This joint resolution nullifies the Environmental Protection Agency rule relating to Federal "Good Neighbor Plan" for the 2015 Ozone National Ambient Air Quality Standards (88 Fed. Reg. 36654) and published on June 5, 2023. The rule ensures that 23 states meet "Good Neighbor" standards required by the Clean Air Act by reducing pollution that significantly contributes to problems attaining and maintaining health-based air quality standards for ground-level ozone in downwind states.

Leveling the Playing Field 2.0 Act This bill addresses unfair trade practices by making various changes to U.S. antidumping and countervailing duty law. Antidumping provides relief to U.S industries and workers that are materially injured or threatened with injury due to imports of like products sold in the U.S. market at less than fair value, while countervailing duty provides such relief from imports of products subsidized by a foreign government or public entity. Specifically, the bill establishes a process for successive antidumping and countervailing duty investigations. Successive investigations may be concurrent (an ongoing investigation of the same product) or recently completed (not more than two years before the date of the initiation of the successive investigation). Further, the bill establishes a time line for the Department of Commerce to issue determinations in successive investigations. Among other provisions, the bill authorizes Commerce to apply countervailing duty law to subsidies provided by a foreign government or public entity to a company operating in a third country, use another method for calculating the cost of production in specific circumstances, and require importers to provide a certification that the imported merchandise is not subject to an antidumping or countervailing duty order. Additionally, the bill statutorily establishes procedures for Commerce to conduct circumvention inquiries, including by specifying the deadlines for preliminary and final determinations. The bill also provides statutory authority for Commerce to investigate currency undervaluation as a countervailable subsidy.

Children's Hospital GME Support Reauthorization Act of 2023 This bill reauthorizes through FY2028 the Children's Hospital Graduate Medical Education Payment program, which supports education and training for medical residents and fellows in children's hospitals. The bill also bars children's hospitals that provide gender-affirming care to minors from receiving payments through the program. Under the bill, gender-affirming care generally includes procedures (e.g., surgeries or hormone therapies) that change the body of an individual to correspond to a sex that is different than the individual's biological sex. It excludes, however, specified types of procedures, including those for treating (1) individuals who have both ovarian and testicular tissue or abnormal sex chromosome structure or hormones, or (2) infections or other harms that result from a previous gender-transition procedure.

This joint resolution nullifies the final rule issued by the Consumer Financial Protection Bureau titled Small Business Lending under the Equal Credit Opportunity Act (Regulation B) and published on May 31, 2023. The rule requires financial institutions to collect and report to the bureau credit application data for small businesses. On July 31, 2023, the U.S. District Court for the Southern District of Texas ordered the bureau not to implement or enforce the rule until a related pending case is resolved.

Stop Harboring Iranian Petroleum Act or the SHIP Act This bill requires the President to impose visa- and property-blocking sanctions against foreign persons that knowingly transport, process, refine, or otherwise deal in petroleum and petroleum products originating in Iran. These sanctions also extend to certain foreign persons associated with the sanctioned individual, such as adult family members and any entities owned or controlled by the sanctioned individual.

Stop Anti-Semitism on College Campuses Act This bill prohibits an institution of higher education (IHE) that participates in federal student aid programs from authorizing, facilitating, providing funding for, or otherwise supporting any event that promotes anti-Semitism on the IHE's campus.

Rural Health Clinic Burden Reduction Act This bill makes a series of changes to requirements that apply to rural health clinics under Medicare. For example, the bill allows rural health clinics that are not directed by physicians to enter into arrangements with physician assistants or nurse practitioners that generally comply with state laws (regarding scope of practice), rather than other specific requirements. It also specifies that rural health clinics (1) need only have prompt access to clinical laboratory services (as opposed to having to directly provide these services); (2) must be located in a non-urban area with a population that is less than 50,000; (3) may contract with (as opposed to employ) physician assistants or nurse practitioners; and (4) may primarily provide mental health services if located in a designated mental health professional shortage area.

National POW/MIA Memorial and Museum Act This bill designates the memorial and museum that is being constructed on an approximately 26-acre area on the POW-MIA Memorial Parkway in Jacksonville, Florida, as the National POW/MIA Memorial and Museum. The director of the memorial and museum shall submit a report to Congress that includes a budget for the memorial and museum.

Beautifying Federal Civic Architecture Act This bill declares U.S. policy applicable to public buildings and establishes the President's Council on Improving Federal Civic Architecture. The policy includes that applicable federal public buildings should uplift and beautify public spaces, command respect from the general public, be visually identifiable as civic buildings, respect regional architectural heritage, and meet other specified criteria; in the District of Columbia, classical architecture is the preferred and default architecture for federal public buildings absent exceptional factors; buildings that do not meet specified criteria should be considered for redesign where feasible and economical, particularly with respect to the exterior of the applicable federal building; and the General Services Administration (GSA) should seek input from future users of the applicable federal public buildings and the general public in the community where such buildings will be located before selecting an architectural firm or design style and give the general public's input substantial consideration. The GSA must adhere to the policy. If the GSA proposes to approve a design for a new applicable federal public building that diverges from the preferred architecture, it must notify the Office of the Domestic Policy Advisor and Congress not later than 30 days before the date on which the GSA could reject the design without incurring substantial expenditures and describe the reasons for proposing to approve the design.

Middle Class Borrower Protection Act of 2023 This bill rolls back changes made by the Federal Housing Finance Agency (FHFA) to the fees charged by Fannie Mae and Freddie Mac for a conventional single-family mortgage (i.e., loan-level pricing adjustments) and restricts future fee adjustments. These changes, effective May 1, 2023, revised the fee charts that provide percentage adjustments based on a mortgagor's credit score and down payment. The bill reinstates the fee structure that was in place prior to May 1, 2023. The Government Accountability Office (GAO) must report on the changes made by the FHFA. Further adjustments to the fee structure by FHFA are prohibited until 90 days after the publication of the GAO report. After this period, FHFA must follow Administrative Procedure Act requirements when proposing adjustments to the fee structure. The bill also requires that, to the greatest extent feasible, revisions to the fee schedule must be based on risk. Further, FHFA, Fannie Mae, and Freddie Mac are prohibited from imposing any loan-level pricing adjustment fee that is based on the ratio of the debt of the mortgagor to the income of the mortgagor.

Mountain Valley Pipeline Completion Act This bill establishes requirements to expedite the completion of the Mountain Valley Pipeline, which is a natural gas pipeline located in Virginia and West Virginia. Specifically, the bill ratifies and approves all authorizations, permits, verifications, extensions, biological opinions, incidental take statements, and any other approvals or orders issued pursuant to federal law related to the Mountain Valley Pipeline. In addition, the bill establishes a deadline by which the U.S. Army Corps of Engineers must issue permits or verifications necessary to complete the construction of the pipeline across the waters of the United States and to allow for the operation and maintenance of the pipeline, the Forest Service must amend the Land and Resource Management Plan for the Jefferson National Forest as specified by the bill, and the Department of Interior must grant specified rights-of-way and temporary use permits. Finally, the bill prohibits judicial review of certain approvals related to the pipeline.

Saving America's Future by Educating Kids Act of 2023 This bill directs the Department of Education (ED) to develop and support implementation of an evidence-based, K-12 curriculum on the dangers of substances of misuse, including opioids, vaping, and synthetic drugs. ED must review and update the curriculum every two years. ED must award grants to state educational agencies to implement the evidence-based curriculum. In awarding these grants, ED must give priority to those states that have experienced the highest drug overdose death rates.

Reinstate Our Troops Act This bill addresses the reinstatement of members of the Armed Forces who requested an exemption from an order to receive a COVID-19 vaccination and were involuntarily separated solely on the basis of the refusal to receive such vaccination. Specifically, at the election of the separated individual, the bill requires the military department concerned to reinstate the individual, in the same rank and grade the individual held at the time of separation. An individual must elect to be reinstated within the one-year period following the enactment of this bill. Additionally, such individuals (enlisted members and officers) are not required to repay a bonus for failure to complete a period of service solely because such service was incomplete due to the exemption request and involuntary separation. The military department concerned must return a bonus repaid by an individual if the individual elects to be reinstated. If an individual does not elect reinstatement, the military department concerned must ensure the discharge of the individual is characterized as honorable. The military department concerned must also expunge from an individual's military service record any reference to adverse action related to the refusal to receive a COVID-19 vaccination.

Protecting Rural Telehealth Access Act This bill expands coverage of telehealth services under Medicare. Specifically, the bill permanently (1) removes geographic restrictions on originating sites (i.e., the location of the beneficiary), (2) allows the home of the beneficiary to serve as the originating site for all services, (3) allows federally qualified health centers and rural health clinics to serve as the distant site (i.e., the location of the health care practitioner), and (4) expands coverage to include audio-only services for evaluation and management and behavioral health services.

American Battlefield Protection Program Enhancement Act This bill expands the National Park Service's American Battlefield Protection Program. The bill expands the battlefield acquisition grant program to allow grants to be (1) awarded to Indian tribes and nonprofit organizations, and (2) awarded to acquire certain Revolutionary War or War of 1812 battlefields. The bill expands eligibility for the battlefield restoration grant program to include battlefield land that is owned by a state, tribe, local government, or nonprofit organization. Not later than 2 years after this bill's enactment and every 10 years thereafter, the American Battlefield Protection Program must report to Congress on preservation activities and the condition of battlefields.

Give Kids a Chance Act of 2023 This bill authorizes certain targeted clinical trials involving combinations of drugs to treat pediatric cancer. Specifically, the bill modifies requirements relating to molecularly targeted pediatric cancer investigations so as to authorize investigations of new drugs that are used in combination with active ingredients that have already been approved and that (1) have been determined to be the standard of care for treating a pediatric cancer, or (2) have been approved to treat an adult cancer and are directed at molecular targets for pediatric cancer. The Food and Drug Administration must issue guidance and report on the bill's implementation. The Government Accountability Office must report on the effectiveness of the bill's changes with respect to the development of pediatric cancer drugs.

AM Radio for Every Vehicle Act of 2023 This bill requires the Department of Transportation (DOT) to issue a rule that requires all new motor vehicles to have devices that can access AM broadcast stations installed as standard equipment. (AM broadcast stations are often used to deliver emergency alerts and news and entertainment programming; some newer vehicles do not include AM equipment.) Specifically, this bill applies to motor vehicles manufactured in the United States, imported into the United States, or shipped in interstate commerce after the rule's effective date. The DOT rule must require all such vehicles to have devices that can receive signals and play content transmitted by AM broadcast stations or digital audio AM broadcast stations installed as standard equipment. Prior to the effective date of the rule, manufacturers that do not include devices that can access AM broadcast stations as standard equipment must inform purchasers of this fact through clear and conspicuous labeling. DOT may assess civil penalties against any manufacturer that fails to comply with the mandate. The Department of Justice may also bring a civil action to enjoin a violation. Further, the Government Accountability Office must study and report on whether a reliable alternative communication system exists for delivering emergency alerts and consider the (1) cost to drivers and passengers of receiving communications through an alternative system, and (2) cost and time required to develop and implement an alternative.

Stop TSP ESG Act This bill prohibits a qualified professional asset manager from exercising voting rights associated with the ownership of securities by the Thrift Savings Fund. Under current law, the term qualified professional asset manager includes certain banks, savings and loan associations, insurance companies, and investment advisers.

Gabriella Miller Kids First Research Act 2.0 This bill reauthorizes through FY2028 a pediatric disease research initiative within the National Institutes of Health (NIH) and requires the NIH to coordinate pediatric research activities to avoid duplicative efforts. Additionally, the Department of Health and Human Services must report to Congress about research funded through the initiative.

National Law Enforcement Officers Remembrance, Support and Community Outreach Act This bill directs the Department of Justice (DOJ) to establish a National Law Enforcement Officers Remembrance, Support, and Community Outreach Program. The bill further directs DOJ to award a grant under the program to the National Law Enforcement Officers Memorial Fund for the expenses associated with community outreach, public education, and officer safety and wellness programs operated by the of the National Law Enforcement Officers Memorial Fund and National Law Enforcement Museum.

Protecting Children From Experimentation Act of 2023 This bill establishes a new federal criminal offense for health care professionals who perform or provide referrals for gender transition procedures on minors. A physical or mental health care professional who performs or provides a referral for a gender transition procedure on a minor is subject to criminal penalties—a fine, a prison term of up to five years, or both. The bill authorizes civil remedies for a minor who undergoes a gender transition procedure. A minor who undergoes a gender transition procedure may not be arrested or prosecuted for an offense under this bill.

Senior Citizens Tax Elimination Act This bill repeals the inclusion of any Social Security or tier I railroad retirement benefits in gross income for income tax purposes. The bill also (1) appropriates funds to cover reductions in transfers to the Social Security and Railroad Retirement Trust Funds resulting from the enactment of this bill, and (2) expresses the sense of Congress against using tax increases to provide revenue necessary to carry out this bill.

Assad Regime Anti-Normalization Act of 2023 This bill prohibits federal officials or employees from taking any action to recognize a Syrian government led by Bashar al-Assad. The bill also expands existing sanctions related to the Syrian conflict to cover additional activities and persons (individuals and entities). Current law requires the President to impose visa- and property-blocking sanctions on foreign persons engaged in certain activities related to the conflict in Syria. For example, such sanctions must be imposed on those that knowingly (1) are responsible for serious human rights abuses against the Syrian people, or (2) provide aircraft or spare aircraft parts for military purposes on behalf of the Syrian government to a foreign person operating in certain areas of Syria. This bill expands the types of activities that would subject a foreign person to sanctions, including knowingly (1) providing any type of aircraft or spare aircraft parts to the Syrian government, (2) diverting humanitarian assistance intended for the Syrian people, or (3) confiscating property in Syria or owned by a Syrian citizen for personal gain or political purposes. The bill also extends these sanctions to entities owned or controlled by a sanctioned person and to a sanctioned person's adult family members. Additionally, the bill removes an exception to the sanctions related to the importation of goods. The Department of State must provide Congress with a strategy to counter foreign government efforts to normalize relations with the Bashar al-Assad regime.

Peace and Tolerance in Palestinian Education Act This bill requires the Department of State to report on the curriculum (including textbooks, leaflets, pamphlets, magazines, and other instructional materials) used in schools in areas controlled by the Palestinian Authority or located in Gaza and controlled by any other entity. Among other topics, the report must address (1) whether the materials used encourage violence or intolerance toward other nations or ethnic groups, (2) the steps the Palestinian Authority is taking to reform such materials, and (3) whether U.S. foreign assistance is used to fund the dissemination of the offending materials. The State Department must make such reports publicly available.

Affordable Housing Credit Improvement Act of 2023 This bill revises provisions of the low-income housing tax credit and renames it as the affordable housing tax credit . The bill increases the per capita dollar amount of the credit and its minimum ceiling amount beginning in 2023 and extends the inflation adjustment for such amounts. The bill modifies tenant income eligibility requirements and the average income formula for determining such income. It also revises rules for student occupancy of rental units and tenant voucher payments, and prohibits any refusal to rent to victims of domestic abuse. The bill further modifies the credit to increase state allocations of the credit; repeal the qualified census tract population cap; prohibit consideration of local approval and local government contribution requirements for housing projects; increase the credit for certain projects designated to serve extremely low-income households; increase the credit for certain bond-financed projects designated by state agencies; eliminate the basis reduction for properties that receive certain energy-related tax benefits; and increase the population cap for difficult development areas (i.e., areas with high construction, land, and utility costs relative to area median gross income). The bill also includes Indian and rural areas as difficult development areas and modifies other requirements relating to casualty losses, tax-exempt bond financing, and foreclosures.

Fight and Combat Rampant Iranian Missile Exports Act or the Fight CRIME Act This bill imposes sanctions pertaining to Iran's missile program. The President must impose visa- and property-blocking sanctions on foreign persons (i.e., foreign individuals, entities, and states) that are knowingly involved with Iran or Iran-aligned entities in certain missile-related activities, such as (1) acquiring, possessing, developing, transporting, transferring, or deploying missiles or related items and technology that are covered by the Missile Technology Control Regime (MTCR), or (2) developing missile or drone technologies. (The MTCR is an informal political understanding among states that seek to limit missile proliferation.) The President must also impose sanctions on (1) certain adult family members of those who are subject to the sanctions discussed above, and (2) foreign persons who knowingly provide significant support to or engage in a significant transaction with those subject to the sanctions discussed above. The bill also requires the Department of State to report to Congress on various topics, including (1) a diplomatic strategy to renew international restrictions on certain missile-related activities set forth in Annex B of U.N. Security Council Resolution 2231, which concerns restrictions on arms transfers to and from Iran; (2) the identities of foreign persons engaging in restricted activity under Annex B; and (3) an analysis of the foreign and domestic supply chains that facilitate Iran's missile or drone programs.

Special Envoy for the Abraham Accords Act This bill establishes the position of Special Envoy for the Abraham Accords within the Department of State. (The Abraham Accords are agreements to normalize or improve relations between Israel and four members of the Arab League: the United Arab Emirates, Bahrain, Morocco, and Sudan.) The Special Envoy shall serve as the primary advisor to the U.S. government for expanding and strengthening the Abraham Accords. The duties of the Special Envoy include (1) encouraging counties without diplomatic relations with Israel to establish formal diplomatic, economic, security, and people-to-people ties; (2) expanding and strengthening existing relationships between Israel and Muslim-majority countries; and (3) coordinating efforts across the US government and engaging diplomatically with foreign governments, nongovernmental organizations, and other stakeholders to expand and strengthen the Abraham Accords. The Special Envoy shall have the rank and status of ambassador.

Federal Prison Oversight Act This bill establishes an inspections regime for the Bureau of Prisons (BOP). The Department of Justice (DOJ) Office of the Inspector General must conduct risk-based evaluations of BOP facilities. An inspection of a facility may be announced or unannounced. Higher risk facilities must receive more frequent inspections. The bill (1) provides for the establishment in DOJ of an Ombudsman who may receive complaints, make inquiries, and recommend actions, and decline to investigate or take action, as specified; and (2) prohibits BOP retaliation against any person or entity that has instituted or caused to be instituted any proceeding, investigation, or inspection under this bill. The ombudsman shall coordinate with the BOP to educate incarcerated people, their representatives, and the public about the existence and functions of the ombudsman.

Teachers Empowered Against Classroom Harm Act of 2023 or the TEACH Act of 2023 This bill addresses school safety and security, including by expanding access to firearms for certain individuals and providing grants for defensive training programs. Current law prohibits the use of federal elementary and secondary education funds to provide any person with a dangerous weapon or training in the use of a dangerous weapon. The bill removes this prohibition. Next, the bill broadens the authority for certain individuals to carry firearms in a school zone. Specifically, the bill exempts individuals authorized by state law to carry firearms from the federal prohibition on possessing a firearm in a school zone. Further, the bill prohibits the Department of Education (ED) from disbursing or obligating funds for states, local governments, or eligible entities (e.g., local educational agencies or private schools) that restrict (in excess of federal law) the possession of firearms within school zones. Additionally, the bill directs ED to obligate certain reserved funds (i.e., funds reserved for technical assistance and capacity building) for a grant program. In particular, ED must award grants to enable eligible entities (e.g., local educational agencies or private schools) to participate in defensive training programs designed to protect schools from armed intruders. ED must fully obligate these funds for awarding grants and failure to do so shall result in a hiring freeze for ED.

Helping Everyone Access Long Term Healthcare Act or the HEALTH Act This bill allows a tax deduction for direct primary care physicians who provide charity care. The care must be provided without expectation of reimbursement and to an individual enrolled in Medicaid or the Children's Health Insurance Program (CHIP). A direct primary care physician is a physician who provides primary care (1) to individuals who have paid a periodic subscription fee, and (2) in exchange for a fee that is published on a publicly available website of the physician.

Living Donor Protection Act of 2023 This bill prohibits certain insurance carriers from discriminating against, and provides other protections for, living organ donors. Specifically, carriers may not deny, cancel, or otherwise impose conditions on policies for life insurance, disability insurance, or long-term care insurance based on an individual's status as a living organ donor. The bill also expressly specifies that recovery from organ-donation surgery constitutes a serious health condition that entitles eligible employees to job-protected medical leave. In addition, the Department of Health and Human Services must update educational materials on living organ donation to include information about the benefits of living organ donation and about access to insurance for living organ donors.

Federal Insurance Office Elimination Act This bill eliminates the Federal Insurance Office (FIO) within the Department of the Treasury. The bill also removes the FIO director as a nonvoting member of the Financial Stability Oversight Council.

Responsible Borrower Protection Act of 2023 This bill prohibits the Federal Housing Finance Agency, the Federal National Mortgage Association (Fannie Mae) and the Federal Home Loan Mortgage Corporation (Freddie Mac) from implementing their January 2023-announced changes to the single-family pricing framework for fees on purchase, rate-term refinance, and cash-out refinance loans. The changes revise the fee charts that provide percentage adjustments based on a borrower's credit score and other factors.

Block Nuclear Launch by Autonomous Artificial Intelligence Act of 2023 This bill prohibits the use of federal funds for an autonomous weapons system that is not subject to meaningful human control to launch a nuclear weapon or to select or engage targets for the purposes of launching a nuclear weapon. With respect to an autonomous weapons system, meaningful human control means human control of the (1) selection and engagement of targets, and (2) time, location, and manner of use.

This resolution pays tribute to the members of Brigada de Asalto 2506 (Assault Brigade 2506) who participated in the Bay of Pigs operation, and it calls on the United States to support policies that promote respect for democratic principles, civil liberties, freedom, and justice in Cuba.

Puerto Rico Status Act This bill provides for a plebiscite to be held on November 2, 2025, to resolve Puerto Rico's political status. Specifically, such plebiscite shall offer eligible voters a choice of independence, sovereignty in free association with the United States, or statehood. The Puerto Rico State Elections Commission shall invite national and international election observers to ensure transparency and confidence in the electoral process, and carry out a nonpartisan voter education campaign through traditional paid media and make available at all voting locations voter education materials related to the plebiscites. All voter educational materials and ballots used to carry out this bill shall be made available in English and Spanish. The bill sets forth transition and implementation provisions for each choice offered in the plebiscite.
