Medical Leave for Disabled Veterans Act

Medical Leave for Disabled Veterans Act This bill amends the Family and Medical Leave Act of 1993 (FMLA) to provide eligibility for specified medical/hospital care for an employee who: (1) has a Department of Veterans Affairs (VA) disability rating of between 30% and 50% and at least 833 hours of service with the employer (from whom leave is requested) during the previous eight-month period, or (2) has a VA disability rating of 60% or higher and at least 625 hours of service with such employer during the previous 6-month period. Medical/hospital leave shall also be provided to an employee who is not covered by the above provision but who retired from the Armed Forces by reason of a service-connected disability: (1) rated at between 30% and 50% at retirement and who has at least 833 hours of service with such employer during the previous eight-month period, or (2) rated at 60% or higher at retirement and who has at least 625 hours of service with such employer during the previous 6-month period. (Under current law, employees of an FMLA-covered employer become eligible for medical leave after 12 months on the job and at least 1,250 hours of service with such employer during the previous 12-month period.) A employee must submit a certification to the employer from the VA or the Department of Defense, as appropriate, to be eligible for such adjustment.

This bill directs the Department of Veterans Affairs to treat ambulance services as reimbursable emergency services if: the ambulance request was made because of the sudden onset of a medical condition of such nature that a prudent layperson would have reasonably expected that a delay in seeking immediate medical attention would have been hazardous to the individual or could reasonably expect the absence of immediate medical attention to result in placing the individual in serious jeopardy, and the individual is transported to the closest and most appropriate medical facility capable of treating such emergency medical condition.

This bill provides FY2016 emergency supplemental appropriations to the Departments of State and Health and Human Services (HHS) to prevent, prepare for, and respond to the Zika virus and other infectious diseases. The bill specifies permissible uses for the funds and designates the funds as an emergency requirement, which exempts the funds from discretionary spending limits. The bill provides appropriations to HHS for: the Food and Drug Administration, the Centers for Disease Control and Prevention, the National Institutes of Health, and the Public Health and Social Services Emergency Fund. The bill amends the Public Health Service Act to permit Project BioShield to be used to support the advanced development and procurement of medical countermeasures to diagnose, mitigate, prevent, or treat harm from any infectious disease that may pose a threat to the public health. (Under current law, Project BioShield supports only countermeasures against specific chemical, biological, radiological, and nuclear terrorist threats.) The bill temporarily increases from 55% to 65% the Medicaid Federal Medical Assistance Percentage in the territories (Puerto Rico, the U.S. Virgin Islands, Guam, American Samoa, and the Northern Mariana Islands). The bill provides appropriations to the Department of State for: the Administration of Foreign Affairs, the U.S. Agency for International Development, Bilateral Economic Assistance, International Security Assistance, and Multilateral Assistance. Unobligated balances of specified funds provided for the Ebola virus may be used to respond to the Zika virus and other infectious diseases.

PROTECT Act

Prevent Retaliation and Open up Transparency to Expand Care for Troops Act of 2016 or the PROTECT Act This bill amends the Uniform Code of Military Justice to establish the offense of retaliation. Retaliation provisions require that any person subject to the code who, with the intent to retaliate against any person for reporting or planning to report a criminal offense, or with the intent to discourage any person from reporting a criminal offense, wrongfully takes or threatens to take an adverse personnel action against any person, or wrongfully withholds or threatens to withhold a favorable personnel action with respect to any person, shall be punished as a court-martial may direct. The Department of Defense (DOD) shall prescribe uniform standards for conduct of each of the following functions at all stages of the military justice system, including pretrial, trial, post-trial, and appellate processes: collection and analysis of data concerning substantive offenses and procedural matters in a manner that facilitates case management and decision making and enhances the quality of periodic reviews; case processing and management; timely and accurate production and distribution of trial records; and facilitation of access to docket information, filings, and records. Each military department shall ensure that any individual investigating an allegation of retaliation against a person who has made a protected communication must have training in the definition and characteristics of retaliation. If the investigation involves alleged retaliation in response to a communication regarding rape, sexual assault, or other sexual misconduct, the training shall include specific instruction regarding such violations. It is the sense of Congress that DOD should ensure that its medical and mental health providers are adequately trained to meet the needs of male survivors of military sexual trauma.

The bill includes an exception for legislation that increases guarantee fees to finance reforms to the secondary mortgage market. (Guarantee fees are charged by enterprises, such as the Federal National Mortgage Association [Fannie Mae] and the Federal Home Loan Mortgage Corporation [Freddie Mac], to guarantee the payment of principal and interest on loans. This bill prevents the fees from being used to offset provisions that increase the deficit in determining whether a budget point of order applies to legislation.)

Military Parental Leave Modernization Act

Military Parental Leave Modernization Act This bill revises military parental leave requirements to state that: a member of the armed forces, regardless of gender or marital status, shall be authorized to take at least 84 days of parental leave in connection with the birth of a child, a qualifying adoption of a child, or the placement of a child in foster care with the service member; and in the case of a dual military family, both service members shall be authorized to take parental leave. (The Department concerned shall permit the transfer of such leave between the two service members to accommodate individual family circumstances.) Such parental leave shall be in addition to other leave. Convalescent or other leave taken before childbirth by a pregnant service member shall not reduce the number parental leave days.

Puppies Assisting Wounded Servicemembers (PAWS) Act of 2016 This bill directs the Department of Veterans Affairs (VA), through the Office of Patient Centered Care and Cultural Transformation, to carry out a five-year pilot program under which the VA shall provide service dogs and veterinary health insurance to certain veterans who: (1) served on active duty on or after September 11, 2001; and (2) were diagnosed with, and continue to suffer from, post-traumatic stress disorder. The provision of a service dog shall be done in addition to other types of treatment for post-traumatic stress disorder and shall not replace established treatment modalities.

Fairness for Veterans Act of 2016 This bill addresses medical evidence reviews in the case of: (1) a former member of the Armed Forces who was deployed in a contingency operation and subsequently diagnosed as suffering from post-traumatic stress disorder or traumatic brain injury as a consequence of such deployment, or (2) a former member whose application for relief from the terms of his or her military discharge is based in whole or in part on matters relating to post-traumatic stress disorder or traumatic brain injury related to combat or military sexual trauma. Any board of review shall: review medical evidence of the Department of Veterans Affairs or a civilian health care provider presented by the former member, and review the case with a rebuttable presumption in favor of the former member that post-traumatic stress disorder or traumatic brain injury materially contributed to the circumstances resulting in the discharge of a lesser characterization.

Veteran Urgent Access to Mental Healthcare Act This bill directs the Department of Veterans Affairs (VA) to establish a program to provide former members of the Armed Forces with: (1) an initial mental health assessment; and (2) health care services required to treat the former member's urgent mental health care needs, including risk of suicide or harming others. A former member of the Armed Forces is an individual who meets either of the following criteria: the individual is a former member of the Armed Forces, including the reserve components, who served in the active military, naval, or air service, and was discharged or released under a condition less than honorable (except a dishonorable or bad conduct discharge by reason of a general court martial), has applied for a character of service determination that has not yet been made, and is not otherwise eligible to enroll in the VA health care system by reason of such discharge or release; or the individual is a veteran not otherwise eligible for VA health care. The VA may provide such mental health care services pursuant to a contract with a qualified mental health professional if: (1) the receipt of mental health care services by an individual in VA facilities would be clinically inadvisable, or (2) VA facilities are not capable of furnishing such mental health care services to that individual economically because of geographical inaccessibility. The VA shall seek to enter into a contract with an independent nongovernmental entity to study the effect combat service has had on suicide rates and serious mental health issues among veterans.

The report shall include a description of: actions in bilateral and multilateral fora to address the issue of rights for Jewish refugees from Arab countries; and measures to help ensure that the interests of Jews displaced from Arab countries and Iran and of all refugees displaced as a result of the Arab-Israeli conflict, including Arabs, Jews, Christians, and other groups, are considered in any final settlement of the Middle East refugee question that is part of any comprehensive Arab-Israeli peace.

Assistance, Quality, and Affordability Act of 2016 This bill amends the Safe Drinking Water Act to reauthorize the Act through FY2021. The bill sets forth requirements concerning Safe Drinking Water Act State Revolving Fund (SRF) projects, including mandates for the use of bond sales, mandates to produce goods in the United States, and mandates to provide prevailing wages to laborers and mechanics. The bill makes changes to provisions that states must include in their Intended Use Plans, including data on variances, exemptions, and persistent violations. The bill amends the Safe Drinking Water Act to provide additional assistance to public water systems that serve disadvantaged communities. The bill increases the portion of SRF funds that states may reserve to provide technical assistance to public water systems. Additionally, the bill increases the funds that may be reserved by the Environmental Protection Agency (EPA) for use in the District of Columbia, American Samoa, Northern Mariana Islands, Guam, and the Virgin Islands. The EPA must: (1) study the presence of pharmaceuticals and personal care products in drinking water sources, (2) establish requirements for electronic submission of compliance monitoring data by public water systems, (3) collect data on best practices for administration of SRF programs, (4) implement a certification program for effective water leak control technology, (5) develop a strategic plan for assessing and managing the risks of drought to drinking water, (6) establish a grant program to assist water systems in improving drinking water resiliency and sustainability, and (7) establish a grant program to remove lead service lines from public water systems.

Fair Day in Court for Kids Act of 2016

Fair Day in Court for Kids Act of 2016 This bill amends the Immigration and Nationality Act (INA) authorize the Department of Justice (DOJ) to appoint or provide counsel at government expense to aliens in removal proceedings. The Department of Homeland Security (DHS) shall provide an alien in removal proceedings with all relevant documents in its possession, unless the alien has knowingly waived the right to such documents. In the absence of a waiver a removal proceeding may not proceed until the alien has received, and had time to review, the documents. DOJ may appoint or provide counsel to aliens in any INA proceeding. DHS shall ensure that aliens have access to counsel inside all immigration detention and border facilities. DOJ shall appoint counsel, at government expense if necessary, for an unaccompanied alien child or a particularly vulnerable individual. If DOJ has consolidated any such alien's case with that of any other alien, and that other alien does not have counsel, then the appointed counsel shall be appointed to represent the other alien as well. DHS shall: (1) facilitate access to counsel for all aliens detained in facilities under the supervision of U.S. Immigration and Customs Enforcement or of U.S. Customs and Border Protection (CBP); and (2) establish procedures to ensure that legal orientation programs are available for all detained aliens, including aliens held in CBP facilities. DOJ shall develop and administer a two-year pilot program at not fewer than two immigration courts to grant access to legal information to non-detained aliens with pending asylum claims. DHS shall establish a pilot program to increase the court appearance rates of unaccompanied alien children and particularly vulnerable individuals by contracting with nongovernmental, community-based organizations to provide such aliens with case management services. The pilot program shall not be used to monitor individuals designated as unaccompanied alien children under the Homeland Security Act. If DOJ fails to appoint counsel for an unaccompanied alien child or vulnerable person: (1) no limitation pertaining to the filing of any motion to reopen the removal proceeding shall apply, and (2) the filing of such a motion shall stay the removal of the alien.

Veteran Suicide Prevention Act

Veteran Suicide Prevention Act This bill directs the Department of Veterans Affairs (VA) to complete a publicly available review of the deaths of all covered veterans who died by suicide during the preceding five-year period. Such review shall include: the total number of veterans who died by suicide during the five-year period; a summary that includes age, gender, and race; a list of the medications prescribed to, and found in the systems of, such veterans at the time of their deaths, and a summary of medical diagnoses by VA physicians which led to the prescribing of such medications; the number of instances in which the veteran was concurrently on multiple medications prescribed by VA physicians; the percentage of veterans who were not taking any medication prescribed by a VA physician; the percentage of veterans with combat experience or trauma; Veterans Health Administration facilities with markedly high prescription and patient suicide rates; a description of VA policies governing the prescribing of medications; and recommendations to improve the safety and well-being of veterans. "Covered veteran" means any veteran who received VA hospital care or medical services during the five-year period preceding the veteran's death.

Keeping American Jobs Act This bill amends the Immigration and Nationality Act to prohibit the admission of an H-1B visa (specialty occupation) nonimmigrant worker if the Department of Labor determines that the H-1B application was filed by the prospective employer for the primary purpose of using one or more U.S. workers to train the H-1B worker in the job duties and responsibilities of the U.S. workers in order to lay off the U.S. workers and move their job or jobs abroad, unless the application states that the employer did not and will not displace a U.S. worker within the period beginning 90 days before and ending 90 days after the date of filing of any visa petition supported by the application.

Naismith Memorial Basketball Hall of Fame Commemorative Coin Act

Naismith Memorial Basketball Hall of Fame Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue not more than 50,000 $5 coins, 400,000 $1 coins, and 750,000 half-dollar coins in recognition and celebration of the Naismith Memorial Basketball Hall of Fame. The coins shall be in the shape of a dome, and the design on the common reverse of the coins shall depict a basketball. Treasury shall hold a competition to determine the design of the common obverse of the coins, which shall be emblematic of the game of basketball. The bill requires all sales of such coins to include specified surcharges, which shall be paid by Treasury to the Hall to fund an endowment for its operations.

Gas Pump Access Act of 2016 This bill declares that it shall be a prohibited form of discrimination against individuals with disabilities in a place of public accommodation under the Americans with Disabilities Act of 1990 for a gas station or convenience store to fail to clearly display at each self-service gas pump a decal that includes its telephone number and the words "Call for Assistance." A gas station or convenience store that is open for business to the public with at least two attendants on duty must provide gas pumping assistance to a qualified individual with a disability who makes a request for such assistance. But it shall not be considered discrimination for a gas station or convenience store with one attendant on duty to fail to provide such requested gas pumping assistance if such attendant notifies the individual that assistance cannot be provided because there is only one attendant on duty. The Department of Transportation and the Department of Justice must promulgate regulations necessary to ensure compliance with this bill and make graphics for the decals publicly available on their websites.

POSTURE Act

The bill sets forth: FY2016 Army, Marine Corps, and Selected Reserve strength levels; and Army, Navy, Marine Corps, and Air Force permanent active duty end strength minimum levels. Any proposal to lower the end strength levels established by this Act must first be approved by Congress through enactment of a law to that effect.

Lake Berryessa Recreation Enhancement Act of 2016

Lake Berryessa Recreation Enhancement Act of 2016 This bill establishes as the Lake Berryessa Recreation Area specified land administered by the Bureau of Reclamation that is underlying or adjacent to Lake Berryessa in California, including any improvements. The bill transfers the administrative jurisdiction over the area from the Bureau of Reclamation to the Bureau of Land Management (BLM) of the Department of the Interior. Interior shall develop a management plan for the area and may establish guidelines and restrictions on recreational uses to ensure the safety and security of recreational users. Interior may also issue recreation concession permits, including at the area, to allow a third party to provide facilities and services to visitors on lands and waters managed by the BLM in support of outdoor recreational opportunities. Reclamation shall continue to administer and operate the Monticello Dam and any related facility, including any power facility.

Rights for Transportation Security Officers Act of 2016

Rights for Transportation Security Officers Act of 2016 This bill repeals: (1) provisions authorizing the Department of Homeland Security (DHS) to establish a human resources management system for some or all of its organizational units, and (2) the authority granted to the Transportation Security Administration (TSA) to establish or modify a personnel management system for TSA employees engaged in airport security screening. Within 60 days after the enactment date of this bill: (1) any such human resources management system and all TSA personnel management policies, directives, letters, and guidelines shall cease to be effective, and (2) all TSA positions and DHS positions that provide transportation security in furtherance of the purposes of the Aviation and Transportation Security Act shall become subject to general civil service provisions. This bill sets forth transition rules that protect the pay rates and other rights of such employees. DHS shall consult with the labor organization certified by the Federal Labor Relations Authority to carry out the conversion of such positions. The provisions of this bill do not affect the prohibitions against disloyalty and asserting the right to strike against the federal government.

Education for All Act of 2016 This bill expresses the sense of Congress that: (1) it is in the U.S. national security interest to promote universal basic education in developing countries; and (2) an educated citizenry contributes to economic growth, strengthened democratic institutions, the empowerment of women and girls, and decreased extremism. The Foreign Assistance Act of 1961 is amended to state that it is U.S. policy to work with foreign countries and international and civil society organizations to achieve sustainable quality universal basic education by: (1) assisting developing countries and nongovernmental and multilateral organizations to provide all children with a quality basic education, and (2) promoting education as the foundation for community development. The President, through the U.S. Agency for International Development (USAID), shall develop a comprehensive U.S. strategy to promote quality universal basic education. The President shall give assistance priority to foreign countries in which there is the greatest need and opportunity to expand universal access and to improve learning outcomes, and in which the assistance can produce a substantial, measurable impact on children and educational systems. Priority should also be considered in countries where there are chronically underserved and marginalized populations, or populations affected by conflict or crisis. USAID shall designate a Senior Coordinator of United States Government Actions to Provide Basic Education Assistance, who shall have primary responsibility for the oversight and coordination of all U.S. government resources and international activities to promote quality universal basic education.

Families of Flint Act

Families of Flint Act This bill provides support for Flint, Michigan in addressing lead in the city's drinking water and related issues. The bill amends the Safe Drinking Water Act by establishing a 10-year grant program to ensure that Flint's drinking water does not contain: (1) lead levels that threaten public health or the environment, or (2) other drinking water contaminants and pathogens that threaten public health. The bill also establishes specified grant programs for assisting Flint that are established within the Department of Labor, the Department of Health and Human Services (HHS), the Department of Education, the Department of Commerce, the Department of Justice, and the Department of Housing and Urban Development. The bill amends the Consolidated Appropriations Act, 2016, by allowing states to use more than 20% of funds from Drinking Water State Revolving Fund capitalization grants for addressing a threat to public health from heightened exposure to lead in a municipal drinking water supply if a federal or state emergency declaration has been issued for that threat. HHS must establish in Flint a Center of Excellence on Lead Exposure. The bill amends the Child Nutrition Act of 1966 to increase the allowable participation period in the Special Supplemental Nutrition Program for Women, Infants, and Children for children residing in areas that are in a state of emergency. A state may elect to allow those children to participate in the program for a period that ends on the earlier of: (1) the child's tenth birthday (currently fifth), or (2) five years after the emergency (currently children may participate for a one-year period).

Stop Act This bill amends the Federal Election Campaign Act of 1971 to prohibit an individual holding federal office from soliciting funds directly from any person: (1) for or on behalf of any political committee, or (2) for or on the behalf of any person for use for federal election activity. Such an individual, however, may participate in a fundraising event, including planning or attending it, speaking at it, or serving as a featured guest at the event, so long as he or she does not engage in any written or verbal solicitation of funds in connection with the event.

Iran Ballistic Missile Prevention and Sanctions Act of 2016 This bill directs the President to impose five or more sanctions with respect to a person (or an entity) that knowingly transfers to or from Iran advanced conventional weapons or ballistic missiles, or technology, parts, components, or technical information related to advanced conventional weapons or ballistic missiles. Sanctions may include: prohibitions on Export-Import Bank assistance, prohibitions on loans from U.S. financial institutions and other financial services, prohibitions on foreign exchange and other banking transactions, prohibitions on property transactions, prohibitions on exports and federal procurement, prohibitions on equity and debt investment, U.S. exclusion of corporate officers, and imposition of sanctions on principal executive officers. The President shall include a sanctioned person on the list of specially designated nationals and blocked persons maintained by the Department of the Treasury's Office of Foreign Assets Control. The President may, with prior congressional notice, waive the application of sanctions on a case-by-case basis if in the U.S. national security interests.

Assault Weapons Ban of 2015

Assault Weapons Ban of 2015 This bill amends the federal criminal code to make it a crime to knowingly import, sell, manufacture, transfer, or possess a semiautomatic assault weapon (SAW) or large capacity ammunition feeding device (LCAFD). The prohibition does not apply to a firearm that is: (1) manually operated by bolt, pump, lever, or slide action; (2) permanently inoperable; (3) an antique; or (4) a rifle or shotgun specifically identified by make and model. Additionally, the bill does not prohibit, with respect to a SAW or LCAFD: importation, sale, manufacture, transfer, or possession related to certain law enforcement efforts, or authorized tests or experiments; importation, sale, transfer, or possession related to securing nuclear materials; and possession by a retired law enforcement officer. The bill permits continued possession, sale, or transfer of a grandfathered SAW, which must be securely stored. A licensed gun dealer must conduct a background check prior to the sale or transfer of a grandfathered SAW between private parties. The bill permits continued possession of, but prohibits sale or transfer of, a grandfathered LCAFD. Newly manufactured LCAFDs must display serial number identification. Newly manufactured SAWs and LCAFDs must display the date of manufacture. The legislation amends the NICS Improvement Amendments Act of 2007 to require law enforcement agencies to be notified when a prohibited person attempts to purchase a grandfathered SAW. It also amends the Omnibus Crime Control and Safe Streets Act of 1968 to allow a state or local government to use Edward Byrne Memorial Justice Assistance Grant Program funds to compensate individuals who surrender a SAW or LCAFD under a buy-back program.

Military Family Stability Act of 2015

Military Family Stability Act of 2015 This bill allows a member of the Armed Forces undergoing a permanent change of station and the member's spouse to elect jointly that the spouse may relocate to the new location at the time during the covered relocation period as the member and spouse jointly select. The following families shall be eligible: the spouse is employed, or enrolled in a degree-, certificate-, or license-granting program, at the beginning of the covered relocation period; the member and spouse have one or more children in school; the spouse or children are covered under the Exceptional Family Member Program; the member and spouse are caring for an immediate family member with a chronic or long-term illness; or the member is undergoing a permanent change of station as an individual augmentee or other deployment arrangement. Families with other needs may receive exceptions granted by military commanders on a case-by-case basis. A member undergoing a permanent change of station who has one or more specified dependents and is no longer married to the individual who is or was the parent of such dependents at the beginning of the covered period of relocation may elect that such dependents relocate to the new location as follows: by the member alone if the former spouse is dead or has no custodial rights, or by the member and the former spouse jointly in all other circumstances. A member may not make: more than three elections; or any election unless the member's period of obligated service, or the time remaining under the member's enlistment contract, at the time of election is at least 24 months. The bill prescribes related housing and housing allowance requirements. Transportation allowances authorized for personal property of a member and spouse may be allocated as the member and spouse select. The Department of Defense shall establish a single application approval process for coverage under this Act which shall apply uniformly among the Armed Forces.

Businesses installing such systems must configure the systems to provide a notification to a central location at the facility where the system is installed when a person at the facility initiates a call to 9-1-1 using the system, provided that the system is able to be so configured without an improvement to the hardware.

Gun Violence Research Act This bill amends the Public Health Service Act to specifically include injuries from gun violence as a research subject for the Centers for Disease Control and Prevention (CDC).
