Reproductive Health Patient Navigator Act of 2023 This bill provides funding for patient navigator grants to assist individuals in accessing abortion services. The Department of Health and Human Services must award the grants to state, tribal, or local governments; nonprofits; or community organizations that offer unbiased and medically accurate programs, services, or activities to connect individuals with abortion services. Grant-funded activities include, among others, coordinating the scheduling, financing, and other logistics of abortion services. Further, the bill prohibits individuals, entities, and states from preventing or otherwise disadvantaging an entity that is eligible to receive a grant from carrying out activities to assist individuals with accessing abortion services, including in any state in which those services are not lawful. Such activities include providing (or assisting in the provision of) abortion care and other reproductive health services that are either (1) lawful in the state where the services are provided, or (2) provided to an individual who does not reside in the state where the services are provided. The Department of Justice may bring civil actions for violations; the bill also provides for a private right of action.

Food and Agriculture Industry Cyberspace Support Act This bill requires the establishment of a clearinghouse for food and agriculture cyberspace resources and the development of related best practices recommendations. Specifically, the National Telecommunications and Information Administration (NTIA) must establish a publicly available clearinghouse that contains current food and agriculture industry-focused cybersecurity resources. Further, the NTIA must develop voluntary cybersecurity recommendations relating to the development, maintenance, and operation of the food and agriculture industry. The recommendations must be based on a consolidation of public and private sector best practices and be included in the NTIA clearinghouse. The recommendations must also include, to the greatest extent practicable, materials that address (1) risk-based, cybersecurity-informed engineering; (2) planning for retention or recovery of positive control of systems in the event of a cybersecurity incident; (3) protection against unauthorized access to critical functions of the industry; and (4) plans for how industry businesses should respond to ransomware attacks. The Government Accountability Office must coordinate with specified federal agencies to conduct a study on actions the federal government has taken or may take to improve cybersecurity in the food and agriculture industry.

Accelerating Kids' Access to Care Act This bill requires state Medicaid programs to establish a process through which qualifying out-of-state providers may enroll as participating providers for five years without undergoing additional screening requirements, unless the state has an agreement with other states that governs coverage of children with medically complex conditions that is in accordance with specified guidance from the Centers for Medicare & Medicaid Services (CMS). Among other requirements, a qualifying provider must (1) serve individuals under the age of 21; (2) have previously been screened for Medicare participation or for participation in the Medicaid program of the state in which the provider is located; and (3) have been determined by the CMS or state Medicaid program to pose a limited risk of fraud, waste, or abuse.

Cybersecurity for Rural Water Systems Act This bill directs the Department of Agriculture (USDA) to establish a cybersecurity circuit rider program to provide cybersecurity technical assistance for rural water and wastewater systems. The program must be structured similarly to the USDA Circuit Rider Program. (Under this program, USDA provides technical assistance to rural water systems that serve areas with populations of 10,000 or fewer people and are experiencing day-to-day operational, financial, or managerial issues.) Specifically, the cybersecurity circuit rider program must provide technical assistance to rural water or wastewater systems to provide rapid assessments of the system's current ability or inability to respond to cybersecurity threats and protect cyber infrastructure, develop reasonable protocols to enhance cybersecurity protection, provide assistance to address inadequate cyber protection plans, and document a system's current state of water supply cyber protection.

Jimmy Deal Trafficking Survivors Assistance Act of 2023 This bill requires the Transportation Security Administration (TSA) to provide air travel assistance for survivors of human trafficking who do not have the identification documents necessary for air travel. Specifically, the TSA must establish the position of Trafficking Survivor Point of Contact (TSPoC) at every TSA screening airport. The TSPoC must liaise and establish relationships with service providers and provide air travel assistance for survivors of human trafficking. The TSPoC must provide information to an eligible service provider and assist the provider or the individual (who does not have the identification documents necessary for air travel) throughout the vetting process, travel, and arrival at the destination airport. The bill directs a TSPoC to follow specific procedures. Under the bill, a service provider is a nonprofit organization that provides services to individuals who are victims of human trafficking, including (1) emergency services, such as shelter, food, clothing, and transportation; (2) case management or wraparound services; (3) mental health care or other medical services; and (4) legal services.

Freedom to Vote Act This bill addresses voter registration and voting access, election integrity and security, redistricting, and campaign finance. Specifically, the bill expands voter registration (e.g., automatic and same-day registration) and voting access (e.g., vote-by-mail and early voting). It also limits removing voters from voter rolls. Next, the bill establishes Election Day as a federal holiday. The bill declares that the right of a U.S. citizen to vote in any election for federal office shall not be denied or abridged because that individual has been convicted of a criminal offense unless, at the time of the election, such individual is serving a felony sentence. The bill establishes certain federal criminal offenses related to voting. In particular, the bill establishes a new criminal offense for conduct (or attempted conduct) to corruptly hinder, interfere with, or prevent another person from registering to vote or helping someone register to vote. Additionally, the bill sets forth provisions related to election security, including by requiring states to conduct post-election audits for federal elections. The bill outlines criteria for congressional redistricting and generally prohibits mid-decade redistricting. The bill addresses campaign finance, including by expanding the prohibition on campaign spending by foreign nationals, requiring additional disclosure of campaign-related fundraising and spending, requiring additional disclaimers regarding certain political advertising, and establishing an alternative campaign funding system for certain federal offices.

Medicare PBM Accountability Act This bill establishes reporting requirements for pharmacy benefit managers (PBMs) under the Medicare prescription drug benefit and Medicare Advantage, particularly relating to the prices of prescription drugs. Specifically, PBMs must (1) disclose certain information underlying cost performance measurements (e.g., exclusions and terms), and (2) report to prescription drug plan (PDP) sponsors (and to the Centers for Medicare & Medicaid Services upon request) an itemized list of prescription drugs that were dispensed during the previous year and related data about costs, claims, affiliated pharmacies, and other specified information. PDP sponsors may audit PBMs to ensure compliance with this bill's requirements and must annually certify their compliance; PBMs are responsible for any associated civil penalties for violations. In addition, the Government Accountability Office must study federal and state reporting requirements for health plans and PBMs with respect to prescription drug price transparency and recommend ways to streamline these requirements.

Federal Reserve Racial and Economic Equity Act This bill requires the Federal Reserve Board to carry out its duties in a manner that supports the elimination of racial and ethnic disparities in employment, income, wealth, and access to affordable credit. The board must report on disparities in labor force trends as well as on plans and activities of the board to minimize and eliminate these disparities.

Preventing the Financing of Illegal Synthetic Drugs Act This bill requires the Government Accountability Office to study illicit financing in connection with the trafficking of synthetic drugs, including fentanyl and methamphetamine, fentanyl- and methamphetamine-related substances, Captagon, and fentanyl and methamphetamine precursors, and to report to Congress.

PrEP Access and Coverage Act of 2023 This bill requires private health insurance plans to cover prescription drugs that prevent HIV, including related screenings, diagnostic procedures, administrative fees, and clinical follow-ups, without any cost-sharing obligation for the plan holder. Further, insurance plans must not impose any preauthorization requirement for this coverage. These coverage requirements also apply to public health insurance programs, including Medicare, Medicaid, and the Children's Health Insurance Program. Additionally, the bill prohibits denying, limiting, or qualifying coverage or increasing premiums for disability insurance, long-term care insurance, or life insurance policies based on an individual taking medication for HIV prevention. The bill further requires the Department of Health and Human Services (HHS) to award grants to states, or directly to eligible local organizations, to provide uninsured individuals and underinsured individuals access to prescription drugs and related services that prevent HIV. The Centers for Disease Control and Prevention also must develop a public awareness campaign that focuses efforts in communities with a high need for HIV prevention treatment. HHS, the Department of Labor, and the Department of Treasury must enforce and report on private insurers' compliance with the bill's requirements.

The resolution r ecognizes that LGBTQ rights are human rights and protected by the laws of the United States and international treaties. Additionally, the resolution encourages the celebration of LGBTQ Pride Month in June.

Expanding Access to Family Planning Act This bill provides, subject to specified conditions, funding through FY2033 for federally funded family planning services and clinics. In particular, the funds must be used for (1) grants and contracts that support the provision of family planning services, and (2) clinic infrastructure (e.g., construction and renovation of clinics). Clinics that receive funding to provide family planning services must offer each patient with a positive pregnancy test the opportunity for nondirective counseling on (1) prenatal care and delivery; (2) infant care, foster care, and adoption; and (3) pregnancy termination. This counseling must include referrals if requested by a patient. Additionally, if a funding recipient makes subawards for the provision of family planning services, the recipient may not prohibit an entity from participating in a subaward program for reasons other than the entity's inability to provide family planning services.

Equality Act This bill prohibits discrimination based on sex, sexual orientation, or gender identity with respect to businesses, employment, housing, federally funded programs, and other settings. Specifically, the bill expands Title II and Title VI of the Civil Rights Act of 1964 to prohibit public accommodations and federally funded programs, respectively, from discriminating based on sex, sexual orientation, or gender identity. It also includes stores, transit services, recreational facilities, and establishments that provide health care, accounting, or legal services as public accommodations under Title II. The bill also expands Title IV (desegregation of public schools) and Title VII (employment discrimination) to specifically include sexual orientation and gender identity. (The Supreme Court held in Bostock v. Clayton County that Title VII's prohibition of employment discrimination based on sex also prohibits employment discrimination based on sexual orientation or gender identity.) The bill similarly expands the Fair Housing Act (discrimination in public and private housing) to include sexual orientation and gender identity. It also prohibits discrimination based on sexual orientation or gender identity by creditors and with respect to jury selection. The bill defines sex for purposes of the aforementioned provisions to include sex stereotypes, pregnancy, childbirth, sexual orientation, gender identity, and sex characteristics.

Medicare Multi-Cancer Early Detection Screening Coverage Act This bill allows for Medicare coverage and payment for multi-cancer early detection screening tests that are approved by the Food and Drug Administration and that are used to screen for cancer across many cancer types, if the Centers for Medicare & Medicaid Services determines such coverage is appropriate.

Freedom to Travel for Health Care Act of 2023 This bill prohibits anyone from interfering with a person's ability to access out-of-state reproductive health care. ( Reproductive health care is defined as medical, surgical, counseling, or referral services and care related to pregnancy, including the prevention or termination of a pregnancy, and other reproductive care.) Specifically, the bill prohibits anyone from restricting, discriminating against, or otherwise disadvantaging anyone who receives, provides, or assists with out-of-state reproductive health care that is legal in the state in which it is provided. The bill allows the Department of Justice to bring a civil action and establishes a private right of action for violations. The bill specifically waives any applicable governmental immunity and preempts any contravening state laws.

Sloan Canyon Conservation and Lateral Pipeline Act This bill expands the boundaries of the Sloan Canyon National Conservation Area in Clark County, Nevada, and grants rights-of-way through the conservation area for the construction of a water transmission pipeline and related facilities. Specifically, the bill requires the Bureau of Land Management (BLM), which administers the conservation area, to grant certain rights-of-way to the Southern Nevada Water Authority (SNWA) for the purposes of (1) performing geotechnical investigations within the rights-of-way, and (2) constructing and operating a water pipeline and related facilities. Rights-of-way may not be located through or under areas designated as wilderness, and construction of the pipeline may not permanently adversely affect surface resources within the conservation area. The BLM may place other reasonable terms and conditions on the issuance of rights-of-way as necessary to protect the conservation area’s resources. In tunneling the water pipeline, SNWA may excavate and dispose of sand, gravel, minerals, and other materials as needed. The BLM must enter into a memorandum of understanding with SNWA to identify federal land on which SNWA may dispose of such materials. The bill also adds approximately 9,000 acres of land to the conservation area. This expansion of the conservation area is subject to valid existing rights (e.g., utility transmission rights), must not preclude authorized activities within existing rights-of-way or corridors, and must not preclude the BLM from authorizing new utility rights-of-way.

Rebuilding Economic Prosperity and Opportunity for Ukrainians Act or the REPO for Ukrainians Act This bill requires or authorizes various actions related to the confiscation and disposition of Russian sovereign assets (which include funds and other property of Russia's central bank, direct investment fund, or ministry of finance). Under the bill, the President must require U.S. financial institutions to notify the Department of the Treasury of any Russian sovereign assets located at such institutions. The President may confiscate any such assets subject to U.S. jurisdiction. Confiscated funds and the proceeds of liquidated property must be deposited into the Ukraine Support Fund established by the bill. The Ukraine Support Fund shall be available to the Department of State only to compensate Ukraine for damages caused by the Russian invasion, including by providing funds to an international body or mechanism for (1) reconstruction and rebuilding efforts in Ukraine, (2) humanitarian assistance to the Ukrainian people, or (3) other purposes which support the recovery of Ukraine and the welfare of the Ukrainian people. The bill also directs the President to seek to establish, with foreign partners, an international mechanism to provide compensation to Ukraine using the Ukraine Support Fund and Russian sovereign assets confiscated by foreign partners. Additionally, the bill sets policy on related topics, such as specifying that the United States should lead an international sanctions regime to freeze Russian sovereign assets in conjunction with allies and partners.

Improving Corporate Governance Through Diversity Act of 2023 This bill requires certain issuers of securities to disclose the racial, ethnic, and gender composition of their boards of directors and executive officers, as well as the status of any of those directors and officers as a veteran. It also requires the disclosure of any plan to promote racial, ethnic, and gender diversity among these groups. The Securities and Exchange Commission must establish a Diversity Advisory Group to report on strategies to increase gender, racial, and ethnic diversity among board members.

Reproductive Health Care Training Act of 2023 This bill establishes a grant program that supports training for providers of abortion care. Specifically, the Health Resources and Services Administration must award grants to health professional schools, academic health centers, or other nonprofit health care safety net providers to support training in abortion care, if such training is authorized in the state in which they are located. Funds may be used to train students, residents, and advanced practice clinicians in abortion care and to connect them to appropriate entities to provide such care, among other activities.

Working Families Tax Relief Act of 2023 This bill expands the earned income tax credit and makes the child tax credit fully refundable. The bill increases and makes permanent the earned income tax credit for taxpayers with no qualifying children and expands age limits for credit eligibility (currently, taxpayers must be at least 25 years of age and not older than 65). It lowers the age baseline of 25 years to 19 years and eliminates the 65 age limit). The bill increases the child tax credit amount and provides for monthly advance payments of such credit.

Right to Contraception Act This bill sets out statutory protections for an individual's right to access and a health care provider's right to provide contraception and related information. Contraception refers to an action taken to prevent pregnancy, including the use of contraceptives (i.e., a device or medication used to prevent pregnancy), fertility-awareness based methods, and sterilization procedures. Generally, the bill prohibits measures that single out and impede access to contraception and related information. However, a party may defend against a claim that a measure violates the bill's prohibitions by demonstrating, through clear and convincing evidence, that the measure significantly advances the safety of contraception and cannot be achieved through less restrictive means. The bill also specifies that the prohibition preempts inconsistent state and local laws and applies in spite of other federal laws, including the Religious Freedom Restoration Act of 1993. The Department of Justice, individuals, or health care providers may bring a lawsuit to enforce this bill, and states are not immune from suits for violations.

Protect Vulnerable Immigrant Youth Act This bill exempts Special Immigrant Juveniles visas from certain annual numerical limitations on such visas. (Generally, Special Immigrant Juvenile status is available to qualifying non-U.S. nationals under 21 years of age who are in the United States and have been abused, abandoned, or neglected by a parent.)

Mental Health Services for Students Act of 2023 This bill provides specific statutory authority for the Project AWARE (Advancing Wellness and Resiliency in Education) State Educational Agency Grant Program that is administered by the Substance Abuse and Mental Health Services Administration. The program supports school-based mental health services, including screening, treatment, and outreach programs.

Screening for Communities to Receive Early and Equitable Needed Services for Cancer Act of 2023 or the SCREENS for Cancer Act of 2023 This bill reauthorizes through FY2028 and makes changes to the National Breast and Cervical Cancer Early Detection Program. This program provides funding to states for breast and cervical cancer screening, diagnostic, and treatment services for individuals who have low incomes, are uninsured, or otherwise lack access to such services.

LGBTQ I+ Data Inclusion Act This bill addresses federal data collection of voluntary, self-disclosed information on sexual orientation, gender identity, and variations in sex characteristics. Specifically, the bill requires federal agencies that collect information through a survey for statistical purposes that includes demographic data (where subjects self-report information or a proxy provides information about the subject or responds for all persons in a household) to review existing data sets to determine which data sets do not include information about sexual orientation, gender identity, and variations in sex characteristics. Such agencies must assess needed changes in survey methods related to asking questions on such matters. Agencies that publish reports relying on survey demographic data must include information on sexual orientation, gender identity, and variations in sex characteristics. Agencies may waive this publication requirement on a case-by-case basis if the confidentiality of the information cannot be maintained or if adding such information to the survey would impair the agency's ability to preserve the utility, accuracy, or objectivity of the survey while also generating relevant evidence about the LGBTQI+ community. The Government Accountability Office must report to Congress on the implementation of this bill's requirements by agencies.

Expanding Access to Palliative Care Act This bill requires the Center for Medicare and Medicaid Innovation (CMMI) to test a model that provides community-based palliative care and care coordination for high-risk Medicare beneficiaries and that may replace the Medicare Care Choices Model (which ended on December 31, 2021). Under the new model, multi-disciplinary teams must provide coordinated, palliative care that is available 24-7 for Medicare beneficiaries with serious illnesses or injuries, such as cancer. The CMMI must evaluate the model by comparing patients participating in the model with those outside of the model in relation to specified metrics, including the election and duration of hospice care.

Affordable Housing Bond Enhancement Act This bill modifies the Mortgage Revenue Bond (MRB) and the Mortgage Credit Certificate (MCC) programs of state housing finance agencies to expand the supply of affordable homes and homeownership for low- and moderate-income homebuyers. The bill requires the Internal Revenue Service to annually report to the congressional banking and tax committees on the use by states of their private activity bond authority for housing investment. It also increases the MRB home improvement loan limit from $15,000 to $50,000. The bill permits states to redesignate their carryforward authority and use it for housing investment and permits MRBs to be used to refinance home loans for borrowers who have incomes below 115% of median family income. The bill modifies the recapture requirement for homeowners who receive a MRB-financed mortgage or an MCC and sell their residences within the first nine years of ownership and reduces the time in which a recapture tax may be assessed from nine to five years. The bill revises the MCC benefit calculation to a simple percentage of the original loan balance. It also extends the MCC revocation period from two to four years. The bill reduces the public notice requirement for MCC issuers from 90 days to 30 days and eliminates certain MCC lendor reporting requirements.

Filing Relief for Natural Disasters Act This bill authorizes the Internal Revenue Service to postpone federal tax filing deadlines upon the written request of a governor of a state in which an emergency or disaster has been declared. The bill also extends current mandatory extensions from 60 to 120 days. For purposes of this bill, a state includes the District of Columbia, the Commonwealth of Puerto Rico, the U.S. Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands.

Protecting Air Ambulance Services for Americans Act of 2023 This bill authorizes payment changes under Medicare for air ambulance services based on certain collected data and requires additional reporting from providers of these services. Current law requires providers of air ambulance services to report certain information regarding general costs and utilization to the Department of Health and Human Services; private health insurers are also required to report information relating to coverage of these services. The bill authorizes the Centers for Medicare & Medicaid Services to revise payment rates under Medicare for air ambulance services based on this data, and it requires providers of air ambulance services to specifically report information relating to costs and utilization under Medicare. The bill also requires the Government Accountability Office to report on the data that is collected under current law requirements and to recommend changes to Medicare payment rates accordingly.

Failed Bank Executives Clawback Act This bill requires the Federal Deposit Insurance Corporation (FDIC) to claw back compensation from specific responsible parties in case of a large insured depository institution's insolvency, resolution, or receivership. This clawback requirement applies to an entity (including a director, shareholder, or other person who participates in the conduct of the institution's affairs) that caused more than a minimal financial loss to, or a significant adverse effect on, the insured depository institution. The compensation subject to the clawback requirement includes salary, bonuses, awards, and any profits realized from the buying or selling of securities during the preceding three years. The bill also expands the authority of the FDIC to claw back compensation of parties responsible for financial losses incurred by a financial company regardless of the process by which it is appointed receiver.

Western Wildfire Support Act of 2023 This bill establishes activities to address wildfires. The bill requires the Department of Agriculture (USDA) and the Department of the Interior to establish spatial fire management plans before the end of FY2026. The bill establishes accounts in the Treasury for addressing wildfires, a program to train and certify citizens who wish to be able to volunteer to assist USDA or Interior during a wildland fire incident, a program to award grants to eligible states or units of local government to acquire slip-on tank and pump units for a surge capacity of resources for fire suppression, the Theodore Roosevelt Genius Prize for the management of wildfire-related invasive species, and the Management of Wildfire-Related Invasive Species Technology Advisory Board. The bill also requires the Department of Defense (DOD) to reimburse a state or federal agency for the costs of wildfire suppression as a result of a fire caused by DOD activity, requires the Joint Fire Science Program to work with unmanned aircraft test ranges to carry out research and development of unmanned aircraft system fire applications, requires federal and state disaster preparedness programs to include postdisaster assistance, and authorizes the Federal Emergency Management Agency to provide funding to a state agency to establish and operate a website to provide information relating to postfire recovery funding and resources to a community or an individual impacted by a wildland fire.
