Amends the Internal Revenue Code to establish, on a permanent basis, a zero percent tax rate for the net capital gains of individuals and corporations for purposes of the regular and alternative minimum tax. Eliminates the terminating date in the Jobs and Growth Tax Relief Reconciliation Act of 2003 (i.e., December 31, 2008) for provisions that reduce the capital gains tax rate for individuals.

Human-Animal Hybrid Prohibition Act of 2008- Amends the federal criminal code to prohibit and to set penalties for: (1) creating or attempting to create a human-animal hybrid (a being with human and non-human tissue as specified in this Act); (2) transferring or attempting to transfer a human embryo into a non-human womb, or a non-human embryo into a human womb; or (3) transporting or receiving for any purpose a human-animal hybrid.

Caleb Martin-Travis Dodson Wounded Warrior Retention Act - Authorizes a member of the Armed Forces who would normally be retired, placed on the temporary disability retired list, or separated as the result of a combat-related disability to elect to instead be retained on active service in an active status, as long as the member: (1) remains medically able to perform noncombat-related military occupational specialties or duties; and (2) is not disqualified from performing such specialties or duties because of performance, mandatory retirement for age, or other reasons. Subjects members placed in such status to periodic physical examinations, as provided to members placed on the temporary disability retired list. Authorizes the Secretary of Defense to permit, on a case-by-case basis, the reenlistment or appointment in such status of a member who, during the period beginning on September 1, 2001, and ending on the date of enactment of this Act, was retired or separated as the result of a combat-related disability. Requires a report from the Secretary to Congress on the number and types of noncombat-related military occupational specialties in the Armed Forces and Department of Defense (DOD) civilian employee positions that would be available for such members.

Boy Scouts of America Centennial Commemorative Coin Act - Directs the Secretary of the Treasury to mint and issue up to 350,000 $1 coins in commemoration of the centennial of the founding of the Boy Scouts of America. Requires the coin design to be emblematic of the 100 years of the organization. Restricts issuance of such coins to February 8 through December 31, 2010. Subjects coin sales to a surcharge of $10 per coin. Requires payment of such surcharges to the National Boy Scouts of America Foundation, to be made available to local councils in the form of grants for the extension of Scouting in hard-to-serve areas.

Rejects the National Collegiate Athletic Association (NCAA) Division I A Bowl Championship Series (BCS) football playoff system as an illegal restraint of trade that violates the Sherman Anti-Trust Act. Calls for: (1) the Department of Justice's Antitrust Division to investigate and bring appropriate action to have the BCS system declared illegal and to require a playoff to determine a national champion; and (2) establishment of an NCAA Division I Football Bowl Subdivision Championship playoff system in the interest of fairness and to bring parity to all NCAA teams.

Free Speech Protection Act of 2008 - Allows any U.S. person against whom a lawsuit for defamation is brought in a foreign country on the basis of the content of any speech by that person that has been published, uttered, or otherwise disseminated in the United States to bring an action in a U.S. district court against any person who, or entity which, brought the suit, if the speech at issue in the foreign lawsuit does not constitute defamation under U.S. law. Allows the award of treble damages if it is determined by a preponderance of the evidence that the person or entity bringing the foreign lawsuit intentionally engaged in a scheme to suppress rights under the First Amendment to the Constitution by discouraging publishers or other media from publishing, or by discouraging financial supporters from employing, retaining, or supporting the research, writing, or other speech of an individual.

Hubbard Act - Amends federal employment, armed forces, military pay, and veterans' benefits law to authorize the provision of the following benefits to a member of the Armed Forces who is discharged at the member's request pursuant to a Department of Defense (DOD) policy permitting the early discharge of a member who is the only surviving child in a family in which the father or mother, or one or more siblings, served in the Armed Forces and, incident to such service, was killed, died as a result of wounds, accident, or disease, is in a captured or missing in action status, or is permanently disabled: (1) continued payment, through the original agreed-upon service period, of any bonus, incentive, or similar benefit to which the member was entitled during service; (2) separation pay, even though the member has completed less than six years of active service before discharge; (3) transitional health care, on the same basis as an active-duty member, for 180 days after discharge; (4) transitional commissary and exchange benefits, on the same basis as an active-duty member, for two years after discharge; (5) veterans' housing loan, employment and training, and basic educational assistance; (6) federal unemployment compensation; and (7) veteran's preference for federal employment purposes. Makes this Act effective with respect to any such discharge granted after September 11, 2001.

Federal Sunset Act of 2008 - Establishes the Federal Agency Sunset Commission to: (1) submit to Congress a schedule for review by the Commission, at least once every 12 years, of the abolishment or reorganization of each agency; (2) review and evaluate the efficiency and public need for each agency using specified criteria; (3) recommend whether each agency should be abolished or reorganized; and (4) report to Congress on all legislation introduced that would establish a new agency or a new program to be carried out by an existing agency. Requires the abolishment of any agency within one year of the Commission's review, unless the agency is reauthorized by Congress. Authorizes the deadline for abolishing an agency to be extended for an additional two years by legislation enacted by a super majority of the House of Representatives and the Senate. Terminates the Commission on December 31, 2033. Directs the Comptroller General and the Director of the Congressional Budget Office, in cooperation with the Director of the Congressional Research Service, to prepare an inventory of federal programs within each agency for the purpose of advising and assisting Congress and the Commission in carrying out the requirements of this Act.

Cell Tax Fairness Act of 2008 - Prohibits states or local governments from imposing any new discriminatory tax on mobile services, mobile service providers, or mobile service property for five years after the enactment of this Act. Defines "new discriminatory tax" as a tax imposed on mobile services, providers, or property that is not generally imposed on other types of services or property, or that is generally imposed at a lower rate.

Secure Access to Firearms Enhancement (SAFE) Act of 2008 - Amends the federal criminal code to provide for reciprocity for the carrying of certain concealed firearms in different states by persons who are not prohibited by federal law from possessing, transporting, shipping, or receiving a firearm and who are: (1) carrying a valid state license or permit for carrying a concealed firearm; or (2) otherwise entitled to carry a concealed firearm in their state of residence.

Expresses support for: (1) designation of a National Autism Awareness Month; and (2) devoting new resources to researching the root causes of autism, identifying the best methods of early intervention and treatment, expanding programs for individuals with autism, and promoting understanding of their special needs. Commends parents and relatives for providing for the special needs of children with autism. Stresses the need to begin early intervention services. Recognizes: (1) the shortage of appropriately trained teachers to teach, assist, and respond to special needs students; and (2) the importance of worker training programs tailored to the needs of developmentally disabled persons.

Homeowner Empowerment Act of 2008 - Amends the Internal Revenue Code to: (1) exclude from gross income distributions from individual retirement plans and other qualified retirement plans for payments on the mortgage of a taxpayer's principal residence; (2) require repayments of amounts distributed from such retirement plans over a 12-year period; and (3) waive the 10% penalty on premature distributions from retirement plans for distributions used to pay a mortgage.

Stop M-Spam Abuse as a Sales industry Habit Act of 2008 or the SMASH Act of 2008 - Requires the Federal Trade Commission (FTC) to issue regulations to revise the Telemarketing Sales Rule to explicitly prohibit, as an abusive telemarketing act or practice, the sending of any electronic commercial message containing an unsolicited advertisement to a telephone number that is assigned to a commercial mobile service and listed on the FTC's do-not-call registry. Prohibits interpreting anything in this Act to preclude or override the applicability of specified provisions of the Communications Act of 1934 or the CAN-SPAM Act of 2003 or rules prescribed under specified provisions of the Telemarketing and Consumer Fraud and Abuse Prevention Act.

Medicaid Fraud Reduction Act of 2008 - Amends title XIX (Medicaid) of the Social Security Act (SSA), for purposes of determining or redetermining an individual's Medicaid eligibility, to direct each state to implement an asset verification program requiring Medicaid applicants or recipients to authorize the state to: (1) obtain records from a financial institution; and (2) use them to verify the individual's financial resources. Directs the Secretary of Health and Human Services to provide payments to eligible states to establish and carry out practices to reduce fraud under the state Medicaid program. Requires the Secretary to report to Congress on the feasibility of, and potential program savings from, implementing an electronic system for verifying asset transfers, particularly of real property, by Medicaid applicants or recipients. Authorizes the Secretary to require states to implement such a system if feasible and cost-effective. Requires withholding of federal matching payments to states for: (1) failure to implement an asset verification program; and (2) any expenditures other than for compensation of a state employee or payment to a state entity (for instance, expenditures for consultants). Requires states to submit to the Secretary state plan amendments for creating Internet-based transparency programs to improve public disclosure of Medicaid payments information. Amends SSA title XI to permit limitations, restrictions, and suspensions of Medicaid eligibility in cases of Medicaid-related civil or criminal fraud or abuse. Provides for an extended period of one year to recover Medicaid overpayments resulting from fraud or abuse.

English as the Official Language Act of 2008 - Requires: (1) English to be the national language of the federal government; and (2) the federal government to preserve and enhance the role of English as the national language. Provides that no person has a right, entitlement, or claim to have the federal government act, communicate, perform or provide services, or provide materials in any language other than English, unless specifically provided by statute. Makes the English language version of a government form issued in a language other than English the sole authority for legal purposes. Declares that this Act does not prohibit the use of a language other than English.

Labor Management Reporting and Disclosure Enforcement Act of 2008 - Amends the Labor-Management Reporting and Disclosure Act of 1959 (Landrum-Griffin Act) to make a labor organization liable to any of its members for a civil money penalty of up to $250 for each day that it fails to provide such member information regarding the organization's constitution, bylaws, organization report, and annual financial report, including any books, records, and accounts necessary to verify such reports. Authorizes the Secretary of Labor to bring an action in U.S. district court for injunctive relief and enforcement of administrative penalties against any person who has violated or is about to violate any reporting requirements of such Act, including those applying to a labor organization which has or assumes trusteeship over any subordinate labor organization. Requires a district court, upon a complaint by the Secretary that demonstrates failure to file timely and complete reports, to enjoin continued violation of the related reporting requirements. Authorizes the Secretary, upon finding a violation of specified reporting and disclosure requirements, to impose an administrative money penalty of up to $250 a day, or $10,000 in aggregate, adjusted for inflation, against the person, labor organization, or employer responsible for such violation.

United States Army Commemorative Coin Act of 2008 - Instructs the Secretary of the Treasury to mint and issue $5 gold coins, $1 silver coins, and half dollar clad coins as numismatic items emblematic of the traditions, history, and heritage of the U.S. Army, and its role in American society from the Colonial period to today. Requires the design for such coins to contain motifs that honor specifically the American soldier of both today and yesterday, in wartime and in peace, consistent with the traditions and heritage of the U.S. Army, the mission and goals of the National Museum of the U.S. Army, and the missions and goals of the Army Historical Foundation. Restricts coin issuance to the one-year period beginning on January 1, 2011. Requires all surcharges from coin sales to be promptly paid by the Secretary to the Foundation to help finance the National Museum of the U.S. Army.

Amends the Energy Independence and Security Act of 2007 to repeal provisions prohibiting any federal agency from entering into a contract for procurement of an alternative or synthetic fuel for any mobility-related use, other than for research or testing, unless the contract specifies that the lifecycle greenhouse gas emissions associated with the production and combustion of the fuel must be less than or equal to such emissions from the equivalent conventional fuel.

Protecting the Second Amendment and Hunting Rights on Federal Lands Act of 2008 - Prohibits any federal regulation from restricting any individual from possessing or carrying a firearm or ammunition, if such restriction is based, in whole or in part, upon the fact that the individual is in a unit of the National Park System or the Wildlife Refuge System. Sets forth provisions with regard to allowing hunting activities on federal lands. Requires an agency with jurisdiction over any federal land, when developing or considering approval of a management plan, to ensure that hunting activities are allowed as a use of such land to the extent that such use is not clearly incompatible with the purposes for which the federal land is managed.

Directs the Secretary of Transportation to solicit proposals for projects for the financing, design, construction, and operation of an initial high-speed rail system between Washington, DC, and New York City, New York (Northeast Corridor). Requires the Secretary to: (1) determine whether a proposal is feasible; and (2) establish a commission for each corridor for which one or more feasible proposals are submitted. Directs the Secretary to report to Congress on the results of an economic development study of Amtrak's Northeast Corridor service.

Condemns the government of Venezuela for its support of international terrorist groups. Directs the Secretary of State to work with the countries of the Western Hemisphere to ensure implementation of: (1) the Inter-American Convention Against Terrorism; and (2) U.N. Security Council resolutions to prevent the proliferation of nuclear, chemical, and biological weapons, and to halt the spread of global terrorism. Calls upon the government of Venezuela to renounce all support to terrorist organizations, including the Revolutionary Armed Forces of Colombia (FARC) and the Colombian National Liberation Army. Urges the U.S. government to designate Venezuela as a state sponsor of terrorism.

Entitles federal employees who satisfy age and service requirements for immediate or early retirement under the Federal Employees' Retirement System or the Foreign Service Pension System and who are separated from service or transferred to a position not subject to either of those retirement systems to a lump-sum payment for 15% of the amount of their accumulated sick leave exceeding 500 hours. Prohibits such a payment from exceeding $10,000. Excludes hours of sick leave that are creditable in the computation of any other compensation or benefit.

Stop Adolescent Smoking Without Excessive Bureaucracy Act of 2008 - Amends the Public Health Service Act to set forth conditions for the receipt by states of federal substance abuse prevention and treatment grants. Requires such states to: (1) prohibit a minor from purchasing or receiving a tobacco product or possessing a tobacco product in a public place; and (2) require law enforcement agencies to notify a minor's parent, custodian, or guardian whose name and address is reasonably ascertainable of any such violation. Requires such states to require any person engaged in the business of distributing tobacco products at retail to implement a program to: (1) notify its employees that state law prohibits the sale or distribution of tobacco products to minors and the purchase, receipt, or possession in a public place of a tobacco product by a minor; and (2) ensure compliance with such law. Directs such states to provide for a civil monetary penalty or community service for violations. Requires such states to have established goals for reducing the rate of retailer violations. Allows states to use minors to test compliance under certain conditions. Directs such states to certify expenditure of more than 10% of the funds paid to the state as part of the comprehensive settlement of November 1998 against tobacco manufacturers on health programs, tobacco control and cessation activities, or economic development for tobacco regions. Requires the Secretary of Health and Human Services to provide assistance to states in developing, enacting, and implementing such laws and in setting goals, including by developing model legislative language.

American-Made Energy Act of 2008 - Amends the Internal Revenue Code to modify and set forth provisions concerning tax credits for alternative and renewable energy, nuclear power facility construction, and an advanced coal project and deductions for energy efficient commercial buildings, qualified refinery property, and oil and gas well depletion. Establishes the American-Made Energy Trust Fund. Amends the Energy Independence and Security Act of 2007 to repeal a provision that prohibits federal agencies from procuring alternative or synthetic fuel for any mobility-related use unless its life cycle greenhouse gas emissions are less than those for fuel from conventional petroleum sources. Directs the Federal Trade Commission (FTC) to study the effects of state guaranteed profit laws and credit card processing fees on gasoline prices. Requires the Secretary of the Interior to establish a competitive oil and gas leasing program that will result in an environmentally sound program for the exploration, development, and production of the Coastal Plain's oil and gas resources. Amends the Alaska National Interest Lands Conservation Act of 1980 to repeal a provision concerning the prohibition on leasing or other development leading to the production of oil and gas from the Arctic National Wildlife Refuge. Authorizes the Secretary to designate certain Coastal Plain lands as Special Areas requiring special management and regulatory protection, including the Sadlerochit Spring area. Amends the Energy Policy and Conservation Act to set forth provisions concerning: (1) studying the maintenance of coal-to-liquid products in the Strategic Petroleum Reserve; (2) constructing specified storage facilities for the Reserve; (3) acquiring, storing, transporting, or exchanging coal-to-liquid fuel; (4) procuring biobased fuel or coal-to-liquid fuel; and (5) auctioning to the public coal-to-liquid fuel put option contracts. Amends the Clean Air Act to authorize funding for grants for cellulosic ethanol production for FY2009-FY2010. Amends the Farm Security and Rural Investment Act of 2002 to require the Secretary of Agriculture to: (1) make loan guarantees to entities to assist in paying the cost of development and construction of biorefineries and biofuel production plants to carry out projects to demonstrate the commercial viability of processes for converting biomass to fuels or chemicals; and (2) conduct a competitive research and development program to encourage new forest-to-energy technologies. Amends the Agricultural Risk Protection Act of 2000 to repeal provisions concerning biomass research and development. Authorizes persons who generate credits for renewable fuel that exceed their annual obligation for such fuel to retain such credits for the purpose of complying with obligations under the Clean Air Act with respect to advanced biofuel. Amends the Energy Policy Act of 1992 to terminate prohibitions on expenditures to conduct oil or natural gas leasing and preleasing activities for Outer Continental Shelf (OCS) areas and to revoke withdrawals of federal submerged lands from the OCS. Amends the Outer Continental Shelf Lands Act to prohibit the Secretary of the Interior from granting certain oil or natural gas leases for OCS areas that are located within a specified number of miles of the coastline of a state. Establishes the state seaward boundaries under the Outer Continental Shelf Lands Act. Authorizes the President to take steps to increase the share of electricity generated from nuclear power to 40% of the total domestic generation by 2050.

Amends part B (Supplementary Medical Insurance) of title XVIII (Medicare) of the Social Security Act, as amended by the Medicare, Medicaid, and SCHIP Extension Act of 2007, with respect to Medicare payments for physicians' services through 2009. Revises the update to the single conversion factor in the formula for determination of such payments to make it: (1) 1% for the period between July 1, 2008, and December 31, 2008; and (2) 1.8% for all of 2009.

Johnson of Texas, who were held as prisoners of war during the Vietnam conflict. Declares that the House of Representatives will continue to press for a full accounting of the 1,729 members of the Armed Forces who remain unaccounted for from that conflict. Honors all members of the Armed Forces who have fought and died in the defense of freedom.

Ronald Reagan Centennial Commission Act - Establishes the Ronald Reagan Centennial Commission to: (1) plan and carry out activities to honor Ronald Reagan on the occasion of the 100th anniversary of his birth; (2) provide assistance to federal, state, and local governmental agencies and civic groups to carry out such activities; and (3) study other federal activities to honor Ronald Reagan, including the issuance of a postal stamp, the issuance of a $1 coin for one year, and the convening of a joint session of Congress.

Condemns the ongoing Iranian-enabled rocket attacks on Israeli civilians and places responsibility for launching the attacks on Hamas and other terrorist organizations in Gaza. Supports the government of Israel's right to defend its territory. Recognizes the difficult balance Israel faces with the competing pressures of being the primary supplier of numerous necessities for Palestinian civilians, even while rockets are being fired at Israel from Palestinian areas. Supports Palestinian civilians who reject Hamas and all forms of terrorism. Reaffirms the friendship between the governments and the people of Israel and the United States.

Economic Growth Act of 2008 - Amends the Internal Revenue Code to: (1) repeal the dollar and other limitations on the expensing allowance of depreciable business assets; (2) reduce to 25% the maximum corporate income tax rate; (3) provide for an inflation adjustment to the basis of certain capital assets for purposes of determining gain or loss; and (4) reduce from 35 to 15% the alternative capital gains tax rate for corporations.

Stealth Tax Relief Extension Act of 2008 - Amends the Internal Revenue Code to: (1) increase the exemption from the alternative minimum tax for individual taxpayers in 2008; and (2) extend through 2008 the allowance of certain nonrefundable tax credits against alternative minimum tax liability.

Ultrasound Informed Consent Act - Amends the Public Health Service Act to require abortion providers, before a woman gives informed consent to any part of an abortion, to perform an obstetric ultrasound on the pregnant woman, explain the results, display the ultrasound images so the woman may view them, and provide a medical description of the ultrasound images, including the dimensions of the embryo or fetus and the presence of external members and internal organs, if present and viewable. Provides for: (1) civil penalties for willful failure to comply; and (2) a medical emergency exception. Prohibits construing this Act to require a woman to view the images or penalizing the physician or the woman if she refuses to look at the images.

Bureau of Alcohol, Tobacco, Firearms, and Explosives Reform and Firearms Modernization Act of 2007 - Amends the federal criminal code to revise the civil penalties for violations of firearms law and the procedures for assessing such penalties. Revises the definition of "willfully" for purposes of firearms violations and standards for criminal violations of firearms recordkeeping requirements. Requires the Attorney General to: (1) make preliminary determinations on firearms license applications and notify applicants in writing of a proposed denial; and (2) establish guidelines for Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) inspections, examinations, or investigations of possible firearms violations. Prohibits ATF from disclosing information on firearms purchasers other than to a court, law enforcement agency, or prosecutor. Permits an owner of a firearms business whose license is expired, surrendered, or revoked 60 days to liquidate inventory. Requires any state agency that stores or keeps explosive materials to report to the Attorney General on the location and amount of such materials. Allows the transfer and possession of machineguns for use by federal security contractors. Prohibits taxes or user fees for background checks under the Brady Handgun Violence Prevention Act. Eliminates the requirement of written permission for the use of a handgun for lawful purposes by a minor (under age 18) where a parent or legal guardian is present at all times during such use. Restricts the disclosure of information in the ATF firearms trace system database. Increases penalties for possession of firearms by felons with prior convictions of a crime of violence or a serious drug offense.

Declares that the Congress rejects and condemns as unjustified and unsupported by law the position of the Equal Employment Opportunity Commission (EEOC) that English-only employment rules violate title VII (Equal Employment Opportunity) of the Civil Rights Act of 1964. Calls on the EEOC to suspend enforcement of that position.

Santa Fe Quadricentennial Commemorative Coin Act - Instructs the Secretary of the Treasury, in commemoration of the quadricentennial of the City of Santa Fe, New Mexico, to issue $5 gold coins and $1 silver coins emblematic of the settlement of Santa Fe, New Mexico, the oldest capital city in the United States. Permits issuance of such coins only during calendar 2010. Requires the Secretary to pay 50% of surcharges received from such coin sales to: (1) the Santa Fe 400th Anniversary Committee, Inc.; and (2) the Secretary of the Interior to sustain the ongoing mission of preserving Santa Fe, including educational programs, infrastructure and archaeological research activities, and other programs to support the quadricentennial of the establishment of Santa Fe.

Prohibits the Secretary of Veterans Affairs from authorizing an honor guard to participate in the funeral of any veteran interred in a national cemetery under the control of the National Cemetery Administration unless the honor guard agrees to offer to the family of each veteran in whose funeral the honor guard chooses to participate the option of having it perform one of the 13-fold flag recitations. Expresses the sense of Congress that 13-fold flag recitations are a historical tradition and that it should be the policy of the Department of Veterans Affairs (VA) to authorize honor guards to participate in the funerals of veterans and proactively offer such a recitation to each veteran's family.

Amends title XVIII (Medicare) of the Social Security Act to repeal the limitiation on actual charges to a beneficiary under Medicare for services by a nonparticipating physician or nonparticipating supplier or other person who does not accept payment on an assignment-related basis for a physician's service. Prohibits a state from imposing a limit on the amount of charges, in relation to recognized payment amounts under any health plan or otherwise, a physician may impose for services furnished. Preempts any such limit.
