This resolution recognizes Immigrant Heritage Month in honor of the contributions immigrants and their children have made to the United States. It also welcomes immigrants presently in the United States and individuals seeking to immigrate to the United States to contribute to the health, safety, diversity, and prosperity of the United States.

Taskforce Recommending Improvements for Unaddressed Mental Perinatal & Postpartum Health for New Moms Act of 2021 or the TRIUMPH for New Moms Act of 2021 This bill temporarily establishes within the Department of Health and Human Services the Task Force on Maternal Mental Health. The task force must develop a national strategy for maternal mental health and report on best practices, policies, and programs to prevent, screen for, diagnose, treat, and reduce disparities in maternal mental health conditions. The report must identify opportunities for state- and local-level partnerships to address maternal mental health, and the task force must share those opportunities with state governors.

The People's Response Act This bill establishes multiple grant programs and requirements to promote qualified approaches to community safety. These are programs or services that are disconnected from carceral institutions (e.g., law enforcement, child welfare services, and immigration enforcement). Specifically, the bill establishes the Division of Community Safety within the Department of Health and Human Services (HHS) to administer the grants and carry out related activities. These include grants for community-based organizations to support qualified approaches to community safety, such as unarmed first responder agencies and 9-1-1 diversion programs; neighborhood-level interventions, including safe passage to school and violence interruption programs; behavioral health treatment, nutrition support, and other public health programs; housing security programs; and programs for youth and families, survivors of violence, and individuals exiting incarceration or criminal supervision. Additionally, the division must administer grants pertaining to qualified approaches for community safety for state and local governments and hiring and training first responders. The bill also establishes an advisory board to oversee the division's activities. Membership on the board must reflect the racial, ethnic, and other demographic diversities of the United States. The board must also include members who have personal experience with the criminal justice system. Furthermore, HHS must set up (1) a federal health response unit to respond to any public health emergency, assist with qualified approaches to community safety, and provide resources for safe and inclusive schools; and (2) an interagency task force to promote qualified approaches to community safety across federal programs.

This resolution expresses support for (1) equal rights and protections for all people, regardless of actual or perceived sexual orientation or gender identity; and (2) the designation of LGBTQ Equality Day on June 26 to commemorate Supreme Court decisions handed down on that day in 2003, 2013, and 2015. The resolution also acknowledges the need for further legislation to ensure that people in the United States are free from all forms of discrimination on the basis of actual or perceived sexual orientation or gender identity.

LGBTQ Data Inclusion Act This bill requires federal agencies that collect information through a survey that includes demographic data (where subjects self-report information or a proxy provides information about the subject or responds for all persons in a household) to review existing data sets to determine in which data sets information about sexual orientation and gender identity is not included, and to assess needed changes in survey methods related to asking questions on sexual orientation and gender identity. Agencies that publish reports relying on survey demographic data must include information on sexual orientation and gender identity.

Extinction Crisis Emergency Act of 2021 This bill requires the President to declare the global wildlife extinction crisis a national emergency and to take certain actions to restore wildlife. Specifically, the President shall direct the U.S. Fish and Wildlife Service and the National Marine Fisheries Service to review all species that are identified as critically imperiled, critically endangered, endangered, or vulnerable, and to use all authorities to propose and finalize protections for all species that may warrant protection; and establish new national wildlife refuges and new marine protected areas. The Departments of Commerce and the Interior must, after accepting public comment, conduct annual reviews of every nation's compliance with any international fishery conservation program or international program for endangered or threatened species, and take specified actions. The President must enlist all federal agencies to help fight the wildlife extinction crisis by directing each federal agency to take specified actions to prioritize the recovery of endangered species and to rebuild healthy wildlife and plant populations, including by fully integrating climate change concerns into the conservation and recovery of endangered species. The President must direct the Department of Defense to prioritize the protection of endangered species and rare habitats on U.S. military installations around the world.

Tax-Free Pell Grant Act This bill excludes from gross income, for income tax purposes, any amount received as a federal Pell Grant. It also expands the definition of qualified tuition and related expenses under the American Opportunity and Lifetime Learning tax credit to include computer or peripheral equipment (up to a maximum of $1,000), child and dependent care expenses, and course materials.

Patriotic Corporations of America Act of 2021 This bill establishes new requirements for federal contracts, including Department of Defense contracts, with respect to issues of labor, environmental sustainability, taxes, and private equity firms. Specifically, the bill prohibits an executive agency from awarding a contract unless the offeror, among other requirements pays employees wages that meet certain minimums; agrees to sign a neutrality agreement with respect to efforts to form a labor organization and an agreement not to hire replacement workers in any strike; submits to the agency an actionable plan to address natural disasters and health crises, including policies and plans for paid family and medical leave and for whistleblower protections; and submits to the agency an actionable plan to recruit and promote people of color, women, LGBTQ+ people, people with disabilities, and veterans. The bill sets forth additional provisions to assure that the offeror meets specified requirements with respect to the payment of environmental penalties, federal income tax liability and financial performance, and a controlling private equity firm meeting certain labor and environmental requirements. The bill establishes specified contract preferences (e.g., in favor of an offeror that does not outsource jobs outside the United States and that has a collective bargaining agreement with employees).

Veterans Visa and Protection Act of 2021 This bill provides permanent resident status and citizenship eligibility to certain noncitizen veterans and addresses related issues. The Department of Homeland Security (DHS) must establish a program that allows (1) eligible noncitizen veterans outside of the United States to be admitted as permanent residents, and (2) eligible noncitizen veterans in the United States to obtain permanent resident status. Generally, an eligible noncitizen veteran under this bill is one who was not removed from the United States for certain crimes related to violence or national security. DHS may waive these eligibility requirements for humanitarian, family unity, public interest, or exceptional military service reasons. A noncitizen veteran who obtains permanent resident status under this bill shall be eligible for (1) naturalization through service in the Armed Forces, and (2) military and veterans benefits as if they had not been removed (or ordered removed) from the United States. For a noncitizen veteran in removal proceedings or subject to a final removal order, the Department of Justice (DOJ) must determine whether the veteran is eligible for permanent resident status under this bill. If the veteran is eligible, DOJ must adjust the veteran's status. The bill also protects noncitizen veterans or service members from being removed from the United States unless the veteran has been convicted of a crime of violence.

Keeping Girls in School Act This bill authorizes the U.S. Agency for International Development (USAID) to enter into agreements to address social, cultural, health, and other barriers that adolescent girls face in accessing quality secondary education. The USAID shall seek to ensure that such activities meet various requirements related to monitoring and evaluating outcomes, collecting data, and using specified indicators and methodologies for international basic education. The Department of State shall periodically update and report to Congress a publicly available U.S. global strategy to empower adolescent girls, and the USAID shall periodically report to Congress on the activities initiated under this bill and efforts to monitor and evaluate such activities.

Better Care Better Jobs Act This bill establishes programs and provides funds for state Medicaid programs to improve home- and community-based services (HCBS), such as home health care, personal care, case management, and rehabilitative services. Specifically, the bill provides funds for the Centers for Medicare & Medicaid Services to award planning grants, develop quality measures, and provide technical assistance to states regarding specified HCBS improvements, particularly with respect to access, utilization, and the associated workforce. The bill also increases the Federal Medical Assistance Percentage (i.e., federal matching rate) for HCBS in states that develop plans and meet specified benchmarks for improvements. The bill also makes permanent (1) the Money Follows the Person Rebalancing Demonstration Program (a grant program to help states increase the use of HCBS for long-term care and decrease the use of institutional care), and (2) certain provisions regarding Medicaid eligibility that protect against spousal impoverishment for recipients of HCBS.

Advancing FASD Research, Services, and Prevention Act or the FASD Respect Act This bill expands and establishes programs for fetal alcohol spectrum disorders (FASD). Specifically, it directs the Department of Health and Human Services, the National Institutes of Health, the National Center on Birth Defects and Developmental Disabilities, and the Health Resources and Services Administration to carry out and coordinate research, surveillance, and related activities to diagnose, prevent, and treat FASD. Furthermore, the bill establishes various grant programs to support FASD coalitions and develop systems of care; provide services for individuals affected by FASD and other conditions related to prenatal substance exposure; identify and implement best practices for educating children with FASD; and establish centers for excellence to build relevant capacity for preventing, treating, and responding to the needs of individuals with FASD. The bill also directs the Department of Education and the Department of Justice to develop and disseminate trainings and best practices related to FASD in schools and correctional facilities, respectively.

Therapeutic Fraud Prevention Act of 20 21 This bill prohibits commercial conversion therapy, which is a practice or treatment designed to change a person's sexual orientation or gender identity or otherwise change behaviors, thoughts, or expressions related to gender or sexual attraction. This prohibition does not apply to treatment that assists an individual undergoing a gender transition or facilitates identity exploration and development.

Saving America's Pollinators Act of 2021 This bill addresses the use of certain pesticides and the health and status of native bees and other pollinators. First, the bill requires the Environmental Protection Agency (EPA) to establish a Pollinator Protection Board to develop an independent review process for pesticides that pose a threat to pollinators and their habitats. All active ingredients and pesticide products that contain one or more specified neonicotinoid pesticides must be deemed to generally cause unreasonable adverse effects to the environment. Under the bill, the registration of all uses of neonicotinoid pesticides must be immediately and permanently canceled. The EPA must revoke any tolerance or exemption that allows the presence of a neonicotinoid pesticide, or any pesticide chemical residue that results from neonicotinoid pesticide use, in or on food. The continued sale or use of existing stocks of neonicotinoid pesticides is prohibited, and the EPA may not register any such pesticides under the Federal Insecticide, Fungicide and Rodenticide Act. The bill requires the Department of the Interior, the EPA, and the Department of Agriculture to coordinate monitoring activities and report on the health and population status of native bees and other pollinators. Finally, a state or federal agency may be granted an exemption to use neonicotinoid pesticides if the board votes that use of the pesticide is warranted (1) in an emergency situation to avert significant risk to threatened or endangered species, (2) to quarantine invasive species, or (3) to protect public health.

Closing the Meal Gap Act of 202 1 This bill revises the requirements for calculating Supplemental Nutrition Assistance Program (SNAP) benefits. The bill increases the minimum SNAP benefit and requires benefits to be calculated using the value of a low-cost food plan. The Department of Agriculture (USDA) must determine the requirements for the low-cost food plan, which is the diet required to feed a family of four, consisting of a man and a woman 19-50 years of age, a child 6-8 years of age, and a child 9-11 years of age. USDA must (1) reevaluate and publish the market baskets of the plan by January 1, 2027, and every five years thereafter, based on current food prices, food composition data, consumption patterns, and dietary guidance; and (2) make adjustments to the plan to account for household size, changes in the cost of the diet, and the costs of food in specified areas. The bill modifies the requirements for calculating household income to determine SNAP eligibility by (1) authorizing a standard medical expense deduction for households containing an elderly or disabled member, and (2) eliminating the cap on the excess shelter expense deduction. The bill eliminates certain work requirements for SNAP. The requirements apply to able-bodied adults who are ages 18-49 and have no dependent children. The bill allows Puerto Rico, American Samoa, and the Northern Mariana Islands to participate in SNAP. Currently, the three territories receive block grants instead of participating in SNAP.

Large-Scale Water Recycling Project Investment Act This bill requires the Department of the Interior to award grants to water or power delivery authorities for the planning, design, and construction of large-scale water recycling and reuse projects in drought-stricken regions of certain western states. Additionally, the Government Accountability Office must report on the selection process for each project.

Healthy Future Students and Earth Pilot Program Act of 2021 This bill establishes a pilot program for providing 100% plant-based food and milk options in school meals. The Department of Agriculture must award up to 50 grants to school food authorities. Recipients may use funds for activities including training food service personnel on serving 100% plant-based options and covering additional costs of buying plant-based foods and milks.

Vanessa Guillén Military Justice Improvement and Increasing Prevention Act This bill modifies the process and policy related to the disposition of charges and convening of courts-martial for certain sexual assault cases and other specified offenses under the Uniform Code of Military Justice (UCMJ). Among other elements, the bill provides that the determinations on the preferral, disposition, and referral of charges for specified offenses under the UCMJ must be made by a commissioned officer of the Armed Forces who is designated as a court-martial convening authority (in grade O-6 or higher) and who is available for detail as trial counsel, has significant trial experience, and is outside the chain of command of the member subject to the charges.

Aviation Funding Stability Act of 20 21 This bill provides continuing appropriations to the Federal Aviation Administration (FAA) from the Airport and Airway Trust Fund if an appropriations bill for the FAA has not been enacted before a fiscal year begins or a joint resolution making continuing appropriations for the FAA is not in effect. The bill provides appropriations at the rate of operations that was provided for the prior fiscal year to continue programs, projects, and activities for which funds were provided in the preceding fiscal year.

Telemental Health Care Access Act of 2021 This bill eliminates certain restrictions relating to Medicare coverage of mental health services that are provided through telehealth. Current law allows for coverage of such services regardless of the geographic location of the originating site (i.e., the location of the beneficiary) after the end of the COVID-19 public health emergency, as long as the beneficiary previously received in-person services and continues to receive in-person services at specified intervals. The bill eliminates these in-person requirements.

Central American Women and Children Protection Act of 2021 This bill temporarily authorizes the Department of State to enter into bilateral compacts with the governments of El Salvador, Guatemala, and Honduras to strengthen criminal justice systems, social supports, and other means to protect women and children from domestic and gender-based violence. At least 15 days before entering a compact, the State Department must submit to Congress a copy of the proposed agreement and related materials. Authority to enter a compact terminates on September 30, 2023, and a compact may last no more than six years. To support the objectives outlined in a compact, the State Department may provide assistance to international organizations, civil society, or other private entities for programs and activities to prevent and respond to domestic and gender-based violence in a compact country. The bill bars the provision of assistance to the government of a compact country as direct budgetary support. The State Department may suspend or terminate the assistance if a compact country or entity receiving the assistance engaged in conduct contrary to U.S. national security interests or inconsistent with the objectives of the compact. The State Department must notify Congress at least 15 days before suspending or terminating assistance. The bill also requires the State Department to annually report on progress made under each compact, including its effect on reported violence against women and children and other domestic and gender-based violence indicators.

Mental Health in International Development and Humanitarian Settings Act or the MINDS Act This bill directs the U.S. Agency for International Development (USAID) and the Department of State to integrate mental health and psychosocial support activities across all U.S. foreign assistance programs, with a particular focus on children and other vulnerable populations. To facilitate this integration, the bill makes organizational changes at the USAID. It authorizes the USAID to appoint a coordinator to oversee and direct mental health and psychosocial support activities. The coordinator must ensure that these activities focus on children, adult caretakers and families, displaced populations, and other vulnerable groups. In addition, the bill establishes a working group comprised of representatives from every USAID bureau and the Department of State to coordinate interagency efforts related to, promote best practices for, and ensure sustainability and continuity of mental health and psychosocial support activities. The USAID and the State Department must brief Congress about the amount of foreign assistance spending on mental health and psychosocial support activities and related matters.

No PFAS in Cosmetics Act This bill requires the Department of Health and Human Services to issue and finalize a rule to ban the use of intentionally added perfluoroalkyl or polyfluoroalkyl substances in cosmetics.

Cover Outstanding Vulnerable Expansion-eligible Residents Now Act or the COVER Now Act This bill establishes a demonstration program to allow local governments to provide health benefits to the Medicaid expansion population in states that have not expanded Medicaid. Under the program, local governments may provide coverage for individuals who are newly eligible for Medicaid under the Patient Protection and Affordable Care Act (i.e., the Medicaid expansion population) for a maximum of 10 years, or until their respective states expand Medicaid. The bill provides a 100% federal matching rate for the first three years of program participation. The bill prohibits states from taking certain actions against participating localities, such as withholding funding, increasing taxes, or restricting provider participation. States that violate these requirements are subject to certain funding penalties.

Work Without Worry Act This bill modifies eligibility for Social Security Disability Insurance (SSDI) benefits for individuals who have a disability that began before age 22. Under current law, these individuals may obtain SSDI benefits based on the work record of a retired, disabled, or deceased parent. However, an individual with earnings after age 22 that exceed a specified monetary limit (i.e., constitute substantial gainful activity) permanently loses eligibility for such benefits. This bill allows individuals to retain eligibility for such benefits regardless of the amount of earnings after age 22. Additionally, individuals who apply for SSDI benefits on a parent's record and also independently qualify for Social Security benefits on their own record will receive the larger of the two benefit amounts.

Disarm Hate Act The bill expands the categories of persons who are prohibited from receiving or possessing a firearm. Specifically, it prohibits firearm sale or transfer to and receipt, possession, shipment, or transport by a person (1) who has been convicted of a misdemeanor hate crime, or (2) who has received an enhanced hate crime misdemeanor sentence.

Burial Equity for Guards and Reserves Act of 2021 This bill prohibits the Department of Veterans Affairs (VA) from establishing a condition for a cemetery grant that restricts the ability of a state to inter certain reservists (or their spouses and children) at a state-owned veterans' cemetery solely because such individuals are ineligible for burial in an open national cemetery. Specifically, as a condition for grants, the VA cannot restrict the ability of a state to inter a member of a reserve component whose service was terminated under honorable conditions; member of the Army National Guard or Air National Guard whose service was terminated under honorable conditions; member of the Reserve Officers' Training Corps of the Army, Navy, or Air Force who died under honorable conditions while a member; and spouse, minor child, or unmarried adult child of any member described above. The VA is prohibited from (1) denying an application for a grant solely on the basis that the recipient state may use funds to expand, improve, operate, or maintain a veterans' cemetery to allow for the internment of the specified individuals; and (2) enforcing certain conditions on grants for state veterans' cemeteries that were established before the date of enactment of this bill. The bill also provides for plot allowances for the individuals listed in the bill.

American Renewable Energy Act of 2021 This bill establishes an annual renewable energy standard for retail electricity suppliers through 2030. Under the standard, the suppliers must (1) increase their renewable energy generation each year by specified amounts, and (2) generate at least 70% renewable electricity by 2030.

Salton Sea Projects Improvements Act This bill provides the Bureau of Reclamation with additional project authorities for the Salton Sea research project in Southern California. Specifically, the bill authorizes Reclamation to provide grants and enter into contracts and cooperative agreements to carry out projects (e.g., construction activities and dust suppression projects) to improve air quality, fish and wildlife habitat, recreational opportunities, and water quality in the area of the Salton Sea. To carry out these projects, Reclamation may enter into partnerships with state, tribal, and local governments; water districts; joint powers authorities, including the Salton Sea Authority; nonprofit organizations; and institutions of higher education.

Restaurant Revitalization Fund Replenishment Act of 2021 This bill provides an additional $60 billion in FY2021 for the Restaurant Revitalization Fund, which was established to support restaurants and other food and beverage purveyors in response to COVID-19.

Supplemental Security Income Restoration Act of 2021 This bill modifies eligibility for, and other components of, the Supplemental Security Income (SSI) program, including by (1) increasing applicable income and resource limits used to determine SSI eligibility, (2) equalizing treatment of married couples when both spouses receive SSI as compared to two unmarried individuals, and (3) eliminating the penalty on SSI applicants or recipients who transfer resources to another individual for less than fair market value.

Ocean-Based Climate Solutions Act of 2021 This bill establishes a variety of requirements to reduce carbon emissions and protect oceans, coastal habitats, marine mammals, and fish populations from climate change and other threats.

Greater Leadership Overseas for the Benefit of Equality Act of 2021 or the GLOBE Act of 2021 This bill contains provisions related to (1) the protection of LGBTQI individuals globally; and (2) immigration protections for vulnerable individuals. The bill establishes (1) an interagency group to respond to urgent threats to LGBTQI people in foreign countries, and (2) a permanent Special Envoy for the Human Rights of LGBTQI Peoples in the Department of State. The President shall impose visa-blocking sanctions on foreign persons responsible for violating the human rights of individuals based on sexual orientation, gender identity, or sex characteristics. The State Department shall establish the Global Equality Fund to provide assistance to nongovernmental organizations working to advance and protect human rights. The U.S. Agency for International Development shall establish the LGBTQI Global Development Partnership to work with the private sector and nongovernmental organizations to support LGBTQI rights. The bill removes prohibitions against providing foreign assistance to nongovernmental organizations that offer certain medical services (e.g., abortion-related services) using non-U.S. government funds. The bill contains several immigration-related provisions, such as those establishing that persecution based on sexual orientation or gender identity may form the basis of an asylum request, allowing certain applicants to file asylum claims more than a year after their arrival in the United States, including a permanent partnership between two partners as a marriage for immigration law purposes, providing for free counsel in certain immigration proceedings, and granting U.S. citizenship to a child born abroad through assistive reproductive technology from a U.S. citizen who is the child's nonbiological parent.

Women's Health Protection Act of 2021 This bill prohibits governmental restrictions on the provision of, and access to, abortion services. Specifically, governments may not limit a provider's ability to prescribe certain drugs, offer abortion services via telemedicine, or immediately provide abortion services when the provider determines a delay risks the patient's health. Furthermore, governments may not require a provider to perform unnecessary medical procedures, provide medically inaccurate information, comply with credentialing or other conditions that do not apply to providers whose services are medically comparable to abortions, or carry out all services connected to an abortion. In addition, governments may not (1) require patients to make medically unnecessary in-person visits before receiving abortion services or disclose their reasons for obtaining such services, or (2) prohibit abortion services before fetal viability or after fetal viability when a provider determines the pregnancy risks the patient's life or health. The bill also prohibits other governmental measures that are similar to the bill's specified restrictions or that otherwise single out and impede access to abortion services, unless a government demonstrates that the measure significantly advances the safety of abortion services or health of patients and cannot be achieved through less restrictive means. The Department of Justice, individuals, or providers may bring a lawsuit to enforce this bill, and states are not immune from suits for violations. The bill applies to restrictions imposed both prior and subsequent to the bill's enactment.

America's Red Rock Wilderness Act This bill designates specified lands in the following areas of Utah as components of the National Wilderness Preservation System: (1) Great Basin, (2) Grand Staircase-Escalante, (3) Moab-La Sal Canyons, (4) Henry Mountains, (5) Glen Canyon, (6) San Juan-Anasazi, (7) Canyonlands Basin, (8) San Rafael Swell, and (9) Book Cliffs and Uinta Basin. The bill sets forth administrative requirements for (1) the exchange of state-owned lands within such areas, (2) federal reservation of water rights, (3) measurement of setbacks for roads with adjacent wilderness, (4) authorized livestock grazing, and (5) withdrawal of such lands from disposition under certain public land laws.

Physical Therapist Workforce and Patient Access Act of 2021 This bill makes physical therapists eligible for the National Health Service Corps Loan Repayment Program. This program assists primary care, mental health, and dental providers in repaying eligible student loans in exchange for working in areas with shortages of such providers.

Parity Implementation Assistance Act This bill provides grants to assist states with the implementation of the federal mental health parity requirements. States receiving the grants must request and review from private health insurance plans their required comparative analysis of nonquantitative treatment limitations (NQTLs) with respect to mental health or substance use disorder benefits. (NQTLs are limitations on the scope or duration of benefits for treatment, such as preauthorization requirements.)

FAIR Leave Act or the Fair Access for Individuals to Receive Leave Act This bill repeals the limit on the aggregate number of workweeks of family and medical leave that spouses employed by the same employer may be entitled to during any 12-month period. The current limit is 12 aggregate workweeks.

Supplemental Security Income Restoration Act of 2021 This bill modifies eligibility for, and other components of, the Supplemental Security Income (SSI) program, including by (1) increasing applicable income and resource limits used to determine SSI eligibility, (2) equalizing treatment of married couples when both spouses receive SSI as compared to two unmarried individuals, and (3) eliminating the penalty on SSI applicants or recipients who transfer resources to another individual for less than fair market value.

Essential Caregivers Act of 2021 This bill requires skilled nursing facilities, nursing facilities, intermediate care facilities for the intellectually disabled, and nearby inpatient rehabilitation facilities to establish an essential caregivers program during a public health emergency. Under the program, facilities must allow each resident to select up to two essential caregivers to provide daily living assistance, emotional support, or companionship during the emergency. Facilities must afford such caregivers 12 hours of access to residents each day (or unlimited access for end-of-life care), and caregivers must agree to follow facility protocols for staff safety. Facilities may deny access to caregivers who violate protocols, subject to certain notification requirements; the Centers for Medicare & Medicaid Services must establish an appeals process relating to such decisions and may take specified enforcement actions against facilities that violate the bill's requirements.

Don't BLock Our Communities Act or the D-BLOC Act This bill prohibits railroad carriers from obstructing travel at public highway-rail crossings for more than 10 minutes, except under limited circumstances (e.g., safety issues). The Department of Transportation (DOT) must investigate and send notices to carriers of repeated incidents; carriers are subject to civil penalties for violations that occur after having received notice. DOT must also establish a national database for the public to report such incidents.

Equal Access to Green cards for Legal Employment Act of 2021 or the EAGLE Act of 2021 This bill modifies requirements related to employment-based visas and addresses related issues. The bill increases the per-country cap on family-based immigrant visas from 7% of the total number of such visas available that year to 15% and eliminates the per-country cap for employment-based immigrant visas. The bill establishes transition rules for employment-based visas such as (1) reserving a percentage of EB-2 (workers with advanced degrees or exceptional ability) and EB-3 (skilled and other workers) visas for individuals not from the two countries with the largest number of recipients of such visas, and (2) allotting a number of visas for professional nurses and physical therapists. The bill imposes additional requirements on an employer seeking an H-1B visa, such as prohibiting (1) an employer from advertising that a position is only open to H-1B applicants or that H-1B applicants are preferred, and (2) certain employers from having more than half of their employees as nonimmigrant visa workers. The Department of Labor shall create a publicly available website where an employer seeking an H-1B visa must post certain information about the open position. The bill also expands Labor's authority to review and investigate H-1B applications for fraud or misrepresentations. The bill also allows certain aliens to obtain lawful permanent resident status if the alien (1) is in the United States as a nonimmigrant, (2) has an approved immigrant visa petition, and (3) has waited at least two years for a visa.

This bill designates the medical center of the Department of Veterans Affairs (VA) in San Diego, California, as the Jennifer Moreno Department of Veterans Affairs Medical Center. The bill also expresses the sense of Congress that the VA should designate a prominent physical space within the Jennifer Moreno Department of Veterans Affairs Medical Center to honor Kathleen Mae Bruyere.
