Trade Enforcement Act of 2008 - Amends the Trade Act of 1974 to revise certain trade provisions to require the United States Trade Representative (USTR) to: (1) review U.S. trade expansion priorities; and (2) report to Congress on priority foreign country practices which if eliminated will have the most potential to increase U.S. exports. Requires the USTR to seek consultation and satisfactory resolution of any identified priority foreign country trade practice (including an agreement for elimination or provision of compensatory trade benefits) with the country of concern. Establishes the Office of the Congressional Trade Enforcer. Requires the USTR to: (1) identify priority foreign countries that maintain technical barriers to trade, or sanitary or phytosanitary measures, that deny market access to U.S. products; and (2) initiate an investigation of such trade barriers to determine what trade action, if any, must be taken to remedy such barriers. Amends the Tariff Act of 1930 to apply countervailing duty provisions to nonmarket economy countries. Expresses the sense of Congress that: (1) the United States should restore the balance between rights and obligations struck during the Uruguay Round of Multilateral Trade Negotiations; (2) the United States should have the ability to enforce rigorously its trade laws (including antidumping, countervailing duty, and safeguard laws) in World Trade Organization (WTO) negotiations and dispute settlement proceedings; and (2) dispute settlement panels are obligated to follow WTO negotiated agreements and not Appellate Body jurisprudence. Revises requirements for presidential action on a finding by the International Trade Commission (ITC) regarding an imported Chinese product that threatens or causes market disruption to a like U.S. product. Directs the Secretary of the Treasury to establish: (1) a government-wide, uniform data system to identify all goods imported into the United States; and (2) a voluntary government-private Import Safety Program to ensure that all goods in the international supply chain do not pose risks to public health or safety, and to facilitate the movement of such goods through the chain. Requires the Secretary to establish: (1) a list of importers of record and foreign manufacturers, processing facilities, exporters, and suppliers whose imported products have been determined to be inadmissible into the United States or have been the subject of U.S. recalls because of violations of health or safety standards; and (2) sanctions for entities on the list. Establishes the position of Director of Intellectual Property Rights Enforcement to develop an annual strategic plan for the enforcement of intellectual property rights. Sets forth: (1) enforcement activities to combat the counterfeiting and piracy of products; and (2) civil fines for the import of pirated or counterfeit products.

Transportation and Housing Choices for Gas Price Relief Act of 2008 - Directs the Secretary of Transportation to: (1) carry out a competitive grant program that supports community efforts to invest in transportation alternatives and travel demand management strategies; and (2) award grants to eligible entities, giving priority to activity proposals for reducing single occupancy vehicle trips. Provides certain formula grant funding for specified improvement activities to increase use of public transportation. Requires the Secretary to award grants for a national consumer awareness program on the environmental, energy, and economic benefits of transportation alternatives to the single occupancy vehicle, including carpooling, vanpooling, transit, and bicycles. Amends the Internal Revenue Code to: (1) allow a telework tax credit of up to $400 per year; (2) include a qualified bicycle commuting reimbursement as a qualified transportation fringe benefit, excludable from gross income; (3) equalize and increase to $200, with a modified cost-of-living adjustment, the tax exclusion for both transportation and parking fringe benefits; (4) make self-employed individuals eligible for transit pass fringe benefits; (5) include employer-established parking cash-out programs as qualified transportation fringe benefits; and (6) allow a vanpool (general business) tax credit. Requires the Secretary of Housing and Urban Development (HUD) to: (1) incorporate transportation costs associated with location of housing into affordability standards for allocating low-income housing tax credits related to rental assistance vouchers or other affordable housing programs; and (2) develop a model transportation cost field for Multiple Listing Services to measure transportation costs associated with the location of a home. Amends the Federal National Mortgage Association (Fannie Mae) Charter Act and the Federal Home Loan Mortgage Corporation (Freddie Mac) Act to include the use of location-efficient mortgages among their purposes. Amends the Housing and Community Development Act of 1992 to require the Director of the Federal Housing Finance Agency to establish graduated annual goals for the purchase by Fannie Mae and Freddie Mac of location-efficient mortgages for single-family, owner-occupied homes. Requires the Secretary of HUD to make grants to states to construct or acquire affordable housing that is location-efficient. Amends the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) to include high schools in the safe routes to school program.

Prevent Unfair Manipulation of Prices Act of 2008 - Amends the Commodity Exchange Act (CEA) to extend the regulatory authority of the Commodity Futures Trading Commission (CFTC) to certain transactions in derivatives involving specified energy commodities ("included energy transactions"), including those on foreign boards of trade. Defines "included energy transaction" as a contract, agreement, or transaction in an energy commodity for future delivery that: (1) provides for a delivery point in the United States; or (2) is transacted on a computer terminal located in the United States. Prohibits the CFTC from exempting from regulation any "included energy transaction" unless certain notice to Congress and public comment requirements are met. Declares null and void any CFTC "no-action letter" exemptions from CEA requirements for "included energy transactions." Requires the CFTC to establish uniform limits on the aggregate number of positions with respect to "included energy transactions" which may be held by any person for the prompt month, for each month, and for all months in all markets subject to CFTC jurisdiction. Excludes swaps involving "included energy transactions" from any CEA exemption for bona fide hedging transactions. Defines "bilateral included energy transaction" as an included energy transaction executed or traded other than on or through a trading facility. Exempts such transactions from the requirement that transactions be made on or through a designated contract market. Applies to "bilateral included energy transactions" certain reporting and recordkeeping requirements. Instructs the CFTC to publish monthly on its website: (1) the aggregate number and value of long and short positions held by a person in any portfolio constructed to match or track the components of an index of all commodities; and (2) the portion of the positions that are net long positions in "included energy transactions." Amends the Natural Gas Act and the Federal Power Act to set forth enforcement powers of the Federal Energy Regulatory Commission (FERC), including cease-and-desist proceedings, temporary orders, and general implementation authority.

Climate Market, Auction, Trust & Trade Emissions Reduction System Act of 2008, or the Climate MATTERS Act of 2008 - Declares the purpose of this Act to establish a federal program to reduce US greenhouse gas (GHG) emissions substantially enough by 2050 to avert the catastrophic impacts of global climate change. Directs the Secretary of the Treasury to establish an international reserve GHG emission allowance program, whose allowance sales proceeds shall be used to mitigate the negative impacts of global climate change on disadvantaged communities in World Trade Organization (WTO) participant countries. Establishes the International Climate Change Commission to determine annually whether a WTO participant country has taken certain action to limit its GHG emissions. Amends the Internal Revenue Code to: (1) establish a system for issuing, auctioning, recording, and tracking GHG emission allowances; and (2) impose an excess emissions penalty on owners or operators of covered facilities that fail to submit one or more emission allowances to the Secretary for any year. Establishes a Carbon Market Efficiency Board to: (1) analyze information on the GHG emission allowance market; and (2) authorize the Secretary to carry out cost relief measures if the market poses a substantial harm to the U.S. economy. Provides for the distribution of emission allowances to owners and operators of fossil fuel-fired electric power generating facilities and of energy intensive manufacturing facilities. Establishes: (1) the Deficit Reduction Trust Fund; and (2) the Citizen Protection Trust Fund (CPTF). Directs the Secretary to administer a Climate Change Rebate Program. Provides for a healthy families fund. Sets forth allocations of specified CPTF account funds for: (1) investment in natural resource adaptation to impacts of climate change and ocean acidification; (2) owners and operators of covered facilities who take actions that result in verified GHG emission reductions; (3) states that comply with certain federal building energy standards; (4) states with GHG emission reduction programs exceeding federal GHG emission reduction targets; (5) reductions in GHG emissions from the agriculture and forestry sectors, including those from deforestation activities in foreign countries; and (6) states and load-serving entities that implement energy-efficiency programs. Requires distribution of certain funds for grants for fixed guideway transit and other specified alternative transportation projects. Requires the Administrator of the Environmental Protection Agency (EPA) to: (1) develop a federal greenhouse gas registry; (2) make certain GHG emission determinations for covered facilities; and (3) promulgate regulations that require that U.S. GHG emissions in uncovered sectors do not grow.

Medicare DMEPOS Competitive Acquisition Reform Act of 2008 - Amends title XVIII (Medicare) of the Social Security Act to delay generally until after 2011 full implementation of the Medicare competitive acquisition program for the purchase of durable medical equipment (DME), prosthetics, orthotics, and supplies (DMEPOS). Revises such program, dividing its implementation into two rounds, and specifying covered item updates for 2009-2014. Prescribes requirements for application of accreditation in implementing quality standards. Requires suppliers to disclose subcontractors. Directs the Secretary of Health and Human Services to provide for a competitive acquisition ombudsman within the Centers for Medicare & Medicaid Services to respond to complaints and inquiries by suppliers and individuals. Specifies topics for the Comptroller General's required study and report to Congress on the impact of competitive acquisition of DME on suppliers, manufacturers, and patients. Sets forth a special rule for the competitive acquisition program for diabetic testing strips.

Praises the efforts by those countries in Central and Eastern Europe that have enacted legislation for the restitution of, or compensation for, private and communal religious property confiscated during the Nazi and Communist eras. Urges the countries in Central and Eastern Europe that have not already done so to return confiscated properties to their rightful owners or, where restitution is not possible, pay equitable compensation. Calls on the governments of Poland and of Lithuania to enact legislation so that persons (or their heirs) whose property was confiscated during the Nazi or Communist eras are able to obtain restitution of, or compensation for, such property. Calls on the Secretary of State to report to Congress every six months, regarding implementation of this resolution.

Commercial Advertisement Loudness Mitigation Act - Directs the Federal Communications Commission (FCC) to prescribe a regulation prohibiting advertisements accompanying video programming from: (1) being excessively noisy or strident; (2) having modulation levels substantially higher than the accompanying program; and (3) having an average maximum loudness substantially higher than that of the accompanying program.

Small Business Health Options Program Act of 2008 or the SHOP Act - Amends the Public Health Service Act to require the Secretary of Health and Human Services to designate an office within the Department of Health and Human Services (HHS) to administer a health insurance program for small businesses and self-employed individuals to purchase health insurance coverage meeting certain requirements. Establishes a Small Business Health Board to monitor the implementation of the program and make recommendations for improvements. Requires the Administrator of the program to: (1) enter into contracts with health insurance issuers to provide health insurance coverage under this Act; and (2) enter into agreements with entities to serve as navigators to provide information about the program and assist in enrollment. Requires a participating employer to ensure that each eligible employee has an opportunity to enroll in a plan. Sets forth requirements for health plans offered under this Act. Requires the Administrator to contract with the National Association of Insurance Commissioners to study the rating requirements, administrative procedures, and standards of external and internal review that apply to such plans and to health insurance purchased in the small group markets in the states and to develop recommendations concerning rating requirements. Sets forth premium-setting rules for plans under this Act. Allows a state to prohibit participation in this program if the state offers alternative health benefit plans. Amends the Internal Revenue Code to allow a tax credit for small employers for qualified employee health insurance expenses under this Act.

Declares that preventing Iran from acquiring a nuclear weapons capability through economic, political, and diplomatic means is vital to U.S. national security. Urges the President to use his authority to impose sanctions on: (1) Iranian banks engaged in proliferation activities or the support of terrorist groups; (2) international banks which conduct financial transactions with proscribed Iranian banks; (3) energy companies with large investments in the Iranian petroleum or natural gas sector; and (4) all companies which do business with Iran's Islamic Revolutionary Guard Corps. Demands that the President initiate an international effort to increase economic, political, and diplomatic pressure on Iran to suspend its nuclear enrichment activities. Urges the President to lead a regional diplomatic effort to support the legitimate governments in the region against Iranian destabilization efforts.

National Silver Alert Act - Directs the Attorney General to: (1) establish a national Silver Alert communications network to assist regional and local search efforts for missing seniors; (2) assign a Department of Justice officer to serve as the Silver Alert Coordinator to coordinate the network with states; and (3) award grants to states for support of Silver Alert plans and the network. Defines "missing senior" as any individual who is reported as missing to or by a law enforcement agency and who meets state requirements for designation as a missing senior. Directs the Coordinator to: (1) establish minimum standards for the issuance of, and the extent of the dissemination of, alerts issued through the network; and (2) make available to states, local governments, law enforcement agencies, and other concerned entities network training and information.

Belarus Democracy Reauthorization Act of 2008 - Amends the Belarus Democracy Act of 2004 to authorize assistance to promote democracy and civil society in Belarus. Includes Internet broadcasting within the scope of increased support and funding for U.S. government and surrogate broadcasting to Belarus. Specifies that funding may be used for broadcasting by Radio Free Europe/Radio Liberty, the Voice of America, and European Radio for Belarus and Belsat. Includes cessation of repression against student activists and ethnic minorities among the criteria that the government of Belarus must meet in order to end U.S. sanctions under such Act.

Clean Boating Act of 2008 - Amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act) to provide that no permit shall be required by the Administrator of the Environmental Protection Agency (EPA) under the national pollutant discharge elimination system for the discharge from a recreational vessel of graywater, bilge water, cooling water, weather deck runoff, oil water separator effluent, or effluent from properly functioning marine engines or for any other discharge that is incidental to the normal operation of such vessel. Defines a "recreational vessel" as any vessel that is leased, rented, or chartered to a person for that person's pleasure or that is manufactured or used primarily for pleasure, excluding vessels that are subject to Coast Guard inspection and that are engaged in commercial use or that carry paying passengers. Requires the Administrator to: (1) develop management practices for recreational vessels to mitigate the adverse impacts on U.S. waters of discharges incidental to normal vessel operation (excluding sewage) in any case in which the Administrator determines that the use of those practices is reasonable and practicable; and (2) promulgate federal standards of performance (which may distinguish among vessel types) for each discharge for which such a management practice is developed. Requires the Secretary of the department in which the Coast Guard is operating to promulgate regulations governing the design, construction, installation, and use of management practices for recreational vessels as necessary to meet such standards. Prohibits the owner or operator of a recreational vessel from operating in U.S. waters if such owner or operator is not using applicable management practices in compliance with such regulations.

Police and Fire Station Modernization Act of 2008 - Amends the Internal Revenue Code to allow a tax credit for investment in bonds to finance capital expenditures for state and local police or fire departments. Terminates such credit after 2014.

Condemns recent decisions by the government of the Russian Federation to establish official ties with the regions of Abkhazia and South Ossetia, a process that impedes reconciliation between those regions and the government of the Republic of Georgia and that violates Georgia's sovereignty and Russia's commitments to international peacekeeping. Encourages Russia to work with Georgia, the peoples of Abkhazia and South Ossetia, and the international community to find a peaceful solution to the conflict. Calls on U.N. Secretary-General Ban Ki-moon to investigate the April 2008 downing of an unarmed Georgian reconnaissance aircraft. Supports the declaration of the North Atlantic Treaty Organization's (NATO) Bucharest Summit stating that Georgia will become a NATO member.

Taxpayer Responsibility, Accountability and Consistency Act of 2008 - Amends the Internal Revenue Code to: (1) require reporting to the Internal Revenue Service (IRS) of payments of $600 or more made to corporations; (2) set forth criteria and rules relating to the treatment of workers as employees or independent contractors; and (3) increase penalties for failure to file correct tax return information or comply with other information reporting requirements. Requires the Secretary of the Treasury to issue an annual report on worker misclassification.

Post-9/11 Veterans Educational Assistance Act of 2008 - Amends federal veterans' benefits provisions to entitle to educational assistance under the Montgomery GI Bill individuals in certain length-of-service categories who, commencing on or after September 11, 2001, serve on active duty in the Armed Forces. Establishes the duration of such assistance (in most cases 36 months) and assistance amounts. Requires programs of education pursued with such assistance to be approved by the Secretary of Veterans Affairs. Allows for the pursuit of an approved program of education while on active duty. Allows, under such assistance, for the pursuit of: (1) programs on less than a half-time basis; (2) apprenticeship or other on-job training; (3) correspondence courses; (4) flight training; (5) tutorial assistance; and (6) licensure and certification tests. Makes individuals entitled to assistance under this Act also eligible for supplemental educational assistance for additional active duty service. Requires the Secretary to carry out a program, to be known as the "Yellow Ribbon G.I. Education Enhancement Program," under which colleges and universities may enter into an agreement with the Secretary to cover, for certain individuals, a portion of established charges not otherwise covered and match contributions toward such costs. Requires educational assistance under this Act to be used within 15 years of the individual's discharge or release from active duty (with exceptions). Allows individuals currently under the Montgomery GI Bill educational assistance program to elect to participate in the post-9/11 educational assistance program with respect to any unused entitlement.

United States Army Commemorative Coin Act of 2008 - Instructs the Secretary of the Treasury to mint and issue $5 gold coins, $1 silver coins, and half dollar clad coins as numismatic items emblematic of the traditions, history, and heritage of the U.S. Army, and its role in American society from the Colonial period to today. Requires the design for such coins to contain motifs that honor specifically the American soldier of both today and yesterday, in wartime and in peace, consistent with the traditions and heritage of the U.S. Army, the mission and goals of the National Museum of the U.S. Army, and the missions and goals of the Army Historical Foundation. Restricts coin issuance to the one-year period beginning on January 1, 2011. Requires all surcharges from coin sales to be promptly paid by the Secretary to the Foundation to help finance the National Museum of the U.S. Army.

Smuggled Tobacco Prevention Act of 2008 - Amends the Internal Revenue Code to require manufacturers and importers of tobacco products to legibly print a unique serial number on all packages of tobacco products manufactured or imported for sale or distribution. Imposes marking requirements for exports of tobacco products. Authorizes the Secretary of the Treasury to require additional secure methods of identification or marking of tobacco products. Requires the Secretary to prescribe a system of tobacco tax stamps, meter impressions, or other tax-payment indicia for tobacco products. Requires tobacco products sold on Indian reservations to be visibly and prominently labeled as such. Prohibits the export of tobacco products without the posting of a bond with the Secretary. Extends permit, recordkeeping, and reporting requirements to wholesalers of tobacco products. Establishes new criminal offenses relating to the distribution of tobacco products. Increases the civil penalty for tobacco-related infractions from $1,000 to $10,000. Amends the federal criminal code to: (1) extend criminal penalties for contraband cigarettes to tobacco products (i.e., cigars, cigarettes, smokeless tobacco, pipe tobacco, and roll-your-own tobacco) and define "contraband tobacco product" for purposes of such penalties; (2) establish new unlawful acts relating to tobacco products and machines used to manufacture or package tobacco products; and (3) establish whistleblower protections for employees who provide information about violations relating to contraband tobacco.

Protecting the Medicaid Safety Net Act of 2008 - Amends the U.S. Troop Readiness, Veterans' Care, Katrina Recovery, and Iraq Accountability Appropriations Appropriations Act, 2007 to extend until April 1, 2009, the moratorium on implementation of a proposed rule ("Medicaid Program; Cost Limit for Providers Operated by Units of Government and Provisions To Ensure the Integrity of Federal-State Financial Partnership") relating to the federal-state financial partnerships under titles XIX (Medicaid) and XXI (State Children's Health Insurance Program) (SCHIP) of the Social Security Act. Extends until April 1, 2009, the moratorium on any action by the Secretary of Health and Human Services to restrict Medicaid payments for graduate medical education (GME). Amends the Medicare, Medicaid, and SCHIP Extension Act of 2007 to extend until April 1, 2009, the moratorium on certain restrictions relating to Medicaid coverage or payment for rehabilitation services or school-based administration and school-based transportation, including specified proposed regulations, if such restrictions are more restrictive in any aspect than those applied to such areas as of July 1, 2007. Establishes additional moratoria until April 1, 2009, on specified regulatory actions concerning Medicaid: (1) treatment of optional case management services; (2) outpatient hospital services; and (3) allowable provider taxes.

National Guard Empowerment and State-National Defense Integration Act of 2008 - Adds the Chief of the National Guard Bureau (Chief) to the Joint Chiefs of Staff. Requires the Chief to: (1) identify gaps between federal and state military capabilities to prepare for and respond to emergencies; and (2) make recommendations to the Secretary of Defense for military assistance to civil authorities to address such gaps. Requires annual defense budget documents to specify separate amounts for training and equipment for the National Guard for military assistance to civil authorities and other domestic operations. Redesignates the: (1) Director and Deputy Director of the Army National Guard as the Vice Chief and Deputy Vice Chief of the Army National Guard; and (2) Director and Deputy Director of the Air National Guard as the Vice Chief and Deputy Vice Chief of the Air National Guard. Treats Vice Chief service as an adjutant general as joint duty experience for assignment or promotion purposes. States that the United States Northern Command and the United States Pacific Command shall be the combatant commands principally responsible for the military support of civil authorities in the United States. Requires the Commander of each Command and the Chief to enter into a memorandum of understanding setting forth the operational relationships, and individual roles and responsibilities, during responses to domestic emergencies among such Commands and the National Guard Bureau. Directs the Secretary to assure that tactical control of the Armed Forces on duty within a state or possession is vested in the governor thereof when such forces are engaged in emergency response activities. Requires the officer serving as: (1) Commander of Army North Command to be an officer in the Army National Guard; and (2) Commander of Air Force North Command to be an officer in the Air National Guard. Expresses the sense of Congress that, in assigning officers to such positions, the President should afford a preference to officers who have served as a state adjutant general. Requires at least one of each of three specified commander and deputy commander joint task force positions to be an officer in the Army or Air National Guard.

Assuring and Improving Cancer Treatment Education and Cancer Symptom Management Act of 2008 - Amends title XVIII (Medicare) of the Social Security Act, as amended by the Medicare, Medicaid, and SCHIP Extension Act of 2007, to provide for Medicare coverage of comprehensive cancer patient treatment education services. Amends the Public Health Service Act to direct the Director of the National Institutes of Health (NIH) to expand, intensify, and coordinate programs for the conduct and support of research with respect to: (1) improving the treatment and management of symptoms and side effects associated with cancer and cancer treatment; and (2) evaluating the role of nursing interventions in the amelioration of such symptoms and side effects. Requires the NIH Director to make nursing intervention research grants for studying cancer symptom management care and services delivered by registered nurses. Directs the Secretary of Health and Human Services to enter into an arrangement under which the Institute of Medicine of the National Academy of Sciences shall evaluate and report to the Secretary and Congress on the current state of symptom management, patient treatment education, and supportive care given to people with cancer.

Officer Daniel Faulkner Children of Fallen Heroes Scholarship Act of 2008 - Amends the Higher Educaton Act of 1965 to eliminate the expected family contribution used in determining Pell Grant eligibility in the case of a student applicant whose parent or guardian died as a result of performing service as a police officer, firefighter, or other first responder.
