Pharmacy and Medically Underserved Areas Enhancement Act This bill amends title XVIII (Medicare) of the Social Security Act to provide for Medicare coverage and payment with respect to certain pharmacist services that: (1) are furnished by a pharmacist in a health-professional shortage area, and (2) would otherwise be covered under Medicare if furnished by a physician.

Medical Device Access and Innovation Protection Act This bill amends the Internal Revenue Code to repeal the excise tax on the sale of a medical device by the manufacturer, producer, or importer.

Counteracting Russian Hostilities Act of 2017 This bill directs the President to impose U.S. entry and property blocking sanctions against: (1) a person that engages in significant activities for the government of the Russian Federation that undermine U.S. or allied cyber security, or (2) a foreign person responsible for serious human rights abuses in any territory occupied or controlled by Russia. The President shall impose specified financial and property sanctions against a person that: (1) engages in a significant transaction on behalf of Russian defense or intelligence sectors; (2) invests specified amounts in Russian petroleum or natural gas resources, energy export pipelines, or civil nuclear projects; (3) purchases or facilitates the issuance of Russian sovereign debt; or (4) contributes to Russia's ability to privatize state-owned assets. The Department of Homeland Security shall conduct public service campaigns to educate the people of the United States on cyber security threats and protective online practices. No federal agency shall take any action that recognizes: (1) Russian sovereignty over Crimea, or (2) the independence of South Ossetia or Abkhazia from Georgia. It is U.S. policy to assist Ukraine in restoring its sovereignty and territorial integrity. Specified executive orders imposing Ukraine-related sanctions shall remain in effect. The bill expresses the sense of Congress that the countries of Europe and Eurasia should redouble efforts to build resilience within their political systems and civil society to counter Russian efforts to undermine democratic institutions. The Department of State shall report to Congress regarding Russian-controlled media outlets. The bill establishes in the Treasury the Europe and Eurasia Democracy and Anti-Corruption Fund. The Department of the Treasury shall establish a task force within the Financial Crimes Enforcement Network that focuses on illicit Russian-linked financial flows that interact with the U.S. financial system.

Middle Class Health Benefits Tax Repeal Act of 2017 This bill amends the Internal Revenue Code to repeal, beginning with taxable years beginning after December 31, 2017, the excise tax on employer-sponsored health care coverage for which there is an excess benefit (high-cost plans).

Objects to U.N. Security Council Resolution 2334. Such resolution characterizes Israeli settlements in the West Bank and East Jerusalem as illegal and demands cessation of settlement activities. Calls for such resolution to be repealed or fundamentally altered and allows all final status issues toward a two-state solution to be resolved through direct bilateral negotiations between the parties. Rejects efforts by outside bodies to impose solutions that set back the cause of peace. Demands that the United States ensure that no action is taken at the Paris Conference on the Israeli-Palestinian conflict scheduled for January 15, 2017, that imposes an agreement or parameters on the parties. Notes that granting membership and statehood standing to the Palestinians at the U.N., its specialized agencies, and other international institutions outside of the context of a bilateral peace agreement with Israel would cause severe harm to the peace process and would likely trigger penalties under provisions of the Department of State, Foreign Operations, and Related Agencies Appropriations Act, 2016 regarding limitations on assistance to the Palestinians. Rejects any efforts by international organizations to use such resolution to further isolate Israel and urges the U.S. government to act where needed to counter any such efforts. Urges: (1) U.S. presidential Administrations to uphold the practice of vetoing all Security Council resolutions that seek to insert the council into the peace process, recognize unilateral Palestinian actions, or dictate terms and a time line for a solution of the Israeli-Palestinian conflict; and (2) the incoming presidential Administration to work with Congress to create conditions that facilitate the resumption of negotiations without preconditions between Israelis and Palestinians to achieve a sustainable agreement acceptable to both sides. Reaffirms that it is U.S. policy to seek a sustainable, just, and secure two-state solution to the Israeli-Palestinian conflict.

This bill amends the Federal Deposit Insurance Act to require certain municipal obligations to be treated as level 2B liquid assets if they are investment grade, liquid, and readily marketable. Under current law, corporate debt securities and publicly traded common-equity shares, but not municipal obligations, may be treated as level 2B liquid assets (which are considered to be high-quality assets).

No Vote No Recess Resolution Prohibits the Senate, between September 27, 2016, and the end of the 114th Congress, from adjourning, remaining adjourned, or recessing for more than two days and convening solely in a pro forma session unless, by the beginning of the adjournment or the pro forma session, it has taken action on any presidential nomination for a position as a justice of the U.S. Supreme Court by: holding a hearing and a vote on the nomination in the Senate Committee on the Judiciary, and holding a confirmation vote on it in the full Senate. Prescribes procedures for Senate adjournments and recesses during such period. Prohibits the Presiding Officer from entertaining a request to suspend the operation of this resolution by unanimous consent or motion. States that nothing in this resolution shall be construed in a manner that is inconsistent with S. Res. 296 (108th Congress) or any other Senate emergency procedures or practices.

Offers condolences to the families, friends, and loved ones of those who were killed and expresses hope for the quick and complete recovery of those who were wounded. Declares that the Senate stands united against violence and hatred and in support of the police officers who work to keep the country safe.

Protecting Veterans Credit Act of 2016 This bill amends the Fair Credit Reporting Act to exclude from a consumer report: (1) for one year, information related to a veteran's medical debt resulting from hospital or medical services provided in a non-Department of Veterans Affairs (VA) facility; and (2) information related to a fully paid or settled medical debt that had been characterized as delinquent, charged off, or in collection. A veteran may submit a notice along with proof of VA liability for such debt to a consumer reporting agency or a reseller to dispute the debt's inclusion in a consumer report. The consumer reporting agency shall, within 30 days, delete such information from the consumer's file and notify the furnisher and the veteran. The Consumer Credit Protection Act is amended to provide a mechanism for veterans to dispute the inclusion of program debt already on a credit report. A consumer reporting agency shall, within 30 days after receiving notice of such dispute, delete such information from the veteran's file and notify the furnisher and the veteran. Within five days after the initial communication with a veteran, a debt collector shall, unless the appropriate information is contained in the initial communication or the veteran has paid the debt, send the veteran a written notice containing specified debt-related information, including information concerning the debt amount, creditors, the insurance company involved, and the hospital or medical care provider. If a veteran notifies the debt collector within such one-year period that the program debt is disputed or that the veteran requests the name and address of the original creditor, the debt collector shall cease collection until debt verification or the name and address of the original creditor is obtained.

This bill exempts retired air traffic controllers from a reduction to their Federal Employees Retirement System annuity supplement (on account of their earnings for work performed while entitled to the annuity after their separation from federal service) during any period in which they are employed full time as air traffic control instructors under contract with the Federal Aviation Administration.

Biodiesel Tax Incentive Reform and Extension Act of 2016 This bill amends the Internal Revenue Code to modify and extend: (1) the income tax credit for biodiesel and renewable diesel used as fuel, and (2) the excise tax credit for biodiesel fuel mixtures. The bill: (1) makes the credits available to domestic producers of the fuels rather than the policy under current law of providing a mixture credit to the blender of the fuel, (2) increases the income tax credit for certain small biodiesel producers, and (3) extends the credits through 2019.

Supports efforts of the Department of Veterans Affairs (VA) and the Department of Defense, as well as the medical community, to educate members of the Armed Forces, veterans, their families, and the public about the causes, symptoms, and treatment of post-traumatic stress. Welcomes the efforts of the VA's National Center for PTSD (post-traumatic stress disorder) and local Vet Centers to assist veterans suffering from the effects of post-traumatic stress. Encourages Armed Forces commanders to support appropriate treatment of Armed Forces personnel diagnosed with PTSD.

Merchant Mariners of World War II Congressional Gold Medal Act of 2016 This bill directs the Speaker of the House of Representatives and the President pro tempore of the Senate to award a Congressional Gold Medal to the U.S. merchant mariners of World War II in recognition of their dedicated and vital service during World War II. Expresses the sense of Congress that the American Merchant Marine Museum should make the medal available for display elsewhere, particularly at appropriate locations associated with the U.S. Merchant Marine, giving preference to locations affiliated with it.

Apollo 11 50th Anniversary Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue gold, silver, half-dollar clad, and proof silver coins in recognition and celebration of the 50th anniversary of the first manned landing on the moon. Treasury may issue coins minted under this bill for only a one-year period, beginning January 1, 2019. All sales of these coins shall include a surcharge of $35 per gold coin, $10 per silver coin, $5 per half-dollar clad coin, and $50 per proof silver coin. All of the surcharges received from the sale of such coins shall be paid as follows: one-half to the Smithsonian Institution's National Air and Space Museum's "Destination Moon" exhibit; one-quarter to the Astronauts Memorial Foundation; and one-quarter to the Astronaut Scholarship Foundation, to aid its missions by providing college scholarships for the very best and brightest students pursuing degrees in science, technology, engineering, or mathematics.

Veterans First Act TITLE I--PERSONNEL AND ACCOUNTABILITY MATTERS This bill establishes in the Department of Veterans Affairs (VA) the Office of Accountability and Whistleblower Protection. The VA is required to develop criteria to promote supervisory protection of whistle-blowers. The bill revises VA authority to remove certain employees or senior VA executives for reasons of misconduct or performance. TITLE II--HEALTH CARE MATTERS Jason Simcakoski Memorial Act The bill establishes the Veterans Expedited Recovery Commission to examine the VA's therapy model for treating mental health illnesses. The VA shall require additional information about a prospective health care employee from the medical board of each state in which the health care provider holds or has held a medical license. The VA family caregiver program is expanded. The bill establishes a VA advisory committee on caregiver policies. The VA shall revive the Intermediate Care Technician Pilot Program. The VA may place a veteran requesting nursing home care in a medical foster home that meets appropriate VA standards. The bill sets forth requirements for VA hospitals with emergency departments to provide appropriate examination and stabilizing treatment for emergency medical conditions and women in labor. The VA and the Department of Defense (DOD) shall jointly update the VA/DOD Clinical Practice Guideline for Management of Opioid Therapy for Chronic Pain. The VA shall expand its Opioid Safety Initiative. The bill establishes the VA Office of Patient Advocacy. The VA shall ensure that payments are made promptly to non-VA health care providers. If the VA is unable to furnish certain hospital, medical, or extended care at VA facilities or under other authorized contracts or sharing agreements, it may enter into a Veterans Care Agreement with an eligible provider to furnish such care. The bill authorizes the VA to carry out specified major medical facility projects in California, Maryland, Kentucky, and Washington. The VA shall: (1) adopt the Federal Drug Administrations's unique device identification system to identify biological implants for use in VA medical procedures; (2) expand research and integration of complementary and integrative health services into veterans health care services; and (3) carry out a three-year program to assess the feasibility of integrating complementary and alternative medicine services for veterans with mental health conditions, chronic pain conditions, and other chronic conditions. TITLE III--DISABILITY COMPENSATION AND PENSION The VA may pay burial and funeral expenses and other benefits to a survivor of a veteran who has not filed a formal claim if the record contains sufficient evidence to establish the survivor's entitlement to such benefits. The bill increases the special monthly pension for living Medal of Honor recipients. The Veterans Benefits Act of 2003 is amended to extend VA authority to provide for persons other than VA employees (i.e., contract physicians) to conduct medical disability examinations of applicants for VA benefits. The VA shall carry out a five-year disability claims appeals pilot program. TITLE IV--EDUCATION Any member of the Armed Forces who died between September 11, 2001, and December 31, 2005, is deemed to have died on January 1, 2006, in order to make that member's surviving spouse eligible for the Marine Gunnery Sergeant John David Fry scholarship. VA educational assistance payments for a veteran who was forced to discontinue a course or who did not receive credit toward completion of an education program because of a permanent school closure shall not be charged against the individual's educational assistance entitlement or counted against the aggregate assistance period. The bill revises the process for electing Post-9/11 educational benefits. TITLE V--EMPLOYMENT AND TRANSITION Each state director for veterans' employment and training shall coordinate activities with the state's departments of labor and veterans affairs. TITLE VI--HOMELESS VETERANS The bill includes as a homeless veteran, for purposes of VA benefits, a veteran or veteran's family fleeing domestic violence, sexual assault, stalking, or other dangerous or life-threatening conditions in their current housing situation. The VA shall shall carry out case management services to improve the retention of housing by: (1) veterans who were previously homeless and who are transitioning to permanent housing, and (2) veterans who are at risk of becoming homeless. The VA shall establish the National Center on Homelessness Among Veterans. This bill eliminates the minimum continuous active duty service requirement for homeless veterans to receive certain benefits. Homeless veterans are exempted from disqualification for such benefits because of a discharge or dismissal from the Armed Forces under conditions other than honorable, except for a discharge by reason of a general court-martial. TITLE VII--UNITED STATES COURT OF APPEALS FOR VETERANS CLAIMS The bill extends the temporary expansion of the Court of Appeals for Veterans Claims. TITLE VIII--BURIAL BENEFITS The VA may, in lieu of furnishing a headstone or marker to certain deceased individuals, furnish a medallion or other device to be attached to a headstone or marker furnished at private expense. TITLE IX--OTHER MATTERS The VA may carry out specified leases at the VA's West Los Angeles Campus in Los Angeles, California.

Trickett Wendler Right to Try Act of 2016 This bill bars the federal government from prohibiting or restricting the production, manufacture, distribution, prescribing, or dispensing of an experimental drug, biological product, or device that is: (1) intended to treat a patient who has been diagnosed with a terminal illness; and (2) authorized by, and in accordance with, state law. The federal government may not restrict the possession or use of such a treatment by a patient certified by a physician as having exhausted all other treatment options. A producer, manufacturer, distributor, prescriber, dispenser, possessor, or user of such a treatment has no liability regarding the treatment. The outcome of production, manufacture, distribution, prescribing, dispensing, possession, or use of such a treatment may not be used by a federal agency to adversely impact review or approval of the treatment. The treatment must: (1) have successfully completed a phase 1 (initial, small scale) clinical trial; (2) remain under investigation in a clinical trial approved by the Food and Drug Administration (FDA); and (3) not be approved, licensed, or cleared for sale under the Federal Food, Drug, or Cosmetic Act or the Public Health Service Act. Not later than 30 days after enactment of this bill, and every 30 days thereafter until implementation is complete, the FDA must report on its progress in implementing a streamlined application process for compassionate use of experimental drugs and biological products.

Ensuring Children’s Access to Specialty Care Act of 2016 This bill amends the Public Health Service Act to include pediatric subspecialties in primary health services for purposes of the National Health Service Corps (NHSC). Psychiatrists who are pediatric subspecialists are included in behavioral and mental health professionals. (These amendments make pediatric subspecialists, including psychiatrists, eligible for the NHSC fellowship program for the delivery of primary health services in health professional shortage areas, the NHSC Scholarship Program, and the NHSC Loan Repayment Program.) “Health professional shortage area” can mean an underserved population of children and adolescents.

Charities Helping Americans Regularly Throughout the Year Act This bill amends the Internal Revenue Code to modify several tax provisions affecting charitable contributions and tax-exempt organizations. The bill excludes from the gross income of an individual who is at least 70-1/2 years of age up to $100,000 in distributions from an individual retirement plan to a donor-advised fund (DAF). (A DAF is a fund or account that is separately identified by reference to contributions of a donor or donors. The account is owned and controlled by a sponsoring charitable organization, while the donor retains advisory privileges with respect to the distribution and investment of funds in the account.) Sponsors of DAFs must disclose in their returns specified details regarding: (1) policies on inactive or dormant funds, and (2) average aggregate contributions to and grants made from the funds during the most recent three-year period. The bill reduces from 2% to 1% the excise tax on the investment income of private foundations and eliminates a provision that reduces the rate to 1% if a foundation meets certain distribution requirements. Tax-exempt organizations must file their returns in electronic form, and the Internal Revenue Service (IRS) must make the returns available to the public in a machine readable format as soon as practicable. The IRS may delay the requirement for up to two years for certain small organizations. The IRS may determine the standard mileage rate for deducting the cost of using a passenger automobile for charitable purposes (currently set by statute at 14 cents per mile), and the rate may not be less than the rate for medical purposes (19 cents per mile for 2016). The bill exempts certain philanthropic business holdings from the tax on excess business holdings of private foundations if a foundation meets requirements for exclusive ownership, donating all profits to charity, and independent operation.

Patient Access to Durable Medical Equipment Act of 2016 This bill amends title XVIII (Medicare) of the Social Security Act to establish a bid ceiling for durable medical equipment (such as wheelchairs) under Medicare's competitive acquisition program, through which rates are set according to a bidding process rather than by an established fee schedule. Specifically, the bid ceiling for such an item shall not be less than the fee schedule amount that would otherwise be determined. Under current law, the Centers for Medicare & Medicaid Services (CMS) must use payment information from competitive acquisition programs to make payment adjustments for areas outside of such programs. The bill requires CMS, in making these adjustments, to account for stakeholder input. In addition, CMS must account for a comparison of competitive acquisition areas and other areas with respect to the following factors: average travel distance and cost associated with furnishing items and services, barriers to access, average delivery time, average volume of items and services furnished by suppliers, and number of suppliers. In addition, CMS shall delay by 15 months the full implementation of new Medicare payment rates for durable medical equipment. On a monthly basis, CMS must publish on its website the results of the monitoring of health outcomes and Medicare beneficiaries' access to durable medical equipment. The bill accelerates the applicability, from January 1, 2019, to October 1, 2018, of provisions of current law that limit federal Medicaid reimbursement to states for durable medical equipment to Medicare payment rates.

Modernizing the Pittman-Robertson Fund for Tomorrow's Needs Act of 2016 This bill amends the Pittman-Robertson Wildlife Restoration Act to make it one of the purposes of the Act to extend financial and technical assistance to the states for the promotion of hunting and recreational shooting. The bill also prescribes a formula for the allocation of funds apportioned to a state that may be used for any activity or project to recruit or retain hunters and recreational shooters. Amounts apportioned to the states from any taxes on pistols, revolvers, bows, and arrows may be used for hunter recruitment and recreational shooter recruitment. The funds apportioned to a state for wildlife restoration management may be used for related public relations. If a state has not used all of the tax revenues apportioned to it for firearm and bow hunter education and safety program grants, it may use its remaining apportioned funds for the enhancement of hunter recruitment and recreational shooter recruitment. Up to $5 million of the revenues covered into wildlife restoration fund in the Treasury from any tax imposed for a fiscal year on the sale of certain bows, arrows, and archery equipment shall be available to the Department of the Interior exclusively for making hunter recruitment and recreational shooter recruitment grants that promote a national hunting and shooting sport recruitment program, including related communication and outreach activities.

Veterans Choice Equal Cost for Care Act of 2016 This bill amends the Veterans Access, Choice, and Accountability Act of 2014 to permit the Department of Veterans Affairs (VA) to recover or collect reasonable charges for hospital care or medical services from a health-care plan when an eligible veteran is furnished such care or services for a non-service-connected disability. The VA shall have the primary (and sole) responsibility to pay any related health insurance cost sharing amount. An eligible veteran shall not pay a greater amount for receiving hospital care or medical services than the amount the veteran would pay for receiving the same or comparable care or services at a VA medical facility or from a VA health care provider. (The bill repeals the VA's secondary responsibility to pay the costs of care in such circumstances.)

Combating BDS Act of 2016 This bill authorizes a state or local government to adopt and enforce measures to divest its assets from, or prohibit investment of its assets in: (1) an entity that such government determines, using credible information available to the public, engages in a commerce or investment-related boycott, divestment, or sanctions activity targeting Israel; or (2) an entity that owns or controls, is owned or controlled by, or is under common ownership or control with, such an entity. Such government shall provide written notice to such an entity before applying such a measure. Such a measure by a state or local government is not preempted by any federal law. The bill applies to any measure adopted by a state or local government before, on, or after the date of this Act's enactment. The bill amends the Investment Company Act of 1940 to prohibit any person from bringing any civil, criminal, or administrative action against any registered investment company, or any officer or employee thereof, based solely upon such company divesting from, or avoiding investing in, securities issued by persons that such company determines, using credible information available to the public, engage in any commerce or investment-related boycotts, divestments, or sanctions activities targeting Israel.
