Health Maintenance Organization Amendments - Makes the offering of supplemental health services, as defined by the Health Maintenance Organization Act of 1973, optional by health maintenance organizations. Eliminates the requirement imposed by such Act that health maintenance organizations offer annual open enrollment for individual membership. Redesignates medical treatment and referral services for drug or alcohol abuse or addiction and home health services as supplemental health services for purposes of such Act. Enables private entities to obtain federally guaranteed loans for the planning, initial development, and operation of a health maintenance organization to serve populations in addition to medically underserved populations. Includes State and local governmental employers as among those employers which must offer employees the option of membership in a health maintenance organization. Sets forth new procedures, penalties, and other requirements, to be applied by the Secretary of Health, Education, and Welfare where health maintenance organizations are alleged to be in noncompliance with such Act. Extends the authorization of appropriations for programs under such Act an additional two years.

Expresses the sense of Congress that the United States delegation to the European Security Conference should not agree to the recognition by the European Security Conference of the Soviet Union's annexation of Estonia, Latvia, and Lithuania and it should remain the policy of the United States not to recognize in any way the annexation of the Baltic nations by the Soviet Union.

Allows individuals who have attained age 65 or who are disabled a refundable tax credit of up to $500, under the Internal Revenue Code of 1954, for property taxes paid by them on their principal residences or for a portion of the rent attributable to property taxes they pay for their principal residences during the taxable year. Reduces the credit available under this Act by 10 percent of the individual's adjusted gross income in excess of $9,000. Disallows the tax deduction for such taxes when a tax credit is taken.

Veterans' Administration Physicians and Dentists Comparability Pay Act - Provides increases in pay for physicians and dentists employed full time by the Department of Medicine and Surgery of the Veterans' Administration. Establishes special pay for such physicians and dentists to maximum annual amounts of $5,000 and $2,500, respectively. Establishes a schedule of incentive pay in amounts up to $8,500 for physicians, and $4,250 for dentists, annually. Directs the Comptroller General of the United States to report to Congress by August 31, 1976, on investigations and evaluations: (1) of the problems facing Federal departments and agencies, including the uniformed services, in recruiting and retaining qualified physicians and dentists; (2) of the extent to which a uniform system of pay, allowances, and benefits would alleviate or solve such problems; and (3) of other appropriate solutions. Directs the Comptroller General to develop alternative courses of action to solve such recruitment and retention problems. (Amends 38 U.S.C. 4107; 4114 (a) (2))

Permits the Secretary of the Treasury under the State and Local Fiscal Assistance Act to withhold a percentage of the total entitlement payment for any period to insure sufficient funds for final allocation of funds among the state and local units of government. Appropriates to the State and Local Government Fiscal Assistance Trust Funds: (1) $1,625,000,000 for fiscal year 1976, (2) $6,687,500,000 for fiscal year 1977, (3) $6,837,500,000 for fiscal year 1978, (4) $6,987,500,000 for fiscal year 1979, (5) $7,137,500,000 for fiscal year 1980, and (6) $7,287,500,000 fiscal year 1981. Appropriates to the Fund as noncontiguous States adjustments: (1) $1,195,000 for fiscal year 1976, and (2) $4,780,000 for each of the fiscal years 1976 through 1981. Exempts amounts appropriated to the Fund from the provisions of the Congressional Budget Act. Directs the Secretary of the Treasury to submit a report with appropriate recommendations to the Congress no later than September 30, 1980, concerning the extension of this title. Declares that if the entitlement of any Indian tribe or Alaskan native village is waived for any entitlement period, then the amount of such entitlement shall become part of the entitlement of the county government of the county in which such unit is located. Increases the maximum percentage points per entitlement period until it reaches 175 percent. Directs each State and local unit of government which receives funds under such Act to submit a report to the Secretary after the close of each entitlement period on the use of the funds received. Directs such unit of local government which expects to receive funds to submit a report to the Secretary on how it plans to use the funds it expects to receive. Empowers the Secretary whenever he determines that a unit of government has failed to comply with an applicable regulation to withhold all or a portion of the entitlement funds due such unit of government, to terminate the eligibility of such unit of government, and to require repayment of the entitlement funds expended. Requires units of government to provide an opportunity for citizens to give recommendations and views on the proposed expenditures of all funds within such units distributed under such Act.

Jobs Creation Act - Title I: Individual Income Taxes - Allows a tax credit in the amount of 10 percent (up to $1,000) the amount of qualified individual deposits and investments made by an individual during the taxable year. Defines qualified investments as amounts used to purchase stock in or debt instruments of a domestic corporation. Provides that the first $1000 of capital gain shall be excluded from gross income during the taxable year. Provides, for purposes of the estate tax, that the lesser of: (1) $200,000 and (2) the value of the decedent's interest in a family farming operation continually owned by him for 5 years prior to his death and which passes to a related individual shall be excluded from the value of the taxable estate. Title II: Corporation Taxes - Reduces the normal tax rates imposed on corporations. Increases the investment credit to 15 percent (12 percent in the case of property constructed or acquired before an unspecified date in March, 1975). Increases the corporate surtax exemption from $25,000 to $100,000. Increases the class life variance for purposes of the depreciation deduction allowed for property used in a trade or business or held for the production of income. Title III: Employee Stock Ownership Plan Financing - Creates special deductions for dividends paid during the taxable year by employers on securities held by an employee stock ownership plan (as defined by this title). Provides for the distribution of dividends to employees and repurchase of qualifying employer securities from persons receiving distributions. Provides for the exclusion from gross income of that part of a distribution held or reinvested within 60 days in income-producing assets of equivalent value for the purpose of realizing current income from such assets.

Broadcast License Renewal Act - Permits the Federal Communications Commission to extend three-year broadcast licenses for an additional two years upon a finding of public interest. Requires in making such determination, considerations of whether different term lengths for radio and television stations and for different categories of licensees are in the public interest. Limits other class licenses to a five-year maximum, prescribing the renewal procedures for such licenses and the criteria to be considered in renewal, including responsiveness and lack of serious deficiencies. Sets guidelines for expeditious action on applications for renewal of broadcasting station licenses by limiting material required to be filed. Requires the Commission to examine the renewal process and report within six months on methods of reducing and consolidating filings and supporting documents.

Prohibits a petroleum refiner or distributor from cancelling, failing to renew, or otherwise terminating a franchise unless he furnishes notification in writing to each affected distributor or retailer by certified mail not less than ninety days prior to the date on which such franchise will be canceled, together with a statement of the reasons of such cancellation and of the remedies available. Provides that a petroleum refiner or distributor shall not cancel, fail to renew, or otherwise terminate a franchise unless the retailer or distributor whose franchise is terminated failed to comply substantially with any essential and reasonable requirement of such franchise or failed to act in good faith in carrying out the terms of such franchise. States that if a refiner or distributor engages in conduct prohibited under this Act, a retailer or distributor may maintain a suit against such refiner or distributor.

Veterans Disability Compensation and Survivor Benefits Act - Title I: Veterans Disability Compensation - Increases the rates of disability compensation for disabled veterans, depending on the severity of the disability. Provides additional allowances to spouses, children, and dependent parents in all cases where the veteran is rated 50 percent or more disabled. Title II: Survivors Dependency and Indemnity Compensation - Increases the monthly benefits payable to widows and children under the Survivors Dependency and Indemnity Compensation program by 10 percent. Title III: Conversion Under Servicemen's Group Life Insurance - Provides that a member eligible for automatic conversion of Servicemen's Group Life Insurance may elect to convert to an individual commercial policy, or elect to be insured under the Veterans' Group Life Insurance program. Title IV: Effective Dates - Provides that titles I and II shall take effect on the first day of the second calendar month which begins after the date of enactment of this Act. Provides that title III shall take effect on the date of enactment of this Act.

Emergency Employment Appropriation Act - Authorizes the appropriation of enumerated sums for emergency employment for fiscal year 1975. Title I: - Authorizes specified amounts for the Comprehensive Manpower Assistance, Community Service Employment for Older Americans, and Temporary Employment Assistance programs in the Department of Labor. Authorizes specified amounts for the Health Services, Higher Education, and Social and Rehabilitative Service Work Incentives programs in the Department of Health, Education, and Welfare. Authorizes $5,000,000 for the administrative expenses of the United States Railway Association in the Department of Transportation. Title II: Limits the application of sums under this Act. Prohibits the expenditure of sums authorized by this Act for the acquisition of motor vehicles other than motor vehicles manufactured and assembled in the United States.

Social Security Reform Amendments - Repeals the earnings limitation under title II (Old-Age, Survivors, and Disability Insurance) of the Social Security Act. Provides benefits under such title to husbands, widowers, and fathers on the same basis as wives, widows, and mothers who presently receive benefits. Eliminates the five-month waiting period for disability benefits. Continues the benefit entitled under such title through the month of the beneficiary's death. Permits individuals 65 years of age or older to elect an exemption from Social Security coverage and payment of Social Security taxes. Eliminates marriage or remarriage of a beneficiary as a factor in terminating or reducing the amount of benefits available. Authorizes direct payments to physicians and other providers at their option under the supplementary medical insurance program of title XVIII (Medicare) of the Social Security Act.

Provides, under the Omnibus Crime Control and Safe Streets Act, that specific grants under such Act shall not be made to any State, unit of general local government, or public agency, unless there is in effect a law enforcement officer's bill of rights. States that such bill of rights must substantially provide as a minimum the rights enumerated in this Act, including: (1) the right of a law enforcement officer to engage in political activity during off-duty hours or to refrain from such activity; and (2) observance of specified standards with respect to the investigation of a law enforcement officer who is under investigation for alleged malfeasance, misfeasance, or nonfeasance of official duty, with a view to possible disciplinary action, demotion, dismissal, or criminal charges. States that such standards shall include: (1) informing the law enforcement officer of the nature of the investigation, the names of any complainants, and the identity and authority of the person conducting such investigation; (2) full recordation of the investigation; and (3) allowing the law enforcement officer to have his counsel present at any interrogation in connection with the investigation. Grants a law enforcement officer the right to recover pecuniary and other damages from persons violating any of the rights established under the bill of rights. Provides that no law enforcement officer shall be required to disclose, for the purposes of promotion or assignment, any item of his property, income, assets, debts, or expenditures. Establishes a Law Enforcement Officers' Grievance Commission composed of representatives of the general public, law enforcement agencies, and other public agencies. Gives the Commission the authority to receive, investigate, and determine grievances of any law enforcement officer, and to require testimony under oath and the production of documents. Defines terms used in this Act.

Railroad Right-of-Way Improvement Act - Declares it the purpose of this Act to provide, during times of high unemployment, assistance to create employment opportunities in rebuilding the Nation's railroad rights-of-way. Authorizes the Secretary of Transportation to provide financial assistance during times of high unemployment for the purpose of providing employment for unemployed and under employed persons in jobs maintaining or rebuilding railroad rights-of-way. Authorizes, for such purposes, appropriations of $500,000,000 for fiscal year 1975; $1,000,000,000 for fiscal year 1976, and $1,000,000,000 for fiscal year 1977. Requires such funds be expended only for wages and employment benefits. Prohibits further obligation of such funds to be made subsequent to a determination by the Secretary that the rate of national unemployment (seasonally adjusted) has receded below 4.5 percent for three consecutive months. Requires applications for financial assistance for a railroad right-of-way employment program to contain specified assurances. Directs the Secretary to transmit to Congress at least annually a detailed report setting forth the activities conducted under this Act.

Directs that funds for such efforts be taken from their discretionary funds.

Medical Malpractice Claims Settlement Assistance Act - Sets forth the findings of Congress that the achievement of equal access to quality health care at a reasonable cost is jeopardized by the uncertain future availability and cost of medical malpractice insurance. Title I: Federal Authority - Authorizes the Secretary of Health, Education, and Welfare to make available to insurance companies and other insurers reinsurance against medical malpractice claims by any of their insureds which exceed $200,000 within a qualified State. Defines "qualified States" as a State which meets requirements set forth in this Act. Permits the Secretary to use existing facilities and services in carrying out his responsibilities under this Act. Entitles the Secretary to recover from any insurer the amount of any unpaid premiums lawfully payable by such insurer to the Secretary. Requires, as a condition to the receipt of reinsurance, that each insurer file specified information with the Secretary. Directs the Secretary to conduct comprehensive studies of medical malpractice claims and litigation, in order to determine methods of minimizing the costs of such a system. Title II: State Programs - Requires States to establish a program for the arbitration of medical malpractice claims. Provides that any civil action arising from a claim for damages on account of alleged medical malpractice on the part of any health professional or health care insitution may be instituted in a court of the State only after there has been an arbitration of the claim which forms the basis for such action. Sets forth procedures governing the initiation of arbitration, the appointment of an arbitration panel, hearing procedures, the decision of the arbitration panel, proceedings subsequent to the decision of the arbitration panel, the admissibility of the arbitration panel decision as evidence at trial, and the reporting of arbitration decisions. Requires States to establish and appropriately enforce a schedule of maximum contingent fee rates which may be charged or accepted by attorneys for services performed in connection with claims for damages on account of alleged medical malpractice. Provides that in order for any State to be eligible for Medicaid payments under title XIX of the Social Security, such State must have in effect a patient grievance mechanism applicable to all health care entities within the State. States that in order to qualify for malpractice reinsurance under this Act, such patient grievance mechanism must (1) receive, investigate, and evaluate grievances of patients respecting medical injuries occurring in noninstitutional settings, and (2) assist in the equitable settlement of any claims arising out of such grievances. Requires such mechanism to make quarterly reports to the Secretary on the grievances received by the mechanism, the disposition of such grievances, and the medical malpractice claims arising out of such grievances.

Directs the Secretary of Health, Education, and Welfare to reimburse the States, under the Older Americans Act of 1965, for real property tax relief programs aimed at elderly households with incomes of $15,000 or less. Provides that the amount of such reimbursement shall be a percentage (determined on the basis of the household income) of the tax relief provided multiplied by the aggregate number of households receiving such relief. Authorizes to be appropriated the sums necessary to carry out the provisions of this Act for fiscal years 1976 through 1979.

Provides that recipients of veterans' pension and compensation shall not have the amount of such pension or compensation reduced, or entitlement thereto discontinued, because of increases in monthly social security benefits resulting from the enactment of Public Law 93-66, Public Law 93-233, and subsequent cost-of-living increases under title II of the Social Security Act. Provides that the provisions of this Act shall apply with respect to annual income determinations made for calendar years after 1972.

Revises the Internal Revenue Code to allow as a credit against the income tax amounts paid by an individual during the taxable year for the expenses of higher education for himself or any other individual. Limits such credit to 100 percent of the first $300 of such educational expenses, 50 percent of the next $300, and 10 percent of the next $400 of such expenses. Reduces such credit by 2 percent of the amount by which the adjusted gross income of the taxpayer exceeds $20,000. Reduces the amount of educational expenses otherwise recognized by this Act by the amounts received as scholarships, fellowships, and veterans benefits.

Requires the Secretary of the Interior, under the Land and Water Conservation Fund Act, to permit the conversion of outdoor recreation property to enclosed or indoor property if he finds that extreme weather conditions (including frequent snowy and icy conditions in the area) would render it difficult to maintain the property in question for outdoor recreation uses.

Expresses the sense of Congress that the President shall utilize contacts with the Soviet Union to persuade that government to allow the resurrection of the Ukranian Orthodox and Catholic churches and to insure religious freedom. Calls upon the President to raise in the United Nations the issue of Stalin's liquidation of the two churches and the effect such action has upon the Soviet Union's posture in light of the United National Charter and the Declaration of Human Rights.

Provides that if the Postal Service and a supervisory organization, recognized by the Postal Service under this Act, representing a majority of supervisors are unable to agree, within 60 days after the organization submits a written notice to the Postal Service, upon a program for consultation or a plan to participate directly in the planning and development of pay policies and schedules, fringe benefit programs, and other programs relating to supervisory employees, either party shall have the right to refer the matter to an arbitration board established under the provisions of this Act. Provides that if the Postal Service and a supervisory organization recognized by the Postal Service under this Act as representing the majority of supervisors are unable to agree with respect to pay policies and schedules, fringe benefit programs, and other programs related to supervisory employees, which affect all or a substantial portion of supervisory personnel on a long- term or permanent basis, after participating directly in the planning and development thereof, either party, upon a 30-day written notice, may refer the dispute to an arbitration board established under the provisions of this Act. Provides for the establishing of an arbitration board to consider specified disputes. Sets forth hearing requirements to be met by such board. Provides that the decisions of the arbitration board shall be conclusive and binding upon the parties.

Eliminates, under title XVI (Supplemental Security Income Benefits) of the Social Security Act, the present prohibition against the payment of supplemental security income benefits to individuals who are residents of skilled nursing facilties, nursing homes, intermediate care facilities, or residential facilities.

Constitutional Amendment - States that, except in time of war or national emergency, the Congress shall make no appropriation for any fiscal year if the resulting total of appropriations for such fiscal year would exceed the total revenues of the United States for such fiscal year, nor shall there be expended by or on behalf of the United States during any fiscal year an aggregate amount which exceeds the total revenue of the United States for that fiscal year.

Creates a select committee in the House of Representatives with authority to conduct a full and complete investigation of the problem of United States servicemen missing in action or known to be dead whose bodies have not been recovered, as a result of military operations in North Vietnam, South Vietnam, Laos and Cambodia. Provides that such investigation shall include an examination of the need for additional international inspection teams to determine whether there are servicemen still held as prisoner of war. Authorizes the Committee to hold hearings, issue subpenas, and maintain a staff as necessary to carry out its responsibilities under this resolution. Directs the committee to report to the House the results of its investigation no later than one year after adoption of this resolution. Provides that the committee's authority shall expire 30 days after the filing of such report. Directs that the expenses of the select committee shall be paid from the contingent fund of the House of Representatives upon vouchers signed by the Chairman.

Constitutional Amendment - Provides that, on or before the fifteenth day after the beginning of each regular session of the Congress, the President shall transmit to the Congress a budget which shall set forth separately: (1) his estimate of the receipts of the Government, other than trust funds, during the ensuing fiscal year under the laws then existing; (2) his recommendations with respect to outlays to be made from funds other than trust funds during such ensuing fiscal year; and (3) if such recommendations exceed such estimate, a surtax rate which the President determines to be necessary to be applied with respect to the income tax of taxpayers to those portions of taxable years of taxpayers occurring during such fiscal year, so that such receipts will equal such outlays. Directs the Speaker of the House of Representatives during the first quarter of each fiscal year, and during the third quarter of each fiscal year to: (1) estimate the receipts of the Government, other than trust funds, during such fiscal year; (2) estimate outlays to be made from funds other than trust funds during such fiscal year; and (3) (A) if such estimate of outlays exceeds such estimate of receipts, determine a surtax rate which the Speaker considers necessary to be applied, with respect to the income tax of taxpayers, to those portions of taxable years of taxpayers remaining in such fiscal year, so that such receipts will equal such outlays; or (B) if such estimate of outlays equals such estimate of receipts, determine that no surtax rate is necessary to be applied. Directs the President during the last month of each fiscal year to review whether the receipts of the Government, other than trust funds, for such year will be less than the outlays other than trust funds for that fiscal year. Provides that if he finds that such receipts are going to be less than such outlays, he shall determine a surtax rate which he considers necessary to be applied with respect to the income tax of taxpayers, so that taxes received by the Government from such surtax, when added to other receipts of the Government, will equal such outlays. Authorizes the suspension of the provisions of this Article in the case of a grave national emergency declared by Congress (including a state of war formally declared by Congress) by a concurrent resolution, agreed to by a rollcall vote of three-fourths of all the Members of each House of Congress, with each such resolution providing the period of time (not exceeding one year) during which those provisions are to be suspended.

Provides for a sentence of not less than five nor more than fifteen years for the commission of a felony with a firearm in addition to the sentence imposed for the commission of the felony. Provides for an additional sentence of from ten to thirty years for the commission of any subsequent felony with a firearm.

Designates as election day the first Tuesday after the first Monday in November in 1976 and every second year thereafter and makes such day a legal public holiday. Designates November 11 as Veterans Day.
