Federal Firefighters Fairness Act of 2009

Federal Firefighters Fairness Act of 2009 - Provides that: (1) specified diseases, including heart disease, lung disease, tuberculosis, hepatitis, human immunodeficiency virus (HIV), and specified cancers, of federal employees in fire protection activities shall be presumed to be proximately caused by such employment; (2) the disability or death of such an employee due to such a disease shall be presumed to result from personal injury sustained while in the performance of duty; and (3) such presumptions may be rebutted by a preponderance of the evidence. Defines an "employee in fire protection activities" as a firefighter, paramedic, emergency medical technician, rescue worker, ambulance personnel, or hazardous material worker, who: (1) is trained in fire suppression; (2) has the legal authority and responsibility to engage in fire suppression; (3) is engaged in the prevention, control, and extinguishment of fires or response to emergency situations where life, property, or the environment is at risk; and (4) performs such activities as a primary responsibility of his or her job. Directs the National Institute of Occupational Safety and Health (NIOSH) to examine the implementation of this Act and appropriate scientific and medical data related to the health risks associated with firefighting and to report to Congress on: (1) an analysis of the injury claims made under this Act; (2) an analysis of the available research related to the health risks associated with firefighting; and (3) recommendations for any administrative or legislative actions necessary to ensure that those diseases most associated with firefighting are included in the presumption created by this Act.

Psoriasis and Psoriatic Arthritis Research, Cure, and Care Act of 2009 - Requires the Secretary of Health and Human Services, acting through the Director of the National Institutes of Health (NIH), to continue to expand and intensify research and related NIH activities with respect to psoriasis and psoriatic arthritis. Requires the Directors of the National Institute of Arthritis and Musculoskeletal and Skin Diseases and the National Institute of Allergy and Infectious Diseases to continue to conduct and support research to expand understanding of the causes of, and to find a cure for, psoriasis and psoriatic arthritis. Requires the Secretary, acting through the Director of the Centers for Disease Control and Prevention (CDC), to undertake psoriasis and psoriatic arthritis data collection and develop a psoriasis and psoriatic arthritis patient registry. Encourages the Secretary to convene a summit on federal efforts regarding psoriasis and psoriatic arthritis research, treatment, education, quality-of-life, and data collection. Directs the Secretary to enter into an agreement with the Institutes of Medicine to study insurance coverage of psoriasis and psoriatic arthritis.

Airline Flight Crew Technical Corrections Act - Amends the Family and Medical Leave Act of 1993 with respect to the hours-of-service requirement airline flight crews must meet to be eligible for leave under such Act. Declares that a flight attendant or flight crewmember will be considered to meet such requirement if he or she has worked or been paid for: (1) 60% of the applicable monthly guarantee, or the equivalent annualized over the preceding 12-month period; and (2) a minimum of 504 hours during such period. Authorizes the Secretary of Labor to provide, by regulation, a method for calculating such leave for airline flight crews.

James Zadroga 9/11 Health and Compensation Act of 2009 - Amends the Public Health Service Act to establish within the National Institute for Occupational Safety and Health the World Trade Center Health Program (WTC program) to provide: (1) medical monitoring and treatment benefits to eligible emergency responders and recovery and cleanup workers who responded to the World Trade Center terrorist attacks on September 11, 2001; and (2) initial health evaluation, monitoring, and treatment benefits to residents and other building occupants and area workers who were directly impacted and adversely affected by such attacks. Requires the WTC program administrator to: (1) implement a quality assurance program; (2) establish the WTC Health Program Scientific/Technical Advisory Committee; (3) establish the WTC Responders Steering Committee and the WTC Community Program Steering Committee; (4) provide for education and outreach on services under the WTC program; (5) provide for the uniform collection of data related to WTC-related health conditions; (6) conduct research on physical and mental health conditions that may be related to the September 11 terrorist attacks; and (7) extend and expand arrangements with the New York City Department of Health and Mental Hygiene to provide for the World Trade Center Health Registry. Authorizes the administrator to make grants to the Department to address mental health needs relating to the terrorist attacks. Amends the Air Transportation Safety and System Stabilization Act to: (1) make individuals eligible for compensation under the September 11 Victim Compensation Fund of 2001 for harm as a result of debris removal; and (2) extend the deadline for making a claim for compensation.

Performance Rights Act - Amends federal copyright law to: (1) grant performers of sound recordings equal rights to compensation from terrestrial broadcasters; (2) establish a flat annual fee in lieu of payment of royalties for individual terrestrial broadcast stations with gross revenues of less than $1.25 million and for noncommercial, public broadcast stations; (3) grant an exemption from royalty payments for broadcasts of religious services and for incidental uses of musical sound recordings; and (4) grant terrestrial broadcast stations that make limited feature uses of sound recordings a per program license option. Prohibits taking into account license fees payable for public performance via digital audio transmission of sound recordings in any proceeding to set or adjust the license fees for the purpose of reducing or adversely affecting such license fees. (Current law prohibits taking those fees into account in such a proceeding without referencing the purpose.) Prohibits anything in this Act from adversely affecting the public performance rights or royalties payable to songwriters or copyright owners of musical works. Prohibits taking into account the rates established by the Copyright Royalty Judges in any proceeding to reduce or adversely affect the license fees payable for public performances by terrestrial broadcast stations. Requires that such license fees for the public performance of musical works be independent of license fees paid for the public performance of sound recordings. Revises provisions relating to proceeds from the licensing of transmissions.

Amends the Homeland Security Act of 2002 to: (1) include dental personnel within the definition of "emergency response providers"; and (2) require the Chief Medical Officer of the Department of Homeland Security (DHS) to serve as DHS's primary point of contact for the dental community with respect to medical and public health matters related to natural disasters, acts of terrorism, and other man-made disasters. Amends the Post-Katrina Emergency Management Reform Act of 2006 to require operational plans developed by federal agencies with responsibilities under the National Response Plan to address the preparedness and deployment of dental resources.

Establishes in the Department: (1) the Office of Peace Education and Training; (2) the Office of Domestic Peace Activities; (3) the Office of International Peace Activities; (4) the Office of Technology for Peace; (5) the Office of Arms Control and Disarmament; (6) the Office of Peaceful Coexistence and Nonviolent Conflict Resolution; (7) the Office of Human Rights and Economic Rights; and (8) the Intergovernmental Advisory Council on Peace. Directs the Secretary of Defense and the Secretary of State to consult with the Secretary concerning nonviolent means of conflict resolution when a conflict between the United States and any other government or entity is imminent or occurring. Transfers to the Department the functions, assets, and personnel of various federal agencies. Establishes the Federal Interagency Committee on Peace. Directs the Secretary to encourage citizens to celebrate the blessings of peace and endeavor to create peace on a Peace Day.

Young, Jr. Social Work Reinvestment Act - Directs the Secretary of Health and Human Services to establish the Social Work Reinvestment Commission to provide independent counsel to Congress on policy issues associated with the recruitment, retention, research, and reinvestment in the profession of social work. Directs the Commission to study and report to Congress on issues facing the social work profession, including: (1) fair market compensation, high social work educational debt, social work workforce trends, translating social work research to practice, and social work safety; and (2) state-level social work licensure policies and reciprocity agreements for providing services across state lines. Requires such study to assess the professional capacity of the social work workforce to serve and respond successfully to the increasing biopsychosocial needs of individuals, groups, and communities in certain areas, including aging and child welfare. Authorizes the Secretary to award: (1) workplace improvement grants to eligible entities and individuals to address workplace concerns for the social work profession, including caseloads, compensation, social work safety, supervision, and working conditions; and (2) research grants, education and training grants, and community-based programs of excellence grants. Directs the Secretary to: (1) contract with a national social work research entity to serve as a coordinating center and clearinghouse for information on activities funded under the grants; and (2) develop a multi-media outreach campaign and issue public service announcements that advertise and promote the social work profession.

Military Retirees Health Care Protection Act - Expresses the sense of Congress that: (1) the Department of Defense (DOD) and the nation have a committed health benefits obligation to retired military personnel that exceeds the obligation of corporate employers to civilian employees; and (2) DOD has many additional options to constrain the growth of health care spending in ways that do not disadvantage beneficiaries, and should pursue such options rather than seeking large fee increases for beneficiaries. Prohibits an increase after: (1) April 1, 2006, in a premium, deductible, copayment, or other charge prescribed by the Secretary of Defense for medical and dental health care coverage for military personnel; and (2) September 30, 2009, in the dollar amount of a cost-sharing requirement under the DOD pharmacy benefits program. Prohibits: (1) charges for DOD inpatient care from exceeding $535 per day; and (2) beginning on January 1, 2009, an increase in premiums under TRICARE (a DOD managed health care program) for certain members of the Selected Reserve.

Military Domestic and Sexual Violence Response Act - Establishes in the Department of Defense (DOD) an Office of the Victims' Advocate to facilitate access to services for victims of domestic or family violence, sexual assault, and stalking in the military. Directs the Secretary of Defense, acting through the Director of the Office, to require DOD policies for victim assistance, family advocacy, and equal opportunity programs to provide for a victims' advocates program within each military department. Authorizes the Secretary to award contracts to: (1) support DOD crisis intervention services for victims of such violence; and (2) provide training on prevention of such violence. Prohibits any person from restricting a member of the Armed Forces in communicating with the Office or from taking or withholding a personnel action in retaliation for making such a communication. Provides for: (1) employment of a sexual assault nurse examiner, a psychiatrist, and a complimentary clinical team at each DOD military treatment facility; and (2) DOD community level programs and shelter services for active duty members and their families who are victims of such violence shelter . Specifies the rights of victims of such violence reported to a military law enforcement agency. Directs a military commanding officer who receives a qualifying complaint alleging such violence to investigate it and report. Specifies circumstances under which military law enforcement officers shall arrest a person for committing domestic violence. Establishes a Director of Special Investigations in DOD to review investigations of allegations of such violence and refer cases for prosecution. Amends the Uniform Code of Military Justice to: (1) include as "aggravated assault" and specify penalty limits for an assault involving domestic or family violence; and (2) provide for court-martial punishment of violations of no contact or protective orders. Authorizes the Secretary to: (1) contract for treatment services for members of the Armed Forces who have committed such violence; and (2) ensure that sex offender treatment providers in the contracted program meet the state licensing or certification standards. Requires the Secretary of Veterans Affairs to: (1) ensure that Department of Veterans Affairs (VA) primary care providers receive training in the screening and referral of veterans who have suffered military sexual trauma; and (2) conduct related pilot programs. Prohibits the Secretary of the military department concerned from approving a financial award or a promotion for an officer or employee who has been convicted of or disciplined for committing such violence. Directs the Secretary to study: (1) the prevalence and nature of such violence, of intimate partner violence, and of child maltreatment, abuse, suicide, and homicide in the Armed Forces; and (2) military procedures after an incident is reported.

Prohibits requiring repayment of certain amounts previously paid to SBP recipients in the form of a retired pay refund. Repeals the optional authority of (and instead requires) the Secretary of the military department concerned to pay an annuity to a member's dependent children when there is no eligible surviving spouse. Directs the Secretary concerned to restore annuity eligibility to a surviving spouse who earlier agreed to transfer such eligibility to a surviving child or children of a member.

Pancreatic Cancer Research and Education Act - Amends the Public Health Service Act to require the Secretary of Health and Human Services to establish and implement a Pancreatic Cancer Initiative to assist in coordinating activities to address the high mortality rate associated with pancreatic cancer. Requires the Secretary to establish the Interdisciplinary Pancreatic Cancer Coordinating Committee to: (1) provide advice on overall research objectives and benchmarks for pancreatic cancer research; (2) develop and annually update a strategic plan for pancreatic cancer research awareness; and (3) conduct evaluations and make recommendations to the Secretary, the Director of the National Institutes of Health (NIH), and the Director of the National Cancer Institute regarding the prioritization and award of NIH research grants relating to pancreatic cancer. Requires the Secretary to develop a primary care provider education program on pancreatic cancer. Requires the Director of NIH and the Director of the Centers for Disease Control and Prevention (CDC) to develop a communication tool kit for patients and their families that focuses on specific pancreatic cancer issues relating to patient choices and patient care. Allows the Secretary to award grants to research institutions for use in developing innovative compounds or technologies for the prevention, early detection, or treatment of those cancers with five-year survival rates of less than 50%. Requires the Secretary to focus on pancreatic cancer during the initial five fiscal years of awarding such grants. Allows the Secretary to designate two additional Specialized Programs of Research Excellence focusing solely on pancreatic cancer research.

Food and Drug Administration Globalization Act of 2009 - Amends the Federal Food, Drug, and Cosmetic Act (FFDCA) to set forth provisions governing food safety, including requiring for each food facility: (1) a hazard analysis of facilities that manufacture, process, pack, transport, or hold food for consumption in the United States; (2) identification and implementation of preventive controls; and (3) a written food safety plan. Requires the Secretary of Health and Human Services to: (1) issue science-based performance standards to significantly minimize, prevent, or eliminate the occurrence of such hazards; (2) establish science-based minimum standards for the safe production and harvesting of fruits and vegetables as necessary; (3) establish a risk-based inspection schedule; and (4) establish a program to expedite the movement of certified food through the importation process. Provides for: (1) an accreditation system for food facilities; and (2) certification of laboratories to conduct sampling and testing of food. Requires the Secretary, acting through the Director of the Centers for Disease Control and Prevention (CDC), to establish an active surveillance system for food. Sets forth provisions governing drug and device safety, including: (1) providing for risk-based inspection schedules; (2) requiring quality risk management plans for establishments; (3) requiring country of origin labeling; and (4) providing for the recall of drugs. Sets forth provisions governing cosmetic safety, including requiring cosmetic establishments to: (1) submit to the Secretary a cosmetic and ingredient statement for each cosmetic; (2) report any serious and unexpected adverse event in the United States associated with the use of the cosmetic; and (3) conform with good manufacturing practices. Sets forth provisions governing the Food and Drug Administration (FDA), including provisions: (1) regarding the reorganization of FDA; and (2) authorizing the Commissioner of Food and Drugs to issue subpoenas for any proceeding regarding a violation of the FFDCA.

Permits the vouchers to be transferred to another person to allow that person to mail correspondence and small parcels to the member. Limits vouchers to one per month. Providing Resources Early for Kids Act of 2009 or the PRE-K Act - Amends the Elementary and Secondary Education Act of 1965 to direct the Secretary of Education to award matching grants to states to enhance or improve state-funded preschool programs. Sets forth a grant formula favoring states that: (1) have curricula aligned with state early learning standards; (2) use nationally-established, or better, best practices for class size and teacher-to-student ratios; (3) require each teacher to have at least an associate degree in early childhood education or a related field; (4) require such programs to operate for at least a full academic year; and (5) have a plan for meeting the requirement, within five years of receiving such grant, that teachers have at least a baccalaureate degree in early childhood education or have such degree in a related field, but have also completed specialized training in early childhood education. Directs the Secretary to establish a competitive process for awarding grants to other states that demonstrate that they will meet such requirements within two fiscal years. Prohibits state grantees from reducing their preschool or child care expenditures. Requires states to give priority, in using grant funds, to preschool programs in communities with high concentrations of impoverished children. Includes among grant uses: (1) increasing the qualifications of, and benefits provided to, teachers, teacher aides, and program directors; (2) decreasing class size and improving teacher-to-student ratios; (3) providing certain comprehensive services that support healthy child development; (4) extending program duration; and (5) improving program monitoring and learning environments. Reserves funds for competitive grants to Indians for their preschool programs.

Nonnative Wildlife Invasion Prevention Act - Requires the Secretary of the Interior to promulgate regulations establishing a process for assessing the risk of all nonnative wildlife species proposed for importation into the United States, other than those included in a list of approved species issued under this Act. Sets forth factors that must be considered, including the identity of the organism to the species level, the native range of the species, whether the species has caused harm to the economy, the environment, or other animal species or human health in similar ecosystems, and the likelihood of establishment or spread of the species in the United States. Provides procedures for issuance and expansion of a list of nonnative wildlife species approved for importation and a list of nonnative wildlife species that are prohibited. Establishes prohibitions on: (1) importation or transportation between states of nonnative species that are not included in the list of approved species; (2) permit violations; and (3) possession, purchase, sale, barter, release, or breeding of such species. Exempts from such prohibitions actions by law enforcement personnel to enforce this Act or by federal or state officials to prevent the introduction or establishment of nonnative wildlife species. Declares that nothing in this Act restricts the importation or transportation between states of such species by a federal agency for its own use if the species remains in its possession. Authorizes the Secretary to issue permits authorizing otherwise prohibited importation for scientific research, for medical, accredited zoological or aquarium display purposes, or for educational purposes that are specifically reviewed, approved, and verified by the Secretary if the Secretary finds that there has been a proper showing by the permittee of responsibility for the specimen and continued protection of the public interest and health. Allows the imposition of fees on persons who submit a proposal to include a species in either of the lists to recover the costs of assessing risks of nonnative wildlife species. Establishes a Nonnative Wildlife Invasion Prevention Fund into which such fees and fines for violations will be deposited. Redesignates the Invasive Species Council established by Executive Order 13112 as the National Invasive Species Council.

Federal Employees Paid Parental Leave Act of 2009 - Allows federal employees to substitute any available paid leave for any leave without pay available for either the: (1) birth of a child; or (2) placement of a child with the employee for either adoption or foster care. Makes available (subject to specified requirements) for any of the 12 weeks of leave an employee is entitled to for such purposes: (1) four administrative weeks of paid parental leave in connection with the birth or placement involved; and (2) any accumulated annual or sick leave. Authorizes the Director of the Office of Personnel Management (OPM) to promulgate regulations to increase the amount of paid parental leave available to such an employee to a total of eight administrative workweeks, based on the consideration of: (1) the benefits to the federal government, including enhanced recruitment and employee retention; (2) the cost to the government; (3) trends in the private sector and in state and local governments; and (4) the federal government's role as a model employer. Amends the Congressional Accountability Act of 1995 and the Family and Medical Leave Act of 1993 to allow the same substitution for covered congressional employees, Government Accountability Office (GAO) employees, and Library of Congress employees.
