Commercial Spectrum Enhancement Act

Commercial Spectrum Enhancement Act - Amends the National Telecommunications and Information Administration Organization Act to revise provisions concerning the reallocation of spectrum from governmental to commercial users. Mandates that any Federal entity that operates a Government station assigned within a specified band of frequencies and that incurs relocation costs due to reallocation to non-Federal use receive reimbursement from the Spectrum Relocation Fund established in this Act in lieu of any other authorized Federal payment. Requires the National Telecommunications and Information Administration to notify the Federal Communications Commission (FCC) of estimated relocation costs at least six months prior to the commencement of any auction of eligible frequencies. Amends the Communications Act of 1934 to require the FCC: (1) in designing competitive bidding under such auctions, to have as an objective the recovery of 110 percent of the estimated relocation costs; (2) prescribe methods by which the total cash proceeds from any auction equals at least 110 percent of such costs; and (3) prohibit the FCC from concluding any auction under which such goal is not reached. Authorizes the FCC to grant a license for the advance use of eligible frequencies pending an auction, on the condition that the licensee cannot cause harmful interference to the Federal entity until the entity's authorization has been terminated. Establishes the Fund. Exempts the Fund from sequestration under the Balanced Budget and Emergency Deficit Control Act of 1985. Provides the basis for loans or other extensions of credit made from the Telecommunications Development Fund (established under prior law).

Uniformed Services Divorce Equity Act of 2003 - Requires a court, in the case of the disposition of monthly retired pay upon a divorce, to award the former spouse 50 percent of such pay of a member of the uniformed services if the former spouse was married to the member throughout the member's creditable service. Reduces such amount proportionately for the reduced period of the marriage in relation to the total service period. Requires that, if the marriage period is: (1) less than 240 months, such payments shall continue for a period equal to the marriage period; and (2) 240 months or more, such payments shall continue at least until the death of the member or former spouse. Provides that for purposes of such monthly payments, the disposable retired pay of a member to whom a final divorce, disillusionment, annulment, or legal separation decree is issued before the member begins to receive such pay shall be computed based on the pay grade and length of service of the member while married. Increases such amount concurrently with retired pay increases. Prohibits a court from ordering such payments before a member's retirement based upon an imputation of a property interest in future retired pay. Requires a former spouse to obtain a court order for reapportionment of disposable military retired pay within two years of the date of the final decree. Prohibits the court from treating as part of a member's disposable retired pay amounts which: (1) have been waived from such pay in order to receive veterans' disability compensation; or (2) represent payment for service-connected disabilities.

Sets forth certain limits on the reduction of duties on such products.

Directs the Secretary, acting through the Administrator of the Centers for Medicare & Medicaid Services, to establish a demonstration project to assess the efficacy of pancreatic cell islet transplantation for individuals who: (1) have Type I (juvenile) diabetes; and (2) have end-stage renal disease; and (3) are Medicare beneficiaries. Senator Paul Wellstone Mental Health Equitable Treatment Act of 2003 - Amends the Employee Retirement Income Security Act of 1974 and the Public Health Service Act to prohibit certain employee group health plans or related insurances providing both medical-surgical and mental health benefits from imposing mental health treatment limitations or financial requirements unless comparable limitations and requirements are imposed upon medical-surgical benefits. States that the foregoing shall not be construed as requiring a group health plan (or related insurances) to: (1) provide any mental health benefits; (2) prevent the medical management of mental health benefits; or (3) require the provision of specific mental health services, except to the extent that failure to provide such services would result in a disparity between the coverage of mental health and medical-surgical benefits. Exempts specified small employers from such requirements. Requires that, in the case of a group health plan that offers a participant or beneficiary two or more benefit package options, the coverage requirements shall be applied separately with respect to each such option. Provides that, in the case of a plan or insurance providing in-network mental health benefits, out-of-network mental health benefits need not be provided at parity to medical-surgical benefits, as long as in-network mental health benefits are provided at parity with medical-surgical benefits and the plan or insurance provides reasonable access to in-network providers and facilities. Requires a General Accounting Office study of such requirements' effects upon health insurance costs, access, and quality and a cost estimation of extending such requirements to the treatment of substance abuse and chemical dependency.

Defines such an action to: (1) include an action brought against a manufacturer or seller of a firearm, ammunition, or a component of a firearm that has been shipped or transported in interstate or foreign commerce, or against a trade association of such manufacturers or sellers, for damages resulting from the criminal or unlawful misuse of a firearm; and (2) exclude an action brought against persons who transfer a firearm knowing that it will be used to commit a crime of violence or a drug trafficking crime; an action brought against a seller for negligent entrustment or negligence per se; an action in which a manufacturer or seller of a firearm willfully violated a State or Federal statute applicable to the sale or marketing of the firearm and the violation was a proximate cause of the harm for which relief is sought; an action for breach of contract or warranty in connection with the purchase of the firearm; or an action for physical injuries or property damage resulting directly from a defect in design or manufacture of the firearm when used as intended.

Reasonable Right-of-Way Fees Act of 2003 - Amends the Federal Land Policy and Management Act of 1976 to direct the Secretary of the Interior to amend the Code of Federal Regulations to revise the per acre rental fee zone value schedule by State, county, and type of linear right-of-way use to reflect current land values. Directs the Secretary of Agriculture to make such revisions for linear rights-of-way granted, issued, or renewed on National Forest System lands. Directs the Secretaries to annually update the schedules of linear rights-of-way under their respective jurisdictions by a specified method using the Gross National Product Implicit Price Deflator Index. Requires the Secretaries to review the zones and rental per acre figures whenever the cumulative change in the index exceeds 30 percent, or whenever the change in the 3-year average of the 1-year Treasury interest rate used to determine per acre rental fee zone values exceeds plus or minus 50 percent. Authorizes the Secretaries to revise the base zones and rental fees if the value of Federal land differs sufficiently from the index to warrant such action. Amends the Mineral Leasing Act to direct the Secretary of the Interior or appropriate agency heads to use the same valuation method as in the Federal Land Policy and Management Act of 1976 (as revised by this Act) to calculate the value of rights-of-way for pipeline passage.

Directs: (1) the Secretary of Transportation and the Administrator of the Environmental Protection Agency (EPA) to designate as hazardous certain byproducts of the methamphetamine production process and expand penalties against laboratory operators; (2) the Administrator of the Drug Enforcement Administration to list byproducts likely to cause long-term environmental harm; (3) the Secretary of Labor, acting through the Occupational Safety and Health Administration, to provide grants to State and local law enforcement for specified training and equipment acquisition; (4) the EPA Administrator to study the impact of methamphetamine laboratory operation on the environment; and (5) the Secretary of Health and Human Services to study contamination issues. Amends: (1) the Elementary and Secondary Education Act of 1965 to authorize grants for educational programs; (2) the Public Health Service Act to authorize grants to provide treatment; (3) the Omnibus Crime Control and Safe Streets Act of 1968 to include among permissible grant projects under the "cops on the beat" program hiring personnel and purchasing equipment; and (4) the Controlled Substances Act to set penalties for promoting, for commercial purposes, an entertainment event where the promoter knows that a controlled substance will be used or distributed in violation of specified law. Urges the President to seek commitments from the Canadian Government regarding the availability of pseudoephedrine.

Public Safety Employer-Employee Cooperation Act of 2003 - Provides collective bargaining rights for public safety officers employed by States or local governments. Directs the Federal Labor Relations Authority (FLRA) to determine whether State law provides specified rights and responsibilities for public safety officers, including: (1) granting public safety employees the right to form and join a labor organization which excludes management and supervisory employees, and which is, or seeks to be, recognized as the exclusive bargaining agent for such employees; and (2) requiring public safety employers to recognize and agree to bargain with the employees' labor organization. Requires the FLRA to issue regulations establishing collective bargaining procedures for public safety employers and employees in States that do not substantially provide for such public safety employee rights and responsibilities. Directs the FLRA, in such cases, to: (1) determine the appropriateness of units for labor organization representation; (2) supervise or conduct elections to determine whether a labor organization has been selected as an exclusive representative by a majority of the employees in an appropriate unit; (3) resolve issues relating to the duty to bargain in good faith; (4) conduct hearings and resolve complaints of unfair labor practices; and (5) resolve exceptions to arbitrator's awards. Grants a public safety employer, employee, or labor organization the right to seek enforcement of such FLRA regulations and authority through appropriate State courts. Prohibits public safety employers, employees, and labor organizations from engaging in lockouts or strikes. Provides that existing collective bargaining units and agreements shall not be invalidated by this Act.

Adjusts similarly percentage amounts with respect to survivors of reserve personnel and survivors of persons who die while on active duty. Provides a corresponding phased elimination of the SBP supplemental annuity authorized to be provided to such surviving spouses. Requires periodic recomputation of: (1) annuity amounts beginning in October 2004; and (2) retired pay reductions for supplemental survivor annuities. Provides a one-year open enrollment period for SBP participation, commencing October 1, 2004, for those currently not participating, those electing to increase current coverage, and those wishing to participate in the supplemental SBP. Authorizes the Secretary of Defense to require appropriate premiums for SBP participation.

Fair Care for the Uninsured Act of 2003 - Amends the Internal Revenue Code to allow an individual a tax credit in an amount equal to the amount paid for qualified health insurance, subject to stated limitations. Directs the Secretary of the Treasury to make payments to the provider of an individual's qualified health insurance equal to such individual's qualified health insurance credit advance amount (the Secretary's estimate of the amount of credit allowable) with respect to such provider. Requires each health insurer, health maintenance organization, and health service organization to participate in a health insurance safety net which shall assure the availability of health insurance to uninsurable individuals. Funds such safety nets through assessments against such insurers and organizations. Permits such insurers and organizations to add the costs of such assessments to the costs of its insurance or coverage. Amends the Public Health Service Act to allow health benefits coverage through individual membership associations (IMAs). Sets forth IMA requirements, including that the IMA be an organization operated under the direction of an association and that IMA health benefits coverage only be provided through contracts with health insurance issuers. Requires IMAs to include a minimum of two health insurance coverage options.

Subjects the trust lands to the Pueblo Lands Act of 1924. Requires trust lands to be used only for traditional or customary uses or stewardship conservation. Prohibits this Act from being construed to constitute the reservation of water or water rights in the trust lands or any change in status of water rights of either Pueblo.

Galisteo Basin Archaeological Sites Protection Act - Designates specified archaeological sites in New Mexico as the Galisteo Basin Archaeological Protection Sites. Requires the Secretary of the Interior to: (1) continue to search for additional Native American and Spanish colonial sites in the Galisteo Basin area; and (2) submit to the Congress recommendations for additions to, deletions from, and modifications of the boundaries of such sites. Requires the Secretary to submit to specified congressional committees a general management plan for the identification, research, protection, and public interpretation of the archaeological protection sites located on Federal lands, and those sites located on private and State lands for which the Secretary has entered into discretionary Cooperative Agreements with their owners for the protection, preservation, maintenance, and administration of their archaeological resources and associated lands. Authorizes the Secretary to acquire lands and interests within the boundaries of the archaeological protection sites, and access to them, by donation, purchase with donated or appropriated funds, or by exchange. Limits to donation or exchange the Secretary's acquisition authority for lands or interests owned by the State of New Mexico or a local government, except that State trust land may be acquired only by exchange. Withdraws all Federal lands within the sites, subject to valid existing rights, from: (1) all forms of entry, appropriation, or disposal under the public land laws; (2) location, entry, and patent under the mining laws; and (3) disposition under all laws relating to mineral and geothermal leasing. States that this Act shall not: (1) authorize regulation of privately owned lands within an archaeological protection site; or (2) restrict or limit an Indian tribe from protecting cultural or religious sites on tribal land.

Directs the Coordinator to: (1) notify and consult with the Federal Bureau of Investigation concerning each child abduction for which an AMBER Alert is issued; and (2) establish minimum standards for the issuance of alerts and for the extent of their dissemination (limited to the geographic areas most likely to facilitate the recovery of the abducted child). Requires the Secretary of Transportation to provide grants to States for the development or enhancement of notification or communications systems along highways for alerts and other information for the recovery of abducted children. Includes among permissible activities the development or enhancement of electronic message boards, and the placement of additional signage, along highways. Directs the Attorney General to provide grants to States for the development or enhancement of programs and activities for the support of AMBER Alert communications plans.

Prisoner of War Benefits Act of 2003 - Amends Federal veterans' benefits provisions with respect to former prisoners of war to repeal the currently required: (1) 30-day minimum period of internment prior to the presumption of service connection for certain listed diseases, for purposes of the payment of veterans' disability compensation; and (2) 90-day minimum period of internment prior to eligibility for dental care furnished through the Department of Veterans Affairs. Adds the following to the listed diseases under (1), above: heart disease, stroke, liver disease, diabetes (type 2), and osteoporosis. Requires: (1) such presumption also with respect to any disease that the Secretary of Veterans Affairs determines warrants such presumption by reason of having a positive association with the experience of being a prisoner of war; and (2) the Secretary to make such a determination within 60 days after a recommendation from the Advisory Committee on Former Prisoners of War that such presumption be established for a non-listed disease.

Price-Anderson Amendments Act of 2003 - Amends the Atomic Energy Act of 1954 to extend from August 1, 2002 to August 1, 2017 the indemnification authority of the Nuclear Regulatory Commission (NRC) and the Secretary of Energy (Secretary) with respect to certain licensees, Department of Energy (DOE) contractors, and nonprofit educational institutions, respectively. Increases the maximum amount of standard deferred premium that may be assessed a licensee following a nuclear incident. Specifies $10 billion as the aggregate amount by which the Secretary must indemnify DOE contractors above the amount of the financial protection required for each nuclear incident. Increases from $100 million to $500 million the indemnification limits for incidents outside the United States. Mandates an indemnification inflation adjustment at least once every five years. Instructs the NRC to consider a combination of modular reactors at a single site. Repeals the requirement that the Secretary determine by rule whether nonprofit educational institutions should receive automatic remissions of civil monetary penalties for violations of DOE regulations. Limits the civil liability incurred by not-for-profit contractors, subcontractors, and suppliers to the total amount of fees paid within any one-year period under the contract to which the violation occurs.
