SECURE Small Business Act

Strengthening and Enhancing Cybersecurity Usage to Reach Every Small Business Act or the SECURE Small Business Act This bill requires the Small Business Administration (SBA) to help small businesses purchase cybersecurity products and services. Specifically, the SBA must establish a website that provides a marketplace for facilitating agreements under which small businesses may cooperatively purchase cybersecurity products and services. Such website shall be free to use for small businesses and cybersecurity vendors. The SBA must also take steps to educate small businesses about the types of cybersecurity products and services that are specific to each industry sector and provide outreach to encourage use of the cooperative marketplace. The Government Accountability Office must study and report on potential improvements to existing federal initiatives that train small businesses on how to avoid cybersecurity threats.

Kids Online Safety Act

Kids Online Safety Act This bill sets out requirements to protect minors from online harms. The requirements apply to covered platforms, which are applications or services (e.g., social networks) that connect to the internet and are likely to be used by minors. However, the bill exempts internet service providers, email services, educational institutions, and other specified entities from the requirements. Covered platforms must act in the best interest of minors using the applications or services, including by mitigating harms that may arise from that use (e.g., sexual exploitation and online bullying). Additionally, covered platforms must provide (1) minors (or their parents or guardians) with certain safeguards, such as settings that restrict access to minors' personal data; and (2) parents or guardians with tools to supervise minors' use of a platform, such as control of privacy and account settings. Covered platforms must also disclose specified information, including details regarding the use of personalized recommendation systems and targeted advertising; allow parents, guardians, minors, and schools to report certain harms; refrain from facilitating advertising of age-restricted products or services (e.g., tobacco and gambling) to minors; and annually report on foreseeable risks of harm to minors from using the platform. The bill provides for enforcement through the Federal Trade Commission and states. Further, the bill establishes a program to facilitate relevant independent research for noncommercial purposes and a council to advise on implementing the bill. It also requires guidance for market and product research focused on minors and an evaluation of options to verify a user's age.

Living Donor Protection Act of 2023 This bill prohibits certain insurance carriers from discriminating against, and provides other protections for, living organ donors. Specifically, carriers may not deny, cancel, or otherwise impose conditions on policies for life insurance, disability insurance, or long-term care insurance based on an individual's status as a living organ donor. The bill also expressly specifies that recovery from organ-donation surgery constitutes a serious health condition that entitles eligible employees to job-protected medical leave. In addition, the Department of Health and Human Services must update educational materials on living organ donation to include information about the benefits of living organ donation and about access to insurance for living organ donors.

Connecting Our Medical Providers with Links to Expand Tailored and Effective Care or the COMPLETE Care Act This bill modifies payments and establishes certain requirements to support integrated behavioral health services under Medicare. Specifically, the bill increases payments for integrated behavioral health services that are provided by physicians under Medicare for 2025-2027, with payments increased by 175% in 2025, 150% in 2026, and 125% in 2027. The bill also requires the Centers for Medicare & Medicaid Services (CMS) to establish reporting requirements for physicians and practitioners who participate in certain alternative payment models under Medicare in order to measure the extent to which behavioral health services are integrated into primary care under these models. The bill provides funds for FY2024-FY2027 for the CMS to contract with entities to provide technical assistance to primary care practices that want to adopt models for behavioral health integration.

SAFE Banking Act of 2023

Secure and Fair Enforcement Banking Act of 2023 or the SAFE Banking Act of 2023 This bill provides protections for federally regulated financial institutions that serve state-sanctioned marijuana businesses. Currently, many financial institutions do not provide services to state-sanctioned marijuana businesses due to the federal classification of marijuana as a Schedule I controlled substance. Under the bill, a federal banking regulator may not penalize a depository institution for providing banking services to a state-sanctioned marijuana business. For example, regulators may not terminate or limit the deposit or share insurance of a depository institution solely because the institution provides financial services to a state-sanctioned marijuana business. The bill also prohibits a federal banking regulator from requesting or ordering a depository institution to terminate a customer account unless (1) the regulator has determined that the depository institution is engaging in an unsafe or unsound practice or is violating a law or regulation, and (2) that determination is not based primarily on reputation risk. Additionally, proceeds from a transaction involving activities of a state-sanctioned marijuana business are no longer considered proceeds from unlawful activity. (Financial institutions that handle proceeds from unlawful activity are subject to anti-money laundering laws. Violators of these laws are subject to fines and imprisonment.) Furthermore, a financial institution, insurer, or federal agency may not be held liable or subject to asset forfeiture under federal law for providing a loan, mortgage, or other financial service to a state-sanctioned marijuana business.

Election Worker Protection Act of 2023

Election Worker Protection Act of 2023 This bill establishes certain protections for election workers. Specifically, the bill makes it a crime to intimidate, threaten, coerce, or harass an election worker with the intent to interfere with the official duties of, or retaliate against, the worker. The bill extends (1) the prohibition on certain types of intimidation in federal elections to also prohibit intimidation for processing ballots or tabulating, canvassing, or certifying votes; and (2) the prohibition on public disclosure of restricted personal information to also prohibit the disclosure of information about election officials, poll workers, or election volunteers in connection with a federal election. The bill also authorizes election officials to remove poll observers who are interfering with or attempting to disrupt the administration of an election. Additionally, the bill directs the Election Assistance Commission to award grants to states (or local governments under specified circumstances) for (1) recruiting and training individuals to serve as poll workers and election volunteers on dates of elections for public office, and (2) physical security services and social media threat monitoring for election workers. The bill directs the Department of Justice to (1) provide training to law enforcement and federal attorneys on addressing threats to election workers, and (2) establish a grant program to support programs to prevent the disclosure of personally identifiable information of election workers.

Let Doctors Provide Reproductive Health Care Act

Let Doctors Provide Reproductive Health Care Act This bill sets out protections for and establishes programs to support health care providers (and those who assist such providers) who offer reproductive health care services that are lawful in the state where the services are provided. Reproductive health care services refer to abortion services; contraceptive services; in vitro fertilization; or other reproductive care, education, and counseling that is provided (1) at a health care site or via telehealth, and (2) in a medically accurate manner. The bill prohibits individuals, entities, and states from preventing, restricting, or otherwise interfering with the provision of lawful reproductive health care services by health care providers. The Department of Justice, individuals, or providers may bring a lawsuit to enforce this bill, and states are not immune from suits for violations. Furthermore, states may not use federal funds to pursue legal cases or similar proceedings (e.g., adverse licensing proceedings) against health care providers, individuals, or entities that offer or assist with lawful reproductive health care services. Additionally, medical malpractice insurers may not deny coverage to or sue a health care provider solely because the provider offers or assists with lawful reproductive health care services. The bill also funds grants to assist health care providers who offer or refer for abortion services and face legal issues relating to their provision of reproductive health care services with legal matters and improving security.

FEND Off Fentanyl Act

Fentanyl Eradication and Narcotics Deterrence Off Fentanyl Act or the FEND Off Fentanyl Act This bill requires or authorizes various actions, including sanctions, targeting foreign persons (individuals and entities) engaged in trafficking of fentanyl and other illicit opioids. This bill requires that the sanctions specified in Executive Order 14059 (relating to sanctions on foreign persons involved in the global illicit drug trade), as well as any amendments to or directives issued pursuant to that executive order before the date of the enactment of this bill, shall remain in effect. The bill also requires the President to impose property-blocking sanctions on any foreign person knowingly involved in (1) significant trafficking of fentanyl, fentanyl precursors, or other related opioids by a transnational criminal organization; or (2) significant activities of a transnational criminal organization relating to the trafficking of fentanyl, fentanyl precursors, or other related opioids. The Department of the Treasury is authorized to take certain actions relating to classes of transactions that (1) involve a non-U.S. jurisdiction, and (2) are of primary money laundering concern in connection with illicit opioid trafficking. For such transaction classes, Treasury may require domestic financial institutions to (1) take certain special measures, (2) prohibit certain transmittals of funds, or (3) impose conditions on transmittals of funds. Treasury's Financial Crimes Enforcement Network must issue guidance to U.S. financial institutions for filing reports of suspicious transactions related to suspected fentanyl trafficking by transnational criminal organizations.

Love Lives On Act of 2023

Love Lives On Act of 2023 This bill extends entitlement for various benefit programs and services for surviving spouses of deceased members of the Armed Forces or veterans. First, the bill removes the expiration on a surviving spouses' entitlement to educational assistance through the Marine Gunnery Sergeant John David Fry Scholarship (Fry Scholarship). The bill also provides that the remarriage of a surviving spouse must not bar the furnishing of dependency and indemnity compensation to such spouse. Next, the Department of Defense may not terminate the payment of an annuity for a surviving spouse under the Survivor Benefit Plan solely because the surviving spouse remarries. Additionally, the bill provides commissary store and MWR retail facility (e.g., exchange store) access to surviving spouses regardless of the martial status of the spouse. Such spouses must be entitled to use such stores and facilities to the same extent and on the same basis as surviving spouses who did not remarry. The bill expands the definition of a dependent under TRICARE to include a remarried widow or widower whose subsequent marriage has ended due to death, divorce, or annulment. Finally, the bill modifies the definition of a surviving spouse for purposes of veterans benefits to include same sex marriages.

SMART Prices Act

Strengthening Medicare And Reducing Taxpayer Prices Act or the SMART Prices Act This bill modifies requirements of the Medicare Drug Price Negotiation Program and makes other changes with respect to the prices of prescription drugs under Medicare. Current law requires the Centers for Medicare & Medicaid Services (CMS) to negotiate maximum prices for brand-name drugs that do not have other generic equivalents and that account for the greatest Medicare spending. The CMS must negotiate the prices of 10 drugs that are covered under the Medicare prescription drug benefit in 2026, 15 drugs that are covered under the Medicare prescription drug benefit in 2027, 15 drugs that are covered under the Medicare prescription drug benefit or under Medicare medical services in 2028, and 20 drugs that are covered under the Medicare prescription drug benefit or under Medicare medical services in 2029 and each year thereafter. The bill requires the CMS to negotiate the prices of 20 drugs under the Medicare prescription drug benefit in 2026 and 40 drugs under the Medicare prescription drug benefit or under Medicare medical services in 2027 and each year thereafter. It also (1) shortens the required period of market approval from 7 years and 11 years for drugs and biologics, respectively, to 3 years; and (2) modifies the ceiling for the maximum fair price for short-, extended-, and long-monopoly drugs. The bill also repeals provisions that prohibit the CMS from interfering in negotiations between drug manufacturers, pharmacies, and PDP sponsors (i.e., noninterference clause).

Uyghur Policy Act of 2023

Uyghur Policy Act of 2023 This bill addresses human rights issues concerning the Uyghurs and other persecuted minority groups in China, particularly in the Xinjiang Uyghur Autonomous Region (XUAR). Specifically, the bill requires the Department of State to support human rights advocates representing these groups to speak at public diplomacy forums, including in Muslim-majority countries; ensure that Uyghur language training is available to Foreign Service officers; make every effort to ensure a Uyghur-speaking member of the Foreign Service is assigned to U.S. diplomatic and consular missions in China, Turkey (Türkiye), and other nations with Uyghur populations; and submit to Congress a strategy to secure the release of political prisoners in China. The bill also requires the State Department and the U.S. Permanent Representative to the United Nations (U.N.) to support the appointment of a U.N. special rapporteur or working group to monitor and report on human rights violations and abuses in the XUAR, oppose any efforts to prevent consideration of issues related to the XUAR at the United Nations, and oppose any efforts to prevent Uyghur human rights advocates from participating in certain U.N. events.

21st Century Entrepreneurship Act

21st Century Entrepreneurship Act This bill requires the Small Business Administration (SBA) to develop a curriculum for volunteers with the Service Corps of Retired Executives (SCORE) to teach underrepresented students (e.g., minority students, English learners, and children with disabilities) about entrepreneurship. The SBA shall develop and implement a strategy to encourage partnerships between the SCORE program and community learning centers to teach this curriculum and, in developing the curriculum, collaborate with education specialists and groups with experience serving underrepresented children. The SBA must submit a biennial report on partnerships between the SCORE program and community learning centers, the use of funds by the program, the number of students reached through the entrepreneurship curriculum, and plans for improving the curriculum.

Coin Metal Modification Authorization and Cost Savings Act of 2023

Coin Metal Modification Authorization and Cost Savings Act of 2023 This bill authorizes the United States Mint to modify the metallic composition of circulating coins (including by prescribing reasonable manufacturing tolerances with respect to those coins) if a study and analysis conducted by the Mint indicates that the modification will reduce costs incurred by the taxpayers; be seamless, which means that the coins must have the same weight and diameter as current coins and that the coins work interchangeably in most coin acceptors using electromagnetic signature technology; and have as minimal an adverse impact as possible on the public and stakeholders. The Mint must notify Congress before making the modification and provide a justification for the modification. Congress may disapprove of any proposed modification through a joint resolution.

EARN IT Act of 2023

Eliminating Abusive and Rampant Neglect of Interactive Technologies Act of 2023 or the EARN IT Act of 2023 This bill revises the federal framework governing the prevention of online sexual exploitation of children. The bill establishes the National Commission on Online Child Sexual Exploitation Prevention. The commission must develop best practices for interactive computer services providers (e.g., Facebook and Twitter) to prevent, reduce, and respond to the online sexual exploitation of children. Additionally, the bill limits the liability protections of interactive computer service providers with respect to claims alleging violations of child sexual exploitation laws. The bill replaces various statutory references to child pornography and material that contains child pornography with child sexual abuse material . Finally, the bill makes changes to the reporting requirements for electronic communication service providers and remote computing service providers (providers) who report apparent instances of crimes involving the sexual exploitation of children to the National Center for Missing and Exploited Children. Among the changes, the bill requires providers to report facts and circumstances sufficient to identify and locate each minor and each involved individual. The bill also increases the amount of time that providers must preserve the contents of a report.

Do No Harm Act This bill prohibits the application of the Religious Freedom Restoration Act of 1993 (RFRA) to specified federal laws or the implementation of such laws. Currently, RFRA prohibits the government from substantially burdening a person's exercise of religion even if the burden results from a rule of general applicability, except in furtherance of a compelling governmental interest when using the least restrictive means. Under the bill, RFRA is inapplicable to laws or the implementation of laws that protect against discrimination or require the promotion of equal opportunity (e.g., the Civil Rights Act of 1964); require employers to provide wages, other compensation, or benefits, including leave; protect collective activity in the workplace; protect against child labor, abuse, or exploitation; or provide for access to, information about, referrals for, provision of, or coverage for any health care item or service. The bill prevents RFRA from being used to deny (1) goods or services the government has agreed to provide to a beneficiary of or participant in a program or activity funded by a government contract, grant, agreement, or other award; or (2) a person's full and equal enjoyment of a government-provided good, service, benefit, facility, privilege, advantage, or accommodation. In order for a person to assert a RFRA claim or defense in a judicial proceeding, the government must be a party to the proceeding.  

Workplace Violence Prevention for Health Care and Social Service Workers Act

Workplace Violence Prevention for Health Care and Social Service Workers Act This bill requires the Department of Labor to address workplace violence in health care, social service, and other sectors. Specifically, Labor must issue an interim occupational safety and health standard that requires certain employers to take actions to protect workers and other personnel from workplace violence. The standard applies to employers in the health care sector, in the social service sector, and in sectors that conduct activities similar to those in the health care and social service sectors. In addition, Labor must promulgate a final standard within a specified time line.

A resolution recognizing the designation of the week of April 11 through April 17, 2023, as the sixth annual "Black Maternal Health Week" to bring national attention to the maternal health crisis in the United States and the importance of reducing maternal mortality and morbidity among Black women and birthing persons.

Ending Trading and Holdings In Congressional Stocks (ETHICS) Act This bill generally prohibits Members of Congress (and their spouses and dependents) from purchasing or selling certain investments, such as individual stocks and related financial instruments that are not diversified investment funds, Treasury securities, or other specified holdings. Violations of this prohibition are subject to specified civil penalties. Members must certify their compliance with the provisions of the bill, and the applicable House or Senate ethics office must make the certifications and related information (e.g., trust agreements; descriptions of assets held in trusts; and federal loans, grants, or related benefits that the Member received) available online. Additionally, the bill restricts certain communications between trustees and beneficiaries related to investments held in qualified blind trusts. Violations of the restriction are subject to specified civil penalties. Further, the bill imposes penalties for failing to comply with existing financial disclosure requirements and requires electronic filing of those disclosures in a searchable format.

Invest to Protect Act of 2023

Grant funds may be used for various activities, including to provide de-escalation training and improve recruitment and retention.

Evapotranspiration Data Act

Open Access Evapotranspiration Data Act This bill directs the U.S. Geological Survey (USGS) to establish an Open Access Evapotranspiration (OpenET) Data Program that supports the operational distribution of satellite-based evapotranspiration data generated under the program to sustain and enhance water resources. The bill defines evapotranspiration as the process by which water is transferred from the land to the atmosphere by (1) evaporation from soil and other surfaces, and (2) transpiration from plants. Under the program, the USGS must provide for the delivery of evapotranspiration data to advance the quantification of evaporation and consumptive water use and to provide data users with estimates of evapotranspiration data across large landscapes over certain periods of time.

Global Health, Empowerment and Rights Act This bill establishes that a foreign nongovernmental organization shall not be disqualified from receiving certain U.S. international development assistance solely because the organization provides medical services using non-U.S. government funds if the medical services do not violate the laws of the country in which they are being provided and would not violate United States federal law if provided in the United States. Such foreign organizations shall not be subject to requirements relating to their use of non-U.S. funds for advocacy or lobbying activities, other than those that apply to U.S. nongovernmental organizations.

MicroCap Small Business Investing Act of 2023

MicroCap Small Business Investing Act of 2023 This bill authorizes the Small Business Administration (SBA) to issue up to ten Small Business Investment Company (SBIC) licenses each year to certain applicants. An SBIC is a privately owned company, licensed and regulated by the SBA, which invests in small businesses through debt and equity. A license issued under the bill must be awarded to an applicant that would otherwise be issued a license except that the management of the applicant does not satisfy certain qualification requirements such as investment experience; where the fund managers have a documented record of successful business experience, a record of business management success, or knowledge in the particular industry or business in which the investment strategy is being pursued; and that will make at least 25% of its investments in specified areas and businesses (e.g., low-income communities, businesses owned or controlled by individuals in underserved communities, and rural areas). The SBA must prioritize applicants that are located in states with fewer licenses and establish a streamlined application process for those licenses.

Lower Drug Costs for Families Act

Lower Drug Costs for Families Act This bill applies certain Medicare prescription drug rebate requirements to prescription drugs that are available under private health insurance. Current law requires drug manufacturers to issue rebates to the Centers for Medicare & Medicaid Services for brand-name drugs without generic equivalents under Medicare that (1) cost $100 or more per year per individual, and (2) for which prices increase faster than inflation. Manufacturers that fail to comply are subject to civil penalties. The bill applies these requirements to prescription drugs that are available in the commercial market under private health insurance. It also indexes rebate calculations to drug prices in 2016 (as opposed to 2021).

Financial Compensation for CFPB Whistleblowers Act

Financial Compensation for CFPB Whistleblowers Act This bill requires the Consumer Financial Protection Bureau to provide awards to whistleblowers who report information resulting in monetary sanctions. Whistleblowers claiming an award are permitted to have legal representation. Anonymous whistleblowers claiming an award are required to have legal representation and must disclose their identity to the bureau. The bureau may not disclose an anonymous whistleblower's identity except in limited circumstances, including to other government agencies in the course of an investigation. The protections in this bill may not be waived by any employment agreement, including by a predispute arbitration agreement.

Failed Bank Executives Clawback Act

Failed Bank Executives Clawback Act This bill requires the Federal Deposit Insurance Corporation (FDIC) to claw back compensation paid to certain responsible parties when an insured depository institution is placed into FDIC receivership.  Specifically, all or part of the compensation paid the previous five years to an institution-affiliated party responsible for the condition of the institution must be paid to FDIC to prevent unjust enrichment and to assure that the party bears losses consistent with their responsibility. Compensation includes salary, bonuses, awards, and profits from buying or selling securities. The bill also expands the authority of the FDIC to claw back compensation of parties responsible for financial losses incurred by a financial company regardless of the process by which FDIC is appointed receiver.  Finally, the bill establishes that the creditors and shareholders of an insured depository institution's holding company are responsible for the losses when the institution is resolved by the FDIC.

EACH Act of 2023

Equal Access to Abortion Coverage in Health Insurance Act of 2023 or the EACH Act of 202 3 This bill requires federal health care programs (e.g., Medicaid, Medicare, and the Children's Health Insurance Program (CHIP)) to provide coverage for abortion services and requires federal facilities to provide access to those services. Currently, coverage for such services under federal programs is generally only available in the case of rape, incest, or life endangerment. Additionally, the bill repeals certain provisions of the Patient Protection and Affordable Care Act that permit states to prohibit coverage of abortion services in plans offered through a health insurance exchange in the state. The bill also permits qualified health plans to use funds attributable to premium tax credits and reduced cost sharing assistance to pay for abortion services. The bill is not subject to the Religious Freedom Restoration Act of 1993, which generally prohibits the federal government from substantially burdening a person's exercise of religion even if the burden results from a generally applicable law.

National Plan to End Parkinson’s Act

National Plan to End Parkinson's Act This bill requires the Department of Health and Human Services (HHS) to carry out a project to prevent and cure Parkinson's disease (a progressive brain disorder that causes unintended or uncontrollable movements) and related conditions. Among other components of the project, HHS must (1) implement and periodically update a national plan to coordinate and guide efforts to prevent, slow the progression of, and cure the disease; and (2) improve diagnosis, treatment, and care of those with the disease. HHS must also annually assess the preparations for and response to the increased burden of Parkinson's disease. In addition, the bill establishes a council, comprised of federal and nonfederal stakeholders, to advise HHS on and make recommendations concerning the prevention and treatment of Parkinson's disease. The provisions of the bill terminate at the end of calendar year 2035.

Combating Illicit Xylazine Act

Combating Illicit Xylazine Act This bill criminalizes the illicit use of xylazine. (Xylazine, also known as Tranq , is a sedative that is approved for use in animals. The Drug Enforcement Administration (DEA) has reported an increase in the trafficking of fentanyl mixed with xylazine.) Specifically, the bill establishes criminal penalties for manufacturing, distributing, or dispensing, or possessing with intent to manufacture, distribute, or dispense, xylazine for illicit use (i.e., for use in humans) in accordance with the penalties for schedule III substances (up to 10 years imprisonment or, if death or serious bodily injury occurs, up to 15 years imprisonment, as well as criminal fines). In addition, the DEA must coordinate with the Food and Drug Administration to report on the prevalence of the illicit use of xylazine, including associated supply chains. The bill also declares the illicit use of xylazine as an emerging drug threat.
