Invest in American Jobs Act of 2013

Invest in American Jobs Act of 2013 - Revises Buy American requirements with respect to federal-aid highways, capital investment grants to support intercity passenger rail service (rail grants), and Amtrak, particularly the handling of waiver requests. Revises similar Buy American requirements with respect to public transportation, particularly rolling stock. Requires the cost of rolling stock components and subcomponents produced in the United States to increase from 60% in FY2013 by 10% annual increments up to 100% for FY2017 and ensuing fiscal years. Revises waiver requirements as well to mirror those for federal-aid highways. Applies the rail grant Buy American requirements under this Act to recipients of rail loans and loan guarantees with respect to railroad rehabilitation and improvement. Prescribes Buy American requirements for procurement of a facility or equipment under federal aviation programs similar to those for rolling stock. Requires the Secretary of Transportation (DOT) to report annually to Congress on: (1) each project for which a waiver of Buy American requirements was issued; and (2) the country of origin and product specifications for steel, iron, or manufactured goods acquired pursuant to each waiver. Amends the Federal Water Pollution Control Act to prescribe Buy American requirements for steel, iron, and manufactured goods used in the construction of a publicly owned wastewater treatment works. Adds similar Buy American requirements to the Public Works and Economic Development Act of 1965, with respect to economic development programs, and to the Robert T. Stafford Disaster Relief and Emergency Assistance Act, with respect to the Federal Emergency Management Agency (FEMA) Hazard Mitigation Grant Program. Amends the Truman-Hobbs Act to prescribe Buy American requirements for steel, iron, and manufactured goods used in the alteration of a bridge over U.S. navigable waters. Declares that only a vessel owned by a U.S. citizen for which a certificate of documentation with a registry endorsement is issued may engage in support of exploration, development, or production of resources in, on, above, or below the exclusive economic zone (EEZ), or any other activity in the EEZ, to the extent that the regulation of such activity is not prohibited under customary international law. Exempts from this requirement any activities requiring either a coastwise endorsement or a fishery endorsement. Subjects to U.S. shipping law any vessels operating in the EEZ, to the extent that the regulation of such operation is not prohibited under customary international law. Directs the Secretary of the department in which the Coast Guard is operating to establish a program to provide Coast Guard personnel with the training necessary for implementation of U.S. shipping law in the EEZ.

United States-Israel Strategic Partnership Act of 2013 - Declares that Israel is a major strategic partner of the United States. Amends the Israel Enhanced Security Cooperation Act of 2012 to extend authority to: (1) make additions to foreign-based defense stockpiles, and (2) transfer certain obsolete or surplus Department of Defense (DOD) items to Israel. Authorizes the President to carry out U.S.-Israel cooperative activities and to provide assistance for cooperation in the fields of energy, water, homeland security, agriculture, and alternative fuel technologies. Amends the the Energy Independence and Security Act of 2007 to extend the grant program for U.S.-Israeli cooperation on research, development, and commercialization of renewable energy or energy efficiency. Expresses the sense of Congress that the United States and Israel should increase cyber-security cooperation. Urges the President to provide assistance for enhancement of the David's Sling Weapon System, the joint United States-Israel Arrow Weapon System, and the Iron Dome short-range rocket defense system. States that it shall be U.S. policy to include Israel in the visa waiver program when Israel satisfies such program's inclusion requirements.

Ensuring Access to Quality Complex Rehabilitation Technology Act of 2013 - Amends title XVIII (Medicare) of the Social Security Act to cover, as medical and other health services, complex rehabilitation technology items designed and configured for a specific qualified individual to meet that individual's unique: (1) medical, physical, and functional needs related to a medical condition; and (2) capacities for basic activities of daily living (ADLs) and instrumental ADLs. Directs the Secretary of Health and Human Services (HHS) to: (1) designate complex rehabilitation technology items (excluding adaptive equipment to operate motor vehicles or certain prosthetic devices and orthotics); and (2) establish eligibility criteria for them. Prescribes requirements for payments for CRT items. Directs the Secretary to establish standards for clinical conditions for CRT item payment as well as quality standards for suppliers of such items. Directs the Secretary to establish a Healthcare Procedure Coding System (HCPCS) coding subset that uses specified HCPCS codes for CRT items. Requires payment for replacement of a CRT item (or any part of one), without regard to certain continuous use or useful lifetime restrictions established for items of durable medical equipment (DME), if a qualified ordering practitioner determines that a replacement item (or part) is necessary.

Wall Street Trading and Speculators Tax Act - Amends the Internal Revenue Code to impose a .03% excise tax on the purchase of a security if: (1) such purchase occurs or is cleared on a trading facility located in the United States, or (2) the purchaser or seller is a U.S. person. Defines "security" to include: (1) stocks, partnership interests, notes, bonds, debentures, or other evidences of indebtedness; (2) interests in a derivative financial instrument (i.e., any option, forward contract, futures contract, or any similar financial instrument) and (3) any notional principal contract. Exempts from such tax: (1) initial issues of securities; (2) any note, bond, debenture, or other evidence of indebtedness which is traded on a trading facility located in the United States and has a fixed maturity of not more than 100 days; and (3) securities traded pursuant to certain lending arrangements. Makes such tax applicable to transactions by controlled foreign corporations and payable by its U.S. shareholders. Allows an offset against such tax for contributions to certain tax-favored accounts, including tax-exempt retirement plans, Archer medical savings accounts, health savings accounts, and qualified tuition plans and Coverdell education savings accounts.

Expresses support for efforts to ensure that: (1) parents have and can use earned sick days to care for themselves and their families, have paid leave to prepare for and recover from pregnancy and childbirth and to care for their children or loved ones, and may receive a social security credit if they are forced to leave the workforce to care for a child or a loved one; and (2) women receive equal pay for equal work. Expresses support for efforts to: (1) work to end gender discrimination and improve women's health by implementing the Affordable Care Act, end health disparities for women, and end gender-based violence; and (2) eliminate discrimination and promote women's health and economic security by ensuring reasonable workplace accommodations for workers whose ability to perform job functions are limited by pregnancy, childbirth, or a related medical condition.

Nuclear Iran Prevention Act of 2013 - Directs the Secretary of State to determine if Iran's Revolutionary Guard Corps (IRGC) meets the criteria for designation as a foreign terrorist organization and: (1) if so, designate the IRGC as a foreign terrorist organization; and (2) if not, report to Congress concerning those criteria which have not been met. Expresses the sense of Congress regarding the imposition of sanctions on certain Iranian government persons responsible for, or complicit in, human rights abuses, diversion of food and medicine, and censorship. Amends the Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010 to subject to mandatory sanctions a financial institution that facilitates a significant transaction or provides significant financial services for a person that: (1) is subject to human rights-related sanctions, or (2) exports sensitive technology to Iran and is subject to the prohibition on procurement contracts. Amends the Iran Threat Reduction and Syria Human Rights Act of 2012 to authorize the President to impose sanctions on a foreign person that knowingly conducted or facilitated a significant financial transaction with the Central Bank of Iran or other Iranian financial institution subject to sanctions for the purchase of goods (other than petroleum or petroleum products) or services by or from a person in Iran, or on behalf of a person in Iran. Excludes from such sanctions a transaction for the sale of agricultural commodities, food, medicine or medical devices to Iran. Directs the President to impose specified sanctions on a foreign financial institution that knowingly facilitated a significant financial transaction on behalf of any person directly or indirectly owned or controlled by an Iranian person included on the list of specially designated nationals and blocked persons maintained by the Department of the Treasury's Office of Foreign Assets Control. Revises the exception to the imposition of sanctions for purchases of Iranian petroleum or petroleum products. Expresses the sense of Congress that the President should coordinate with the European Union (EU) and its member states to restrict Iran's access to the euro currency. Directs the President to develop a National Strategy on Iran that provides strategic guidance for addressing threats posed by Iran. Directs the President to report to Congress every 60 days regarding the Iranian nuclear timetable and the projected economic effects of international sanctions on Iran. Requires the Government Accountability Office (GAO) to report to Congress regarding presidential implementation of specified sanctions on Iran.

Puppy Uniform Protection and Safety Act - Amends the Animal Welfare Act to define a "high volume retail breeder" as a person who, in commerce, for compensation or profit: (1) has an ownership interest in or custody of one or more breeding female dogs; and (2) sells, via any means of conveyance, more than 50 of the offspring of such dogs for use as pets in any one-year period. Considers such a breeder of dogs to be a dealer. Requires dealers to include on licensing applications and annual renewals the total number of dogs exempted from exercise on the premises of the dealer in the preceding year by a licensed veterinarian. Requires the Secretary of Agriculture (USDA) to promulgate requirements for the exercise of dogs at facilities owned or operated by a dealer, including requiring daily access to exercise that: (1) allows the dogs to move sufficiently in a way that is not forced, repetitive, or restrictive; and (2) is in an area that is spacious, cleaned at least once a day, free of infestation by pests or vermin, and designed to prevent the dogs from escaping. Allows an exemption if: (1) a licensed veterinarian determines that a dog should not exercise because of the health, condition, or well-being of the dog; and (2) such determination is reviewed and updated at least once every 30 days by the veterinarian, unless the basis for the determination is a permanent condition. Subjects such a determination to review and approval by the Secretary.

Authorizes the Secretary of Health and Human Services (HHS) to engage in public awareness and education activities to increase understanding and recognition of FGIMDs.

Delivering Antimicrobial Transparency in Animals Act of 2013 - Amends the Federal Food, Drug, and Cosmetic Act to revise reporting requirements for the sponsor of a new animal drug containing an antimicrobial active ingredient. Requires a sponsor's annual report to the Secretary of Health and Human Services (HHS) to specify for each dosage form the known or estimated amounts of the antimicrobial active ingredient sold or distributed for use in each food-producing animal for which the new animal drug is approved. Repeals the requirement that such report list, for each dosage form, the target animals, indications, and production classes specified on the approved label of the product. Requires live poultry dealers, swine contractors, or feed lot operators who purchase, contract, or manufacture animal feed in final formulation bearing or containing a new animal drug with an antimicrobial active ingredient to report annually to the Secretary information about such ingredient by food-producing animal for which the new animal drug is approved and, if applicable, by production class of the animal. Exempts dealers, contractors, or operators from this reporting requirement if the value of their live animals does not exceed $10 million or such other sum as the Secretary may specify. Authorizes the Secretary to specify alternative reporting requirements. Establishes requirements for: (1) publicly available summaries of the information in the annual reports, including data by antimicrobial class; and (2) how to report data with fewer than three sponsors of such approved new animal drugs. Requires the Secretary, acting through the Commissioner of Food and Drugs (FDA), to increase collaboration and coordination with the Secretary of Agriculture (USDA) to expand and coordinate the collection of data on the use of antimicrobial drugs in or on food-producing animals, as well as provide information to the Secretary of Agriculture for use by: (1) the Animal and Plant Health Inspection Service to help inform its collection of data through the National Animal Health Monitoring System, and (2) the Economic Research Service to help inform its collection of data through the Agricultural Resource Management Survey. Requires the Secretary to publish a final version of draft guidance #213 entitled “New Animal Drugs and New Animal Drug Combination Products Administered in or on Medicated Feed or Drinking Water of Food-Producing Animals: Recommendations for Drug Sponsors for Voluntarily Aligning Product Use Conditions with GFI #209.” Requires the Comptroller General (GAO), within three years after such publication, to evaluate: (1) the voluntary approach used by the FDA to eliminate injudicious use of antimicrobial drugs in food-producing animals, and (2) the effectiveness of FDA data collection activities regarding antimicrobial resistance.

Real Education for Healthy Youth Act of 2013 - Requires the Secretary of Health and Human Services (HHS) to award competitive grants to enable eligible entities to carry out programs that provide adolescents with comprehensive sex education to: (1) replicate evidence-based sex education programs, (2) substantially incorporate elements of evidence-based sex education programs, or (3) create a demonstration project based on generally accepted characteristics of effective sex education programs. Sets forth provisions regarding evaluation of such programs. Requires the Secretary to establish a common set of performance measures to assess the implementation and impact of grant programs funded under this Act. Requires the Secretary to award competitive grants to: (1) institutions of higher education to enable such institutions to provide young people with comprehensive sex education with an emphasis on reducing HIV, other sexually transmitted infections, and unintended pregnancy; and (2) eligible entities to train targeted faculty and staff in order to increase effective teaching of comprehensive sex education for elementary and secondary school students. Prohibits programs funded under this Act from discriminating on the basis of actual or perceived sex, race, color, ethnicity, national origin, disability, sexual orientation, gender identity, or religion. Prohibits federal funds provided under this Act from being used for health education programs that: (1) deliberately withhold life-saving information about HIV; (2) are medically inaccurate or have been scientifically shown to be ineffective; (3) promote gender stereotypes; (4) are insensitive and unresponsive to the needs of sexually active youth or lesbian, gay, bisexual, or transgender youth; or (5) are inconsistent with the ethical imperatives of medicine and public health. Amends the Public Health Service Act to repeal a prohibition against the use of appropriations for AIDS prevention programs to provide education or information designed to promote or encourage, directly, homosexual or heterosexual activity or intravenous substance abuse. Amends the Elementary and Secondary Education Act of 1965 to repeal a prohibition against the use of authorized funds to operate a program of contraceptive distribution in schools.

Denying Firearms and Explosives to Dangerous Terrorists Act of 2013 - Amends the federal criminal code to grant the Attorney General the authority to deny the transfer of firearms or the issuance of a federal firearms and explosives license to any individual if the Attorney General: (1) determines that such individual has been engaged in or has provided material support or resources for terrorist activities, and (2) has a reasonable belief that such individual may use a firearm or explosive in connection with terrorism. Allows any individual whose firearm or explosives license application has been denied to bring legal action challenging the denial. Prohibits the sale or distribution of firearms or explosives to any individual whom the Attorney General has determined to be engaged in terrorist activities. Directs the Director of the Federal Housing Finance Agency (FHFA) to establish a single website where borrowers may: (1) determine their potential eligibility for participation in the Program, (2) see a complete list of and links to qualified lenders, (3) use a mortgage refinance calculator to calculate potential payment savings based on different interest rates, and (4) obtain tips on refinancing their loan. Directs the Director of FHFA to issue guidance to require the GSEs to make their refinancing guidelines consistent to ease the compliance requirements of qualified lenders, and in particular with respect to loans with less than 80% loan-to-value ratio and closing cost policies of the GSEs, which regulations or guidance shall be put into effect not later than 90 days after the enactment of this Acts.

Defines "qualified ABLE program" as a program established and maintained by a state agency under which a person may make contributions to an ABLE account established to pay for qualified disability expenses. Requires amounts in ABLE accounts to be disregarded in determining eligibility for Medicaid and other means-tested federal programs. Suspends the payment of supplemental security income benefits under title XVI (Supplemental Security Income) of the Social Security Act to an individual during any period in which such individual has excess resources attributable to an ABLE account.

Includes as a "covered mental health condition" post-traumatic stress disorder, anxiety, depression, or any other mental health diagnosis that the Secretary determines to be related to military sexual trauma. Requires the Secretary to report annually to Congress in each of 2014 through 2018 on covered claims submitted.

Allows USPS to provide any nonpostal service or product in a manner consistent with the public interest. Provides for the mailing of wine and beer sent by a licensed winery or brewery in accordance with the laws of the state, territory, or district where the addressee or agent takes delivery. Establishes in USPS the position of the Chief Innovation Officer who shall have proven expertise and success in the postal and shipping industry and in innovation, marketing, technology, and management. Establishes a Postal Innovation Advisory Commission. Requires the Postmaster General to report to specified congressional committees and the Postal Regulatory Commmission on a comprehensive strategy for maximizing USPS revenue through innovative postal and nonpostal products and services. Prohibits USPS from reducing the frequency of mail delivery to fewer than six days each week or from increasing the expected delivery time for market-dominant products. Repeals the annual limitation on the percentage changes on postal rates for market-dominant products.

Requires a comprehensive school mental health program funded under this Act to assist children in dealing with trauma and violence. Makes only a partnership between a local educational agency and at least one community program or agency that is involved in mental health eligible for such funding. Sets forth assurances required for eligibility, including that: (1) the local education agency will enter into a memorandum of understanding with at least one relevant community-based entity that clearly states the responsibilities of each partner; (2) the program will include training of all school personnel, family members of children with mental health disorders, and concerned members of the community; and (3) the program will demonstrate the measures to be taken to sustain the program after funding terminates. Requires grantees to comply with the health information privacy requirements of the Health Insurance Portability and Accountability Act of 1996 (HIPAA). Requires the Administrator of the Substance Abuse and Mental Health Services Administration to develop a fiscally appropriate process for evaluating grant program activities, including: (1) the development of guidelines for the submission of program data by recipients; and (2) the development of measures of outcomes to be applied by recipients in evaluating programs, to include student and family measures and local educational measures.

Denies certain tax benefits to any taxpayer that is not a small, independent oil and gas company, including: (1) the tax credits for producing oil and gas from marginal wells and for enhanced oil recovery, (2) expensing of intangible drilling and development costs in the case of gas wells and geothermal wells, (3) percentage depletion, (4) the tax deduction for qualified tertiary injectant expenses, (5) the exemption from limitations on passive activity losses, and (6) the tax deduction for income attributable to domestic production activities. Prohibits the use of the last-in, first-out (LIFO) accounting method by major integrated oil companies. Limits or denies the foreign tax credit and tax deferrals for amounts paid or accrued by a dual capacity taxpayer to a foreign country or U.S. possession for any period with respect to combined foreign oil and gas income. Defines "dual capacity taxpayer" as a person who is subject to a levy of a foreign country or U.S. possession and receives (or will receive) directly or indirectly a specific economic benefit from such county or possession..

Wellstone Muscular Dystrophy Cooperative Research Centers to include cardiac and pulmonary function research. Requires the Director of NIH to ensure the sharing of data between such centers. Revises the composition of the Muscular Dystrophy Coordinating Committee (MDCC) to include the Social Security Administration and the United States Administration for Community Living. Requires the MDCC to meet at least two times per year. Requires the MDCC Action Plan to provide for: (1) health economic studies to demonstrate the cost-effectiveness of providing independent living resources and support to patients with various forms of muscular dystrophy, (2) studies to determine optimal clinical care interventions for adults with various forms of muscular dystrophy, and (3) the development of clinical interventions to improve the health of adults with various forms of muscular dystrophy. Requires the MDCC to develop a plan to expedite the evaluation and approval of emerging therapies and personalized medicines that have the potential to decrease fatal disease progression across the various forms of muscular dystrophy. Requires the Secretary of Health and Human Services (HHS), in carrying out epidemiological activities regarding Duchenne and other forms of muscular dystrophies, to ensure that data from different racial and ethnic populations is captured and made publicly available to investigators conducting public or private research on muscular dystrophy. Directs the Secretary to foster ongoing engagement and collaboration between the surveillance program and the research centers. Amends the Muscular Dystrophy Community Assistance, Research, and Education Amendments of 2001 to authorize the Secretary to: (1) update and disseminate widely existing Duchenne-Becker muscular dystrophy care considerations for pediatric patients, and (2) develop and disseminate widely Duchenne-Becker muscular dystrophy considerations for adult patients and acute care considerations for all muscular dystrophy populations. Directs that such care considerations should build upon existing efforts currently underway for specified forms of muscular dystrophy and incorporate strategies specifically responding to the findings of the national transitions survey of minority, young adult, and adult communities of muscular dystrophy patients.

Requires the Administrator to give priority to plants at which nutrient removal technology upgrades would: (1) produce the greatest nutrient load reductions at points of discharge, (2) result in the greatest environmental benefits to the Great Lakes System, and (3) help meet the objectives related to nutrients outlined in Annex four of the 2012 Great Lakes Water Quality Agreement. Defines as "eligible" a plant that: (1) has a permitted design capacity to treat an annual average of at least 500,000 gallons of wastewater per day, and (2) is located within the Great Lakes System in any of such states. Prohibits the federal share from exceeding 55% of the total cost of upgrading such plants.

Urges the President, in negotiating any conventional arms control agreement, to: (1) encourage the national control list of each party to an agreement to cover all types of weaponry, munitions, armaments and related material used for potentially lethal force in military and law enforcement operations; (2) assess each application or proposal to export or internationally transfer arms on a case-by-case basis; (3) deny an arms transfer authorization if there is a substantial risk that the arms will be used to commit or facilitate violations of international human rights law or international humanitarian law; (4) require import and transit state authorizations and certified end use assurances before issuing an export license or authorization for any international transfer of conventional arms; and (6) require each party to an agreement to establish a legal framework for lawful brokering and shipping activities relating to conventional arms transfers. Prohibits, with certain exemptions, the transfer of defense articles or defense services to the government of a foreign country under the Foreign Assistance Act of 1961 or the Arms Export Control Act unless the President certifies to Congress that such government is not: (1) engaging in gross violations of internationally-recognized human rights, and (2) identified by the Secretary of State as having governmental armed forces or government supported armed groups that recruit or use child soldiers.

Directs the Secretary of Health and Human Services (HHS), upon receipt of a report on study results, to publish a determination of whether such mining presents any health risks to individuals in those communities. Defines "mountaintop removal coal mining" as surface coal mining that uses blasting with explosives in the steep slope regions of Kentucky, Tennessee, West Virginia, and Virginia. Prohibits issuance of an authorization for any mountaintop removal coal mining project (or expansion), under the Federal Water Pollution Control Act (commonly known as the Clean Water Act) or the Surface Mining Control and Reclamation Act of 1977, until and unless the Secretary publishes a determination that such mining does not present any health risk to individuals in the surrounding communities. Imposes requirements for continuous monitoring of air, noise, and water pollution and frequent monitoring of soil until a determination by the Secretary is made. Directs the President, acting through the Office of Surface Mining Reclamation and Enforcement of the Department of the Interior, to assess a one-time fee upon persons that conduct such mining projects, sufficient to cover the federal cost of the health studies and pollution monitoring required by this Act.

Directs the Advisory Committee (or an existing advisory committee designated by the Secretary) to develop, and periodically review and revise, a plan for conducting and supporting research, education, and programs on preterm birth through HHS. Requires the Secretary to designate an appropriate agency within HHS to coordinate existing studies and report to the Secretary and Congress on hospital readmissions of preterm infants.
