Declares that, in recognition of the historic contributions of the U.S. veterans who served in World War I, the last surviving U.S. veteran of such War should be permitted to lie in honor in the rotunda of the Capitol upon his death, so that U.S. citizens may pay their last respects to these great Americans.

Medal of Honor Commemorative Coin Act of 2009 - Directs the Secretary of the Treasury to mint and issue $5 gold coins and $1 silver coins emblematic of the design selected by the Secretary, after consultation with the Boards of the Congressional Medal of Honor Society and the Congressional Medal of Honor Foundation, in honor of the distinguished service of the American military men and women who have been Medal of Honor recipients. Limits the period for coin issuance to calendar year 2011. Imposes a surcharge of $35 per coin for the $5 coin and $10 per coin for the $1 coin, to be distributed to the Congressional Medal of Honor Foundation to help finance educational, scholarship, and outreach programs of the Foundation.

Rebating America's Deposits Act - Amends the Nuclear Waste Policy Act of 1982 to direct the President to publish in the Federal Register a notice certifying that the Yucca Mountain site (Nevada) is the selected site for the development of a repository for the disposal of high-level radioactive radioactive waste and spent nuclear fuel. Declares that, if the President fails to publish the certification or revokes it, each entity: (1) that is required to make a payment to the Nuclear Waste Fund shall not be required to make any additional payment; and (2) that has made a payment shall receive a refund, 75% of which shall be used for rebates to the entity's ratepayers, and 25% shall be used to carry out upgrades to the entity's nuclear power facilities to enhance the storage and security of materials used to generate nuclear power. Requires the Secretary of Energy to initiate by January 1, 2017, the transportation to the Yucca Mountain site of defense waste from each state in which it is located. Imposes penalties on the Secretary for failure to initiate such transportation.

Helicopter Medical Services Patient Safety, Protection, and Coordination Act - Authorizes states to regulate helicopter medical services with respect to: (1) the medical qualifications and training of helicopter medical personnel; and (2) the obligation of providers of helicopter medical services to comply with a state's health planning, patient safety, and medical service requirements. Prohibits states from imposing requirements on pilots. Authorizes states to regulate the following aspects of helicopter medical services to the extent such regulations are harmonized with applicable federal operating requirements: (1) establishment of criteria for determination of the appropriate medical institution to receive a transported patient; (2) specification of service requirements with respect to geographic areas within a state or during specified hours and days; (3) coordination of flight requests for emergency helicopter medical services; (4) compliance with medical services accreditation requirements, except where they infringe upon relevant federal operating requirements; and (5) provision of emergency helicopter medical services to all persons where needed. Authorizes a state to regulate certain aspects of helicopter medical services to the extent that such regulations are consistent with, and do not infringe upon, applicable federal operating requirements. Specifies among the aspects of helicopter medical services which states may regulate: (1) the necessary medical equipment and supplies to be carried on board or affixed to the helicopter; (2) the physical attributes of the helicopter necessary for the provision of quality medical care and for the protection of helicopter, ground medical, and emergency response personnel; and (3) specified communication capabilities among helicopter medical personnel and emergency medical services and public safety personnel, and between the flight crew and helicopter medical personnel. Requires a provider of helicopter medical services that is licensed in more than one state where state helicopter medical services regulations are inconsistent to comply with the most stringent regulation. Requires a state, if necessary, to establish regulations or negotiate mutual aid agreements with adjacent states, or providers of helicopter medical services in such states, to ensure access to such services across state borders.

Pedestrian Safety Enhancement Act of 2009 - Directs the Secretary of Transportation to study and report to Congress on the minimum level of sound that is necessary to be emitted from a motor vehicle, or some other method, to alert blind and other pedestrians of the presence of operating motor vehicles while traveling.

Respecting States Rights and Concealed Carry Reciprocity Act of 2009 - Amends the federal criminal code to provide for reciprocity for the carrying of certain concealed firearms in states that allow their residents to carry such firearms by persons who are not prohibited by federal law from possessing, transporting, shipping, or receiving a firearm and who are: (1) carrying a valid state license or permit for carrying a concealed firearm; or (2) otherwise entitled to carry a concealed firearm in their state of residence.

International Clean Energy Development Act of 2009 - Directs the Secretary of State to establish a Development and Commercialization Committee on Clean and Efficient Energy Technologies within the Asia-Pacific Partnership on Clean Development and Climate Program Office of the Department of State. Directs the Committee to: (1) evaluate information on clean and efficient energy technologies; (2) identify, prioritize, and carry out projects for the development and commercialization of clean and efficient energy technologies; and (3) report to the appropriate congressional committees on Committee progress and projects.

Family Caregiver Program Act of 2009 - Directs the Secretary of Veterans Affairs to waive charges for care provided by the Department of Veterans Affairs (VA) in emergency cases to attendants accompanying veterans severely injured while on active duty on or after September 11, 2001, while such veterans are receiving VA care for such injuries. Directs the Secretary, as part of authorized VA home health services for veterans, to furnish family caregiver assistance to family members of veterans in need of personal care services due to a serious injury incurred or aggravated during active duty. Requires the Secretary to: (1) evaluate the services needed by each veteran; (2) provide training and certification to the caregivers; (3) designate a primary personal care attendant for each eligible veteran; (4) provide ongoing family caregiver assistance to such family members; (5) provide respite care, in appropriate cases; (6) pay monthly caregiver stipends; (7) conduct oversight of the caregiver assistance program; (8) provide program outreach; and (9) report on program implementation and evaluation. Authorizes the provision of VA health care to primary personal care attendants. Directs the Secretary to reimburse attendants for travel expenses, including lodging and subsistence, in connection with authorized VA treatment for veterans.

Net Operating Loss (NOL) Carryback Act - Amends the Internal Revenue Code to allow a five-year carryback of net operating losses, including the operating losses of life insurance companies, incurred in 2008 and 2009. Denies such extended loss carryover period to: (1) taxpayers in whom the federal government acquires an equity interest under the Emergency Economic Stabilization Act of 2008; (2) the Federal National Mortgage Association (Fannie Mae) and the Federal Home Loan Mortgage Corporation (Freddie Mac); and (3) members of certain affiliated groups.

Collegiate Housing and Infrastructure Act of 2009 - Amends the Internal Revenue Code to allow tax-exempt charitable or educational organizations to make collegiate housing and infrastructure improvement grants to certain tax-exempt social clubs (e.g., college fraternities and sororities) which apply such grants to their collegiate housing property.

Amends title II of the Elementary and Secondary Education Act of 1965 to rename part D (Achievement through Technology and Innovation) and reauthorize it through FY2015. Alters the current program to require states to use a portion of their allotted funds to develop challenging academic content and achievement standards to ensure that students are technologically literate before the end of grade eight. Specifies that such standards are only for tracking technological literacy and not for assessing adequate yearly progress (AYP) under title I. Permits technological literacy testing to be embedded in other state tests or performance-based assessments portfolios, or made through other valid and reliable means. Requires states to use the bulk of their part D allotment for two new subgrant programs for local educational agencies (LEAs), devoting: (1) 60% for formula subgrants to improve teaching and learning through technology; and (2) 40% for competitive subgrants for systemic school redesign through technology integration. Requires LEAs to: (1) include a new or updated local long-range strategic educational technology plan in their applications; (2) use a specified percentage of each subgrant for teacher training; and (3) use each subgrant to acquire and apply technology to identify individual student learning needs and support individualized learning. Allows LEAs that receive funds for both programs to use all the funds for systemic school redesign through technology integration program activities. Directs the Secretary of Education to: (1) conduct an annual national study and report on the extent to which student technology literacy is attained by grade eight; (2) annually publish the results of state technology literacy assessments; and (3) implement, and update every five years, a National Education Technology Plan. Requires the Secretary to award a competitive grant to an education technology research entity, or a partnership comprising such an entity and one or more educational, nonprofit, or research entities, to establish a National Center for Achievement Through Technology that will identify and disseminate promising practices and exemplary programs that effectively use educational technologies.

Preservation of the Second Amendment in National Parks and National Wildlife Refuges Act - Allows, except as provided under federal criminal law relating to the possession of firearms and other dangerous weapons in federal facilities, a person to possess, carry, and transport concealed, loaded, and operable firearms within a national park area or national wildlife refuge area in accordance with the laws of the state in which such area, or that portion thereof, is located.

Medicare Fracture Prevention and Osteoporosis Testing Act of 2009 - Amends title XVIII (Medicare) of the Social Security Act, as amended by the Medicare Improvements for Patients and Providers Act of 2008, to direct the Secretary of Health and Human Services to establish a national minimum payment amount for CPT code 77080 (relating to dual energy x-ray absorptiometry, or DXA, the most widely accepted method of measuring bone mass to predict fracture risk) and CPT code 77082 (relating to vertebral fracture assessment, or VFA), and any successor to such codes as identified by the Secretary (bone mass scans). Directs the Secretary to arrange with the Institute of Medicine of the National Academies to study and report to the Secretary and Congress on: (1) the ramifications of Medicare reimbursement reductions for DXA and VFA on beneficiary access to bone mass measurement benefits; and (2) the methods to increase use of bone mass measurement by Medicare beneficiaries.

Consumer Rental-Purchase Agreement Act of 2009 - Amends the Consumer Credit Protection Act to prescribe consumer protection guidelines for rental-purchase transactions, including: (1) the determination of rental-purchase cost; (2) disclosure requirements; (3) prohibitions against confessions of judgment, wage assignments, and waiver of consumer claims or defenses; (4) furnishing of statements of account; (5) point-of-rental disclosures; and (6) rental-purchase advertising disclosures. Declares that an action for civil liability may be brought against a merchant's assignee only if the violation is apparent on the face of a rental-purchase agreement to which it relates, including, but not limited to, a disclosure that can be determined to be incomplete or inaccurate from the face of the agreement. Authorizes the Board of Governors of the Federal Reserve System to promulgate implementing regulations. Grants enforcement powers to the Federal Trade Commission and to state attorneys general. Subjects to criminal penalties any willful and knowing violation of the information disclosure requirements of this Act.

Directs the Comptroller General of the United States to study and report to specified congressional committees on the functions and capabilities of the Civil Air Patrol to support the homeland security missions of state, local, and tribal governments and the Department of Homeland Security (DHS). Requires the Comptroller General to review the process by which the Civil Air Patrol may provide assistance to DHS, other federal agencies, and states to support homeland security missions, including by providing: (1) aerial reconnaissance or communications capabilities for border security; (2) capabilities for collective response to an act of terrorism, natural disaster, or other man-made event by assisting in damage assessment and situational awareness, conducting search and rescue operations, assisting in evacuations, or transporting time-sensitive medical or other materials; or (3) assistance in the exercise and training of departmental resources responsible for the interception of aviation threats to designated restricted areas. Directs the Comptroller General's report to include assessments of: (1) the feasibility and cost-effectiveness of using Civil Air Patrol assets; and (2) whether existing mechanisms for requesting support from the Civil Air Patrol are sufficient. Requires the Secretary to analyze the study and submit a report, including any recommendations for action that could affect DHS's organization and administration.

Best Buddies Empowerment for People with Intellectual Disabilities Act of 2009 - Authorizes the Secretary of Education to award grants to, or enter into agreements with, Best Buddies (a nonprofit organization dedicated to helping people with intellectual disabilities mesh with mainstream society) to promote the expansion of its programs.

Veterans 2nd Amendment Protection Act - Prohibits, in any case arising out of the administration of laws and benefits by the Secretary of Veterans Affairs, considering any person who is mentally incapacitated, deemed mentally incompetent, or experiencing an extended loss of consciousness from being considered adjudicated as a mental defective for purposes of the right to receive or transport firearms without the order or finding of a judge, magistrate, or other judicial authority of competent jurisdiction that such person is a danger to himself or herself or others.

Star-Spangled Banner Bicentennial Commemorative Coin Act - Directs the Secretary of the Treasury to mint and issue $5 gold coins and $1 silver coins in commemoration of the bicentennial of the writing of the Star-Spangled Banner . Requires a coin design emblematic of the War of 1812, and in particular of, the Battle for Baltimore that formed the basis for the Star-Spangled Banner. Limits the period for coin issuance to calendar year 2012. Imposes a surcharge of $35 per coin for the $5 coins and $10 per coin for the $1 coins, which shall be distributed to the Maryland War of 1812 Bicentennial Commission for the purpose of supporting bicentennial activities, educational outreach activities, and preservation and improvement activities pertaining to the sites and structures relating to the War of 1812.

Medical Economic Deferment for Students Act or the MEDS Act - Amends the Higher Education Act of 1965 with respect to the meaning of economic hardship under the Federal Family Education Loan or Perkins Loan and related loan insurance programs. Considers borrowers under such programs to be suffering economic hardship if they are working full-time, have a federal educational debt burden equal to at least 20% of their adjusted gross income, and the difference between their adjusted gross income minus such debt burden is less than 220% of the greater of: (1) the annual earnings of an minimum wage earner; or (2) 150% of the poverty line applicable to their family size.

Condemns all forms of anti-Semitism and rejects attempts to rationalize anti-Jewish hatred or attacks as a justifiable expression of disaffection over political events in the Middle East or elsewhere. Decries the comparison of Jews to Nazis perpetrating a Holocaust or genocide as a pernicious form of anti-Semitism. Calls on leaders to speak out against manifestations of anti-Semitism that have entered the Middle East debate. Reaffirms support for the mandate of the Special Envoy to Monitor and Combat Anti-Semitism. Urges the Secretary of State to maintain the fight against anti-Semitism as a U.S. foreign policy priority.

Senator Paul Simon Water for the World Act of 2009 - Amends the Foreign Assistance Act of 1961 to direct the Administrator of the United States Agency for International Development (USAID) to establish the Office of Water within the Bureau for Economic Growth, Agriculture, and Trade to: (1) give assistance to provide safe water and sanitation for people worldwide; and (2) be headed by a Director for Safe Water and Sanitation. Outlines the Director's duties. Requires the Secretary of State, in order to increase the capacity of the Department of State to address international issues regarding safe water, sanitation, integrated river basin management, and other international water programs, to establish a Special Coordinator for International Water. Outlines the Special Coordinator's duties. Amends the Senator Paul Simon Water for the Poor Act of 2005 to: (1) revise requirements concerning the safe water and sanitation strategy; (2) provide for the establishment of a program to build the capacity of host country institutions and officials responsible for water and sanitation in countries that receive assistance to provide safe water and sanitation under the Foreign Assistance Act of 1961; (3) expand the list of activities that may be supported by assistance furnished by the President for programs in developing countries to provide affordable and equitable access to safe water and sanitation; and (4) require the report regarding water for peace and security to include an assessment of political tensions over water sources and a multidisciplinary assessment of the expected impacts of global climate change on water supplies in 10, 25, and 50 years.

Directs the President pro tempore of the Senate and the Speaker of the House of Representatives to make appropriate arrangements for the award of a single gold medal in honor of the Women Airforce Service Pilots (WASP) collectively, in honor of their pioneering military service and exemplary record, which forged revolutionary reform in the U.S. Armed Forces. Expresses the sense of Congress that the Smithsonian Institution shall make the medal available for display elsewhere, particularly at other locations associated with the WASP.

Federal Reserve Sunshine Act of 2009 - Repeals the authority of the Comptroller General to carry out an onsite examination of an open insured bank or bank holding company only if the appropriate federal regulatory agency has consented in writing. (Retains the authority of the Comptroller General to audit a federal agency.) Directs the Comptroller General to complete, before the end of 2010, an audit of the Board of Governors of the Federal Reserve System and of the federal reserve banks, followed by a detailed report to Congress.

Federal Tobacco Act of 2009 - Establishes the Tobacco Regulatory Agency within the Department of Health and Human Services (HHS), but not as part of the Food and Drug Administration (FDA). Sets forth criteria by which tobacco products are deemed adulterated or misbranded. Establishes limits on tobacco product advertising, promotion, and marketing related to youth, including: (1) prohibiting the use of any cartoon; (2) restricting the use of any human image; (3) prohibiting sponsorship of certain athletic events; and (4) limiting the sale of small packages of cigarettes. Amends the Public Health Service Act to require the Secretary of Health and Human Services to reduce federal substance abuse grants for states that: (1) do not have in effect a statute setting forth specific provisions to prevent the sale of tobacco products to minors; or (2) spend less than the recommended amount of tobacco settlement agreement funds on tobacco control programs. Prohibits the use of certain descriptors in the packaging and advertising of cigarettes. Requires an approved application under this Act for any reduced-exposure or reduced-risk claim. Directs the Administrator of the Agency to establish standards and procedures for ranking tobacco products and nicotine-containing products based on the relative risks of serious or chronic tobacco-related diseases and adverse health conditions. Requires tobacco product manufacturers to publicly disclose a list of the ingredients in each of their tobacco products. Establishes testing and reporting requirements for tobacco products to determine nicotine and tar yields. Sets forth provisions governing disclosures on tobacco product packaging. Directs the Administrator to assess an annual user fee on each tobacco product manufacturer.

Perpetual Purple Heart Stamp Act - Directs the Postmaster General to provide for the issuance of a forever stamp (a stamp that meets first-class postage requirements even if postage rates increase) to honor the sacrifices of the men and women of the Armed Forces who have been awarded the Purple Heart.

Labeling Education and Nutrition Act of 2009 or the LEAN Act of 2009 - Amends the Federal Food, Drug, and Cosmetic Act to authorize a food service establishment to provide nutrition information for a food item by: (1) providing calories and nutrient information required for food intended for human consumption; (2) disclosing such information in written form; and (3) making such disclosure available upon request prior to purchase. Requires the labeling of a standard food item served or offered for sale in a food service establishment that is part of a chain that operates 20 or more establishments under the same trade name to disclose, in a clear and conspicuous manner, prior to the point of purchase: (1) the number of calories on a menu board, on a sign meeting certain requirements, in the menu, or as part of or supplement to the menu; (2) specified nutrient information, in writing and upon request; (3) a statement directing the consumer to the availability of additional nutrient information; and (4) a statement providing suggested daily caloric intake, on a menu or menu board that does not list calories. Declares a person to have knowingly or willfully violated the requirements of this Act if the person: (1) purposefully fails to make a disclosure required by this Act; or (2) makes a disclosure with the intent to deceive. Provides that a reasonable basis determination of nutrition information shall be required only once per standard food item if certain requirements are met. Preempts state laws not identical to this Act.

Repeals certain provisions which require the offset of amounts paid in dependency and indemnity compensation from Survivor Benefit Plan (SBP) annuities for the surviving spouses of former military personnel who are entitled to military retired pay or would be entitled to such pay except for being under 60 years of age. Prohibits recoupment by the Secretary of Defense of certain amounts previously paid to SBP recipients in the form of a retired pay refund. Repeals the optional authority of (and instead requires) the Secretary of the military department concerned to pay an annuity to a member's dependent children when there is no eligible surviving spouse. Directs the Secretary concerned to restore annuity eligibility to a surviving spouse who earlier agreed to transfer such eligibility to a surviving child or children of a member.

FDA Food Safety Modernization Act - Amends the Federal Food, Drug, and Cosmetic Act (FFDCA) to expand the authority of the Secretary of Health and Human Services (the Secretary) to regulate food, including by authorizing the Secretary to suspend the registration of a food facility. Requires each food facility to evaluate hazards and implement preventive controls. Directs the Secretary to assess and collect fees related to: (1) food facility reinspection; (2) food recalls; and (3) the voluntary qualified importer program. Requires the Secretary and the Secretary of Agriculture to prepare the National Agriculture and Food Defense Strategy. Requires the Secretary to: (1) identify preventive programs and practices to promote the safety and security of food; (2) promulgate regulations on sanitary food transportation practices; (3) develop a policy to manage the risk of food allergy and anaphylaxis in schools and early childhood education programs; (4) allocate inspection resources based on the risk profile of food facilities or food; (5) recognize bodies that accredit food testing laboratories; and (6) improve the capacity of the Secretary to track and trace raw agricultural commodities. Requires the Secretary, acting through the Director of the Centers for Disease Control and Prevention (CDC), to enhance foodborne illness surveillance systems. Authorizes the Secretary to order an immediate cessation of distribution, or a recall, of food. Requires the Administrator of the Environmental Protection Agency (EPA) to assist state, local, and tribal governments in preparing for, assessing, decontaminating, and recovering from an agriculture or food emergency. Provides for: (1) foreign supplier verification activities; (2) a voluntary qualified importer program; and (3) the inspection of foreign facilities registered to import food.

Select Agent Program and Biosafety Improvement Act of 2009 - Amends the Public Health Service Act and the Agricultural Bioterrorism Protection Act of 2002 to reauthorize appropriations for the Select Agent Program, which lists and controls biological agents and toxins that have the potential to pose a severe threat to public health and safety. Requires appropriate training of individuals handling or using such agents and toxins. Includes the Department of Homeland Security (DHS) among the federal agencies limited in the disclosure of information related to listed agents or toxins. Requires the Secretary of Health and Human Services to contract with the National Academy of Sciences to review and make recommendations for improving the Select Agent Program. Sets forth additional factors that the Secretary must consider in determining whether to list an agent or toxin, including whether the agent or toxin is endemic to the United States. Requires the Secretary to issue guidance on inventorying and monitoring listed biological agents. Directs the Attorney General to issue guidance regarding the scope of the statutory definition of "variola virus." Requires the Secretary to: (1) develop guidelines for how laboratories and laboratory personnel that do not regularly test for listed agents and toxins may be rapidly accessed and utilized during emergencies; and (2) evaluate national needs of, and oversight of, high containment biological laboratories. Provides for the development of minimum standards for laboratory biosafety and biosecurity training for relevant personnel of high containment biological laboratories. Requires the Secretary to establish a Biological Laboratory Incident Reporting System.

Federal and Military Retiree Health Care Equity Act - Amends the Internal Revenue Code to permit: (1) federal civilian and military retirees to pay Federal Employees Health Benefits Program (FEHBP) and TRICARE supplemental premiums on a pretax basis (i.e., exclude premiums from gross income); and (2) a tax deduction (available to itemizers and nonitemizers) for TRICARE supplemental premiums or enrollment fees. Directs the Director of the Office of Personnel Management (OPM) and the Secretary of Defense to ensure that the option of paying FEHBP and TRICARE supplemental premiums on a pretax basis is available to federal civilian and military retirees for the first open enrollment period beginning not less than 90 days after the enactment of this Act.

Achieving a Better Life Experience Act of 2009 or the ABLE Act of 2009 - Amends the Internal Revenue Code to establish tax-exempt ABLE accounts for individuals with a disability to pay certain expenses of such individuals, including expenses for education, housing, transportation, employment support, medical care, and certain life necessities. Defines "individual with a disability" as an individual who is eligible to receive certain supplemental security income benefits under the Social Security Act. Allows individual taxpayers a tax deduction, up to $2,000 per year, for contributions to an ABLE account. Requires the Secretary of the Treasury to study and report to Congress on the use of ABLE accounts and the effect of the tax deduction for contributions to such accounts. Requires ABLE accounts to be disregarded in determining eligibility for Medicaid benefits and for purposes of determining eligibility for other means-tested federal programs.

Directs the Secretary of Veterans Affairs to provide a dental insurance plan for any veteran enrolled in the Department of Veterans Affairs (VA) annual patient enrollment system, as well as the survivors and dependents of certain veterans. Provides for: (1) the payment of premiums for plan enrollment; and (2) voluntary plan disenrollment.

Military Spouses Residency Relief Act - Amends the Servicemembers Civil Relief Act to prohibit, for purposes of voting for a federal, state, or local office, deeming a person to have lost a residence or domicile in a state, acquired a residence or domicile in any other state, or become a resident in or of any other state solely because the person is absent from a state because the person is accompanying the person's spouse who is absent from the state in compliance with military or naval orders. Prohibits a servicemember's spouse from either losing or acquiring a residence or domicile for purposes of taxation because of being absent or present in any U.S. tax jurisdiction solely to be with the servicemember in compliance with the servicemember's military orders if the residence or domicile is the same for the servicemember and the spouse. Prohibits a spouse's income from being considered income earned in a tax jurisdiction if the spouse is not a resident or domiciliary of such jurisdiction when the spouse is in that jurisdiction solely to be with a servicemember serving under military orders. Suspends land rights residency requirements for spouses accompanying servicemembers serving under military orders.

Secret Ballot Protection Act of 2009 - Amends the National Labor Relations Act to make it an unfair labor practice for: (1) an employer to recognize or bargain collectively with a labor organization that has not been selected by a majority of the employees in a secret ballot election conducted by the National Labor Relations Board; and (2) a labor organization to cause or attempt to cause an employer to recognize or bargain collectively with a representative that has not been selected in such manner.

Captive Primate Safety Act - Amends the Lacey Act Amendments of 1981 to add nonhuman primates to the definition of "prohibited wildlife species" for purposes of the prohibition against the sale or purchase of such species in interstate or foreign commerce. Makes it unlawful for a person to import, export, transport, sell, receive, acquire, or purchase a live animal of any prohibited wildlife species in interstate or foreign commerce (i.e., for pet trade purposes). Sets forth exceptions to such prohibition, including, under certain conditions, for: (1) transporting a nonhuman primate to or from a veterinarian; (2) transporting a nonhuman primate to a legally designated caregiver as a result of the death of the preceding owner; and (3) transporting a single primate of the genus Cebus that was obtained from and trained by a charitable organization to assist a permanently disabled individual with a severe mobility impairment. Sets forth civil and criminal penalties for violations of the requirements of this Act. Extends the authorization of appropriations to carry out such prohibition for FY2010-FY2014. Authorizes appropriations to the Secretary for FY2010 for use in hiring additional law enforcement personnel of the United States Fish and Wildlife Service to enforce the Lacey Act Amendments of 1981.
