Public Safety Officers' Benefits Improvement Act of 2016 This bill amends the Omnibus Crime Control and Safe Streets Act of 1968 to revise administrative requirements for the Public Safety Officers' Benefits (PSOB) program. Specifically, it authorizes the Department of Justice's Bureau of Justice Assistance (BJA) to establish PSOB program rules, regulations, and procedures based on standards developed by another federal agency. In determining eligibility for death or disability benefits, the BJA must give substantial weight to evidence and facts presented by a state, local, or federal agency. Additionally, the BJA must publish and update information on pending claims and report to Congress on submitted claims for death, disability, and educational benefits.

Protecting Patient Access to Emergency Medications Act of 2016 This bill amends the Controlled Substances Act to direct the Drug Enforcement Administration (DEA) to register an emergency medical services (EMS) agency as an entity authorized to dispense controlled substances, instead of registering the individual practitioners or medical directors of the agency. A registered EMS agency must be overseen by one or more medical directors. The bill specifies that an EMS practitioner who is employed by a registered EMS agency may administer controlled substances under a standing order issued by a medical director. The standing order does not have to be specific to an individual patient. An EMS agency must keep the standing order on file and make it available to the DEA upon request.

Care Veterans Deserve Act of 2016

Care Veterans Deserve Act of 2016 This bill amends the Veterans Access, Choice, and Accountability Act of 2014 to make the Veterans Choice Program permanent. Program eligibility is expanded to include all veterans who are enrolled in the annual patient enrollment system under the Department of Veterans Affairs (VA) hospital care and medical services program. The VA shall provide information about the availability of Program care and services to veterans who are new to, or already enrolled, in the system. The VA shall contract with a national chain of walk-in clinics to provide hospital care and medical services in such clinics to veterans who are in the annual patient enrollment system. A veteran shall not be required to: (1) obtain pre-authorization for such care, or (2) pay a copayment to the clinic or to the VA. Such national chain shall establish an automated system to provide the VA with weekly information on veterans receiving hospital care or medical services. A covered health care professional may practice his or her health care profession at any location in any state, regardless of where such health care professional or the patient is located, if the health care professional is using telemedicine to treat an individual. Such treatment is permitted regardless of whether the professional or patient is located in a federally-owned facility. "Covered health care professional" means a health care professional who is: (1) authorized by the VA to provide health care, including a private health care professional who provides such care under a VA contract or agreement; and (2) licensed, registered, or certified in a state to practice his or her health care profession. The VA shall: extend the operating hours for each VA pharmacy to include weekday evenings until 8:00 p.m., weekends, and federal holidays; and contract with qualifying physicians and nurses to work at VA medical facilities during nights and weekends. The VA may: (1) hire support staff in connection with such extended operating hours, and (2) provide for a nongovernmental hospital organization best-practices peer review of each VA medical center.

Christa McAuliffe Commemorative Coin Act of 2016 This bill directs the Department of the Treasury to mint and issue not more than 350,000 $1 silver coins in commemoration of Christa McAuliffe. The design of the coins shall bear an image of and the name of Christa McAuliffe on the obverse side and a design on the reverse side that depicts the legacy of McAuliffe as a teacher. Treasury may issue the coins from January 1-December 31, 2018. All surcharges received by Treasury from the sale of the coins shall be paid to the FIRST robotics program for the purpose of engaging and inspiring young people, through mentor-based programs, to become leaders in the fields of science, technology, engineering, and mathematics.

Boost Saving for College Act This bill amends the Internal Revenue Code to modify the tax treatment of qualified tuition programs (known as 529 plans). The bill allows: (1) a nonrefundable tax credit for contributions of an individual to a 529 plan, and (2) an exclusion from the gross income of an employee of up to $1000 per year of employer contributions to a 529 plan. The bill also permits savings from a 529 plan to be rolled over tax-free into: (1) a Roth Individual Retirement Account of the owner or the beneficiary of a 529 plan that has been maintained for 10 years, and (2) an ABLE account of the designated beneficiary of the 529 plan. (Tax-favored ABLE [Achieving a Better Life Experience] accounts are designed to enable individuals with disabilities to save for and pay for disability-related expenses.)

Microloan Program Modernization Act of 2016 This bill amends the Small Business Act to repeal the "25/75" rule under the Small Business Administration (SBA) Microloan Program (assisting low-income individuals to start and operate a small business) that permits SBA-designated microloan intermediary lenders to expend up to 25% of the intensive marketing, management, and technical assistance grant funds they receive from the SBA to provide information and technical assistance to small business concerns that are their prospective borrowers. The total amount of loans outstanding and committed to any particular intermediary (excluding outstanding grants) from the SBA business loan and investment fund shall be increased from $5 million to $6 million for the remaining years of the intermediary's participation in the program. The SBA shall: compare the operations of a representative sample of eligible intermediaries that participate in the microloan program and of eligible intermediaries that do not, study the reasons why the latter do not participate, recommend how to encourage increased participation by intermediaries in the microloan program, and recommend how to decrease the associated costs for intermediary participation. The Government Accountability Office shall evaluate: SBA oversight of the microloan program, including oversight of participating intermediaries; and the specific processes the SBA uses to ensure program compliance by participating intermediaries and overall microloan program performance.

Annual reports to Congress on the SBIR and STTR programs shall include information regarding awards under the Rapid Innovation Program under the Ike Skelton National Defense Authorization Act for Fiscal Year 2011. An SBIR or STTR award may cover the indirect cost of seeking protection for intellectual property created through work performed under it. The Government Accountability Office shall audit annually federal government compliance with SBIR and STTR goals and incentives. Federal agencies and prime contractors shall issue Phase III awards relating to technology, including sole source awards, to the SBIR and STTR award recipients that developed the technology. The SBA shall establish a Regional SBIR State Collaborative Initiative Pilot Program. The bill reauthorizes the Federal and State Technology (FAST) Partnership Program through FY2021. The bill establishes an SBIR and STTR Interagency Policy Committee to: determine how to collect data on achievements by small business concerns in each phase of the programs; and establish a uniform baseline for metrics that support improving the solicitation, contracting, funding, and execution of program management.

The bill also amends the Higher Education Act of 1965 to require the Department of Education (ED) to discharge the liability on loans that parents received on behalf of a student who: (1) has become permanently and totally disabled, or (2) is unable to engage in any substantial gainful activity due to a physical or mental impairment that can be expected to result in death or has lasted or is expected to last continuously for at least 60 months. (Under current law, ED is required to discharge the loans to parents if the student dies.)

Rural Access to Hospice Act of 2016 This bill amends title XVIII (Medicare) of the Social Security Act to allow payment under Medicare for certain services furnished to hospice patients by rural health clinics and federally qualified health centers (FQHCs). With respect to a patient who elects to receive hospice care under Medicare, current law generally limits payment for services that are either duplicative of such care or related to the treatment of the individual's terminal illness. However, current law exempts from this limitation: (1) physicians' services furnished by the individual's attending physician, if not an employee of the hospice program; and (2) services provided or arranged by the hospice program. The bill expands this exemption with regard to rural health clinic and FQHC services. Specifically, the Medicare payment limitation shall not apply to such services that: (1) would otherwise be physicians' services if furnished by an individual unaffiliated with a rural health clinic or FQHC; and (2) are either arranged by the hospice program or furnished by the individual's attending physician, if not an employee of the hospice program.

Manufacturing Extension Partnership Improvement Act of 2016 This bill amends the National Institute of Standards and Technology Act to direct the Department of Commerce, through the National Institute of Standards and Technology (NIST), to convert the current program for creation and support of regional centers for the transfer of manufacturing technology into one for creation and support of manufacturing extension centers for the transfer of manufacturing technology and best business practices, to be known as the Hollings Manufacturing Extension (HME) Partnership, and reauthorized for FY2017-FY2020. Each Hollings Manufacturing Extension Center may be affiliated with an institution of higher education or a state or local government, as well as with a U.S.-based nonprofit institution (or consortium of such institutions) as under current law. Authorized Center activities that currently include selective, short-term loans of advanced manufacturing equipment to small manufacturing firms shall be replaced by facilitation of collaborations and partnerships between small and medium-sized manufacturing companies and community colleges and area career and technical education schools. The bill repeals the current six-year limit on federal financial assistance to a Center, allowing open-ended assistance through a cooperative agreement. Commerce shall appoint a panel to review and evaluate each Center receiving financial assistance during its third and eighth years of operation, but the Department shall review a Center directly during its fifth year of operation. Each Center shall establish a board to oversee its operations. The bill establishes a Manufacturing Extension Partnership Advisory Board. The NIST shall establish within the HME Partnership: a program of competitive awards for a participating Center, or a consortium of Centers, to develop projects to solve new or emerging manufacturing problems; and an innovation services initiative to assist small and medium-sized manufacturers in improving profitability through the reduction of energy use, greenhouse gas emissions, and environmental waste.

GAP Act

Gender Advancement in Pay Act or the GAP Act This bill amends the Fair Labor Standards Act of 1938 to expand exceptions to the prohibition against sex discrimination to include payments pursuant to a differential based on expertise, shift, or a business-related factor other than sex, including but not limited to education, training, or experience. The statute of limitations under the Portal-to-Portal Act of 1947 for a charge of prohibited sex discrimination, or an action by or on behalf of an employee for such discrimination, shall be tolled until the earlier of: (1) the date on which the Equal Employment Commission or the Department of Justice brings an action or notifies the employee concerned with respect to the charge under the Civil Rights Act of 1964, or (2) 270 days after the charge is filed. Nonretaliation prohibitions are extended to cover inquiring about, discussing, or disclosing the wages of an employee or of another employee, or declining to discuss or disclose the employee's wages, with specified exceptions. An employer shall be considered to have committed an unlawful act if the employer requires an employee to sign a contract or waiver that would prohibit the employee from disclosing information about the employee's wages. Civil penalties are established for violation of prohibitions against sex discrimination. The Department of Labor, together with the Department of Education, shall conduct a multistate study, through a grant to a nonprofit research institution, that includes strategies to increase the participation of women in high-wage, high-demand occupations and industries in which women are underrepresented. The Government Accountability Office shall also conduct a multistate study to develop such strategies.

Kelsey Smith Act This bill amends the Communications Act of 1934 to require a mobile or Internet voice service provider to disclose, at the request of an investigative or law enforcement officer, the call location information of a device that is: (1) used to place a 911 call, or (2) reasonably believed to be in the possession of an individual who is in an emergency situation that involves a risk of death or serious physical harm. Additionally, the bill prohibits a civil action or administrative proceeding against a telecommunications carrier who discloses call location information in good faith in accordance with this bill.

Promoting Responsible Opioid Prescribing Act of 2016 or the PROP Act of 2016 This bill amends title XVIII (Medicare) of the Social Security Act to exclude certain pain-related measures for purposes of calculating incentive payments under the value-based purchasing program (VBP). (VBP is a program that links hospital payments to the quality of care provided.) Preventing Iran's Access to United States Dollars Act of 2016 This bill prohibits the President from issuing a license that permits a person to: conduct an offshore U.S. dollar clearing system for transactions involving the government of Iran or an Iranian person, or provide U.S. dollars for any offshore U.S. dollar clearing system conducted by a foreign government or a foreign financial institution for transactions involving the government of Iran or an Iranian person. The Department of the Treasury shall report to Congress: a list of financial institutions operating or participating in an offshore U.S. dollar clearing system that conducts transactions involving the government of Iran or an Iranian person, and an assessment of Treasury efforts to prevent such transactions. The President shall block and prohibit all transactions in property and property interests of any listed institution if the property and interests: (1) are in the United States, (2) come within the United States, or (3) are or come within the possession or control of a U.S. person. The President may impose additional sanctions pursuant to the International Emergency Economic Powers Act. The National Defense Authorization Act for Fiscal Year 2012 is amended to subject to sanctions: (1) u-turn transactions (fund transfers from a foreign bank that pass through a U.S. financial institution and are then transferred to a second foreign bank), and (2) book transfers (fund transfers for the benefit of an Iranian financial institution made between accounts of the same financial institution).

Advancing NIH Strategic Planning and Representation in Medical Research Act This bill amends the Public Health Service Act to require the National Institutes of Health (NIH) to: publish a strategic plan that addresses research, training, the biomedical workforce, and collaboration with other agencies; foster collaboration among certain clinical research projects to increase the number and diversity of human subjects; encourage improvement in research related to the health of sexual and gender minority populations; convene a working group to make recommendations to enhance the rigor and reproducibility of NIH-funded research; and develop policies for NIH-funded basic research projects to assess how differences between male and female cells, tissues, or animals may be examined and analyzed. In assessing research priorities, the NIH must publish data on clinical research study populations. The strategic plans of the national research institutes must ensure that future activities take into account women and minorities and are focused on reducing health disparities. Advisory council reports must include certain demographic data for clinical research subjects. The results of clinical trials that include women and minorities must be submitted to the NIH’s clinical trial data bank. The National Institute on Minority Health and Health Disparities may foster partnerships between national research institutes and encourage the funding of collaborative research projects. The Department of Health and Human Services must establish the Task Force on Research Specific to Pregnant Women and Lactating Women to report on issues including development of safe and effective therapies for such women.

The bill requires that DOD Joint Travel Regulations be modified to require that: (1) the reduced flat rate per diem for long-term temporary duty not be imposed on civilian employees of naval shipyards traveling on such duty for direct labor in support of off-yard work, and (2) those employees be paid the full per diem rate for such travel.

Palliative Care and Hospice Education and Training Act This bill amends the Public Health Service Act to require the Department of Health and Human Services (HHS) to award grants or contracts for Palliative Care and Hospice Education Centers. These Centers must improve the training of health professionals in palliative care and establish traineeships for individuals preparing for advanced education nursing degrees, social work degrees, or advanced degrees in physician assistant studies in palliative care. HHS may make grants to, and enter into contracts with, schools of medicine, schools of osteopathic medicine, teaching hospitals, and graduate medical education programs to support the training of physicians who plan to teach palliative medicine. HHS must: (1) provide Palliative Medicine and Hospice Academic Career Awards to individuals to promote their career development; (2) award grants or contracts to entities that operate a Palliative Care and Hospice Education Center; (3) award incentive grants or contracts to advanced practice nurses, social workers, physician assistants, pharmacists, chaplains, or students of psychology pursuing an advanced degree in palliative care or related fields; and (4) award grants to schools of nursing, health care facilities, or programs leading to certification as a nurse assistant to train individuals in providing palliative care. The Agency for Healthcare Research and Quality must provide for a national education and awareness campaign to inform patients, families, and health professionals about the benefits of palliative care. The National Institutes of Health must expand national research programs in palliative care.

Detaining Terrorists to Protect Americans Act of 2016 This bill prohibits the use of funds to transfer, release, or assist in the transfer or release to or within the United States, its territories, or possessions of Khalid Sheikh Mohammed or any other detainee who: (1) is not a U.S. citizen or a member of the Armed Forces; and (2) is or was held by the Department of Defense (DOD) on or after January 20, 2009, at Naval Station Guantanamo Bay, Cuba. No funds may be used: to construct or modify any facility in the United States, its territories, or possessions to house any individual detained at Guantanamo under DOD custody or control unless expressly authorized by Congress; or through FY2017 to transfer, release, or assist in the transfer or release of an individual detained at Guantanamo to any foreign country or foreign entity unless expressly authorized by Congress. "Individual detained at Guantanamo" means any individual located at Guantanamo as of October 1, 2009, who: (1) is not a U.S. citizen or a member of the Armed Forces; and (2) is under DOD custody or control, or otherwise under detention at Guantanamo. No funds may be used to: (1) close or abandon Guantanamo, (2) relinquish control of Guantanamo to Cuba, or (3) implement a material modification to the Treaty Between the United States of America and Cuba that constructively closes Guantanamo.

Protecting Workplace Advancement and Opportunity Act This bill declares that the proposed or the final rule of the Department of Labor entitled "Defining and Delimiting the Exemptions for Executive, Administrative, Professional, Outside Sales and Computer Employees" shall cease to have any force or effect. The rule revises the "white collar" exemption of executive, administrative, professional, outside sales, and computer employees from minimum wage and maximum hour, or overtime, requirements of the Fair Labor Standards Act of 1938 (FLSA). If the proposed rule is a final rule on the date of enactment of this bill: Labor shall not enforce it based on conduct occurring before that enactment date, an employee shall not have any right of action against an employer for the employer's failure to comply with the final rule at any time before that enactment date, any regulations that were amended by the final rule shall be restored and revived as if the final rule had never taken effect, and nothing in this bill shall be construed to create a right of action for an employer against an employee for the recoupment of any payments made to the employee before the enactment of this bill that were in compliance with that final rule. Labor may promulgate any substantially similar rule only if it has completed certain required actions; but the rule shall not contain any automatic updates to the salary threshold for purposes of exemptions to minimum wage and maximum hour requirements under the FLSA. The requirement that definitions applicable for such exemptions be defined and delimited from time to time by Labor regulations shall be construed to: require Labor to issue a new rule through notice and comment rulemaking for each change in any salary threshold it has proposed; and exclude any rule that would result in changes to any salary threshold for multiple time periods, including through any automatic updating procedure. Labor may not promulgate any final rule that includes any revision to duties tests for exemption from minimum wage and maximum hours requirements unless specific regulatory text for the provision was proposed in the proposed rule.

Iran Terrorism and Human Rights Sanctions Act of 2016 This bill prescribes requirements for mandatory sanctions with respect to: Iran's Revolutionary Guard Corps (IRGC) and entities it owns in whole or in part, Mahan Air, Iran's support of terrorism, Iran's human rights abuses, certain Iranian individuals, persons who conduct transactions with or on behalf of certain Iranian individuals, and financial institutions that engage in certain transactions on behalf of persons involved in human rights abuses or that export sensitive technology to Iran. The Department of the Treasury shall establish and publish in the Federal Register an IRGC watch list. The bill prescribes prohibitions against Iran's direct and indirect access to the U.S. financial system. The Iran Threat Reduction and Syria Human Rights Act of 2012 is amended to authorize a state or local government to divest its assets from, or prohibit investment in, any person that engages in investment or business activities with the IRGC or a person on the Treasury's list of designated nationals and blocked persons. The bill specifies additional requirements for removal of a person's designation as a state sponsor of terrorism. The Department of State may assist individuals and entities working in Iran for the purpose of supporting and promoting the rule of law, civil society, and economic opportunity. The President shall: (1) designate within the State Department a Special Coordinator on Human Rights and Democracy in Iran; and (2) report to Congress on U.S. citizens, including dual citizens, detained by Iran or Iranian-supported groups. Radio Free Europe/Radio Liberty and Voice of America shall increase programming to Iran.

Iran Ballistic Missile Sanctions Act of 2016 This bill amends the Iran-Iraq Arms Non-Proliferation Act of 1992 to cover ballistic missile or related technology. The Iran Sanctions Act of 1996 is amended to: (1) extend the Act through December 31, 2031, and (2) require sanctions on Iran and related entities and persons for actions to acquire or develop ballistic missiles and launch technology. The Iran Threat Reduction and Syria Human Rights Act of 2012 is amended to direct the President to report to Congress biannually on: (1) identified persons that have knowingly aided Iran in developing its ballistic missile program, and (2) Iran-North Korea ballistic missile cooperation. The President shall block and prohibit all transactions in property and property interests in the United States of any identified person. An identified person, with certain exceptions, shall be excluded from U.S. entry. The President shall prohibit the opening and prohibit or impose strict conditions on the maintaining in the United States of a correspondent account or a payable-through account by a foreign financial institution that knowingly conducts or facilitates a significant financial transaction for an identified person. The President shall block and prohibit all transactions in property and property interests in the United States of: any entity owned in part by the Aerospace Industries Organization, the Shahid Hemmat Industrial Group, or the Shahid Bakeri Industrial Group, or collectively by a group of individual investors in such groups; or any person that controls or is a board member of such an entity. The Department of the Treasury shall submit to Congress a list of entities (and their officers) in which the Aerospace Industries Organization, the Shahid Hemmat Industrial Group, the Shahid Bakeri Industrial Group, or any agent or affiliate has a specified minimum ownership interest. The President shall: certify to Congress biannually that each person listed in an annex of certain United Nations Security Council Resolutions is not involved with the development of or transfer to Iran of ballistic missiles, related technology, or components; but issue sanctions on any persons involved in those activities and prohibit associated financial transactions in the United States. The President shall report to Congress: (1) biannually a list of sectors of the Iranian economy involved with the development of or transfer to Iran of ballistic missiles or technology; and (2) annually a list of all foreign persons involved with the development of ballistic missiles, technology, or components in those sectors, namely: automotive, chemical, computer science, construction, electronic, energy, metallurgy, mining, petrochemical, research (including universities and research institutions), and telecommunications. The Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010 is amended to cover the acquisition or development of ballistic missiles, capabilities, and launch technology. The Securities Exchange Act of 1934 is amended to require each issuer of securities to disclose to the Securities and Exchange Commission whether it knowingly engaged in any activity involving sectors of Iran that support its ballistic missile program for which sanctions may be imposed.

Modernizing the Pittman-Robertson Fund for Tomorrow's Needs Act of 2016 This bill amends the Pittman-Robertson Wildlife Restoration Act to make it one of the purposes of the Act to extend financial and technical assistance to the states for the promotion of hunting and recreational shooting. The bill also prescribes a formula for the allocation of funds apportioned to a state that may be used for any activity or project to recruit or retain hunters and recreational shooters. Amounts apportioned to the states from any taxes on pistols, revolvers, bows, and arrows may be used for hunter recruitment and recreational shooter recruitment. The funds apportioned to a state for wildlife restoration management may be used for related public relations. If a state has not used all of the tax revenues apportioned to it for firearm and bow hunter education and safety program grants, it may use its remaining apportioned funds for the enhancement of hunter recruitment and recreational shooter recruitment. Up to $5 million of the revenues covered into wildlife restoration fund in the Treasury from any tax imposed for a fiscal year on the sale of certain bows, arrows, and archery equipment shall be available to the Department of the Interior exclusively for making hunter recruitment and recreational shooter recruitment grants that promote a national hunting and shooting sport recruitment program, including related communication and outreach activities.

Mental Health Reform Act of 2016

Mental Health Reform Act of 2016 This bill amends the Public Health Service Act to revise Substance Abuse and Mental Health Services Administration (SAMHSA) authorities, duties, centers, reports, and strategic planning. The bill creates the position of Chief Medical Officer within SAMHSA. The Department of Health and Human Services (HHS) must establish the Interdepartmental Serious Mental Illness Coordinating Committee. SAMHSA's Office of Policy, Planning, and Innovation is replaced by the National Mental Health and Substance Use Policy Laboratory. SAMHSA may provide support for: (1) the development of interventions for mental illness, serious emotional disturbances, and substance use disorders; and (2) integration of primary care and behavioral health care. The bill revises and extends through FY2021 SAMHSA support for various services and programs, including: (1) mental health and substance abuse services for homeless individuals, (2) mental and behavioral health education and training grants, and (3) substance use disorder treatment services for children and pregnant and postpartum women. The bill revises and extends block grants for community mental health services and transition from homelessness. SAMHSA must maintain the National Suicide Prevention Lifeline program and National Treatment Referral Routing Service. HHS must ensure health care providers, patients, and others have access to resources regarding the protected health information of patients seeking or undergoing mental or substance use disorder treatment. HHS, the Department of Labor, and the Department of the Treasury must take specified actions regarding requirements for health insurance to provide parity between mental health and substance use disorder benefits and medical and surgical benefits.
