Trade Enforcement Act of 2009

Trade Enforcement Act of 2009 - Amends the Trade Act of 1974 to revise certain trade provisions to require the United States Trade Representative (USTR) to: (1) review U.S. trade expansion priorities; and (2) report to Congress on priority foreign country practices which if eliminated will have the most potential to increase U.S. exports. Requires the USTR to seek consultation and satisfactory resolution of any identified priority foreign country trade practice (including an agreement for elimination or provision of compensatory trade benefits) with the country of concern. Establishes the Office of the Congressional Trade Enforcer. Requires the USTR to: (1) identify priority foreign countries that maintain technical barriers to trade, or sanitary or phytosanitary measures, that deny market access to U.S. products; and (2) initiate an investigation of such trade barriers to determine what trade action, if any, must be taken to remedy such barriers. Amends the Tariff Act of 1930 to apply countervailing duty provisions to nonmarket economy countries. Expresses the sense of Congress that: (1) the United States should restore the balance between rights and obligations struck during the Uruguay Round of Multilateral Trade Negotiations; (2) the United States should have the ability to enforce rigorously its trade laws (including antidumping, countervailing duty, and safeguard laws) in World Trade Organization (WTO) negotiations and dispute settlement proceedings; and (2) dispute settlement panels are obligated to follow WTO negotiated agreements and not Appellate Body jurisprudence. Revises requirements for presidential action on a finding by the International Trade Commission (ITC) regarding an imported Chinese product that threatens or causes market disruption to a like U.S. product. Directs the Secretary of the Treasury to establish: (1) a government-wide, uniform data system to identify all goods imported into the United States; and (2) a voluntary government-private Import Safety Program to ensure that all goods in the international supply chain do not pose risks to public health or safety, and to facilitate the movement of such goods through the chain. Requires the Secretary to establish: (1) a list of importers of record and foreign manufacturers, processing facilities, exporters, and suppliers whose imported products have been determined to be inadmissible into the United States or have been the subject of U.S. recalls because of violations of health or safety standards; and (2) sanctions for entities on the list. Establishes the position of Director of Intellectual Property Rights Enforcement to develop an annual strategic plan for the enforcement of intellectual property rights. Sets forth: (1) enforcement activities to combat the counterfeiting and piracy of products; and (2) civil fines for the import of pirated or counterfeit products.

Housing Fairness Act of 2009 - Instructs the Secretary of Housing and Urban Development to conduct, and report to Congress on, a nationwide testing program to: (1) detect and document differences in the treatment of persons seeking to rent or purchase housing or obtain or refinance a home mortgage loan; (2) measure patterns of adverse treatment because of the race, color, religion, sex, familial status, disability status, or national origin of a renter, home buyer, or borrower; and (3) measure the prevalence of such discriminatory practices across housing and mortgage lending markets. Amends the Housing and Community Development Act of 1987 to reauthorize the fair housing initiatives program. Expresses the sense of Congress that the Secretary should: (1) fully comply with such Act's requirements to establish, design, and maintain a national education and outreach program for the development and dissemination of the fair housing rights of individuals who seek to rent, purchase, sell, or facilitate the sale of a home; (2) use all amounts appropriated for such program; and (3) promulgate regulations on the fair housing obligations of each recipient of federal housing funds to affirmatively further fair housing. Directs the Secretary to implement a competitive matching grant program to assist private nonprofit organizations in: (1) conducting comprehensive studies of specified aspects of the causes and effects of housing discrimination and segregation; and (2) implementing pilot projects that test solutions to help prevent or alleviate housing discrimination and segregation.

Compassionate Assistance for Rape Emergencies Act of 2009 - Requires hospitals, as a condition of receiving federal funds, to offer and to provide, upon request, emergency contraception to victims of sexual assault. At-Risk Communities Teenage Pregnancy Prevention Act of 2009 - Authorizes the Secretary to award grants for teenage pregnancy prevention programs. Requires the Secretary to award grants for teenage pregnancy prevention research. Truth in Contraception Act of 2009 - Requires that any information concerning the use of a contraceptive provided through specified federally funded education programs be medically accurate and include health benefits and failure rates. Unintended Pregnancy Reduction Act of 2009 - Amends title XIX (Medicaid) of the Social Security Act to expand Medicaid's coverage of family planning services. Responsible Education About Life Act of 2009 - Authorizes the Secretary to make grants to states to conduct sex education programs, including programs that provide education on abstinence and contraception for the prevention of teenage pregnancy and sexually transmitted diseases.

Children's Health Insurance Program Reauthorization Act of 2009 - Amends title XXI (State Children's Health Insurance Program) (SCHIP) of the Social Security Act (SSA) to reauthorize the program (referred to in this Act as CHIP) through FY2013 at increased levels. Revises requirements for: (1) CHIP allotments; (2) optional coverage of low-income pregnant women; (3) outreach and enrollment activities; (4) verification of U.S. citizenship or nationality for CHIP and Medicaid (SSA title XIX); (5) state option for providing premium assistance, including coordination with private coverage; (6) child health quality improvement activities; (7) access to dental and mental health benefits; and (8) program integrity and data collection, including the payment error rate measurement (PERM). Establishes in the Treasury the Child Enrollment Contingency Fund. Requires phase-out of CHIP coverage for nonpregnant childless adults. Limits the matching rate for states that propose to cover children with effective family income that exceeds 300% of the poverty line. Denies federal funding for illegal aliens. Prohibits initiation of new health opportunity account demonstration programs. Establishes a task force to conduct a nationwide campaign of education and outreach for small business concerns regarding the availability of coverage for children through private insurance options, the Medicaid program, and CHIP. Expresses the sense of the Senate affirming its intent to enact legislation this year that improves access to affordable and meaningful health insurance coverage for employees of small businesses and individuals. Prohibits any increase in physician ownership or investment in hospitals or any expansion of the physical capacity of such hospitals. Prescribes requirements for hospitals to qualify for the rural provider and hospital exception to such prohibition. Amends the Internal Revenue Code to increase the excise tax on tobacco products but allow a specified credit against tobacco floor stocks taxes. Directs the Secretary of the Treasury to study and make recommendations to Congress about the magnitude of tobacco smuggling in the United States. Amends the Tax Increase Prevention and Reconciliation Act of 2005 to increase the amount of any required installment of corporate estimated tax which is otherwise due in July, August, or September 2013.

Lilly Ledbetter Fair Pay Act of 2009 - Amends the Civil Rights Act of 1964 to declare that an unlawful employment practice occurs when: (1) a discriminatory compensation decision or other practice is adopted; (2) an individual becomes subject to the decision or practice; or (3) an individual is affected by application of the decision or practice, including each time wages, benefits, or other compensation is paid. Allows liability to accrue, and allows an aggrieved person to obtain relief, including recovery of back pay, for up to two years preceding the filing of the charge, where the unlawful employment practices that have occurred during the charge filing period are similar or related to practices that occurred outside the time for filing a charge. Applies the preceding provisions to claims of compensation discrimination under the Americans with Disabilities Act of 1990 and the Rehabilitation Act of 1973. Amends the Age Discrimination in Employment Act of 1967 to declare that an unlawful practice occurs when a discriminatory compensation decision or other practice is adopted, when a person becomes subject to the decision or other practice, or when a person is affected by the decision or practice, including each time wages, benefits, or other compensation is paid.

Paycheck Fairness Act - Amends the portion of the Fair Labor Standards Act of 1938 (FLSA) known as the Equal Pay Act to revise remedies for, enforcement of, and exceptions to prohibitions against sex discrimination in the payment of wages. Revises the exception to the prohibition for a wage rate differential based on any other factor other than sex. Limits such factors to bona fide factors, such as education, training, or experience. States that the bona fide factor defense shall apply only if the employer demonstrates that such factor: (1) is not based upon or derived from a sex-based differential in compensation; (2) is job-related with respect to the position in question; and (3) is consistent with business necessity. Avers that such defense shall not apply where the employee demonstrates that: (1) an alternative employment practice exists that would serve the same business purpose without producing such differential; and (2) the employer has refused to adopt such alternative practice. Revises the prohibition against employer retaliation for employee complaints. Prohibits retaliation for inquiring about, discussing, or disclosing the wages of the employee or another employee in response to a complaint or charge, or in furtherance of a sex discrimination investigation, proceeding, hearing, or action, or an investigation conducted by the employer. Makes employers who violate sex discrimination prohibitions liable in a civil action for either compensatory or (except for the federal government) punitive damages. States that any action brought to enforce the prohibition against sex discrimination may be maintained as a class action in which individuals may be joined as party plaintiffs without their written consent. Authorizes the Secretary of Labor (Secretary) to seek additional compensatory or punitive damages in a sex discrimination action. Requires the Equal Employment Opportunity Commission (EEOC) and the Office of Federal Contract Compliance Programs to train EEOC employees and affected individuals and entities on matters involving wage discrimination. Authorizes the Secretary to make grants to eligible entities for negotiation skills training programs for girls and women. Directs the Secretary and the Secretary of Education to issue regulations or policy guidance to integrate such training into certain programs under their Departments. Directs the Secretary to conduct studies and provide information to employers, labor organizations, and the general public regarding the means available to eliminate pay disparities between men and women. Establishes the Secretary of Labor's National Award for Pay Equity in the Workplace for an employer has made substantial effort to eliminate pay disparities between men and women. Amends the Civil Rights Act of 1964 to require the EEOC to collect from employers pay information data regarding the sex, race, and national origin of employees for use in the enforcement of federal laws prohibiting pay discrimination. Directs: (1) the Commissioner of Labor Statistics to continue to collect data on woman workers in the Current Employment Statistics survey; (2) the Office of Federal Contract Compliance Programs to use specified types of methods in investigating compensation discrimination and in enforcing pay equity; and (3) the Secretary to make accurate information on compensation discrimination readily available to the public. Directs the Secretary and the Commissioner of the EEOC jointly to develop technical assistance material to assist small businesses to comply with the requirements of this Act.

Makes technical corrections to the Railroad Retirement Act of 1974 with respect to railroad retirement payments to persons not entitled to an annuity. Makes technical corrections to the Age Discrimination in Employment Act of 1967 with respect to special age-related rules for determination of the market rate of return in the calculation of interest credits in governmental defined benefit plans. Makes technical corrections to the Internal Revenue Code to modify: (1) the interest rate assumption required with respect to certain small employer plans; and (2) the penalties for failure to file partnership returns and S corporation returns. Prescribes a special rule for exclusion from gross income of certain reimbursements from governmental plans for medical care. Requires treatment as a qualified rollover contribution of any airline payment amount received by a qualified airline employee in an airline carrier bankruptcy which is transferred to a Roth IRA. Revises asset valuation rules for certain commercial airline benefit plans. Provides a waiver of minimum distribution requirements for certain retirement plans for 2009. Sets forth requirements to: (1) provide for the delay of the designation of multiemployer benefit plans as endangered or critical for FY2009; and (2) extend the funding improvement and rehabilitation periods for such plans that are endangered or critical for FY2008 or FY2009.

Preserving Access to Healthcare (PATH) Act of 2008 - Declares that between October 1, 2008, and March 31, 2009, specified regulations regarding the formula for determining the federal rate for inpatient hospital capital-related costs under the Medicare prospective payment system (PPS) shall apply without the mandatory phase out of the indirect medical education adjustment factor. Directs the Secretary of Health and Human Services to delay for six months following enactment of this Act any implementation of the Medicaid outpatient hospital services regulation proposed on September 28, 2007. Prohibits the Secretary from phasing out or eliminating the Medicare hospice wage index budget neutrality adjustment factor before April 1, 2009. Directs the Secretary, acting through the Administrator of the Centers for Medicare and Medicaid Services and upon the request of the state of California, to extend approval, and full federal financial participation, of the state's Medicaid family planning demonstration project until June 30, 2009, under the eligibility requirements and processes that were in place before the project's first extension period. Amends title XVIII (Medicare) of the Social Security Act to increase funding for the Medicare Improvement Fund.

Amends the Dominican Republic-Central America-United States Free Trade Agreement Implementation Act to direct the Secretary of Commerce to establish a program to provide earned import allowance certificates to any producer or entity controlling production of eligible apparel articles in an eligible country, based on specified elements. Declares that eligible apparel articles wholly assembled in an eligible country and imported directly from an eligible country shall enter the United States free of duty, without regard to the source of the fabric or yarns from which the articles are made, if such apparel articles are accompanied by an earned import allowance certificate reflecting the amount of credits equal to the total square meter equivalents of fabric in such apparel articles. Amends the African Growth and Opportunity Act to repeal certain special rules for fabrics and yarns in commercial quantities in Africa. Adds Mauritius as a lesser developed beneficiary sub-Saharan African country (LDC) for purposes of the application of preferential treatment to apparel articles wholly assembled, or knit-to-shape and wholly assembled, or both, in one or more LDCs, regardless of the country of origin of the fabric or the yarn used to make such articles, that are imported into the United States. Directs the U.S. International Trade Commission (ITC) to review, identify, and report to the appropriate congressional committees and the Comptroller General on yarns, fabrics, and other textile and apparel inputs that through new or increased investment or other measures can be produced competitively in beneficiary sub-Saharan African countries. Amends the Trade Act of 1974 to extend the Generalized System of Preferences program through December 31, 2009. Amends the Consolidated Omnibus Budget Reconciliation Act of 1985 to extend certain customs fees for the processing of merchandise entered into the United States. Requires the Secretary of Health and Human Services to direct the Organ Procurement and Transplantation Network to establish an application procedure, determine eligibility, and arrange for the presentation of medals. Allows only one medal per family. Requires that such medal be presented to the donor or, in the case of a deceased donor, the family member who signed the consent form authorizing the organ donation. Authorizes the Network to collect funds to offset expenditures relating to the issuance of medals. Prohibits federal funds from being used to carry out this Act. Requires the Secretary of the Treasury to design and strike the Stephanie Tubbs Jones Gift of Life Medals using certain specifications. Provides that a medal under this Act shall not be treated as valuable consideration for purposes of prohibiting transferring human organs for valuable consideration.

Paul Wellstone and Pete Domenici Mental Health Parity and Addiction Equity Act of 2008 - Amends the Employee Retirement Income Security Act of 1974 (ERISA), the Public Health Service Act, and the Internal Revenue Code to require a group health plan that provides both medical and surgical benefits and mental health or substance use disorder benefits to ensure parity in the provision of such benefits. Extends through 2009 the 0.2% Federal Unemployment Tax Act (FUTA) surtax. Increases and extends through 2017 the Oil Spill Liability Trust Fund financing rate. Requires the inclusion in gross income for income tax purposes of employee compensation deferred under a nonqualified deferred compensation plan of certain foreign entities when there is no substantial risk of forfeiture of the rights to such compensation. Delays until 2018 the application of special rules for the worldwide allocation of interest for purposes of computing the limitation on the foreign tax credit. Energy Improvement and Extension Act of 2008 - Amends the Internal Revenue Code to provide incentives for energy production and conservation, extend expiring energy-related tax provisions, and provide for revenue enhancements. Extends the tax credit: (1) for producing electricity from wind facilities through 2009; and (2) for closed and open-loop biomass, geothermal, small irrigation power, landfill gas, trash combustion, and hydropower facilities through FY2011. Extends through 2016 the energy tax credit for solar energy, fuel cell, and microturbine property. Allows a new energy tax credit for combined heat and power system property. Increases to $1,500 the credit limitation for fuel cell property. Modifies energy tax credit rules to allow: (1) offsets of tax credit amounts against alternative minimum tax (AMT) liabilities; and (2) public utility property to qualify for such credit. Increases and extends through 2016 the tax credit for residential energy efficient property. Eliminates the limitation on the tax credit for solar electric property. Allows a new tax credit for 30% of expenditures for wind turbines used to generate electricity in a residence and for geothermal heat pumps. Extends deferral provisions for the gain on sales of transmission property by vertically-integrated electric utilities to independent transmission companies approved by the Federal Energy Regulatory Commission (FERC). Allows a 30% investment tax credit rate for advanced coal-based generation technology projects and increases the maximum credit amounts allocable for such projects to $2.55 billion. Increases to 30% the investment tax credit rate for coal gasification projects. Extends the excise tax on coal through December 31, 2018. Requires the Secretary of the Treasury to undertake a comprehensive review of Internal Revenue Code provisions that have the largest effects on carbon and other greenhouse gas emissions and provide an estimate of the magnitude of such effects. Includes cellulosic biofuel within the definition of "biomass ethanol plant property" for purposes of bonus depreciation. Extends through 2009 income and excise tax credits for biodiesel and renewable diesel used as fuel. Increases the rates of such credits. Disqualifies foreign-produced fuel that is used or sold for use outside the United States for the income and excise tax credits for alcohol, biodiesel, and alternative fuel production. Allows a new tax credit for the production of qualified plug-in electric drive motor vehicles. Allows an exclusion from the heavy truck excise tax for idling reduction devices and advanced insulation used in certain heavy trucks and trailers. Allows employees to exclude reimbursements for bicycle commuting expenses from gross income. Increases and extends the tax credit for residential and commercial alternative fuel refueling property expenditures. Treats certain income and gains relating to alcohol, biodiesel, and alternative fuels and mixtures as qualifying income for publicly traded partnerships. Extends the tax credit for nonbusiness energy property expenditures through 2008. Includes energy-efficient biomass fuel stoves as property eligible for such tax credit. Extends through 2013 the tax deduction for energy efficient commercial building expenditures. Modifies tax credit amounts for energy efficient household appliances produced after 2007. Allows an accelerated 10-year recovery period for the depreciation of qualified smart electric meters and smart electric grid systems. Extends through FY2012 the authority to issue tax-exempt green building and sustainable design projects bonds. Provides for revenue enhancements by: (1) limiting the tax deduction for income attributable to domestic production activities for taxpayers with gross receipts derived from oil, gas, or any primary products thereof; (2) conforming the tax treatment of foreign oil and gas extraction income and foreign oil related income for purposes of the foreign tax credit; (3) requiring investment brokers to report information relating to customer basis in securities transactions; (4) increasing and extending the Oil Spill Liability Trust Fund financing rate; and (5) increasing estimated tax payments for certain large corporations.

Authorizes the administrator to make grants to the Department to address mental health needs relating to the terrorist attacks. Amends the Air Transportation Safety and System Stabilization Act to: (1) make individuals eligible for compensation under the September 11 Victim Compensation Fund of 2001 for harm as a result of debris removal; and (2) extend the deadline for making a claim for compensation. Provides for revenue enhancements by: (1) reducing by 3% the tax deduction for income attributable to domestic production activities for taxpayers with income derived from activities related to oil, gas, or any primary products thereof; (2) conforming the tax treatment of foreign oil and gas extraction income and foreign oil related income for purposes of the foreign tax credit; (3) including within the reporting requirements of investment brokers the adjusted basis of any publicly traded security owned by customers of such brokers; (4) extending through 2009 the 0.2% Federal Unemployment Tax Act (FUTA) surtax; (5) requiring the inclusion in gross income of employee compensation deferred under compensation plans of certain foreign business entities; (6) delaying until 2017 the application of special rules for the worldwide allocation of interest for purposes of computing the limitation on the foreign tax credit; and (7) increasing the estimated tax payments of certain large corporations in the third quarter of 2013.

Extends through March 31, 2009, various airport development projects, including: (1) the pilot program for passenger facility fees at nonhub airports; (2) the small community air service development program; (3) small airport grants for airports located in the Marshall Islands, Micronesia, and Palau; (4) state and local airport compatibility projects; (5) the authority of the Metropolitan Washington Airports Authority to apply for an airport development grant and impose a passenger facility fee; (6) the temporary increase to 95% in the government share of certain AIP project costs; (7) Midway Island airport development; and (8) airport planning and development grant programs. Extends through March 31, 2009, Department of Transportation (DOT) insurance coverage for domestic and foreign-flag air carriers. Extends through May 31, 2009, air carrier liability limits for injuries to passengers resulting from acts of terrorism. Extends through March 31, 2009, the authorization of appropriations for: (1) Federal Aviation Administration (FAA) operations; (2) air navigation facilities and equipment; and (3) research, engineering, and development.

Paul Wellstone and Pete Domenici Mental Health Parity and Addiction Equity Act of 2008 - Amends the Employee Retirement Income Security Act of 1974 (ERISA), the Public Health Service Act, and the Internal Revenue Code to require a group health plan that provides both medical and surgical benefits and mental health or substance use disorder benefits to ensure that: (1) the financial requirements, such as deductibles and copayments, applicable to such mental health or substance use disorder benefits are no more restrictive than the predominant financial requirements applied to substantially all medical and surgical benefits covered by the plan; (2) there are no separate cost sharing requirements that are applicable only with respect to mental health or substance use disorder benefits; (3) the treatment limitations applicable to such mental health or substance use disorder benefits are no more restrictive than the predominant treatment limitations applied to substantially all medical and surgical benefits covered by the plan; and (4) there are no separate treatment limitations that are applicable only with respect to mental health or substance use disorder benefits.

Stephanie Tubbs Jones Gift of Life Medal Act of 2008 - Makes any organ donor, or the family of any organ donor, eligible for a Stephanie Tubbs Jones Gift of Life Medal. Requires the Secretary of Health and Human Services to direct the Organ Procurement and Transplantation Network to establish an application procedure, determine eligibility, and arrange for the presentation of medals. Allows only one medal per family. Requires that such medal be presented to the donor or, in the case of a deceased donor, the family member who signed the consent form authorizing the organ donation. Authorizes the Network to collect funds to offset expenditures relating to the issuance of medals. Requires the Secretary of the Treasury to design and strike the Stephanie Tubbs Jones Gift of Life Medals using certain specifications. Provides that a medal under this Act shall not be treated as valuable consideration for purposes of prohibiting transferring human organs for valuable consideration.
