Ethics in Government Act

Ethics in Government Act - Title I: Legislative Personnel Financial Disclosure Requirements - Requires each Member of Congress, each Congressional officer and employee who is compensated at a rate equal to or more than the pay rate for grade GS-16, and any candidate for the office of Member to file an annual financial disclosure report (hereinafter referred to as "report") containing specified information including: (1) sources and amounts of income, gifts, and reimbursements; (2) the identity and approximate value of property held and liabilities owed; (3) transactions in property, commodities, and securities; and (4) certain financial interests of a spouse or dependent. Provides that such report be filed with the Clerk of the House of Representatives or the Secretary of the Senate. Directs the Clerk and the Secretary to: (1) send a copy of each report of a Member to the Secretary of State of the Member's State; (2) compile and publish the reports of each Member as a House or Senate document; (3) submit each report for review by either the Committee on Standards of Official Conduct of the House or the Select Committee on Ethics of the Senate; and (4) make such reports generally available to the public. Prohibits the use of information from such reports for commercial, credit, or solicitation purposes. Requires the Comptroller General to report to Congress on the effectiveness of the implementation of this Title and the feasibility of conducting random audits of such reports. Establishes criminal penalties for the violation of the requirements of this Act. Title II: Executive Personnel Financial Disclosure Requirements - Requires the President, Vice President, each presidential or vice-presidential candidate, each military officer rated at 0-7 or higher, each presidential appointee whose Senate confirmation is pending, and each employee of the Executive branch who is compensated at a pay rate equal to or greater than that for grade GS-16 to file such report as described in Title I of this Act which shall include additional information regarding positions held with business entities, and agreements with respect to future employment and continuation of payments by former employers. Establishes within the Civil Service Commission the Office of Government Ethics with which the following persons must file their reports: the President, Vice President, and candidates for those offices; the Postmaster General; the Deputy Postmaster General; the Governors of the Board of Governors of the Postal Service; presidential appointees; and agency heads. Requires other Federal personnel to file with the head of the agency employing such persons, or in the case of military officers, with the Secretary of their branch of service. Charges such Office with responsibility for: (1) the overall direction of executive branch policies related to preventing conflicts of interest; (2) monitoring compliance with this Title; (3) reviewing such reports to ascertain possible violations of conflict of interest laws; and (4) developing the method of determining the value of assets required to be disclosed under this Title. Requires that such reports be made generally available to the public. Prohibits the use of information from such reports as described in Title I. Extends from one to two years the period of prohibition on appearances before an agency by a former Federal employee or official on matters that were under such person's responsibility. Includes within such prohibition informal as well as formal contacts. Prohibits formal and informal contacts with such agencies by former employees on certain other matters for a period of one year after the end of such employment. Title III: Judicial Personnel Financial Disclosure Requirements - Requires the Chief Justice and the Associate Justices of the Supreme Court, each Federal court judge, any presidential nominee for judicial office whose Senate confirmation is pending, and each judicial employee who is compensated at a pay rate equal to or greater than that for grade GS-16 to file such report as described in Title II. Directs the Judicial Conference of the United States to establish a Judicial Ethics Committee to: (1) receive such reports of judicial personnel; (2) monitor compliance with this Title; (3) provide for the availability of such reports to the public; (4) develop the method of determining the value of assets required to be disclosed under this Title; and (5) review such reports to ascertain possible violations of conflict of interest laws. Prohibits the use of information from such reports as described in Title I.

Federal Oil Shale Commercialization Test Act

Federal Oil Shale Commercialization Test Act - Declares it the purpose of this Act to establish a Federal program to test the commercial, social, and environmental viability of oil shale technologies. Directs the Secretary of Energy to (1) establish a program to determine the commercial viability of as many as three oil shale retorting technologies; (2) invite proposals from interested persons for the design, construction, and operation of oil shale commercial demonstration projects; and (3) select as many as three such proposals and enter into contracts for the implementation of such projects. Sets forth considerations for the Secretary in selecting projects. Requires that all projects authorized by this Act be located at a single site on the lands of the Naval Oil Shale Reserves. Requires the Secretary to consult with appropriate State and local officials, before selecting a demonstration project, to assess the environmental impacts of the project on the area affected. Establishes criteria for the evaluation of the economic, social, and environmental impact of oil shale technologies. Requires the publication of such evaluation by the Secretary within one year of the completion of the demonstration projects. Requires the Secretary to hold at least one public hearing, prior to the completion of his evaluation, in the area which would be most directly affected by the commercial development of oil shale. Vests title in the United States to any invention made or conceived by a participant in the demonstration projects. Prohibits the Secretary, under the authority of the Federal Nonnuclear Energy Research and Development Act of 1974, from waiving the rights of the United States to title in such inventions. Authorizes the Secretary to grant nonexclusive licenses in inventions made or conceived during the projects. Protects the ownership of background patents which project participants possess at the outset of the program. Establishes a panel to advise the Secretary on the social, environmental, and safety impact of the demonstration projects authorized by this Act. Authorizes the Secretary to use, store, or sell any shale oil produced during the program. Requires public sale of such oil to the highest qualified bidder. Authorizes the Secretary to make financial commitments for the purpose of financing essential community development and planning necessitated by the funding of demonstration facilities under this Act. Limits the amount of such commitments to $20,000,000 per year for fiscal years 1979 and 1980. Authorizes the Secretary to make direct loans and grants to eligible State and local governments should authorized funds prove insufficient. Authorizes appropriations for fiscal year 1979 for such purposes. Creates within the Treasury the Oil Shale Commercialization Test Special Fund to carry out such community development and planning assistance programs. Prescribes rules to govern the operation of the fund and related financial matters. Requires the Secretary, within 180 days after the enactment of this Act, to submit to Congress a comprehensive plan for the acquisition of information and evaluation of the environmental, social, economic and technological impact of the program. Sets forth the required content of such report. Requires an annual report from the Secretary on action he has or has not taken under this Act. Requires that the interest paid on any bond obligation guaranteed under this Act shall be included in the gross income of the purchaser of such obligation. Provides for the public disclosure of information collected by the Secretary under this Act, except to the extent such information is exempted from disclosure by federal law. Requires the holders of Federal contracts under this Act to keep such records as the Secretary may require, subject to inspection and audit by the Secretary and the Comptroller General. Authorizes appropriations for carrying out the provisions of this Act.

Establishes in the Executive Office of the President an Office of Population Policy: (1) to develop and recommend policies to meet the environmental, social, economic, health, and other needs of the Nation; (2) to study population growth; (3) to report annually to the President; and (4) to coordinate with the Secretary of State and the Director of the Agency for International Development with respect to international policies affecting population growth.

Comprehensive Family Planning Services, Research in Human Reproduction, and Prevention of Unwanted Teenage Pregnancy Act - Amends the Public Health Service Act to authorize the Secretary of Health, Education, and Welfare to make grants to, and enter into contracts with, public or nonprofit entities to assist: (1) in the establishment, maintenance and expansion of voluntary family planning projects which offer a broad range of family planning methods (including natural family planning methods) to all persons who need and desire them; (2) in the provision through such projects of comprehensive services appropriate to the needs of teenagers who are at risk of unwanted pregnancy; and (3) in the establishment and operation of demonstration projects aimed toward the alleviation of problems of infertility through counseling, referral, and medical services to persons who need and desire them. Authorizes the Secretary to make grants to public or nonprofit private entities and enter into contracts with public or nonprofit private entities and individuals: (1) to establish and maintain a network of community-based informational and educational services designed to help adolescents more fully understand the risks and consequences of teenage pregnancy and childbearing; and (2) to assist in developing appropriate information and educational materials for dissemination to such community-based services. Requires the Secretary to annually report a plan for achieving the purposes set forth in this Act with particular emphasis on assistance to adolescents. Authorizes the appropriation of specified amounts for fiscal years 1979 through 1981 to carry out the programs specified in this Act.

Voluntary Job Preservation and Community Stabilization Act - Directs the Secretary of Commerce to conduct a continuing investigation to identify those industrial, business, agricultural, and service organizations (1) which are in danger of ceasing operation or of outmigration and (2) whose closing or relocation would result in substantial unemployment and economic dislocation in the community. Provides, through the Secretary, loans for technical assistance and status and operating costs to an employee or employee/community corporation which meets certain requirements in order that it may assume ownership and operation of an organization so identified. Conditions loans, among other factors, upon certification that the corporation will allow new employees to participate and will adopt a method for acquisition of stock of persons no longer associated with the organization for the purpose of making it available to all employees on a nondiscriminatory basis. Authorizes loans of up to $15,000 to an employee who wishes to purchase stock in a purchasing corporation and who is unable to secure financing elsewhere.

Terminates all Federal statistical authority at the end of the five year period beginning on the date such authority takes effect or the date the President's compilation is submitted to Congress, whichever is later, unless the statistical authority is otherwise provided for by law. Requires that each report accompanying any bill or resolution which provides for Federal information authority to contain specified information regarding the authority involved including its cost, the number of respondents involved, and the purpose for which the information is being collected. Requires the Bureau of the Census, upon request, to provide Congress with information regarding the evaluation of any existing or proposed Federal statistical authority or information which would be appropriate for the formation or evaluation of the estimates required to be included in committee reports pursuant to this Act.

Assigns an employee of the Small Business Administration to each Federal agency to monitor compliance with specified small business programs. Establishes the Small Business Procurement Advisory Committee.

Bilingual Education Act Amendments - Revises the Bilingual Education Act to extend the general authorization for appropriations under such Act to 1981. Stipulates that grants for assistance to bilingual education programs will be available for fiscal years 1979, 1980, and 1981. Revises application requirements for such grants, including provisions regarding an evaluation plan and bilingual personnel recruitment. Provides special provisions for Puerto Rico regarding use and distribution of funds under such Act. Directs the Commissioner of Education to conduct a study of the need for compensatory English proficiency programs in Puerto Rico. Directs the Commissioner to make authorized payments directly to the applicants rather than to the Secretary of the Interior for specified programs of bilingual education for Indian children. Transfers specified evaluation responsibilities of the Secretary regarding such programs to the Commissioner of the Bureau of Indian Affairs. Revises specified bilingual education training provisions under such Act to place particular emphasis on degree programs in bilingual education. Extends indefinitely the Commissioner of Education's authority to award fellowships for bilingual teacher training. Directs the Commissioner to undertake an ongoing study of the impact of such fellowships on the field of bilingual education. Revises the definition of "eligible applicant" for purposes of such training grants. Requires an individual receiving such assistance to work in a bilingual education related activity for a period equivalent to the period such assistance was received. Establishes within the Office of Education in place of the existing Office of Bilingual Education a Bureau of Bilingual Education to be headed by a Deputy Commissioner of Bilingual Education. Revises the composition of the National Advisory Council on Bilingual Education, including a requirement that at least two parents of children whose language proficiency is other than English be included in such Council. Extends authorizations for research and demonstration projects under such Act to fiscal year 1981. Authorizes appropriations for fiscal years 1979-1983 for a grant program to local educational agencies and private nonprofit organizations eligible for Emergency School Aid assistance to meet the needs of minority children from an environment in which English is not the dominant language. Stipulates that such grants be designed to complement local programs carried out under the Emergency Aid Act. Provides for a program of grants for fiscal years 1982 and 1983 to States for bilingual education and for supplementary incentive grants to States providing State assistance to bilingual education programs. Provides guidelines for State applications for such bilingual education grants, including an annual State plan for distribution of such funds to local educational agencies giving priority to those programs that have been funded in previous years. Amends the Emergency School Aid Act to revise certain appropriation allocations and application requirements regarding: (1) educational television; (2) special projects; and (3) evaluations of specific projects assisted under such Act.

Establishes the National Solar Energy Advisory Council to advise the Secretary in the performance of his duties under this Act. Directs the Secretary to report to the President and Congress annually starting April 20, 1980 on the progress of the Federal Government and the nation in converting to solar energy.

Prohibits the Bank or its employees from utilizing the Solar Bank to finance political activities. Imposes criminal penalties for the furnishing of false or misleading information by applicants for loans under this Act. Declares that the Solar Bank and its assets shall be exempt by Federal, State, and local taxation. Establishes a Solar Energy Fund in the Treasury of the United States to pay the expenses of the Bank. Authorizes the appropriation of $5,000,000,000 to the Fund.

Authorizes the Secretary of the Treasury to lend the Facility up to $500,000,000 to enable it to meet the obligations arising under this Act. Directs the Administration to prepare and submit to the President and to the Congress annually a full report on the activities of the Facility for the previous year. Directs the Comptroller General to audit the Central Liquidity Facility.

Tribally Controlled Community College Assistance Act - Title I: Tribally Controlled Community Colleges - Provides for educational grants by the Secretary of the Interior to tribally controlled Indian community colleges. Provides that schools eligible for such grants shall be: (1) formally controlled, sanctioned or chartered by an Indian tribe or tribes; (2) governed by a board of directors, a majority of whom are Indians; (3) directed by stated goals, philosophy, or plan of action aimed at meeting the needs of Indians; and (4) attended by students, a majority of whom must be Indians if the school has been in operation more than one year. Authorizes technical assistance to the schools. Authorizes the Secretary of the Interior to contract with the Assistant Secretary of Education of the Department of Health, Education and Welfare for feasibility studies of individual schools. Requires such studies to be conducted by the Secretary of the Interior upon tribal request. Provides for the administration, and funding of these grants, with certain rule-making authority being vested in the Secretary. Authorizes appropriations of stated amounts for three years. Directs the Secretary to make annual reports and recommendations to Congress on the program. Stipulates that assistance under this Act shall not, in itself, prevent any recipient college from receiving other educational assistance. Directs the Secretary to prepare a report, on existing and planned tribally controlled community college facilities, Bureau of Indian Affairs facilities which could reasonably be converted to such use. Excludes the Navajo Tribe from the provisions of this title, as well as any colleges which limit enrollment to specific tribes. Title II: Construction Grants - Directs the Secretary to submit to Congress by November, 1979, a survey and study on the academic facilities required by tribally controlled community colleges. Authorizes the Secretary to make planning and construction grants to the colleges upon proper applications and showings. Excludes the Navajo Tribe, as well as any colleges which limit enrollment to specific tribes, from the provisions of this title. Title III: Navajo Community College - Navajo Community College Assistance Act - Amends the Navajo Community College Act to authorize construction appropriations of $60,000,000 for the College over the three years following this enactment. Appropriates additional operating and maintenance appropriations for the College. Directs the Secretary of the Interior to establish procedures to control such appropriations and to segregate them from appropriations for Navajo programs historically expended by the Bureau of Indian Affairs.

Census Act - Establishes procedures for taking the decennial census of population. Authorizes the officers or public bodies having initial responsibility for the legislative apportionment or districting in each State to submit a plan to the Secretary of Commerce identifying the geographic areas for which specific tabulations of populations are desired. Requires that such plans be developed in accordance with criteria established by the Secretary which will insure that such plan will be developed in a nonpartisan manner. Stipulates that the decennial census shall consist of: (1) an enumeration of the population; (2) sample surveys of the characteristics of population and housing; and (3) supplemental surveys as the Secretary considers necessary or when the State requests such a survey under specified circumstances. Sets forth restrictions regarding the collection of such data. Allows employees conducting the enumeration of population access to the records of the Federal Government, and of State and local governments which are necessary to insure that all individuals and households are counted. Stipulates that the survey of housing and population characteristics be conducted only through the use of samples and prohibits the Secretary from using any questionnaire for such survey unless it has been submitted to Congress and neither House has disapproved the use of such questionnaire by resolution. Authorizes the Secretary to conduct special surveys in a State for the purpose of clarifying the findings of the survey of characteristics under specified circumstances. Requires the Secretary to establish procedures for determining if errors have occurred in the process of collecting data for the enumeration of population or the survey of housing and population characteristics. Directs the Secretary beginning in 1985 and every ten years thereafter to conduct a mid-decade census of population. Requires the use of the most recent data, either from the decennial or mid-decade census, in determining eligibility for benefits under Federal programs in which census data is a factor. Requires the Secretary to submit specified reports to Congress prior to the taking of a decennial or mid-decade census. Directs the Secretary to seek the cooperation of States and units of local government in conducting the decennial census and to insure they are consulted and their needs taken into account in the publication of the results of such census. Directs the Secretary to insure that the language and categories of questions used on census forms take into account the needs and preferences of the public and do not cause arbitrary or awkward responses. Directs the Secretary to establish a public participation plan and public information plan in the taking of the decennial census. Authorizes the Secretary to issue determination estimates defined as estimates derived from any data which is not produced as an activity of the decennial census period, and which is produced to enable the executive branch to determine the amount of benefit received under Federal law by a State or unit of local government. Sets forth procedures by which a State or unit of local government may challenge such an estimate. Establishes a Census Review Committee to review policies of the Bureau of the Census, to assess the accuracy and quality of data published by the Bureau and to make recommendations to the Secretary with respect to long-range planning for the activities of the Bureau. Requires the Bureau to conduct its activities in accordance with standards established by the Committee. Stipulates that such Committee shall terminate ten years after the enactment of this Act. Requires the General Accounting Office to audit the activities of the Committee no later than nine years after the enactment of this Act. Directs the Secretary to issue regulations specifying, for each group of temporary staff, the conditions under which such staff may be utilized, the number of staff which may be utilized at one time, and the information to which such staff may have access. Directs the Secretary in 1979, in 1983 and every fifth year after to take a census of agriculture and to take a census of irrigation and drainage in conjunction with such census in 1979, in 1988 and every tenth year thereafter.
