Superfund Cleanup Participation Act of 1985

Superfund Cleanup Participation Act of 1985 - Amends the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 to direct the Administrator of the Environmental Protection Agency to notify each potentially responsible party within 90 days of placing a facility on the National Priorities List for cleanup of hazardous wastes. Requires notified parties to indicate to the Administrator whether or not such party intends to participate in settlement negotiations. Requires the Administrator to conduct negotiations with interested notified parties, seeking an agreement for a remedial action and cost allocation plan for such facility. Allocates responsibility for costs and cleanup among all potentially responsible parties, based upon contribution to the facility in terms of amount and toxicity of the substances involved and the degree of involvement and care exercised. Imposes a moratorium during the course of negotiations on nonemergency actions against a participating party. Authorizes the Administrator to issue an order requiring a participant to carry out the terms of the settlement agreement. Requires the Administrator to enter into a limitation of future liability agreement with a settling party when permanent cleanup technology is used. Prohibits any other person from seeking contribution from a settling party for the same release. Requires remedial investigations and feasibility studies for facilities which are the subject of negotiations to review the available on-site permanent cleanup technologies. Requires the Administrator to publish an explanation of why such technologies were not used, if they were not used. Exempts response action contractors from liability for nonnegligent actions during the course of a response. Requires competitive bidding among such contractors. Requires the United States to provide legal representation to a response action contractor when an action is brought by a non-Federal entity for damages resulting from the contractor's actions or a release from the facility in question. Requires States, as a condition for receiving Federal remedial action, to make assurances that they have adequate facilities in compliance with the Solid Waste Disposal Act for the disposal or treatment of hazardous waste for the next 20 years.

Child Abuse Victims Rights Act of 1985

Child Abuse Victims Rights Act of 1985 - Amends the Racketeer Influenced and Corrupt Organizations (RICO) Statute to extend its coverage to the sexual exploitation of children. Authorizes a civil suit for treble damages for any persons injured personally or in their business or property by violations of RICO relating to the sexual exploitation of children. Amends the Federal criminal code to provide a mandatory life sentence for any person who kidnaps an individual under the age of 18. Imposes the death penalty in any case where such victim dies as a result of the kidnapping. Increases the penalties for offenses involving the sexual exploitation of children. Provides for a mandatory minimum sentence for second offenders. Extends the statute of limitations for certain offenses involving the sexual exploitation of children. Requires the Attorney General, within one year, to submit a report to the Congress recommending possible changes in the Federal Rules of Evidence, the Federal Rules of Criminal Procedure, the Federal Rules of Civil Procedure, and other courtroom prosecutorial and investigative procedures which would facilitate the participation of child witnesses in cases involving child abuse and sexual exploitation. Specifies a list of considerations including: (1) the use of closed-circuit cameras, two-way mirrors, and other out-of-court statements; (2) the use of judicial discretion to circumscribe the use of harassment or confusing questions; (3) the use of videotape in investigations; (4) the possibility of streamlining investigative procedures; and (5) improved training of prosecutorial and investigative staff in the special problems of child witnesses. Requires the Attorney General to modify the classification system used by the National Crime Information Center in its Interstate Identification Index, and by the Identification Division of the Federal Bureau of Investigation, with respect to offenses involving the sexual exploitation of children, to include the age of the victim and the relationship of the victim to the offender. Requires such classification to use a uniform definition of a child. Amends the Missing Children's Assistance Act to increase by one the membership of the Advisory Board on Missing Children.

Amends the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 to direct the Administrator of the Environmental Protection Agency (EPA) to establish an Office of Demonstration within the Office of Emergency and Remedial Response within EPA to administer a program for testing and demonstrating innovative technologies for hazardous waste cleanup. Requires the program to develop and choose projects for demonstration at selected sites on the National Priorities List (NPL). Permits any person to apply to demonstrate innovative technology, each application to be reviewed within EPA. Directs the Administrator to establish a plan, based upon the applicant's demonstration plan, and evaluate the technology's effectiveness. Directs the Administrator to act upon applications according to a specified timetable. Authorizes the Administrator to provide loan guarantees for demonstration projects. Requires a minimum of five projects in FY 1986, increased to a minimum of ten per year during the succeeding four fiscal years. Directs the Administrator to revise and republish the National Contingency Plan (NCP) to include standards and testing procedures utilizing alternative or innovative technologies, according to cost-effectiveness. Requires the Administrator to document for the demonstrator how the technology concerned is considered for NPL site response actions. Authorizes appropriations from the Hazardous Substance Response Trust Fund (Superfund) for FY 1986 through 1990 to carry out this demonstration program.

Dairy Unity Act of 1985 - Amends the Agricultural Act of 1949 to extend milk price supports for FY 1986 through 1990. Sets the preliminary support price as the product of $8.83 per hundred weight and the adjusted cost of production index (as formulated under this Act). Directs the Secretary of Agriculture to establish such support level on October 1 of each year. Directs the Secretary to provide for a support reduction if a milk diversion program is in effect. Extends milk diversion authority through FY 1990. Authorizes reductions if estimated purchases are between 5,000,000,000 pounds and 7,000,000,000 pounds, and requires them if such estimates exceed 7,000,000,000 pounds. Provides a civil penalty for a person who purchases one or more dairy cattle for slaughter and fails to slaughter such cattle within a reasonable time. Expresses the sense of the Congress that two years after the date of enactment of this Act the congressional agricultural committees should make an evaluation of the cost of production index. Amends the Dairy Production Stabilization Act of 1983 to establish in the Department of Agriculture a National Dairy Research Endowment Institute to provide a permanent system for funding dairy market-expansion research activities. Establishes in the Treasury a Dairy Research Trust Fund. Extends through FY 1990: (1) the dairy indemnity program; and (2) the program authorizing dairy products to be transferred to the military and to veterans' hospitals. Amends the Agricultural Adjustment Act, reenacted with amendments by the Agricultural Marketing Agreement Act of 1937, to set forth minimum price adjustments for fluid milk marketing orders. Amends the Agriculture and Food Act of 1981 to extend seasonal production adjustment authority through FY 1990. Authorizes: (1) marketwide service payments; and (2) cooperative association representation. States that the legal status of producer milk handlers under the Agricultural Adjustment Act, reenacted with amendments by the Agricultural Marketing Agreement Act of 1937, shall be the same after enactment of this Act as it was before such date.

Amends title XVIII (Medicare) of the Social Security Act to direct the Secretary of Health and Human Services to enter into an agreement with any physician owing a past-due obligation because of a breach of contract by the physician under the National Health Service Corps Scholarship program. Requires the agreement to provide that: (1) deductions will be made from amounts owed the physician under the Medicare or Medicaid (title XIX of the Act) program until the past-due obligation has been repaid; (2) Medicare payments for services provided by such physician shall only be made on the basis of an assignment; and (3) if the physician does not provide services for which payment may be made under Medicare or Medicaid or if the physician breaches any provision of the agreement then the Attorney General shall sue the physician to recover the amount owed and the physician shall be barred from Medicare and Medicaid participation until the obligation has been repaid. Prohibits barring a physician if such physician is the sole community physician. Requires a State's Medicaid program to make such deductions from amounts otherwise payable. Provides, under the Public Health Service Act, for the collection of such past-due amounts through Medicare and Medicaid deductions.

Directs the Secretary of Agriculture, with respect to the 1985 and subsequent tobacco crops, to make price supports available to producers through loans to associations. Provides for the transfer of such Fund and Account balances through the Commodity Credit Corporation of the Tobacco Equalization Trust Fund as created by this Act. Title II: Additional Tax on Cigarettes - Amends the Internal Revenue Code to: (1) establish in the Treasury the Tobacco Equalization Trust Fund; and (2) impose an additional excise tax on cigarettes to finance such Fund and support program.

Young Astronaut Program Medal Act - Commemorates the Young Astronaut Program by directing the Secretary of the Treasury to strike and deliver to the Young Astronaut Council no more than 750,000 medals with emblems, devices, and inscriptions determined by the Secretary. Authorizes the Council to dispose of the medals at a premium and to have them delivered as required in quantities of no less than 2,000. Directs that no medals be struck after December 31, 1987. Directs the Secretary to set the price of the medals at no less than the manufacturing cost plus a surcharge of ten percent of such cost. Requires the furnishing of security sufficient to fully indemnify the United States for such costs. Directs that the medals be struck in gold, silver, and bronze and in such size or sizes as determined by the Secretary. Gives the U.S. Comptroller General the right to examine the records of the Council which are related to the medals.
