Medicare Safety Net Access Act of 2002 - Amends title XVIII (Medicare) of the Social Security Act (SSA) to revise the payment for certain Federally qualified health center (FQHC) services furnished to an individual enrolled with a Medicare+Choice organization under Medicare part C (Medicare+Choice), allowing for supplemental reimbursement, among other changes. Amends Medicare+Choice to add additional Medicare+Choice contract requirements. Amends SSA title XI with respect to criminal penalties for acts involving Federal health care programs, particularly illegal remunerations (kickbacks). Exempts from the prohibition against such remunerations any remuneration: (1) between a FQHC (or an entity controlled by such a health center) and a Medicare+Choice organization pursuant to a specified written agreement; and (2) between a certain kind of public or nonprofit private health center entity and any individual or entity providing goods, items, services, donations, loans, or a combination, to such health center entity pursuant to an agreement, if such agreement produces a community benefit that will be used by the health center entity to maintain or increase the availability or accessibility, or enhance the quality, of services provided to a medically underserved population served by the health center entity. Amends Medicare to provide for coverage of additional FQHC services. Directs the Secretary of Health and Human Services to establish standards relating to the exception for health center entity arrangements to described anti-kickback penalties.

Supports the goals and ideals of National Better Hearing and Speech Month. Commends the 41 States that have implemented routine hearing screenings for every newborn before they leave the hospital. Supports the efforts of speech and hearing professionals in their efforts to improve the speech and hearing development of children. Encourages the U.S. people to have their hearing checked regularly and to avoid environmental noise that can lead to hearing loss.

Water Quality Financing Act of 2002 - Amends the Federal Water Pollution Control Act (FWPCA) to authorize the Administrator of the Environmental Protection Agency to make grants to nonprofit organizations to provide technical and information assistance for rural and small treatment works. Requires establishment of procedures for the competitive award of grants. Extends funding for State- and interstate-managed pollution control programs. Revises State water pollution control revolving fund provisions concerning: (1) agreements for treatment works capitalization grants; (2) project eligibility; (3) loan payments, subsidization, and administrative expenses; (4) technical and planning assistance for small treatment works; (5) funding allotments; (6) priorities and intended use plans; and (7) Federal oversight review procedures. Increases the limit on amounts authorized for grants for development of management plans and construction of publicly owned treatment works to serve Indians. Waives application of the Federal Reports Elimination and Sunset Act to various water pollution-related reporting requirements, thereby leaving them in place. Amends the Internal Revenue Code to exempt from the private activity bond volume cap bonds issued as part of an issue whose proceeds are to be used to provide water or sewage facilities. Revises arbitrage bond rules to exclude from consideration as proceeds of an issue any amounts derived from a Federal grant or related State contribution made in connection with a FWPCA or Safe Drinking Water Act State revolving loan fund.

World War I Veterans Medal of Honor Justice Act - Authorizes the President, notwithstanding certain time limitations with respect to the award of the Medal of Honor, to award posthumously the Medal of Honor to Henry Johnson of Albany, New York, for acts of valor while serving as a private in the 369th Infantry Regiment of the U.S. Army during World War I. Directs the Secretary of the Army to review the service records of each African American World War I Army veteran who was awarded the Distinguished Service Cross, or the French Legion of Merit or the Croix de Guerre by the government of France, to determine whether such veteran should be awarded the Medal of Honor. Authorizes the award of the Medal of Honor to an African American World War I veteran upon the recommendation of the Secretary.

Nullifies discretionary spending limit adjustments made by the Director of the Office of Management and Budget pursuant to the Balanced Budget and Emergency Deficit Control Act of 1985 (Gramm-Rudman-Hollings Act) to the highway category and to the Transportation Equity Act for the 21st Century (which limits obligation levels for such category) when the President submitted the budget for FY 2003.

Dot Kids Implementation and Efficiency Act of 2002 - Amends the National Telecommunications and Information Administration Organization Act to direct the Secretary of Commerce to assign to the National Telecommunications and Information Administration (NTIA) responsibility for providing for the establishment, and overseeing operation, of a second-level Internet domain within the U.S. country code domain that provides access only to materials suitable for, and not harmful to, minors. Directs NTIA to require the same registry selected to operate and maintain the U.S. country code to establish, operate, and maintain such second-level domain. Requires the selected registry, as a condition of contract renewal, to provide and implement written content standards for the new domain and a process for the removal of content that does not meet such standards. Requires the NTIA to publicize the availability of the new domain and to educate parents of minors regarding the process for utilizing such domain in coordination with filtering or blocking technologies. Provides for Comptroller General review of the registry selected and the domain content.

Pension Security Act of 2002 - Amends the Employee Retirement Income Security Act of 1974 (ERISA) to require individual account plans, including those with cash or deferred arrangements under IRC section 401(k), to furnish quarterly pension benefit statements to plan participants and beneficiaries with rights to direct investments. Requires individual account plan administrators to give 30 days notice (except in specified circumstances) to plan participants and beneficiaries before a period (lockdown, blackout) in which their ability to divest or diversify assets control over their account assets will be limited. Provides that, during such lockdown periods, employers are not exempt from liability for failing in fiduciary duty with respect to individual account plan investments; but states that this loss of exemption from liability is not triggered by any limitations or restrictions on employee ability to divest or diversify assets, if such limitations or restrictions are disclosed to participants and beneficiaries through summary plan description or materials describing specific investment alternatives under the plan. Amends ERISA and IRC to prohibit individual account plans from acquiring or holding employer securities with respect to which there is any restriction on divestment by a participant or beneficiary after the participant has completed three years of plan participation. Exempts employee stock ownership plans (ESOPS) from this prohibition. Allows ERISA prohibited transaction exemptions under specified conditions to: (1) a fiduciary adviser's providing certain investment advice to an employee benefit plan or to a participant or beneficiary of such plan; (2) sale, acquisition, or holding of securities or other property (including any lending of money or other extension of credit associated with these) pursuant to such advice; and (3) direct or indirect receipt of fees or other compensation by the fiduciary adviser or an affiliate in connection with providing such advice. Amends the Securities Exchange Act of 1934 to prohibit certain insider trading during pension plan transaction suspension periods.

Requires: (1) the Secretary of the Interior to issue regulations under the Migratory Bird Treaty Act that authorize States to establish hunting seasons for double-crested cormorants; and (2) such regulations to limit the number of cormorants that a person may take per day (10) or possess from a hunting season (20).

Employee Retirement Savings Bill of Rights - Amends the Internal Revenue Code to: (1) impose an excise tax on a pension plan failing to provide notice of generally accepted investment principles, including principles of risk management and diversification; (2) impose an excise tax on a pension plan failing to provide notice of any transaction restriction period to each applicable individual to whom the transaction restriction period applies (and to each employee organization representing such applicable individuals); and (3) set forth diversification requirements for plans, including requiring the provision of at least three investment options, other than employer securities, in amounts equivalent to the amounts invested in employer securities.

Medicaid Community-Based Attendant Services and Supports Act of 2002 - Amends title XIX (Medicaid) of the Social Security Act (SSA) to provide for: (1) mandatory coverage of community-based attendant services and supports; and (2) increased Federal financial participation for early coverage States for certain expenditures with respect to community-based attendant services and supports. Directs the Secretary of Health and Human Services to award grants to eligible States to carry out certain capacity building activities with respect to community-based attendant services and supports. Requires each State to establish a Consumer Task Force to assist the State in the development, implementation, and evaluation of real choice systems change initiatives. Directs the Secretary to conduct a project to evaluate service coordination and cost-sharing approaches with respect to the provision of community-based services and supports to non-elderly dually eligible individuals.

Community Access to Emergency Defibrillation Act of 2001 - Amends the Public Health Service Act to direct the Secretary of Health and Human Services to award grants to States, political subdivisions of States, Indian tribes, and tribal organizations to develop and implement public access defibrillation programs by: (1) training and equipping local emergency medical services personnel to administer immediate care, including cardiopulmonary resuscitation (CPR) and automated external defibrillation (AED), to cardiac arrest victims; (2) purchasing AEDs, placing the defibrillators in public places where cardiac arrests are likely to occur, and training personnel in such places to administer CPR and AED to such victims; (3) setting procedures for proper maintenance and testing of such devices; (4) providing training to members of the public in CPR and AED; (5) integrating the emergency medical services system with the public access defibrillation programs; and (6) encouraging private companies to purchase AEDs and provide training for their employees to administer CPR and AED to cardiac arrest victims in their community. Directs the Secretary to award grants to States, Indian tribes, and tribal organizations to develop and implement innovative, comprehensive, community-based public access defibrillation demonstration projects that: (1) provide CPR and AED to cardiac arrest victims in unique settings; (2) provide training to community members in CPR and AED; and (3) maximize community access to AEDs. Directs the Secretary to award a grant to a health care organization to establish a national information clearinghouse that provides information to increase public access to defibrillation in schools.

Health Care Safety Net Improvement Act - Amends the Public Health Service Act (PHSA) to increase the authorization of appropriations for health centers for FY 1997 through FY 2002 and authorize such appropriations as may be necessary for such centers for FY 2003 through FY 2006. Includes within: (1) "required primary health services" appropriate cancer screening (currently, screening for breast and cervical cancer), specialty referral when medically indicated, and specified housing-related services; and (2) "additional health services" behavioral and mental health substance abuse services. Permits grants to health centers for the planning and development of management networks. Rewrites PHSA provisions regarding rural health. Provide grants for expanded delivery of health care services in rural areas, for the planning and implementation of integrated health care networks in rural areas, and for the planning and implementation of small health care provider quality improvement activities. Telehealth Grant Consolidation Act of 2001 - Provides for the establishment: (1) of telehealth network and telehealth resource centers grant programs; and (2) an Office for the Advancement of Telehealth. Provides for grants to eligible entities to enable such entities to provide for improved emergency medical services in rural areas. Reauthorizes and rewrites PHSA provisions regarding the National Health Service Corps program. Prohibits an entity to which a Corps member is assigned from denying requested health services and discriminating in the provision of services because an individual is unable to pay. Provides for a community access demonstration program to improve the effectiveness, efficiency, and coordination of services for uninsured and underinsured individuals. Expands the availability of dental health services.

Community Choice in Real Estate Act - Amends the Bank Holding Company Act of 1956 and the Revised Statutes of the United States to prohibit the Board of Governors of the Federal Reserve System and the Secretary of the Treasury, respectively, from making a determination that real estate brokerage activity or real estate management activity is an activity that is either financial in nature or incidental to any financial activity, or is complementary to a financial activity.

Stroke Treatment and Ongoing Prevention Act of 2001 - Amends the Public Health Service Act to direct the Secretary of Health and Human Services to carry out a national education and information campaign promoting stroke prevention and immediate treatment. Directs the Secretary to: (1) maintain the Paul Coverdell National Acute Stroke Registry and Clearinghouse, including conducting and/or making available research concerning best practices for prevention, treatment, and rehabilitation; (2) make grants to States to establish statewide stroke prevention, treatment, and rehabilitation systems; and (3) develop a model curriculum for training emergency medical services personnel. Sets forth requirements for the State grant program, including matching funds, standards for care and facilities, central data reporting and analysis, special consideration for geographic areas with high rates of disability from stroke or significant need, and technical assistance. Authorizes the Secretary to make grants to develop and implement education programs for appropriate medical personnel with regard to newly developed diagnostics, technologies, and therapies for stroke prevention and treatment.

State Budget Relief Act of 2001 - Requires the Federal medical assistance percentage (FMAP) under title XIX (Medicaid) of the Social Security Act (SSA) for: (1) a State for FY 2001 to be substituted for the State's FMAP for FY 2002 if the FY 2002 FMAP would otherwise be less than the FY 2001 FMAP; and (2) each eligible State for each calendar quarter in FY 2002 to be increased by two percentage points. Mandates specified FMAP increases for States with high unemployment rates, and a specified Medicaid payment cap increase for territories. Prohibits application of the FMAP increases for a State under this Act with respect to: (1) disproportionate share hospital payments under Medicaid; and (2) payments under SSA titles IV and XXI (State Children's Health Insurance) (SCHIP).

Condemns the terrorist attacks resulting in the death of 26 and the wounding of at least 175 innocent people in Israel within 14 hours during December 1-2, 2001, and extends the deepest sympathies of Congress to Israel and to the families of the victims. Expresses outrage at the ongoing Palestinian terrorist campaign and insists that the Palestinian Authority take all necessary steps to end it. Urges the President to take all necessary steps to ensure that the Palestinian Authority takes specified actions. Urges the President to insist that countries harboring or materially supporting Palestinian terrorist groups end their support, dismantle the groups, and bring them to justice. Commends the President for his strong leadership against international terrorism. Expresses U.S. solidarity with Israel in their struggle against terrorism.

National Sea Grant College Program Act Amendments of 2001 - Amends the National Sea Grant College Act to include an emphasis on ocean and coastal resources conservation and management and collaboration between academia and the scientists and programs of the National Oceanic and Atmospheric Administration. Excludes grants to assist coastal and ocean research from the two-thirds limitation otherwise applicable. Revises and expands the terms of membership for the sea grant review panel. Authorizes appropriations for zebra mussel, oyster, harmful algal bloom, and coastal ocean research.

New York Liberty Zone Tax Relief Act of 2001 - Amends the Internal Revenue Code to provide specified temporary tax benefits for the New York Liberty Zone (NYLZ) (September 11, 2001-damaged area). Allows through 2006: (1) additional depreciation (30 percent) as specified for qualified property acquired after September 10, 2001; and (2) a five-year recovery period for depreciation of certain qualified leasehold improvement property (interior of nonresidential real property), as specified. Increases the aggregate dollar limitation for the expensing of certain depreciable business assets (section 179), as specified. Treats qualified New York Liberty Bonds as tax-exempt facility bonds, subject to a maximum aggregate amount, as specified. Extends the replacement period for nonrecognition of gain from two to five years for certain property involuntarily converted as a result of the terrorist attacks in the NYLZ.

Medicare Physician Payment Fairness Act of 2001 - Amends title XVIII (Medicare) of the Social Security Act (SSA) to set the conversion factor (update) for payments under the Medicare physician fee schedule for 2002 at 0.9 percent less than the conversion factor for 2001. Declares that this conversion factor and a specified update adjustment factor for a year after 2002 shall be applied as if this Act had not been in effect. Directs the Medicare Payment Advisory Commission (MEDPAC) to study and report to Congress on replacing or modifying the use of the sustainable growth rate as a factor in determining the update for such payments such that the factor used more fully accounts for changes in the unit costs of providing physicians' services.

United States Consensus Council Act of 2001 - Establishes the United States Consensus Council to: (1) promote and advance programs based on consensus building as a complement to the current deliberative processes used by Congress and the executive branch in addressing national public policy issues; (2) enter into formal and informal relationships with other public and private institutions for purposes not inconsistent with this Act; (3) receive referrals from Congress, the President, executive departments, agencies, private groups, or organizations that request the Council's expertise in building a consensus on a particular public policy issue; (4) coordinate with, and make referrals to and receive them from, other consensus building instrumentalities of the United States, including the U.S. Institute for Environmental Conflict Resolution or the Federal Mediation and Conciliation Service; and (5) develop and apply assessment plans for reviewing such referrals.

Help America Vote Act of 2001 - Directs the Administrator of General Services to establish programs under which the Administrator makes payments to each eligible State or local government to: (1) replace a punch card voting system with a voting system which does not use punch cards; or (2) make technical enhancements to the performance of its punch card voting system. Establishes: (1) an independent Election Assistance Commission to serve as a national clearinghouse and resource for the compilation of information and review of procedures with respect to the administration of Federal elections; and (2) the Election Assistance Commission Standards Board and the Election Assistance Commission Board of Advisors to review any of the voluntary standards for engineering and procedural performance, for maintenance and enhancement of the accessibility and privacy of registration facilities, polling places, and voting methods, and for election management practices recommended by the Commission. Establishes the Technical Standards Development Committee to assist the Executive Director of the Commission by recommending standards to ensure the usability, accuracy, security, accessibility, and integrity of voting systems and voting equipment. Directs the Commission to: (1) provide for the testing, certification, decertification, and recertification of voting system hardware and software by accredited laboratories; (2) make payments to States for voting system improvements, grants to entities for voting equipment and technology research and development, and grants for pilot programs to try out new voting systems and equipment technologies; and (3) develop the Help America Vote College Program to encourage college students to assist State and local governments in election administration. Amends Federal law to create the Help America Vote Foundation as a nonprofit charitable corporation to mobilize secondary school students to participate in the election process in a nonpartisan manner as poll workers or assistants. Outlines minimum standards for State election systems. Sets forth provisions regarding voting rights of military members and overseas citizens. Amends Federal postal service law to replace reduced rates for voter registration purposes with reduced rates for official election mail.

Expresses the sense of Congress that the President should direct: (1) the Nuclear Regulatory Commission (NRC), the Department of Defense, the National Guard Bureau, the Department of Transportation, the Federal Bureau of Investigation, and the Central Intelligence Agency to conduct a joint study to assess the present and future need for military and National Guard units to augment security at the 103 active nuclear facilities in the United States; (2) the NRC and National Guard Bureau to work with State law enforcement agencies to establish basic guidelines for the proper training and use of National Guard units deployed at such facilities; and (3) the NRC, the Federal Emergency Management Agency, and the Food and Drug Administration to establish emergency reserves of potassium iodide tablets in communities within the emergency planning zones of each of the 64 U.S. nuclear power sites. Calls for Federal funding of the National Guard units protecting nuclear facilities.

Spirit of America Commemorative Coin Act of 2001 - Directs the Secretary of the Treasury to mint and issue $50 gold coins, one-dollar silver coins, and half-dollar clad coins emblematic of the tragic events that occurred at the Pentagon, in New York City, and in Pennsylvania, on September 11, 2001. Establishes the Victims of September 11th Fund which shall consist of amounts from surcharges received from the sale of such coins transferred to the Office for Victims of Crime for individuals who were injured, and to the families of individuals who were killed or injured, in the terrorist attacks against the United States on September 11, 2001.

Combatting Illegal Gambling Reform and Modernization Act - Amends the Federal criminal code to revise provisions regarding interstate gambling. Increases the term of imprisonment for violations. Prohibits (with exceptions) any person engaged in a gambling business from knowingly using a communication facility for the transmission: (1) of bets or wagers, or betting information, in interstate or foreign commerce, within the special maritime and territorial jurisdiction of the United States, or to or from any place outside the jurisdiction of any nation regarding any transmission to or from the United States,; or (2) of a communication in such interstate or foreign commerce which entitles the recipient to receive money or credit as a result of bets or for information assisting in the placing of bets. Prohibits (with exceptions) any person engaged in a gambling business from knowingly accepting credit, an electronic fund transfer, a check, or the proceeds of certain other forms of financial transaction as the Secretary may prescribe in connection with the transmission of such a communication of information assisting the placing of bets. Lists exceptions, including certain: (1) transmissions of information assisting in the placing of bets (such as for use in news reporting); and (2) uses of communication facilities for the transmission of bets (e.g., where a State or Tribe has explicitly authorized such bets). Sets forth remedies for violations. Bars imposition of damages, penalties, or forfeiture against any person or entity for an act done in compliance with notice received from a law enforcement agency.

Disaster Relief Charities Accountability Act - Establishes the Charity Accountability Board which shall: (1) request information from and make recommendations to qualifying charitable organizations regarding the amount of disaster relief funds collected and dispersed by such organizations, administrative costs incurred, and the criteria used in dispersing disaster relief funds; (2) provide information about disaster relief funds to disaster victims and those wishing to contribute to such funds; and (3) report to the President and Congress on the status of such funds.

September 11 Surviving Spouse Student Loan Relief Act - Directs the Secretary of Education to discharge or cancel the Federal student loan indebtedness of spouses of individuals who died (or die) or who became (or become) permanently and totally disabled from injuries suffered in the terrorist attacks on September 11, 2001.

Medicare Ambulance Payment Reform Act of 2001 - Amends title XVIII (Medicare) of the Social Security Act (SSA) to revise requirements for payment for ambulance services concerning: (1) the establishment of a fee schedule; and (2) the coding system specifying the medical condition of the individual transported by an ambulance and the appropriate level of transportation service. Amends SSA titles XVIII (Medicare) (including part C (Medicare+Choice) of the Medicare program) and XIX (Medicaid) to establish a prudent layperson standard for justification of emergency ambulance services under Medicare and Medicaid.

Calls for a joint session of Congress in New York City, New York, during the 107th Congress at such date, time, and location as the Speaker of the House of Representatives and the President Pro Tempore of the Senate may jointly select, for the purpose of conducting such business as the Speaker and the President Pro Tempore may consider appropriate.

Freedom to Fish Act - Amends the Magnuson-Stevens Fishery Conservation and Management Act to prohibit any fishery management plan prepared by a Regional Fishery Management Council or the Secretary of Commerce from establishing areas closed to recreational fishing unless: (1) there is a clear indication that recreational fishermen are the cause of a specific conservation problem and that less severe conservation measures will not adequately provide for conservation and management of the affected stocks of fish; (2) the closed area regulation includes specific measurable criteria to determine the conservation benefit of the closed area on such fish and provides a timetable for periodic review of the continued need for the closed area; (3) the closed area is no larger than that which is supported by the best available scientific information; or (4) provision is made to reopen the closed area to recreational fishing whenever any such condition that was the basis of the closure no longer exists. Amends the National Marine Sanctuaries Act to direct the Secretary to provide such a Council with the opportunity to propose and revise all regulations applicable to fishing within designated marine sanctuaries according to the standards and procedures of the Magnuson-Stevens Fishery Conservation and Management Act. Requires such regulations, upon approval by the Secretary, to apply within the exclusive economic zone and allows them to be applied within a State, with the approval of the State's Governor or pursuant to the Secretary's authority under such Act.
