Commute Less Act of 2013

Commute Less Act of 2013 - Requires metropolitan planning organization (MPO) transportation plans to include, among other things, employer and transportation management organization outreach activities and strategies to help create and expand employer-based commuter programs. Defines "employer-based commuter program" to mean a program implemented by employers to provide their employees with alternatives to driving to and from work in a vehicle occupied by a single individual. Requires each MPO to establish an employer advisory council consisting of representatives of employers in the transportation management area. Requires each council to develop and maintain a commuter trip reduction plan that identifies area goals for the reduction of vehicle miles traveled during peak commuting hours. Requires MPO transportation improvement programs (TIPs) to include, among other things, a list of projects identified in a commuter trip reduction plan that help achieve such reduction goals. Authorizes the Secretary of Transportation (DOT) to make a grant to a national nonprofit organization or other entity engaged in efforts relating to employer-based commuter programs to establish and operate an information clearinghouse for employer investment in transportation and employer-based commuter programs. Requires recipients of federal assistance for the construction of federal-aid highway projects costing $75 million or more, or that will reduce traffic flow for more than 120 days, to prepare congestion mitigation plans that include funding for projects to reduce vehicle miles traveled during peak commuting hours along impacted corridors. Requires the Secretary to: (1) develop and implement a plan to expand and promote employer-based commuter programs; and (2) report to Congress recommendations on how to better integrate such programs into disaster emergency planning, preparedness, and response activities.

Senator Paul Simon Water for the World Act of 2014

Senator Paul Simon Water for the World Act of 2013 - Expresses the sense of Congress that: (1) the initial U.S. Agency for International Development (USAID) Water and Development Strategy is a significant accomplishment and improves USAID's capacity to provide sustainable and effective water, sanitation, and hygiene assistance; and (2) the Secretary of State, through the Special Advisor for Water Resources, should develop a Global Water Resources Strategy relating to U.S. foreign policy water objectives. Amends the Foreign Assistance Act of 1961 to direct: (1) the Administrator to designate a Global Water Coordinator to coordinate and oversee water, sanitation, and hygiene assistance; and (2) the Secretary of State to designate a Special Advisor for Water Resources to coordinate and oversee policy relating to water, hygiene, and sanitation assistance. Sets forth principles to ensure that water, sanitation, and hygiene projects carried out under the Foreign Assistance Act of 1961 and the Senator Paul Simon Water for the Poor Act of 2005 achieve maximum impact. Amends the Senator Paul Simon Water for the Poor Act of 2005 to direct: (1) the President, through the Secretary, to develop a strategy every five years to further the U.S. foreign policy objective to provide affordable and equitable access to safe water and sanitation in developing countries; and (2) the Administrator, through the Global Water Coordinator, to develop a complementary strategy to further the U.S. foreign assistance objective to provide affordable and equitable drinking water, sanitation, and hygiene in developing countries.

Runaway and Homeless Youth Inclusion Act of 2013 - Amends the Runaway and Homeless Youth Act to revise requirements for services provided under grants from the Secretary of Health and Human Services (HHS) for centers for runaway and homeless youth and their families. Requires the plan proposed by grant applicants for a runaway and homeless youth center to: provide services to persons in a minority category related to sexual orientation or gender identity or expression, include demographics on the sexual orientation and gender identity or expression of the youth it serves within its statistical records, and serve youth in a manner that is culturally competent. Revises requirements for: transitional living programs for homeless youth to require such programs to serve them in a manner that is culturally competent, and sexual abuse prevention programs to require certification to HHS that these programs have systems in place to ensure services to all youth in such a manner. Requires the HHS report on periodic estimates of incidence and prevalence of youth homelessness to include data on the demographics of such individuals (except identity), including whether they are sexual and gender minority youth. Prohibits any person in the United States, on the basis of actual or perceived race, color, religion, national origin, sex, sexual orientation, gender identity or expression, or disability, from being excluded from participation in, denied the benefits of, or subjected to discrimination under: (1) any program or activity funded in whole or in part with funds made available under the Act; or (2) any program or activity funded in whole or in part with funds appropriated for grants, agreements, and other assistance administered with such funds. Grants the Attorney General and the Office of Justice Programs the same authority to enforce this Act as granted under the Omnibus Crime Control and Safe Streets Act of 1968.

United States Coast Guard Commemorative Coin Act - Directs the Secretary of the Treasury to mint and issue in commemoration of the United States Coast Guard: (1) $5 gold coins, (2) $1 silver coins, and (3) half-dollar clad coins. Requires the design of such coins to be emblematic of the traditions, history, and heritage of the Coast Guard, and its role in securing our nation since 1790. Prescribes design requirements. Restricts the issuance of such coins to the one-year period beginning on January 1, 2017. Prescribes the sale price of the coins and coin surcharges. Requires such surcharges to be paid by the Secretary to the National Coast Guard Museum Foundation to help finance the design and construction of the National Coast Guard Museum.

Financial Security Credit Act of 2013

Financial Security Credit Act of 2013 - Amends the Internal Revenue Code to allow an income-based tax credit equal to the lesser of $500 or 50% of the total amount deposited or contributed into designated savings products in a taxable year. Defines "designated savings products" as a qualified retirement plan, a qualified tuition plan, a Coverdell education savings account, a U.S. savings bond, a certificate of deposit with a duration of at least 8 months, a savings account, or other savings product considered appropriate by the Secretary of the Treasury. Directs the Internal Revenue Service (IRS) to notify individual taxpayers who may qualify for a savings product tax credit that they have the option of an electronic direct deposit of any portion of their tax refund into a designated savings product.

Captive Primate Safety Act - Amends the Lacey Act Amendments of 1981 to add nonhuman primates to the definition of "prohibited wildlife species" for purposes of the prohibition against the sale or purchase of such species in interstate or foreign commerce. Makes it unlawful for a person to import, export, transport, sell, receive, acquire, or purchase a live animal of any prohibited wildlife species in interstate or foreign commerce (i.e., for pet trade purposes). Modifies exceptions to such prohibition, including by making it inapplicable to a person who is: (1) a licensed and inspected person who does not allow direct contact between the public and prohibited wildlife species, and (2) transporting a single primate of the genus Cebus that was obtained from and trained by a charitable organization to assist a permanently disabled individual with a severe mobility impairment. Sets forth civil and criminal penalties for violations of the requirements of this Act.

Growing Responsible Energy Efficient Neighborhoods Jobs Act of 2013 or the GREEN Jobs Act of 2013 - Amends the Community Development Banking and Financial Institutions Act of 1994 to allow financial and technical assistance provided under such Act to be used by community development financial institutions to develop or support small businesses that provide green jobs to low-income individuals in low-income communities. Limits such assistance to $2 million in financial assistance and $100,000 in technical assistance. Defines "green jobs" as jobs that: (1) aim to protect or restore ecosystems and biodiversity; (2) reduce energy, materials, and water consumption through high efficiency strategies; (3) reduce greenhouse gas emissions and other pollutants; (4) minimize or altogether avoid generation of all forms of waste and pollution; or (5) increase the use of energy generation systems such as solar, fuel cells, natural gas, and micro turbines.

Restore Honor to Service Members Act

Restore Honor to Service Members Act - Requires appropriate military record correction boards or discharge review boards to review the discharge characterization of any former members of the Armed Forces requesting a review who were discharged because of their sexual orientation. Permits such boards to change a characterization to honorable if such characterization is any characterization except honorable. Directs the Secretary of Defense (DOD) to ensure that any such changes are carried out consistently and uniformly across the military departments using specified criteria, including that: (1) the original discharge was based on the policy of Don't Ask Don't Tell (as in effect before it was repealed pursuant to the Don't Ask, Don't Tell Repeal Act of 2010) or a similar earlier policy; and (2) the discharge characterization will be changed if, with respect to the original discharge, there were no aggravating circumstances, such as misconduct, that would have independently led to any discharge characterization except honorable. Prohibits "aggravating circumstances" from including: (1) an offense of sodomy committed by the member against a consenting person of the same sex; or (2) statements, consensual sexual conduct, or consensual acts relating to sexual orientation or identity, or the disclosure of such statements, conduct, or acts, that were prohibited at the time of discharge but that became permitted after such discharge. Directs the Secretary of each military department to ensure that oral historians of the department: (1) review discharges between World War II and September 2011 based on sexual orientation, and (2) receive oral testimony of individuals who personally experienced discrimination and discharge because of actual or perceived sexual orientation so that such testimony may serve as an official record of such discriminatory policies and their impact on American lives. Requires the reissuance of specified military personnel records and discharge forms in a manner that shall not reflect the sexual orientation of the member. Amends the Uniform Code of Military Justice to remove from the offense of sodomy specified activity referred to as unnatural carnal copulation with another person of the same or opposite sex.

CLEANER Act of 2013 or the Closing Loopholes and Ending Arbitrary and Needless Evasion of Regulations Act of 2013 - Amends the Solid Waste Disposal Act, with respect to the regulation of wastes associated with the exploration, development, or production of crude oil, natural gas, or geothermal energy, to require the Administrator of the Environmental Protection Agency (EPA), within one year, to: determine whether drilling fluids, produced waters, and other wastes associated with such activities meet the criteria promulgated for the identification or listing of hazardous waste; identify or list as hazardous waste any of such energy-associated wastes that the Administrator determines meet the identification or listing criteria; and promulgate regulations regarding standards applicable to generators, transporters, and owners and operators of facilities for the treatment, storage, or disposal of wastes described under this Act (except that the Administrator may modify the requirements for such regulations to consider such wastes' special characteristics so long as the requirements protect human health and the environment). Directs the Administrator to promulgate revisions of the criteria regarding sanitary landfills and practices of open dumping for facilities that receive the energy-associated wastes described under this Act not identified as hazardous waste. Requires such revisions to: be those necessary to protect human health and the environment, allowing consideration of the practicable capability of such facilities; and include, at minimum, groundwater monitoring as necessary to detect contamination, criteria for the acceptable location of new or existing facilities, and provision for corrective action and financial assurance.

Embassy Security and Enhancement Act of 2013 - Directs the Secretary of State to: (1) submit to Congress a list of diplomatic and consular posts designated as high risk, high threat posts; and (2) determine if a post should be so designated before its opening or reopening. Directs the Secretary, before opening or reopening a high risk, high threat post, to establish a working group responsible for the geographic area in which such post is to be opened or reopened. Expresses the sense of Congress that the Secretary should complete a strategic review of the Department of State's Bureau of Diplomatic Security to ensure that the Bureau is fulfilling Department needs. Authorizes FY2014 appropriations for the capital security cost sharing program. Expresses the sense of Congress that the program should prioritize the construction of new facilities and the maintenance of existing facilities at high risk, high threat posts. Authorizes the Secretary to transfer to, and merge with, any appropriation for embassy security, construction, and maintenance such amounts appropriated for any other purpose related to the administration of foreign affairs on or after October 1, 2013. Authorizes the Secretary to provide physical security enhancements at overseas educational facilities established for the children of U.S. government employees. Revises requirements for: (1) local guard contracts abroad, and (2) computation of the death gratuity payable to surviving dependents of Foreign Service employees who die from injuries sustained in the performance of duty abroad. Makes permanent the Secretary's authority to waive the annuity termination of a temporarily reemployed annuitant in a position for which there is exceptional difficulty in recruiting or retaining a qualified employee. Expresses the sense of Congress regarding: (1) application of the Overseas Security Policy Board's security standards to all facilities; and (2) assignment of key personnel at high risk, high threat posts. Requires security training for permanent or long-term personnel assigned to high risk, high threat posts. Urges that language training be provided for diplomatic security personnel assigned to permanent or long-term duty at high threat, high risk posts. Authorizes the Secretary to provide a group life insurance supplement for a Foreign Service employee who dies while on duty abroad as a result of a terrorist attack. Directs the Secretary to provide educational assistance to a widow, widower, familial designee, or child of any U.S. national Foreign Service employee who dies while on duty abroad as a result of a terrorist attack.

OPEN Act

Openness in Political Expenditures Now Act or OPEN Act - Amends the Federal Election Campaign Act of 1971 to require a corporation which submits regular, periodic reports to its shareholders and a labor organization which submits similar reports to its members to include in each such report specified information on disbursements it has made for certain political activity (including independent expenditures and electioneering communications) during the period covered by the report. Limits the amount of disbursements reported, however, to the amount that equals or exceeds the applicable threshold for the covered political activity. Defines "applicable threshold" for a disbursement as: (1) $250 for an independent expenditure, (2) $10,000 for an electioneering communication or another kind of communication meeting specified criteria, and (3) the amount of the applicable limitation on contributions in effect for payment of dues or other amounts to a trade association or to a tax-exempt non-profit civic league meeting certain criteria (501[c][4] organization). Requires a corporation or labor organization reporting such expenditures to: (1) file a statement about them with the Election Assistance Commission (EAC), and (2) post on its website (if any) a hyperlink from its homepage to this statement on the EAC website. Amends the Internal Revenue Code to subject a 501(c)(4) organization to the income tax on corporations if: (1) its expenditures for the taxable year for covered political activity exceed the lesser of 10% of its total expenditures or $10 million, and (2) its governing instrument does not effectively prohibit its expenditures for a covered political activity from exceeding these thresholds.

Foreign Aid Transparency and Accountability Act of 2013 - Directs the President to establish guidelines for the establishment of measurable goals, performance metrics, and monitoring and evaluation plans for U.S. foreign assistance. Requires such guidelines to provide direction to federal departments and agencies that administer U.S. foreign assistance relating to: (1) resource monitoring, (2) project and program evaluation, and (3) analysis of findings and generalizations and their applicability to proposed project and program design. Requires: (1) each appropriate federal department or agency to begin using such guidelines within one year after their establishment, and (2) the President to submit a related report to Congress within 18 months. Directs the President to require the Secretary of State to establish and maintain an Internet website to make publicly available comprehensive and accessible information on U.S. foreign assistance programs on a country-by-country and program-by program basis. Requires the head of a federal department or agency to brief Congress if specified information requirements are not met. Authorizes a department or agency to use up to 5% of its foreign development assistance funds for activities under this Act.

STEM Innovation Networks Act of 2013 - Directs the Secretary of Education to award matching grants to state-based science, technology, engineering, and mathematics (STEM) networks or similar organizations of STEM stakeholders to expand STEM education and STEM educator development. Includes among grant uses: testing, sharing, and scaling up STEM education research, promising practices, and exemplary programs; identifying state STEM education weaknesses and prioritizing strategies to address them; implementing rigorous career and college ready standards in STEM education; developing and implementing innovative STEM assessments that measure student progress toward those career and college ready standards; promoting and developing pre- and in-service STEM teacher training; developing STEM career pathways and workforce education and training programs that reflect 21st century workforce needs; facilitating the implementation of expanded STEM learning opportunities on school sites; and promoting, supporting, and designing programs that develop STEM content coaches and master educators in order to strengthen core competencies of the classroom practitioner. Requires grantees to conduct periodic independent evaluations of their effectiveness in accomplishing those activities. Prohibits the Secretary from: (1) endorsing or approving any STEM curriculum designed for use in an elementary school, secondary school, or institution of higher education; or (2) requiring a state, local educational agency, or school to adopt a specific STEM program or instructional materials.

Expresses the sense of Congress that the U.S. Agency for International Development (USAID) should: (1) prioritize where loan guarantees to African financial institutions would facilitate involvement in African power projects, and where partnerships and grants would increase access to electricity; and (2) consider providing grants to develop national, regional, and local energy and electricity policy plans, and expand electricity access to the poorest. Urges: (1) the Secretary of the Treasury to use U.S. influence at each institution in the World Bank Group and the African Development Bank to encourage power sector and electrification investments in sub-Saharan Africa, (2) the Overseas Private Investment Corporation (OPIC) to prioritize investment in the electricity sector of sub-Saharan Africa, and (3) the Trade and Development Agency to promote U.S. private sector participation in energy sector development projects in sub-Saharan Africa.

National Infrastructure Development Bank Act of 2013

National Infrastructure Development Bank Act of 2013 - Establishes the National Infrastructure Development Bank as a wholly owned government corporation. Makes the Bank's Board of Directors responsible for monitoring and overseeing energy, environmental, telecommunications, and transportation infrastructure projects. Authorizes the Board to: (1) make senior and subordinated direct loans and loan guarantees to assist in the financing or refinancing of an infrastructure project, (2) issue public benefit bonds and provide financing to infrastructure projects, and (3) pay an interest subsidy to the issuer of American Infrastructure Bonds. Requires the Board to establish an Executive Committee, headed by the chief executive officer, to establish requirements and make recommendations for project proposals to be considered for financial assistance. Requires the Bank to establish a Risk Management Committee, headed by the chief risk officer, which shall: (1) create financial, credit, and operational risk management guidelines for the Bank; (2) set guidelines to ensure diversification of lending activities by both geographic region and infrastructure project type; (3) create conforming standards for all financial assistance provided by the Bank; (4) monitor financial, credit, and operational exposure of the Bank; (5) provide financial recommendations to the Board; and (6) ensure that the aggregate amount of interest subsidies provided for American Infrastructure Bonds in a given calendar year do not exceed 28% of interest payable under all such Bonds. Requires the Bank to establish an audit committee, headed by a chief compliance officer, to be responsible for auditing and accounting activities. Requires the Board to approve criteria established by the Executive Committee, with public input, for determining project eligibility for financial assistance. Sets forth criteria to be considered by the Board for each type of infrastructure project. Requires the Executive Committee to conduct an analysis that considers the economic, environmental, and social benefits and costs of each project under consideration, prioritizing projects that contribute to economic growth, lead to job creation, and are of regional or national significance. Requires any financial assistance for an infrastructure project to be repayable from dedicated revenue sources that also secure the infrastructure project obligations. Limits the amount of assistance under this Act to 50% of reasonably anticipated project costs. Exempts all bonds issued by the Bank, and the interest on or credits with respect to such bonds, from state or local government taxation. Sets forth requirements regarding compliance of assisted projects with wage rate, domestic content, and buy American statutes. Requires the Board to establish an American Infrastructure Bond program. Establishes in the Treasury the National Infrastructure Development Bank Trust Fund into which an amount estimated to equal the tax receipts attributable to interest payable under such Bonds is to be appropriated.

Community Parks Revitalization Act - Requires the Secretary of Housing and Urban Development (HUD) to carry out a community revitalization program of federal grants to eligible local governments located within standard metropolitan statistical areas for various park and recreation purposes, including grants for rehabilitation and construction, innovation and recreation programming, and recovery action programs. Authorizes the Secretary to designate local governments not located in standard metropolitan statistical areas to receive such grants under a partial eligibility waiver. Prescribes requirements, including matching requirements, for rehabilitation and construction and for innovation and recreation grants. Limits to 10% the use of funds appropriated for rehabilitation and construction grants for acquisition of land or interests in land. Allows a recipient, at its discretion, to transfer a grant in whole or in part to private nonprofit agencies for recreational areas and facilities they own or operate which offer recreational opportunities to the general population. Requires an applicant, for project approval, to submit to the Secretary evidence of its commitment to ongoing planning, rehabilitation, service, operation, and maintenance programs for its park and recreation systems, expressed in a five-year local park and recreation recovery action program. Prescribes requirements for the five-year park and recreation recovery action program under an at-risk youth recreation grant. Authorizes the Secretary to increase federal rehabilitation and construction, innovation, and at-risk youth recreation grants to a state under this Act by an additional match of up to 15% (but not more than 15%) of total project or program cost. Limits the aggregate amount of the grant and the additional grant amounts to 85% percent of total project or program cost. Prohibits the conversion, without HUD approval, of any property improved or developed with assistance under this Act for uses other than for public recreation.

Counseling for Career Choice Act - Amends the Elementary and Secondary Education Act of 1965 to direct the Secretary of Education to award competitive establishment grants to states to develop and implement comprehensive school counseling programs that provide students with effective postsecondary education planning and career guidance services. Requires each program to be aligned with a statewide counseling framework that: (1) encompasses grades 6 through 12 and postsecondary education; and (2) is developed in consultation with, or exists with the support of, at least five stakeholders that include at least one business or industry and at least one local educational agency (LEA) or secondary school. Requires establishment grant funds to be used to: (1) train and hire school counselors; (2) identify regional workforce trends and postsecondary options available in the state; (3) establish, improve, or coordinate postsecondary opportunities; (4) recommend curricular improvements to better align curricula with workforce trends and available postsecondary opportunities; (5) establish partnerships with American Job Centers; and (6) leverage the resources and emerging technologies being developed by stakeholders to support the counseling framework. Allows states to carry out program activities directly or through competitive subgrants to LEAs, or consortia consisting of an LEA, and one or more LEAs, educational service agencies, tribal organizations, postsecondary institutions, or nonprofit organizations with expertise in counseling or career and technical education. Directs the Secretary to reserve at least 10%, but no more than 20%, of the amount appropriated for this Act's counseling program to award competitive capacity-building grants to states that do not receive an establishment grant.

PRIME Act of 2013

Preventing and Reducing Improper Medicare and Medicaid Expenditures Act of 2013 or PRIME Act of 2013 - Amends part D (Prescription Drug Benefits) of title XVIII (Medicare) of the Social Security Act (SSA) to direct the Secretary of Health and Human Services (HHS) to prohibit sponsors of prescription drug plans (PDPs) from paying claims for prescription drugs that do not include the valid National Provider Identifier for the drug's prescriber. Requires the Secretary's annual report to Congress on the use of recovery audit contractors under the Medicare Integrity Program to: (1) describe the types and financial cost of improper payment vulnerabilities identified by recovery audit contractors and how the Secretary is addressing them, and (2) assess the effectiveness of changes made to Medicare payment policies and procedures in order to address those vulnerabilities. Requires the Secretary to address improper payment vulnerabilities in a timely manner, prioritized based on the risk to the Medicare program. Authorizes the Secretary, under recovery audit contracts under both Medicare and Medicaid (SSA title XIX), to retain a certain portion of the recovered amounts for a program management account for activities addressing problems that contribute to improper payments and fraud. Requires the Secretary, under such contracts, to retain an additional 5% of the recovered amounts to be made available to the HHS Inspector General to investigate improper payments or audit internal controls associated with Medicare or Medicaid payments. Directs the Secretary to develop a plan to revise the incentive program under the Health Insurance Portability and Accountability Act of 1996 for the reporting of fraud and abuse to encourage greater participation by individuals reporting Medicare fraud and abuse. Requires the plan to include certain recommendations for: (1) ways to enhance rewards for individuals reporting, and (2) extention of the incentive program to the Medicaid program. Amends SSA title XIX to cover the costs of equipment, salaries and benefits, and travel and training in appropriations for the Medicaid Integrity Program. Allows the Secretary to increase Centers for Medicare and Medicaid Services (CMS) staff whose duties consist solely of protecting the integrity of the Medicare program by a number determined necessary to carry out the Program (currently, by 100). Directs the Secretary to provide incentives for Medicare administrative contractors to reduce the improper payment error rates in their jurisdictions. Requires imprisonment for up to 10 years or a fine of up to $500,000 ($1 million in the case of a corporation), or both, for knowingly, intentionally, and with the intent to defraud purchasing, selling, distributing, or arranging for the purchase, sale, or distribution of a Medicare, Medicaid, or CHIP beneficiary identification number or billing privileges under SSA titles XVIII, title XIX, or title XXI (Children's Health Insurance Program). Amends SSA title IV part D (Child Support and Establishment of Paternity) with respect to the Federal Parent Locator Service to give the CMS Administrator access to information in the National Directory of New Hires to determine the eligibility of an applicant for, or enrollee in, the Medicare program or an applicable state health subsidy program under the Patient Protection and Affordable Care Act (PPACA). Requires the Secretary to disclose to the HHS Inspector General information on individuals and their employers in the National Directory of New Hires if the HHS Inspector General gives the Secretary their names and Social Security account numbers. Restricts the use of such information to: (1) determining the eligibility of an applicant for, or enrollee in, the Medicare program or an applicable state health subsidy program; or (2) evaluating the integrity of such programs. Sets forth rules for the use and disclosure of such information by state agencies. Directs the Secretary to establish a plan to encourage and facilitate the participation of states in the Medicare-Medicaid Data Match Program (Medi-Medi Program). Revises Medi-Medi Data Match Program purposes. Amends SSA title XIX, as amended by PPACA, and XXI with respect to claims processing and detection of fraud within the Medicaid and CHIP programs.

Authorizes the Secretary to renew Promise Neighborhood Partnership grants and Promise School grants if the grantees demonstrate significant success in: (1) ensuring children's school readiness; (2) improving their academic outcomes; (3) increasing their college and career readiness; and (4) improving their health, mental health, and social and emotional well-being. Requires this Act's grantees to evaluate their programs continuously and improve them based on data and outcomes. Directs the Secretary to evaluate this Act's grant programs and disseminate research on best practices for improving the academic achievement of children living in our most distressed communities. Authorizes the Secretary to award matching planning grants to entities eligible for this Act's other grants.

FIT Kids Act

Fitness Integrated with Teaching Kids Act or FIT Kids Act - Requires the Secretary of Education to award grants to states to implement comprehensive programs to promote physical activity, education, and fitness and nutrition that are based on scientifically valid research, and an analysis of need that considers, at a minimum, physical education indicators. Limits a grant award to a maximum of five years. Prescribes certain activities under a grant, including that states must: (1) develop and implement a physical education indicators measurement system; (2) collect and publish information on physical activity, education, and fitness and nutrition at the school level; (3) use indicators to identify and address student needs; (4) encourage local education agencies to integrate physical activity, education, and fitness into a range of subjects throughout the school day and locations within schools; and (5) award sub-grants based on identified needs. Requires the Secretary, acting through the Director of the Institute of Education Sciences, to establish program performance metrics to measure the effectiveness of the grant program's activities. Amends the Elementary and Secondary Education Act of 1965 to require the compact with parents under the school-level parental involvement policy to include a description of the school's responsibility to support their children in leading a healthy and active life, such as by providing health meals and snacks, encouraging participation in physical education, and sharing in physical activity outside the school day to support successful academic achievement. Amends the Rehabilitation Act of 1973 to require the Secretary to promote equal opportunities for students with disabilities to be included and participate in physical education and extracurricular athletics implemented in, or in conjunction with, elementary schools, secondary schools, and institutions of higher education, by ensuring the provision of appropriate technical assistance and guidance for schools and institutions and their personnel.

Amends the DOD pilot program for assessing the feasibility and advisability of permitting enlisted personnel to obtain civilian credentialing or licensing for skills required for military occupational specialties to require the designation as military occupational specialties of the MOS 31B Military Police, MOS 15Q AC-Air Traffic Controller, and the MOS 12M Fire Protection, in addition to not fewer than three and not more than five additional military occupational specialties. Amends the Small Business Act to direct the head of each executive department to submit an annual report to the Administrator of the Small Business Administration (SBA) containing the percentage of the total value of all prime contracts awarded by the executive department during the preceding one-year period to small business concerns owned and controlled by service-disabled veterans.

Directs the Secretary of Education to waive the application of these requirements to IHEs for which the requirements are not practicable due to events that cause them severe economic distress, a dramatic reduction in state or federal aid, or any other circumstance the Secretary determines to be appropriate.
