Prohibit U.S. Funds to the Palestinian Authority Act This bill prohibits any federal department or agency from providing certain foreign assistance funds to the Palestinian Authority unless certain conditions are met. First, the Department of State must submit the results of an independent audit of the budget of Palestinian Authority to Congress. Second, the conditions mentioned above include, for example, that the Palestinian Authority does not manipulate or inappropriately influence election outcomes in its area; is advancing democratic ideals by actively promoting human rights and ending government corruption; regularly and strongly condemns terrorism; has ceased to participate in boycotts against Israel; recognizes Israel's right to exist as a Jewish state; and has excluded Hamas from participating in a unity government.

Defending Education Transparency and Ending Rogue Regimes Engaging in Nefarious Transactions Act or the DETERRENT Act This bill expands oversight and disclosure requirements related to foreign sources and institutions of higher education (IHEs). Specifically, the bill requires an IHE to annually disclose to the Department of Education (ED) any year in which the IHE receives a gift from a foreign country of concern (e.g., China or Russia) or foreign entity of concern of any dollar amount; receives a gift or contract from a foreign source (other than a foreign country of concern or foreign entity of concern) that is valued at $50,000 or more, considered alone or in combination with all other gifts or contracts within a calendar year (current disclosure threshold is $250,000 or more), or which has an undetermined monetary value; enters into a contract with a foreign country of concern or foreign entity of concern after receiving a waiver for such contract; or is substantially controlled by a foreign source. Additionally, the bill prohibits IHEs from entering into contracts with a foreign country of concern or with a foreign entity of concern without obtaining a waiver, requires certain IHEs to disclose gifts or contracts between faculty members and foreign sources, and requires private IHEs with specified assets or investments to file annual investment disclosure reports. The bill authorizes ED to investigate possible violations of this bill and outlines the various penalties for each violation.

This bill expands the authority of U.S. Customs and Border Protection (CBP) to consolidate, modify, or reorganize customs revenue functions. For example, this bill authorizes CBP to add functions to existing positions that perform these revenue functions. CBP may also establish new job series and grades for personnel that perform these functions. The bill also modifies a provision that prohibits CBP from reducing the staffing level of certain revenue functions (e.g., import specialists, entry specialists, and customs auditors). Specifically, this bill relaxes this prohibition by allowing for reductions if the reduction will not result in a staffing level below the optimal level as determined in a specified resource allocation model. (Currently, CBP is required to report to Congress every two years the results of this model to determine the optimal staffing levels for carrying out CBP commercial operations.) The bill also expands this staffing level reduction restriction to also apply to national account managers and international trade analysts.

Honor Our Commitment Act of 2023 This bill prohibits the detention or removal of a national of Vietnam who entered the United States on or before July 12, 1995, has continuously resided in the United States since entry, and is subject to a final order of removal (i.e., covered individual). This prohibition does not apply to an individual who (1) the Department of Homeland Security (DHS) has determined is directly responsible for harming the security of the United States, or (2) is subject to extradition. Under the bill, a covered individual shall receive work authorization.  The bill directs DHS to provide notice of the bill’s provisions to covered individuals. The notice shall include information explaining the requirements and instructions for filing a motion to reopen removal proceedings.

This bill specifies a legal standard for determining whether an individual is considered an independent contractor rather than an employee for the purposes of federal labor laws that address issues such as the federal minimum wage, overtime compensation, and collective bargaining. The rights and protections provided by these laws exclusively apply to employees. Under the bill, an individual is considered an independent contractor if (1) another individual or entity does not exercise significant control over the details of how the individual's work is performed, without regard to any control the other individual or entity may exercise over the final result of the work performed; and (2) while performing such work, the individual has opportunities and risks inherent with entrepreneurship (for example, the discretion to exercise professional judgment). The bill also sets forth factors that may not be used to determine whether an individual is an employee. Specifically, factors such as whether another individual or entity requires the individual to meet certain legal, health and safety, insurance, or performance requirements may not be used to make such a determination.

Pandemic Unemployment Fraud Recoupment Act This bill extends the time period when a state must recover improperly paid pandemic unemployment insurance (UI) benefits and bring related criminal charges or enforcement actions to 10 years. The bill also adds certain recovery requirements to two pandemic UI programs—Pandemic Unemployment Assistance (PUA) and Lost Wages Assistance (LWA)—that match the requirements of other pandemic UI programs. Specifically, the state must (1) repay itself by deducting the PUA or LWA funds from any UI benefits a recipient may later qualify to receive; and (2) ensure the recipient is provided with notice, a hearing, and a final determination.

Kidney Patient Access to Technologically Innovative and Essential Nephrology Treatments Act of 2023 or the Kidney PATIENT Act of 2023 This bill delays a change to the payment methodology under Medicare for oral drugs that are used to treat end-stage renal disease (ESRD). Under current regulations, beginning January 1, 2025, the Centers for Medicare & Medicaid Services will incorporate payments for oral-only ESRD drugs into the ESRD prospective payment system rather than issuing separate payments to ESRD facilities. The bill delays implementation of this policy until January 1, 2033, or until an approved intravenous drug is available, whichever is earlier.

The State Department must also increase the number of U.S.-sponsored junior professional officers at the United Nations to match or exceed the number of such officers sponsored by China. Furthermore, the State Department and the U.S. Permanent Representative to the United Nations must report to Congress annually about China's actions to expand its influence on the United Nations, including through coercion, intimidation, and other illegitimate means.

Hospital and ASC Price Transparency Act of 2023 This bill requires Medicare hospitals and ambulatory surgical centers to publish their prices. Specifically, hospitals and ambulatory surgical centers must publish pricing information for at least 300 shoppable services designated by the Centers for Medicare & Medicaid Services (CMS), including the gross charge and discounted cash price. The CMS must establish the method and manner of publication; hospitals and ambulatory surgical centers that have price estimator tools are deemed to be in compliance with the bill's requirements if the tool meets certain specified criteria. Hospitals and ambulatory surgical centers are subject to civil penalties for noncompliance. The CMS must publish information about the status of each hospital and ambulatory surgical center's compliance. The bill provides funds for FY2024 to implement these requirements.

Personality traits refer to the patterns of an individual with respect to behaviors, thoughts, and emotions and may include patterns relating to humor, sensitivity, grit, leadership, integrity, helpfulness, courage, and kindness. Specifically, the IHE must make available on its public website and application materials (1) a statement informing applicants of the use of personality traits in making admission determinations, (2) the rationale for such use of personality traits, (3) a description of the process under which personality traits are considered, and (4) the standards and criteria used for rating personality traits.

Medical Supply Chain Resiliency Act

Medical Supply Chain Resiliency Act This bill authorizes actions to facilitate trade in medical goods (i.e., medical devices, pharmaceutical goods, or inputs for such devices or goods). Specifically, the bill authorizes the President to (1) negotiate, enter into, and enforce a trusted trade partner agreement with a country or countries with respect to medical goods; and (2) proclaim a modification of any existing duty, a continuance of existing duty-free or excise treatment, or additional duties to carry out the trade agreement. These actions may only be taken if the President determines, based on specified considerations, that the reciprocal elimination of existing duties or other import restrictions with respect to medical goods would contribute to U.S. national security and public health.  A trusted trade partner agreement may include certain provisions, such as those to (1) reduce or eliminate duties, quotas, or other trade barriers; (2) diversify and expand supplier networks to secure a reliable supply of medical goods; and (3) harmonize regulatory procedures. Not later than 60 days before initiating negotiations with a trusted trade partner, the President must submit written notice to Congress. The bill requires congressional consultation and review of these trade agreements. A trade agreement shall not take effect if, during the required review period, Congress enacts a joint resolution of disapproval. The Office of the U.S. Trade Representative must monitor compliance by a trusted trade partner with the trade agreement's commitments and obligations. Further, the President may take certain actions in response to a failure to comply.

REPO for Ukrainians Act

Rebuilding Economic Prosperity and Opportunity for Ukrainians Act or the REPO for Ukrainians Act This bill requires or authorizes various actions related to the confiscation and disposition of Russian sovereign assets (which include funds and other property of Russia's central bank, direct investment fund, or ministry of finance). Under the bill, the President must require U.S. financial institutions to notify the Department of the Treasury of any Russian sovereign assets located at such institutions. The President may confiscate any such assets subject to U.S. jurisdiction. Confiscated funds and the proceeds of liquidated property must be deposited into the Ukraine Support Fund established by the bill. The Ukraine Support Fund shall be used by the Department of State to compensate Ukraine for damages caused by the Russian invasion. The Ukraine Support Fund may also support an international body or mechanism for (1) reconstruction and rebuilding efforts in Ukraine, (2) humanitarian assistance to the Ukrainian people, or (3) other purposes which support the recovery of Ukraine and the welfare of the Ukrainian people. The bill also directs the President to seek to establish, with foreign partners, an international mechanism to provide compensation to Ukraine using the Ukraine Support Fund and Russian sovereign assets confiscated by foreign partners. Additionally, the bill sets policy on related topics, such as specifying that the United States should lead an international sanctions regime to freeze Russian sovereign assets in conjunction with allies and partners.

United States-Taiwan Initiative on 21st-Century Trade First Agreement Implementation Act This bill expresses the approval of Congress for the June 1, 2023, agreement regarding trade between the United States and Taiwan. The bill also imposes requirements on the negotiations of certain further trade agreements between the United States and Taiwan. (The June 1, 2023, agreement, which addresses issues such as customs administration and regulatory practices, is the first of several expected agreements under the United States-Taiwan Initiative on 21st-Century Trade.) The June 1, 2023, agreement may enter into force no earlier than 30 days after the President certifies in writing to Congress that Taiwan has taken measures necessary to comply with the agreement. The bill also imposes requirements on the negotiation of further agreements under the United States-Taiwan Initiative on 21st-Century Trade, such as requiring the U.S. Trade Representative (USTR) to (1) share any U.S. negotiating texts with Congress prior to sharing the text with Taiwan or any parties outside of the executive branch, (2) share any negotiating texts from Taiwan within three days of receipt, and (3) provide daily briefings to certain Members of Congress during negotiating rounds. A further agreement shall not take effect unless (1) the President, at least 60 days before entering into the further agreement, makes the text publicly available on a USTR website; and (2) a bill is enacted into law expressly approving the further agreement.

DOE must give the highest priority to decommissioned or decommissioning reactors located in areas (1) with large populations, (2) with high earthquake hazards, and (3) where the continued storage of high-level radioactive waste or spent nuclear fuel poses a significant national security concern.

Defending American Jobs and Investment Act

Defending American Jobs and Investment Act This bill provides for the enforcement of remedies against foreign countries that have extraterritorial or discriminatory taxes. Specifically, the bill requires the Department of the Treasury to periodically submit a report to Congress that lists each foreign country that has one or more extraterritorial or discriminatory taxes. Treasury must commence enhanced bilateral engagement with each foreign country included in the report. This engagement must (1) express the concern of the United States with respect to the adverse trade and economic effects of tax policies that violate bilateral tax treaties and international tax norms, (2) urge the repeal of extraterritorial and discriminatory taxes that target U.S. persons, and (3) advise the foreign country of remedial actions (as outlined by this bill). The bill increases income tax and withholding tax rates on certain foreign citizens, corporations, and partnerships of any foreign country listed in Treasury's report. The bill provides the executive branch with additional tools to enforce against extraterritorial and discriminatory taxes. These tools include authorizing the President to prohibit government contracting or procurement of goods or services from a foreign country listed in Treasury's report, directing Treasury to consider these taxes in assessing whether to enter into or update a bilateral tax treaty with the foreign country, and requiring the U.S. Trade Representative and the Department of Commerce to consider these taxes in assessing whether to enter into any free trade agreement or executive agreement with the foreign country.
