PALS Act

Protecting Access to Lifesaving Screenings Act of 2019 or the PALS Act This bill makes a series of changes relating to health insurance coverage of screening mammography. Specifically, the bill requires that any provision of law referring to current recommendations of the U.S. Preventive Services Task Force (USPSTF) with respect to breast cancer screening mammography be administered as if (1) the provision referred to USPSTF recommendations last issued before 2009; and (2) those recommendations applied to any screening mammography modality, including any digital modality of such a procedure. This requirement shall also apply to the Veterans Health Administration's policy on mammography screening for veterans. In addition, the bill preserves Medicare coverage for screening mammography, without a requirement for coinsurance, and expands the definition of screening mammography to include any digital modality of such a procedure. Further, the Centers for Medicare & Medicaid Services may not decrease the frequency with which screening mammography may be paid by Medicare for a woman over 39 years of age. In 2009, the USPSTF updated its guidelines to recommend against routine screening mammography for women between 40 to 49 years of age and to recommend biennial, instead of annual, screening mammography for most women between 50 to 74 years of age. In 2015, through the appropriations process, a three-year moratorium was placed on implementing the guidelines; the moratorium was subsequently renewed until January 1, 2020.

Such a project is one that installs raised concrete or metal posts on a sidewalk adjacent to a roadway that are designed to slow or stop a motor vehicle.

Such methodology must incorporate specified data-collection tools including, among others, (1) uniform, closed-ended questions; (2) a rating system to report findings; (3) a guidance document for practitioners; and (4) ongoing training for home-study personnel.

Resilient Highways Act of 2019

Resilient Highways Act of 2019 This bill addresses projects to improve the resiliency of federal-aid highways and bridges on and off the National Highway System. Specifically, the bill allows states to use up to 15% of funds apportioned under the national highway performance program for projects to mitigate the risk of recurring damage or the cost of future repairs from extreme weather, flooding, and other natural disasters on infrastructure that is part of the National Highway System; provides for a maximum federal cost-share of up to 100% for these projects; and authorizes emergency relief funds to be used to pay for these projects, including raising roadway grades, deepening channels to prevent flooding, improving drainage, and stabilizing slopes.

Summer Meals Act of 2019

Summer Meals Act of 201 9 This bill revises provisions related to the Summer Food Service Program (SFSP) of the Department of Agriculture (USDA), which provides meals to children and teens in low-income areas during the summer months when school is not in session. The bill redefines areas in which poor economic conditions exist , where the SFSP may operate, as areas in which at least 40% (currently, 50%) of the children have been determined to be eligible for free or reduced price school meals under the school lunch and breakfast programs. The bill reimburses service institutions (other than school food authorities) for up to one meal and one snack per child each day during after-school hours, weekends, and school holidays during the regular school calendar. Currently, such institutions are reimbursed for meals and snacks served to children over the summer months or to children who are on vacation under a continuous school calendar. USDA must award competitive grants to service institutions to increase participation in the summer food service program for children who lack the ability to access a congregate feeding site through (1) innovative approaches to limited transportation, (2) mobile meal trucks, and (3) any other method or approach that does not require children to access a congregate feeding site. Service institutions that are participating in the summer food service program for children may serve up to three meals, or two meals and one snack, during each day of operation. Currently, this option is reserved for camps and service institutions that serve meals primarily to migrant children.

Advancing Emergency Preparedness Through One Health Act of 2019 This bill requires the Department of Health and Human Services and the Department of Agriculture, in coordination with other specified agencies and departments, to develop, publish, and submit to Congress a national One Health Framework for coordinated federal activities under the One Health Program, which encourages collaborative efforts to help better prevent, prepare for, and respond to zoonotic disease outbreaks. The framework must (1) describe existing efforts and contain recommendations for building upon and complementing the activities of federal entities; and (2) establish specified goals, including advancing the scientific understanding of the connections among human, animal, and environmental health.

Alternatives to Detention Act of 2019

Alternatives to Detention Act of 2019 This bill requires the Department of Homeland Security (DHS) to establish programs that are alternatives to detention for immigration enforcement and addresses related issues. Such programs must be available regardless of whether an alien is subject to a removal order or whether a charge of removability is pending, but shall not be available to certain aliens, such as those subject to mandatory detention. DHS or an immigration judge must determine, within 72 hours of an individual being taken into custody for immigration enforcement, the appropriate level of supervision for the individual and whether the individual may participate in such an alternative program. For a member of a vulnerable population (such as a victim of trafficking) or a caregiver (such as a parent of a minor), there must be a presumption that such an individual must be placed in a community-based supervision program. DHS must restore the Family Case Management Program as an alternative to detention. This program must provide community supervision and community support services through a contract with a nongovernmental organization. DHS must establish a Coordinator of Alternatives to Detention position. The Government Accountability Office must report on the use and effectiveness of the programs established under this bill.

Julius Rosenwald and Rosenwald Schools Study Act of 2019 This bill directs the Department of the Interior to study the sites associated with the life and legacy of Julius Rosenwald, a part-owner and President of the Sears, Roebuck, & Company and a noted philanthropist. The study shall include a special focus on the Rosenwald Schools (the 5,357 schools and related buildings that were constructed in 15 southern states between 1912-1932). In conducting such study, Interior shall (1) determine which sites are of national significance, (2) prioritize the study of any Rosenwald Schools recommended to Interior by the State Historic Preservation Officer of any of the states in which such schools exist, and (3) determine the suitability and feasibility of designating one or more units of the National Park System to include those Rosenwald Schools and other sites representing Julius Rosenwald's life and legacy.

Hong Kong Human Rights and Democracy Act of 2019

Hong Kong Human Rights and Democracy Act of 2019 This bill directs various departments to assess whether political developments in Hong Kong justify changing Hong Kong's unique treatment under U.S. law. Hong Kong is part of China but has a largely separate legal and economic system. The Department of State shall report annually to Congress as to whether Hong Kong is sufficiently autonomous from China to justify its unique treatment. The report shall assess whether China has eroded Hong Kong's civil liberties and rule of law as protected by Hong Kong's Basic Law. The Department of Commerce shall report annually to Congress on China's efforts to use Hong Kong to evade U.S. export controls and sanctions. The President shall provide Congress an assessment as to whether to withdraw from the U.S.-Hong Kong extradition treaty, and what actions are needed to protect U.S. citizens and national security interests, if Hong Kong (1) amends its laws to allow the rendition of individuals to countries that lack defendants' rights protections, or (2) passes a national security law. The State Department shall allow otherwise qualified Hong Kong residents to obtain visas to work or study in the United States, even if the applicant had been arrested for participating in certain nonviolent protests supporting human rights or the rule of law. The President shall report to Congress a list of individuals responsible for abducting and torturing people for exercising internationally recognized human rights in Hong Kong. The bill bars such individuals from entering the United States and imposes sanctions on them.

State and Local Government Cybersecurity Act of 2019 This bill provides for collaboration between the Department of Homeland Security (DHS) and state, local, tribal, and territorial governments, as well as corporations, associations, and the general public, regarding cybersecurity. The bill expands DHS responsibilities through grants and cooperative agreements, including provision of assistance and education related to cyber threat indicators, defensive measures and cybersecurity technologies, cybersecurity risks, incidents, analysis, and warnings. The bill requires the National Cybersecurity and Communications Integration Center to coordinate with entities such as the Multi-State Information Sharing and Analysis Center to (1) conduct exercises, (2) provide operational and technical cybersecurity training, and (3) promote cybersecurity education and awareness. DHS shall establish a pilot program to deploy network sensors for the purpose of identifying and filtering malicious network traffic.

Affordability is Access Act This bill establishes several requirements relating to health-insurance coverage of, and access to, over-the-counter contraceptives. Specifically, the bill requires the Department of Health and Human Services, the Department of Labor, and the Department of the Treasury to specify that private health-insurance plans must cover over-the-counter contraceptives that are approved by the Food and Drug Administration (FDA), even without a prescription. Under current law, private health-insurance plans (with some exceptions) must cover FDA-approved prescription contraceptives, without cost-sharing requirements. The bill also prohibits retailers from interfering with an individual's access to oral contraceptives that are meant for routine, daily use and are FDA-approved for use without a prescription.

If It's Good Enough For the Banks, It's Good Enough For Students Act This bill establishes a program that allows qualified borrowers to refinance their Federal Direct Loans down to the lower interest rates offered to banks by the Federal Reserve System (i.e., through the discount window). The refinanced interest rate is fixed for the period of the loan. The bill also directs the Department of Education and the Consumer Financial Protection Bureau to carry out a campaign to notify qualified borrowers who are not in default on their loans that they are eligible to apply for refinancing under the program within a two-year period.

Deceptive Practices and Voter Intimidation Prevention Act of 2019 This bill generally prohibits deceptive practices, false statements, and voter interference regarding federal elections. Specifically, the bill prohibits any person, within 60 days before an election, from communicating, causing to be communicated, or producing for communication certain information on voting, if the person (1) knows such information to be materially false, and (2) has the intent to impede or prevent another person from exercising the right to vote in an election. The bill also prohibits false statements regarding public endorsements and hindering, interfering with, or preventing voting or registering to vote. A private right of action for preventive relief is established for persons aggrieved by violations of these prohibitions. Criminal penalties are also established for violations. If the Department of Justice (DOJ) receives a credible report that materially false information has been or is being communicated in violation of these prohibitions, DOJ must communicate to the public accurate information designed to correct the materially false information.

Deter Obnoxious, Nefarious, and Outrageous Telephone Calls Act of 2019 or the DO NOT Call Act This bill increases and establishes criminal penalties, which include imprisonment for up to one year, for an intentional violation of the prohibition on automated telephone marketing and messaging. In addition, a person may be imprisoned for up to three years for an aggravated violation of such prohibition if the person (1) previously has been convicted of such an offense, (2) initiates a certain high volume of such calls during specified periods of time, (3) commits the offense in the furtherance of a felony, or (4) causes losses of at least $5,000 during any one year period to one or more persons. The bill also increases from $10,000 to $20,000 the fine for intentionally transmitting misleading or inaccurate caller identification information.

Broadband DATA Act

Broadband Deployment Accuracy and Technological Availability Act or the Broadband DATA Act This bill requires the Federal Communications Commission (FCC) to change the way broadband data is collected, verified, and reported. Specifically, the FCC must collect and disseminate granular broadband service availability data (broadband maps) from wired, fixed-wireless, satellite, and mobile broadband providers. To do this, the FCC is required to establish the Broadband Serviceable Location Fabric (a dataset of geocoded information for all broadband service locations, atop which broadband maps are overlaid) as the vehicle for reporting broadband service availability data. Additionally, the FCC must put forth specified requirements for service availability data collected from broadband providers, and it must create a challenge process to enable the submission of independent data challenging the accuracy of FCC broadband maps.

Horseracing Integrity Act of 2019 This bill establishes the Horseracing Anti-Doping and Medication Control Authority as an independent, private non-profit corporation with responsibility for developing and administering an anti-doping and medication control program for (1) Thoroughbred, Quarter, and Standardbred horses that participate in horse races; and (2) the personnel engaged in the care, training, or racing of such horses. The Federal Trade Commission shall have oversight over the authority. An interstate compact may be established after five years to take over the authority's duties. The sale of a Thoroughbred, Quarter, or Standardbred horse shall be considered an unfair or deceptive act or practice if the seller (1) knows or has reason to know the horse has been administered a substance that the authority determines has a long-term degrading effect on the soundness of the horse, and (2) fails to disclose to the buyer the administration of such substance.

Jobs and Childcare for Military Families Act of 2019 This bill amends the Internal Revenue Code to allow a work opportunity tax credit for hiring a qualified military spouse. A "qualified military spouse" is the spouse or domestic partner (as recognized under state law or by the Armed Forces) of a member of the Armed Forces. The bill also requires the Department of Defense and the Department of Homeland Security (with respect to the Coast Guard) to implement flexible spending arrangements that permit members of the Armed Forces to use basic pay and compensation to pay for childcare services for their dependent children on a pre-tax basis.

Affordable Medications Act This bill revises and expands various requirements relating to prescription-drug pricing and affordability. Specifically, the bill expands financial reporting requirements for drug manufacturers and establishes corresponding civil penalties for noncompliance; adds reporting requirements for certain nonprofit patient-assistance programs; requires the Centers for Medicare & Medicaid Services (CMS) to negotiate prices for certain prescription drugs under Medicare; requires the Centers for Medicare and Medicaid Innovation within the CMS to test specified models for negotiating drug prices; establishes reporting requirements, and corresponding civil penalties for noncompliance, for pharmaceutical companies with respect to spikes in prescription-drug prices; establishes an excise tax on prescription drugs subject to price spikes; lessens prescription-drug cost-sharing requirements under qualified health plans and group health plans; modifies requirements for the importation of prescription drugs; requires drug manufacturers to provide drug rebates for drugs dispensed to certain low-income individuals under the Medicare program; limits the time frame that trade agreements are required to provide market exclusivity for biological products; establishes an innovation incentive fund for new or more effective treatments of bacterial infections; establishes a Center for Clinical Research within the National Institutes of Health; revises certain time frames and conditions related to drug exclusivity; requires the Food and Drug Administration to establish a database of generic drugs; and modifies other provisions related to generic drugs, prescription-drug advertising, disclosure of wholesale acquisition prices, and patent-infringement proceedings.

Keeping Gun Dealers Honest Act of 2019 This bill modifies the requirements and penalties applicable to an individual who engages in the business of dealing, importing, or manufacturing firearms (i.e., a federal firearms licensee, or FFL). Among other things, the bill does the following: increases the allowable number of annual compliance inspections; authorizes the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) to hire at least 80 additional personnel to conduct additional inspections; increases the maximum prison term for an FFL or licensed collector who knowingly makes a false statement or representation in required firearms records; allows the ATF to require an FFL to conduct physical inventories if the FFL unlawfully transfers a firearm or if 10 or more crime guns are traced back to the FFL; allows the ATF to deny an application for a federal firearms license if it would endanger public safety or if the applicant is unlikely to comply with the law; and modifies the liability standard for an FFL who fails to comply with laws or regulations.

United States Call Center Worker and Consumer Protection Act of 2019 This bill establishes restrictions on businesses that relocate call centers or redirect customer service calls to locations outside the United States. Specifically, a business must notify the Department of Labor that it intends to move its customer service call center overseas and Labor must maintain a publicly available list of such businesses. Subject to narrow exceptions, a business appearing on such list is ineligible to receive federal grants or guaranteed loans for five years after the business is added to the list. Further, agencies must condition the awarding of government contracts on the requirement that any call center activity pursuant to the contract must be performed in the United States. Additionally, the bill requires call center employees to disclose their physical location at the beginning of each call initiated or received, unless all employees of the business participating in the communication are located in the United States, among other exceptions.

Every Child Deserves a Family Act This bill prohibits discrimination on the basis of sexual orientation, gender identity, marital status, or religion in the provision of child welfare programs and services by entities receiving federal funding. The Department of Health and Human Services (HHS) must provide technical assistance to help states follow this requirement, including (1) guidance for bringing state laws into compliance, (2) developing training to increase cultural competency related to social identity, and (3) training for judges and attorneys involved in child welfare cases, among other supports. Additionally, HHS must establish the National Resource Center on Safety, Well-Being, Placement Stability, and Permanency for LGBTQ Children and Youth Involved with Child Welfare Services to provide training, technical assistance, and guidance to applicable state and local agencies and service providers. Further, the Religious Freedom Restoration Act may not be the basis for challenging the application or enforcement of this bill. The Government Accountability Office must study and report on states' compliance with the requirements of the bill no later than three years after enactment.

Military Justice Improvement Act of 2019 This bill modifies the process for convening courts-martial for sexual assault cases and certain other offenses. For example, the bill authorizes independent military prosecutors to decide whether to convene courts-martial for (1) sexual assault cases and other specified crimes punishable by confinement of more than one year; and (2) other specified offenses, such as retaliation for reporting a crime, regardless of the maximum punishment authorized for the offenses. Under current law, the military's chain of command generally has sole decisionmaking authority as to whether to prosecute such cases.

Restoring Overtime Pay Act of 2019 This bill requires the Department of Labor to update the salary threshold applicable to bona fide executive, administrative, and professional employees for purposes of determining eligibility for overtime pay. The bill adopts rulemaking promulgated by Labor in 2016 that established the threshold for exempting such employees from overtime requirements at the 40th percentile of earnings for full-time salaried employees in the lowest-wage census region. The bill also requires updates to the threshold amount every three years. In addition, the Bureau of Labor Statistics shall publish quarterly on its public website data on the weekly earnings of nonhourly, full-time salaried workers by census region.

Central American Women and Children Protection Act of 2019 This bill authorizes the Department of State to enter into bilateral agreements with the governments of El Salvador, Guatemala, and Honduras to assist such countries in addressing violence against women and children. Such agreements shall establish a plan to achieve certain objectives, such as (1) identifying areas of the highest incidence of violence against women and children, (2) evaluating victims' access to justice and the ability of the justice system to hold perpetrators accountable, and (3) identifying measurable goals to deter crimes against women and children. The State Department may assist the governments of El Salvador, Guatemala, or Honduras if such a government enters into an agreement with the United States, but no funds provided under this bill may be given directly to such a government.

Territories Health Equity Act of 2019 This bill alters provisions under Medicaid, Medicare, and Medicare Advantage relating to U.S. territories, and generally modifies and establishes programs to expand health insurance coverage for residents. Among other things, the bill eliminates Medicaid funding limitations for U.S. territories beginning in FY2020, repeals provisions that exclude residents of Puerto Rico from a certain automatic enrollment process for Medicare medical services, establishes minimum criteria for certain elements used in Medicare Advantage payment calculations for areas within U.S. territories, and allows residents of U.S. territories who are unable to obtain health insurance through their employer or a health insurance exchange to instead obtain coverage that is at least as broad as the coverage available to Members of Congress and their staff through the District of Columbia exchange.

Safe Sleep Act of 2019 This bill makes it unlawful to manufacture, sell, or distribute inclined sleepers for infants. Specifically, inclined sleepers for infants are those that are designed for an infant up to one year old and have an inclined sleep surface of greater than 10 degrees. The bill also requires that any rules promulgated by the Consumer Product Saftey Commission with respect to infant sleepers are consistent with prevailing safe sleep best practices.

Real Emergency Access for Aging and Disability Inclusion for Disasters Act or the REAADI for Disasters Act This bill establishes programs and requirements to assist individuals with disabilities and the elderly with disaster preparedness. The Department of Health and Human Services (HHS) shall award disaster response grants to eligible entities to carry out projects to create opportunities for disabled individuals and older adults to contribute to disaster response and mitigation. The bill also establishes the National Commission on Disability and Aging Rights and Disasters to address the rights of disabled individuals and older adults throughout the period of preparation for and response to disasters. The Government Accountability Office must study the compliance of federal agencies with the Americans with Disabilities Act of 1990 in expending funds to support disabled individuals and older adults in responding to and mitigating disasters.

Disaster Relief Medicaid Act

Disaster Relief Medicaid Act This bill establishes a series of programs and requirements relating to Medicaid coverage of individuals affected by a federally declared major disaster. In particular, the bill provides for specific disaster relief coverage under Medicaid for individuals who meet specified income eligibility standards and, during the seven-day period preceding the disaster, were either residents of the impacted area or were employed in the impacted area (and subsequently lost employment). Coverage is effective for two years after the date of the disaster declaration. State Medicaid programs must provide disaster relief coverage that is at least as comprehensive as the state's Medicaid coverage and the Medicaid coverage of the individual's home state, as applicable. The bill applies a 100% Federal Medical Assistance Percentage to such coverage and related administrative expenses.

Carbon Pollution Transparency Act This bill requires the heads of federal agencies, when making certain rulemaking or procurement decisions, to consider and document the cost of carbon dioxide, methane, and nitrous oxide emissions in accordance with a set of standardized amounts. The bill establishes the Interagency Working Group on the Costs of Greenhouse Gases to evaluate, at least once every five years, the method of calculating the cost of carbon dioxide, methane, and nitrous oxide. The bill also establishes the Costs of Greenhouse Gases Scientific Review Committee to make recommendations to the working group regarding revisions to the calculation method. The 10 members of the committee must be selected by the National Academies of Sciences, Engineering, and Medicine and represent relevant scientific fields.

Protecting Families and Improving Immigration Procedures Act This bill establishes limitations on separating alien children from parents and on detaining families, and also addresses other immigration-related matters. A child may be separated from a parent or legal guardian at or near a port of entry or U.S. border only if (1) a state court has made a relevant ruling, such as terminating the parent's rights; (2) a qualified child welfare agency official has ruled that separation is in the child's best interest; or (3) a specified official makes certain determinations, such as concluding that a child is a trafficking victim. A child may not be separated from a parent or guardian solely to deter migration or promote compliance with immigration laws. This bill establishes presumptions (1) in favor of family unity and keeping siblings together, and (2) against detention. The Department of Homeland Security (DHS) shall (1) document all child separations, (2) develop training for officers handling separations, (3) publish guidance on how to locate a separated child, (4) periodically provide a parent or guardian information about a separated child, and (5) pay for counsel to represent unaccompanied alien children in removal proceedings. The Flores settlement (an agreement imposing conditions on the treatment of detained alien minors) and a related court holding shall apply to the detention of families. The Department of Justice shall increase the number of immigration judges and support staff. Immigration judges may suspend removal proceedings in certain instances, such as when the alien appears to be prima facie eligible for another immigration benefit.

EQUITABLE Act

Ensuring Quality Information and Transparency for Abroad-Based Listings on our Exchanges Act or the EQUITABLE Act This bill generally restricts the use of a foreign public accounting firm by a foreign issuer of securities. The bill requires certain disclosures from a foreign issuer of securities that uses, for its required audit report to the Securities and Exchange Commission (SEC), a foreign public accounting firm that is not subject to inspection by the Public Company Accounting Oversight Board. If an issuer uses such a foreign public accounting firm, the issuer is generally prohibited from listing its securities on a national securities exchange. Specifically, an issuer that is not currently listed on an exchange and uses such a firm may not be listed. A currently-listed issuer will be delisted beginning in 2025 if the issuer uses such a firm for three consecutive years.

Paying a Fair Share Act of 201 9 This bill requires an individual taxpayer whose adjusted gross income exceeds $1 million (high-income taxpayer) to pay a minimum tax rate of 30% of the excess of the taxpayer's adjusted gross income over the taxpayer's modified charitable contribution deduction for the taxable year (tentative fair share tax). The amount of the tax is the excess (if any) of the tentative fair share tax over the excess of (1) the sum of the taxpayer's regular tax liability, the alternative minimum tax (AMT) amount, and the payroll tax for the taxable year; over (2) certain tax credits. The bill provides for a phase-in of such tax and requires an inflation adjustment to the $1 million income threshold for taxable years beginning after 2020. The bill also expresses the sense of the Senate that Congress should enact tax reform that repeals unfair and unnecessary tax loopholes and expenditures, simplifies the tax system, and makes sure that the wealthiest taxpayers pay a fair share of taxes.

Affordable Housing Credit Improvement Act of 2019

Affordable Housing Credit Improvement Act of 2019 This bill revises provisions of the low-income housing tax credit and renames it as the affordable housing credit . The bill increases the per capita dollar amount of the credit and its minimum ceiling amount beginning in 2019 and extends the inflation adjustment for such amounts. The bill modifies tenant income eligibility requirements and the average income formula for determining such income. It also revises rules for student occupancy of rental units and tenant voucher payments and prohibits any refusal to rent to victims of domestic abuse. The bill further modifies the credit to establish a 4% minimum credit rate for certain housing projects, repeal the qualified census tract population cap, prohibit local approval and contribution requirements, increase the credit for certain projects designated to serve extremely low-income households, increase the credit for certain bond-financed projects designated by state agencies, eliminate the basis reduction for properties that receive certain energy-related tax benefits, and increase the population cap for difficult development areas (i.e., areas with high construction, land, and utility costs relative to area median gross income). The bill also includes Indian and rural areas as difficult development areas and modifies other requirements relating to casualty losses, acquisition credits, and foreclosures.
