Water Quality Protection and Job Creation Act of 2017 The bill amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act) to reauthorize through FY2022: programs for preventing and reducing pollution through research, investigations, and training; state and interstate water pollution control programs; wet weather watershed pilot projects; a grant program for implementing state management programs for controlling pollution added from nonpoint sources (e.g., pollution on the ground picked up by rain) to navigable waters; a grant program for protecting groundwater quality; clean water state revolving funds; a pilot program for alternative water source projects; and sewer overflow and stormwater reuse municipal grants (formally known as sewer overflow control grants). The bill authorizes the Environmental Protection Agency to make grants to rural, small, and tribal municipalities for addressing pollution. The bill revises requirements governing capitalization grant agreements, clean water state revolving funds, and sewer overflow and stormwater reuse municipal grants.

Action for Dental Health Act 2017 This bill amends the Public Health Service Act to reauthorize oral health promotion and disease prevention programs through FY2022. The Centers for Disease Control and Prevention (CDC) may award grants or enter into contracts to obtain portable or mobile dental equipment and pay operational costs for the provision of free dental services to underserved populations. The CDC may also award grants or enter into contracts to collaborate with state, county, or local public officials and other stakeholders to develop and implement initiatives to: (1) improve oral health education and dental disease prevention; (2) make the dental services delivery system more accessible and efficient through outreach programs that facilitate the establishment of dental homes; (3) reduce geographic barriers, language barriers, cultural barriers, and other similar barriers in the provision of dental services; (4) reduce the use of emergency departments by individuals who seek dental services more appropriately delivered in a dental primary care setting; or (5) facilitate the provision of dental care to nursing home residents who are disproportionately affected by lack of care.

Anti-Lunch Shaming Act of 2017 This bill amends the Richard B. Russell National School Lunch Act to establish requirements for the treatment of a child who is a student at a school participating in the National School Lunch Program or the School Breakfast Program and is unable to pay for a meal at the school. The bill applies to a child who either does not have funds to pay for a meal or has outstanding credit that was extended by a school food authority (SFA). A SFA may not permit public identification or stigmatization of the child, such as by requiring a wristband or hand stamp. The child also may not be required to: (1) perform chores or activities that are not required of students generally, or (2) dispose of food after it has been served to the child. Any communication related to outstanding credit must be directed to the child's parent or guardian. A child may be required to deliver a letter regarding outstanding credit that is addressed to a parent or guardian if the letter is not distributed to the child in a manner that stigmatizes the child. The bill also expresses the sense of Congress regarding several issues regarding the administration of the school meal programs.

Nurse Staffing Standards for Patient Safety and Quality Care Act of 2017 This bill amends the Public Health Service Act to require hospitals to implement and submit to the Department of Health and Human Services (HHS) a staffing plan that complies with specified minimum nurse-to-patient ratios by unit. Hospitals must post a notice regarding nurse-to-patient ratios in each unit and maintain records of actual ratios for each shift in each unit. HHS must adjust Medicare payments to hospitals to cover additional costs incurred in providing services to Medicare beneficiaries that are attributable to compliance with these ratios. The bill states that nurses have a duty and a right to act based on their professional judgment and provide care in the exclusive interests of patients. Nurses may object to, or refuse to participate in, an assignment if it would violate minimum ratios or if they are not prepared by education or experience to fulfill the assignment without compromising the safety of a patient or jeopardizing their nurse's license. Hospitals may not: (1) take specified actions against a nurse based on the nurse's refusal to accept an assignment for such a reason; or (2) discriminate against individuals for good faith complaints relating to the care, services, or conditions of the hospital or related facilities. HHS must publish the names of hospitals penalized for violating the requirements in this bill. The bill adds stipends to the nurse workforce loan repayment and scholarship program. The nurse retention grant program is expanded to authorize programs to implement nurse preceptorship and mentorship projects.

Stop Predatory Bail Contracts Act This bill requires the Federal Trade Commission (FTC) to limit the fee that bail bond agents or persons underwriting or insuring the provision of a bail bond may charge for an ankle monitor or homing device that they require an accused individual to wear as a condition on issuing a bond for his or her appearance in court. The fee may not exceed the cost of maintaining and operating such monitor or device. The bill provides the FTC with authority to enforce against violations, which shall be treated as unfair or deceptive acts or practices under Federal Trade Commission Act.

Water Infrastructure Flexibility Act

Water Infrastructure Flexibility Act This bill amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act) to allow municipalities to develop a plan that integrates wastewater and stormwater management. A permit for a municipal discharge under the national pollutant discharge elimination system that incorporates an integrated plan may integrate all requirements under the Act addressed in the plan. Those permits may include a schedule of compliance that allows actions for meeting water quality-based effluent limitations to be implemented over more than one permit term if the compliance schedules are authorized by state water quality standards. Those actions may include implementing green infrastructure as part of a water quality-based effluent limitation. (Green infrastructure includes measures that mimic natural processes to store, reuse, or reduce stormwater.) The bill establishes an Office of the Municipal Ombudsman in the Environmental Protection Agency (EPA) to provide: (1) technical assistance to municipalities seeking to comply with the Clean Water Act and the Safe Drinking Water Act, and (2) information to the EPA to ensure that agency policies are implemented by all EPA offices. The EPA must ensure that specified EPA offices promote the integration of green infrastructure into permitting programs, planning efforts, research, technical assistance, and funding guidance. The bill establishes requirements for revising the EPA's 1997 guidance about combined sewer overflows, including by setting forth criteria for determining the ability of households to pay utility bills. (Combined sewer systems collect rainwater, sewage, and industrial wastewater into one pipe. During storms, the combined wastewater sometimes exceeds the capacity of the treatment plant. When this occurs, combined sewer overflows discharge directly into water bodies.)

PAWS Act of 2017

Puppies Assisting Wounded Servicemembers Act of 2017 or the PAWS Act of 2017 This bill directs the Department of Veterans Affairs (VA) to carry out a five-year pilot program under which it provides grants to eligible nonprofit organizations to provide service dogs to veterans who suffer from post-traumatic stress disorder after completing other evidence-based treatment. An organization that receives a grant shall provide for each participating service dog and veteran: coverage by a commercially available veterinary health insurance policy, hardware clinically determined to be required by the dog to perform the tasks necessary to assist the veteran, payments for travel expenses to obtain the dog, and travel expenses required to obtain a replacement service dog. To be eligible for a grant, an organization must: (1) agree to cover all costs in excess of the grant amount to guarantee such benefits, (2) be certified by Assistance Dogs International, (3) provide one-on-one training for each service dog and recipient for 30 hours or more over 90 days or more, and (4) provide an in-house residential facility or other accommodations nearby in which service dog recipients stay for a minimum of 10 days while receiving at least 30 hours of training. The VA shall develop metrics to measure the improvement in psychosocial function and therapeutic compliance and changes independence on prescription narcotics and psychotropic medication of veterans participating in the program. The Government Accountability Office must report to Congress on the methodology used for the pilot program.

National Suicide Hotline Improvement Act of 2017 This bill requires the Federal Communications Commission (FCC) to coordinate with the Substance Abuse and Mental Health Services Administration and to consult with the Department of Veterans Affairs to examine: (1) the feasibility of designating a three-digit dialing code for a national suicide prevention and mental health crisis hotline system; and (2) the effectiveness of the current National Suicide Prevention Lifeline (1-800-273-TALK), including how well it addresses the needs of veterans. The FCC must submit to Congress a recommended dialing code, a cost-benefit analysis comparing the three-digit code to the current lifeline number, and cost estimates for service providers, states, and localities.

No funds made available to eligible counties under such Act may be used in lieu of, or to otherwise offset, a state funding source for a local school, facility, or educational purpose. The merchantable timber contracting pilot program is repealed. The bill extends through FY2019 the authority under such Act to initiate special projects on such federal lands and certain county activities.

Rights for Transportation Security Officers Act of 2017

Rights for Transportation Security Officers Act of 2017 This bill repeals: (1) provisions authorizing the Department of Homeland Security (DHS) to establish a human resources management system for some or all of its organizational units, and (2) the authority granted to the Transportation Security Administration (TSA) to establish or modify a personnel management system for TSA employees engaged in airport security screening. Within 60 days after the enactment date of this bill: (1) any such human resources management system and all TSA personnel management policies, letters, guidelines, and directives shall cease to be effective, and (2) all TSA positions and DHS positions that provide transportation security in furtherance of the purposes of the Aviation and Transportation Security Act shall become subject to general civil service provisions. This bill sets forth transition rules that protect the pay rates and other rights of such employees. Any collective bargaining agreement on the effective date of this legislation shall remain in effect. DHS shall consult with the labor organization certified by the Federal Labor Relations Authority to carry out the conversion of such positions. The provisions of this bill do not affect the prohibitions against disloyalty and asserting the right to strike against the federal government.

San Gabriel Mountains Foothills and Rivers Protection Act This bill establishes the San Gabriel National Recreation Area in California as a unit of the National Park System, consisting of approximately 51,107 acres of identified federal lands and interests. The Department of the Interior must cooperate with the Department of Defense (DOD) to develop opportunities for the management of the federal lands under DOD jurisdiction that are included within the recreation area. The bill establishes the San Gabriel National Recreation Area Public Advisory Council and the San Gabriel National Recreation Area Partnership. Interior and the San Gabriel National Recreation Area Public Advisory Council shall create a comprehensive management plan for the recreation area. Interior shall develop an integrated visitor services plan for the recreation area and is authorized to construct visitor use facilities. The Department of Agriculture must modify the boundaries of the San Gabriel Mountains National Monument in California to include approximately 109,143 acres of additional, identified National Forest System lands and administer them as part of the monument.

Regional Infrastructure Accelerator Act of 2017 This bill authorizes the Department of the Treasury to establish a regional infrastructure accelerator (RIA) program to provide initial and subsequent grants to RIAs to facilitate investment in, and long-term financing of, economically viable covered infrastructure projects. An "RIA" is defined as a multi-jurisdictional organization dedicated to providing technical assistance, financing options, and resources for covered infrastructure projects within the represented jurisdictions. A "covered infrastructure project" is defined as a project sponsored by a state, local, or regional public entity that involves the construction, consolidation, alteration, or repair of rail, bus, or public transportation facilities or equipment, highway facilities (including bridges and tunnels), airports, port or marine facilities and equipment, pipelines, inland waterways, intermodal facilities and equipment, water treatment and solid waste disposal facilities, storm water management systems, dams and levees, and facilities or equipment for energy transmission, distribution, or storage. From applications received, Treasury shall select five RIAs from geographically diverse regions to receive initial grants. An RIA shall use such a grant to: assess regional approaches for advancing innovative investment in covered infrastructure projects; develop strategies for transparency in the analysis of such projects to ensure protection of the public interest, for the bundling of smaller scale and rural projects into larger covered infrastructure projects to facilitate transactions and investments, and for reducing transaction costs associated with investments in such projects; facilitate the creation of a catalog of covered infrastructure projects available for investment; and analyze and apply project procurement methods for covered infrastructure projects. Treasury shall review final reports submitted by RIAs and select four of them to receive subsequent grants. A selected RIA shall use such subsequent grant to make subgrants to public entities for costs associated with a covered infrastructure project.

Small Business Relief and Job Creation Act This bill amends the Internal Revenue Code to allow small business employers whose gross receipts in the preceding taxable year did not exceed $20 million or who did not employ more than 100 full-time employees during the preceding taxable year a work opportunity tax credit for hiring unemployed individuals as full-time employees (at least 30 hours per week for 35 or more calendar weeks in the taxable year) during 2018 or 2019. The bill doubles the rate of such credit for employers located in counties with unemployment rates that exceed the national rate of unemployment.

Putting Main Street FIRST Act or the Putting Main Street FIRST: Finishing Irresponsible Reckless Speculative Trading Act This bill amends the Internal Revenue Code to impose a .03% excise tax on the purchase of a security if: (1) such purchase occurs on, or is subject to the rules of, a qualified board or exchange located in the United States; or (2) the purchaser or seller is a U.S. person. A "security" includes: (1) any share of stock in a corporation, (2) any partnership or beneficial ownership interest in a partnership or trust; (3) any note, bond, debenture, or other evidence of indebtedness; and (4) derivatives that meet specified criteria. The tax applies to transactions with respect to a derivative if: (1) the derivative is traded on, or is subject to the rules of, a qualified board or exchange located in the United States; or (2) any party with rights under the derivative is a U.S. person. The bill exempts from such tax: (1) initial issues of securities; and (2) any note, bond, debenture, or other evidence of indebtedness which is traded on or is subject to the rules of, a qualified board or exchange located in the United States, and has a fixed maturity of not more than 100 days. The tax applies to transactions by a controlled foreign corporation and must be paid by its U.S. shareholders. The bill allows an offset against such tax for contributions to certain tax-favored savings accounts.

Equality Act This bill amends the Civil Rights Act of 1964 to include sex, sexual orientation, and gender identity among the prohibited categories of discrimination or segregation in places of public accommodation. The bill defines: "sex" to include a sex stereotype, sexual orientation or gender identity, and pregnancy, childbirth, or a related medical condition; "sexual orientation" as homosexuality, heterosexuality, or bisexuality; and "gender identity" as gender-related identity, appearance, mannerisms, or characteristics, regardless of the individual's designated sex at birth. The bill expands the categories of public accommodations to include places or establishments that provide: exhibitions, recreation, exercise, amusement, gatherings, or displays; goods, services, or programs, including a store, a shopping center, an online retailer or service provider, a salon, a bank, a gas station, a food bank, a service or care center, a shelter, a travel agency, a funeral parlor, or a health care, accounting, or legal service; or transportation services. The bill prohibits "establishment" from being construed to be limited to a physical facility or place. The Department of Justice (DOJ) may bring a civil action if it receives a complaint from an individual who claims to be: denied equal utilization of a public facility owned, operated, or managed by a state (other than public schools or colleges) on account of sex, sexual orientation, or gender identity; or denied admission to, or not permitted to continue attending, a public college by reason of sexual orientation or gender identity, thereby expanding DOJ's existing authority to bring such actions for complaints based on race, color, religion, sex, or national origin. The bill revises public school desegregation standards to provide for the assignment of students without regard to sexual orientation or gender identity. The bill prohibits programs or activities receiving federal financial assistance from denying benefits to, or discriminating against, persons based on sex, sexual orientation, or gender identity. The bill prohibits employers with 15 or more employees from discriminating based on sexual orientation or gender identity, subject to the same exceptions and conditions that currently apply to unlawful employment practices based on race, color, religion, sex, or national origin. Employers must recognize individuals in accordance with their gender identity if sex is a bona fide occupational qualification that is reasonably necessary to the normal operation of that particular business or enterprise. The bill provides government employees with protections against discrimination based on sexual orientation or gender identity. DOJ may intervene in equal protection actions in federal court on account of sexual orientation or gender identity. Protections against discrimination based on race, color, religion, sex, sexual orientation, gender identity, or national origin shall include protections against discrimination based on: (1) an association with another person who is a member of such a protected class; or (2) a perception or belief, even if inaccurate, that an individual is a member of such a protected class. The bill prohibits the Religious Freedom Restoration Act of 1993 from providing a claim, defense, or basis for challenging such protections. The bill prohibits an individual from being denied access to a shared facility, including a restroom, a locker room, and a dressing room, that is in accordance with the individual's gender identity. The bill amends Fair Housing Act, the Equal Credit Opportunity Act, and jury selection standards to add sexual orientation and gender identity as classes protected against discrimination under such laws.

Carried Interest Fairness Act of 201 7 This bill amends the Internal Revenue Code to: (1) set forth a special rule for the inclusion in gross income of partnership interests transferred in connection with the performance of services, (2) treat as ordinary income the net capital gain with respect to an investment services partnership interest except to the extent such gain is attributable to a partner's qualified capital interest, (3) exempt income from investment services partnership interests from treatment as qualifying income of a publicly traded partnership, (4) exempt certain family partnerships from the application of this bill; (5) increase the penalty for underpayments of tax resulting from failure to treat income from an investment services partnership interest as ordinary income, and (6) include income and loss from an investment services partnership interest for purposes of determining net earnings from self-employment and applicable self-employment taxes. Creating Higher Education Affordability Necessary to Compete Economically Act or the Middle Class CHANCE Act This bill amends title IV (Student Assistance) of the Higher Education Act of 1965 to modify provisions related to the Federal Pell Grant program. Specifically, it increases the maximum Federal Pell Grant award for academic year 2018-2019 and adjusts it in subsequent award years to account for changes in the Consumer Price Index. The bill also increases from one to two the number of Pell Grants an eligible student may receive in a single award year (i.e., it restores year-round Pell Grants). A student's total amount of Pell Grants must not exceed 150% of the maximum Pell Grant for that award year. Also, any period during which a student receives an additional Pell Grant counts toward that student's lifetime Pell Grant eligibility period. Finally, the bill increases from 12 to 15 semesters a student's lifetime Pell Grant eligibility period.

Veterans Dog Training Therapy Act This bill directs the Department of Veterans Affairs (VA) to carry out a five-year pilot program to assess the effectiveness of addressing veterans' post-deployment mental health and post-traumatic stress disorder symptoms through the therapeutic medium of training service dogs for veterans with disabilities. The VA shall: seek to enter into contracts with non-government entities that are certified in the training and handling of service dogs and that are located in close proximity to at least three but not more than five VA medical centers, provide such entities access to a training area in a VA facility that would be appropriate for use in educating veterans with mental health conditions in service dog training and handling, administer the program through the Center for Compassionate Innovation of the Veterans Health Administration in collaboration with the Recreation Therapy Service under the direction of a certified recreational therapist, and establish a director of therapeutic service dog training. Veterans may participate in the program in conjunction with the VA's compensated work therapy program.

Access to Contraception for Women Servicemembers and Dependents Act of 2017 This bill expands the TRICARE health care program to entitle additional female beneficiaries and dependents to care related to the prevention of pregnancy. (Currently, such care is limited to certain female members of the uniformed service or a reserve component performing active duty or certain servicewomen performing inactive-duty training.) Cost-sharing may not be imposed or collected for such pregnancy prevention care, including for any method of contraception provided through a facility of the uniformed services, the TRICARE retail pharmacy program, or the national mail-order pharmacy program. Such pregnancy prevention care shall include: (1) all methods of contraception approved by the Food and Drug Administration (FDA), (2) contraceptive care, (3) sterilization procedures, and (4) patient education and counseling. The Department of Defense shall establish a uniform standard curriculum to be used in family planning education programs for all men and women members of the Armed Forces. Every military treatment facility, upon request, shall provide emergency contraception, information about FDA-approved methods of emergency contraception, and notification of confidentiality rights to any woman who: (1) states, or is accompanied by another individual who states, that the woman is a victim of sexual assault; or (2) is reasonably believed to be a survivor of sexual assault.

Flags of Convenience Don't Fly Here Act This bill bars the Department of Transportation (DOT) from issuing a foreign air carrier permit or an exemption from certain air carrier certificate requirements to a person to provide foreign air transportation under the United States-European Union Air Transport Agreement of April, 2007, in a proceeding in which the applicability of Article 17 bis of such Agreement has been raised by an interested person, unless DOT: finds that issuing the permit or exemption would be consistent with the intent set forth in Article 17 bis of the agreement, that opportunities created by the agreement do not undermine labor standards or the labor-related rights and principles contained in the laws of the respective parties to the agreement; and imposes conditions on the permit or exemption necessary to ensure that the person complies with the intent of Article 17 bis . In carrying out such air carrier certificate requirements, DOT shall consider preventing entry of flag of convenience carriers into U.S. markets as being in the public interest and consistent with public convenience and necessity for safety in air transportation and air commerce. In formulating U.S. international air transportation policy, the Department of State and DOT shall develop a negotiating policy emphasizing the greatest degree of competition for a well-functioning air transportation system that eliminates specified discriminatory and unfair competitive practices faced by U.S. airlines in foreign air transportation, to include erosion of labor standards associated with flag of convenience carriers. A "flag of convenience carrier" is defined as a foreign air carrier that is established in a country other than the home country of its majority owner or owners in order to avoid the home country's regulations.

Northern Rockies Ecosystem Protection Act

Northern Rockies Ecosystem Protection Act This bill designates specified National Forest System lands, National Park System lands, and public lands in Idaho, Montana, Oregon, Washington, and Wyoming as wilderness and as components or additions to existing components of the National Wilderness Preservation System. The bill also designates specified federal lands as biological connecting corridors and as special corridor management areas. The Wild and Scenic Rivers Act is amended to designate segments of specified rivers and creeks in Idaho, Montana, and Wyoming as components of the National Wild and Scenic Rivers System. The bill designates specified areas as wildland recovery areas. The Department of Agriculture shall develop a wildland recovery plan for each recovery area. A specified panel of independent scientists shall study roadless lands greater than 1,000 acres that are within the National Forest System in the Wild Rockies bioregion in Idaho, Montana, Oregon, Washington, or Wyoming and that are not designated as components of the National Wilderness Preservation System for their role in maintaining biological diversity in the Northern Rockies and as part of the overall forest reserve system. Any new road construction or reconstruction or timber harvest is prohibited in those lands after the evaluation without an Act of Congress. Oil or gas leasing, mining, or other development which impairs the natural and roadless qualities of the land is also prohibited. The Department of the Interior may apply the Indian Self-Determination and Education Assistance Act in carrying out this bill.

Therapeutic Fraud Prevention Act of 2017 This bill prohibits sexual orientation or gender identity conversion therapy from being provided in exchange for monetary compensation. It bars advertisements for such therapy that claim to: (1) change an individual's sexual orientation or gender identity, (2) eliminate or reduce sexual or romantic attractions or feelings toward individuals of the same gender, or (3) be harmless or without risk. Individuals or entities shall not assist or facilitate a conversion therapy if they receive monetary compensation from any source in connection with providing such therapies. These prohibitions are inapplicable to practices or treatments that do not seek to change sexual orientation or gender identity if they provide: (1) assistance to an individual undergoing a gender transition; or (2) acceptance, support, and understanding of clients or facilitation of clients' coping, social support, and identity exploration and development, including sexual orientation-neutral interventions to prevent or address unlawful conduct or unsafe sexual practices. The Federal Trade Commission and states are provided authority to enforce against violations.
