Family Farm Reorganization Act

Family Farm Reorganization Act - Establishes separate Federal bankruptcy provisions governing family farm reorganizations. Requires the court to appoint a trustee in a family farm reorganization case only if no U.S. trustee or standing trustee for personal bankruptcy cases has been appointed. Permits the court to appoint one or more standing trustees or a U.S. trustee to serve in a judicial district if warranted by the number of family farm reorganization cases. Sets forth duties and compensation of such trustees. Grants a debtor in possession in a family farm reorganization case the powers, functions, and duties, with specified exceptions, of a debtor in possession in a regular reorganization case. Authorizes the debtor in possession or the trustee to operate the debtor's farming and other businesses, unless the court orders otherwise. Requires the court or an appointed U.S. trustee to order the appointment of a committee of three unsecured creditors. Sets forth the powers and duties of such committee in a family farm reorganization case. Authorizes a party in interest, the Department of Agriculture, the U.S. Attorney General, or the chief officer of the agricultural agency of any State in which property of the debtor is located to raise, appear, and be heard on any issue in a family farm reorganization case. Provides for: (1) the removal of a debtor as the debtor in possession for cause or in the best interest of creditors; and (2) the reinstatement of a debtor as debtor in possession on request of a party in interest. Permits the debtor to convert a family farm reorganization case to a liquidation case at any time. Prohibits the court from converting a family farm reorganization case to a liquidation case if the debtor is: (1) a family farmer; or (2) a farmer or a corporation which is not a moneyed business or commercial corporation. Specifies grounds for dismissal of a case by the court. Allows any party in interest to file a family farm reorganization plan only if: (1) the debtor is not a debtor in possession; or (2) the debtor has not filed a plan or had a plan confirmed within specified periods. Sets forth required contents of a plan proposed by the debtor. Specifies restrictions on plan modifications. Sets forth conditions for court confirmation of a plan proposed by the debtor which allow deferred cash payments over up to six years on certain unsecured claims of governmental units. Provides that provisions governing the following aspects of a plan filed in a regular reorganization case shall apply to a plan filed in a family farm reorganziation case: (1) required contents of a plan filed by a party in interest other than the debtor; (2) post-petition disclosure and solicitation; (3) acceptance of the plan by interest and claim holders; (4) confirmation of a plan filed by a party in interest other than the debtor; (5) the effect of confirmation; (6) distribution under the plan; (7) revocation of an order of confirmation; (8) securities laws exemption; and (9) aircraft equipment and vessels. Authorizes adequate protection to be provided in a family farm reorganization case by the debtor paying to the trustee reasonable rent for the use of farmland. Authorizes the trustee in a family farm reorganization case to sell estate property free and clear of any interest of an entity other than the estate if the property is farmland or farm equipment. Provides for the filing and allowance of property claims and interest. Permits the court in a family farm reorganization case to authorize the obtaining of credit for emergency care of the debtor's stock without notice or a hearing if: (1) irreparable loss or damage will result if such authorization is delayed; and (2) such authorization is in the best interests of the estate. Establishes a $200 filing fee for a family farm reorganization case. Repeals this Act five years after its enactment.

Hazardous Substance Response Trust Fund Temporary Funding Act - Amends the Internal Revenue Code to extend temporarily the authority to collect Hazardous Substance Response Trust Fund (Superfund) excise taxes on petroleum and chemicals during the period beginning on the date of enactment of this Act and ending on the date the amount received totals $150,000,000. Terminates the authority to collect an excise tax on the receipt of hazardous waste at a qualified facility after September 30, 1985. Amends the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (Superfund) to permit advances to such trust fund to be made through May 13, 1986.

Africa Famine, Recovery and Development Fund Act of 1986 - Amends the Foreign Assistance Act of 1961 to authorize the President to provide aid for: (1) relief, rehabilitation, and recovery activities in Africa; and (2) long-term development in Africa. Sets forth the objectives of such long-term development assistance. Authorizes appropriations for FY 1988 through 1991 to carry out this Act. Makes certain other development and economic assistance funds available for assistance to Africa. Designates such authorizations and funds as the Africa Famine, Recovery and Development Fund. Authorizes the Agency for International Development (AID) to take whatever administrative steps are appropriate to provide goods and services for such assistance on an expedited basis and to finance goods and services normally found in the recipient country. Authorizes the President to make available to international organizations some of the assistance funds authorized by this Act. Encourages AID and the African Development Bank and the African Development Fund to cooperate on activities in support of the objectives of this Act. Expresses the sense of the Congress that the President should: (1) encourage the Organization for Economic Cooperation and Development, the International Bank for Reconstruction and Development, and the United Nations to take a leading role in coordinating development efforts in Africa; and (2) assist the efforts of such agencies. Expresses the sense of the Congress that the Secretary of State should coordinate a special effort to reduce trade barriers and encourage economic interchange with the developing countries of Africa. Includes in the President's annual report to the Congress on foreign aid programs a report on the progress made in carrying out this Act. Amends the Peace Corps Act to include in the President's annual report to the Congress on Peace Corps programs a report on the activities undertaken to carry out this Act.

New Clean Air Act - Amends the Clean Air Act to limit after 1991 the number of hours a fossil-fuel-burning electric generating facility which is a major stationary source of sulfur dioxide emissions may operate according to its emissions rate. Requires such major sources to attain by 1995 the best degree of emission reduction technically available. Requires the Administrator of the Environmental Protection Agency (EPA) to periodically publish demonstrated levels of emission reduction and to promulgate emission standards for oil shale production and processing facilities, synthetic fuels production facilities, and other categories of major energy-production sources. Sets emission standards for light-duty vehicles and engines for model years after 1989 and for heavy-duty vehicles and engines for model years after 1990. Prohibits the sale of diesel fuel with a sulfur content above a certain level determined by the Administrator. Requires State vehicle inspection programs to require emissions testing or direct inspection of components of vehicle emissions control systems. Provides for the assessment of daily civil penalties for violations of the fuel and fuel additive regulatory requirements. Directs the Administrator to implement a monitoring system for assessing the effects of acid deposition by 1988. Makes it a violation of the Clean Air Act if a State's air pollutant emissions contribute to the violation of another State's water quality standard under the Clean Water Act. Amends the Clean Water Act to state that such emissions endanger health or welfare abroad if they contribute to the violation of such country's water quality standards. Directs the President to negotiate with Canada and Mexico by 1987 to cooperate in reducing air pollution. Directs the President to negotiate treaties or other international agreements to apply uniform standards of performance for the control of air pollutant emissions. Directs the Secretary of the Treasury to report to the Congress by 1989 on a system of tariffs on emissions sufficient to encourage reductions.

States that collective bargaining agreements may only be repudiated after the National Labor Relations Board certifies election results in which a majority of the employees select a bargaining representative other than the representative with whom such agreement was made.

Requires the Office to collect specified data and to report such data to the SBA. Requires the General Accounting Office, not later than September 30, 1990, to prepare a report on the impact that contracts awarded to such organizations have on for-profit small businesses for FY 1987 through 1989. Requires such report to be transmitted to specified congressional committees. Establishes a task force on purchases from the blind and severely handicapped.

Directs the Secretary of Defense to prescribe regulations listing hostile foreign governments. Makes this Act inapplicable to the Coast Guard or the National Aeronautics and Space Administration.

Prohibits the Secretary, during the moratorium period, from issuing any regulations relating to the substantiation requirements with respect to deductions for the business use of vehicles or with respect to amounts included in income for the personal use of employer-provided vehicles.

Sets a maximum civil penalty of $10,000 for violations of FAA air transportation security regulations. Authorizes additional appropriations for civil aviation security programs equal to the penalties collected for such violations. Establishes a pay scale for police force employees of Washington National Airport and Washington Dulles International Airport.
