Patent Eligibility Restoration Act of 2023 This bill amends the law relating to patent subject matter eligibility to establish that only specified subject matter (e.g., a natural process wholly independent of human activity) is ineligible for patenting. (Currently, subject matter eligibility is determined by examining whether the claimed invention is directed to certain ineligible categories, and if so, whether there is an inventive concept. Subject matter eligibility is one of several requirements that an invention must satisfy in order to receive patent protection.) Under this bill, an invention shall be considered to involve patent-ineligible subject matter only if it falls within specified categories, such as (1) a mathematical formula that is not part of a useful process, machine, manufacture, or composition; (2) a mental process that is performed solely in the human mind; or (3) an unmodified human gene as the gene exists in the human body.

This resolution recognizes that the COVID-19 pandemic and increased tensions between the United States and China have exposed vulnerabilities due to overreliance by the United States and other countries on supply chains based in China. The resolution emphasizes that nearshoring in Latin America and the Caribbean has the potential to contribute to the economic security of the United States while advancing the post-pandemic economic recovery of countries in the Western Hemisphere. Nearshoring is the practice of moving a business or supplier to a nearby country, as opposed to a more distant one. The resolution encourages the U.S. Agency for International Development and the U.S. International Development Finance Corporation to support initiatives likely to relocate global supply chains to the Western Hemisphere. The resolution also calls for governments in Latin America and the Caribbean to increase opportunities for nearshoring in the region. Finally, the resolution urges the Department of State to prioritize efforts to advance nearshoring in Latin America and the Caribbean.

The bill similarly expands the Fair Housing Act (discrimination in public and private housing) to include sexual orientation and gender identity. It also prohibits discrimination based on sexual orientation or gender identity by creditors and with respect to jury selection. Save America's Forgotten Equines Act of 2023 or the SAFE Act of 2023 This bill permanently prohibits the slaughter of equines (e.g., horses and mules) for human consumption. (Current law prohibits the slaughter of dogs and cats for human consumption. This bill extends the prohibition to equines.) Specifically, this bill prohibits a person from knowingly slaughtering an equine for human consumption; or shipping, transporting, possessing, purchasing, selling, or donating an equine to be slaughtered for human consumption or equine parts for human consumption. The bill subjects a violator to a fine. The bill applies to conduct in or affecting interstate or foreign commerce or within the special maritime and territorial jurisdiction of the United States. However, it does not apply to an activity carried out by an Indian for a religious ceremony. In recent years, appropriations acts have prohibited the Department of Agriculture (USDA) from using federal funds to inspect horses before they are slaughtered for human consumption. Therefore, there are currently no USDA-inspected horse slaughter facilities in the United States.

Right to Contraception Act This bill sets out statutory protections for an individual's right to access and a health care provider's right to provide contraception and related information. Contraception refers to an action taken to prevent pregnancy, including the use of contraceptives (i.e., a device or medication used to prevent pregnancy), fertility-awareness based methods, and sterilization procedures. Generally, the bill prohibits measures that single out and impede access to contraception and related information. However, a party may defend against a claim that a measure violates the bill's prohibitions by demonstrating, through clear and convincing evidence, that the measure significantly advances the safety of contraception and cannot be achieved through less restrictive means. The bill also specifies that the prohibition preempts inconsistent state and local laws and applies in spite of other federal laws, including the Religious Freedom Restoration Act of 1993. The Department of Justice, individuals, or health care providers may bring a lawsuit to enforce this bill, and states are not immune from suits for violations.

(AM broadcast stations are often used to deliver emergency alerts and news and entertainment programming; some newer vehicles do not include AM equipment.) America's CHILDREN Act of 2023 or the Protecting Children of Long-Term Visa Holders Act of 2023 This bill provides lawful permanent resident status to certain college graduates who entered the United States as children and addresses other immigration-related issues. Specifically, this bill allows a non-U.S. national ( alien under federal law) to apply for lawful permanent resident status if the individual (1) was lawfully present in the United States as a dependent child of an individual admitted for employment, (2) was in the United States with such status for at least eight years, (3) has graduated from an institution of higher education in the United States, and (4) is not deportable or otherwise inadmissible. In addition, the individual must have been lawfully present in the United States for at least 10 years at the time of the application. The bill also modifies various provisions related to calculating an individual's age for immigration purposes and the priority date of certain immigration-related applications. For example, to determine whether an individual is a dependent child for certain immigration petitions, the individual's age at the time a petition is filed shall be the age used for that determination. (Currently, this determination for some petitions is based on the individual's age at the time a visa becomes available, so it is possible for an individual to be a dependent child when filing a petition but become too old to qualify by the time the visa is available.)

Finally, the VBA must evaluate the guidance relating to PTSD to determine if updates are warranted to provide claims processors with better resources regarding best practices for claims processing, including specific guidance regarding development of claims involving compensation for service-connected PTSD.
