This resolution condemns the imprisonment of Cuban democracy and human rights activist Jose Daniel Ferrer and calls for the release of Ferrer and all members of the Patriotic Union of Cuba (UNPACU). The resolution further commends Ferrer and recognizes the contributions of UNPACU for advancing human rights and fundamental freedoms in Cuba.

Significant Transnational Criminal Organization Designation Act This bill makes membership in a significant transnational criminal organization a ground for inadmissibility into the United States and provides for criminal penalties against those that provide material support to such an organization. The bar against admission applies to an alien member of such an organization and an alien spouse or child of such an individual. The bar shall not apply to a spouse or child who (1) did not know, or should not reasonably have known, that the individual was a member of such an organization; or (2) has renounced the organization in question. The bill establishes statutory authority and procedures for the Department of Justice to designate an organization a significant transnational criminal organization. The Department of the Treasury may require U.S. financial institutions to block transactions involving assets belonging to such an organization. An individual who knowingly provides material support or resources to a significant transnational criminal organization (or attempts or conspires to do so) shall be fined, imprisoned for up to 20 years, or both. If the death of any person is the result, the offending individual may be imprisoned for any term of years or for life. A financial institution that becomes aware that it possesses or controls funds belonging to such an organization shall retain such funds and notify Treasury.

This bill requires the U.S. Executive Director of the International Bank for Reconstruction and Development to oppose any extension of financial or technical assistance by the bank to a country that both exceeds the graduation threshold of the bank and is designated as a country of particular concern for religious freedom.

Financial Institution Customer Protection Act of 2019 This bill specifies that a federal banking agency may not request or order a depository institution to terminate a customer account unless (1) the agency has a valid reason for doing so, and (2) that reason is not based solely on reputation risk. Valid reasons for terminating an account include threats to national security and involvement in terrorist financing, including state sponsorship of terrorism. A federal banking agency requesting a termination must provide the depository institution with notification and justification. The bill also sets forth additional requirements for the Department of Justice when seeking subpoenas, summoning witnesses, or compelling document production in the course of conducting a civil investigation in contemplation of a civil proceeding involving certain banking laws.

Head Start Improvement Act of 2019 This bill replaces the existing Head Start program with block grants to states and Indian tribes for prekindergarten (pre-K) education. Instead of providing direct financial assistance to Head Start agencies, the Department of Health and Human Services (HHS) shall allot block grant funds for pre-K education among eligible states and tribes in accordance with their relative proportions of children, age three, four, or five, from low-income households. Grant recipients shall use the grant funds to (1) award subgrants to eligible entities that provide pre-K education programs; (2) administer such programs; and (3) provide technical assistance, oversight, monitoring, research, and training. Under current law, HHS is authorized to designate, monitor, and establish standards for Head Start agencies. The bill instead shifts pre-K program oversight and control to states and tribes, which shall have full flexibility to use grant funds to finance the pre-K programs of their choice. In addition, to the extent permitted under state law, grant recipients may use grant funds to establish (1) portable voucher systems that allow costs to be paid for attendance at private pre-K education programs; and (2) an education savings account that allows a parent of a low-income child to use a portion of the grant funds, or other available public or private funds added to the account, for expenses related to prekindergarten education. Under current law, federal financial assistance for a Head Start program is generally limited to 80% of total program costs. The bill maintains this limitation by requiring grant recipients to provide matching funds equal to 20% of the grant amount.

Veterans Burn Pits Exposure Recognition Act of 2019 This bill establishes a presumption, for purposes of Department of Veterans Affairs (VA) health care benefits and wartime disability compensation, that a veteran was exposed to certain toxins, chemicals, and hazards from burn pits if such veteran served on active duty in a covered location during a specified time frame. A burn pit is an area used for burning solid waste in open air. Specifically, the bill identifies the following covered locations and corresponding time periods Iraq, between August 2, 1990, and February 28, 1991, as well as from March 19, 2003, until burn pits are no longer used in this location; Southwest Asia (including Kuwait, Saudi Arabia, Bahrain, Oman, Qatar, and the United Arab Emirates), from August 2, 1990, until burn pits are no longer used in these locations; Afghanistan and Djibouti from September 11, 2001, until burn pits are no longer used in these locations; and other locations and time periods set forth by the Airborne Hazards and Open Burn Pit Registry or determined by the VA. Under the bill, if an exposed veteran submits insufficient evidence to establish a service-connection for purposes of disability compensation, the VA shall provide a medical examination and request medical opinions regarding a causal link between the disability and a toxin, chemical, or hazard.

Public Water Supply Invasive Species Compliance Act of 2019 This bill addresses transfers between Texas, Arkansas, and Louisiana of water that contains invasive species. The bill exempts certain water transfers between public water supplies in Texas, Arkansas, and Louisiana from prohibitions on illegal trade of plants and wildlife. Specifically, the prohibitions do not apply to covered water transfers containing prohibited species if the species are present in both public water supplies before the transfer, the water is subject to effective mitigation measures, and the water is transferred directly between the supplies; or the water is transferred in a closed conveyance system, such as a pipe system, and sent directly to treatment facilities where the species will be destroyed. The costs of the mitigation measures must be borne by the entity that sells the water for financial gain. Finally, the bill establishes notification requirements for water transfers.

Gordon, the crew of Apollo 12; commends the efforts of all of the individuals of the United States who contributed to the achievement of the Moon landing; and supports continued U.S. leadership in the exploration and use of space through human spaceflight.

Keep Our Communities Safe Act of 2019 This bill revises provisions related to the authority of the Department of Homeland Security (DHS) to detain aliens. DHS may detain an alien pending a removal decision for any length of time until the alien is subject to a final removal order. DHS must detain certain aliens, such as those convicted of an aggravated felony, beyond certain time limits for detaining an alien. The authority of the Department of Justice to review DHS custody decisions concerning an alien awaiting a removal decision shall be limited to whether the alien may be detained, released on bond, or released with no bond. DHS may release such an alien on bond only if the alien is not a flight risk or risk to the community. For an alien subject to a removal order, DHS may extend the 90-day removal period (generally the window in which DHS has to remove an alien after a final order of removal) in certain instances, such as when the alien's removal is stayed during an appeal. DHS may continue to detain an alien beyond the removal period and any removal period extensions. DHS shall periodically certify a justification for detaining an alien beyond the removal period. DHS shall establish a detention review process for aliens who (1) have made all reasonable efforts to comply with a removal order, and (2) are not subject to mandatory detention. DHS shall use the review process to determine whether an alien should be detained or released with conditions.

Patient Access to Higher Quality Health Care Act of 2019 This bill repeals specified limitations, for purposes of Medicare participation, on self-referrals by newly constructed or expanded physician-owned hospitals.

National Purple Heart Honor Mission Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue $5 gold coins, $1 silver coins, and half-dollar clad coins emblematic of the mission of the National Purple Heart Honor Mission. The bill limits the issuance of such coins to the one-year period beginning on January 1, 2022. The bill prescribes surcharges for coin sales, which shall be paid to the National Purple Heart Honor Mission, Inc., to support the mission of such organization, including capital improvements to the National Purple Heart Honor Mission facilities.

National Aeronautics and Space Administration Authorization Act of 2019 This bill reauthorizes the National Aeronautics and Space Administration (NASA) for FY2020. The bill provides for continued use of the International Space Station through 2030 and authorizes NASA programs and activities, including a rocket engine test infrastructure program, a low-Earth orbit commercialization program, a Lunar Discovery Program for lunar science research, a 21st Century Aeronautics Capabilities Initiative, a Skilled Technical Education Outreach Program for secondary school students, and a 21st Century Space Launch Infrastructure Program. NASA shall establish the Planetary Defense Coordination Office to implement a program for surveying threats posed by near-Earth objects equal to or greater than 140 meters in diameter. NASA shall also continue providing opportunities for formal and informal STEM (science, technology, engineering, and mathematics, including computer science) education engagement activities, including under the Established Program to Stimulate Competitive Research (EPSCoR).

Global Hostage Act of 2019 This bill directs the President to impose property- and visa-blocking sanctions on foreign individuals or entities that knowingly participate in or are complicit in politically motivated harassment, abuse, arrest or imprisonment of a U.S. citizen or permanent resident. The sanctions also apply to those that materially assist or support such actions and those that provide significant support to an individual or entity sanctioned under this bill.

Protecting American Jobs Act This bill modifies provisions governing the National Labor Relations Board to repeal the authority of the General Counsel of the board, to issue, and prosecute before the board, complaints of unfair labor practices; limit the board's rulemaking authority to rules concerning the internal functions of the board; prohibit the board from promulgating regulations affecting the substantive or procedural rights of any person, employer, employee, or labor organization, including rules concerning unfair labor practices and representation elections; repeal the board's authority to prevent persons from engaging in unfair labor practices, limiting such authority to the investigation of allegations of such practices; and repeal the board's authority to petition courts for enforcement of its orders, seek injunctions, or hold hearings on jurisdictional strikes.

This resolution expresses the sense of the Senate that the United States is committed to supporting peace in South Sudan and should continue providing assistance to meet the humanitarian needs of the South Sudanese people; the incumbent government and all other signatories of the Revitalized Agreement on the Resolution of the Conflict in the Republic of South Sudan should work to implement that agreement and establish a Revitalized Transitional Government of National Unity; the Department of State should monitor implementation of the United Nations' South Sudan mandate and ensure any return or relocation of internally displaced persons from UN protection of civilian sites is safe, voluntary, and dignified; the State Department should monitor human rights abuse and corruption in South Sudan and support peacebuilding, conflict prevention, transitional justice, and reconciliation efforts; the Department of the Treasury should use best efforts to prevent, investigate, and mitigate money laundering activities; the United States should support implementation and renewal of the UN Security Council arms embargo in South Sudan.

Growing American Innovation Now Act This bill modifies terminology for purposes of the New Source Review (NSR) permitting program of the Environmental Protection Agency (EPA). In order for a change to a stationary source to be a modification (a change to a stationary source that increases the air pollutant emissions or results in new pollutants) for purposes of the NSR permitting program, the maximum hourly emission rate achievable by such source must be higher than the maximum hourly rate achievable by such source during any hour in the 10-year period preceding the change. A change at a stationary source is not considered to be a modification under the bill if it is designed to (1) reduce the amount of any air pollutant emitted; or (2) restore, maintain, or improve the reliability of operations at, or safety of, the source. However, such changes are not excepted if the EPA determines the increase in the maximum achievable hourly emission rate from such change would cause an adverse effect on human health or the environment. Construction for a major emitting facility (a type of stationary source) does not include a change at such a facility that does not result in a significant emissions increase or a significant net emissions increase. In relation to major emitting facilities in nonattainment areas, the terms modifications and modified do not include changes at such facilities that do not result in a significant emissions increase or a significant net emissions increase.

This joint resolution condemns Turkey's hostilities against Kurdish forces in northeastern Syria and expresses support for a continued U.S. military presence in Syria, Iraq, and Afghanistan. Specifically, the joint resolution (1) calls on the U.S. government to pressure Turkey to curtail its hostilities against U.S. partner forces in Syria; (2) calls on the U.S. government and other nations to continue supporting, or to increase support for, stabilization efforts in northeastern Syria; (3) warns that a precipitous withdrawal of U.S. forces from the ongoing fight against terrorist groups in the region would be detrimental to the interests of the United States and its allies; and (4) otherwise expresses the sense of Congress regarding military, diplomatic, and humanitarian support in the region.

Davis-Bacon Repeal Act This bill repeals the Davis-Bacon Act (which requires that the locally prevailing wage rate be paid to various classes of laborers and mechanics working under federally-financed or federally-assisted contracts for construction, alteration, and repair of public buildings or public works). References in any law to a requirement under the Davis-Bacon Act shall be null and void.

Recognizing the Protection of Motorsports Act of 2019 or the RPM Act of 2019 This bill authorizes the modification of a vehicle's air emission controls for vehicles that are not legal for operation on a street or highway and are used solely for competition. In relation to the exemption of competition vehicles from anti-tampering provisions, the Environmental Protection Agency (EPA) is prohibited from creating or authorizing a database of vehicle registration information that is required to be consulted at the point of manufacture, sale, installation, or use of parts or components. Additionally, the EPA may not require the registration of a vehicle, or part or component of a vehicle, by the manufacturer, seller, purchaser, installer, or user of the vehicle. The regulation prescribed by the EPA regarding the exemption must include certain components, including a description of the reasonable conditions for the applicability of the exemption.

Dignity for Aborted Children Act This bill requires abortion providers to offer patients specified options concerning the human fetal tissue from an abortion. Specifically, patients must be given an informed consent form specifying the options to (1) take possession of the tissue for transfer to an entity that provides interment or cremations services, or (2) release the tissue to the provider. If the tissue is released to the abortion provider, the provider must ensure the tissue is interred or cremated within seven days of the procedure in a manner consistent with state law regarding the disposal of human remains. Abortion providers must report annually about the aggregate number of abortions performed and other specified information. The bill provides civil or criminal penalties for violations of disposal, informed consent, and reporting requirements.

Ensuring Accurate and Complete Abortion Data Reporting Act of 2019 This bill requires states, as a condition of federal payment under Medicaid for family planning services, to report certain abortion data to the Centers for Disease Control and Prevention (CDC). (Currently, reporting is voluntary.) The CDC must develop standardized questions for states with respect to specified variables (e.g., maternal demographics and methods of abortion).

Disaster Assistance Simplification Act This bill addresses the interaction of disaster recovery relief assistance provided by the Department of Housing and Urban Development (HUD) and the Small Business Administration (SBA). Specifically, the bill prohibits HUD and recipients of HUD disaster relief grants from (1) considering whether an applicant for assistance rejected a separate disaster loan from the SBA, or (2) reducing the amount of assistance by the amount of a rejected SBA loan.

Save Our Seas 2.0: Enhanced Global Engagement to Combat Marine Debris Act This bill directs the Department of State and the President to make efforts to reduce marine debris. The State Department shall implement the U.S. policy to cooperate with foreign governments and the private sector to combat marine debris, which includes support for (1) strengthening systems for processing and reusing waste plastic, (2) developing and using reusable alternatives to disposable plastic products, and (3) deploying technology for capturing value from post-consumer materials and municipal solid waste streams. The President shall direct U.S. representatives to various international bodies to support U.S. marine debris policies. The Environmental Protection Agency is authorized to build partnerships in support such policies. The State Department shall report to Congress on the potential for entering into new agreements or creating a new forum to reduce land-based sources of marine debris and derelict fishing gear.

Targeting Invasive Autocratic Networks, And Necessary Mandatory Export Notifications Act of 2019 or the TIANANMEN Act of 2019 This bill imposes sanctions on foreign entities related to surveillance in China's Xinjiang province. The President shall (1) report to Congress a list of foreign entities that provide the Chinese government with technology to conduct surveillance in Xinjiang; and (2) consider whether specified entities, such as China Communications Services Co. Ltd., should be on the list. Entities on the list shall be subject to Bureau of Industry and Security export licensing requirements. Such entities, and any corporate officer or primary shareholder, shall be subject to property-blocking sanctions. The Department of Commerce may not remove Huawei Technologies Co. Ltd. (or any subsidiaries or affiliates) from the President's list until the President certifies that Huawei (1) is not involved in activities contrary to U.S. national security or foreign policy interests, and (2) does not conduct or facilitate Chinese government surveillance in Xinjiang. U.S. entities that conduct transactions with entities on the President's list shall disclose such transactions to the Securities and Exchange Commission.

Negro Leagues Baseball Centennial Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue up to 50,000 $5 gold coins, 400,000 $1 silver coins, and 750,000 half-dollar clad coins in commemoration of the 100th anniversary of the establishment of the Negro National League, a professional baseball league that was formed in response to African-American players being banned from baseball's major leagues. The design of the coins shall be emblematic of the Negro Leagues Baseball Museum and its mission to promote tolerance, diversity, and inclusion. All surcharges from sales of these coins shall be paid to the Negro Leagues Baseball Museum for educational and outreach programs and exhibits.

Endangered Species Management Self-Determination Act This bill revises requirements governing the management of endangered or threatened species, establishes a process to compensate land owners under certain circumstances, and removes protections for black vultures and ravens. The Department of the Interior or the Department of Commerce must obtain the consent of each state for adding species to the list of threatened or endangered species when the species is present in the state. A state may regulate endangered or threatened species that are only present within the state. If a state elects to regulate them, it is given exclusive authority to manage them. State action with respect to such species is not subject to judicial review. Species are taken off the federal list after five years, but Interior may petition for the species to be relisted. The bill requires congressional approval before a species may be listed as endangered or threatened. The bill eliminates awards of attorney fees in citizen suits concerning endangered or threatened species. Owners or lessees of property may apply to Interior for a determination of whether a proposed property use will violate requirements governing endangered or threatened species. The use is deemed compliant if Interior fails to respond within 90 days. The owners and lessees may seek monetary compensation for unfavorable determinations. The bill removes migratory bird protections provided to black vultures and ravens in certain circumstances.

Eric's Law This bill modifies procedures with respect to capital sentencing hearings. If a jury at a capital sentencing hearing does not reach a unanimous recommendation on the defendant's sentence, then the court must order a new special sentencing hearing and impanel a new jury. If the new jury at the special sentencing hearing does not reach a unanimous recommendation on the defendant's sentence, then the court is prohibited from imposing a death sentence.

Visa Transparency Anti-Trafficking Act of 2019 This bill directs the Department of Homeland Security to build a searchable database with certain information about each temporary foreign nonimmigrant worker. The database shall include information such as (1) each worker's age, gender, and country of origin; (2) the type of visa used and the status of such visa; (3) where each worker is employed; and (4) each worker's occupation and the compensation received. The database shall only be available to (1) law enforcement, (2) service providers to human trafficking victims, (3) worker protection organizations, and (4) entities agreeing to use the information only for research purposes. The bill expands existing reporting requirements related to temporary foreign nonimmigrant workers to include additional information such as (1) the 10 employers that hired the most temporary foreign nonimmigrant workers, and (2) the 10 occupations with the most temporary foreign nonimmigrant workers.
