Biomass Research and Development Act of 1980

Biomass Research and Development Act of 1980 - Declares it to be the purpose of this Act to: (1) make the cost of energy produced by biomass systems competitive; (2) increase the efficiency of biomass energy production; (3) encourage the development of biomass energy resources on land unsuited for cultivating food; and (4) assure the production of at least three quadrillion British thermal units of energy per year from biomass by 1986. Directs the Secretary of Energy, in consultation with the Secretary of Agriculture, to establish a six-year biomass energy system research and development program to carry out the purposes of this Act. States that the program shall consist of: (1) a feedstocks program; (2) a conversion program; and (3) an end uses program. Authorizes the Secretary of Energy to establish procedures to permit any public or private entity wishing to install a biomass energy system to apply for and receive assistance in purchasing such a system. Directs the Secretary, after the termination of the six year program, to promulgate by rule voluntary performance standards for biomass energy systems. Directs the Secretary to initiate a three-year national biomass resource assessment program. Directs the Secretary to prepare and submit to Congress a comprehensive program management plan for the conduct of the programs established under this Act. Sets forth criteria for program selection. Directs the Secretary to monitor the performance and operation of biomass energy systems assisted or installed under this Act. Directs the Secretary to study and evaluate specified matters related to the development of biomass energy systems and report the findings to Congress. Establishes a biomass energy utilization program for the accelerated procurement and installation of biomass energy systems for power production for Federal facilities. Requires the Secretary to take steps to assure that small business will have adequate opportunities to participate in the programs established under this Act.

Used Oil Recycling Act of 1980 - Amends the Solid Waste Disposal Act to require lubricating oil to be labeled with a statement concerning the recycling of used oil. Requires re-refined oil used as lubricating oil to bear a label stating that such oil is a recycled product. Authorizes the Administrator of the Environmental Protection Agency to make grants to States with solid waste plans to encourage the use of recycled oil, prohibit hazardous uses of used oil, and establish a program for the collection and disposal of oil in a safe manner. Authorizes the Administrator to provide technical assistance to States in removing impediments to the recycling of used oil. Directs the Administrator to promulgate regulations protecting the public health and environment from the hazards of burning used oil. Requires the Administrator to determine and report to Congress on whether used oil ought to be treated as a hazardous waste. Directs the Administrator to study the collection and demand in the used oil industry, and energy savings associated with re-refining used oil.

Amends the Internal Revenue Code (Tax on Employers) to increase the excise tax paid by employers on employees' compensation so as to generate funds to finance such increases. Directs the Railroad Retirement Board, not later than 30 days before the beginning of a calendar year, to determine the account balance-benefit ratio for such calendar year. Directs the Board to publish a notice in the Federal Register of such ratio and of the tax rate applicable under this Act.

Armed Forces Educational Assistance Act of 1980

Armed Forces Educational Assistance Act of 1980 - Establishes an Armed Forces Educational Assistance Program for persons who enter military service after September 30, 1980, and serve on active duty for three years or more. Sets forth a schedule of educational assistance entitlement for such veterans as follows: (1) for service of 36 consecutive months but less than 48 consecutive months and an agreement to serve three years in the Ready Reserve, 18 months of assistance; (2) for service of 48 consecutive months but less than 72 consecutive months and an agreement to serve four years in the Ready Reserve, 36 months of assistance; and (3) for service of 72 consecutive months, 36 months of assistance. Allows eligible veterans who have served on active duty for 16 years by September 30, 1986, to transfer their educational entitlement to their spouse or children. Makes any veteran entitled to assistance under this Act eligible to participate in the Predischarge Education Program (PREP) and eligible for education loans. Provides that such veterans are eligible for educational assistance for the six-year period following their discharge or release date. Sets forth procedures extending any applicable time period for such veterans who are prevented from initiating or completing a program of education under certain circumstances. Directs the Administrator of Veterans' Affairs to pay tuition costs and a substantial allowance to eligible veterans in the program. Makes technical and conforming amendments to existing laws relating to veterans educational assistance. Grants to eligible veterans, who have served on active duty from three to six years, the right to transfer educational assistance entitlements to such veteran's spouse or children in such manner as prescribed by the Administrator concerned and under limitations set forth in this Act. Terminates the Post-Vietnam Era Veterans' Educational Assistance program after September 30, 1982. Requires the Administrator of Veterans' Affairs and the Secretary of Defense to submit a joint report to the Congress, not later than 90 days after the enactment of this Act, on plans for implementing the educational assistance provided in such Act. Directs the Secretary of Defense to report semiannually to Congress on the effect of such program on the number and quality of individuals entering the Armed Forces.

National Ground Water Environmental Research Act of 1980

National Ground water Environmental Research Act of 1980 - Title I: Ground Water Research and Planning - Directs the President to establish a Commission on Ground Water Research to develop guidelines and coordinate research by the States on identification of major freshwater aquifers in the United States and the extent of ground water pollution. Directs the Commission to make grants to States to conduct the freshwater aquifer research program. Requires the Commission to develop a comprehensive research plan for the prevention of ground water pollution. Authorizes the Commission to provide Federal, State, and local governments with technical advice on the protection of ground water from pollution. Directs the Commission to submit to Congress an annual report with recommendations for legislation on the protection of ground water from pollution. Title II: Institute for Research on Drinking Water Technology - Establishes an Institute for Research on Drinking Water Technology to conduct research and development on purification of drinking water. Stipulates that the Institute shall not conduct research on the health effects of drinking water. Sets forth the authorities of the Institute. Establishes an initial board of directors composed of Federal, State, and local officials and private water supply utilities officials appointed by the President. Authorizes the Institute to: (1) make research and development grants to institutions of higher education; (2) work with other agencies, institutions, and States in carrying out its functions under this title; and (3) assess and collect voluntary contributions from participating water supply agencies. Prohibits the Institute from engaging in lobbying activities. Sets forth the criteria for the operation of the Institute, including: (1) a location at or near a related laboratory or university; (2) establishment of a program for visiting researchers, postdoctoral fellows, and other scholars; and (3) the requirement that the bulk of the Institute's programs be conducted directly by the Institute and not be contract. Directs the Institute to: (1) develop new drinking water treatment and monitoring technologies; (2) improve existing drinking water treatment and monitoring technologies; (3) cooperate with research programs conducted under Title I of this Act and by participating water supply agencies; (4) publish archival and review articles; and (5) publish an annual progress report. Directs the Institute to establish a technology transfer program with water supply agencies. Requires the Institute to publish the results of a formal evaluation of such program.

Former Presidents Facilities and Services Reform Act of 1980 - Title I: Presidential Libraries - Prohibits the Administrator of General Services from establishing any Presidential archival depository after January 20, 1983. Directs the Administrator to submit to Congress a prospectus for establishing a central Presidential library (library) for the deposit and preservation of the records and papers of former Presidents, and historical materials related to the former Presidents. Requires the prospectus to provide: (1) for the establishment of the library in a phased manner allowing for expansion; (2) that the first phase of the library shall provide for the deposit and preservation of the records, papers, and materials concerning two former Presidents; (3) that the archival and research space for each former President in the library shall equal the average space provided per President in all Presidential archival depositories; and (4) that a specified area be established for museum displays concerning each former President. Authorizes the Administrator to lend any item stored in the library for display in a private Presidential museum or library. Directs the Administrator to duplicate and make available upon request the more historically significant documents. Requires the President, while holding office, to dispose of his or her Presidential records which have no administrative, historical, informational, or evidentiary value after obtaining the views of the Archivist of the United States concerning such disposal, unless the Archivist notifies the President that the Archivist intends to request advice from certain congressional committees. Declares that the provisions of this title apply only to: (1) the records of those Presidents taking office after January 20, 1969, for whom a Presidential archival depository is not established before January 20, 1983; and (2) all Presidential records to which the Government has title. Title II: Former Presidents - Changes the amount of the annual allowance to which the spouse of a deceased former President is entitled from $20,000 to two-thirds of the allowance to which a former President is entitled. Repeals the requirement that the spouse must waive the right to any other Government annuity or pension to qualify for such allowance. Authorizes the Administrator to provide to each former President, upon request: (1) one office; (2) compensation, without an aggregate ceiling, for members of an office staff who shall be subject to certain provisions of civil service laws; (3) payment for the travel and subsistence allowances for specified office employees; (4) communications services; and (5) printing and binding expenses. Allows any Federal employee to be detailed to the office staff of a former President with the consent of the employee's agency head. Authorizes the Administrator to provide a former Vice President with necessary services and facilities for winding up his or her office affairs which are similar to the services and facilities provided to a former President under this title. Prohibits the use of funds provided for necessary services and facilities of a former President or Vice President for partisan political activities or income generating activities. Permits a former President to use such funds to prepare his or her memoirs if the former President signs an agreement providing that the Public Printer will print and distribute such memoirs. Prohibits the expenditure of such funds for a former President any time beyond 90 days after the former President dies. Requires each former President to submit to Congress an annual report concerning activities carried out with the assistance of such funds. Authorizes appropriations to carry out the provisions of this title concerning the services and facilities to be provided for former Presidents and Vice Presidents. Repeals specified provisions of the Presidential Transition Act of 1963. Title III: Protection of Former Presidents, Former Vice Presidents, and Their Families - Prohibits the United States Secret Service from protecting a former President, former Vice President, or the spouse, widow, widower, or minor child of a former President except as authorized under this title. Authorizes the Secret Service to protect: (1) a former President for eight years after the individual becomes a former President; and (2) the spouse of a former President to the extent that such protection is incidental to the protection of the former President. Permits the Secretary of the Treasury to reinstate for six months the Secret Service protection of a former President or the spouse, widow, widower, or minor child of a former President after the original protection has been terminated upon finding that a serious threat warranting such protection exists. Allows the Secretary to extend for six-month periods the Secret Service protection provided to such an individual upon the individual's written request and upon the approval of an existing advisory committee established to determine whether protection should be furnished to certain Presidential or Vice Presidential candidates. Establishes the Advisory Panel on Secret Service Protection to review requests for extended protection and to make recommendations on such requests to such advisory committee. Permits the Secretary to authorize Secret Service protection for a former Vice President for a period beginning on the last day of the individual's Vice Presidential term and ending on the last day of the fiscal year in which the term expires, upon the former Vice President's written request and upon finding that a threat exists which warrants such protection. Declares that this title shall take effect on October 1, 1981.

Research and Development Authorization Estimates Act - Amends the Presidential Science and Technology Advisory Organization Act to require the Director of the Office of Science and Technology Policy to advise the President and the Director of the Office of Management and Budget every other fiscal year in preparing an estimate of the appropriate funding levels for research and development for each Federal department, agency and instrumentality for at least that and the following fiscal years. Requires the Director of the National Science Foundation to identify and describe situations and conditions which warrant special attention within the next four years, rather than the next five years as is now required, including the significant effects of current and projected trends in science and technology on the requirements of the Nation and existing and projected scientific and technological resources. Requires the director to consult with the Federal Coordinating Council for Science, Engineering, and Technology concerning programs and responsibilities relating to the problems, constraints, and opportunities so identified, and to recommend legislation which will contribute to the resolution of such problems. Requires the Office of Science and Technology Policy to study on a continuing basis the impact of inflation on the conduct of federally-supported research and development. Amends the National Science Foundation Act of 1950 to require the Foundation to annually submit to Congress an analysis of all Federal research and development funding by function.

Amends the Internal Revenue Code to provide homebuilders with an income tax credit for the construction of residences which incorporate a passive solar energy system. Directs the Secretary of the Treasury, after consultation with the Secretaries of Energy and Housing and Urban Development, to prescribe regulations setting forth a solar construction credit table for purposes of determining the amount of the credit for which the incorporator of the solar energy system is eligible. Limits the dollar amount of such credit to $2,000 for calendar years prior to 1986 and phases out the amount of the credit by $500 decrements until 1989 when such credit terminates. Defines "passive solar energy system" as a system which contains a solar collection area, an absorber, a storage mass, a heat distribution method, and heat regulation devices. Requires such system to be installed in a new residence after September 30, 1980 and before January 1, 1989.

Municipal Arts Program Act of 1980 - Authorizes the Chairman of the National Endowment for the Arts, with the advice of the National Council on the Arts, to make grants to cities and metropolitan areas to help finance municipal arts programs approved under this Act. Authorizes appropriations for fiscal years 1981 through 1985. Limits the total amount of any grant to one-third of the costs of such municipal arts program. Exempts 15 percent of the funds available to the Chairman from this restriction. Directs the Chairman to submit to Congress timely requests for additional authorizations for fiscal years 1986 through 1989. Sets forth requirements for applications for grants, including summaries of projected uses of such funds, general sources of revenue, and assurances of citizen participation in the planning process of such program. Limits the percentage of funds which may be expended for planning and administration purposes. Directs the Chairman to approve an application unless the activities fall clearly outside the purposes of this Act. Sets forth the activities eligible for assistance under a municipal arts program. Requires grants to cities and metropolitan areas with populations of less than 500,000 to be reviewed by the State agency except as specified. States that an application will be deemed approved unless disapproved. Sets forth the formula for the allocation and distribution of funds for annual grants. Creates a discretionary fund for each of the fiscal years in an amount equal to ten percent of authorizations for grants to be used by the Chairman in making grants for specified purposes, including special studies service centers and clearinghouses. Authorizes the Chairman to make grants up to 100 percent of the costs of such programs. Directs the Chairman to report to the President and Congress within three years on the progress of the municipal arts program.

Nuclear Liability Reform Act of 1980 - Amends the Atomic Energy Act of 1954 to limit the aggregate liability of persons liable for public liability caused by a nuclear incident to the sum of the financial protection required and a certain indemnity provided by the Nuclear Regulatory Commission. Limits such aggregate liability under an indemnification agreement for a nuclear incident outside the United States to $100,000,000 plus the contractor's required protection. Prohibits the payment for such liability at certain facilities from any source except the financial protection required until that protection is exhausted. Requires certain licensees and allows others to make arrangements which satisfy the Commission that the facility's manufacturer and architect-engineer will participate in the industry retrospective rating plan. Directs the Commission, in calculating the maximum amount of liability insurance available from private sources for licensees, to include private liability insurance available under an industry retrospective rating plan providing for premium charges deferred until public liability exceeds or appears likely to exceed the level of the licensee's required primary financial protection. Directs such insurance to be available to and required of each licensee, manufacturer, and architect-engineer of such a facility. Requires the deferred premium charged under such a plan to be: (1) $50,000,000 for each licensee with respect to each facility for which the maximum amount of financial protection is required; (2) for each manufacturer, $25,000,000 multiplied by the number of such facilities the manufacturer has built; and (3) for the architect-engineer, $25,000,000 multiplied by the number of such facilities designed or supervised by such architect-engineer. Increases the statute of limitations to 40 years for certain suits based on nuclear incidents. Directs a finding of liability for damages caused by a nuclear incident if a reasonable person could conclude that medical expenses and the injury or disease which caused them are reasonably related to such nuclear incident. Allows recovery even if the claimant cannot show: (1) the identity or source of the substance which caused the injury or disease; (2) the route the substance took to the claimant; or (3) an explanation of the cause of the substance in the claimant. Prohibits courts from considering claims by the owner or operator of a nuclear reactor until all other permitted claims have been resolved.

Authorizes the President to present a gold-plated medal, on behalf of the Congress, to those athletes selected through the Olympic trial process to be members of the United States Summer Olympic Team of 1980. Directs the Secretary of the Treasury to cause to be stricken 650 such medals with suitable emblems. Declares that such medals are national medals and that funds to carry out this Act shall be made available under the Amateur Sports Act of 1978.

Ocean Thermal Energy Conversion Research and Development Act - Directs the Secretary of Energy to prepare a comprehensive program management plan of research, development, and demonstration of ocean thermal energy conversion (OTEC) systems. Directs the President to submit to Congress annually the most recent revision of the plan giving justification for any changes. Directs the Secretary to initiate research or accelerate existing research in areas in which the lack of knowledge limits development of OTEC in order to achieve the purposes of this Act. Authorizes the Secretary to initiate a program to design, construct, and operate well instrumental OTEC facilities of sufficient size to demonstrate the technical feasibility of utilizing the various forms of OTEC to displace nonrenewable fuels. Directs the Secretary to conduct evaluations, arrange for tests, and disseminate information to support such design efforts. Provides for the competitive selection of at least two independent parallel pilot demonstration projects. Establishes goals for the demonstration program which shall include: (1) the demonstration of OTEC technical feasibility through multiple pilot demonstration plants with a combined capacity of at least 50 megawatts of electrical capacity or energy product equivalent by 1987; (2) the delivery of baseload electricity to utilities located on land or the production of commercially attractive quantities of energy products; and (3) the continuous operation of each pilot demonstration facility for a sufficient period of time to collect and analyze system performance and reliability data. Directs the Secretary to prepare a comprehensive technology application and market development plan that will permit the realization of the national goal set forth in this Act of 2,500 megawatts of electrical capacity or energy product equivalent from OTEC systems by 2000. Directs the Secretary to set priorities consistent with several criteria including: (1) the realization of competitive energy costs for OTEC; (2) private cost-sharing; and (3) the promotion of OTEC in areas vulnerable to interruptions in the supply of fossil fuel. Establishes the OTEC Advisory Committee to advise and report to the Secretary. Requires the Committee to meet at least four times annually until the demonstration goals are met. Authorizes appropriations for operating expenses for fiscal year 1982. Authorizes appropriations for the conceptual and preliminary design of demonstration plants with a combined capacity of at least 50 megawatts electrical or energy product equivalent.

Title I: Export Trading Companies - Export Trading Company Act of 1980 - Directs the Secretary of Commerce to promote export trading companies and facilitate contacts between producers of exportable goods and export trading companies. Authorizes any banking organization to invest up to specified amounts in export trading companies upon notifying, but without obtaining the prior approval of, the appropriate Federal banking agency, if such investment does not cause an export trading company to become a subsidiary of such organization. Allows greater investment by Edge Act Corporations not engaged in banking. Permits any banking organization to invest beyond such limitations with the prior approval of the appropriate Federal banking agency. Requires prior notification of such agencies in specified circumstances. Sets forth further limitations on export trading companies and investments by banking organizations. Specifies factors to be taken into consideration by the banking agencies. Permits such agencies to impose conditions in approving applications to invest in export trading companies. Requires such agencies to report to the appropriate congressional committees concerning implementation of this Act and any recommendations. Provides for judicial review of denial orders in the appropriate U.S. Court of Appeals. Sets forth the grounds for disapproval. Provides for remand for further consideration by the banking agency. Directs the Economic Development Administration and the Small Business Administration to give special weight to export-related benefits when considering applications for loans and guarantees by export trading companies. Directs the Export-Import Bank of the United States to provide loan guarantees to export trading companies or exporters to be secured by accounts receivable or inventories when adequate financing is not otherwise available and such guarantees will facilitate expansion of exports. Title II: Export Trade Associations - Export Trade Association Act of 1980 - Amends the Webb-Pomerene Act to exempt the export trade, export trade activities, and methods of operation of certified export trade associations and export trading companies from the antitrust laws. Delays the effectiveness of any certificate upon the notification of the Secretary of Commerce by the Attorney General or the Federal Trade Commission (FTC) of disagreement with the decision to issue a certificate. Sets forth the procedure to be followed by any association, company, or export trading company seeking certification under this Act and by the Secretary in issuing such certificates. Provides for appeal of the Secretary's denial of certification. Authorizes the Attorney General or the FTC to bring an action to invalidate a certification. Requires the Secretary, in consultation with the Attorney General and the FTC, to publish guidelines for determining whether an association or export trading company will meet the certification requirements. Requires certified associations and export trading companies to submit annual reports to the Secretary. Directs the Secretary to establish within the Department of Commerce an office to promote export trade associations and trading companies. Provides for automatic certification of existing associations. Stipulates that all applications for certification be kept confidential with specified exceptions. Authorizes the Secretary to require an association or trading company to modify its operation to be consistent with international obligations of the United States. Directs the President to appoint, with the Senate's advice and consent, a task force seven years after enactment to examine the effect of this Act and to make recommendations. Title III: Taxation of Export Trading Companies - Amends the Internal Revenue Code of 1954 to make banking organizations which have invested in an export trading company eligible for treatment as domestic international sales corporations (DISC). Includes the gross receipts from the export of services produced in the United States and from export trade services as qualified export receipts, in the case of a DISC which is an export trading company. Directs the Secretary of Commerce, with the Secretary of the Treasury, to develop and distribute information concerning the utilization of the DISC provisions. Amends the Internal Revenue Code of 1954 to make export trading companies eligible for Subchapter S treatment if the shareholders of such companies are otherwise small business corporations. Exempts such companies from restrictions on the amount of foreign income they can receive and still be eligible for Subchapter S tax treatment.

Directs the Secretary of the Treasury to sell all such gold obtained and invest the proceeds in safe U.S. and foreign securities for payment of the awards of U.S. nationals. Requires all interest and other income from such investments to be deposited into the Czechoslovakian Claims Fund for distribution to those U.S. nationals holding certified awards against Czechoslovakia. Provides for the payment to Czechoslovakia of all the proceeds from such gold sale and any balance remaining in such Fund after all such awards have been paid and Treasury Department expenses are recovered. Denies jurisdiction to any court over any claim against the United States for actions taken under this Act. Supercedes provisions prohibiting the release of Czechoslovak gold until an agreement with Czechoslovakia is approved by Congress.
