Brownfields Reauthorization Act of 2010 - Amends the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 to: (1) include nonprofit organizations within the meaning of "eligible entity" for purposes of brownfields revitalization funding; (2) increase the limit on the maximum amount of a grant for brownfields remediation for each site; (3) authorize the President to transfer any duties under the brownfield remediation grant program to the Administrator of the Environmental Protection Agency (EPA); (4) revise eligibility requirements for brownfields revitalization funding; (5) require the Administrator to establish a program to provide multi-purpose grants to inventory, characterize, assess, conduct planning related to, or remediate brownfield sites in an area; (6) require the Administrator to establish a program to make competitive grants to be used at brownfield sites for projects that reduce environmental impact, increase community livability, and encourage sustainability; (7) authorize the Administrator to assign EPA employees to entities servings small, disadvantaged, or rural communities to build local capacity for the remediation and revitalization of brownfield sites in such communities; (8) increase and extend funding for brownfields revitalization; (9) require at least 7.5% of such funding to be used to carry out projects that reduce environmental impact, increase community livability, and encourage sustainability; and (10) increase and extend funding for state response programs established under such Act.

Demands that Hamas: (1) immediately and unconditionally release Israeli soldier Gilad Shalit; (2) allow access to the Israeli captives by competent medical personnel and representatives of the International Committee of the Red Cross; and (3) provide Gilad Shalit the humane treatment all captives are entitled to as a fundamental human right, including communication with his family. Expresses: (1) commitment to the survival of Israel as a Jewish and democratic state within recognized and secure borders; (2) support in resolving the Israeli-Palestinian conflict through the creation of a democratic, viable, and independent Palestinian state living in peace alongside Israel; (3) sympathy for Gilad Shalit's family; and (4) commitment to seek the release of Gilad Shalit and other missing Israeli soldiers. Recalls Israeli soldiers Ehud Goldwasser, Eldad Regev, Zecharya Baumel, Zvi Feldman, Yehuda Katz, Ron Arad, Guy Hever, and Majdy Halabi. Condemns: (1) Hamas for the cross border attack and kidnapping of Gilad Shalit; and (2) Iran and Syria for their support for international terrorism.

Educational Success for Children and Youth Without Homes Act of 2010 - Amends the McKinney-Vento Homeless Assistance Act's program of grants to states and, through them, subgrants to local educational agencies (LEAs) for the education of homeless youths to: (1) raise the minimum allotment for each state; (2) elaborate on the functions of each state's Office of the Coordinator for Education of Homeless Children and Youths; (3) elaborate on required state procedures for resolving disputes regarding the educational placement of homeless youth; (4) ensure that homeless youth do not lose credits earned in other schools and are not segregated into separate schools or programs within schools; (5) require states, LEAs, and schools to promote success for homeless youth by holding them to the same achievement standards as other students and removing barriers to their full participation in all classes and school activities; (6) list student-centered factors to be considered before an LEA places a homeless youth in a school; (7) require such schools to immediately enroll homeless youth despite unpaid fees or missed application or enrollment deadlines; (8) protect the privacy of information about a homeless youth's living situation; (9) require LEAs to coordinate services provided to homeless and disabled youth; (10) add to the duties of, and funding available to, LEA liaisons for homeless youth; (11) provide for the enrollment of homeless children in preschool programs; (12) require the Secretary of Education to establish or designate a Federal Office of the Coordinator for Education of Homeless Children and Youths; (13) authorize the Secretary to award grants or enter into contracts for evaluation, dissemination, and technical assistance activities for educational programs for homeless youth; and (14) triple authorized FY2010 appropriations from those authorized for FY2009. Establishes a separately funded Emergency Disaster Grant program which distributes funds to LEAs directly or through states to increase LEAs' capacity to respond to major disasters.

Get the Lead Out Act - Amends the Safe Drinking Water Act to exempt from prohibitions on the use or sale of lead pipes, solder, and flux: (1) pipes or pipe or plumbing fittings or fixtures, including backflow preventers, that are used exclusively for nonpotable services such as manufacturing, industrial processing, irrigation, outdoor watering or any other uses where the water is not anticipated to be used for human consumption; or (2) toilets, bidets, urinals, fill valves, flushometer valves, tub fillers, shower valves, service saddles, or water distribution main gate valves that are two inches in diameter or larger. Redefines "lead free" under such Act to mean: (1) not containing more than 0.2% lead when used with respect to solder and flux (current law); and (2) not more than a weighted average of 0.25% when used with respect to the wetted surfaces of pipes and pipe and plumbing fittings and fixtures. Establishes a formula to calculate the weighted average lead content of a pipe or pipe or plumbing fitting or fixture.

Seniors Purchasing Power Protection Act - Directs the Bureau of Labor Statistics of the Department of Labor to prepare and publish a monthly Consumer Price Index for Elderly Consumers (CPI) that indicates changes over time in expenditures for consumption which are typical for individuals aged 62 years of age or older. Amends title II (Old Age, Survivors and Disability Insurance) (OASDI) to use such new CPI in the computation of cost-of-living increases for Social Security benefits.

Big Oil Bailout Prevention Act of 2010 - Amends the Oil Pollution Act of 1990 to: (1) increase the liability of the party responsible for an offshore facility, except a deepwater port, from which oil is discharged into or upon navigable waters or adjoining shorelines to the total of all discharge removal costs plus $10 billion (currently, $75 million) for each incident; and (2) direct the President to promulgate regulations to allow advance payments from the Oil Spill Liability Trust Fund to states and localities to prepare for and mitigate substantial threats from the discharge of oil. Amends the Internal Revenue Code to eliminate: (1) the $1 billion per incident limitation on expenditures from the Oil Spill Liability Trust Fund for cleanup of oil spills: and (2) restrictions on the borrowing authority of such Trust Fund. Makes this Act effective on April 15, 2010.

Eunice Kennedy Shriver Act - Reauthorizes the Special Olympics Sport and Empowerment Act of 2004 for FY2011-FY2015. Directs the Secretary of State to act through the Assistant Secretary of State for Educational and Cultural Affairs in awarding grants or entering agreements with Special Olympics for activities outside the United States. Includes community-based prevention among the activities for which the Secretary of Health and Human Services (HHS) may award grants or enter into agreements with Special Olympics. Requires grant or agreement applications to include a description of specific measurable annual benchmarks, as well as long-term goals and objectives, to be achieved through specified activities, which must include: (1) activities to increase the full participation of people with intellectual disabilities in inclusive school and community activities with nondisabled people; (2) education programs that dispel negative stereotypes about people with intellectual disabilities; and (3) activities to increase the participation of people with intellectual disabilities in Special Olympics outside of the United States. Requires annual reports by Special Olympics to describe demographic data about Special Olympics participants. Authorizes the Secretary of Education to award grants or enter into contracts or cooperative agreements to promote the expansion of Best Buddies, including activities to increase the participation of people with intellectual disabilities in social relationships and other aspects of community life, including education and employment, within the United States. Directs the Secretary of Education to award competitive grants to institutions of higher education to establish Eunice Kennedy Shriver Institutes for Sport and Social Impact. Requires recipients to use grant funds to advance the quality of life and inclusion of people with intellectual disabilities through research and evaluation, technical assistance, training, data collection, evaluation, collaboration, and dissemination of evidence-based best practices.

FEHBP Dependent Coverage Extension Act - Extends eligibility for coverage under the Federal Employees Health Benefits Program to a federal employee's, annuitant's, or former spouse's dependent child (currently, unmarried dependent child) who is under age 26 (currently, under age 22) or incapable of self-support because of mental or physical disability which existed before age 26 (currently, before age 22).

Smuggled Tobacco Prevention Act of 2010 or the STOP Act - Amends the Internal Revenue Code to restrict the sale, lease, importation, or delivery of tobacco production machines to persons lawfully engaged in: (1) the sale, lease, or delivery of such machines; (2) the manufacture or processing of tobacco products, including for personal use; or (3) the application of unique identification markings onto tobacco product packages. Defines "tobacco production machine" as a machine used to manufacture, process, or package tobacco products or to apply unique identification markings to packages of tobacco products. Requires any person leasing, importing, exporting, or delivering a tobacco production machine to keep records relating to any transfers or deliveries of such machines. Requires manufacturers and importers of tobacco products to affix a unique identification marking to each package of tobacco products prior to sale or distribution of such products. Directs the Secretary of the Treasury to design a system of unique identification markings that does not interfere with state and local tax stamps and markings. Requires wholesalers of tobacco products to obtain permits for selling or exporting tobacco products. Establishes new criminal offenses relating to the distribution of tobacco products. Increases the civil penalty for tobacco-related infractions from $1,000 to $10,000. Establishes in the Treasury the Anti-Contraband Tobacco Trafficking Fund to finance the enforcement provisions of this Act and other laws relating to contraband or illegal tobacco products using the increased civil and criminal fines provided by this Act. Amends the Tariff Act of 1930 to impose a civil penalty for the importation of tobacco products and cigarette papers and tubes by fraudulent means.

Employee Misclassification Prevention Act - Amends the Fair Labor Standards Act of 1938 (FLSA) to require every person to: (1) keep records of non-employees (contractors) who perform labor or services (except substitute work), including through an entity such as a trust, estate, partnership, association, company, or corporation, for remuneration; and (2) provide certain notice to each new employee and new non-employee, including classification as an employee or non-employee and information concerning their rights under the law. Makes it unlawful for any person to: (1) discharge or otherwise discriminate against an individual (including an employee) who has opposed any practice, or filed a complaint or instituted any proceeding related to this Act, including with respect to an individual's status as an employee or non-employee; and (2) fail to classify accurately an employee or non-employee. Doubles the amount of liquidated damages for maximum hours, minimum wage, and notice of classification violations by an employer. Subjects a person who: (1) violates such requirements (including recordkeeping requirements) to a civil penalty of up to $1,100; or (2) repeatedly or willfully violates such requirements to a civil penalty of up to $5,000 for each violation. Directs the Secretary of Labor to establish a webpage on the Department of Labor website that summarizes the rights of employees under this Act and other appropriate information. Amends the Social Security Act to require, as a condition for a federal grant for the administration of state unemployment compensation, for the state's unemployment compensation law to include a provision for: (1) auditing programs that identify employers that have not registered under the state law or that are paying unreported compensation where the effect is to exclude employees from unemployment compensation coverage; and (2) establishing administrative penalties for misclassifying employees or paying unreported unemployment compensation to employees. Requires any office, administration, or division of the Department of Labor to report any misclassification of an employee by a person subject to the FLSA that it discovers to the Department's Wage and Hour Division (WHD). Authorizes the WHD to report such information to the Internal Revenue Service (IRS).

Amends the federal criminal code to impose a fine and/or maximum prison term of five years for anyone who knowingly sells or offers to sell an animal crush video in interstate or foreign commerce for commercial gain. States that this prohibition shall not be construed to prohibit the selling or offering to sell videos that depict hunting. Defines "animal crush video" as any visual depiction of animals being intentionally crushed, burned, drowned, or impaled that: (1) depicts actual conduct in which a living animal is tortured, maimed, or mutilated that violates any criminal prohibition on intentional cruelty under federal law or the law of the state in which the depiction is sold; and (2) taken as a whole, does not have religious, political, scientific, educational, journalistic, historical, or artistic value.

Health Information Technology Extension for Behavioral Health Services Act of 2010 - Amends the Public Health Service Act to expand the definition of "health care provider" for purposes of health information technology provisions to include a behavioral or mental health professional, a substance abuse professional, a psychiatric hospital, a behavioral and mental health clinic, and a substance abuse treatment facility. Requires the Secretary of Health and Human Services (HHS), acting through the National Coordinator for Health Information Technology, to award grants to eligible entities to: (1) facilitate the purchase of health information technology; (2) enhance the use of such technology, including covering costs associated with upgrading such technology in order to meet the criteria required to become a certified electronic health record (EHR) technology; (3) train personnel in the use of such technology; (4) improve the secure electronic exchange of health information among behavioral and mental health professionals, substance abuse professionals, and other health care providers; (5) improve such technology for adaptation to community-based behavioral health settings; (6) assist with the implementation of telemedicine, including facilitation of distance clinical consultations in rural and underserved areas; and (7) collaborate and integrate with health information technology regional extension centers. Amends titles XVIII (Medicare) and XIX (Medicaid) of the Social Security Act to include qualified clinical psychologists, clinical social workers, psychiatric hospitals, mental health treatment facilities, and substance abuse treatment facilities within the health professionals, hospitals, and Medicaid providers eligible for incentive payments for the meaningful use of certified EHR technology.

Recognizes that mental well-being is as important as physical well-being for citizens, communities, businesses, and the economy. Applauds the coalescing of national and community organizations in working to promote public awareness of mental health and in providing critical information and support to the people and families affected by mental illness. Encourages all organizations and health practitioners to use Mental Health Month as an opportunity to promote mental well-being and awareness, ensure access to appropriate services, and support overall quality of life for those living with mental illness.

Home Health Care Planning Improvement Act of 2010 - Amends title XVIII (Medicare) of the Social Security Act to revise conditions of and limitations on payment for home health care services. Allows payment for home health services to Medicare beneficiaries by: (1) a nurse practitioner; (2) a clinical nurse specialist working in collaboration with a physician in accordance with state law; (3) a certified nurse-midwife; or (4) a physician assistant under a physician's supervision.

Federal Buildings Sustainable Design Standards Act of 2009 [ sic ] - Directs the head of a federal agency constructing a building at an estimated cost exceeding $1 million, more than 50% of which is comprised of federal funding, to ensure that the building's life-cycle cost is considered with respect to the building's design. Defines "life-cycle cost" to mean the sum of investment, capital, installation, energy, operating, maintenance, and replacement costs, as estimated for the lifetime of a building.

Housing Non-Discrimination Act of 2010 - Amends the Fair Housing Act to prohibit discrimination on the basis of sexual orientation or gender identity in housing sales and rentals, residential real estate-related transactions, and brokerage services. Amends the Civil Rights Act of 1968 to prohibit the intimidation, interference, or injury of individuals because of their sexual orientation or gender identity. Authorizes appropriations to the Department of Housing and Urban Development (HUD) for FY2011 for educating the public regarding the protections provided by the amendments made by this Act.

Amends the Internal Revenue Code to: (1) extend through 2012 the alternative motor vehicle tax credit for advanced lean-burn technology, hybrid, and new alternative fuel motor vehicles; (2) increase the amounts of such credit; (3) increase the threshold (the number of qualified vehicles manufactured by the manufacturer after December 31, 2005) for initiating the phaseout period for the eligibility of hybrid and advanced lean-burn technology vehicles for such credit; and (4) deny such credit to a taxpayer whose adjusted gross income exceeds $100,000 ($200,000 in the case of married couples filing jointly).

TRICARE Dependent Coverage Extension Act - Deems the following individuals as dependents, for purposes of dependent coverage under TRICARE (a Department of Defense [DOD] managed health care program): (1) a child who has not yet attained age 26 and is not eligible to enroll in any employer-sponsored plan; or (2) a person who is in the legal custody of the covered member, has not attained age 26, is not eligible to enroll in any employer-sponsored plan, resides with the member, is not otherwise a dependent under TRICARE, and is not the child of another covered beneficiary. Requires a premium payment for such coverage.

Amends the Low-Income Home Energy Assistance Act of 1981 to increase from $600 million to $750 million the annual authorization of appropriations for the home energy assistance needs of states arising from a natural disaster or other emergency.

Requires the total budget resources for expenditures from the Harbor Maintenance Trust Fund for harbor maintenance programs to equal the level of receipts plus interest credited to such Fund for that fiscal year. Limits the use of such resources to such programs only. Declares that it shall be out of order in the House of Representatives or the Senate to consider any bill, joint resolution, amendment, motion, or conference report that would cause total budget resources for the Fund in a fiscal year for harbor maintenance programs to be less than the level of receipts plus interest credited to the Fund for that fiscal year.

Women and Workforce Investment for Nontraditional Jobs or Women WIN Jobs - Requires the Secretary of Labor, in any fiscal year in which the total authorization of appropriations to carry out this Act exceeds $50 million, to allocate grants to states with approved state plans to provide funding to eligible entities (partnerships) to increase low-income women's participation in high-wage, high-demand occupations in which women make up less than 25% of the current workforce. Authorizes states to use grants for statewide activities, including to: (1) provide technical assistance to eligible entities and to state registered apprenticeship programs and sponsors and joint apprenticeship training councils in meeting their enrollment goal for low-income women in nontraditional occupations; (2) develop policies and protocols that set goals for hiring specific percentages of women into registered apprenticeships and permanent employment openings in publicly assisted projects; and (3) engage in outreach activities and provide training to overcome stereotypes about women in nontraditional occupations as well as gender inequity among employers. Authorizes the allocation of grant funds to eligible entities to support the recruitment, training, placement, and retention of low-income women in nontraditional occupations. Directs the Secretary to convene a national commission to examine and make recommendations for improving the status of women in high-demand, high-wage nontraditional occupations. Directs the Bureau of Labor Statistics (BLS) to collect data on the status of women's participation in underrepresented sectors of the economy, and examine the status of women in relation to that of men. Directs the Secretary to establish a national clearinghouse to collect and distribute best practices.

Local Jobs for America Act - Directs the Secretary of Labor, acting through the Employment and Training Administration (ETA) of the Department of Labor, to provide for the allotment of funds to states, local government units, and community-based organizations to save and create local jobs through the retention, restoration, or expansion of services needed by local communities. Makes appropriations for this program. Prohibits the hiring of an individual for a position funded under this Act if: (1) it results in the layoff or partial displacement of an existing employee of a unit or organization, or (2) such individual will perform the same or substantially similar work that was performed by the previous employee of the unit or organization. Makes appropriations to: (1) the Department of Education for an Education Jobs Fund, (2) the Department of Justice for community oriented policing services, (3) the Department of Homeland Security (DHS) for the Federal Emergency Management Agency (FEMA) for firefighter assistance grants, and (4) the Department of Labor for ETA for on-the-job training and employment services.

Aviation Jobs Outsourcing Prevention Act - Requires a domestic or a foreign air carrier to file with the Secretary of Transportation any agreement, a request to discuss cooperative arrangements, or a modification or cancellation of an agreement between the domestic or foreign air carrier and another air carrier, a foreign carrier, or another carrier. Requires the Secretary to disapprove or, after periodic review, end approval of, an agreement, a request to discuss cooperative arrangements, or a modification that provides for or permits the sharing or pooling of revenue or profits between participating carriers earned in covered operations, unless the Secretary finds that each participating air carrier's share of the pooled revenue or pooled profits (whichever is greater) contributed by covered operations in any consecutive 12-month period does not exceed 130% of the participating carrier's share of pooled available seat miles (ASMs) in covered operations during the period.

Great Lakes Ecosystem Protection Act of 2010 - Amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act) to expand the duties of the Great Lakes Program Office by requiring the Office to: (1) provide support for Great Lakes governance and management; and (2) coordinate with the Great Lakes Interagency Task Force. Establishes: (1) the Great Lakes Leadership Council to establish policy, goals, and priorities with respect to Great Lakes protection and restoration, determine a process for participating in international forums, and provide annual input regarding federal budget priorities and levels for Great Lakes protection and restoration; (2) the Great Lakes Management Committee within the Council to report to and provide direction for the Council, monitor and assist implementation activities relating to Great Lakes management, and engage in problem solving regarding Great Lakes management; and (3) the Great Lakes Interagency Task Force. Requires the Administrator of the Environmental Protection Agency (EPA) to report annually to Congress on budgets and restoration activities relating to EPA's organizational elements involved in Great Lakes activities and EPA's reasons for approving or disapproving the Council's recommendations. Authorizes appropriations for: (1) remediation of sediment contamination in areas of concern in the Great Lakes; and (2) the Great Lakes Program. Requires EPA, in coordination with federal partners, to implement a Great Lakes Restoration Initiative which will: (1) identify and support programs to target the most significant environmental problems in the Great Lakes ecosystem; (2) be based on the work of the Task Force and the Council's stakeholders and nongovernmental partners; and (3) represent the government's commitment to significantly advance Great Lakes protection and restoration. Prohibits funding made available to implement the Initiative from being used for water infrastructure activity that is implemented using funds made available under the clean water or drinking water state revolving fund program. Requires federal agencies to: (1) maintain the base level of funding for their Great Lakes activities; and (2) identify new activities to support the environmental goals of the Initiative.

Civil War Sesquicentennial Commission Act - Directs the Secretary of the Interior to establish a Civil War Sesquicentennial Commemoration Commission. Directs the National Endowment for the Humanities: (1) in collaboration with the National Endowment for the Arts, to award grants for activities that are determined to be appropriately related to the Civil War sesquicentennial; and (2) consider for such grants university, museum, or academic programs with national scope that sponsor multidisciplinary projects that represent the totality of the Civil War.

Farm to School Improvements Act of 2010 - Amends the Richard B. Russell National School Lunch Act to direct the Secretary of Agriculture to provide competitive matching grants to schools, nonprofit organizations, and other able entities for farm to school programs that improve the access of school lunch and breakfast program participants to local foods. Provides that each grant may include an implementation grant, training and technical assistance grant, and planning grant. Requires farm to school programs to be designed to: (1) improve the nutritional health and well being of children; (2) procure healthy local foods from small and medium-sized farms; (3) support experiential nutrition education by involving school children in farm and garden-based agricultural education activities; (4) commit public and private community stakeholders to the sustained success of such programs; and (5) increase farmers' income by facilitating their access to institutional markets. Directs the Secretary to provide grant recipients with technical assistance that includes sharing information, best practices, research, and data on existing farm to school programs.

Delaware River Basin Conservation Act of 2010 - Requires the Secretary of the Interior, through the Director of the United States Fish and Wildlife Service, to establish a Delaware River Basin Restoration Program, under which the Director shall: (1) work in consultation with existing management structures to identify, prioritize, and implement restoration and protection activities within the Delaware Basin (defined as including all of Delaware Bay and portions of Delaware, New Jersey, New York, and Pennsylvania located in the Delaware River watershed); (2) adopt a single plan that includes a shared set of priorities for implementation of the Program; (3) establish the Delaware River Basin Restoration Grant Program; and (4) provide technical assistance to other federal agencies, state and local governments, nonprofit and community organizations, universities, and others to carry out the Restoration Program. Requires the Grant Program to provide competitive matching grants to state and local governments, nonprofit organizations, community organizations, universities, and others to carry out Restoration Program purposes. Requires the Director to develop criteria to ensure that funded activities: (1) restore or protect fish and wildlife species and their habitats; (2) improve or protect water quality by reducing nonpoint and point source pollutants; (3) reduce or improve management of water volume and flooding; (4) address priority needs or actions identified in the single plan adopted; and/or (5) include activities with multiple benefits in the Basin, including habitat, water quality, and flood protection. Limits the federal share of the total cost of a funded project to 75%. Authorizes the Director to contract with the National Fish and Wildlife Foundation or another organization with the expertise to manage the Grant Program.

Reaffirms the nation's commitment to combating multiple sclerosis by promoting awareness about its causes and risks, promoting new education programs, supporting research, and expanding access to medical treatment. Recognizes people living with multiple sclerosis and salutes the health care professionals and medical researchers who assist those so afflicted and continue to work to find cures and improve treatments.
