For Accurate Import Relief To Aid Retailers and Importers of Foreign Freights Act of 2023 or the FAIR TARIFF Act of 2023 This bill provides for the liquidation or reliquidation of certain entries of products (e.g., wine, spirits, and food) of European Union countries imported into the United States during specified time periods. A request for liquidation or reliquidation must be filed with U.S. Customs and Border Protection (CBP). A request must contain sufficient information for CBP to (1) locate the entry or, if the entry cannot be located, reconstruct the entry; and (2) verify the eligibility of the request. Further, CBP must develop and make publicly available an application process for requesting these refunds. The bill also requires the U.S. Trade Representative to provide advance notice with respect to certain increases in tariff rates.

Pay Less at the Pump Act

Pay Less at the Pump Act This bill eliminates the excise tax on domestic crude oil and imported petroleum products (known as the petroleum Superfund tax rate) beginning on January 1, 2023. The bill also eliminates the authority for advances to the Hazardous Substance Superfund from the General Fund of the Treasury. Under current law, the petroleum Superfund tax rate imposed is 16.4 cents per barrel (indexed annually for inflation). Amounts collected from this tax are deposited into the Hazardous Substance Superfund, which finances the remediation of certain environmentally contaminated sites. Further, under current law, the authority for advances to be appropriated to the Hazardous Substance Superfund extends through 2032.

Defending American Jobs and Investment Act

Defending American Jobs and Investment Act This bill provides for the enforcement of remedies against foreign countries that have extraterritorial or discriminatory taxes. Specifically, the bill requires the Department of the Treasury to periodically submit a report to Congress that lists each foreign country that has one or more extraterritorial or discriminatory taxes. Treasury must commence enhanced bilateral engagement with each foreign country included in the report. This engagement must (1) express the concern of the United States with respect to the adverse trade and economic effects of tax policies that violate bilateral tax treaties and international tax norms, (2) urge the repeal of extraterritorial and discriminatory taxes that target U.S. persons, and (3) advise the foreign country of remedial actions (as outlined by this bill). The bill increases income tax and withholding tax rates on certain foreign citizens, corporations, and partnerships of any foreign country listed in Treasury's report. The bill provides the executive branch with additional tools to enforce against extraterritorial and discriminatory taxes. These tools include authorizing the President to prohibit government contracting or procurement of goods or services from a foreign country listed in Treasury's report, directing Treasury to consider these taxes in assessing whether to enter into or update a bilateral tax treaty with the foreign country, and requiring the U.S. Trade Representative and the Department of Commerce to consider these taxes in assessing whether to enter into any free trade agreement or executive agreement with the foreign country.

Financing Our Energy Future Act This bill expands the types of partnerships that qualify for treatment as publicly traded partnerships instead of as corporations for tax purposes. Under current law, partnerships that meet certain gross income requirements (i.e., at least 90% of the partnership's gross income in a taxable year consists of qualifying income) are excepted from being treated as a corporation for tax purposes. This bill expands the sources of income that are considered qualifying income and make a partnership eligible for such an exception. Specifically, the bill provides that income derived from the generation of specified alternative energy, alternative fuel projects, or the associated property, storage, or transportation for such projects (e.g., the conversion of renewable biomass into renewable fuel or the storage or transportation of such fuel) is considered qualifying income.

Mountain Valley Pipeline Completion Act This bill establishes requirements to expedite the completion of the Mountain Valley Pipeline, which is a natural gas pipeline located in Virginia and West Virginia. Specifically, the bill ratifies and approves all authorizations, permits, verifications, extensions, biological opinions, incidental take statements, and any other approvals or orders issued pursuant to federal law related to the Mountain Valley Pipeline. In addition, the bill establishes a deadline by which the U.S. Army Corps of Engineers must issue permits or verifications necessary to complete the construction of the pipeline across the waters of the United States and to allow for the operation and maintenance of the pipeline, the Forest Service must amend the Land and Resource Management Plan for the Jefferson National Forest as specified by the bill, and the Department of Interior must grant specified rights-of-way and temporary use permits. Finally, the bill prohibits judicial review of certain approvals related to the pipeline.

The bill expands the battlefield acquisition grant program to allow grants to be (1) awarded to Indian tribes and nonprofit organizations, and (2) awarded to acquire certain Revolutionary War or War of 1812 battlefields. The bill expands eligibility for the battlefield restoration grant program to include battlefield land that is owned by a state, tribe, local government, or nonprofit organization. Not later than 2 years after this bill's enactment and every 10 years thereafter, the American Battlefield Protection Program must report to Congress on preservation activities and the condition of battlefields.

Specifically, the bill modifies requirements relating to molecularly targeted pediatric cancer investigations so as to authorize investigations of new drugs that are used in combination with active ingredients that have already been approved and that (1) have been determined to be the standard of care for treating a pediatric cancer, or (2) have been approved to treat an adult cancer and are directed at molecular targets for pediatric cancer. The Food and Drug Administration must issue guidance and report on the bill's implementation. The Government Accountability Office must report on the effectiveness of the bill's changes with respect to the development of pediatric cancer drugs.

Community College Agriculture Advancement Act of 2023

Community College Agriculture Advancement Act of 2023 This bill authorizes the Department of Agriculture (USDA) to make competitive grants to assist eligible entities in maintaining and expanding their capacity to conduct workforce training, education, research, and outreach activities related to agriculture and similar disciplines. An eligible entity includes a junior or community college, or a consortium or alliance of two-year public colleges, supporting agriculture advancement. In awarding grants, USDA must give priority to entities coordinating with a local agriculture industry operator to provide experiential training and other opportunities for students. Grant funds may be used to expand and maintain the capacity of the eligible entity, including through the purchase or other acquisition of equipment and other infrastructure, the professional growth and development of faculty, and the development of apprenticeships and other work-based learning opportunities. An eligible entity may submit to USDA an application for designation and funding as a Center of Excellence for Agriculture Advancement. Funding received as a result of such a designation must be used to demonstrate agriculture best practices and to provide leadership in capacity building at a regional or national level.

AM Radio for Every Vehicle Act of 2023

AM Radio for Every Vehicle Act of 2023 This bill requires the Department of Transportation (DOT) to issue a rule that requires all new motor vehicles to have devices that can access AM broadcast stations installed as standard equipment. (AM broadcast stations are often used to deliver emergency alerts and news and entertainment programming; some newer vehicles do not include AM equipment.) Specifically, this bill applies to motor vehicles manufactured in the United States, imported into the United States, or shipped in interstate commerce after the rule's effective date. The DOT rule must require all such vehicles to have devices that can receive signals and play content transmitted by AM broadcast stations or digital audio AM broadcast stations installed as standard equipment. Prior to the effective date of the rule, manufacturers that do not include devices that can access AM broadcast stations as standard equipment must inform purchasers of this fact through clear and conspicuous labeling. DOT may assess civil penalties against any manufacturer that fails to comply with the mandate. The Department of Justice may also bring a civil action to enjoin a violation. Further, the Government Accountability Office must study and report on whether a reliable alternative communication system exists for delivering emergency alerts and consider the (1) cost to drivers and passengers of receiving communications through an alternative system, and (2) cost and time required to develop and implement an alternative.

Veteran Entrepreneurs Act of 2023 This bill allows a business-related tax credit of 25% of up to $400,000 of the franchise fees paid or incurred by an eligible veteran for the purchase of a franchise. The bill reduces the amount of such credit if the veteran does not own 100% of the stock or capital or profits interest of the franchisee. An eligible veteran is a person who served in the active military, naval, or air service; was discharged or released under conditions other than dishonorable; and who pays or incurs a franchise fee in connection with a franchise agreement with a franchisor. The veteran may elect to transfer the credit to an eligible franchisor in exchange for a discount in the franchise fee commensurate with the value of the credit. The Small Business Administration and the Department of Veterans Affairs must provide information about the tax credit allowed by this bill to veterans service organizations and veteran advocacy groups.

Affordable Housing Credit Improvement Act of 2023 This bill revises provisions of the low-income housing tax credit and renames it as the affordable housing tax credit . The bill increases the per capita dollar amount of the credit and its minimum ceiling amount beginning in 2023 and extends the inflation adjustment for such amounts. The bill modifies tenant income eligibility requirements and the average income formula for determining such income. It also revises rules for student occupancy of rental units and tenant voucher payments, and prohibits any refusal to rent to victims of domestic abuse. The bill further modifies the credit to increase state allocations of the credit; repeal the qualified census tract population cap; prohibit consideration of local approval and local government contribution requirements for housing projects; increase the credit for certain projects designated to serve extremely low-income households; increase the credit for certain bond-financed projects designated by state agencies; eliminate the basis reduction for properties that receive certain energy-related tax benefits; and increase the population cap for difficult development areas (i.e., areas with high construction, land, and utility costs relative to area median gross income). The bill also includes Indian and rural areas as difficult development areas and modifies other requirements relating to casualty losses, tax-exempt bond financing, and foreclosures.

Fight CRIME Act

Fight and Combat Rampant Iranian Missile Exports Act or the Fight CRIME Act This bill imposes sanctions pertaining to Iran's missile program. The President must impose visa- and property-blocking sanctions on foreign persons (i.e., foreign individuals, entities, and states) that are knowingly involved with Iran or Iran-aligned entities in certain missile-related activities, such as (1) acquiring, possessing, developing, transporting, transferring, or deploying missiles or related items and technology that are covered by the Missile Technology Control Regime (MTCR), or (2) developing missile or drone technologies. (The MTCR is an informal political understanding among states that seek to limit missile proliferation.) The President must also impose sanctions on (1) certain adult family members of those who are subject to the sanctions discussed above, and (2) foreign persons who knowingly provide significant support to or engage in a significant transaction with those subject to the sanctions discussed above. The bill also requires the Department of State to report to Congress on various topics, including (1) a diplomatic strategy to renew international restrictions on certain missile-related activities set forth in Annex B of U.N. Security Council Resolution 2231, which concerns restrictions on arms transfers to and from Iran; (2) the identities of foreign persons engaging in restricted activity under Annex B; and (3) an analysis of the foreign and domestic supply chains that facilitate Iran's missile or drone programs.

Federal Prison Oversight Act This bill establishes an inspections regime for the Bureau of Prisons (BOP). The Department of Justice (DOJ) Office of the Inspector General must conduct risk-based evaluations of BOP facilities. An inspection of a facility may be announced or unannounced. Higher risk facilities must receive more frequent inspections. The bill (1) provides for the establishment in DOJ of an Ombudsman who may receive complaints, make inquiries, and recommend actions, and decline to investigate or take action, as specified; and (2) prohibits BOP retaliation against any person or entity that has instituted or caused to be instituted any proceeding, investigation, or inspection under this bill. The ombudsman shall coordinate with the BOP to educate incarcerated people, their representatives, and the public about the existence and functions of the ombudsman.

IGO Anti-Boycott Act

IGO Anti-Boycott Act This bill penalizes U.S. persons (individuals or entities) that participate in certain boycotts imposed by international governmental organizations (IGOs). The bill expands an existing law that prohibits various actions by U.S. persons in relation to boycotts imposed by foreign governments on a country that is friendly to the United States and not itself the object of a U.S. boycott. This bill applies those prohibitions to similar boycotts imposed by IGOs. Prohibited actions include (1) refusing to do business with companies organized under the laws of the boycotted country, if the refusal is pursuant to an agreement with or request from the country or IGO imposing the boycott; (2) furnishing information about whether any person has a business relationship with or in the boycotted country; and (3) furnishing information about whether someone is associated with charitable or fraternal organizations that support the boycotted country. Criminal penalties for willful violations of this law include fines of up to $1 million. In addition to such fines, individuals may be imprisoned for up to 20 years. Civil penalties may include fines and revocations of export licenses for certain national security-related items.

The bill defines catastrophic risk transfer company as any domestic corporation created and regulated under state law with the purpose of entering into one or more insurance or reinsurance agreements covering catastrophic risk.

Living Donor Protection Act of 2023 This bill prohibits certain insurance carriers from discriminating against, and provides other protections for, living organ donors. Specifically, carriers may not deny, cancel, or otherwise impose conditions on policies for life insurance, disability insurance, or long-term care insurance based on an individual's status as a living organ donor. The bill also expressly specifies that recovery from organ-donation surgery constitutes a serious health condition that entitles eligible employees to job-protected medical leave. In addition, the Department of Health and Human Services must update educational materials on living organ donation to include information about the benefits of living organ donation and about access to insurance for living organ donors.

Stop Institutional Child Abuse Act This bill establishes an interagency Federal Work Group on Youth Residential Programs to support and implement best practices regarding the health and safety, care, treatment, and appropriate placement of youth in youth residential programs. The work group must develop recommendations about a national database to aggregate information about processes and outcomes for youth in such programs. The work group also must support the education and training of professional and paraprofessional personnel in fields that service such youth. Further, the Department of Health and Human Services must contract with the National Academies of Sciences, Engineering, and Medicine to study and make recommendations about various aspects of federal and state oversight of youth residential programs.

Protecting Patients Against PBM Abuses Act This bill establishes requirements for Medicare pharmacy benefit managers (PBMs) with respect to remuneration, payments, and fees. Specifically, the bill restricts PBMs that are under contract with plans under the Medicare prescription drug benefit or Medicare Advantage from (1) receiving income for their services other than flat dollar amount service fees; (2) basing any service fees on the prices of covered drugs or any associated discounts, rebates, or other remuneration; (3) charging plan sponsors for ingredient costs or dispensing fees in amounts that are different than what is reimbursed to the pharmacy; or (4) reimbursing network pharmacies for less than that what is reimbursed to PBM-affiliated pharmacies. Such PBMs must also report on the difference between certain costs for drugs on the plan's formulary and those that are not on the formulary but are therapeutically equivalent. PBMs must also report certain information regarding rebates and fees they receive from drug manufacturers; the Centers for Medicare & Medicaid Services must publish this and other information that is currently reported by PBMs online.

Processing Revival and Intrastate Meat Exemption Act or the PRIME Act This bill exempts from federal inspection requirements animals and meats that are slaughtered and prepared at custom animal slaughter facilities for distribution within the state. Under current law, a custom slaughter exemption applies if the meat is slaughtered exclusively for personal, household, guest, or employee uses. Specifically, the bill expands the federal inspection exemption to include the slaughter of animals or the preparation of carcasses, meat, and meat food products that are slaughtered and prepared at a custom slaughter facility in accordance with the laws of the state where the facility is located; and prepared exclusively for distribution to household consumers in the state or restaurants, hotels, boarding houses, grocery stores, or other establishments in the state that either prepare meals served directly to consumers or offer meat and food products for sale directly to consumers in the state. The bill does not preempt any state law concerning (1) the slaughter of animals or the preparation of carcasses, meat, and meat food products at a custom slaughter facility; or (2) the sale of meat or meat food products.

Accelerating Individuals into the Workforce Act This bill requires the Administration for Children and Families (ACF) to make grants to states for demonstration projects that provide wage subsidies to enable low-income individuals to enter and retain employment. States may use grant funds to subsidize an individual's wages for up to 12 months. The subsidy may be up to 50% of an individual's wages. Individuals are eligible for subsidized wages if they (1) are recipients of Temporary Assistance for Needy Families or similar state assistance or a noncustodial parent of a child receiving such assistance, and (2) are unemployed when the subsidy begins or have an income below 200% of the poverty line. States must ensure that participants in subsidized job programs do not displace current workers. The ACF must reserve funding to carry out this bill from amounts in the Contingency Fund for State Welfare Programs.

Fair Access to Banking Act

Fair Access to Banking Act This bill places restrictions on certain banks, credit unions, and payment card networks if they refuse to do business with a person who complies with the law. Restrictions include prohibiting the use of electronic funds transfer systems and lending programs, termination of an institution's depository insurance, and specified civil penalties. Banks and other specified financial institutions are allowed to deny financial services to a person only if the denial is justified by a documented failure of that person to meet quantitative, impartial, risk-based standards established in advance by the institution. This justification may not be based upon reputational risks to the institution. Banks may also deny services to a person who engaged in rude or harassing conduct toward an employee of the bank. The bill establishes the right for a person to bring a civil action for a violation of this bill.

MADE in America Act

Manufacturing API, Drugs, and Excipients in America Act or the MADE in America Act This bill establishes a tax credit for certain manufacturers of pharmaceuticals or medical products. Specifically, the bill establishes a tax credit for manufacturers of pharmaceuticals, active pharmaceutical ingredients, excipients (i.e., inactive ingredients), medical diagnostic devices, or personal protective equipment, if they are located in a designated distressed zone. The tax credit is equal to 25% of the manufacturer's production expenditures; the credit increases to 30% of expenditures if a substantial portion of the manufacturer's employees reside in a distressed zone. The bill defines distressed zone as an area that has been designated as a qualified opportunity zone by the Internal Revenue Service (i.e., an economically distressed community in which certain new investments may be eligible for preferential tax treatment) and that has a poverty rate of over 30%.

Fighting Trade Cheats Act of 2023

Fighting Trade Cheats Act of 2023 This bill increases penalties for, and establishes additional enforcement mechanisms related to, fraudulent and grossly negligent violations of U.S. customs laws. Specifically, the bill increases the maximum civil penalty for a fraudulent violation to three times the domestic value of the merchandise. Further, the bill prohibits a person who commits a fraudulent violation from importing merchandise into the United States for a five-year period. Additionally, the bill increases the maximum civil penalty for a grossly negligent violation to the lesser of (1) 3 times the domestic value of the merchandise; or (2) 10 times the lawful duties, taxes, and fees. It also prohibits a person who commits a grossly negligent violation from importing merchandise into the United States for a two-year period. Further, the bill applies these importation bans to an affiliated person (e.g., a family member, partner, or employee) of the person who committed the fraudulent or grossly negligent violation. The bill also establishes a private right of action for customs fraud or grossly negligent violations. In particular, the bill allows manufacturers, producers, wholesalers, labor unions, or trade associations to bring a civil action against a violator or any person that aids or abets a violator. The bill prohibits any person (or an affiliated person) who commits a fraudulent or grossly negligent violation from participating in the U.S. Customs and Border Protection's Importer of Record program, and further requires their importer of record numbers to be revoked.

Mining Schools Act of 2024

In addition, the bill repeals the Mining and Mineral Resources Research Institute Act of 1984.

Safe Step Act

Safe Step Act This bill requires a group health plan to establish an exception to medication step-therapy protocol in specified cases. A medication step-therapy protocol establishes a specific sequence in which prescription drugs are covered by a group health plan or a health insurance issuer.  A request for such an exception to the protocol must be granted if (1) an otherwise required treatment has been ineffective, (2) such treatment is expected to be ineffective and delaying effective treatment would lead to irreversible consequences, (3) such treatment will cause or is likely to cause an adverse reaction to the individual, (4) such treatment is expected to prevent the individual from performing daily activities or occupational responsibilities, (5) the individual is stable based on the prescription drugs already selected, or (6) there are other circumstances as determined by the Employee Benefits Security Administration. The bill requires a group health plan to implement and make readily available a clear process for an individual to request an exception to the protocol, including required information and criteria for granting an exception. The bill further specifies timelines under which plans must respond to such requests.

Federal Firearms Licensee Protection Act of 2023 This bill modifies criminal penalties for an offense involving the theft of a firearm from a licensed importer, manufacturer, or dealer, or from their business premises. Specifically, the bill does the following: increases from 10 to 20 years the maximum prison term, and creates a 3- or 5-year mandatory minimum prison term for an offense that occurs during the commission of a burglary or robbery. An attempt to commit an offense is subject to the same penalties as a substantive offense.
