Medicare Benefit Improvements Act of 1990 - Amends title XVIII (Medicare) of the Social Security Act to cover screening mammographies for women over age 34 at a frequency which varies on the basis of a woman's age and risk of developing breast cancer. Covers up to 80 hours of annual in-home respite care furnished to an individual who has incurred expenses equal to a specified Medicare Part B (Supplementary Medical Insurance) cost-sharing limit and, for the preceding three months, has been unable to perform at least two specified daily living activities without the assistance of an uncompensated primary caregiver with whom he or she resides. Covers nursing care and home health aide services as home health services if such services are needed less than seven days each week or are needed for up to 38 consecutive days. Amends part A (Hospital Insurance) of the Medicare program to create an extension period of hospice care for terminally ill beneficiaries which is to follow the two 90-day periods and the subsequent 30-day period of hospice care coverage currently provided in an individual's lifetime. Increases the Medicare part B premium.

Expedited Consideration of Proposed Rescissions Act of 1990 - Amends the Congressional Budget and Impoundment Control Act of 1974 to require a special message, in the case of budget authority proposed to be rescinded or reserved, to include language amending the law authorizing such programs to allow them to continue to function at the proposed new level of budget authority. Allows the President to transmit to both Houses of the Congress, for expedited consideration, one or more special messages proposing to rescind all or part of any item of budget authority provided in an appropriation bill. Requires that such special message be transmitted not later than three days after the President approves the appropriation bill and be accompanied by a draft bill or joint resolution that would, if enacted, rescind the budget authority proposed to be rescinded. Sets forth House and Senate procedures for the expedited consideration of such a proposal.

Amends the Internal Revenue Code to provide that payment under a life insurance contract to an insured who is terminally ill be treated as a death benefit, making such payment eligible for tax exclusion from gross income. Provides that any reference to life insurance shall be treated as referring to a qualified terminal illness rider. Provides for the tax treatment of such riders. Describes such a rider as one which provides for payments to an insured upon the insured's becoming terminally ill.

Freedom of Choice Act of 1989 - Provides that a State may not restrict the right of a woman to choose to terminate a pregnancy: (1) before fetal viability; or (2) at any time, if such termination is necessary to protect the life or health of the woman. Allows a State to impose requirements medically necessary to protect the life or health of such women.

Middle-Income Family Higher Education Savings Act of 1989 - Amends the Internal Revenue Code to allow an individual an income tax deduction for contributions to a savings account established to pay the educational expenses (tuition, supplies, meals, and lodging) of the taxpayer's child at an institution of higher education or a vocational school. Limits the deduction to $1,000 per year per child. Provides that no account may have more than one beneficiary. Permits a deduction with respect to only one account in cases of multiple accounts for the same beneficiary. Disallows the deduction for contributions made to an account after the beneficiary either attains age 25 or graduates from an eligible educational institution. Permits the exclusion from the gross income of the recipient beneficiary of payments and distributions from an education savings account as long as such amounts: (1) are used for the educational expenses of that individual; or (2) are rolled over into an education savings account established for a sibling of that individual. Exempts the education savings accounts themselves from taxation unless they cease to be proper education savings accounts because either the contributor taxpayer or the beneficiary engages in prohibited transactions or the beneficiary pledges the account as security. Establishes penalties in the form of additional tax when account funds or distributions are improperly used. Requires that the trustee of an education savings account report to the Secretary of the Treasury and to the account's benefactor on the maintenance of the account. Identifies the criteria and requirements applicable to an education savings account. Provides that contributions to an education savings account shall not be subject to gift tax. Establishes: (1) a five percent excise tax on amounts connected with any prohibited transaction with respect to an education savings account; and (2) a penalty for failure to file required reports concerning the education savings account.

Newspaper Incentive Recycling Conservation Act of 1989 - Amends the Internal Revenue Code to deny the use of the accelerated cost recovery system for determining the depreciation deduction for major newspapers that are not using the required percentage of recycled newsprint. Reduces the deduction for trade or business expenses for major newspapers that do not use such required percentage. Establishes an investment tax credit for recycling equipment.

Older Americans Long-Term Care Insurance Act of 1989 - Title I: Tax Provisions Related to Long-Term Care Insurance - Amends the Internal Revenue Code to require that, for the purpose of determining the income tax liability of issuers of qualified long-term insurance, the contracts be treated as accident or health insurance. Applies this provision to policies covering at least 12 consecutive months of necessary diagnostic, preventive, therapeutic, rehabilitative, or personal care services that are provided in a setting other than an acute care unit of a hospital. Requires policies issued after 1989 to be reinsured by the Federal National Long-Term Care Reinsurance Corporation, if the Corporation is incorporated when the policy is issued. Directs the Secretary of Health and Human Services to: (1) submit to the Congress before 1991 a study on long-term insurance policies; and (2) report annually to the Congress regarding the certification of qualified long-term care insurance. Treats qualified long-term care insurance as accident or health insurance and its benefits as benefits for personal injuries or sickness for purposes of determining appropriate tax exclusions for employer contributions or employee benefits. Excludes from gross income: (1) distributions or payments from individual retirement plans that are used during the year to pay the premiums for qualified long-term care coverage of individuals aged 59 1/2 or older; and (2) amounts received upon surrender, cancellation, or exchange of a life insurance contract and used during the year to pay the premiums for qualified long-term care insurance. Title II: Federal National Long-Term Care Reinsurance Corporation - Federal National Long-Term Care Reinsurance Corporation Act - Authorizes the Secretary to provide for the incorporation of the Federal National Long-Term Care Reinsurance Corporation (not an agency or establishment of the U.S. Government). Requires the Corporation to confine its activities to reinsuring insurance companies for extraordinary loss in the issuance or payment of qualified long-term care insurance benefits. Directs the Corporation to report annually to the President and to the Congress regarding its activities.

Urges the President to: (1) call on the Government of the United Kingdom to reject the policy of involuntary repatriation of Vietnamese boat people and allow those who have been denied refugee status by the screening program supervised by the United Nations High Commissioner for Refugees to remain temporarily in Hong Kong, pending the conclusion of negotiations over alternative measures to deal with the nonrefugee Vietnamese population; (2) commend the first asylum countries for their longstanding commitment to solving the Indochinese refugee situation and urge such countries to reject proposals to turn away refugee boats; (3) reaffirm U.S. opposition to involuntary repatriation of Vietnamese nonrefugees in Hong Kong; and (4) initiate a leadership role for the United States in implementing the Comprehensive Plan of Action, adopted at the International Conference on Indochinese Refugees in June 1989 in Geneva, Switzerland, and in negotiations over proposals to ensure humane treatment for the Vietnamese nonrefugees in Hong Kong.

Benjamin Franklin Memorial Fire Service Bill of Rights Act - Title I: Minting of Benjamin Franklin National Memorial Commemorative Coin - Benjamin Franklin National Memorial Commemorative Coin Act - Provides for the sale of Benjamin Franklin commemorative coins at a surcharge of which 25 percent shall be paid to the Benjamin Franklin National Memorial and the remainder be distributed in specified percentages to the National Fire Center and Museum Account, the National Hero Scholarship Account, the Firefighter's Tuition Assistance Account, the Hazardous Materials Response Computer Account, the In Search of Excellence Research and Education Account, and the Burn Research Grant Account of the Firefighter Assistance Trust Fund (Fund). Prohibits the issuance of such coins from resulting in any net cost to the Federal government. Title II: Fire Service Bill of Rights - Fire Service Bill of Rights Act - Amends the Federal Fire Prevention and Control Act of 1974 to establish a fire service bill of rights. Establishes the National Fire Center and Museum in the District of Columbia to provide information about the fire service and safety to the public and fire services. Funds such museum exclusively through the Fund. Establishes a National Hero Scholarship to fund the higher education of the children or spouse of a deceased firefighter. Establishes a scholarship providing tuition assistance to firefighters for higher education in fire safety or protection. Authorizes the Administrator of the United States Fire Administration to use amounts in the In Search of Excellence Research and Education Account of the Fund to fund other specified programs under the Fire Prevention and Control Act of 1974. Establishes the Firefighters Assistance Trust Fund. Places the National Academy for Fire Prevention and Control within the United States Fire Administration. Directs the Administrator to use funds from the Hazardous Materials Response Computer Account of the fund to procure computer equipment for fire services that want such equipment. Directs the Administrator to make a grant from the Burn Research Grant Account of the Fund to one national firefighter's burn foundation dedicated to reducing burn injuries. Requires the Administrator to prepare and make available to State fire marshals, upon request, a manual describing Federal procedures for disposing of surplus property and highlighting how fire services could obtain such property. Directs the Administrator to distribute to such marshals information on the infectious diseases to which firefighters are particularly vulnerable.

Amends the Internal Revenue Code to allow an individual income tax deduction for contributions to a savings account established to pay the educational expenses (tuition, supplies, meals, and lodging) of the taxpayer's child or certain other relatives at an institution of higher education or a vocational school. Limits the deduction to $1,500 annually (adjusted for inflation) for each account. Disallows the deduction for contributions to an account maintained for any individual aged 19 or older. Requires any account balance to be distributed after the beneficiary attains age 30. Excludes from gross income any account distributions that are: (1) used to pay educational expenses of the eligible beneficiary; or (2) transferred within 60 days to an individual retirement account. Exempts an account from taxation (except for the tax on unrelated business income of a charitable organization), unless a contributor or the beneficiary engages in specified prohibited transactions in connection with it. Imposes a ten percent surtax on distributions not used for educational purposes. Requires the account trustee to report to the Secretary of the Treasury and to the account's beneficiary concerning the account. Imposes a penalty for failure to report. Allows taxpayers who do not otherwise itemize deductions to deduct for contributions to an education savings account. Imposes penalty taxes in connection with excess contributions or prohibited transactions associated with an account. Exempts from contribution limitations any distributions from education savings accounts into individual retirement accounts. Excludes from gross income distributions from individual retirement accounts into education savings accounts.

Department of Housing and Urban Development Reform Act of 1989 - Title I: Ethics - Amends the Housing and Community Development Act of 1974 to require the Department of Housing and Urban Development (HUD) to allocate certain housing assistance on a need-based formula. Amends the Department of Housing and Urban Development Act to require HUD to make funding decisions and assistance allocations public. Prohibits advance disclosure of funding decisions and establishes civil monetary penalties for such violations. Amends the Housing and Community Development Act of 1974 to revise headquarters reserve categories. Requires that amounts made available to the reserve be approved in appropriation Acts. Repeals the Secretary of HUD's authority to make grants for technical assistance, special projects, and new communities under the community development block grant program (CDBG). Permits the Secretary to set aside .1 percent of specified appropriations for technical assistance. Amends the Department of Housing and Urban Development Act to require that all HUD regulation and handbook waivers be in writing and specify the grounds for the waiver. Authorizes the Secretary to impose civil monetary penalties on mortgagees or lenders for specified violations. Amends the National Housing Act to authorize the Secretary to impose civil monetary penalties on multifamily mortgagors for specified violations. Amends the Housing Act of 1959 to authorize the Secretary to impose civil monetary penalties on housing for the elderly or handicapped program mortgagors for specified violations. Amends the National Housing Act to authorize the Secretary to impose civil monetary penalties on Government National Mortgage Association issuers for specified violations. Amends the Interstate Land Sales Full Disclosure Act to authorize the Secretary to impose civil monetary penalties on land developers for specified violations. Amends the Department of Housing and Urban Development Act to require expenditure reporting and registration of consultants, lobbyists, and others attempting to influence HUD decisions. Establishes civil monetary penalties for reporting violations. Title II: Management Reform - Amends the Department of Housing and Urban Development Act to establish in HUD: (1) a Chief Financial Officer to serve as the Secretary's principal financial management advisor; and (2) a Federal Housing Administration (FHA) Comptroller. Amends the Housing and Urban Development Act of 1970 to authorize appropriations for program evaluation and monitoring. Authorizes the transfer of additional specified appropriations for management reform activities. Amends the Department of Housing and Urban Development Act to provide for expedited congressional review of HUD rulemaking. Authorizes the use of national comparability studies in implementing section 8 (c)(2) (lower income rent adjustments) of the United States Housing Act of 1937. Amends the Housing and Community Development Act of 1974 to target community development block grant use to low- and moderate-income persons. Nullifies State laws permitting single family mortgagors to redeem foreclosed properties under the rehabilitation loan program of the Housing Act of 1964. Title III: Federal Housing Administrative Reform - Amends the National Housing Act to require the Secretary to make available annually to the public an audited financial statement of the insurance funds established under such Act. Eliminates private investor-owners from the FHA single family mortgage insurance program. Retains program eligibility for public and nonprofit investor-owners. Limits secondary residence (vacation home) program eligibility to instances of undue mortgagor hardship. Requires credit reviews (under standards prescribed by HUD) of persons acquiring FHA-mortgaged properties at any time during the life of the mortgage. Repeals title X (mortgage insurance for new communities land development) of the National Housing Act. Prohibits dealer and loan broker participation in the organization of property improvement loans.

Hazardous Materials Transportation Act Uniform Safety Amendments Act of 1989 - Amends the Hazardous Materials Transportation Act to direct the Secretary of Transportation to issue regulations for the safe transportation of hazardous materials in domestic and foreign commerce (including route designations). Cites the area in which Federal regulations preempt State hazardous materials transportation requirements. Authorizes the Secretary to promulgate regulations for dispute resolution among the States or Indian tribes regarding hazardous materials highway route designations. Permits States or Indian tribes to petition for judicial review of the dispute resolution decision. Grants the Secretary discretion to either adopt or reject hazardous materials transportation standards adopted by international bodies according to the Secretary's perception of the public interest. Requires a person who offers a hazardous material for transportation in commerce to disclose to the carrier specified information on such material. Prohibits a person from altering any required marking or packaging of hazardous materials. Prohibits a person who receives a package containing a hazardous material from removing any such markings from the package until the material has been removed. Directs the Secretary to issue regulations governing the number, content, and placement of documents with respect to the transportation of hazardous materials. Provides for: (1) filing of registration statements with the Secretary by persons who transport hazardous materials; (2) the issuance of safety permits to motor carriers who transport specified hazardous materials; and registration statements and safety permit fees. Increases the penalties for persons who commit violations in the transport of hazardous materials. Prescribes guidelines under which the preemption of State laws or Indian laws conflicting with this Act shall be determined. Authorizes appropriations for FY 1990 through 1992. Directs the Secretary to conduct a study on a State-by-State basis of the flow of hazardous materials in commerce and the capability of emergency response to unintentional releases of them in the United States. Requires the Secretary to issue guidelines for the preparation and submission of a hazardous materials transportation emergency preparedness assessment of each State. Requires the Secretary to issue regulations with respect to the safe transportation of high-level radioactive waste and spent nuclear fuel (including mode and route designations). Prohibits any railroad tank car constructed before a specified date from being used for the transportation of certain explosives or hazardous materials unless its air brake equipment support attachments comply with minimum Federal standards. Requires the Secretary to conduct a study of the present system of identifying hazardous materials and of means to improve such identification while in transit. Provides for State participation in the regulation of the transportation of hazardous materials by rail carriers. Requires the Secretary to issue regulations for the safe operation of trains that transport specified hazardous materials. Directs the Secretary to promulgate regulations to prohibit the transportation in commerce of hazardous materials or solid waste in any motor vehicle which is also used to transport any food, food additive, drug, cosmetic, or device, or any package containing such items. Requires the Secretary to issue regulations with respect to making safety ratings of motor carriers available to the public. Requires the Federal Railroad Administration, the Federal Highway Administration, and the Research and Special Programs Administration to employ an additional number of safety inspectors. Provides for State participation in the regulation of hazardous materials transported by rail carriers.

Declares it is in the interests of the United States to support efforts to protect South Pacific marine resources (including albacore tuna, porpoises, whales, seals and other marine mammals, birds, sea turtles, and fish) from the slaughter of driftnet fishing. Supports the Tarawa Declaration and the South Pacific Commission resolution calling for an immediate ban on driftnet fishing in the South Pacific. Urges the Secretary of State to work toward an international convention banning driftnet fishing in the South Pacific. Urges Japan and Taiwan to immediately cease the use of driftnets in international South Pacific waters.

Amends the Education of the Handicapped Act to provide that, in exceptional circumstances, the recovery of costs incurred in providing an appropriate education for a child may be included in any award of damages recovered against a State in certain actions, including Federal actions, brought as procedural safeguards for the free and appropriate education of handicapped children.

Tuna Management Act of 1989 - Amends the Magnuson Fishery Conservation and Management Act to declare that the United States claims and will exercise exclusive fishery management authority over all pelagic species throughout the migratory range of each such species beyond the U.S. Exclusive Economic Zone, except when within any foreign nation's territorial sea or exclusive economic zone as recognized by the United States. Repeals provisions of such Act providing for the exclusion of highly migratory species of fish from the sovereign rights and exclusive fishery management authority asserted by the United States under existing provisions. Amends the Atlantic Tunas Convention Act of 1975 to change the composition of the advisory committee established by that Act.

Long-Term Health Care Markets Development Act - Title I: Tax-Free Withdrawals from IRA's Permitted for Payment of Long-Term Care Insurance Premiums - Amends the Internal Revenue Code to exclude from gross income any distribution from an individual retirement plan if: (1) the payee has attained age 59 1/2 on or before the date of the distribution; and (2) the distribution is used to pay premiums for an insurance policy covering at least 12 months of medically necessary care for the payee or a spouse meeting the same 59 1/2 year age requirement. Title II: Employers Encouraged to Offer Higher Deductibles on Employer-Provided Group Health Insurance - Amends the Internal Revenue Code to empower the trustee of an eligible individual retirement account (IRA) maintained for the benefit of an employee electing employee group health insurance coverage under a qualified high-deductible option to extend credit to the employee to pay certified medical expenses. Uses the IRA assets as security for such credit, which is subject to specified limits. Authorizes credit only in connection with plans under which the employer contributes to the employee's IRA the premium savings resulting from the employee's choice of a high deductible health care option. Title III: Elimination of Certificate of Need Programs for Nursing Facilities - Amends title XIX (Medicaid) of the Social Security Act to prohibit any State from establishing or operating any certificate of need program in connection with nursing facilities. Title IV: Tax-Free Conversion of Life Insurance Policies into Long-Term Care Insurance - Amends the Internal Revenue Code to exclude from the gross income of an individual otherwise taxable amounts derived from the whole or partial surrender, cancellation, or exchange of any life insurance policy if: (1) the individual is age 65 or older on the date of the transaction; and (2) the amounts in question are used to pay premiums for a long-term care insurance policy for the benefit of the individual or a spouse meeting the same 65-year age requirement. Title V: Reserves for Long-Term Care Insurance Treated in Same Manner as Reserves for Noncancellable Accident or Health Insurance - Amends the Internal Revenue Code to require that, for the purpose of determining the income tax liability of insurance companies, insurance contracts providing for qualified long-term health care be treated in the same way as noncancellable accident or health insurance contracts.

International and South Pacific Forestry Cooperation Act of 1989 - Authorizes the Secretary of Agriculture to undertake various activities to promote sound management and conservation of forests and related natural resources in other countries and in U.S. territories in the South Pacific. Authorizes the Secretary, in cooperation with the Government of American Samoa, to establish: (1) the South Pacific Tropical Forestry Research Center; and (2) the American Samoa Experimental Forest. Authorizes appropriations.

Expresses the sense of the Congress that the policy of the United States should be to achieve international agreement on banning large-scale driftnet fishing on the high seas as soon as possible including by supporting the Tarawa Declaration (issued by the South Pacific Forum and supporting a regional convention to establish a driftnet free zone in the South Pacific and calling for cessation of driftnet fishing by Japanese and Taiwanese vessels) and other international efforts.

Expresses the sense of the Congress that a National Environmental Institute should be established that should: (1) coordinate the environmental research and education efforts of the United States; (2) include a national college of the environment; (3) educate public policymakers in environmental protection; (4) sponsor public awareness campaigns and educational programs for school children; and (5) be the home of the National Environmental Data Bank.

Requires the Director of the Office of Personnel Management to report to the Congress on a plan to subject General Schedule employees to a locality pay system by October 1, 1990, to ensure that employees working in high-cost areas are compensated at basic pay rates commensurate with the costs of living in such areas. Requires such report to include: (1) the number of employees likely to receive locality pay and the implementation costs during the first three years of such plan; (2) any benefits resulting from such plan; (3) a description of which aspects of the plan may be implemented under existing law; and (4) proposals for any legal action which may be necessary.

Amends part B (Supplementary Medical Insurance) of title XVIII (Medicare) of the Social Security Act to cover an annual screening mammography for women over age 64.

Amends title XIX (Medicaid) of the Social Security Act to provide Medicaid coverage of screening mammographies for women age 35 and older. Varies the permissible frequency of such covered tests on the basis of a woman's age and her risk of developing breast cancer. Directs the Secretary to periodically review and revise permissible frequencies of such tests, and to establish standards which assure their safety and accuracy.
