Veterans Information Security Improvement Act

Veterans Information Security Improvement Act Directs the Secretary of Veterans Affairs to: (1) carry out certain information security activities, (2) ensure that officials and staff of the Department of Veterans Affairs (VA) possess specified qualifications in such areas, and (3) coordinate the staffing of related information technology and security offices. Requires the Secretary to ensure that: (1) the Assistant Secretary for Information and Technology, the head of the Office of Information Security (OIS), and relevant field staff possess certain levels of information technology education, certifications, and experience; (2) Office of Information and Technology (OIT) staff are assigned to the OIS; and (3) subordinate OIT offices maintain appropriate information security functions. Directs the Secretary to ensure that subordinate OIT offices maintain functions to: (1) integrate the VA's security architecture into the VA's overall enterprise architecture strategy, (2) restrict the development of new data warehouses and data marts holding sensitive personal information of veterans, (3) reduce the number of data marts holding such personal information, and (4) deploy an incident response capability. Defines: "data mart" as a subset of a data warehouse that contains information for a specific entity of an organization rather than the entire organization, and "data warehouse" as a collection of data designed to support management decision making that contains a wide variety of data presenting a coherent picture of business conditions for an entire organization at a single point in time and whose development includes systems to extract data from operating systems plus installation of a warehouse database system that provides managers with flexible data access. Requires the Secretary to safeguard VA network infrastructure, computers, and servers. Directs the Secretary to protect the confidentiality of sensitive personal information of veterans by: providing upgrades or phaseouts of outdated or unsupported operating systems to protect against harmful viruses and malicious software; and securing VA web applications and the Veterans Health Information Systems and Technology Architecture (commonly referred to as the "Vista system," which allows for an integrated inpatient and outpatient electronic health record for patients and provides administrative tools to VA employees). Directs the Secretary to submit certifications to Congress regarding the VA's compliance with information security requirements, including actions required by the National Institute of Standards and Technology and the Office of Management and Budget. Requires the Secretary to submit monthly reports to Congress regarding security vulnerabilities discovered after performing regular scans of VA computers and servers.

Concrete Masonry Products Research, Education, and Promotion Act of 2015

Concrete Masonry Products Research, Education, and Promotion Act of 2015 This bill directs the Secretary of Commerce to issue orders applicable to manufacturers of concrete masonry products. Any such order must provide for the establishment of a Concrete Masonry Products Board to carry out a program of promotion, research, and information regarding concrete masonry products. Manufacturers and importers shall maintain, and make available, specified records. An order must also provide that assessments be paid by concrete masonry product manufacturers with respect to concrete masonry products manufactured and marketed in the United States. Assessment rates are specified. At least 50% of the assessments paid by a manufacturer must be used to support research, education, and promotion plans and projects in support of the geographic region of the manufacturer. During the 60-day period preceding the proposed effective date of an order, the Secretary shall conduct a referendum for order approval among the manufacturers required to pay assessments under it. Referendum procedures are outlined. The bill allows petition and review of an order, and order enforcement through U.S. district courts. The Secretary: (1) may conduct appropriate investigations in order to administer this Act (with power of subpoena); and (2) must suspend or terminate any order or provision that obstructs or does not tend to effectuate the purposes of this Act, or that is not favored by persons voting in a referendum.

English Language Unity Act of 2015

English Language Unity Act of 2015 Establishes English as the official language of the United States. Requires naturalization ceremonies and official functions of the U.S. government, subject to exceptions, to be conducted in English. Declares that all citizens should be able to read and understand generally the English language text of U.S. laws. Allows a person injured by a violation of this Act to obtain relief, including a declaratory judgment, in a civil action. Declares that English language requirements and workplace policies, whether in the public or private sector, shall be presumptively consistent with U.S. laws. Requires any ambiguity in U.S. laws to be resolved in accordance with the rights retained by the people and the powers reserved to states under the Bill of Rights. Directs the Department of Homeland Security to issue a proposed rule for uniform testing of the English language ability of candidates for naturalization based upon the principles that: (1) all citizens should be able to read and understand generally the English language text of the Declaration of Independence, the Constitution, and the laws of the United States; and (2) any exceptions to this standard should be limited to extraordinary circumstances, such as asylum.

ROV In-Depth Examination Act The Consumer Product Safety Commission shall have no authority to: (1) establish recreational off-highway vehicle (ROV) performance or configuration standards until the study required by this Act is completed, or (2) require ROV manufacturers to provide performance and technical data to prospective purchasers and to the first purchaser of an ROV for purposes other than resale. The Commission shall contract with the National Academy of Sciences to determine: the technical validity of the lateral stability and vehicle handling requirements proposed by the Commission for purposes of reducing the risk of ROV off-road rollovers, the number of ROV rollovers that would be prevented if the proposed requirements were adopted, whether there is a technical basis for the proposal to provide information on a point-of-sale hangtag about a vehicle's rollover resistance on a progressive scale, and the effect on the utility of ROVs used by the Armed Forces if the proposed requirements were adopted.

Orphan Product Extensions Now Accelerating Cures and Treatments Act of 2015 Amends the Federal Food, Drug, and Cosmetic Act to require the Food and Drug Administration (FDA) to extend by six months the exclusivity period for an approved drug or biological product when the product is additionally approved to prevent, diagnose, or treat a new indication that is a rare disease or condition (also known as an “orphan disease”). Allows the FDA to revoke an extension if the application for the new indication contained an untrue material statement. Requires the sponsor of a product receiving an extension to notify the FDA one year prior to discontinuing production for commercial reasons. Requires the FDA to notify the public of products that receive this extension and patents related to those products. Limits a product to one extension under this Act. Sets forth that extensions under this Act are in addition to other extensions. Applies only to products approved after enactment of this Act for a new indication that is a rare disease or condition.

Health Care Conscience Rights Act Amends title I of the Patient Protection and Affordable Care Act to declare that nothing in that title requires an individual to purchase individual health insurance coverage that includes coverage of an abortion or other item or service to which the individual has a moral or religious objection, or prevent an issuer from offering coverage excluding such item or service to that individual. Denies that title I requires a health plan sponsor or a health insurance issuer to cover an item or service to which the sponsor or issuer has a moral or religious objection. Denies also that title I authorizes imposition of a tax, penalty, fee, fine, or other sanction, or imposition of coverage of such an item or service, on health insurance coverage that excludes such an item or service. Amends the Public Health Service Act to codify the prohibition against any action by the federal government and any state or local government receiving federal financial assistance to subject a health professional, or health care facility, organization, or plan to discrimination on the basis that the entity refuses to participate in abortion-related activities. Requires the Department of Health and Human Services (HHS) to designate the Director of the Office for Civil Rights of HHS to receive and investigate complaints alleging a violation of this abortion discrimination prohibition. Creates a cause of action for the Attorney General or any person or entity adversely affected to obtain equitable or legal relief for any violation of this abortion discrimination prohibition. Allows commencement of an action and the granting of relief without a prerequisite pursuit of administrative remedies. Allows such an action against a federal or state governmental entity.

Boys Town Centennial Commemorative Coin Act Directs the Secretary of the Treasury to mint and issue up to 50,000 $5 gold coins, 350,000 $1 silver coins, and 300,000 half-dollar clad coins to commemorate the centennial of the founding of Father Flanagan's Boys Town. Requires the design of the coins to be emblematic of the 100 years of Boys Town, one of the largest nonprofit child care agencies in the United States. Permits issuance of such coins only between January 1, 2017, and December 31, 2017. Subjects all coin sales to specified surcharges, which shall be paid to Boys Town to carry out its cause of caring for and assisting children and families in underserved communities across America. Directs the Secretary to ensure that: (1) minting and issuing such coins will not result in any net cost to the federal government; and (2) no funds, including surcharges, will be disbursed to Boys Town until the total cost of designing and issuing all authorized coins is recovered by the Treasury.

(The rule requires the Secretary to set nutrition standards for all foods sold in schools that are not foods sold under the school lunch and breakfast programs.)

United States-Israel Trade and Commercial Enhancement Act This bill states that among the principal U.S. trade negotiating objectives for trade agreements with foreign countries regarding commercial partnerships are to: discourage actions by potential trading partners that discourage commercial activity solely between the United States and Israel; discourage politically motivated actions to boycott, divest from, or sanction Israel and to seek the elimination of politically motivated non-tariff barriers on Israeli commerce; and seek the elimination of state-sponsored unsanctioned foreign boycotts against Israel or compliance with the Arab League Boycott of Israel. The President is directed to report annually to Congress on politically motivated acts of boycott, divestment from, and sanctions against Israel. The Securities Exchange Act of 1934 is amended to require a foreign issuer traded on the U.S. stock market to disclose in its quarterly or annual report: whether the issuer has discriminated against doing business with Israel in the last calendar year; whether the issuer has been advised by a foreign government or a non-member state of the United Nations (U.N.) to discriminate against doing business with Israel, entities owned or controlled by Israel, or entities operating in Israel or Israeli-controlled territory; and any instances where the issuer has learned that a person, foreign government, or a non-member state of the U.N. is boycotting the issuer, divesting itself of an ownership interest in the issuer, or placing sanctions on the issuer because of the issuer's relationship with Israel. No U.S. court may recognize or enforce any judgment by a foreign court against a U.S. person carrying out business operations in Israel or in any territory controlled by Israel, and on which is based a determination by the foreign court that the location in Israel, or in any territory controlled by Israel, of the facilities at which the business operations are carried out is sufficient to constitute a violation of law.

Fairness in Ambulance Reimbursement Act of 2015 This bill directs the Secretary of Health and Human Services to suspend through December 31, 2015, implementation of the reclassification of rural to urban zip codes for payments under the fee schedule for ambulance services, as contained in the final rule published in the Federal Register by the Centers for Medicare & Medicaid Services on November 13, 2014. The Secretary is required to ensure that claims for ambulance services furnished on or after July 1, 2015, are paid according to the classification of zip codes applied the day before the effective date of that final rule. The Secretary must reclassify rural to urban zip codes for payment for ambulance services furnished on or after January 1, 2016, taking into account specified revised geographic delineations of the Office of Management and Budget. Payments for ambulance services (other than air ambulance services) furnished during 2016 must be adjusted according to a certain formula to achieve budget-neutral results.

Requires the GAO's report to include: (1) advantages and disadvantages of such a relinquishment of the NTIA's responsibility; (2) any principles or criteria that the NTIA sets for relinquishment proposals, as well as an analysis of each proposal received by the NTIA; (3) the processes used by the NTIA and any other federal agencies for evaluating proposals; (4) any national security or network security concerns; and (5) a definition of "multistakeholder model" as used by the NTIA with respect to Internet policymaking and governance.

Child Interstate Abortion Notification Act

Child Interstate Abortion Notification Act Amends the federal criminal code to prohibit transporting a minor child across a state line to obtain an abortion (deems such transporting to be a de facto abridgment of the right of a parent under any law in the minor’s state of residence that requires parental involvement in the minor’s abortion decision). Makes an exception for an abortion necessary to save the life of the minor. Makes it an affirmative defense to a prosecution or civil action under this Act that a defendant: (1) reasonably believed that before the minor obtained the abortion, the required parental consent or notification or judicial authorization took place; or (2) was presented with documentation showing that a court waived parental notification requirements or authorized the minor's abortion. Defines "abortion" to mean the use or prescription of any instrument, medicine, drug, or any other substance or device: (1) to intentionally kill the unborn child of a woman known to be pregnant; or (2) to intentionally prematurely terminate the pregnancy of a woman known to be pregnant with an intention other than to increase the probability of a live birth or of preserving the life or health of the child after live birth, or to remove a dead unborn child. Imposes a fine and/or prison term of up to one year on a physician who performs or induces an abortion on an out-of-state minor in violation of parental notification requirements. Requires such physician to give 24-hour actual or constructive notice to a parent of the minor seeking an abortion, subject to certain exceptions.

Email Privacy Act Amends the Electronic Communications Privacy Act of 1986 to prohibit a provider of remote computing service or electronic communication service to the public from knowingly divulging to a governmental entity the contents of any communication that is in electronic storage or otherwise maintained by the provider, subject to exceptions. Revises provisions under which the government may require a provider to disclose the contents of such communications. Eliminates the different requirements applicable under current law depending on whether such communications were: (1) stored for fewer than, or more than, 180 days by an electronic communication service; or (2) held by an electronic communication service as opposed to a remote computing service. Requires the government to obtain a warrant from a court before requiring providers to disclose the content of such communications regardless of how long the communication has been held in electronic storage by an electronic communication service or whether the information is sought from an electronic communication service or a remote computing service Requires a law enforcement agency, within 10 days after receiving the contents of a customer's communication, or a governmental entity, within 3 days, to provide a customer whose communications were disclosed by the provider a copy of the warrant and a notice that such information was requested by, and supplied to, the government entity. Allows the government to request delays of such notifications. Prohibits disclosure requirements that apply to providers from being construed to limit the government's authority to use an administrative or civil discovery subpoena to require: (1) an originator or recipient of an electronic communication to disclose the contents of such communication, or (2) an entity that provides electronic communication services to its employees or agents to disclose the contents of an electronic communication to or from such employee or agent if the communication is on an electronic communications system owned or operated by the entity. Allows the government to apply for an order directing a provider, for a specified period, to refrain from notifying any other person that the provider has been required to disclose communications or records. Directs the Comptroller General to report to Congress regarding disclosures of customer communications and records under provisions: (1) as in effect before the enactment of this Act, and (2) as amended by this Act.

States that nothing in this Act shall be construed to: (1) preempt any state law prohibiting gambling; or (2) alter, limit, or extend the relationship between the Interstate Horseracing Act of 1978 and other federal laws currently in effect, the ability of a state licensed lottery retailer to make in-person, computer-generated retail lottery sales, or the relationship between federal laws and state charitable gaming laws.

Justice and Mental Health Collaboration Act of 2015 Amends the Mentally Ill Offender Treatment and Crime Reduction Act of 2004 to: (1) expand the assistance provided under such Act, and (2) reauthorize appropriations for FY2016-FY2020. Authorizes the Attorney General to award grants to establish or expand: (1) veterans treatment court programs, which involve collaboration among criminal justice, veterans, and mental health and substance abuse agencies to provide qualified veterans (preliminarily qualified offenders who were discharged from the armed forces under conditions other than dishonorable) with intensive judicial supervision and case management, treatment services, alternatives to incarceration, and other appropriate services, including housing, transportation, job training, education, and assistance in obtaining benefits; (2) peer to peer services or programs to assist such veterans in obtaining treatment, recovery, stabilization, or rehabilitation; (3) practices that identify and provide treatment, rehabilitation, legal, transitional, and other appropriate services to such veterans who have been incarcerated; and (4) training programs to teach criminal justice, law enforcement, corrections, mental health, and substance abuse personnel how to identify and respond to incidents involving such veterans. Revises the definition of "preliminarily qualified offender" to include, in the case of a veterans treatment court program, an adult or juvenile accused of an offense who has been diagnosed with, or manifests obvious signs of, mental illness or a substance abuse disorder or co-occurring mental illness and substance abuse disorder. Removes a requirement that the adult or juvenile be accused of a nonviolent offense. Requires preliminarily qualified offenders to be unanimously approved for participation in a collaboration program by, when appropriate, the relevant prosecuting attorney, defense attorney, probation or corrections official, judge, and representative from the relevant mental health agency. Authorizes the Attorney General to award grants to enhance the capabilities of a correctional facility to: (1) identify and screen for mentally ill inmates; (2) plan and provide assessments of the clinical, medical, and social needs of inmates and appropriate treatment and services that address mental health and substance abuse needs; (3) develop, implement, and enhance post-release transition plans that coordinate services and public benefits, the availability of mental health care and substance abuse treatment services, alternatives to solitary confinement and segregated housing, and mental health screening and treatment for inmates placed in solitary confinement or segregated housing; and (4) train employees in identifying and responding to incidents involving inmates with mental health disorders or co-occurring mental health and substance abuse disorders. Authorizes the Attorney General to make grants to provide support for programs that teach law enforcement personnel how to identify and respond to incidents involving persons with such disorders. Directs the Attorney General to give priority in awarding grants for adult or juvenile collaboration programs to applications that: (1) propose interventions that have been shown by empirical evidence to reduce recidivism, and (2) use validated assessment tools to target preliminarily qualified offenders with a moderate or high risk of recidivism and a need for treatment and services.

Directs the Secretary of Health and Human Services to study how the conversion factor should be modified, if at all, to take into account the cost of providing ambulance services in urban, rural, and super-rural areas. Directs the Secretary to establish a process to determine, in advance of furnishing end stage renal disease ambulance services, whether payment for them may not be made because they are not covered or because they are excluded from coverage. Prohibits any payment unless the Secretary determines, pursuant to this process, that the service meets coverage requirements. Directs the Secretary to develop a data collection system for ambulance providers to collect cost, revenue, utilization, and other appropriate information.

Defines "investigative leave" as a temporary absence without duty for disciplinary reasons, of a period not greater than 90 days. Authorizes a federal agency to: (1) place an SES employee on investigative leave, without loss of pay and without charge to annual or sick leave, only for misconduct, neglect of duty, malfeasance, or misappropriation of funds; (2) place such employee on leave without pay if such employee's conduct is flagrant and such employee intentionally engaged in such conduct; or (3) remove such employee if such employee acted in a manner that endangers the interest of the agency mission and the removal is deemed necessary or advisable in the interests of the United States. Requires an agency head to periodically review the investigation into the conduct of an SES employee placed on investigative leave and take certain actions with respect to such employee at the end of a period of investigative leave, including removal, suspension without pay, or reinstatement to duty. Grants an employee placed on investigative leave certain rights, including: (1) advance written notice of, and the right to answer, charges; (2) the right to be represented by an attorney; and (3) the right to appeal to the Merit Systems Protection Board. Includes misappropriation of funds as a ground in suspending or reinstating an SES employee or placing such employee in another civil service position.

The Army Corps and the EPA must withdraw the interpretive rule entitled, "Notice of Availability Regarding the Exemption from Permitting Under Section 404(f)(1)(A) of the Clean Water Act to Certain Agricultural Conservation Practices," issued on April 21, 2014. The Army Corps and the EPA are required to consult with relevant state and local officials to develop recommendations for a regulatory proposal that would identify the scope of waters covered under the Clean Water Act and the scope of waters not covered.
