Title VIII Nursing Workforce Reauthorization Act of 2019 This bill modifies and reauthorizes through FY2024 grant programs that fund nursing workforce development and retention. Such grants must generally be used to develop high-quality nursing services in areas that have, or are projected to have, a nursing shortage. The bill also reauthorizes grant programs for nursing education, loan repayment, and geriatric care training. The bill further requires the Government Accountability Office to evaluate and report on the nursing education loan repayment program, including (1) the methods of payment, (2) existing and recommended oversight functions, (3) the number of nurses participating in the program, and (4) the type of facility at which participants are serving.

Child Care Protection Improvement Act of 2019 This bill establishes an interagency task force, chaired by the Administration for Children and Families, to support states in conducting required criminal background checks for childcare staff members. Specifically, the task force must consult with relevant state agencies and develop recommendations and best practices. This includes evaluating how agencies are responding to interstate requests for information about staff, or prospective staff, who have lived in another state within the preceding five years. The task force must submit a final report with its recommendations within one year of the first meeting of the task force.

Pandemic and All-Hazards Preparedness and Advancing Innovation Act of 2019 This bill reauthorizes, revises, and establishes several programs and entities relating to public-health emergency preparedness and response. Among other programs, the bill reauthorizes through FY2023 and revises the Public Health Emergency Preparedness cooperative-agreement program administered by the Centers for Disease Control and Prevention (CDC), the Hospital Preparedness Program administered by the Office of the Assistant Secretary for Preparedness and Response, the CDC situational-awareness and biosurveillance program, the Emergency System for Advance Registration of Volunteer Health Professionals, the National Disaster Medical System, the Volunteer Medical Reserve Corps, the National Advisory Committee on Children and Disasters, the Strategic National Stockpile, and the Biomedical Advanced Research and Development Authority. In addition, the bill provides statutory authority for several existing programs, including the Children's Preparedness Unit within the CDC and the Public Health Emergency Medical Countermeasures Enterprise. The bill also establishes new programs and entities, including a trauma-center grant program to support military trauma teams. Finally, the bill institutes a series of reporting requirements for the Department of Health and Human Services (HHS), including a report regarding efforts to reunify children in HHS facilities with their parents after separation at the U.S.-Mexico border under a specified immigration enforcement policy.

Gold Star Family Tax Relief Act This bill treats certain military survivor benefits that are received by children as earned income of the child for the purposes of the kiddie tax (the tax on the unearned income of children). This has the effect of exempting the benefits from such tax.

PFAS Accountability Act of 2019 This bill addresses the remediation of water or land that is contaminated from certain perfluoroalkyl or polyfluoroalkyl substances (PFAS) originating from federal facilities or sites, including the Department of Defense's sites or facilities. PFAS are man-made and may have adverse human health effects. A variety of products contain PFAS, such as nonstick cookware or weatherproof clothing. Upon state request, federal departments or agencies must expedite cooperative agreements with states to address the contamination—or suspected contamination—of drinking water, surface water, groundwater, land surface, or subsurface strata (e.g., rock or soil). The cooperative agreements must meet or exceed the most stringent of the standards enumerated in the bill. If cooperative agreements are not finalized a year after requests are made by states, then the President must provide to Congress reports that include (1) explanations of why cooperative agreements have not been finalized or amended, and (2) projected timelines for finalizing the agreements.

Lumbee Recognition Act This bill extends federal recognition to the Lumbee Tribe of North Carolina and makes its members eligible for the services and benefits provided to members of federally recognized tribes. Members of the tribe residing in Robeson, Cumberland, Hoke, and Scotland counties in North Carolina are deemed to be within the delivery area for such services. The Department of Health and Human Services must develop, in consultation with the tribe, a determination of needs to provide the services for which members of the tribe are eligible. The Department of the Interior may take land into trust for the benefit of the tribe. Gaming is allowed on such land taken into trust for the tribe. North Carolina must exercise jurisdiction over all criminal offenses committed, and all civil actions that arise, on North Carolina lands owned by, or held in trust for, the Lumbee Tribe or any dependent Indian community of the tribe unless jurisdiction is transferred to the United States pursuant to an agreement between the tribe and the state.

National Law Enforcement Museum Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue up to 50,000 $5 gold coins, 400,000 $1 silver coins, and 750,000 half-dollar clad coins that are emblematic of the National Law Enforcement Museum in the District of Columbia and of the service and sacrifice of law enforcement officers throughout the history of the United States. All sales of such coins shall include specified surcharges, which shall be distributed to the National Law Enforcement Officers Memorial Fund, Inc., for educational and outreach programs and exhibits.

Patient Access to Cellular Transplant Act or the PACT Act This bill specifies that payment under Medicare to a hospital for the acquisition costs of an allogeneic hematopoietic stem cell transplant (e.g., bone marrow transplant from a donor) must be made on a reasonable cost basis (similar to the current payment methodology for solid organ acquisitions). The Centers for Medicare & Medicaid Services must determine included items through regulations.

Women's Suffrage Centennial Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue up to 400,000 $1 silver coins that are emblematic of the women who played a vital role in rallying support for the 19th Amendment to the U.S. Constitution. Such coins may be issued during the period beginning on January 1, 2020, and ending on December 31, 2020. All surcharges received from the sales of such coins shall be paid to the American Women's History Initiative of the Smithsonian Institution.

Stop for School Buses Act of 2019 This bill addresses safety measures and programs to prevent the illegal passing of school buses. Specifically, the Department of Transportation must conduct a review of existing state laws and programs regarding the illegal passing of school buses; establish and implement a nationwide public safety campaign to highlight the importance of illegally passing school buses; review and evaluate the effectiveness of various technologies to enhance school bus safety; review driver education materials in states to determine how the illegal passing of school buses is addressed; and research and prepare a report on the connections between the illegal passing of school buses and other safety issues.

Stop Student Debt Relief Scams Act of 2019 This bill establishes criminal penalties for unauthorized access of certain student loan information and expands the requirements for student loan exit counseling. Specifically, the bill makes it a crime to knowingly use an access device (e.g., account number) that was issued to another person or was fraudulently obtained to access Department of Education (ED) information technology systems for commercial advantage or private financial gain. A violator is subject to criminal penalties—a fine, a prison term of up to five years, or both. Further, the bill expands loan exit counseling requirements to require an institution of higher education that participates in federal student-aid programs to provide an explanation to borrowers cautioning them about third-party student debt relief companies. It also requires ED to prevent unauthorized access to the central database for student aid (i.e., the National Student Loan Data System) and warn borrowers of suspicious activity regarding their student loan accounts.

Poison Center Network Enhancement Act of 2019 This bill modifies and reauthorizes through FY2024 the national poison center network program. Specifically, the bill allows the use of other communication technologies (in addition to the national toll-free number) to access poison control centers and requires the program to include toxic exposure (in addition to poisoning) in nationwide media campaigns. Further, the bill modifies the waiver limitations for poison control center accreditation.

Protect Act This bill adds, among other provisions, requirements to the Health Insurance Portability and Accountability Act of 1996 for private health insurance plans with respect to preexisting conditions, guaranteed enrollment, and discrimination based on health-related factors. Specifically, the bill prohibits private health insurance plans from (1) limiting or excluding benefits covering preexisting conditions; (2) denying enrollment to employers or individual applicants, subject to specified limits; (3) establishing rules for eligibility based on an individual's health status; or (4) requiring an individual to a pay higher premium than similarly situated individuals enrolled in the plan based the individual's health status. Additionally, the bill prohibits plans from collecting genetic information in connection with issuing health insurance and provides requirements for workplace wellness programs connected to health insurance.

Ensuring Integrity in the IRS Workforce Act of 201 9 This bill prohibits the Internal Revenue Service (IRS) from rehiring former IRS employees who were involuntarily separated for misconduct. The bill generally applies with respect to any employee removed from employment before, on, or after the date of enactment of this bill. It does not apply to any employee who is employed by the IRS as of the enactment of this bill with respect to any removal for misconduct which occurred prior to enactment.

Land and Water Conservation Fund Permanent Funding Act This bill makes permanent, beginning in FY2020, funding for the Land and Water Conservation Fund (LWCF). The President shall annually submit to Congress specified details regarding the allocation of funds to the LWCF. Congress may provide for alternate allocations using specified procedures.

Revitalizing Underdeveloped Rural Areas and Lands (RURAL) Act This bill modifies the definition of income used to determine the tax-exempt status of a mutual or cooperative telephone or electric company to exclude certain government grants, contributions, and assistance. Specifically, the bill excludes from income (1) grants, contributions, and assistance provided under the Robert T. Stafford Disaster Relief and Emergency Assistance Act or by local, state, or regional governmental entities for disasters or emergencies; and (2) certain grants or contributions provided by a government entity for electric, communications, broadband, internet, or other utility facilities or services.

Supporting Accurate Views of Emergency Services Act of 2019 or the 911 SAVES Act This bill requires the Office of Management and Budget, by 30 days after the bill's enactment, to categorize public safety telecommunicators as a protective service occupation under the Standard Occupational Classification System.

Homeless Veterans Prevention Act of 2019 This bill expands programs, and revises policies, related to veterans who are homeless or at risk of homelessness. Currently, grant recipients under the Department of Veterans Affairs (VA) comprehensive service program for homeless veterans receive per diem payments for services furnished to homeless veterans. The bill provides that furnishing care for a dependent in the care of a homeless veteran (who is receiving services from a grant recipient) may count as a service for which grant recipients may receive per diem payments. The bill requires the VA to enter into partnerships with public or private entities to fund a portion of the legal services such entities provide to homeless veterans and veterans at risk of homelessness, including legal services related to housing, family law, criminal defense, and income support. Under the bill, veterans who are receiving assistance under the Housing Choice Voucher Program are eligible for specified VA dental care. The bill repeals the sunset on the authority of the VA and the Department of Labor to carry out a program of referral and counseling for veterans who are at risk of homelessness and are transitioning from certain institutions (e.g., penal institutions). The bill also extends authorization through FY2020 for the VA to provide financial assistance for supportive services for very low-income veteran families in permanent housing. The Government Accountability Office must complete a study of VA assistance to homeless veterans. Finally, the bill repeals an annual reporting requirement related to VA assistance to homeless veterans.

PFAS Detection Act of 2019 This bill sets forth requirements for detecting and sampling perfluorinated compounds. Perfluorinated compounds are man-made and may have adverse human health effects. A variety of products contain perfluorinated compounds, such as nonstick cookware, waterproof clothing, stain-resistant fabrics, food packaging, and fire-fighting foams. The bill requires the U.S. Geological Survey (USGS) to establish a performance standard for the detection of perfluorinated compounds. Using such standard, the USGS must carry out a nationwide sampling to determine the concentration of perfluorinated compounds in estuaries, lakes, streams, springs, wells, wetlands, rivers, aquifers, and soil. The sampling data must then be used to inform and enhance assessments of exposure, likely health and environmental impacts, and remediation priorities.

Intercountry Adoption Information Act of 2019 This bill directs the Department of State to include additional information in its annual report to Congress on intercountry adoptions. The reports shall contain (1) a list of countries that have laws that prevent or prohibit adoptions by American parents, (2) various information related to such prohibitions, and (3) what steps the State Department has taken to help such countries reopen intercountry adoptions.

Secure 5G and Beyond Act of 2019 This bill requires the President, in consultation with relevant federal agencies, to develop a strategy to secure and protect U.S. fifth and future generations (5G) systems and infrastructure. Such strategy shall (1) ensure the security of 5G mobile telecommunications systems and infrastructure within the United States; (2) assist mutual defense treaty allies, strategic partners, and other countries in maximizing the security of 5G systems and infrastructure; and (3) protect the competitiveness of U.S. companies, privacy of U.S. consumers, and integrity of standards-setting bodies against political influence.

Debbie Smith Act of 2019 This bill reauthorizes grants that support state and local efforts to process DNA evidence in rape kits. Specifically, it reauthorizes through FY2024 the following: grants under the Debbie Smith DNA Backlog Grant Program; grants to provide DNA training and education for law enforcement personnel, corrections personnel, and court officers; and grants under the Sexual Assault Forensic Exam Program.

Pension Accountability Act This bill revises the rules for voting on the suspension of pension benefits under multiemployer plans in critical and declining status. The bill changes the voting procedure for suspending plan benefits to provide that a suspension shall go into effect unless a majority of plan participants and beneficiaries who cast a vote (currently, a majority of all plan participants and beneficiaries) reject the suspension. The bill also eliminates the authority of the Department of the Treasury, in the case of systemically important plans, to override a vote of plan participants to reject a suspension. A plan is systemically important if projected financial assistance to the plan will exceed $1 billion if suspensions are not implemented.

Access Technology Affordability Act of 2019 This bill allows a refundable tax credit equal to the amounts paid for qualified access technology for use by a blind individual who is the taxpayer, the taxpayer's spouse, or a dependent of the taxpayer. "Qualified access technology" is hardware, software, or other information technology with the primary function of converting or adapting information that is visually represented into forms or formats useable by blind individuals. The credit is limited to (1) costs that are not compensated by insurance or otherwise, and (2) an aggregate amount of $2,000 per blind individual in any period of three consecutive taxable years. The credit must be adjusted for inflation after 2020 and terminates after five years.

Restoring Investment in Improvements Act This bill confirms that the applicable recovery period for qualified improvement property (nonresidential real estate) for depreciation purposes is 15 years under the modified accelerated cost recovery system (MACRS) and 20 years under the alternative depreciation system (ADS).

Merrill's Marauders Congressional Gold Medal Act This bill directs Congress to award a Congressional Gold Medal to the 5307th Composite Unit (Provisional), commonly known as Merrill's Marauders, in recognition of their bravery and outstanding service in the jungles of Burma (Myanmar) during World War II. Following its award, the gold medal shall be given to the Smithsonian Institution where it shall be displayed and made available for research.

No Stolen Trademarks Honored in America Act This bill modifies the bar against U.S. courts enforcing or validating trademarks that were confiscated by the Cuban government. The bill prohibits U.S. courts from enforcing or validating such confiscated trademarks if the mark had been used in connection with a confiscated business or asset. Currently, the prohibition applies only if the confiscated trademark is being asserted in the United States by a Cuban national. Under the bill, the prohibition shall not apply if the original trademark owner, or a successor, has expressly consented to the enforcement action. The prohibition shall apply only if the entity asserting the trademark rights knew or should have known, when it acquired the rights, that the mark was the same or substantially similar to one connected to a confiscated business or asset.

Promoting Affordable Childcare for Everyone Act or the PACE Act This bill modifies the tax credit for expenses for household and dependent care services necessary for gainful employment (known as the Child and Dependent Care Tax Credit) to (1) make the credit refundable, (2) increase the rate for the credit, and (3) require the dollar amounts for such credit to be adjusted for inflation after 2019. The bill also increases the amount of employer-provided dependent care assistance which may be excluded from the gross income of an employee and requires the increased exclusion amount to be adjusted for inflation after 2020.

Removing Barriers to Colorectal Cancer Screening Act of 2019 This bill waives Medicare coinsurance requirements with respect to colorectal cancer screening tests, regardless of the code billed for a resulting diagnosis or procedure.

Education Freedom Scholarships and Opportunity Act This bill allows individual and corporate taxpayers a tax credit for cash contributions to certain scholarship-granting and workforce training organizations. It imposes a cap of $10 billion on the sum of contributions that qualify for a tax credit under this bill. The bill requires the Department of Education, in coordination with the Departments of the Treasury and Labor, to establish, host, and maintain a web portal that (1) lists all eligible scholarship-granting and workforce training organizations; (2) enables contributions to such organizations; (3) provides information about the benefits of this bill; and (4) enables a state to submit and update information about its programs and educational organizations, including information on student eligibility and allowable educational expenses.

Military Widow's Tax Elimination Act of 2019 This bill modifies the Department of Defense's Survivor Benefit Plan and how it operates in relation to other benefits. The plan currently provides a monthly annuity (based on a percentage of a service member's retirement pay) to an eligible beneficiary upon the death of the service member. Currently, if a surviving spouse is also entitled to dependency and indemnity compensation, the annuity paid under the plan will be reduced. The bill repeals certain provisions that require the offset of the plan annuity from amounts paid in dependency and indemnity compensation. Under current law, upon the request of the surviving spouse, the military branch concerned is authorized to pay an annuity to the service member's dependent children instead of to the surviving spouse. The bill restores the annuity to an eligible spouse who previously elected to transfer payment to a dependent child.

Treat and Reduce Obesity Act of 2019 This bill expands Medicare coverage of intensive behavioral therapy for obesity. Specifically, the bill allows coverage for therapy that is provided by (1) a physician who is not a primary care physician; or (2) other health care providers (e.g., physician assistants and nurse practitioners) and approved counseling programs, if provided upon a referral from, and in coordination with, a physician or primary care practitioner. Currently, such therapy is covered only if provided by a primary care practitioner. The bill also allows coverage under Medicare's prescription drug benefit of drugs used for the treatment of obesity or for weight loss management for individuals who are overweight.

ALS Disability Insurance Access Act of 2019 This bill eliminates the five-month waiting period for disability benefits under the Old Age, Survivors, and Disability Insurance program for individuals with amyotrophic lateral sclerosis (a progressive neurodegenerative disease, also known as Lou Gehrig's disease, that affects nerve cells in the brain and spinal cord). Under current law, individuals must wait five months after becoming disabled before their disability insurance benefit payments may begin.

Hidden Figures Congressional Gold Medal Act This bill requires the Speaker of the House of Representatives and President pro tempore of the Senate to arrange for the presentation of one Congressional Gold Medal to Katherine Johnson, in recognition of her service to the United States as a mathematician; one Congressional Gold Medal to Dr. Christine Darden, for her service to the United States as an aeronautical engineer; two Congressional Gold Medals in commemoration of the lives of Dorothy Vaughan and Mary Jackson, in recognition of their service to the United States during the Space Race; and one gold medal in recognition of all the women who served as computers, mathematicians, and engineers at the National Advisory Committee for Aeronautics and the National Aeronautics and Space Administration (NASA) between the 1930s and the 1970s.

National Right-to-Work Act This bill amends the National Labor Relations Act and the Railway Labor Act to repeal those provisions that permit employers, pursuant to a collective bargaining agreement that is a union security agreement, to require employees to join a union as a condition of employment (including provisions permitting railroad carriers to require, pursuant to such an agreement, payroll deduction of union dues or fees as a condition of employment).
