Federal Firearms Licensee Protection Act of 2017 This bill amends the federal criminal code to modify criminal penalties for an offense involving the theft of a firearm from a licensed importer, manufacturer, or dealer, or from their business premises. Specifically, the bill: increases from 10 to 20 years the maximum prison term, and creates a 3- or 5-year mandatory minimum prison term for an offense that occurs during the commission of a burglary or robbery. An attempt to commit an offense is subject to the same penalties as a substantive offense.

Lead-Safe Housing for Kids Act of 2017 This bill amends the Lead-Based Paint Poisoning Prevention Act to direct the Department of Housing and Urban Development (HUD) to promulgate regulations that: require owners of certain housing to initiate a lead-based paint hazard risk assessment before a family with a child under age six occupies such housing, unless lead-based paint has already been removed; state that a visual assessment alone is not sufficient for these purposes; and require owners to control lead-based paint hazards identified in the assessment within 30 days and provide certain notices to residents of the housing. These regulations shall apply to housing receiving federal assistance that was constructed before 1978, but exclude: single-family housing covered by an application for mortgage insurance under the National Housing Act, or multi-family housing that is covered by such an application but does not receive any other federal housing assistance. HUD regulations shall also require emergency relocation of such families, without placement on a waitlist, penalty (including rent payments to be made for that dwelling unit), or lapse in assistance, to a unit that was constructed in 1978 or later or to another unit of covered housing that has no lead-based paint hazards.

Keep Kids' Insurance Dependable and Secure Act of 2017 or the KIDS Act of 2017 This bill amends titles XI (General Provisions), XIX (Medicaid), and XXI (Children's Health Insurance Program) (CHIP) of the Social Security Act to extend funding for CHIP through FY2022 and otherwise revise provisions related to CHIP and Medicaid. The bill also extends funding through FY2022 for: the Child Enrollment Contingency Fund, the Childhood Obesity Demonstration Project, the Pediatric Quality Measures Program, and specified outreach and enrollment grants. In addition, the bill reauthorizes through FY2022: the qualifying-states option (which allows states that provided coverage to now CHIP-eligible children prior to CHIP's enactment to continue to provide such coverage), and the express-lane eligibility option (which allows states to use eligibility findings from other public benefit programs to determine children's eligibility for Medicaid and CHIP). Beginning in FY2020, the bill allows state child-health plans to adopt more restrictive eligibility standards with respect to children in families whose income exceeds 300% of the poverty line. Current law provides states with an enhanced Federal Matching Assistance Percentage (FMAP) for child-health assistance through FY2019. The bill maintains the enhanced FMAP in FY2020, but halves the percentage-point increase.

Reach Every Mother and Child Act of 2017 This bill directs the President to: establish a five-year strategy to achieve, with target countries and donors, the goal of ending preventable child and maternal deaths globally and ensure healthy and productive lives by 2030; and provide assistance to implement the strategy. The President shall designate a current U.S. Agency for International Development (USAID) employee serving in the Senior Executive Service or at the level of a Deputy Assistant Administrator or higher to serve concurrently as the Maternal and Child Survival Coordinator, who shall be responsible for: overseeing such strategy, and all U.S. government funds appropriated or used for international maternal and child health and nutrition programs. Strategy grants, contracts, and cooperative agreements shall include targets for increased implementation of high-impact, evidence-based interventions and strengthening health systems. The President shall report to Congress annually for six years regarding progress made toward achieving the strategy and ending preventable child and maternal deaths.

Restoring Integrity to America's Elections Act This bill amends the Federal Election Campaign Act of 1971 with respect to the Federal Election Commission (FEC) to: (1) reduce the number of members of the FEC from eight to five, (2) remove the Secretary of the Senate and Clerk of the House as ex officio members, and (3) permit no more than two members to be affiliated with the same political party. A majority of the FEC members serving at the time shall constitute a quorum, except that three shall constitute a quorum if there are only four members serving. A Blue Ribbon Advisory Panel shall recommend to the President individuals for nomination to the FEC. The President shall appoint the FEC Chair, subject to Senate confirmation as a member of the FEC. The powers of the FEC are revised and distributed between the chair and the other FEC members. Persons who submit written comments regarding requests for advisory opinions must be given an opportunity to appear at FEC hearings on such requests.

This bill amends the Consolidated Farm and Rural Development Act, with respect to the Community Facilities Direct Loan and Grant Program, to require the Department of Agriculture (USDA) to prioritize loans and grants for substance use disorder treatment services. (Under current law, the program provides funding to develop essential community facilities in rural areas.) The bill requires USDA to prioritize grants and loans for entities: (1) to develop facilities to provide substance use disorder (including opioid substance use disorder) prevention, treatment, or recovery services; and (2) that employ staff with appropriate expertise and training to identify and treat individuals with substance use disorders. An entity that receives funds pursuant to this bill may use the funds for the development of telemedicine facilities and systems to provide telemedicine for substance use disorder treatment.

Recreation Not Red-Tape Act This bill amends the Federal Lands Recreation Enhancement Act to require the Bureau of Land Management (BLM) and the Forest Service to review the process for the issuance and renewal of special recreation permits, including for cross-jurisdictional trips, with respect to outfitters and guides. The Department of the Interior and the Department of Agriculture (USDA) shall: (1) coordinate with states to allow the purchase of federal and state recreation passes at federal and state facilities in the same transaction, and (2) sell National Parks and Federal Recreational Lands Passes, and make payment of entrance and standard amenity recreation fees available, through federal websites. Interior and USDA should work with the Department of Defense and the Department of Veterans Affairs to ensure that service members and veterans have access to outdoor recreation and to outdoor-related volunteer and wellness programs. The Forest Service, BLM, and National Park Service may develop management plans for extending the recreation season or increasing recreation use during the offseason. The Forest Service and BLM shall evaluate land managers based on the achievement of applicable agency recreational and tourism goals. The Army Corps of Engineers, the Bureau of Reclamation, the Federal Energy Regulatory Commission, and the Department of Transportation shall consider how land and water management decisions can enhance recreation opportunities and the recreation economy. The bill amends the Omnibus Parks and Public Lands Management Act of 1996 to establish the Ski Area Fee Retention Account. A specified portion of rental charges for ski area permits on a Forest Service unit shall be deposited in such account, and a specified portion of such amounts shall be available to such unit for ski area administration, improvements, and visitor services. The bill establishes a National Recreation Area System to be comprised of existing National Recreation Areas and new units designated after enactment of this bill. Interior and USDA shall: (1) develop initiatives to enhance private-sector volunteer programs, actively promote private-sector volunteer opportunities, and provide outreach and coordination to the private sector to carry out projects and programs for the stewardship of federal land; and (2) establish an interagency trail management plan under which federal land management agencies shall coordinate so that trails that cross jurisdictional boundaries between those agencies are uniformly managed and maintained.

Viewer and Listener Protection Act of 2017 This bill establishes the Viewer and Listener Protection Fund through FY2022 to reimburse costs incurred by: (1) a multichannel video programming distributor (e.g. cable provider) in order to continue to carry the signal of a broadcast television licensee under specified conditions, and (2) a broadcast television station or broadcast radio station during the ongoing reorganization of the broadcast television spectrum. The Federal Communications Commission (FCC) is directed to modify the transition periods for broadcast television stations that are changing channels or broadcast frequencies as part of the reorganization to ensure their broadcasting is not stopped for a significant amount of time. The FCC shall also make an effort to preserve the coverage area and population served by a broadcast radio station that is impacted by the ongoing broadcast frequency reorganization.

Hizballah International Financing Prevention Amendments Act of 2017 This bill amends the Hizballah International Financing Prevention Act of 2015 to impose specified sanctions on: (1) foreign persons that knowingly assist in or provide support for fund raising or recruitment activities for Hizballah; (2) agencies of foreign governments that provide Hizballah with financial support, arms, or other assistance; and (3) Hizballah by reason of its narcotics trafficking and significant transnational criminal activities. The bill prescribes reporting requirements or reporting modifications with respect to: (1) foreign persons that knowingly assist or provide significant financial, material, or technological support for foreign persons assisting Hizballah; (2) financial institutions that are owned or organized under the laws of state sponsors of terrorism; (3) Hizballah's racketeering activities; (4) combating illicit tobacco trafficking networks used by Hizballah and other foreign terrorist organizations to finance their operations; (5) the estimated net worth of senior Hizballah officials and how their funds were acquired and used; and (6) revenue from Hizbollah's global logistics networks and legal measures available to target such networks.

Harry W. Colmery Veterans Educational Assistance Act of 2017 This bill revises education and related benefits provided to veterans, service members, dependents, and survivors. The bill amends the Post-9/11 veterans' educational assistance program to: remove certain time restrictions on program use; increase assistance for reservists, guardsmen, dependents, and surviving spouses and dependents; provide full eligibility for Post-9/11 Purple Heart recipients and certain reservists and guardsmen; provide an extra academic years' worth of benefits for STEM (science, technology, engineering, or mathematics) degree candidates; establish a five-year pilot program for high technology courses; restore eligibility for service members whose school closes in the middle of a semester; authorize funding to improve claims processing; permit assistance to be used at certain institutions that are not institutions of higher education; and pro-rate the housing stipend for reservists called to active duty. The bill authorizes the Edith Nurse Rogers STEM Scholarship to help veterans complete STEM degrees. The Yellow Ribbon program is extended to Fry Scholarship recipients (surviving dependents of service members who died on active duty) and certain Purple Heart recipients. (The Yellow Ribbon program helps veterans pay for higher education tuition and fee costs not covered by the Post-9/11 program.) The bill: (1) extends the Advisory Committee on Education, (2) increases survivors' and dependents' educational assistance, and (3) extends funding for state educational program approving agencies. The bill provides statutory authority for the veterans success of campus program which provides veterans with on-campus educational and vocational counseling. The Department of Veterans Affairs shall: (1) make a new determination regarding each denied veteran's claim for disability compensation in connection with full-body exposure to mustard gas or Lewisite at specified locations during World War II, and (2) presume such exposure unless there is affirmative evidence otherwise.

Modernizing the Pittman-Robertson Fund for Tomorrow's Needs Act of 2017 This bill amends the Pittman-Robertson Wildlife Restoration Act to make it one of the purposes of the Act to extend financial and technical assistance to the states for the promotion of hunting and recreational shooting. The bill also prescribes a formula for the allocation of funds apportioned to a state that may be used for any activity or project to recruit or retain hunters and recreational shooters. Amounts apportioned to the states from any taxes on pistols, revolvers, bows, and arrows may be used for hunter recruitment and recreational shooter recruitment. The funds apportioned to a state for wildlife restoration management may be used for related public relations. If a state has not used all of the tax revenues apportioned to it for firearm and bow hunter education and safety program grants, it may use its remaining apportioned funds for the enhancement of hunter recruitment and recreational shooter recruitment. Up to $5 million of the revenues covered into the wildlife restoration fund in the Treasury from any tax imposed for a fiscal year on the sale of certain bows, arrows, and archery equipment shall be available to the Department of the Interior exclusively for making hunter recruitment and recreational shooter recruitment grants that promote a national hunting and shooting sport recruitment program, including related communication and outreach activities.

Wounded Officers Recovery Act of 2017 This bill authorizes the Capitol Police Board to make payments from the United States Capitol Police Memorial Fund to employees of the U.S. Capitol Police who have sustained serious line-of-duty injuries. The board is required to issue specific regulations governing the fund's use for making such payments. These regulations shall ensure that the payments are in addition to, and do not otherwise affect, other forms of compensation payable to the employee, including worker's compensation benefits. The bill requires amounts received by the board in response to the shooting incident at the practice for the Congressional Baseball Game for Charity on June 14, 2017, to be deposited into the fund.

The bill also amends the Small Business Act to define "ESOP business concern" and allow such a concern to continue to qualify for loans, preferences, and other programs under such Act.

Commonsense Competition and Access to Health Insurance Act This bill amends the Patient Protection and Affordable Care Act to permit states to enter into interstate health care choice compacts under which qualified health plans may be offered in the small group market in all participating states while being subject to the laws and regulations of only the state in which the plan was written or issued. (Currently, interstate health care choice compacts apply to only qualified health plans in the individual market.) The Department of Health and Human Services (HHS) must request that the National Association of Insurance Commissioners (NAIC) report on health plans provided for under interstate health care choice compacts. HHS may also request that the NAIC include in the report concepts gathered from entities that have experience in offering qualified health plans in states in which those plans were not originally issued.

FUTURE Act

Furthering carbon capture, Utilization, Technology, Underground storage, and Reduced Emissions Act or the FUTURE Act This bill amends the Internal Revenue Code to extend and modify the tax credit for carbon dioxide sequestration. The bill modifies the credit to apply it to carbon oxide sequestration. (Carbon oxide refers to any of the three oxides of carbon: carbon dioxide, carbon monoxide, and carbon suboxide.) The bill also: allows certain new industrial or direct air capture facilities to qualify for the credit if construction begins before January 1, 2024; allows qualified projects to claim the credit for 12 years, beginning on the date the equipment was originally placed in service; increases the separate credit amounts, with respect to projects placed in service upon or after the enactment of this bill, that apply to captured carbon oxide that is: (1) disposed of in secure geological storage, and (2) used as a tertiary injectant in an enhanced oil or natural gas recovery project and disposed of in secure geological storage; expands the purposes for which captured carbon oxide may be used; establishes separate carbon oxide capture thresholds for electricity generating facilities, direct air capture facilities, and facilities used for other purposes; specifies that the 75 million metric ton cap on the carbon dioxide that may qualify for the credit applies to carbon oxide and only to projects placed in service before the enactment of this bill; and allows the credit to be transferred from the entity that owns and uses the capture equipment to the entity that disposes of or uses the carbon oxide.

Modernizing Recreational Fisheries Management Act of 2018

Modernizing Recreational Fisheries Management Act of 2017 This bill requires the National Oceanic and Atmospheric Administration (NOAA) to enter into an arrangement with the National Academy of Sciences to conduct a study of the South Atlantic and Gulf of Mexico mixed-use fisheries. The bill authorizes a regional fishery management council to use alternative fishery management measures in developing a fishery management plan for a recreational fishery or the recreational component of a mixed-use fishery. The bill establishes a temporary moratorium on any new limited access privilege programs (programs whereby limited access privileges to harvest a portion of the total allowable catch in a fishery are issued by federal permit) in mixed-use fisheries under the jurisdiction of the South Atlantic or Gulf of Mexico Fishery Management Councils. Additionally, the bill establishes exemptions from annual catch limit requirements for certain fisheries. NOAA must follow certain guidelines before issuing a new exempted fishing permit. NOAA must develop a report on facilitating greater incorporation of data, analysis, stock assessments, and surveys from state agencies and nongovernmental sources into fisheries management decisions. NOAA must also establish partnerships with states and make grants to improve recreational fisheries data collection.

Orphan Products Extension Now Accelerating Cures and Treatments Act of 2017 This bill amends the Federal Food, Drug, and Cosmetic Act to require the Food and Drug Administration (FDA) to extend by six months the exclusivity period for an approved drug or biological product when the product is additionally approved to prevent, diagnose, or treat a new indication that is a rare disease or condition (also known as an orphan disease). The FDA may revoke an extension if the application for the new indication contained an untrue material statement. The FDA must notify the public of products that receive this extension and patents related to those products. Products may receive only one of these extensions. This extension is in addition to other extensions. Only products approved after enactment of this bill for a new indication that is a rare disease or condition are eligible for an extension. For a medication to be approved as an orphan drug with seven years of marketing exclusivity when it is the same medication for the same condition as an already approved orphan drug, the sponsor of the new medication must demonstrate that the new medication is clinically superior to the approved medication. The bill expands to cover brand name drugs provisions that allow generic drugs to be approved and marketed without labeling for pediatric indications when the pediatric indications are protected by patent or marketing exclusivity.

Consumer Financial Protection Bureau Examination and Reporting Threshold Act of 2017 This bill amends the Consumer Financial Protection Act of 2010 to raise the examination threshold that brings an insured depository institution or insured credit union within its supervisory purview from assets of $10 billion or more to assets of $50 billion or more. The bill increases from assets of $10 billion or less to assets of $50 billion or less the size of an insured depository institution or insured credit union that is subject to the Act's reporting requirements.

Voting Rights Advancement Act of 2017

Voting Rights Advancement Act of 2017 This bill amends the Voting Rights Act of 1965 to allow a representative official of an Indian tribe, with authorization from the governing body of the tribe, to request one or more polling places to be located on tribal lands. The state or political subdivision shall provide each requested polling place at no expense to the Indian tribe if certain criteria are met. A federal court shall retain jurisdiction to enforce constitutional voting guarantees, but also certain violations of the Act as well as of any federal prohibition against discrimination on the basis of race, color, or membership in a language minority group, for an appropriate period to prevent commencement of new devices to deny or abridge the right to vote. Any state (and all of its political subdivisions) shall be subject to certain requirements for a 10-year period if: 15 or more voting rights violations occurred there during the previous 25 years; or 10 or more violations occurred during the previous 25 years, at least one of which was committed by the state itself (as opposed to a political subdivision within it). A state or political subdivision that obtains a declaratory judgment that it has not used a device to deny or abridge the right to vote shall be exempt from such requirements unless as specified. This bill prescribes transparency requirements regarding any changes to specified matters. Department of Justice authority to assign observers receives new extensions. Courts shall grant preliminary injunctive relief if a complainant raises a serious question whether the challenged covered practice violates the Act or the Constitution and, on balance, the hardship imposed upon the defendant by the relief will be less than the hardship on the plaintiff if the relief were not granted.

Charities Helping Americans Regularly Throughout the Year Act of 2017 This bill amends the Internal Revenue Code to modify several tax provisions affecting charitable contributions and tax-exempt organizations. The Internal Revenue Service may determine the standard mileage rate for deducting the cost of using a passenger automobile for charitable purposes (currently set by statute at 14 cents per mile), and the rate may not be less than the rate for medical purposes (17 cents per mile for 2017). The bill modifies the substantiation requirements for charitable contributions to eliminate an exemption for contributions that are reported on a return filed by a tax-exempt organization. Tax-exempt organizations must file their returns in electronic form. The bill excludes from the gross income of an individual who is at least 70-1/2 years of age up to $100,000 in distributions from an individual retirement plan to a donor-advised fund (DAF). The bill also modifies disclosure requirements for DAFs. (A DAF is a fund or account that is separately identified by reference to contributions of a donor or donors. The account is owned and controlled by a sponsoring charitable organization, while the donor retains advisory privileges with respect to the distribution and investment of funds in the account.) The bill reduces from 2% to 1% the excise tax on the investment income of private foundations and eliminates a provision that reduces the rate to 1% if a foundation meets certain distribution requirements. The bill exempts certain philanthropic business holdings from the tax on excess business holdings of private foundations if a foundation meets requirements for exclusive ownership, donating all profits to charity, and independent operation.

Freedom for Americans to Travel to Cuba Act of 2017 This bill states that: (1) the President may not prohibit or otherwise restrict travel to or from Cuba by U.S. citizens or legal residents, or any of the transactions incident to such travel, including banking transactions; and (2) any law, regulation, or policy in effect on the date of enactment of this bill that prohibits or otherwise restricts such travel or transactions incident to such travel shall cease to have any force or effect. Nothing in this bill may be construed to limit the President's authority to restrict such travel or any transaction incident to such travel if the President determines that such restriction is necessary to protect: (1) U.S. national security, or (2) the health or safety of U.S. citizens or legal residents resulting from traveling to or from Cuba. Prior to restricting travel to Cuba, the President shall submit a written justification to Congress.

This bill requires the Environmental Protection Agency (EPA) to establish an Early Action Compact Program, which allows an area that is not attaining the eight-hour ozone national ambient air quality standard (NAAQS) to obtain a deferment of a nonattainment designation upon the relevant state, local, and tribal government voluntarily developing an early action compact plan. The eight-hour ozone NAAQS measures ozone levels over eight-hour periods to determine the amount of ground-level ozone (i.e., smog) in the environment. The EPA: (1) must issue a decision on each early action compact plan no later than one year after it is submitted, and (2) may not designate an area as a nonattainment area until it has issued a decision to approve or deny a plan. The EPA must establish separate requirements relating to winter ozone levels for each early action compact plan.

FDA Regulatory Efficiency Act This bill amends the Federal Food, Drug, and Cosmetic Act to require the Food and Drug Administration (FDA) to establish a third-party quality system assessment program to accredit persons to assess whether a medical device manufacturer's quality system can ensure the safety and effectiveness or substantial equivalence of an approved medical device after certain changes, including changes in manufacturing or changes to enhance device safety. Device manufacturers with quality systems that have been certified by an accredited person are allowed to make changes to a device without submitting to the FDA the premarket notification, 30-day notice, or premarket approval supplement that would otherwise be required. An accredited person who assesses a device manufacturer's quality system must submit a summary of their assessment and, as appropriate, a certification of the quality system to the FDA within 30 days of the assessment. An assessment summary and certification is deemed accepted by the FDA 30 days after submission unless the FDA determines that additional information is needed to support certification, the assessment or certification is unwarranted, or an action other than acceptance of the certification is otherwise justified. Device manufacturers who make changes to devices without submitting a premarket notification must describe the changes in an annual summary submitted to the FDA. Changes made without submitting a 30-day notice or a premarket approval supplement must be described in a periodic report. Certifications accepted by the FDA remain in effect for two years. The FDA must report on this quality system assessment program no later than January 31, 2022. The program is terminated at the end of FY2022.

Freedom from Discrimination in Credit Act of 2017 This bill amends the Equal Credit Opportunity Act (ECOA) to expand the categories of prohibited discrimination when extending credit to include discrimination on account of sexual orientation or gender identity. (Currently, such discrimination in credit is prohibited only on the basis of race, color, religion, national origin, sex or marital status, or age.) The bill defines: (1) "gender identity" as the gender-related identity, appearance, or mannerisms or other gender-related characteristics of an individual with or without regard to the individual's designated sex at birth; and (2) "sexual orientation" as homosexuality, heterosexuality, or bisexuality. The bill specifies that for purposes of the ECOA's protections against sex discrimination, the term "sex" includes: (1) a sex stereotype; (2) pregnancy, childbirth, or a related medical condition; and (3) sexual orientation or gender identity. The bill also extends ECOA's protections against discrimination to include: (1) an association with another person who is a member of a class protected against discrimination; and (2) a perception or belief, even if inaccurate, that the individual is a member of such a protected class. Under a current provision of the ECOA, a request for the signature of both parties to a marriage for the purpose of creating a valid lien, passing clear title, waiving inchoate rights to property, or assigning earnings does not constitute discrimination. The bill prohibits this provision from being construed to permit a creditor to take sexual orientation or gender identity into account in connection with the evaluation of creditworthiness of an applicant.
