Marine Corps 230th Anniversary Commemorative Coin Act - Directs the Secretary of the Treasury to mint and issue not more than 500,000 one dollar coins which shall be emblematic of the warrior ethos of the United States Marine Corps. Requires all surcharges from the sale of the coins to be paid to the Marine Corps Heritage Foundation for construction of the Marine Corps Heritage Center.

Mobile Machinery Tax Fairness Act - Amends the Internal Revenue Code to prohibit the treatment of certain mobile machinery as a highway vehicle, thereby exempting such machinery from federal highway excise taxes.

Tax Reform Action Commission Act of 2003 - Establishes in the legislative branch a Tax Reform Action Commission to make specific recommendations to Congress for the reform of the internal revenue laws in a manner that produces a system that is: (1) simple, transparent, and efficient; (2) fair and equitable to all Americans; and (3) neutral between different activities and between current consumption and future consumption.

Benjamin Franklin Commemorative Coin Act - Directs the Secretary of the Treasury to mint and issue one dollar coins emblematic of the life and legacy of Benjamin Franklin (not more than 250,000 bearing his image as a young statesman and not more than 250,000 with his image as an older numismatist). Directs that all sales include a $10 per coin surcharge, which shall be paid by the Secretary to the Benjamin Franklin Tercentenary Commission, to be used to educate people about Franklin's legacy.

District of Columbia Personal Protection Act - Amends the District of Columbia Code to provide that the D.C. Council's regulatory authority regarding firearms, explosives, and weapons in the District shall not be construed to permit the Council, the Mayor, or any governmental or regulatory authority of the District to prohibit, constructively prohibit, or unduly burden the ability of persons otherwise permitted to possess firearms under Federal law from acquiring, possessing in their homes or businesses, or using for sporting, self-protection or other lawful purposes, any firearm neither prohibited by Federal law nor regulated by the National Firearms Act. Denies the District any authority to enact laws or regulations that discourage or eliminate the private ownership or use of firearms. Amends the Firearms Control Regulations Act of 1975 to repeal the definition of a machine gun as any firearm which shoots, is designed to shoot, or can be readily converted or restored to shoot semiautomatically, more than 12 shots without manual reloading. (Thus repeals the ban on semiautomatic weapons.) Repeals the District's: (1) registration requirement for possession of firearms; (2) prohibition on registration of pistols (handguns); (3) prohibition on possession of handgun ammunition; (4) requirement that, under certain conditions, firearms in the possession of certain individuals must be kept unloaded, disassembled, or with the trigger locked; (5) related firearm registration requirements such as applicant qualifications and filing deadline. Maintains the current ban on the possession and control of a sawed-off shotgun, machine gun, or short-barreled rifle. Eliminates criminal penalties for possessing an unregistered firearm. Amends Federal law to eliminate criminal penalties for carrying a pistol whether loaded or unloaded in one's dwelling house, place of business, or on land possessed by such person.

Agricultural Job Opportunity, Benefits, and Security Act of 2003 - Directs the Secretary of Homeland Security, upon completion of specified agricultural work and residency requirements, to adjust the status of a qualifying alien agricultural worker (and spouse and minor children) to that of a: (1) lawfully admitted temporary nonimmigrant; and (2) permanent resident nonimmigrant. Sets forth provisions with respect to: (1) adjustment of status applications, including penalties for false statements; (2) waiver of numerical limitations and certain grounds for inadmissibility; (3) temporary stay of removal and work authorization; (4) administrative and judicial review; and (5) dissemination of program information. Amends the Social Security Act to provide for the correction of such aliens' social security records. Amends the Immigration and Nationality Act to set forth registry application requirements for H-2A employers and employer associations, including assurances: (1) that the job opportunity is temporary or seasonal, and is not the result of a labor dispute, (2) that attempts have been made to hire U.S. workers; and (3) respecting required wages and benefits, and compliance with labor laws. Sets forth employment requirements with respect to: (1) wages; (2) housing; and (3) transportation reimbursement. Establishes the Commission on Agricultural Wage Standards under the H-2A program. Revises provisions respecting the admission and extension of stay of temporary H-2A workers. Provides special rules for alien sheepherders. Sets forth worker protection and labor standards enforcement provisions for such aliens.

Celia Cruz Commemorative Coin Act - Directs the Secretary of the Treasury to mint and issue not more than 300,000 one dollar silver coins and 500,000 half dollar clad coins emblematic of Celia Cruz (known as the "Queen of Salsa") and her legacy. Establishes surcharges of ten dollars per coin for the dollar coin and three dollars per coin for the half dollar coin, which shall be paid to the Celia Cruz Foundation.

Renewable Fuels and Transportation Infrastructure Enhancement Act of 2003 - Amends the Internal Revenue Code to establish, for a limited period of time: (1) as a credit against the gasoline and diesel fuel excise tax, a credit equal to the sum of the alcohol fuel mixture credit plus the biodiesel mixture credit; and (2) a biodiesel fuels credit business credit.

Surface Transportation Extension Act of 2003 - Extends Federal highway, highway safety, motor carrier safety, and transit programs for six months, and authorizes appropriations, through March 31, 2004. Directs the Secretary of Transportation to: (1) apportion funds made available for Federal-aid highway programs under the Transportation Equity Act for the 21st Century (TEA-21) to each State according to the ratio of the State's FY 2003 obligation authority to the FY 2003 obligation authority for all States; and (2) ensure that each State is apportioned funds for the Interstate maintenance program, the National Highway System program, the bridge program, the surface transportation program, the congestion mitigation and air quality improvement program, the recreational trails program, the Appalachian development highway system program, and the minimum guarantee. Sets forth provisions: (1) for reducing future apportionments, and for recovering funds not apportioned, under a law reauthorizing the Federal-aid highway program that is enacted after enactment of this Act; (2) prohibiting States from obligating any Federal-aid highway program funds after March 31, 2004, until the earlier of the date of enactment of a multi-year law reauthorizing such program or June 30 2004; and (3) directing the Secretary of Transportation, on the earlier of such enactment date or June 1, 2004, to distribute to each State any remaining amounts of obligation authority for Federal-aid highways and highway safety construction programs by allocation as provided in an Act making appropriations for the Department of Transportation for FY 2004 Amends the Balanced Budget and Emergency Deficit Control Act of 1985 and TEA-21, respectively, to set related discretionary spending limits and obligation limitations for FY 2004.

Country of Origin Labeling Amendment Act of 2003 - Amends the Agricultural Marketing Act of 1946 to revise country of origin labeling provisions, including: (1) specifying the model certification of origin program; (2) specifying producer protections; (3) reducing maximum retailer fines; (4) prohibiting treatment of country of origin violations as adulteration or misbranding; and (5) extending the implementing guideline deadline.

Critical Habitat Reform Act of 2003 - Amends the Endangered Species Act of 1973 to require the process for designating critical habitat to be practicable, economically feasible, and concurrent with the approval of a recovery plan for a species. Prohibits the relevant Secretary (the Secretary of the Interior or the Secretary of Commerce) from designating an area as critical habitat of a species, and any designation of critical habitat of a species from applying to an area, if the area is subject to: (1) a habitat conservation plan that the Secretary determines provides protection for habitat of the species that is substantially equivalent to the protection that would be provided by such designation; or (2) a State or Federal land conservation program that provides such protection. Directs the Secretary, in determining whether an area is critical habit, to seek and consider information from local governments in the vicinity of the area, including local resource data maps. Specifies factors for consideration of the economic impact on landowners under the Act, including lost revenues and costs associated with preparing reports, surveys, and analyses. Modifies the contents of the required notice of proposed designation of critical habit to include any municipality having administrative jurisdiction over the area in which the species is believed to occur. Requires the Secretary, with respect to a regulation to designate or revise a designation of critical habitat, to: (1) maintain, on a publicly accessible Internet page of the relevant Department (Interior or Commerce), Geographical Information System maps and coordinates of the area; and (2) include in such notice a reference to the Internet page.

Terrorist Penalties Enhancement Act of 2003 - Amends the Federal criminal code to require any person who, in the course of committing a terrorist offense, engages in conduct that results in the death of a person, to be punished by death or imprisoned for any term of years or life. Includes "terrorist offenses resulting in death" among the aggravating factors for homicide which are used in determining whether a death sentence is justified. Denies Federal benefits to any individual who is convicted of a Federal crime of terrorism, for any term of years or for life.

Railroad Competition Act of 2003 - Amends Federal transportation law to specify the primary objectives of U.S. rail transportation policy. Requires submission to arbitration of certain rail rate, service, and other disputes. Prohibits the Surface Transportation Board (STB) from issuing a certificate authorizing construction and operation of railroad lines, or exempt from such certificate requirement any related activity, that involves a transfer of interest in a line of railroad, from a Class I rail carrier to a Class II or III rail carrier, if the activity directly or indirectly would result in a restriction of: (1) the ability of the Class II or Class III rail carrier to interchange traffic with other carriers; or (2) competition between or among rail carriers in the region affected by the activity in a manner or to an extent that would violate Federal antitrust laws. Prescribes a procedure for shipper petition and STB review of any activity alleged to have resulted in a restricition of competition for at least ten years. Changes from discretionary to mandatory the authority of the STB to require: (1) a rail carrier's terminal facilities to be used by another rail carrier subject to certain conditions; and (2) rail carriers to enter into reciprocal switching agreements. Prohibits the STB, in either instance, from requiring evidence of anticompetitive conduct by a rail carrier from which such access is sought. Requires a rail carrier, upon shipper request, to establish a rate for transportation and provide requested service between any two points on the carrier's system where traffic originates, terminates, or may reasonably be interchanged. Specifies matters the carrier must disregard when establishing such rate. Specifies matters the STB must disregard when determining the reasonableness of a shipper-challenged rate established by a rail carrier with market dominance. Prohibits the STB from charging a fee for the filing of a complaint, protest, or other request for relief in an amount greater than fees charged by U.S. district courts for a comparable filing. Requires the Secretary of Transportation to conduct comprehensive triennial studies on rail carrier competition and STB processes. Requires to STB to designate any State or part of a State as an area of inadequate rail competition after finding that: (1) it encompasses a significant number of rail shipping origins and destinations served exclusively by only one Class I railroad; or (2) a significant number of the persons that ship by rail or receive rail shipments in it usually find it necessary to pay rates exceeding a certain mark, or have experienced competitive disadvantage in the marketplace or other economic adversity because of high cost or poor rail service quality. Specifies actions the STB may take to resolve such anti-competitive conditions. Amends the Department of Agriculture Reorganization Act of 1994 to establish within the Department of Agriculture an Office of Rail Customer Advocacy, headed by a Rail Customer Advocate who shall: (1) collect information on the cost and efficiency of rail transportation of agricultural and forestry commodities or products; (2) perform related studies; and (3) participate as a party in STB proceedings regarding regulation of such transportation, as well as to initiate any petitions for STB action.

Beginning Farmers and Ranchers Tax Incentive Act of 2003 - Amends the Internal Revenue Code to exclude from gross income: (1) 100 percent of the gain from the sale or exchange of qualified farm property to a first-time farmer who certifies that the use of such property shall be as a farm for farming purposes for not less than 10 years after such sale or exchange; (2) 50 percent of the gain from the sale or exchange of qualified farm property to any other person who certifies that the use of such property shall be as a farm for farming purposes for not less than 10 years after such sale or exchange; and (3) 25 percent of the gain from the sale or exchange of qualified farm property to any other person for any other use. Limits the amount of any of the above exclusions with respect to any taxable year to $500,000 on a joint return.

Right-to-Ride Livestock on Federal Lands Act of 2003 - Amends Public Law 91-383 to direct the Secretary of the Interior to preserve and facilitate the continued use and access of pack and saddle stock animals on parts of National Park System lands where there is a historical tradition of such use. Directs that as a general rule, all trails, routes, and areas used by such animals shall remain open and accessible for such use. Allows the Secretary of the Interior to implement a proposed reduction in the use and access of pack and saddle stock animals on such lands only after complying with the full review process required under the National Environmental Policy Act of 1969. Makes the same amendments to other laws regarding other public lands as follows: (1) the Federal Land Policy and Management Act of 1976, with respect to Bureau of Land Management lands; (2) the National Wildlife Refuge System Administration Act of 1966, with respect to National Wildlife Refuge System lands; and (3) the Forest and Rangeland Renewable Resources Planning Act of 1974, with respect to National Forest System lands (with the Secretary directed to act in this case being the Secretary of Agriculture). Directs the Secretaries of the Interior and Agriculture to issue final rules to define the meaning of a historical tradition of use of pack and saddle stock animals on Federal lands for purposes of this Act.

Firefighters Affordable Housing Act - Authorizes the Secretary of Housing and Urban Development to provide mortgage assistance to qualified volunteer firefighters. Ends such assistance upon termination of: (1) use as primary residence; or (2) firefighter duties within ten years of the mortgage's execution. Amends the National Housing Act to provide for one percent downpayments (and deferral and reduction of up-front premium) for Federal Housing Administration mortgage loans for qualified professional firefighters to purchase homes within the jurisdictions of their employing public fire service or rescue or ambulance agency. (Requires the mortgagor to not have had an ownership interest in a principal residence within such jurisdiction during the 12-month period ending upon the mortgage's insurance.)

National Drought Preparedness Act of 2003 - Establishes the National Drought Council which shall: (1) develop a national drought policy action plan; (2) evaluate Federal drought-related programs; (3) coordinate and prioritize enhancement of the national integrated drought system; and (4) provide for the development of a drought information delivery system, drought planning models, and drought preparedness plans. Terminates the Council eight years after enactment of this Act. Requires the Secretary of Agriculture to establish the National Office of Drought Preparedness. Establishes within the Department of Agriculture the Drought Assistance Fund, which shall be used to: (1) assist State, local, tribal, and critical service entities with drought-related activities; and (2) expand the technology transfer of drought and water conservation strategies. Requires: (1) the Secretary to publish guidelines for administering a national technical and financial drought assistance program; and (2) the Secretaries of Agriculture, the Interior, and the Army, and other appropriate Federal agency heads to implement integrated drought preparedness plans. Authorizes States, Indian tribes, local governments, and regional, water providers to develop and implement drought preparedness plans.

Backcountry Landing Strip Access Act - Prohibits either the Secretary of the Interior or the Secretary of Agriculture from taking any action which would permanently close or render or declare as unserviceable any aircraft landing strip located on Federal land under the respective jurisdiction, unless: (1) the head of the aviation department of each State in which the aircraft landing strip is located has approved such action; (2) notice of the proposed action has been published in the Federal Register; (3) a 90-day public comment period on the action has been provided; and (4) any comments received during the comment period have been taken into consideration by the Secretaries, as the case may be, and the appropriate State aviation department heads. Directs the Secretaries to: (1) adopt a nationwide policy for governing backcountry aviation issues related to the management of Federal land under their jurisdiction; and (2) require regional managers to adhere to it. Declares that a policy affecting air access to an aircraft landing strip located on Federal land (including any national policy required under this Act) shall not take effect unless certain conditions are met, including its statement that the FAA has the sole authority to control aviation and airspace over the United States.

Air Line Pension Act of 2003 - Sets forth special funding requirements for certain pension plans maintained by commercial passenger air carriers (plans), notwithstanding any contrary provisions of the Internal Revenue Code or of the Employee Retirement Income Security Act of 1974 (ERISA). Provides for such plans, if they have a funded percentage of less than 80 percent as of January 1, 2003, the following: (1) modifications of funding rules, including funded percentage, assumed interest rate for determining current liability, and estimation of current liability; (2) a moratorium on the deficit reduction contribution, under specified conditions; (3) a one-time amortization of 2008 unfunded current liability; and (4) recognition of a waiver in the deficit reduction contribution. Provides for such plans, if they are maintained for benefit of the carrier's employees pursuant to a collective bargaining agreement and if they terminated during calendar year 2003, the following: (1) restoration by the Pension Benefit Guaranty Corporation (PBGC) to the plan's pre-termination status and transfer of control of plan assets and liabilities to the employer, unless the collective bargaining agreement provides that the plan should not be restored; (2) exclusion of any expected increase in current liability due to benefits accruing during each plan year; (3) amortization of unfunded amounts under the restoration payment schedule; (4) inapplicability of certain contribution requirements to a restored plan until a plan year beginning on the initial post-restoration valuation date, with modified required annual payments; and (5) resetting of funding standard account balances. Limits PBGC liability with respect to certain plans under this Act.

Clear Law Enforcement for Criminal Alien Removal Act of 2003 or the CLEAR Act of 2003 - States that: (1) State and local law enforcement personnel are fully authorized to investigate, apprehend, or remove aliens in the United States (including interstate transportation of such aliens to detention centers) in the enforcement of U.S. immigration laws; and (2) a State that does not have a statute permitting enforcement of Federal immigration laws within two years of enactment of this Act shall not receive certain Federal incarceration assistance. Amends the Immigration and Nationality Act with respect to illegal aliens to: (1) establish criminal penalties and forfeiture for aliens unlawfully present in the United States; (2) increase specified criminal and civil penalties for illegal entry and failure to depart violations; and (3) provide for payment of funds from certain civil penalties to State and local law enforcement agencies for apprehension of such aliens. Provides for the listing of immigration violators in the National Crime Information Center database. Requires States and localities to provide the Department of Homeland Security with specified information about apprehended illegal aliens. Eliminates certain Federal incarceration assistance for noncompliance. Directs the Attorney General to make grants to local police agencies for equipment and facilities related to housing and processing illegal aliens. Amends the Act to provide for Federal custody and State or local compensation of State or locally apprehended illegal aliens. Establishes a process for State and local claims against the Federal Government for failure to cooperate in enforcing immigration laws. Directs the Secretary or the Attorney General to establish immigration-related training for State and local personnel. Provides: (1) personal liability immunity for Federal, State, or local personnel enforcing immigration laws within the scope of their duties; and (2) civil rights money damage immunity for Federal, State, or local agencies enforcing immigration laws unless their personnel violated criminal law in such enforcement. States that the Department of Justice and the Department of Homeland Security shall continue to operate the Institutional Removal Program, which shall be expanded to all States.

Native American Languages Act Amendments Act of 2003 - Amends the Native American Languages Act to require the Secretary of Education to make grants to, or enter into contracts with, Native American language educational organizations, Native American language colleges, Indian tribal governments, organizations that demonstrate the potential to become Native American language educational organizations, or consortia of such entities to establish Native American nests that meet specified requirements for students under the age of seven and families of the students. Requires the Secretary to make grants to, or enter into contracts with, Native American language educational organizations, Native American language colleges or universities where such languages are taught, Indian tribal governments, or consortia of such entities, to operate, expand, and increase the number of Native American language survival schools throughout the United States and its territories for Native American children and Native American language-speaking children. Specifies eligibility requirements for recipients of such funds. Requires the Secretary to make grants, or enter into contracts, to establish four demonstration programs that will provide assistance to Native American language survival schools and Native American languages nests located at: (1) Ka Haka 'Ula O Ke'elikolani College of the University of Hawaii at Hilo, in consortium with the 'Aha Punana Leo, Inc., and with other entities if determined to be appropriate by the College; (2) Piegan Institute of Browning, Montana; (3) the Alaska Native Language Center of the University of Alaska at Fairbanks, in consortium with other entities as the Center determines to be appropriate; and (4) the Native American Studies Department of the University of New Mexico at Albuquerque in consortium with the Linguistic Institute for Native Americans and other entities as determined to be appropriate by the consortium.

Farm-To-Cafeteria Projects Act of 2003 - Amends the Richard B. Russell National School Lunch Act (NSLA) to direct the Secretary of Agriculture to make competitive grants to private nonprofit entities and educational institutions to establish and carry out Farm-to-Cafeteria projects to improve access to local foods in schools and institutions receiving funds under NSLA and the Child Nutrition Act of 1966 (CNA) (except the special supplemental program for women, infants, and children (WIC) which already has a WIC Farmers Market Nutrition program). Requires such projects to be designed to: (1) procure local foods from small and medium-sized farms to provide foods for school meals; (2) support nutrition education activities or curriculum planning incorporating school children's participation in farm and agriculture education projects; and (3) develop a sustained commitment to farm-to-cafeteria projects in the community by linking schools, agricultural producers, parents, and other community stakeholders.

Scientifically Identifying the Need for Critical Habitat Act - Amends the Endangered Species Act of 1973 to change from mandatory to discretionary the authority of the Secretary of the Interior to designate critical habitat of an endangered or threatened species. Directs the Secretary, when required by the Act to use the best scientific and commercial data available, in evaluating comparable data to give greater weight to such data that is empirical or has been field-tested or peer-reviewed. Specifies requirements for the use of sound science in the listing of endangered or threatened species such as: (1) the establishment of criteria for scientific studies to support the listing; (2) use of data obtained by observation of the species in the field; and (3) use of data from landowners who have observed such species on their land. Requires the use of sound science in the preparation of a recovery plan for an endangered or threatened species. Sets forth requirements for: (1) peer review before certain action can become final with respect to endangered or threatened species; and (2) use of information provided by States affected by such species or their habitat for recovery plans.

United States Agricultural Products Market Access Act of 2003 - Amends the Trade Act of 1974 to direct the United States Trade Representative (USTR) to identify those foreign countries that: (1) deny fair and equitable market access to U.S. agricultural products or apply standards for the importation of U.S. agricultural products that are not related to public health concerns or cannot be substantiated by reliable analytical methods; and (2) are determined by the USTR to be priority foreign countries. Limits the identification of priority foreign countries to those that engage in the most onerous or egregious acts which have the greatest adverse impact on the relevant U.S. products. Provides that if available information indicates that such action is appropriate, the USTR may at any time: (1) revoke the identification of any foreign country as a priority foreign country; or (2) identify any foreign country as a priority foreign country. Provides funding for additional staff for the Office of the Assistant U.S. Trade Representative for Agricultural Affairs and Office of the Assistant U.S. Trade Representative for Monitoring and Enforcement. Requires the U.S. Trade Representative to initiate an investigation (without waiting for a petition by an interested person) regarding any act, policy, or practice of a priority foreign country identified under this Act.

Compact Impact Reconciliation Act - Amends the Organic Act of Guam to authorize the Secretary of the Interior to reduce, release, or waive all or part of any amounts owed by the Government of Guam to any department, agency, independent agency, office, or instrumentality of the United States.

Anti-Spam Act of 2003 - Prohibits a person from initiating in interstate commerce any commercial electronic mail (commercial email) message unless the message contains: (1) identification as commercial email; (2) notice of an opt-out opportunity, along with an email address or other mechanism for doing so; and (3) a valid physical street address of the sender. Prohibits the transmission of commercial email: (1) after valid objection; (2) with false or misleading header information or subject headings; (3) from illegally harvested email addresses, including addresses generated by automated means; or (4) without warning labels on commercial email containing sexually oriented material. Provides a right of enforcement action for: (1) providers of Internet access service; (2) States on behalf of any of their residents; and (3) the Federal Trade Commission (FTC). Amends the Federal criminal code to provide criminal penalties for: (1) falsifying the identity of a commercial email sender; (2) failing to place warning labels on commercial email containing sexually oriented material; (3) repeat offenses and bulk email violations; and (4) illegal harvesting of email addresses. Provides for enforcement of such penalties through actions by Internet service providers, the FTC and the Attorney General, and State attorneys general. Requires the FTC to report to Congress regarding the need to protect the rights of users of email to avoid receiving unsolicited commercial email.

United States Consensus Council Act of 2003 - Establishes the United States Consensus Council to develop and conduct processes to build consensus on national policy issues. Authorizes the Council to: (1) enter into formal relationships with other institutions; (2) identify particular public policy issues for which the Council's expertise would be useful in building a consensus; (3) coordinate with, make referrals to, and receive referrals from other conflict or dispute resolution instrumentalities, including the United States Institute for Environmental Conflict Resolution or the Federal Mediation and Conciliation Service; and (4) develop and apply criteria for determining whether the Council will enter into a consensus-building process on a particular issue. Vests Council powers in a Board of Directors. Prohibits any Director from being a Federal officer or employee, including a Member of Congress. Provides for a Council President appointed by the Board. Prohibits the Council from engaging in lobbying activities or being a client.

Permanent Marriage Tax Elimination Act of 2003 - Amends the Internal Revenue Code to accelerate the permanent elimination of the marriage tax penalty in the standard deduction and 15 percent income bracket for married taxpayers filing jointly and surviving spouses. (Eliminates phased-in increase provisions.) .

Death Tax Repeal Permanency Act of 2003 - Declares that the sunset provisions of the Economic Growth and Tax Relief Reconciliation Act of 2001 shall not apply to Title V: Estate, Gift, and Generation-skipping Transfer Tax Provisions of such Act. (Makes the repeal of estate and generation-skipping taxes under the Internal Revenue Code, and certain reductions of the gift tax, permanent.)

Pharmaceutical Market Access Act of 2003 - Amends the Federal Food, Drug and Cosmetic Act to direct the Secretary of Health and Human Services to promulgate regulations allowing qualifying individuals to import covered products (in addition to pharmacists and wholesalers, whom current law authorizes to import such products). Amends provision pertaining to record keeping regarding imported covered products. States that the Secretary shall not have to store records in cases in which qualifying individuals have imported a covered product. Amends provisions regarding the testing of imported covered products. Declares that specified tests, including ones involving authenticity and degradation of products, shall not be required unless the importer is a wholesaler. Requires such tests to be conducted by the importer unless a product is a prescription drug subject to the provisions of this Act pertaining to counterfeit-resistant packaging. (Currently either the importer or the manufacturer may conduct such tests). Eliminates the sunset date current law establishes for the provisions pertaining to the importation of covered products. Classifies prescription drugs as misbranded if they do not incorporate specified counterfeit -resistant technologies in packaging.

Chronic Wasting Disease Research, Monitoring, and Education Enhancement Act of 2003 - Amends the Fish and Wildlife Coordination Act to require the Secretary of the Interior, acting through the Director of the U.S. Geological Survey, to carry out a program to support, conduct, and coordinate programs to strengthen scientific research and monitoring and public education activities to elevate knowledge of Chronic Wasting Disease in free-ranging populations of deer and elk.

Paleontological Resources Preservation Act - Directs the Secretaries of the Interior and Agriculture (the Secretaries) to: (1) manage and protect paleontological resources on Federal land using scientific principles and expertise; and (2) develop plans for inventorying, monitoring, and deriving the scientific and educational use of such resources. Directs the Secretaries to establish a program to increase public awareness about the significance of paleontological resources. Prohibits a person from collecting a paleontological resource from Federal land without a permit issued under this Act by one of the Secretaries. Authorizes the Secretaries to allow casual collecting of common invertebrate and plant paleontological resources for scientific, educational, and recreational uses, without a permit, on certain Federal lands where not inconsistent with laws governing management of such lands and this Act. Recognizes as valid permits issued before enactment of this Act. Prohibits: (1) excavating, removing, or altering a paleontological resource located on Federal lands, except in compliance with this Act; (2) exchanging or receiving such a resource, if the person knew or should have known such resource to have been illegally removed from Federal lands; (3) selling or purchasing a paleontological resource, if the person knew or should have known such resource to have been illegally removed from Federal lands; or (4) making or submitting false records, accounts, or identification of any paleontological resource excavated or removed from Federal lands. Imposes criminal penalties for violating this Act. Sets forth requirements for the assessment of civil penalties by the Secretaries for violations of any prohibitions contained in regulations or permits issued under this Act. Requires any recovered amounts to be available for use: (1) to protect or restore the paleontological resources and sites which were the subject of the action, or to acquire sites with equivalent resources and to protect, monitor, and study the resources and sites; (2) to provide educational materials to the public about paleontological resources and sites; and (3) as a reward. Requires that information on the nature and specific location of a paleontological resource that requires a permit under this Act or other Federal law be withheld from the public, including under the Freedom of Information Act, except under specified conditions. Declares that no permit is required by this Act for the casual collecting of rocks and minerals on National Forest System lands for personal use.

Chronic Wasting Disease Task Force Establishment Act of 2003 - Establishes the National Chronic Wasting Disease Task Force to: (1) coordinate activities to implement the National Plan (published jointly by the Departments of the Interior and Agriculture, and entitled "Plan for Assisting States, Federal Agencies, and Tribes in Managing Chronic Wasting Disease in Wild and Captive Cervids," dated June 26, 2002) in cooperation with State, regional, local, tribal, college, and university and non-governmental partners; (2) plan and host an annual national public conference to review progress made in implementing the Plan; and (3) develop an annual cross-cutting budget to specify sufficient levels of appropriations necessary to implement it.

Amends the Organic Act of Guam to revise the local judicial structure of Guam to vest judicial authority, not only in the District Court of Guam (as currently), but also in a unified judicial system composed of: (1) an appellate court designated as the "Supreme Court of Guam"; (2) a trial court designated as the "Superior Court of Guam"; and (3) such other lower local courts as may have been or may hereafter be established by the laws of Guam. Authorizes the Supreme Court of Guam to create divisions of the Superior Court and other local courts of Guam. Lists the courts of record for Guam. Outlines the jurisdiction and powers of the local courts. Provides that the qualifications and duties of the justices and judges of the courts shall be governed by the laws of Guam and the rules of such courts. Repeals provisions granting the United States Court of Appeals for the Ninth Circuit jurisdiction to review all final decisions of the Supreme Court of Guam (effectively allowing direct review of such decisions to the Supreme Court of the United States).

Rural Veterans Access to Care Act of 2003 - Directs the Secretary of Veterans Affairs to ensure that no less than five percent of the funds made available each fiscal year for the Medical Care appropriation of the Department of Veterans Affairs are used to improve access to medical services for highly rural or geographically remote veterans, including the use of such funds for: (1) acute or chronic sympton management; (2) nontherapeutic medical services; and (3) other appropriate medical services as determined by the director of the geographic service region involved. Provides for the allocation of such funds to such service regions. Requires review of the operation of this Act and, if necessary, recommendation for an adjustment to the percentage of Medical Care funds required for such purpose.

National Monument Fairness Act - Revises Federal law with respect to a presidential proclamation that, during one calendar year, either creates a national monument that is more than 50,000 acres or that adds more than 50,000 acres to an existing national monument. Prohibits the issuance of such a proclamation until 30 days after the President has transmitted the proposed proclamation to the Governor of the State or States in which such acreage is located, soliciting written comment. Makes any such proclamation ineffective two years after its issuance unless Congress has approved it by law. Provides that land subject to a proclamation issued after the enactment of this Act that ceases to be effective shall revert to the land use status it had before the proclamation was issued. Requires the President: (1) to solicit public participation and comment in the development of a monument proclamation; (2) to consult with the Governor and entire congressional delegation of the State or territory in which such lands are located at least 60 days before any national monument proclamation; and (3) before issuing it, to consider any information, including public comments, made available in the development of existing plans and programs for the management of the lands under consideration. Requires any management plan for a national monument developed subsequent to a proclamation made under this Act to comply with the procedural requirements of the National Environmental Policy Act of 1969.

Rural Provider Equity Act of 2003 - Amends title XVIII (Medicare) of the Social Security Act (SSA), the Public Health Service Act, and other Federal law with respect to rural health care, especially: (1) physician reimbursement; (2) rural health clinics and community health centers; (3) home health services and hospice care; (4) air and ground ambulance services; (5) mental health care accessibility; and (6) rural health services research. Amends SSA title XVIII to provide for coverage of marriage and family therapist services and mental health counselor services under Medicare part B (Supplementary Medical Insurance). Amends the Internal Revenue Code to exclude from gross income any loan payments under the National Health Service Corps Loan Repayment Program.

Social Security Earnings Limit Repeal Act of 2003 - Amends title II (Old Age, Survivors and Disability Insurance) (OASDI) of the Social Security Act to repeal the limitation on the amount of outside income which beneficiaries who have attained age 62 may earn (earnings test) without incurring a reduction in benefits.

Lower Yellowstone Reclamation Projects Conveyance Act - Directs the Secretary of the Interior to convey the works, facilities, and lands of the Lower Yellowstone Irrigation Project, the Intake Project in Montana, and the Savage Unit of the Pick-Sloan Missouri Basin Program to the Lower Yellowstone Irrigation Districts No. 1 (Montana) and No. 2 (North Dakota), the Intake Irrigation District (Montana), and the Savage Irrigation District (Montana), respectively, pursuant to the terms of the Memorandum of Understanding of November 16, 1999, between the Districts and the Bureau of Reclamation. Requires: (1) all conveyances under this Act, except the Diversion Works (land and the diversion dam structure, canal headworks, and first section of the mail canal) to be conveyed in the first stage; and (2) the Diversion Works to be conveyed in the second stage.. Requires the Districts to buy Reclamation withdrawn lands as identified in the Memorandum for their value in providing operation and maintenance benefits. Conditions the conveyance on the Secretary requiring payment of: (1) an amount equal to the present value of the remaining water supply repayment obligation from the Savage Irrigation District as full payment of such District's share of the construction of the Savage Unit; and (2) a specified amount from the Pick Sloan Missouri Basin Program (Eastern Division) power customers as full payment for the construction aid-to-irrigation associated with Unit facilities. Conditions the conveyance on the Lower Yellowstone Irrigation Districts conveying a perpetual conservation easement to the State of Montana for the purposes of protecting, preserving, and enhancing the conservation values and permitting recreation on Federal lands to be conveyed under this Act. Sets forth requirements regarding: (1) continuation of Pick-Sloan Program irrigation components and pumping power service; and (2) Yellowstone River fisheries protection.

Directs the Speaker of the House of Representatives and the President Pro Tempore of the Senate to arrange for the presentation of a congressional gold medal to President Jose Maria Aznar of Spain in recognition of his contributions to maintaining the security of all freedom-loving nations. Requires the Secretary of the Treasury to strike such medal and authorizes the Secretary to strike and sell bronze duplicates.

Essential Air Service Modernization Act of 2003 - Increases the authorization of appropriations to carry out the essential air service program. Requires the Secretary to: (1) notify an affected community at least 90 days before the basic essential service to that community is terminated: (2) facilitate and assist in negotiations between major and national air carriers and carriers that provide essential air service in order to determine equitable joint fares; (3) establish an alternate essential air service program which would provide compensation directly to local governments, instead of to air carriers, to use to obtain air service, to obtain surface transportation to and from air hubs, or to participate with other local governments in providing regional transportation services to airports; and (4) pay $5,000 to local governments to promote public use of air service or transportation for which compensation is received under the program.
