Justice for All Reauthorization Act of 2013

Justice for All Reauthorization Act of 2013 - Amends the federal criminal code to: (1) grant crime victims the right to be informed of their rights and of services available to them, (2) expand eligibility for post-conviction DNA testing in criminal proceedings other than death penalty cases, and (3) eliminate the waiver of the right to request DNA testing of biological evidence. Amends the Justice for All Act of 2004 to extend through FY2018 the authorization of appropriations for grant programs for: the enforcement of crime victims' rights; DNA training and education for law enforcement officers; sexual assault forensic exams; DNA research and development; DNA programs of the Federal Bureau of Investigation (FBI); identification of missing persons; improving the quality of legal representation for indigent defendants in capital cases; providing incentives to states to establish a reasonable process for resolving claims of actual innocence; and the Kirk Bloodsworth Post-Conviction DNA Testing Grant Program to help states defray the costs of post-conviction DNA testing. Amends the Victims of Crime Act of 1984 to extend through FY2018 grants for notification to crime victims of dates and developments in criminal proceedings. Amends the DNA Analysis Backlog Elimination Act of 2000 to extend the authorization of appropriations through FY2018 for the Debbie Smith DNA Backlog Grant Program.. Amends the Omnibus Crime Control and Safe Streets Act of 1968 to: (1) extend (until three years after enactment of this Act) the period for compliance by governmental entities with requirements for payment of the full cost of forensic medical exams for victims of sexual assault, and (2) extend (through FY2018) the authorization of appropriations for the Paul Coverdell forensic sciences improvement grant program. Requires the Director of the National Institute of Justice to: (1) establish best practices for evidence retention to focus on the preservation of biological evidence; and (2) assist state, local, and tribal governments in adopting and implementing such best practices. Effective Administration of Criminal Justice Act of 2013 - Amends the Omnibus Crime Control and Safe Streets Act of 1968 to require grant applicants under the Edward Byrne Memorial Justice Assistance Grant Program to include in grant applications a comprehensive state-wide plan for the improvement of the administration of the criminal justice system. Makes all grants awarded by the Department of Justice (DOJ) under this Act subject to audits beginning in FY2014 to prevent waste, fraud, and abuse of funds by grantees.

Veterans Mental Health Treatment First Act of 2013 - Directs the Secretary of Veterans Affairs (VA) to carry out a program of mental health care and rehabilitation for veterans who: (1) have been discharged or released from active-duty service under conditions other than dishonorable for no more than two years; (2) are enrolled in the VA system of annual patient enrollment and were so enrolled before the date of enactment of this Act; (3) are diagnosed by a VA physician with post-traumatic stress disorder, depression, anxiety disorder, or substance use disorder that is service-related (as determined by the Secretary or a VA physician); and (4) agree to certain participation conditions, including not submitting a claim for veterans' disability compensation for any such condition until either one year after program commencement or the conclusion of the prescribed treatment regimen. Requires the Secretary to provide for each participant a treatment regimen and rehabilitation plan for the determined condition. Provides a stipend for participants, commencing upon program commencement, continuing through successful treatment and plan compliance, and ending either upon the conclusion of such treatment or one year after treatment and plan commencement. Allows a veteran to participate more than once in the program if the Secretary determines that the additional participation will assist the veteran in achieving the remediation of the condition.

Homeless Veterans Prevention Act of 2013

Homeless Veterans Prevention Act of 2013 - Requires public or private nonprofit entities that receive grants under the Department of Veterans Affairs (VA) comprehensive service programs for homeless veterans to agree to meet the physical, privacy, safety, and security needs of such veterans. Increases the per diem payment for transitional housing assistance for homeless veterans who are placed in housing that will become permanent upon the termination of such assistance to a maximum of 150% of the per diem rate authorized for veterans receiving domiciliary care in state homes. Allows services for which a homeless veteran receives a grant under the comprehensive service programs to include furnishing care for a dependent. Directs the Secretary of Veterans Affairs (Secretary) to: (1) assess and measure the capacity of programs for which entities receive grants or per diem payments to assist homeless veterans, and (2) use such information to ensure that such programs effectively serve the needs of such veterans. Repeals a required annual VA report on activities under such programs. Repeals the September 30, 2013, sunset on the authority of the Secretary and the Secretary of Labor to carry out a program of referral and counseling for veterans who are at risk of homelessness and are transitioning from certain institutions, including penal institutions. Authorizes the Secretary to enter into partnerships with public or private entities to provide legal services to homeless veterans and veterans at risk of homelessness. Revises VA authority to provide dental care to veterans receiving certain other assistance through the VA to include those veterans receiving assistance under the United States Housing Act of 1937. Extends permanently the VA comprehensive service programs for homeless veterans. Extends temporarily various VA authorities and programs affecting homeless veterans.

Public Employee Pension Transparency Act - Amends the Internal Revenue Code to deny tax benefits relating to bonds issued by a state or political subdivision during any period in which such state or political subdivision is noncompliant with specified reporting requirements for state or local government employee pension benefit plans. Requires plan sponsors of a state or local government employee pension benefit plan to file with the Secretary of the Treasury a report for each plan year beginning on or after January 1, 2014, setting forth: (1) a schedule of the funding status of the plan, (2) a schedule of contributions by the plan sponsor for the plan year, (3) alternative projections for each of the next 60 plan years of the cash flows associated with the current plan liability, (4) a statement of the actuarial assumptions used for the plan year, (5) a statement of the number of plan participants who are retired or separated from service and are either receiving benefits or are entitled to future benefits and those who are active under the plan, (6) a statement of the plan's investment returns, (7) a statement of the degree to which unfunded liabilities are expected to be eliminated, (8) a statement of the amount of pension obligation bonds outstanding, and (9) a statement of the current cost of the plan for the plan year. Directs the Secretary  to develop model reporting statements and create and maintain a public website, with searchable capabilities, for purposes of posting plan information required by this Act. Exempts the United States from liability for any future shortfall in any state or local government employee pension plan.

Veterans Pension Protection Act - Provides that if a veteran eligible for a pension for service or for a non-service-connected disability, or the spouse of such veteran, disposes of a resource that was part of such veteran's estate for less than its fair market value within three years before applying for such pension, then the Secretary of Veterans Affairs (VA) shall deny or discontinue the pension payment for months beginning on the date of such disposition and ending when the uncompensated value of such resource is reached. Provides the same denial or discontinuance in the case of a veteran eligible for an increased pension payment on account of a child, unless the Secretary determines that such denial or discontinuance would work an undue hardship. Applies the same denial or discontinuance, with the same undue hardship exception, in the case of: (1) a veteran's surviving spouse who disposes of a covered resource for less than fair market value within such period, and (2) an increased pension for such spouse on account of a child. Requires the Secretary, at the time a veteran, surviving spouse, or child applies for such a pension, to: (1) inform the individual of such requirements, and (2) obtain information to determine whether a period of ineligibility for such payments will be required. Requires annual reports from the Secretary, through 2018, on the administration of this Act.

Troop Talent Act of 2013 - Directs the Secretaries of the military departments, to the maximum extent practicable, to make information on civilian credentialing opportunities available to members of the Armed Forces (members) beginning with, and at every stage of, their training for military occupational specialities, in order to permit such members to: (1) evaluate the extent to which such training correlates with skills and training required for various civilian certifications and licenses, and (2) assess the suitability of such training for obtaining and pursuing such certifications and licenses. Requires the information made available to: (1) be consistent with the Transition Goals Plans Success program, and (2) include information on the civilian occupational equivalents of military occupational specialties. Requires such Secretaries to make available to civilian credentialing agencies specified information on the content of military training provided to members. Allows members or veterans to use educational assistance provided through the Department of Defense (DOD) or the Department of Veterans Affairs (VA) in pursuit of a civilian certification or license only if the successful completion of a curriculum fully qualifies such student to take the appropriate examination and be certified or licensed to meet any other academic conditions required for entry into that occupation or profession. Requires the military occupational specialties designated for a military skills to civilian credentialing pilot program under the National Defense Authorization Act for Fiscal Year 2012 to include those specialties relating to the military information technology workforce. Directs the VA Secretary to reestablish the Professional Certification and Licensure Advisory Committee (under current law, terminated on December 31, 2006). Provides additional Committee duties, including the development of: (1) guidance for audits of licensure and certification programs in order to ensure high-quality education to members and veterans, and (2) a plan to improve outreach to members and veterans on the importance of licensing and certification and the availability of educational benefits.

Authorizes the termination or nullification of contracts, grants, and cooperative agreements valued in excess of $20,000 (currently, $100,000) with persons or entities identified as enemies of the United States. Requires the Secretary of Defense (DOD) and each senior procurement executive to use available intelligence to identify persons and entities who receive U.S. funds through contracts, grants, and cooperative agreements and who are: (1) providing such funds to an enemy or to a person or entity who is actively supporting an enemy of the United States, or (2) otherwise supporting those who are actively opposing U.S. or coalition forces in a contingency operation. Requires the Secretary and the Administrator for Federal Procurement Policy to jointly carry out a program for providing information to senior procurement executives and commanders of the geographic combatant commands relating to persons or entities who may be providing funding under contracts, grants, or cooperative agreements to enemies of the United States.

VISN Reorganization Act of 2013 - Directs the Secretary of Veterans Affairs to organize the Veterans Health Administration (VHA) into 12 geographically defined Veterans Integrated Service Networks (VISNs). Directs the Secretary to ensure that each VISN: (1) is aligned with the mission of the Department of Veterans Affairs (VA) and the specific health care requirements of veterans in that network; (2) implements VA national goals within their network and associated medical centers; (3) maintains a regional integrated health care system; (4) identifies and reduces the duplication of functions in VHA clinical, administrative, and operational processes and practices; (5) works to achieve maximum effectiveness in patient care and safety, graduate medical education, and research; (6) assesses the consolidation or realignment of institutional functions, in collaboration and cooperation with other VISNs and specified offices or entities within their network; and (7) develops and shares innovations and best practices with each other at the local, regional, and national levels. Prohibits more than one headquarters for each VISN, with no more than 65 full-time employees. Requires the Secretary to report at least annually to the congressional veterans committees on employment at VISN headquarters. Directs the Secretary, at least every three years, to: (1) review and assess VISN structure and operations, and (2) submit review results to such committees. Requires the Secretary, in order to comply with the requirements of this Act, to realign and combine the current 21 VISNs into 12 geographically defined VISNs, and to appropriately consolidate VISN headquarters. Directs the Secretary to submit to such committees a realignment implementation plan. Bars the imposition of any additional restrictions on pedestrian or motorized vehicular access to any part of the Recreation Area for species protection beyond those in the Interim Management Strategy, other than as specifically authorized pursuant to this Act. Allows the Secretary if, based on peer-reviewed science and after public comment, it is determined that additional restrictions on access to a part of the Recreation Area are necessary to protect endangered species, to only restrict pedestrian and vehicular access for recreational activities for the shortest possible time and on the smallest possible portions of such area. Prohibits the final rule titled "Special Regulations, Areas of the National Park System, Cape Hatteras National Seashore--Off-Road Vehicle Management" from having any force or effect. Invalidates the April 30, 2008, consent decree filed in the United States District Court for the Eastern District of North Carolina regarding off-road vehicle use at the Seashore.

Careers for Veterans Act of 2013 - Directs the head of each federal agency to develop a plan for exercising, during the five-year period beginning on the enactment of this Act, current Department of Defense (DOD) and Department of Veterans Affairs (VA) authority to hire qualified veterans for positions within the federal government. Includes as qualified veterans those who: (1) are disabled or recently separated; (2) served on active duty during a war or in a campaign or expedition for which a campaign badge has been authorized; or (3) while serving on active duty, participated in a military operation for which an Armed Forces service medal was awarded. Requires the Director of the Office of Personnel Management (OPM) to ensure that, under such plans, agencies shall appoint no less than 10,000 qualified veterans during the five-year period. Requires a state, as a condition for receipt of a grant or contract from the VA for support of disabled veterans' outreach specialists and local veterans' employment representatives, to establish a program which issues a license or credential to a veteran without requiring any training or apprenticeship if such veteran: (1) receives a satisfactory score on completion of an examination administered by that state, and (2) has at least 10 years of experience in a military occupational specialty that is similar to the civilian occupation for which such license or credential is required. Directs the Secretary of Labor to: (1) furnish each one-stop (job search) center with a list of all Internet websites and applications identified as beneficial for veterans in pursuit of employment; and (2) coordinate with public and private entities to identify websites and applications not included on such list that match veterans seeking employment with available jobs based on skills acquired as members of the Armed Forces, and allow employers to post information about available jobs. Expands VA small business contracting goals to include small businesses fully, but conditionally, owned by one or more veterans. Treats the surviving spouse of a service-disabled veteran who acquires the ownership interest in a small business of the deceased veteran as such veteran, for purposes of eligibility for VA service-disabled small business contracting goals and preferences, for a period of: (1) 10 years after the veteran's death, if such veteran was either 100% disabled or died from a service-connected disability; or (2) 3 years after such death, if the veteran was less than 100% disabled and did not die from a service-connected disability. Treats a small business acquired by the surviving spouse or dependent from a member killed during active duty as a small business owned and controlled by a service-disabled veteran, for purposes of VA small business contracting goals and preferences. Continues such treatment for the period beginning on the date of the member's death and ending on the earlier of the date on which the surviving spouse remarries or relinquishes, or the date on which the surviving dependent relinquishes, such ownership interest or ten years after the member's death. Provides that if the Secretary determines, for purposes of VA small business contracting goals, that an individual would have had a greater degree of ownership of a small business in a state other than a community property state, then the Secretary shall treat such small business as licensed in a non-community property state.

Lead Exposure Reduction Amendments Act of 2013 - Amends the Toxic Substances Control Act (TSCA) to exclude from the definition of "abatement" any renovation, remodeling, or other activity: (1) the primary purpose of which is to repair, restore, or remodel target housing, public buildings constructed before 1978, or commercial buildings; and (2) that incidentally results in a reduction or elimination of lead-based paint hazards. Requires the Administrator of the Environmental Protection Agency (EPA), no later than one year prior to proposing any renovation and remodeling regulation, to study the extent to which persons engaged in such activities: (1) are exposed to lead, and (2) disturb lead and create a lead-based paint hazard. Exempts from any such regulation an emergency renovation that is carried out in response to an event that is an act of God as defined by the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA), that presents a risk to the public health or safety, or that threatens to cause significant damage to equipment or property if not attended to immediately. Prohibits such a regulation from requiring post-abatement clearance testing. Requires the Administrator to promulgate regulations to permit an owner of a residential dwelling that is target housing, who resides in such dwelling, to authorize a contractor to forego compliance with such a regulation if the owner submits a certification stating that: (1) the renovation or remodeling project is to be carried out at such dwelling, (2) no pregnant woman or child under the age of six resides or will reside in such housing, and (3) the owner acknowledges that such contractor will be exempt from the requirements of such regulation. Prohibits the Administrator from holding a contractor responsible for a misrepresentation made by the owner of such dwelling unless the contractor has actual knowledge of such a misrepresentation. Requires the Administrator to: (1) recognize a qualifying test kit for use under such Act, and (2) suspend enforcement of any regulation relating to renovation and remodeling of target housing and commercial buildings constructed after January 1, 1960, and public buildings constructed between January 1, 1960, and January 1, 1978, until a specified period after the Administrator recognizes such a test kit.

Requires annual reports by Special Olympics to describe demographic data about Special Olympics participants. Authorizes the Secretary of Education to award grants or enter into contracts or cooperative agreements to promote the expansion of Best Buddies, including activities to increase the participation of people with intellectual disabilities in social relationships and other aspects of community life, including education and employment, within the United States.

Requires at least 50% of the assessments paid by a manufacturer to be used to support research, education, and promotion plans and projects in support of the geographic region of the manufacturer. Directs the Secretary, during the 60-day period preceding the proposed effective date of an order, to conduct a referendum for order approval among the manufacturers required to pay assessments under the order. Outlines referendum procedures. Provides for petition and review of an order, and order enforcement through U.S. district courts. Authorizes the Secretary to conduct appropriate investigations in order to administer this Act (with power of subpoena). Directs the Secretary to suspend or terminate any order or provision that obstructs or does not tend to effectuate the purposes of this Act, or that is not favored by persons voting in a referendum.
