Two-Midnight Rule Delay Act of 2013

Two-Midnight Rule Delay Act of 2013 - Prohibits the Secretary of Health and Human Services (HHS) from enforcing the two-midnight rule to a hospital for which payment is made under title XVIII (Medicare) of the Social Security Act for admissions occurring before October 1, 2014. (The two-midnight rule allows Medicare coverage of only hospital stays for which a physician admits to a hospital a beneficiary expected to require care that crosses two midnights, but generally denies coverage of care expected to require less than a two-midnight stay.) Applies such prohibition to Medicare review contracts. Prohibits Medicare review contractors from denying a claim for inpartient hospital services furnished by a hospital, or inpatient critical access hospital services furnished by a critical access hospital, for discharges occurring before October 1, 2014: (1) for medical necessity due to the length of an inpatient stay in such hospital or due to a determination that the services could have been provided on an outpatient basis; or (2) for requirements for orders, certifications, or recertifications, and associated documentation relating to such matters. Prohibits the Secretary from increasing the sample of claims selected for prepayment review under the Medicare Probe and Educate program above the number and type established by the Secretary as of November 4, 2013. Directs the Secretary to develop: (1) a Medicare hospital payment methodology for short inpatient hospital stays; (2) general equivalency maps to link the relevant International Statistical Classification of Diseases and Related Health Problems (ICD)-10 codes (used to report medical diagnoses and inpatient procedures) to relevant Current Procedural Terminology (CPT) codes, and the relevant CPT codes to relevant ICD-10 codes, in order to permit comparison of inpatient hospital services and hospital outpatient department servives; and (3) a second crosswalk between Diagnosis-Related Group (DRG) codes for inpatient hospital services and Ambulatory Payment Class codes for outpatient hospital services.

Monuments Men Recognition Act of 2013 - Directs the Speaker of the House of Representatives and the President pro tempore of the Senate to make arrangements for the presentation of a single congressional gold medal in commemoration of the Monuments Men (men and women who served in the Monuments, Fine Arts, and Archives [MFA] Section under the Allied Armies during World War II) in recognition of their heroic role in the preservation, protection, and restitution of monuments, works of art, and artifacts of cultural importance during and following the War. Requires the Medal's display at the Smithsonian Institution. Expresses the sense of Congress that the medal should be made available for display elsewhere, particularly at locations associated with the Monuments Men and that preference should be given to locations affiliated with the Smithsonian Institution. Permits the Secretary of the Treasury to strike and sell duplicates in bronze of the gold medal, at a price sufficient to cover the costs of the medals.

Military Skills to Careers Act

Military Skills to Careers Act - Requires a state, as a condition for receipt of a grant or contract from the Department of Labor to employ disabled veterans' outreach program specialists and local veterans' employment representatives, to establish a program under which that state administers an examination and issues a license or credential to a veteran without requiring any training or apprenticeship if such veteran: (1) receives a satisfactory score on such examination, (2) has been awarded a military occupational specialty that is substantially equivalent to or exceeds the state requirements for such license or credential, (3) has engaged in active practice of such occupation for at least two of the five years preceding the date of application for such license or credential, and (4) pays any fees required by the state for such license or credential. Requires the state to report annually to the Secretary of Labor on the exams administered, the number of veterans who completed such exams, and exam results, disaggregated by occupational field. Allows the Secretary to waive the requirement that a state establish such a program if the state certifies that it: (1) takes into account previous military training or testing; (2) permits veterans to satisfy through examination training or testing requirements for which a veteran has previously completed military training; and (3) substantially reduces training time, based on the military training received by a veteran, required to satisfy requirements the veteran is unable to completely satisfy through examination. Requires an annual report from the Secretary to Congress and the Secretary of Defense on administered exams and exam results.

Careers for Heroes Act - Directs the head of each federal agency other than the Department of Defense (DOD) and the Department of Veterans Affairs (VA) to develop a plan for exercising, during the five-year period beginning on the enactment of this Act, authority to make veterans recruitment appointments and authority under the Veterans Employment Opportunities Act of 1998. Requires the Director of the Office of Personnel Management (OPM) to ensure that, under such plans, agencies shall appoint no less than 15,000 qualified covered veterans during such period. (Covered veterans include those who: (1) are disabled or recently separated; (2) served on active duty during a war or in a campaign or expedition for which a campaign badge has been authorized; or (3) while serving on active duty, participated in a military operation for which an Armed Forces service medal was awarded.)

Debt Management Act of 2013

Debt Management Act of 2013 - Requires the Secretary of the Treasury, within 21 to 60 days before any date on which the Secretary anticipates the public debt will reach the current debt limit, to appear before specified congressional committees to provide specified information. (The debt limit was $16.699 trillion before its suspension in the Continuing Appropriations Act, FY2014 [P.L. 113-46].) Requires the Secretary to include in such appearance: a report on the state of the public debt, including (1) its historical trajectory, major drivers of the current debt and their quantities, and debt projections; and (2) how, if the debt limit is raised, the United States will meet existing debt obligations, including principal and interest; a detailed explanation of: (1) any proposal of the President to reduce the structural deficit in the short-term (the following fiscal year), medium-term (approximately 3-5 years), and long-term (approximately 10 years); (2) the impact an increased debt limit will have on future federal spending, service provision, and the status of the U.S. dollar as the international reserve currency; (3) projections of fiscal health and resilience to long-term entitlement program pressures (including Social Security, Medicare, and Medicaid), given the proposed measures to reduce the structural deficit and the amount of increase in the debt limit; and (4) any proposal of the President to reduce the debt-to-gross domestic product (GDP) ratio, based on current trends, with the exclusion of extreme events (i.e. military, economic, and natural catastrophes); and a detailed report on the progress of implementing all such proposals. Declares that this report shall only be delivered if a Secretary has already appeared at least once during any term of office for a particular President.

Requires Border Patrol agents to elect each year to: (1) be assigned to either a specified level one or level two border patrol rate of pay governing regular rates of pay and overtime work requirements, or (2) decline both levels. Expresses the sense of Congress that U.S. Customs and Border Protection (CBP) should ensure that not more than 10% of agents stationed at a location decline to be assigned to either the level 1 or level 2 border patrol rate of pay. Empowers CBP, without limitation, to require agents to perform overtime work in accordance with agency needs, including if needed in the event of a local or national emergency.

Promoting Adoption and Legal Guardianship for Children in Foster Care Act - Amends part E (Foster Care and Adoption Assistance) of title IV of the Social Security Act (SSA) to revise the adoption incentives grant program (renaming it the adoption and legal guardianship incentive program), creating a new formula for determining adoption incentive payments, and extending the program through FY2016. Requires states to use amounts paid to them under the program to supplement, and not supplant, any federal or non-federal funds used to provide any service under SSA title IV parts B (Child and Family Services) or E. Increases from 24 to 36 the number of months during which incentive program payments are available for expenditure. Requires states to: (1) report annually to the Secretary of Health and Human Services (HHS) on the calculation and use of savings resulting from the application of certain requirements to all children, and (2) spend at least 20% of such savings on post-adoption services. Declares that, in the event of the death or incapacity of the relative guardian, the eligibility of a child for a kinship guardianship assistance payment shall not be affected by reason of the replacement of the relative guardian with a successor legal guardian named in the kinship guardianship assistance agreement. Amends SSA title IV part B to extend the family connection grant program through FY2016. Amends SSA title III (Unemployment Insurance) with respect to the requirement that a state have an unemployment compensation law containing certain provisions in order to receive a specified federal grant. Requires a state owed an unemployment compensation debt meeting specified criteria that remains uncollected within two years after it was first incurred to take specified action under the Internal Revenue Code to recover it, including through a tax refund offset.

Marriage and Religious Freedom Act - Prohibits the federal government from taking an adverse action against a person on the basis that such person acts in accordance with a religious belief that: (1) marriage is or should be recognized as the union of one man and one woman, or (2) sexual relations are properly reserved to such a marriage. Defines "adverse action" as any federal government action to discriminate against such person, including: (1) denying or revoking certain tax exemptions or disallowing a deduction of any charitable contribution made to or by such person; (2) denying or excluding such person from receiving any federal grant, contract, cooperative agreement, loan, license, certification, accreditation, employment, or similar position or status; or (3) denying or withholding any benefit under a federal benefit program. Permits a person to assert an actual or threatened violation of this Act as a claim or defense in a judicial proceeding and to obtain compensatory damages or other appropriate relief against the federal government. Authorizes the Attorney General (DOJ) to bring actions to enforce this Act. Specifies that the term "person" includes any person regardless of religious affiliation, as well as corporations and other entities regardless of for-profit or nonprofit status.

Honoring the Fort Hood Heroes Act - Directs: (1) the Secretary of the military department concerned to award the Purple Heart to members of the Armed Forces (members) who were killed or wounded in the attack at Fort Hood, Texas, on November 5, 2009; and (2) the Secretary of Defense (DOD) to award the Secretary of Defense Medal for the Defense of Freedom to civilian employees and contractors of DOD who were killed or wounded in such attack. Deems, for purposes of all applicable federal benefit laws, regulations, and policies: (1) such members to have been killed or wounded in a combat zone as the result of an enemy act; and (2) such employees to have been killed or wounded by hostile action while serving with the Armed Forces in a contingency operation and to have been killed or wounded in a terrorist attack. Excludes any member whose death or wound was the result of willful misconduct. Applies such provisions to post-traumatic stress disorder (PTSD) or other psychological injuries that were a a result of such attack.

Missing Children's Assistance Reauthorization Act of 2013 - Amends the Missing Children's Assistance to declare that many missing children are runaways. Requires the Administrator of the Office of Juvenile Justice and Delinquency Prevention of the Department of Justice (DOJ) to send the Office's annual report to the President and Congress specifically to the Committee on Education and the Workforce of the House of Representatives and the Committee on the Judiciary of the Senate. Requires the Administrator also to coordinate with the U.S. Interagency Council on Homelessness to ensure that homeless services professionals are aware of educational resources and assistance provided by the Center regarding child sexual exploitation. Adds to the authorized uses of the annual grant to National Center for Missing and Exploited Children: (1) giving technical assistance and training to state and local law enforcement agencies and statewide clearinghouses to coordinate with state and local educational agencies in identifying and recovering missing children; (2) assisting the efforts of law enforcement agencies in coordinating with child welfare agencies to respond to foster children missing from the state welfare system; and (3) giving technical assistance to law enforcement agencies and first responders in identifying, locating, and recovering victims of, and children at risk for, child sex trafficking. Prohibits the use of federal funds to pay the compensation of any Center employee exceeding 110% of the maximum annual salary payable to a member of the federal government's Senior Executive Service (SES) for that year. Allows the Center to compensate an employee at a higher rate provided the amount exceeding this limitation is paid with non-federal funds. Excludes from the meaning of such compensation any health, medical, or life insurance payments, disability or retirement pay, or pensions benefits. Requires the Administrator to conduct national incidence studies triennially (currently, periodically) to determine for a given year the actual number of children reported missing, the number who are victims of abduction by strangers, the number who are the victims of parental kidnappings, and the number who are recovered each year. Requires that the Administrator's duty to provide to state and local governments, public and private nonprofit agencies, and individuals information to facilitate the lawful use of school records and birth certificates to identify and locate missing children be performed in compliance with the Family Educational Rights and Privacy Act of 1974. Authorizes the Administration to make grants or enter into contracts with the Center and with public agencies or nonprofit private organizations for research, demonstration projects, or service programs designed to: (1) educate schools, school leaders, teachers, state and local educational agencies, homeless shelters, and service providers in ways to prevent the abduction and sexual exploitation of children; and (2) aid schools in the collection of materials useful to parents in assisting others in the identification of missing children.

Tribal General Welfare Exclusion Act of 2014

Tribal General Welfare Exclusion Act of 2013 - Amends the Internal Revenue Code to exclude from gross income, for income tax purposes, the value of an Indian general welfare benefit. Defines "Indian general welfare benefit" as any payment made or services provided to or on behalf of a member of an Indian tribe under an Indian tribal government program if: (1) such program is administered under specified guidelines and does not discriminate in favor of members of the governing body of the Indian tribe; and (2) the program benefits are available to any tribal member, are for the promotion of general welfare, are not lavish or extravagant, and are not compensation for services. Directs the Secretary of the Treasury to: (1) establish a Tribal Advisory Committee to advise the Secretary on the taxation of Indians, (2) establish and require training and education for Internal Revenue Service (IRS) field agents on federal Indian law and the implementation of this Act, and (3) suspend audits and examinations of Indian tribal governments and members of Indian tribes and waive any interest or tax penalties related to the exclusion from gross income of Indian general welfare benefits.

Technology and Research Accelerating National Security and Future Economic Resiliency Act of 2013 or the TRANSFER Act of 2013 - Amends the Small Business Act to replace provisions requiring the Director of the National Institutes of Health to use funds for a Proof of Concept Partnership pilot program to accelerate the creation of small businesses and the commercialization of research innovations made by certain institutions with provisions directing each federal agency required to establish a small business technology transfer (STTR) program to carry out an Innovative Approaches to Technology Transfer Grant Program to support innovative approaches to technology transfer at institutions of higher education, nonprofit research institutions, and federal laboratories in order to accelerate the commercialization of federally funded research and technology by small businesses. Outlines activities eligible for funding, application requirements, and award procedures and amounts. Requires successful grant proposals to include a plan to assemble a program oversight board to establish award programs for individual projects and evaluate project applications. Provides the percentage of each agency's extramural budget to be expended on such Program for FY2014-FY2017. Directs each agency to: (1) develop a Program evaluation plan and collect information from grantees annually to evaluate the Program, and (2) submit a Program activities report to specified congressional committees. Requires the Administrator of the Small Business Administration (SBA) to include information on the Program on the public database of small businesses participating in STTR or Small Business Innovation Research programs.

Senator Paul Simon Water for the World Act of 2013 - Expresses the sense of Congress that: (1) the initial U.S. Agency for International Development (USAID) Water and Development Strategy is a significant accomplishment and improves USAID's capacity to provide sustainable and effective water, sanitation, and hygiene assistance; and (2) the Secretary of State, through the Special Advisor for Water Resources, should develop a Global Water Resources Strategy relating to U.S. foreign policy water objectives. Amends the Foreign Assistance Act of 1961 to direct: (1) the Administrator to designate a Global Water Coordinator to coordinate and oversee water, sanitation, and hygiene assistance; and (2) the Secretary of State to designate a Special Advisor for Water Resources to coordinate and oversee policy relating to water, hygiene, and sanitation assistance. Sets forth principles to ensure that water, sanitation, and hygiene projects carried out under the Foreign Assistance Act of 1961 and the Senator Paul Simon Water for the Poor Act of 2005 achieve maximum impact. Amends the Senator Paul Simon Water for the Poor Act of 2005 to direct: (1) the President, through the Secretary, to develop a strategy every five years to further the U.S. foreign policy objective to provide affordable and equitable access to safe water and sanitation in developing countries; and (2) the Administrator, through the Global Water Coordinator, to develop a complementary strategy to further the U.S. foreign assistance objective to provide affordable and equitable drinking water, sanitation, and hygiene in developing countries.

Requires USDA to seek information, and make information disclosures, only to the extent necessary to verify an individual's employment and income. Requires the Secretary of HHS to: (1) compare information in the National Directory with information provided by USDA about such individuals; and (2) disclose to USDA, in turn, National Directory information about them. Authorizes USDA to use the information resulting from a data match to: (1) verify the employment and income of such individuals; and (2) analyze such information after the removal of personal identifiers. Sets forth rules for the types of disclosures permitted and conditions on disclosure. Amends the Internal Revenue Code to apply to farm housing programs under the Housing Act of 1949 the requirement that the Commissioner of Social Security and the Secretary of the Treasury disclose return information on earned, retirement, and unearned income to federal, state, and local agencies administering certain programs under the Social Security Act, the Food Stamp Act of 1977, or veterans programs, or certain housing assistance programs.

Replaces the current pediatric cancer research and awareness grant program carried out by the Secretary of Health and Human Services (HHS) with a comprehensive children's cancer biorepositories program. Authorizes the Director of the National Institutes of Health (NIH) to make awards to eligible applicants to build upon existing initiatives to collect biospecimens and clinical and demographic information (including date of diagnosis, age at diagnosis, and patient's gender, race, and ethnicity) for at least 90% of all children, adolescents, and young adults with cancer in Comprehensive Children's Cancer Biorepositories for the purpose of achieving a better understanding of the cause of such cancers and the effects of treatments. Permits award amounts to be used to: (1) acquire, preserve, and store high quality, donated biospecimens and associated clinical and demographic information on children, adolescents, and young adults diagnosed with cancer in the United States; (2) maintain a secure searchable database for scientists and qualified health care professionals to research such biospecimens and data; and (3) make available and distribute such biospecimens and data to researchers and professionals for peer-reviewed research. Revises the national childhood cancer registry grant program to require the Director of the Centers for Disease Control and Prevention (CDC) to award grants to state cancer registries to enhance and expand infrastructure to track the epidemiology of cancer in children, adolescents, and young adults. Requires a Comptroller General (GAO) report regarding the barriers to conducting pediatric studies of oncologic therapies in applications for new drugs or biological products under the Federal Food, Drug, and Cosmetic Act, including recommendations to improve development and access to new therapies as well as assessments of: (1) the feasibility of requiring studies for a pediatric oncologic indication if the therapeutic target of a drug or biologic product for an adult oncologic indication is highly relevant to any pediatric cancer to which it could apply, and (2) the impact of altering the current exemption for orphan drug designations relating to rare diseases or conditions.
