Nuclear Black-Market Elimination Act

Nuclear Black-Market Elimination Act - Authorizes the President to prohibit, for at least three years, any transaction or dealing by a U.S. person or within the United States with any foreign person or entity that the President determines sells, transfers, brokers, finances, assists, delivers or otherwise provides or receives, on or after the date of the enactment of this Act: (1) nuclear enrichment or reprocessing equipment, materials, or technology to any country for which an additional protocol with the International Atomic Energy Agency for the application of safeguards is not in force, or to any country that the President determines is developing, constructing, manufacturing, or acquiring a nuclear explosive device; or (2) designs, equipment, or specific information to assist in the development, construction, manufacture, or acquisition of a nuclear explosive device by a non-nuclear weapon state. Authorizes the President to provide assistance for up to three years under the Arms Control Act and the Foreign Assistance Act of 1961, as well as a drawdown of defense equipment and services under the latter Act, to any country that cooperates with the United States and U.S. allies to prevent the transport and transshipment of items of proliferation concern in its national territory or airspace or in vessels under its control or registry. Prohibits the United States from transferring any excess defense article that is a vessel or aircraft to a country that has not provided written assurances that it will support and assist U.S. efforts to interdict items of proliferation concern. Prohibits the President from providing, in any fiscal year, more than 75 percent of U.S. assistance to Pakistan unless Pakistan meets certain requirements, including fully sharing with the United States all information relevant to the A.Q. Khan proliferation network, and providing full access to A.Q. Khan, his associates, and any material that bears upon their activities and contacts. Provides for a national security waiver of such requirements, but prohibits its exercise in two successive fiscal years. Requires the President to: (1) identify proliferation network host countries to appropriate congressional committees; and (2) suspend all arms sales licenses to such countries.

NASA and JPL 50th Anniversary Commemorative Coin Act - Directs the Secretary of the Treasury, in commemoration of the 50th anniversary of the establishment of the National Aeronautics and Space Administration (NASA) and the Jet Propulsion Laboratory (JPL) to mint and issue: (1) ten dollar gold coins; (2) five dollar gold coins; (3) one dollar silver coins; and (4) half-dollar silver coins emblematic of the 50 years of exemplary and unparalleled achievements of NASA and JPL. Directs each Federal agency and U.S. instrumentality that has in its possession any craft or any part of a craft that flew in space to: (1) retrieve any gold, silver, copper, and other precious metal that may be used in the production of any coins under this Act from such craft or part; and (2) deposit such metals with the Director of the United States Mint. Requires that all sales of coins minted under this Act include a surcharge of : (1) $75 per coin for the ten dollar coin; (2) $35 per coin for the five dollar coin; (3) $10 per coin for the one dollar coin; and (4) $3 for the half-dollar coin, which shall be paid by the Secretary to the NASA Family Assistance Fund for the purposes of providing financial assistance to the families of NASA personnel who die as a result of injuries suffered in the performance of their official duties.

Haiti Economic Recovery Opportunity Act of 2004 - Amends the Caribbean Basin Economic Recovery Act to provide, beginning on October 1, 2003, and for each of the seven succeeding one-year periods, duty-free treatment for apparel items wholly assembled or knit-to-shape in Haiti (without regard to the country of origin of the fabrics, components, or yarns) if the President certifies to Congress that Haiti: (1) has established or is progressing toward specified political, economic, and social reforms; (2) does not engage in activities that undermine U.S. security or foreign policy; (3) does not engage in gross violations of human rights or activities in support of international terrorism; and (4) is meeting specified enforcement conditions aimed at preventing tariff or quota avoidance, customs evasion, unlawful transshipment, or false information or false document use in order to obtain such preferential treatment. Applies such provisions to goods entered or withdrawn from a warehouse for consumption on or after October 1, 2003, including a retroactive application to certain warehouse entries or withdrawals made between such date and the date of enactment of this Act.

Services for Ending Long-Term Homelessness Act - Amends the Public Health Service Act to require the Director of the Center for Mental Health Services to: (1) administer the grant program established by this Act; (2) provide technical assistance to entities that provide permanent supportive housing to the chronically homeless; and (3) implement an approach to disseminate information about such housing that is targeted to individuals who have been homeless for long periods and have disabilities. Defines "chronically homeless" as an individual or family that is currently homeless, has been homeless continuously for at least one year or on at least four separate occasions in the last three years, and has an adult head of household with a disabling condition. Requires the Secretary of Health and Human Services, acting through the Administrator of Substance Abuse and Mental Health Services Administration, to: (1) design national strategies to provide services in supportive housing to end chronic homelessness; (2) collaborate with specified Federal departments and programs to implement programs that address chronic homelessness; (3) develop improved methods for serving individuals with mental or physical illnesses, disabilities, substance abuse problems, or co-occurring disorders; and (4) promote collaboration between Federal, State and local agencies that are responsible for systems of care to ensure that services for the chronically homeless are delivered in a coordinated manner that promotes housing stability. Requires the Secretary to award matching grants for the provision of services to chronically homeless individuals in permanent supportive housing.

Appeals to the Government of Venezuela and to the democratic opposition to respect the rights of all citizens to freely organize and support political leaders and to conduct peaceful activities in support of human, political, and civil rights. Commends: (1) the National Electoral Council for carrying out the validation of signatures on recall petitions in a fair and expeditious manner; and (2) the Organization of American States, the Group of Friends of the Secretary General of the Organization of American States for Venezuela, and the Carter Center for their assistance. States that the House of Representatives: (1) condemns the Palestinian leadership for failing to carry out its responsibilities under the Roadmap and under other obligations it has assumed, and to bring an end to terrorist attacks directed at Israel; (2) deplores the misuse of the International Court of Justice (ICJ) for the political purpose of advancing the Palestinian position on matters Palestinian authorities have said should be the subject of negotiations, the ICJ's willingness to acquiesce in efforts that are likely to undermine its reputation and interfere with a resolution of the Palestinian-Israeli conflict, and the attempt to infringe upon Israel's right to self defense; (3) commends the President and the Secretary of State for their leadership in marshaling opposition to the misuse of the ICJ; (4) calls on members of the international community to reflect on the steps taken by the Government of Israel to mitigate the impact of the security barrier on Palestinians, including steps it has taken by order of its High Court of Justice; and (5) cautions members of the international community that they risk a strongly negative impact on their relationship with the people and Government of the United States should they use the ICJ's advisory judgment as an excuse to interfere in the Roadmap process and impede efforts to achieve progress toward a negotiated settlement.

Garrett Lee Smith Memorial Act - Amends the Public Health Service Act to revise provisions regarding Federal assistance for programs to reduce suicide among children and adolescents. Requires the Secretary of Health and Human Services, acting through the Administrator of the Substance Abuse and Mental Health Services Administration, to award grants or cooperative agreements to: (1) develop and implement State-sponsored statewide or tribal youth suicide early intervention and prevention strategies in schools, educational institutions, juvenile justice systems, substance abuse programs, mental health programs, foster care systems, and other child and youth support organizations; (2) support public organizations actively involved in State-sponsored statewide or tribal youth suicide early intervention and prevention strategies and in the development and continuation of such intervention and prevention strategies; (3) collect and analyze data on State-sponsored statewide or tribal youth suicide early intervention and prevention services that can be used to monitor the effectiveness of such services and for research, technical assistance, and policy development; and (4) assist eligible entities in achieving their targets for youth suicide reductions. Requires the Secretary, acting through the Administrator, to award a grant or contract to establish the Suicide Prevention Resource Center. Requires the Secretary to award grants to institutions of higher education to expand mental and behavior health services to students, to provide such services, and to develop best practices for the delivery of such services.

Positive Aging Act of 2004 - Amends the Older Americans Act of 1965 to direct the Assistant Secretary for Aging to establish an Office of Older Adult Mental Health Services within the Administration on Aging of the Department of Health and Human Services (HHS). Directs the Assistant Secretary to make grants to: (1) States for systems to deliver mental health screening and treatment services to older individuals lacking access to such services, and for programs to increase public awareness of the benefits of preventing and treating mental disorders; and (2) public and nonprofit private entities for demonstration projects providing mental health screening and treatment services to older individuals residing in rural areas or in naturally occurring retirement communities in urban areas. Amends the Public Health Service Act to direct the Secretary of HHS, acting through the Director of the Center for Mental Health Services, to make grants to public and nonprofit private entities for: (1) demonstration projects integrating mental health services for older patients into primary care settings; and (2) multidisciplinary geriatric mental health outreach teams in community settings where older adults reside or receive social services. Requires the Director to designate a Deputy Director for Older Adult Mental Health Services. Requires membership of the advisory council for the Center for Mental Health Services to include representatives of older Americans, their families, and geriatric mental health specialists. Includes among projects of national significance the targeting of substance abuse by older individuals. Includes services for older individuals under community mental health services block grant State plan criteria.

Unborn Child Pain Awareness Act of 2004 - Amends the Public Health Service Act to require an abortion provider, before beginning any abortion of a pain-capable unborn child (defined as an unborn child who has reached a probable stage of development of 20 weeks after fertilization), to: (1) make a specified statement to the pregnant woman that Congress has determined that there is substantial evidence that the process will cause the unborn child pain, and that the mother has the option of having pain-reducing drugs administered directly to the child; (2) provide to the woman an Unborn Child Pain Awareness Brochure (unless she waives receipt) and an Unborn Child Pain Awareness Decision Form; and (3) obtain on the form the woman's signature and her explicit request for or refusal of the administration of drugs to the child. Directs the Secretary of Health and Human Services to develop the brochure and form. Makes such provisions inapplicable to a provider in the case of a medical emergency. Requires the provider to certify that a medical emergency exists. Sets penalties for false statements. Establishes penalties for willfully failing to comply with this Act, including civil penalties, medical license suspension, or both. Authorizes: (1) specified officials to bring suit in Federal court; and (2) private rights of action by a parent or guardian of a woman who is an unemancipated minor. Requires each State and State medical licensing authority to promulgate procedures for the revocation or suspension of a provider's license upon a court finding that the provider has violated this Act. Subjects a State that fails to implement such procedures to loss of Medicaid funding.

Expresses the sense of the House of Representatives that: (1) all countries should recognize the seriousness of anti-Semitic acts and should take action against those individuals and entities that incite hatred and perpetrate criminal acts against Jewish populations; (2) member countries of the European Union (EU) should continue to officially and publicly repudiate those individuals and entities that carry out such acts and should undertake tougher and more unified measures to combat the growth of anti-Semitic violence and intimidation throughout the European continent; (3) the EU should protect the safety of their Jewish communities through the establishment of the position of a director to monitor and combat anti-Semitism within the EU through education, media analysis, and coordination with responsible partners in each EU member country; (4) the delegates from the Organization for Security and Cooperation in Europe (OSCE) Conference on Anti-Semitism should call on their governments to make anti-Semitism a criminal offense and should establish within the OSCE a framework to monitor anti-Semitic activities, to monitor legislation to combat anti-Semitism, to coordinate between law enforcement organizations in such countries, and to implement relevant educational programs for the next generation of Europeans; (5) the President should direct the United States Permanent Representative to the United Nations to work with EU member countries to secure passage of a resolution condemning anti-Semitism at the upcoming session of the United Nations General Assembly; and (6) combating acts of anti-Semitism worldwide through diplomatic efforts should be a U.S. foreign policy priority.

Amends the State Department Basic Authorities Act of 1956 to authorize and encourage the Secretary of State to establish within the Department of State an Office to Monitor and Combat anti-Semitism. Amends the Foreign Assistance Act of 1961 to include in the Department of State annual reports information on: (1) acts of anti-Semitism in foreign countries; and (2) governmental responses to such acts, including efforts to promote anti-bias education. Makes similar amendments to the International Religious Freedom Act of 1998.

Local Law Enforcement Hate Crimes Prevention Act of 2004 - Authorizes the Attorney General to provide technical, forensic, prosecutorial, or other assistance in the criminal investigation or prosecution of any crime that: (1) constitutes a crime of violence under Federal law or a felony under State or Indian tribal law; and (2) is motivated by prejudice based on the race, color, religion, national origin, gender, sexual orientation, or disability of the victim or is a violation of the hate crime laws of the State or tribe. Directs the Attorney General to give priority for assistance to crimes committed by offenders who have committed crimes in more than one State and to rural jurisdictions that have difficulty covering the extraordinary investigation or prosecution expenses. Authorizes the Attorney General to award grants to assist State, local, and Indian law enforcement officials with such extraordinary expenses. Directs the Office of Justice Programs to: (1) work closely with funded jurisdictions to ensure that the concerns and needs of all affected parties are addressed; and (2) award grants to State and local programs designed to combat hate crimes committed by juveniles. Prohibits specified offenses involving actual or perceived race, color, religion, national origin, gender, sexual orientation, or disability. Directs the U.S. Sentencing Commission to study and provide sentencing enhancements for adult recruitment of juveniles to commit hate crimes. Amends the Hate Crimes Statistics Act to require the crime data to be collected and published by the Attorney General to include data about crimes that manifest evidence of prejudice based on gender.

Recognizes and commends the parents and relatives of children with autism for their sacrifice and dedication in providing for the special needs of children with autism and for absorbing significant financial costs for specialized education and support services. Supports the goal of increasing Federal funding for aggressive research to: (1) determine causes of autism; (2) identify the best methods of early intervention and treatment; (3) expand programs for individuals with autism across their lifespan; and (4) promote understanding of the special needs of individuals with autism. Commends the Department of Health and Human Services for the implementation of the Children's Health Act of 2000, particularly for establishing four centers of excellence at the Centers for Disease Control and Prevention to study the epidemiology of autism and related disorders and proposing centers of excellence at the National Institutes of Health for autism research. Stresses the need to begin early intervention services soon after an individual has been diagnosed with autism, noting that early intervention strategies are the primary therapeutic options for individuals with autism and early intervention significantly improves outcomes for individuals with autism and can reduce the level of funding and services needed later in life. Supports fulfilling the Federal Government's nearly 30-year-old commitment to provide States with part of the costs needed to educate children with disabilities under part B of the Individuals with Disabilities Education Act by funding the maximum 40 percent of such costs. Recognizes the: (1) shortage of appropriately trained teachers who have the skills and support necessary to teach, assist, and respond to special needs students, including those students with autism; and (2) importance of worker training programs that meet the needs of developmentally disabled individuals, including those individuals with autism. Notes that people with autism can be, and are, productive members of the workforce if they are given appropriate support, training, and early intervention services.

Know Your Vote Counts Act of 2004 - Amends the Help America Vote Act of 2002 to revise voting system standards to require the voting system used in an election for Federal office to provide the voter with an auditable paper record showing how the vote will be recorded by the system after the voter enters it. Requires the voter to use such record to verify that the vote shown is the vote the voter intends to cast. Requires the system, if the voter does not verify his or her vote, to provide the voter with: (1) the opportunity to change the ballot and correct any error, and (2) a new auditable paper record that reflects the change or correction made by the voter. Makes a vote final once a voter verifies that the vote shown on a paper record is the vote the voter intends to cast. Makes the paper record serve as a permanent paper record of the vote. Prohibits the removal of such record from the polling place except for purposes related to a recount. Requires voluntary voting system guidelines to include guidelines to ensure security of electronic data.

American Bald Eagle Recovery and National Emblem Commemorative Coin Act

American Bald Eagle Recovery and National Emblem Commemorative Coin Act - Directs the Secretary of the Treasury, in celebration of the recovery of the bald eagle, in commemoration of the 35th anniversary of the enactment of the Endangered Species Act of 1973, and the placement of the bald eagle on the endangered species list under such Act, to mint and issue not more than: (1) 100,000 $5 gold coins; (2) 500,000 $1 silver coins; and (3) 750,000 half dollar coins. Directs that the design of the coins be emblematic of the bald eagle and its history, natural biology, and national symbolism. Requires that sales of the coins include a surcharge of $35 per coin for the $5 coin, $10 for the $1 coin, and $3 for the half dollar coin, which shall be promptly paid by the Secretary to the American Eagle Foundation of Tennessee to: (1) establish an interest-bearing endowment called the American Eagle Fund as a permanent source of support for the care, monitoring, maintenance, and recovery of the bald eagle and its habitat in the United States; (2) make annual grants to Federal, State, and private eagle restoration, protection, and enhancement projects; (3) administer the Fund in an annual amount not to exceed the lesser of ten percent of the annual income of the Fund or $250,000; and (4) provide financial support for capital projects and for continuation and expansion of the Foundation's efforts to educate the American people about the bald eagle.
