Public Health Service Act to authorize the Secretary of Health and Human Services to make grants to qualifying health centers and nonprofit organizations for programs providing cancer screening, counseling, and treatment and information and education on cancer prevention. Targets service populations with significant numbers of low-income minority individuals who are at-risk for cancer, requiring programs to provide: (1) services in the languages most appropriate for, and with consideration for the cultural backgrounds of, services recipients; (2) outreach activities; and (3) cancer information. Requires the Secretary to designate the type(s) of cancer covered by a grant.

Alzheimer's Treatment and Caregiver Support Act - Amends the Public Health Service Act to authorize the Secretary of Health and Human Services to make grants to public and nonprofit private health care providers to expand treatment services for patients with Alzheimer's disease and training and support services for families and caregivers. Conditions grants on the recipient agreeing to: (1) employ a comprehensive approach to care that integrates the treament of patients with training and support services for families and caregivers; (2) provide services in the languages most appropriate for, and with consideration for the cultural backgrounds of, service recipients; (3) provide outreach activities; and (4) provide information on Alzheimer's. Allocates 10% of grant funds for medically underserved communities.

Healthcare Equality and Accountability Act - FamilyCare Act of 2005 - Renames title XXI (State Children's Health Insurance Program) (SCHIP) of the Social Security Act as the FamilyCare Program and extends coverage to certain low-income adults. Establishes the National Commission for Expanded Access to Health Care. Amends the Public Health Service Act to provide limited English proficient individuals with improved access to health care, including by establishing the Robert T. Matsui Center for Cultural and Linguistic Competence in Healthcare. Provides for activities regarding: (1) health workforce diversity; (2) disparities in health and health care experienced by racial and ethnic minorities; and (3) data collection, analysis, and reporting by race, ethnicity, and primary language. Requires the Secretary of Health and Human Services to establish: (1) the Office of Health Disparities within the Office of Civil Rights to prevent discrimination in federal programs; and (2) the Office of Minority Affairs within the Office of the Commissioner of Food and Drugs. Restablishes the Indian Health Service as an agency of the Public Health Service to be administered by an Assistant Secretary of Indian Health. Minority Health and Genomics Act of 2005 - Establishes the Minority Health and Genomics Commission to study issues relating to genomics research as applied to minority groups. Establishes the Interagency Working Group on Environmental Justice and the Federal Environmental Justice Advisory Committee. Sets forth programs designed to improve the quality of and access to health care for minorities, including by establishing the Health Safety Net Infrastructure Trust Fund. Requires the Secretary to establish: (1) the Annie Dodge Wauneka and Susan Laflesche-Picotte Native American Health and Wellness Foundation; and (2) a Joint Working Group on Telehealth. Authorizes integrative eldercare, American Indian and Alaska Native, and oral health telehealth demonstration projects.

Global Poverty Act of 2005 - States that a major priority of U.S. foreign policy is to vastly reduce global poverty and to eliminate extreme poverty in developing countries. Directs the President to develop and implement a comprehensive strategy to further such policy.

National Forest Roadless Area Conservation Act - Identifies roadless areas within the National Forest System set forth in specified maps as National Forest Inventoried Roadless Areas, and directs the Secretary of Agriculture to manage such Areas to maintain their roadless character. Authorizes the Forest Service to modify such maps for the sole purpose of improving their accuracy or inclusiveness. Requires any substantial modification of those maps to be made through the national forest management planning process and documented in an environmental impact statement.

Condemns the gross human rights violations committed by the Cuban regime. Expresses support for the right of the Cuban people to exercise fundamental political and civil liberties. Calls on: (1) the Secretary of State to initiate an international solidarity campaign on behalf of all Cuban political prisoners; (2) the European Union (EU) to reexamine its current policy toward the Cuban regime before June of 2006; and (3) the U.S. Permanent Representative to the United Nations, and other international organizations, to work with United Nations Commission on Human Rights (UNCHR) member countries to ensure a resolution that strongly condemns the July 2005 measures of repression on opposition activists and of all the human rights violations committed by the Cuban regime.

Stolen Valor Act of 2005 - Amends the federal criminal code to expand the prohibition against wearing, manufacturing, or selling military decorations or medals without legal authorization to prohibit purchasing, soliciting, mailing, shipping, importing, exporting, producing blank certificates of receipt for, advertising, or exchanging such decorations or medals without authorization. Prohibits falsely representing oneself as having been awarded any decoration or medal authorized by Congress for the Armed Forces or any of the service medals or badges. Increases penalties for violations if the offense involves a Distinguished Service Cross, an Air Force Cross, a Navy Cross, a silver star, or a Purple Heart.

Lupus Research, Education, Awareness, Communication, and Healthcare Amendments of 2005 - Amends the Public Health Service Act to require the Director of the National Institute of Arthritis and Musculoskeletal and Skin Diseases to expand research on lupus to include: (1) basic research to discover the pathogenesis and pathophysiology of the disease; and (2) research to validate lupus biomarkers. Requires the Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention (CDC), to work with a consortium of academic health institutions to undertake an epidemiological study to determine the prevalence and incidence of lupus in the United States. Requires the Director of CDC to: (1) enter into a cooperative agreement with such consortium to develop, implement, and manage a system for lupus data collection and analysis; and (2) ensure that such consortium represents different geographic areas and includes individuals of racial and ethnic backgrounds disproportionately affected by lupus. Requires the Secretary to enter into a contract with the Institute of Medicine to study and make recommendations related to lupus, to include: (1) evaluating federal and state activities related to lupus and recommending ways to expand such activities; (2) identifying gaps in federal research; and (3) recommending ways to improve the quality of life for people with lupus. Requires the Secretary, acting through the Director of the Office on Women's Health, to conduct and support a national lupus public awareness and health professional education campaign, with an emphasis on reaching populations at highest risk for the disease.

Commends: (1) the Philadelphia Coalition's commitment to active integration and inclusion of all races, genders, and ethnicities in the face of a crime that arose from intolerance and exclusion (the 1964 murder of three civil rights workers by Edgar Ray Killen and other Ku Klux Klansmen); (2) the Coalition for proving that it is never too late for justice to be served; and (3) the commitment and determination of Coalition members to come together for the common aims of justice, dialogue, and progress in the face of adversity.

Secure Transit and Rail Across America and Invest in National Security Act of 2005, or the Secure Trains Act - Directs the Secretary of Homeland Security to: (1) submit to Congress the National Strategy for Transportation Security within 30 days after enactment of this Act; and (2) develop certain supplemental requirements, including prioritized recommendations for improving public transportation and railroad security. Authorizes the Secretary to make grants to improve the security of public transportation systems against acts of terrorism. Directs the Secretary to: (1) report to owners, operators, and providers of public transportation systems and specified others on best practices for the security of public transportation systems; (2) develop a national plan for public outreach and awareness of measures the public can take to increase such security; and (3) establish National Transportation Security Centers at institutions of higher education. Sets forth certain whistleblower protections for Department of Homeland Security employees and federal contractors or subcontractors who provided information or otherwise assisted in an investigation of violations of any law or regulation related to national or homeland security, filed or participated in a proceeding related to such violation, or refused to violate or assist in the violation. Sets forth civil and criminal penalties for violations of such protections. Authorizes the Secretary to make grants for freight and passenger rail (including hazardous materials transportation) security upgrades. Authorizes appropriations for Amtrak for certain fire and life-safety improvements to specified tunnels along the Northeast Corridor. Establishes a research and development (R&D) program to improve railroad security. Requires the Secretary to issue guidelines for a rail worker security training program. Sets forth certain whistleblower protections for rail employees or other persons providing information about perceived security threats. Directs the Secretary to: (1) analyze the cost and feasibility of requiring security screening for passengers, baggage, and cargo on passenger trains; (2) issue certain emergency responder training standards; and (3) provide grants to the Operation Respond Institute.

Domestic Partnership Benefits and Obligations Act - Entitles domestic partners of federal employees to benefits available to spouses of federal employees. Specifies certifications required for benefit eligibility, filing requirements regarding partnership dissolution, and confidentiality requirements. Amends the Internal Revenue Code to extend the tax exemption for employer contributions to accident and health plans to domestic partners under this Act.
