Social Investment and Economic Development for the Americas Act of 2010 - Amends the Foreign Assistance Act of 1961 to direct the President, through the United States Agency for International Development (USAID) and working with governments and civil society in the Americas (the countries of North America, Central America, South America, and the Caribbean), to provide assistance to reduce poverty, expand the middle class, and foster increased economic opportunity. Directs the Secretary of State to establish an advisory group to consider the feasibility of establishing a public-private Fund for Social and Economic Development in the Americas. Authorizes appropriations for: (1) assistance to Central America, South America, the Caribbean, and Mexico; (2) debt and equity financing for a Microfinance Growth Fund for the Americas; (3) the Fund for Social and Economic Development in the Americas; and (4) USAID for labor and environmental capacity building activities relating to the implementation of trade promotion agreements.

Access to Nutritious Meals for Young Children Act of 2009 - Amends the the Richard B. Russell National School Lunch Act to increase reimbursement rates for free, reduced price, and paid meals and snacks served under the Child and Adult Care Food Program (CACFP) at nonresidential child care centers and family or group day care homes. Allows such providers to be reimbursed for the service of three meals and a snack. (Currently, reimbursement is provided for two meals and a snack.) Lowers the percentage of children or school children in an area that must be eligible for free or reduced price meals under the school lunch or breakfast programs to make family or group day care homes in the area eligible for higher CACFP reimbursement rates as tier I homes. Increases the maximum monthly administrative payment per home provided to sponsors of family or group day care homes. Directs the Secretary of Agriculture to improve the ability of the CACFP to reach low-income families by streamlining program and paperwork requirements.

Comprehensive Immigration Reform for America's Security and Prosperity Act of 2009, the Comprehensive Immigration Reform ASAP Act of 2009, or the CIR ASAP Act of 2009 - Directs the Secretary of Homeland Security (DHS) (Secretary) to: (1) develop and submit to Congress a National Strategy for Border Security; (2) increase the number of Customs and Border Protection officers, agriculture specialists, and border security support personnel, and enhance related equipment, assets, and technology; (3) develop a comprehensive land and maritime border surveillance plan, including aerial and integrated surveillance demonstration programs; (4) issue a rule for electronic device searches and related agent training; (5) improve coordination efforts to combat human smuggling; (6) establish a Border Communities Liaison Office in every Border Patrol sector at the southern and northern borders; (7) carry out a ports of entry technology demonstration program; and (8) establish a Southern Border Security Task Force. Authorizes appropriations for border security improvements at U.S. ports of entry. Authorizes border relief grants for tribal, state, or local law enforcement and related agencies in proximity to the border or in a designated High Intensity Drug Trafficking Area. Provides reimbursement for state and county prosecutors in border states for prosecuting federally initiated and referred drug cases. Suspends the Operation Streamline program pending an evaluation of its viability. Expands resources for Project Gunrunner and for Operation Armas Cruzadas along the U.S.-Mexico border. Establishes the United States-Mexico Border Enforcement Commission. Prohibits the U.S. Armed Forces, including the National Guard, from assisting in non-emergency federal, state, local, and civilian law enforcement of immigration laws. Directs the Secretaries of DHS, Interior, Agriculture, Defense, and Commerce to develop: (1) a land border protection strategy; and (2) a borderlands environmental monitoring plan. Provides for: (1) enhanced border cooperation with Mexico; and (2) expansion of Customs-Trade Partnership Against Terrorism programs. Sets forth detention conditions. Directs the Secretary to appoint an Immigration Detention Commission. Sets forth provisions regarding: (1) immigration enforcement protections; (2) unlawful detentions; (3) protections for vulnerable populations; (4) apprehension procedures for families and family detention; (5) welfare requirements for children separated from detained or removed parents; (6) unaccompanied alien children; and (7) female detainees. Provides a stay of removal and work authorization for detained alien workers who are witnesses or necessary for workplace prosecution claims. Eliminates, with specified exceptions, DHS authority to enter into agreements with state and local law enforcement agencies to perform immigration law enforcement functions. Establishes in DHS an Immigration and Customs Enforcement Ombudsman. Eliminates the one-year asylun filing requirement. Provides for federal court review of DHS orders of removal currently exempt from such review. Establishes an alien employment verification system which requires employers to comply with: (1) document verification requirements; and (2) a phased-in electronic employment verification system. Sets forth backlog reduction provisions respecting family-sponsored and employment-based immigrant levels. Revises the definition of "immediate relative" to: (1) include the spouse and child of a lawful permanent resident; and (2) permit a qualifying widow/widower and the child or parent of a U.S. citizen or lawful permanent resident to maintain such status while filing for permanent resident status. Increases: (1) per-country limits for family-sponsored and employment-based immigrants; and (2) specified family-unity exceptions to unlawful presence-based inadmissibility. Prohibits the removal from the United States of an individual who: (1) fled his or her homeland while under the age of 12 years old; and (2) was later admitted to the United States as a refugee, parolee, or asylee. Exempts the sons and daughters of certain naturalized Filipino World War II veterans from worldwide or numerical immigrant visa limits. Makes a minor child of an alien fiancee/fiance or of an alien spouse of a U.S. citizen eligible for derivative K-visa status under specified circumstances. Redefines "child" to include a stepchild under 21 years old. Amends the Haitian Refugee Immigration Fairness Act of 1998 to: (1) require determinations with respect to children to be made using the age and status of an individual on October 21, 1998; and (2) permit an application based upon child status to be filed by a parent or guardian if the child is present in the United States on such filing date. Permits new status adjustment applications to be filed for a limited time period. Reduces the required support level for immigrant sponsorship. Establishes the Prevent Unauthorized Migration Visa (PUM Visa) program which shall provide for: (1) 100,000 PUM conditional permanent resident visas annually, for three years, to persons from countries (transitional visa admission states) which represent at least 5% of the total unauthorized migration population to the United States for the past five years; and (2) a process to adjust to permanent resident status. Exempts specified categories of U.S.-educated aliens from employment-based immigration limits. Permits a nonimmigrant alien whose employer has petitioned for an employment-based green card for such alien to file an application for adjustment of status regardless of whether an immigrant visa is immediately available. (Requires visa availability before such application may be approved.) Return of Talent Act - Establishes the Return of Talent Program to permit an eligible alien (and certain family members) to return to the alien's country of citizenship for up to two years in order to contribute to such country's postconflict or natural disaster reconstruction activities. (During such absence the alien and family members shall be considered to be continuously present and residing in the United States for naturalization purposes.) Establishes a conditional nonimmigrant status for qualifying aliens and their dependents who are illegally present or out of status in the United States and who register and meet the requirements for such status. Authorizes: (1) adjustment from conditional to permanent resident status at the earlier of six years after enactment of this Act or 30 days after specified immigrant visas become available (with exceptions to such time frame for certain students, military personnel, and employed individuals); and (2) naturalization three years after permanent resident status adjustment. Agricultural Job Opportunities, Benefits, and Security Act of 2009 or the AgJOBS Act of 2009 - Confers "blue card status" upon an alien who: (1) during the 24-month period ending on December 31, 2008, has performed specified lengths of, or earned a specified amount from, agricultural employment in the United States; (2) applied for such status during the 18-month application period; (3) is otherwise admissible to the United States; and (4) has not been convicted of specified felonies or misdemeanors. Limits the number of blue cards that may be issued during the five-year period beginning on the date of the enactment of this Act. Provides for adjustment of blue card status to permanent resident status based upon completed periods of agricultural employment. Revises H-2A visa (agricultural labor or temporary or seasonal services) provisions. Replaces the existing labor certification requirement with a labor attestation requirement containing: (1) a description of the nature and location of the job; (2) the job's expected beginning and ending dates; (3) the number of jobs; and (4) specified labor assurances respecting job opportunities covered by collective bargaining agreements and non-covered job opportunities. Establishes: (1) the Commission on Immigration and Labor Markets; and (2) the Security and Prosperity Account in the Treasury. Requires each State Workforce Agency (SWA) to establish an Internet-based American Worker Recruit and Match program. Requires employers and foreign labor contractors to provide workers recruited abroad with specified employment-related information. Amends H-1B visa (specialty occupation) employer application requirements to: (1) revise wage determination requirements; (2) require Internet posting and description of employment positions; (3) lengthen U.S. worker displacement protection; (4) apply certain requirements to all H-1B employers rather than only to H-1B dependent employers; (5) prohibit employer advertising that makes a position available only to, or gives priority to, H-1B nonimmigrants; and (6) limit the number of H-1B and L-1 visa (intracompany transfer) employees that an employer of 50 or more workers in the United States may hire. Authorizes the Department of Labor (DOL) to: (1) investigate applications for fraud; and (2) conduct H-1B compliance audits. Prohibits an employer from hiring an L-1 nonimmigrant for more than one year who will: (1) serve in a capacity involving specialized knowledge; and (2) be stationed primarily at the worksite of another employer. Specifies L-1: (1) employer petition requirements for employment at a new office; (2) wage rates and working conditions; and (3) employer penalties. Authorizes: (1) DOL to enforce federal labor laws with respect to employers of H-2B nonagricultural temporary workers; and (2) a private right of action against such employers. Specifies employer actions to recruit U.S. workers prior to filing for H-2B admissions. Sets forth H-2B and U.S. worker protections. Amends EB-5 visa (alien investor) provisions to: (1) increase EB-5 eligibility; (2) make the regional center program permanent; (3) establish $2,500 regional center designation and premium processing fees; (4) permit concurrent filing for EB-5 petitions and status adjustment applications; (5) establish in the Treasury the Immigrant Entrepreneur Regional Center Account; and (6) increase employment creation-related visas. Revises provisions regarding: (1) immigration service fees; (2) the naturalization age-based English language proficiency exemption; and (3) citizenship application background checks. Establishes the New Americans Initiative grants program to to assist lawful permanent resident aliens to become citizens. Authorizes grants for: (1) public education and community training regarding the provisions of this Act; (2) community-based organizations to assist naturalization applicants (initial entry, adjustment, and citizenship assistance grants); and (3) states to form New American Councils. Provides for the naturalization of certain graduates of U.S. high schools who are under 25 years of age on the date of application for naturalization. Establishes: (1) a tax credit and a deduction for certification expenses for teachers of English language learners; and (2) a tax credit for employer-provided adult English literacy and basic education programs. Makes funds available for oath of allegiance ceremonies.

National Foundation on Physical Fitness and Sports Establishment Act - Establishes the National Foundation on Physical Fitness and Sports as a charitable, nonprofit corporation to promote participation by private organizations in the activities of the President's Council on Physical Fitness and Sports. Subjects any person who uses the Council's or Foundation's official seal or any trademark, trade name, sign, symbol, or insignia falsely representing association with, or authorization by, the Council or Foundation for the purpose of trade, to induce the sale of any goods or services, or to promote any theatrical exhibition, athletic performance, or competition without the Foundation's consent to a civil action for remedies provided in the Trademark Act of 1946. Allows the Foundation, in conjunction with the Council, to authorize contributors and suppliers of goods or services to use such trade name, trademark, seal, symbol, insignia, or emblem in advertising under specified conditions.

Small Business Job Creation and Access to Capital Act of 2009 - Amends the Small Business Act to increase maximum amounts of loans under the following Small Business Administration (SBA) loan programs: (1) the section 7(a) (general small business loans) guaranteed loan program; (2) the section 504 (state and local development company) program; and (3) the Microloan (small-scale loans to start-up, newly-established, and growing small businesses) program. Amends the American Recovery and Reinvestment Act of 2009 to extend through 2010 SBA authority to reduce or eliminate loan fees on section 7(a) and 504 loans. Amends the Small Business Investment Act of 1958 to apply single-business investment limits to SBA-recognized new markets venture capital companies. Directs the SBA Administrator to establish for prospective borrowers an alternative small business size standard that uses maximum tangible net worth and average net income as an alternative to the use of industry standards. Expresses the sense of Congress that the Administrator should establish a website that: (1) lists SBA lenders and provides loan rate information; and (2) allows prospective borrowers to compare rates on SBA-guaranteed loans. Amends provisions of the Small Business Investment Act of 1958 relating to the local development business loan program to allow a small business borrower under such program to refinance a previous business debt: (1) that was incurred no less than two years before application for the SBA loan; (2) that is a commercial loan; (3) that is not guaranteed by a federal agency; (4) the proceeds of which were used to acquire a fixed asset for the benefit of the small business; (5) that is collateralized by fixed assets; and (6) for which the borrower has been current on all payments for at least one year. Allows the Administrator to provide financing under such program for a borrower that meets certain job creation or retention goals. Provides an alternate job retention goal for which a borrower may qualify.

Enhancing Livability for All Americans Act of 2009 - Establishes within the Office of the Secretary of Transportation an Office of Livability. Requires the Office Director to establish a program to award competitive grants to eligible entities to assist: (1) capital investments in surface transportation projects with a significant impact on enhancing the livability in a region, metropolitan area, community, or neighborhood; and (2) communities in developing strategic growth plans that provide a vision and goals for development over a minimum 20-year period and integrate long-term innovative transportation and land use planning. Requires priority be given to: (1) investment projects that increase the number of transportation options, improve access to housing, jobs, and services, and reduce greenhouse gas; and (2) innovative planning applicants who have proposed strategic growth plans for communities with transportation systems characterized by poor access to job centers and schools, limited transportation options for residents, and significant traffic congestion. Requires the Director to: (1) develop statistical and analytical capabilities to ascertain specified transportation data; and (2) collaborate with other federal agencies to carry out activities that promote the development of livable communities, increase transportation choices, and improve the environment, public health, and quality of life.

Put America to Work Act of 2009 - Directs the Secretary of Labor to make grants to states, local government units, and Indian tribes to create employment opportunities for unemployed and underemployed residents of distressed communities. Specifies grant uses, including funding of fast-track jobs for: (1) painting and repair of schools, community centers, and libraries; (2) restoration of abandoned and vacant properties; (3) expansion of emergency food programs to reduce hunger; (4) augmentation of staffing in Head Start and other early childhood education programs; and (5) renovation and maintenance of parks, playgrounds, and other public spaces. Requires grant recipients to use remaining grant funds to make grants to public entities, nonprofit organizations, public-private partnerships, or small businesses to create employment opportunities in: (1) construction, rehabilitation, and improvements in energy efficiency of residences or public facilities; (2) the provision of human services; (3) remediation and demolition of vacant and abandoned properties; and (4) programs that provide opportunities for employment, education, and training for disadvantaged youth.

Preventing Harmful Restraint and Seclusion in Schools Act - Directs the Secretary of Education (Secretary) to establish minimum standards that: (1) prohibit elementary and secondary school personnel from managing any student by using any mechanical or chemical restraint, physical restraint or escort that restricts breathing, or aversive behavioral intervention that compromises student health and safety; (2) prohibit such personnel from using physical restraint or seclusion, unless such measures are required to eliminate an imminent danger of physical injury to the student or others and certain precautions are taken; (3) require states and local educational agencies (LEAs) to ensure that a sufficient number of school personnel receive state-approved training and certification in first aid and certain safe and effective student management techniques; (4) prohibit physical restraint or seclusion from being written into a student's education plan, individual safety plan, behavioral plan, or individual education program as a planned intervention; and (5) require schools to establish procedures to notify parents in a timely manner if physical restraint or seclusion is imposed on their child. Authorizes the Secretary to award grants to states and, through them, competitive subgrants to LEAs to: (1) establish, implement, and enforce policies and procedures to meet such standards; (2) improve their capacity to collect and analyze data related to physical restraint and seclusion; and (3) implement school-wide positive behavior supports. Directs the Secretary to conduct a national assessment of this Act's effectiveness. Gives Protection and Advocacy Systems the authority provided under the Developmental Disabilities Assistance and Bill of Rights Act of 2000 to investigate, monitor, and enforce this Act's protections for students. Directs the Secretary of Health and Human Services to establish standards for Head Start agencies that are consistent with the minimum standards for the management of elementary and secondary school students. Authorizes the Secretary to allocate funds to the Secretary of Health and Human Services to assist Head Start agencies in establishing, implementing, and enforcing policies and procedures to meet such standards.

Borrowers' Right to Inspect Closing Documents Act of 2009 - Amends the Real Estate Settlement Procedures Act of 1974 (RESPA) to revise procedures governing the furnishing of closing documents to borrowers. Requires the lender to furnish to the settlement agent, at least four business days before the scheduled date of a real estate settlement, the completed promissory note, the mortgage instrument, and all other items needed to complete the uniform settlement statement, the final Truth-in-Lending Act disclosure, and the final closing instructions. Requires the settlement agent to furnish the borrower, at least three business days before the scheduled settlement date, with the completed documents and the completed uniform settlement statement, as long as the lender has timely provided the agent with those items. Shields the settlement agent from liability for the lender's noncompliance with this Act. Cites circumstances under which the settlement agent may correct the uniform settlement statement and related documents prior to the scheduled settlement date. Authorizes the Secretary of Housing and Urban Development to exempt settlements from the requirements of this Act in certain circumstances.

Regrets the killing of unarmed civilians and expresses deepest condolences to the families of the 57 victims who were slain in Maguindanao in the worst politically motivated violence in recent Philippine history. Calls for: (1) an independent investigation and prosecution of those responsible; (2) an end to extrajudicial killings and election-related violence; and (3) freedom of press and safety for the investigating reporters. Urges the Department of State, the Department of Justice (DOJ), and other U.S. government agencies to review their assistance programs to the government of the Philippines and to offer any technical assistance that Philippine authorities may request. Reaffirms the U.S. commitment to work with Philippine authorities to combat corruption, terrorism, and security threats.

Community College Emergency Stabilization Fund Act - Directs the Secretary of Education to provide temporary emergency funding to states for use in awarding competitive grants to community colleges to assist them in maintaining, or hiring additional, staff. Allots such funding to states pursuant to a formula that takes into account each state's share of increased unemployment over the past 12 months and the extent to which its unemployment rate exceeds the national average. Directs the Secretary to award competitive grants to career and technical colleges to assist them in maintaining, or hiring additional, staff. Requires the states and the Secretary, when determining the amount of a grant to be awarded to a community college or career and technical college pursuant to this Act, to consider: (1) its student enrollment; (2) the increase in its enrollment over the preceding academic year; and (3) the most recent monthly unemployment rate in its locality. Requires the Comptroller General to conduct an evaluation this Act's grant programs and report its results to Congress.

Green Infrastructure for Clean Water Act of 2009 - Requires the Administrator of the Environmental Protection Agency (EPA) to make competitive grants to eligible higher education institutions and research institutions to establish and maintain between three and five centers of excellence for green infrastructure. Defines "green infrastructure" as a stormwater management technique that preserves, restores, enhances, or mimics natural hydrology. Establishes the duties of each center, including: (1) researching green infrastructure; (2) developing manuals and setting industry standards on best management practices relating to state, local, and commercial green infrastructure; (3) providing information about its research and manuals to the national electronic clearinghouse center; (4) providing technical assistance and training on green infrastructure; and (5) evaluating regulatory and policy issues about green infrastructure. Requires one of the centers to be designated as the national electronic clearinghouse center, which shall, in addition to its other duties, operate a website and a public database on green infrastructure. Requires the Administrator to make competitive grants to eligible entities that manage stormwater, water resources, or waste water resources to: (1) plan and design and install green infrastructure projects; (2) develop standards and revisions to local zoning, building, or other local codes necessary to accommodate such projects; (3) develop fee structures to provide financial support for green infrastructure; (4) develop training and educational materials about green infrastructure; (5) develop and implement a green infrastructure portfolio standard program; (6) monitor and evaluate the environmental, economic, or social benefits of green infrastructure; and (7) implement a best practices standard for a green infrastructure program. Requires the Administrator to give priority to applications from: (1) a community that has combined storm and sanitary sewers in its collection system or is low-income or disadvantaged; or (2) an eligible entity that will use 10% of the grant for a low-income or disadvantaged community. Requires the Administrator to: (1) establish within EPA's Office of Water a green infrastructure program to coordinate and promote the use of green infrastructure and to integrate green infrastructure into the permitting programs; (2) direct each EPA regional office to develop a program to promote and integrate the use of green infrastructure within the region; (3) create a green infrastructure compliance assistance center; and (4) establish measurable goals, to be known as the green infrastructure portfolio standard, to increase the percentage of annual water managed by eligible entities that uses green infrastructure.

Expresses the sense of the Senate that: (1) the United States remains deeply concerned about the plight of specified vulnerable religious and ethnic minorities of Iraq; (2) the U.S. government and the United Nations Assistance Mission for Iraq (UNAMI) should urge the government of Iraq to enhance security at places of worship in Iraq, particularly where religious minorities are known to be at risk; Urges the U.S. government to continue to work with the government of Iraq to: (1) train and deploy into the Iraqi police and security forces members of vulnerable minority communities in Iraq; and (2) ensure that members of such communities suffer no discrimination in recruitment, employment, or advancement in such forces, and be assigned to their locations of origin, rather than transferred to other areas. Urges the government of Iraq, with U.S. government assistance, to: (1) ensure that the upcoming national elections in Iraq are safe, fair, and free of intimidation and violence so that all Iraqis, including religious minorities, can participate in them; and (2) permit and facilitate election monitoring by experts from local and international nongovernmental organizations, the international community, and the United Nations, particularly in minority areas. Encourages the government of Iraq and the Kurdistan regional government to work towards a peaceful and timely resolution of disputes over territories. Encourages the U.S. government and UNAMI to urge the government of Iraq to work with minority communities and their representatives to develop measures to implement article 125 of the Iraq Constitution. Urges the government of Iraq to take affirmative measures to reverse the legal, political, and economic marginalization of religious minorities in Iraq. Urges the U.S. government to: (1) direct assistance to projects that develop the ability of ethnic and religious minorities in Iraq to organize themselves civically and politically to effectively convey their concerns to government; and (2) continue to fund capacity-building programs for the Iraqi Ministry of Human Rights (IMHR), the independent national Human Rights Commission, and a new independent minorities committee whose membership is selected by minority communities of Iraq. Urges the government of Iraq to: (1) direct the IMHR to investigate and report on abuses against and the marginalization of minority communities in Iraq, making recommendations to address such abuses; and (2) help ensure that displaced Iraqis considering return to Iraq have the proper information needed to make informed decisions regarding such return. Urges the U.S. government and international organizations to continue to work with the government of Iraq to develop the legal framework necessary to address property disputes resulting when displaced Iraqis attempt to return to their homes in Iraq.

Expresses commitment to the objectives of the Cairo Consensus as set forth at the International Conference on Population and Development. Encourages nongovernmental organizations, faith based organizations, community organizations, and private citizens to act to improve gender equality, end violence against women, expand access to reproductive, maternal, and other health services, lower childhood and maternal mortality rates, and eradicate world poverty.

Graduation Promise Act of 2009 - Authorizes the Secretary of Education to make grants to states and, through them, subgrants to local educational agencies (LEAs) for differentiated high school improvement systems targeting support to schools with low student achievement and graduation rates after such schools fail for two consecutive years to make adequate yearly progress (AYP) pursuant to state academic performance standards. Allots grant funds to states pursuant to a formula that favors states with low graduation rates and a high percentage of students attending low-income LEAs. Requires state grantees to establish comprehensive school performance indicators and minimum annual improvement benchmarks for use, in addition to current AYP measures, in analyzing school performance and determining the improvement category into which a school is placed. Directs LEA subgrantees to: (1) categorize each of their schools that fail to make AYP for two consecutive years as needing targeted intervention, whole school reforms, or replacement; (2) convene a local school improvement team for each of such schools that will use performance indicators, AYP measures, and other relevant data to conduct a school needs assessment and develop a multiyear school improvement plan tailored to the school's need categorization; and (3) support the successful implementation of such plans and district-wide high school improvement strategies. Authorizes the Secretary to award competitive grants to LEAs, nonprofit organizations, and institutions of higher education to develop and implement, or replicate, effective secondary school models for struggling students and dropouts.

Helping Unemployed Workers Act - Amends the Supplemental Appropriations Act, 2008 with respect to the state-established individual emergency unemployment compensation account (EUCA). Extends the Emergency Unemployment Compensation (EUC) program through March 31, 2011. Amends the Assistance for Unemployed Workers and Struggling Families Act to extend through April 1, 2011: (1) federal-state agreements increasing regular unemployment compensation payments to individuals; and (2) requirements that federal payments to states cover 100% of EUC. Requires the Secretary of Labor to establish a program under which the Secretary shall make payments to any state unemployment trust fund (including the District of Columbia, the Commonwealth of Puerto Rico, and the Virgin Islands) to be used for the payment of unemployment compensation if the Secretary approves an application to receive 100% reimbursement for up to 26 weeks for a short-time compensation program. Bars payments to a state for benefits paid to an individual who is employed by an employer: (1) whose workforce during the three months preceding the date of the submission of the employer's short-time compensation plan has been reduced by temporary layoffs of more than 20%; (2) on a seasonal, temporary, or intermittent basis; or (3) engaged in a labor dispute.

FVPSA Reauthorization Act of 2009 - Revises requirements for and reauthorizes the Family Violence Prevention and Services Act at increased levels for FY2010-FY2014. Directs the Secretary of Health and Human Services (HHS) to establish grant programs for: (1) specialized services for abused parents and their children; (2) domestic violence prevention enhancement and leadership through alliances; and (3) enhancement of culturally competent services for adult and youth victims of domestic violence from racial and ethnic minority groups.

Open Access to Courts Act of 2009 - Prohibits a U.S. district court from dismissing a complaint: (1) unless it appears beyond doubt that the plaintiff can prove no set of facts in support of the claim which would entitle the plaintiff to relief; or (2) on the basis of a determination by the judge that the factual contents of the complaint do not show the plaintiff's claim to be plausible or are insufficient to warrant a reasonable interference that the defendant is liable for the misconduct alleged.

Alzheimer's Treatment and Caregiver Support Act - Amends the Public Health Service Act to authorize the Secretary of Health and Human Services (HHS) to make grants to public and nonprofit private health care providers to expand treatment services for patients with Alzheimer's disease and training and support services for families and caregivers of such patients.

Increasing Housing Opportunities for Veterans Act of 2009 - Directs the Secretary of Housing and Urban Development (HUD) to provide assistance to for-profit developers to expand the supply of supportive housing for veteran families, such assistance coming in the form of zero interest loans and project rental assistance. Requires: (1) not less than 75% of the units in such housing to be made available for occupancy only by veteran families; (2) rent contribution limits for low-income veterans; and (3) owners of assisted housing to ensure that veterans and their families are provided a range of supportive services tailored to their needs. Provides housing development cost limitations. Directs the HUD Secretary to provide information concerning the availability of such housing to the Secretaries of Veterans Affairs and Labor. Requires the repayment of housing assistance and the prevention of undue benefits with respect to housing that fails or ceases to be used for veterans' purposes. Provides funding for such assistance from the Troubled Asset Relief Program (TARP) under the Emergency Economic Stabilization Act of 2008. Amends the Cranston-Gonzalez National Affordable Housing Act to include veterans service agencies as entities authorized to submit state and local housing strategies for housing assistance provided under such Act. Requires a study by the Comptroller General on the availability of credit for veterans of Operations Iraqi Freedom and Enduring Freedom. Directs the HUD Secretary to carry out a program to provide mortgage assistance through the provision of grants and loans for direct mortgage payments on behalf of eligible households (households containing a member of the Armed Forces serving on active duty for more than 30 days). Outlines assistance requirements and limitations. Requires assistance repayment when the annual income of the household exceeds 200% of the poverty level applicable to that family size. Provides TARP funding for such assistance.

Safe Routes to High Schools Act - Amends the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) to include high school students as beneficiaries of the safe routes to school program. (Currently, the program provides funding to states for projects that encourage, and enhance the ability of, primary and secondary school students to walk or bike to school safely.) Requires states to give priority to projects for primary and middle schools and to projects that propose to serve a combination of at least one primary, middle, and high school within the same school district.

Credit Card Fee Limitation and Accountability Act - Amends the Truth in Lending Act, as amended by the Credit CARD Act of 2009, to prohibit a creditor from imposing upon an open-end consumer credit account any fee related to failure of the consumer to: (1) use the credit card to obtain an extension of credit; (2) carry an outstanding balance from any billing cycle to another; and (3) obtain a minimum amount of credit under such account during any specified period. Permits a consumer to: (1) cancel an account within 45 days of receiving notice of an annual fee if no such fee existed upon the account's initial opening; and (2) pay any outstanding account balance at the time of cancellation in accordance with the terms in effect at the time of such cancellation. Prohibits a creditor, as a result of such cancellation, from taking action against a consumer which would adversely affect the consumer's ability to obtain credit under open-end consumer credit plan. Requires any annual fee that a card issuer may impose with respect to a credit card account under an open-end consumer credit plan to be reasonable. Directs the Board of Governors of the Federal Reserve System to issue final rules, within six months after the enactment of this Act, to establish standards for assessing whether the amount of any annual fee is reasonable. Amends the Fair Credit Reporting Act to prohibit a consumer credit reporting entity from taking action or making any determination based upon consumer cancellation of a credit card account which would result in a consumer credit score lower than that which would result without taking such cancellation into account.

Locomotive Fleet Investment Act of 2009 - Amends the Internal Revenue Code to allow a business-related tax credit for 30% of the cost of qualified locomotive property. Defines "qualified locomotive property" as a newly built or remanufactured diesel line-haul, passenger, or switch locomotive (whether or not owned by a railroad) which is acquired after December 31, 2009, and which meets applicable standards under the Clean Air Act for emissions from locomotives, as in effect on December 31, 2009. Terminates such credit after December 31, 2013.

Post 9/11 Troops to Teachers Enhancement Act - Amends the Troops-to-Teachers program of the Elementary and Secondary Education Act of 1965 (which provides veterans with teacher certification stipends in exchange for three years of service in a high-need local educational agency [LEA] or public charter school). Expands program eligibility to cover certain individuals: (1) who, on or after September 11, 2001, serve at least 90 continuous days on active duty in the Armed Forces before being honorably released from such service; or (2) who, on or after January 8, 2002, are separated or released from active duty after at least four (currently, six) years of continuous active duty immediately preceding such separation or release, and agree to serve in the Armed Forces Reserves for at least three years. Makes any LEA that is receiving school improvement funds eligible to host Troops-to-Teachers program participants. Directs the Secretary of Education to establish an Advisory Board, composed of federal, state, and veteran service organization representatives, to collect, study, and disseminate feedback from the program and report to Congress on how the program is operating and might be improved. Reserves specified funding to carry out the Troops-to-Teachers program through FY2014.

First-Time Homebuyer Tax Credit Guarantee Act of 2009 - Amends the Internal Revenue Code to extend the first-time homebuyer tax credit for a 90-day period after its termination date (i.e., November 30, 2009) for taxpayers who entered into a written binding contract for the purchase of a principal residence which was in effect on November 30, 2009.

Bone Health Promotion and Research Act of 2009 - Amends the Public Health Service Act to: (1) authorize the Secretary of Health and Human Services (HHS) to develop and implement a National Bone Health Program for the control, prevention, and surveillance of osteoporosis and related bone diseases and to coordinate and carry out national education and outreach activities in support of such program; (2) authorize the Secretary to award grants to states and Indian tribes for comprehensive osteoporosis and related bone disease control and prevention programs; and (3) award grants or enter into cooperative agreements for the collection, analysis, and reporting of data on osteoporosis and related bone diseases. including osteogenesis imperfecta and Paget's disease of bone. Requires the Secretary to establish the Osteoporosis and Related Bone Disease Advisory Committee to advise the Secretary and the Assistant Secretary for Health on conducting activities related to the National Bone Health Program. Directs the Director of the National Institutes of Health (NIH) to: (1) expand and intensify NIH research programs for osteoporosis and related bone diseases, including osteogenesis imperfecta, Paget's disease of bone, and rare bone diseases; and (2) award planning grants or contracts for the establishment or enhancement of research programs for osteoporosis and related bone diseases.

Strengthening and Updating Resources and Equipment Act or the SURE Act - Amends the Homeland Security Act of 2002 to permit grants awarded under the State Homeland Security Grant Program or the Urban Area Security Initiative to be used for maintenance agreements, user fees, or sustainment costs for purchased equipment related to preventing, preparing for, protecting against, and responding to acts of terrorism. Prohibits the Administrator of the Federal Emergency Management Agency (FEMA) from imposing: (1) a limit on the amount of any such award that may be used to pay for equipment purchase and maintenance costs; and (2) any additional limitation, including any fiscal year limitation, on the amount of any such award that may be used for a specific type, purpose, or category of equipment purchase or maintenance cost.

Fire Grants Reauthorization Act of 2009 - Amends the Federal Fire Prevention and Control Act of 1974 to reauthorize through FY2014 the Federal Emergency Management Agency's (FEMA's) Assistance to Firefighters Grants (AFG) program and the Staffing for Adequate Fire and Emergency Response (SAFER) program. Modifies the scope of the AFG program, including by permitting the use of grant funds for volunteer, non-fire service emergency medical services organizations and for certifying fire and building inspectors employed by a fire department or serving as a volunteer building inspector with a fire department. Increases: (1) funding for fire prevention and firefighter safety programs; and (2) maximum AFG grant amounts. Lowers matching and maintenance of expenditure requirements and authorizes the Administrator of FEMA to waive or reduce such requirements for applicants facing demonstrated economic hardship. Revises grant allocation requirements to require 25% of grant amounts for a fiscal year to be allocated to each of: (1) career fire departments; (2) volunteer fire departments; (3) combination fire departments. Requires the remaining 25% to be awarded on a competitive basis among such fire departments. Revises grant limits based on jurisdiction populations. Sets forth new limits on awards to state fire training academies. Limits grant amounts used to obtain training to training that complies with applicable national voluntary consensus standards. Amends SAFER program provisions to: (1) limit the period of program grants to three years; (2) require grantees to commit to retaining firefighters hired for the entire grant period, with an economic hardship exception; and (3) limit to 80% the portion of the cost of hiring firefighters for each fiscal year that may be provided under a grant.
