Protecting Americans from Violent Crime Act of 2008 - Bars the promulgation or enforcement of any regulation that prohibits an individual from possessing a firearm, including an assembled or functional firearm, in any unit of the National Park System or the National Wildlife Refuge System if: (1) the individual is not otherwise prohibited by law from possessing the firearm; and (2) the possession of the firearm is in compliance with the law of the state in which the unit is located.

Greenhouse Gas Emission Atmospheric Removal Act or the GEAR Act - Declares that it is the policy of the United States to provide incentives to encourage the development and implementation of technology to permanently remove greenhouse gases (GHGs) from the atmosphere on a significant scale. Establishes within the Department of Energy (DOE) the Greenhouse Gas Emission Atmospheric Removal Commission. Requires the Secretary of Energy, acting through the Commission, to provide financial awards on a competitive basis to entities for the achievement of milestones in developing and applying technology that could significantly slow or reverse the accumulation of GHGs in the atmosphere by permanently capturing or sequestrating those gases without significant countervailing harmful effects. Requires the Commission to: (1) develop specific requirements for the competition, performance, monitoring and verification, and the scale of awards; (2) establish minimum levels for the capture or net sequestration of GHGs required to qualify for a financial award; (3) offer awards to entities that demonstrate achievement of specified technological goals; and (4) establish standards for required peer review of proposals seeking such awards. Vests title to intellectual property arising from such awards in U.S. entities. Bars title transfer to an entity not incorporated in the United States until the first obtained patent expires. Authorizes the United States to reserve a license to have such property practiced on its behalf.

Amends the Consolidated Appropriations Act, 2008, to repeal the requirement for a deduction of 2% from the amount payable to a state in FY2008 under the Federal Oil and Gas Royalty Management Act of 1982, and under the provisions of the Mineral Leasing Act and the Geothermal Steam Act of 1970, before disbursing a payment to that state and for the deposit of the amount deducted to miscellaneous receipts.

United States Army Commemorative Coin Act of 2008 - Instructs the Secretary of the Treasury to mint and issue $5 gold coins, $1 silver coins, and half dollar clad coins as numismatic items emblematic of the traditions, history, and heritage of the U.S. Army, and its role in American society from the Colonial period to today. Requires the design for such coins to contain motifs that honor specifically the American soldier of both today and yesterday, in wartime and in peace, consistent with the traditions and heritage of the U.S. Army, the mission and goals of the National Museum of the U.S. Army, and the missions and goals of the Army Historical Foundation. Restricts coin issuance to the one-year period beginning on January 1, 2011. Requires all surcharges from coin sales to be promptly paid by the Secretary to the Foundation to help finance the National Museum of the U.S. Army.

Amends the Internal Revenue Code to allow purchasers of a single-family principal residence a one-time tax credit for up to $15,000 of the purchase price. Requires such a residence to be purchased after February 29, 2008, and before March 1, 2009, and that it be: (1) a new previously unoccupied residence for which a building permit has been issued and construction began on or before September 1, 2007; (2) an owner-occupied residence with a mortgage indebtedness in default on or before March 1, 2008; or (3) in foreclosure and owned by the mortgagor or the mortgagor's agent.

Santa Fe 400th Anniversary Commemorative Coin Act of 2007 - Instructs the Secretary of the Treasury to issue $5 gold coins and $1 silver coins emblematic of the settlement of Santa Fe, New Mexico, the oldest capital city in the United States. Permits issuance of such coins only during calendar 2010. Requires the Secretary to pay 50% of surcharges received from such coin sales to: (1) the Santa Fe 400th Anniversary Committee, Inc.; and (2) the Secretary of the Interior to sustain the ongoing mission of preserving Santa Fe, including educational programs, infrastructure and archaeological research activities, and other programs to support commemoration of the 400th anniversary of Santa Fe.

Wyoming Forest and Watershed Restoration Act of 2007 - Authorizes the Secretary of Agriculture, through the Forest Service and until September 30, 2017, to enter into a cooperative agreement with Wyoming to allow Wyoming to conduct certain forest and watershed restoration services, including the treatment of insect-infected trees and the reduction of hazardous fuels.

Surface Mining Control and Reclamation Act of 1977 Technical Corrections Act - Amends the Surface Mining Control and Reclamation Act of 1977 to modify procedures governing payments of moneys derived from reclamation fees to certified states and Indian tribes. Requires that such payments: (1) be distributed as direct transfers of funds rather than in the form of grants; and (2) be made at the same time as specified payments from the Abandoned Mine Reclamation Fund are made available, including without fiscal year limitation.

Constitutional Amendment - Authorizes the President to make a line item veto of any appropriation in any bill, order, resolution, or vote presented for signature into law. Declares that any legislation the President approves and signs, after being amended with a line item veto, shall become law as so modified. Requires the President to return those portions of the legislation that contain reduced or disapproved appropriations, with objections, to the House where such legislation originated. Authorizes Congress to separately consider any reduced or disapproved appropriations in the manner prescribed under section 7 of Article I for vetoed bills.

Aerial Firefighter Relief Act of 2007 - Amends the Omnibus Crime Control and Safe Streets Act of 1968 to include among persons eligible for public safety officer death benefits any individual serving a public agency or a contractor or subcontractor of a public agency in an official capacity, with or without compensation, as a pilot or a crew member of an aircraft carrying out a firefighting mission.

Reforming an Entitlement through Premium Adjustments based on Income Resources (REPAIR) Act of 2007 - Amends part D (Voluntary Prescription Drug Benefit Program) of title XVIII (Medicare) of the Social Security Act to require an income-related reduction in the part D premium subsidy. Declares that, in the case of an individual whose modified adjusted gross income exceeds a certain applicable threshold amount for a month after December 2008, the monthly amount of the part D premium subsidy shall be reduced (and the monthly beneficiary premium shall be increased) by the monthly adjustment amount determined according to a specified formula.

Loyalty to Our Legacy Act of 2007 - Requires the Architect of the Capitol (AOC) to ensure that the Pledge of Allegiance to the Flag and the national motto "In God We Trust" are each displayed prominently in the Capitol Visitor Center (CVC) on a permanent basis. Prohibits the AOC, in preparing and producing any exhibit or other material relating to the CVC, from removing or refusing to include any language, symbol, writing, document, or record on the grounds that they include a religious reference or Judeo-Christian content.

Provides that tax planning inventions are not patentable. Defines a "tax planning invention" as a plan, strategy, technique, scheme, process, or system to reduce, minimize, avoid, or defer tax liability or to facilitate compliance with tax laws, excluding tax preparation software and other tools or systems used solely to prepare tax or information returns.

Requires the Secretary of Transportation to withhold 10% of a state's apportionment of certain federal-aid highways funds in any fiscal year after FY2009 if such state does not require verifiable evidence of lawful presence in the United States or its territories from each applicant for a driver's license or personal identification card issued by the state. Grandfathers states that have such a requirement in effect before the later of: (1) October 1, 2009; or (2) 10 days after the end of the first session the state's legislature convenes after enactment of this Act. Redistributes withheld funds to states that satisfy the requirements of this Act.

Preserving our Equine Heritage on Public Land Act - Provides for: (1) the continued preservation and use of pack and saddle stock animals on public land administered by the National Park Service, and Bureau of Land Management, the United States Fish and Wildlife Service, or the Forest Service on which there is a historical tradition of the use of pack and saddle stock animals; and (2) defining the term "historical tradition of the use of pack and saddle stock animals" for purposes of this Act.

Wyoming Range Legacy Act of 2007 - Withdraws specified Forest Service land and federally owned minerals in the Wyoming Range portion of the Bridger-Teton National Forest from: (1) all forms of appropriation or disposal under the public land laws; (2) location, entry, and patent under the mining laws; and (3) disposition under laws relating to mineral and geothermal leasing or mineral materials. Makes the Bridger-Teton National Forest Plan, including any revisions, applicable to any land within the Bridger-Teton National Forest that is not withdrawn and any leases of such land. Sets forth provisions for the retirement and repurchase of valid existing federal, oil, gas, and other mineral leases within the Wyoming Range. Requires the Secretary to cancel each lease that is acquired and withdraws land that is subject to a canceled lease in accordance with this Act. Requires notification to holders of valid existing federal leases within the Wyoming Range withdrawal area of the opportunity for retirement and repurchase of their leases.

Supporting America's Protective Security Advisor Act of 2007 - Amends the Homeland Security Act of 2002 to establish the Protective Security Advisor Program Office within the Protective Security Coordination Division of the Office of Infrastructure Protection of the Department of Homeland Security (DHS). Requires the Office to have primary responsibility within DHS for: (1) encouraging state, local, and tribal governments and private sector owners and operators of critical infrastructure and key resources to participate and collaborate within the risk management framework of the National Infrastructure Protection Plan; (2) coordinating national and intergovernmental critical infrastructure and key resource activities with such governments, owners, and operators; (3) facilitating and conducting requirements, capabilities, and risk assessment analyses that enhance critical infrastructure and key resources preparedness; (4) promoting information sharing and security awareness; (5) assisting such governments in developing multijurisdictional security plans; (6) helping to ensure coordination among such governments, such owners and operators, emergency response providers, and related agencies; (7) serving as infrastructure liaison officials when a joint field office is activated in response to a natural disaster or terrorist event; and (8) facilitating and coordinating interaction with international security partners. Directs the Secretary of Homeland Security to develop a plan for the assignment and distribution of protective security advisors that takes into account baseline requirements and anticipated growth to: (1) ensure that protective security advisors are located across the United States and provide appropriate coverage and coordinated support, especially in high-risk regions; and (2) assign protective security advisors and support staff based on risk.

NASA 50th Anniversary Commemorative Coin Act - Directs the Secretary of the Treasury, in commemoration of the 50th anniversary of the establishment of the National Aeronautics and Space Administration (NASA), to mint and issue $50 gold and $1 silver coins emblematic of the 50 years of exemplary and unparalleled achievements of NASA. Requires all such coin sales to include a surcharge of $50 per $50 coin, and of $10 per $1 coin. Requires distribution of the first $4 million to the NASA Family Assistance Fund for financial assistance to the families of NASA personnel who die as a result of injuries suffered in the performance of their official duties. Requires distribution of: (1) one-half of the next $1 million of the remaining amounts to the Dr. Ronald E. McNair Educational (D.R.E.M.E.) Science Literacy Foundation and the Challenger Center for Space Science Education; and (2) the remainder to the Secretary of the Smithsonian Institution for the preservation, maintenance, and display of space artifacts at the National Air and Space Museum (including the Steven F. Udvar-Hazy Center). Authorizes the Secretary to strike and sell bronze duplicates of the $50 gold coins.

Kids First Act - Amends title XXI (State Children's Health Insurance) (SCHIP) of the Social Security Act (SSA) to revise, reauthorize, and extend the SCHIP program through FY2012 at increased levels. Provides for determination of allotments for the 50 states and the District of Columbia based on expenditures and numbers of low-income children. Sets limitations on matching rates for populations other than targeted low-income children or pregnant women covered through a Section 1115 waiver. Prohibits the Secretary of Health and Human Services from approving, extending, renewing, or amending a waiver, experimental, pilot, or demonstration project with respect to a state after the enactment of this Act that would allow funds made available under SCHIP to be used to provide child health assistance or other health benefits coverage for any other adult other than a pregnant woman whose family income does not exceed the income eligibility level specified for a targeted low-income child in that state under a waiver or approved project. Requires a state to determine family income eligibility for child health assistance or other health benefits coverage under the state child health plan solely on the basis of the family's gross income. Directs the Secretary to award grants to eligible entities to conduct outreach and enrollment efforts designed to increase the enrollment and participation of eligible children under SCHIP and SSA title XIX (Medicaid). Allows a state to elect to offer a premium assistance subsidy for qualified employer sponsored coverage to all targeted low-income children eligible for child health assistance. Allows any state the option to include an unborn child as a child under SCHIP. Repeals current federal payment rates at different specified percentages for different specified aspects of Medicaid administrative costs to prescribe a flat 50% rate for all such costs. Requires a 25% reduction in payments for Medicaid administrative costs (to prevent duplication of such payments under part A (Temporary Assistance for Needy Families) (TANF) of SSA title IV).

American Veterans Disabled for Life Commemorative Coin Act - Directs the Secretary of the Treasury to mint and issue $1 silver coins in commemoration of disabled American veterans and emblematic of the design selected by the Disabled Veterans' LIFE Memorial Foundation for the American Veterans Disabled for Life Memorial. Expresses the sense of Congress that, to the greatest extent possible, the coins should be struck at the U.S. Mint at West Point, New York. Limits the period for coin issuance to calendar year 2010. Imposes a $10 surcharge per coin, to be distributed to the Disabled Veterans' LIFE Memorial Foundation for the purpose of establishing an endowment to support the construction of American Veterans' Disabled for Life Memorial in Washington, D.C.

Government Shutdown Prevention Act - Provides for automatic continuing appropriations if any regular appropriation for a fiscal year (or, if applicable, for each fiscal year in a biennium) does not become law before the beginning of such fiscal year, or a joint resolution making continuing appropriations is not in effect. Appropriates amounts necessary to continue any project or activity for which funds were provided in the preceding fiscal year: (1) in the corresponding regular appropriation Act for such preceding fiscal year; or (2) if such legislation did not become law, then in the joint resolution making continuing appropriations for such preceding fiscal year. Requires the appropriations and funds made available, and authority granted, for any fiscal year for a project or activity to be available for the period beginning with the first day of a lapse in appropriations and ending with the earlier of: (1) the date on which the applicable regular appropriation bill for such fiscal year becomes law (whether or not such law provides for such project or activity) or a continuing resolution making appropriations becomes law, as the case may be; or (2) the last day of such fiscal year.

Bipartisan Task Force for Responsible Fiscal Action Act of 2007 - Amends the Congressional Budget Act of 1974 to establish the Bipartisan Task Force for Responsible Fiscal Action to address, and report to the President and Congress on, the nation's long-term fiscal imbalances, including those attributable to the Medicare and Social Security programs and the gap between their projected revenues and expenditures. Provides for expedited legislative consideration of Task Force recommendations.

Coinage Materials Modernization Act of 2007 - Removes restrictions on the weight of, and requirements concerning the metal in, the U.S. half dollar, quarter, dime, nickel, and penny. Requires the Secretary of the Treasury to prescribe the weight and composition of the dollar, half dollar, quarter, dime, five-cent, and one-cent coins. (Currently, the Secretary is authorized to prescribe the weight and the composition of copper and zinc in the alloy of the penny in specified circumstances.) Authorizes the Secretary to prescribe manufacturing tolerances for the nickel and penny.

Pension Protection Technical Corrections Act of 2007 - Amends the Employee Retirement Income Security Act (ERISA) and the Internal Revenue Code, as amended by the Pension Protection Act of 2006, to make changes regarding defined benefit pension plans, including to: (1) revise rules concerning amendments of a plan while a waiver of minimum funding standards is in effect; (2) amend provisions that allow the Secretary of Treasury to provide a transition rule for estimating an at-risk plan's funding target attainment percentage; (3) exclude from the definition of prohibited payment for purposes of limitations on accelerated benefit distributions a payment that may be immediately distributed without the consent of the participant; (4) extend exemption from fiduciary liability during a blackout period to otherwise qualified blackout periods of less than three days; and (5) revise deduction rules for employer contributions to one or more defined contribution plans.

Pharmacy Access Improvement (PhAIm) Act of 2007 - Amends part D (Voluntary Prescription Drug Benefit Program ) of title XVIII (Medicare) of the Social Security Act (SSA) with respect to participating pharmacies and standards for access to them. Requires that such standards ensure that enrollees residing in long-term care facilities have access to a long-term care network pharmacy. Requires prompt payment of clean claims to pharmacies by prescription drug plans (PDPs) and Medicare Advantage prescription drug plans (MA-PD Plans). Defines prompt payment as payment occurring within 14 days from submission for claims submitted electronically, and within 30 days for claims submitted otherwise. Requires payment of interest if a payment is not issued, mailed, or otherwise transmitted within the applicable number of calendar days. Directs the Secretary of Health and Human Services to establish a 24-hour toll-free telephone number dedicated to providing Medicare prescription drug benefit information to pharmacists and pharmacy staff. Requires PDP sponsors to establish toll-free pharmacy and physician and provider hotlines. Prohibits a Medicare prescription drug card issued by a PDP sponsor from displaying the name, brand, logo, or trademark (co-branding) of any pharmacy. Provides for submission of claims by pharmacies located in or contracting with long-term care facilities. Requires the Inspector General of the Department of Health and Human Services to analyze and report to the Secretary on the cost of dispensing covered part D drugs under a PDP or an MA-PD plan. Provides that, if the PDP sponsor uses a standard for reimbursement of pharmacies based on the cost of a drug, each contract entered into with such sponsor with respect to the plan shall require the sponsor to update the standard at least once every seven days.

Establishes the Commission on Congressional Budgetary Accountability and Review of Federal Agencies. Directs the President to: (1) designate two Commission co-chairpersons; (2) establish a systematic method for assessing the effectiveness and accountability of agency programs; (3) divide such programs into four equal budgetary parts; (4) submit to the Commission annual assessments of the programs within each part (one each year) that use such method; and (5) identify common performance measures for programs having similar functions and provide the Commission with data on such measures. Requires the Commission to: (1) evaluate executive agencies and their programs identified in each assessment; (2) consider submitted assessments in evaluating programs; and (3) submit to Congress each of the next four years a plan recommending agencies and programs that should be realigned or eliminated and proposing implementing legislation. Provides for expedited consideration of such legislation.

Medicare Safe Needle Disposal Coverage Act of 2007 - Amends part D (Voluntary Prescription Drug Benefit Program) of title XVIII (Medicare) of the Social Security Act to cover as a part D drug any devices approved for home use by the Food and Drug Administration (FDA) for the safe and effective removal, decontamination, and disposal of needles and the disposal of needles and syringes through a sharps-by-mail or similar program as medically appropriate based on volume of usage.

Help End Addiction to Lethal Tobacco Habits Act or the HEALTH Act - Amends the Federal Cigarette Labeling and Advertising Act and the Smokeless Tobacco Health Education Act of 1986 to make changes to annual reporting requirements relating to ingredients added to tobacco in the manufacture of cigarettes and smokeless tobacco. Requires the Secretary of Commerce, acting through the Director of the National Institute of Standards and Technology, to develop standards and best practices for: (1) the sampling of tobacco, smokeless tobacco, and tobacco products; and (2) accurate measurement and analysis of tobacco constituents. Makes changes to the Surgeon General's Warning on the packages of cigarettes and smokeless tobacco, including the content, size, and location of such warnings. Requires the Secretary of Health and Human Services (the Secretary) to conduct a survey on the usage of tobacco products. Amends the Public Health Service Act to establish an allowance system to reduce the sale of U.S. tobacco products. Amends the Internal Revenue Code to make changes to the excise tax on cigarettes, cigars, and smokeless tobacco. Establishes a classification system for tobacco products based on their level of health risks. Requires the Secretary to establish the Tobacco Risk Classification Panel to make recommendations concerning such classification. Authorizes the Secretary to prohibit the introduction into interstate commerce of any product that contains nicotine if such product has no health benefits. Requires the Secretary, acting through the Administrator of the Substance Abuse and Mental Health Services Administration, to carry out a campaign of counter-advertising with respect to tobacco use. Provides for coverage of tobacco cessation products and programs.

Pharmacist Access and Recognition in Medicare (PhARM) Act of 2007 - Amends part D (Voluntary Prescription Drug Benefit Program) of title XVIII (Medicare) of the Social Security Act to require prompt payment of clean claims to pharmacies by prescription drug plans and Medicare Advantage prescription drug plans. Defines prompt payment as within 14 days from submission for claims submitted electronically, and within 30 days for claims submitted otherwise. Requires payment of interest, also, if a payment is not issued, mailed, or otherwise transmitted within the applicable number of calendar days. Prohibits a Medicare prescription drug card issued by a prescription drug plan sponsor from displaying the name, brand, or trademark (co-branding) of any pharmacy. Revises requirements for a covered medication therapy management program, allowing it to be furnished by a health care provider, other than a pharmacist, with advanced training in medication management. Requires the Secretary of Health and Human Services to specify: (1) the population of part D eligible individuals appropriate for services under a medication therapy management program, based on certain characteristics; and (2) a minimum defined package of medication therapy management services that shall be provided to each enrollee. Revises requirements for pharmacy fees. Directs the Secretary to establish: (1) a two-year demonstration program to examine the impact of medication therapy management furnished by a pharmacist in a community-based or ambulatory-based setting on quality of care, spending, and patient health; and (2) a Best Practices Commission to develop a best practices model for medication therapy management.

Ten Steps to Transform Health Care in America Act - Directs states to implement mechanisms to automatically enroll uninsured individuals in health coverage. Requires each health insurance issuer in a state to offer a certified qualified core plan that provides coverage required by the state with a standard premium. Amends the Internal Revenue Code to allow individuals a standard deduction or a refundable tax credit for health insurance. Requires the Secretary of Health and Human Services (HHS Secretary) to provide for the establishment in each state of a single market for all health plans offered in the state. Amends the Employee Retirement Income Security Act of 1974 (ERISA) to require the Secretary of Labor to promulgate regulations governing small business health plans. Amends the Public Health Service Act to require the HHS Secretary to establish the Health Insurance Consensus Standards Board to develop recommendations that harmonize inconsistent state health insurance laws. Wired for Health Care Quality Act - Establishes: (1) the Office of the National Coordinator of Health Information Technology; (2) a public-private Partnership for Health Care Improvement; and (3) the American Health Information Community. Requires the HHS Secretary to: (1) provide for the development and use of health care quality measures; and (2) develop a Health Information Technology Resource Center. Authorizes the HHS Secretary to make grants for medical residency training programs or new residency positions. Requires the HHS Secretary to develop websites to provide information on advance directives and to store and access such directives. Fair and Reliable Medical Justice Act - Authorizes the HHS Secretary to award demonstration grants to states to develop, implement, and evaluate alternatives to current tort litigation for resolving disputes over injuries allegedly caused by health care providers or organizations.

Amends the U.S. Troop Readiness, Veterans' Care, Katrina Recovery, and Iraq Accountability Appropriations Act, 2007 to eliminate the requirement that forage producers must participate in the insurance pilot program or the noninsured crop disaster assistance program in order to receive crop disaster and livestock assistance.

Wired for Health Care Quality Act - Amends the Public Health Service Act to establish the Office of the National Coordinator of Health Information Technology. Establishes a public-private Partnership for Health Care Improvement to recommend specific actions to achieve a nationwide interoperable health information technology infrastructure. Provides for the adoption by the federal government of standards for the electronic exchange of health information. Establishes the American Health Information Community to provide advice to the Secretary of Health and Human Services and the heads of any relevant federal agencies concerning the policy considerations related to health information technology. Authorizes the Secretary to award grants for the: (1) purchase of qualified health information technology systems; (2) implementation of regional or local health information plans; and (3) development of academic curricula integrating qualified health information technology systems in the clinical education of health professionals. Requires the Secretary to provide for the development and use of health care quality measures to measure the quality and efficiency of health care that patients receive. Extends health information privacy requirements to an operator of a health information electronic database. Gives individuals the right to inspect and obtain a copy of their protected health information stored in electronic format. Directs the Comptroller General to report on the circumstances in which it is necessary and workable to require that individuals be notified if their individually identifiable health information is wrongly disclosed. Requires the Secretary, acting through the Director of the Agency for Healthcare Research and Quality, to develop a Health Information Technology Resource Center.

Biologics Price Competition and Innovation Act of 2007 - Amends the Public Health Service Act to allow a person to submit an application for licensure of a biological product based on its similarity to a licensed biological product (the reference product). Requires the Secretary of Health and Human Services to license the biological product if it is biosimilar to or interchangeable with the reference product. Allows a determination of interchangeability if the product is: (1) biosimilar to the reference product and can be expected to produce the same clinical result in any given patient; and (2) the risk in terms of safety or diminished efficacy of alternating or switching between the products is not greater than the risk of using the reference product without switching. Prohibits the Secretary from determining that a second or subsequent biological product is interchangeable for any condition of use until one year after the first commercial marketing of the first product to be approved as interchangeable for that reference product. Prohibits the Secretary from making approval of an application under this Act f effective until 12 years after the date on which the reference product was first licensed. Authorizes the Secretary to issue product class-specific guidance. Sets forth provisions governing patent infringement actions related to the exchange of confidential information, good faith negotiations, and the filing of an infringement action. Requires the Secretary to: (1) develop recommendations with respect to the goals for the process for the review of biosimilar biological product applications; and (2) collect and evaluate data regarding the cost of reviewing such applications.
