Keep Americans Safe Act

Keep Americans Safe Act This bill establishes a new criminal offense for the import, sale, manufacture, transfer, or possession of a large capacity ammunition feeding device (LCAFD). The bill does not prohibit certain conduct with respect to an LCAFD, including the following: importation, sale, manufacture, transfer, or possession related to certain law enforcement efforts, or authorized tests or experiments; importation, sale, transfer, or possession related to securing nuclear materials; and possession by a retired law enforcement officer. The bill permits continued possession of, but prohibits sale or transfer of, a grandfathered LCAFD. Newly manufactured LCAFDs must display serial number identification and the date of manufacture. Additionally, the bill allows a state or local government to use Edward Byrne Memorial Justice Assistance Grant Program funds to compensate individuals who surrender an LCAFD under a buy-back program.

Transit Worker and Pedestrian Protection Act This bill requires grant recipients under the public transportation safety program who operate a fixed route bus service to (1) develop a risk reduction program for bus operations to improve safety by reducing the number and rates of accidents, injuries, assaults on bus operators, and fatalities; (2) submit the program  to the Department of Transportation (DOT) for review and approval; and (3) implement the approved program. DOT shall require grant recipients who operates a rail fixed guideway public transportation system that is not subject to regulation by the Federal Railroad Administration to (1) develop a risk reduction program for assaults on rail workers to improve safety by reducing the number and severity of assaults on such workers; (2) submit the program to DOT for review and approval; and (3) implement the approved program. A grant recipient shall report to DOT any information on each assault on a transit worker for inclusion in the National Transit Database.

It also repeals provisions related to (1) the President's authority to impose sanctions on countries that provide assistance to Cuba, (2) the prohibition against U.S. investment in domestic telecommunications networks within Cuba, (3) restrictions on vessels that have departed from a port in Cuba within 180 days of loading or unloading freight in the United States, and (4) restrictions on remittances to Cuba. The President is authorized to impose export controls with respect to Cuba and exercise certain emergency economic powers in relation to unusual and extraordinary threats to the United States.

Marijuana Revenue and Regulation Act

Marijuana Revenue and Regulation Act This bill removes marijuana from the list of controlled substances and establishes requirements for the taxation and regulation of marijuana products. The bill imposes (1) an excise tax on marijuana products produced in or imported into the United States, and (2) an occupational tax on marijuana production facilities and export warehouses. The term "marijuana product" does not include (1) any article containing marijuana that has been approved by the Food and Drug Administration (FDA) for sale for therapeutic purposes and is marketed and sold solely for such purpose, or (2) industrial hemp. The excise tax includes exemptions for (1) products used for research or by government entities for nonconsumption purposes; and (2) the transfer of products between production, import, and export facilities. The Department of Justice must remove marijuana from all schedules of controlled substances under the Controlled Substances Act. The bill prohibits marijuana from being shipped or transported into any state or jurisdiction where it is illegal. Producers, importers, and exporters of marijuana products must (1) obtain a permit from the Department of the Treasury, and (2) comply with certain requirements regarding recordkeeping, packaging, labeling, and advertising. The bill also establishes penalties for violations of marijuana laws; prohibits the sale of more than one ounce of marijuana in any single retail transaction; and provides specified authorities to the FDA and the Bureau of Alcohol, Tobacco, Firearms, and Explosives with respect to marijuana.

Families, Not Facilities Act of 2019 This bill amends provisions related to the safety of minor aliens that enter the United States unaccompanied by a guardian. When placing an unaccompanied alien child with a proposed custodian, the Department of Homeland Security (DHS) shall not consider the custodian's immigration status. DHS shall not use certain information obtained for placing a child with a custodian to apprehend, detain, or deport certain individuals, including the child, proposed sponsor, or a person living with the sponsor. The Office of Refugee Settlement shall provide services for unaccompanied alien children after they have been released, to help them transition into their communities and to connect them with legal representation. Money appropriated to the U.S. Immigration and Customs Enforcement (ICE) for FY2019 shall be redirected to fund such services. Other money appropriated for ICE shall be redirected to various programs to investigate and prevent child trafficking. This bill also establishes the Office of Refugee Resettlement Advisory Committee on Shelters for Unaccompanied Alien Children. The advisory committee may conduct unannounced inspections of Office of Refugee Settlement shelters that hold unaccompanied alien children and shall issue reports on its investigations and recommendations regarding the shelters.

Stop Price Gouging Act

Stop Price Gouging Act This bill imposes an excise tax on pharmaceutical companies that sell prescription drugs that are subject to price spikes that exceed the annual percentage increase in the Chained Consumer Price Index. For each taxable prescription drug, the excise tax ranges from 50% to 100% of price spike revenue received by the company, depending on the size of the price spike and including an adjustment for revenue that is due solely to an increase in the cost of the inputs necessary to manufacture the drug. Pharmaceutical companies must submit specified data regarding drug prices and revenue to the Inspector General (IG) of the Department of Health and Human Services (HHS), and the IG must submit an assessment of the data to the Internal Revenue Service. HHS, upon the recommendation of the IG, may exempt certain drugs from the excise tax if (1) a for-cause price increase exemption should apply; or (2) the drug has an average manufacturer price of not greater than $10 for a 30-day supply and is marketed by at least 3 other holders of applications approved under the Federal Food, Drug, and Cosmetic Act. The Government Accountability Office must examine (1) how drug manufacturers and health plans establish initial launch prices for newly approved drugs, and (2) alternative methods that have been proposed for setting the price of new drugs.

Global Health, Empowerment and Rights Act This bill establishes that a foreign nongovernmental organization shall not be disqualified from receiving certain U.S. international development assistance solely because the organization provides medical services using non-U.S. government funds if the medical services are legal in both the United States and the country in which they are being provided. Such foreign organizations shall not be subject to requirements relating to their use of non-U.S. funds for advocacy or lobbying activities, other than those that apply to U.S. nongovernmental organizations. Current U.S. policy prohibits various foreign assistance from going to a foreign nongovernmental organization unless it agrees to not perform or actively promote abortions.

ANTIQUITIES Act

America's Natural Treasures of Immeasurable Quality Unite, Inspire, and Together Improve the Economies of States Act or the ANTIQUITIES Act This bill provides for the administration of certain National Monuments and the designation of certain lands in New Mexico and Nevada as wilderness. This bill directs the National Park Service, Bureau of Land Management (BLM), U.S. Fish and Wildlife Service, Forest Service, and National Oceanic and Atmospheric Administration to administer each specified national monument in accordance with (1) the one or more presidential proclamations that apply to the monument, (2) any Act of Congress enacted before December 4, 2017, that provides for an adjustment to the boundary or administration of such monument, and (3) this bill. The bill establishes the National Monument Enhancement Fund to furnish funding (1) to such federal agencies to develop management plans for their national monuments that were designated under current federal law, (2) for federal acquisition and development of certain land and other areas, and (3) to develop and enhance recreational infrastructure on such designated lands. The bill designates specified BLM lands within the Organ Mountains-Desert Peaks and Rio Grande del Norte National Monuments in New Mexico and in the Gold Butte National Conservation Area in Nevada as wilderness and as components of the National Wilderness Preservation System. The Department of the Interior shall manage approximately 100 acres of BLM land in New Mexico identified as Lookout Peak Communication Site in a manner that preserves the character of the land for future inclusion in the National Wilderness Preservation System.

Craft Beverage Modernization and Tax Reform Act of 2019 This bill modifies the tax treatment of certain alcoholic beverages to exclude the aging period from the production period for beer, wine, or distilled spirits for purposes of determining whether a taxpayer can expense, rather than capitalize, interest costs paid or incurred during the production period; reduce excise tax rates on beer and distilled spirits; permit the transfer of beer between bonded facilities without payment of tax; increase the amount of the small wine producer tax credit and expand the categories of producers covered by such credit; allow an adjustment to the producer credit for hard cider; and modify the alcohol content limitations that apply to certain wines for tax purposes. The Department of the Treasury must amend applicable regulations with respect to the use of wholesome products suitable for human consumption in the production of fermented beverages. The bill also increases funding for the Alcohol and Tobacco Tax and Trade Bureau.

SWIFT Act

Surviving Widow(er) Income Fair Treatment Act of 2019 or the SWIFT Act This bill modifies eligibility requirements and increases benefits for widows, widowers, and surviving divorced spouses under the Old Age, Survivors, and Disability Insurance (OASDI) benefits program. The bill makes widow and widower's benefits available to disabled individuals at any age, whereas currently the benefits are limited to such individuals between ages 50 to 60. Provisions reducing benefits in various instances, such as when a beneficiary is entitled to multiple types of benefits, shall not apply to widow and widower's benefits for individuals with disabilities. For determining whether a beneficiary has a child in his or her care, the bill raises the upper age limit for the child from 16 to 18 years (or 19, if the child is a full-time elementary or secondary school student). An individual with a child in care may receive increased benefits in specified instances. The bill also increases various limits on widow and widower's benefits in certain instances and modifies the calculation for increased benefits for individuals who choose to delay receiving such benefits. For current beneficiaries, increases in OASDI benefits under this bill shall not affect the beneficiary's eligibility for any federal assistance program or the benefit amount to be received under such an assistance program.

The bill also establishes affirmative defenses to such a civil action. In addition, the bill authorizes drug manufacturers seeking Food and Drug Administration approval for a generic drug to use alternative methods to develop elements assure safe use of a drug.

Transition Team Ethics Improvement Act

Transition Team Ethics Improvement Act This bill establishes ethics requirements for a President-elect's transition team. The bill requires a President-elect to submit to Congress a report with a list of any individual (1) for whom an application for a security clearance was submitted, by 10 days after its submission; or (2) provided a security clearance, by 10 days after it was provided. The Federal Transition Coordinator must negotiate a memorandum of understanding with the transition representative of each eligible candidate by October 1 (currently November 1) of a year during which a presidential election occurs. Each memorandum of understanding shall include an agreement that the eligible candidate will implement and enforce an ethics plan to guide the conduct of the transition beginning on the date on which the candidate becomes the President-elect. The ethics plan shall include a description of the ethics requirements that will apply to all transition team members; a description of how the transition team will address the role on the team of registered lobbyists, former registered lobbyists, persons registered under the Foreign Agents Registration Act, foreign nationals, other foreign agents, and transition team members with sources of income or clients that are not disclosed to the public; a Code of Ethical Conduct, to which each transition team member will sign and be subject to, that reflects the content of the ethics plans and that meets other specified requirements; and a description of how the transition team will enforce the Code of Ethical Conduct.

Agent Orange Exposure Fairness Act of 2019 This bill expands eligibility for a presumption of service-connection for veterans exposed to certain herbicide agents (e.g., Agent Orange) during military service in Vietnam. Specifically, the bill removes the manifestation period required for the presumption of service-connection for chloracne and porphyria cutanea tarda. Additionally, the bill provides statutory authority for a presumption of service-connection for certain cases of acute and subacute peripheral neuropathy without a manifestation period. Under a presumption of service-connection, specific disabilities diagnosed in certain veterans are presumed to have been caused by the circumstances of their military service. Health care benefits and disability compensation may then be awarded.

Women Veterans and Families Health Services Act of 2019 This bill addresses fertility treatments, counseling, and other health-related programs for veterans and members of the Armed Forces. Specifically, the bill requires the Department of Defense (DOD) and the Department of Veterans Affairs (VA) to provide fertility treatments and counseling to covered veterans and active duty servicemembers or a spouse, partner, or gestational surrogate of such veteran or servicemember. A covered veteran or service member is a severely wounded, ill, or injured former or current member of the Armed Forces who has an infertility condition incurred or aggravated while serving on active duty. DOD must establish procedures related to gamete retrieval and storage. Fertility counseling and treatment are included within authorized VA medical services. The VA may pay the adoption expenses (for up to three adoptions) for a covered member who is enrolled in the VA health care system. The VA must facilitate specified reproduction and infertility research conducted collaboratively by DOD and the Department of Health and Human Services. The VA shall enhance the capabilities of the VA women veterans contact center to respond to assistance requests and refer such veterans to federal or community resources. The bill permanently extends and expands a VA pilot program related to group reintegration and readjustment services for certain women veterans. The bill provides child care assistance to qualified veterans receiving (1) mental health care services or intensive health care services, and (2) readjustment counseling and related mental health services.

Prevention of Arms Race Act of 2019 This bill restricts the appropriation of funds for the procurement, flight testing, or deployment of missiles banned by the Treaty between the United States of America and the Union of Soviet Socialist Republics on the Elimination of Their Intermediate-Range and Shorter-Range Missiles (INF Treaty). Before such funds may be appropriated, the Department of Defense shall submit a report to Congress that includes (1) a memorandum of understanding from a North Atlantic Treaty Organization or Indo-Pacific ally committing to hosting the deployment of such a missile, (2) confirmation that the United States has not rejected any diplomatic offer to resolve Russia's violation of the INF Treaty, (3) discussion of the ramifications of a collapse of the treaty and of a U.S. withdrawal from the agreement, (4) discussion of the mission requirements with respect to Russia and China that would be met by weapons systems covered by the INF, and (5) discussion of the degree to which INF-compliant weapons can meet such mission requirements.

For the 99.8 Percent Act This bill imposes increased tax rates on decedent estates, gifts, and generation-skipping transfers. Estates with a value of over $1 billion are taxed at a 77% tax rate. The basic exclusion amount is reduced to $3.5 million. The bill increases (1) to $3 million the reduction in valuations of farmland for estate tax purposes and adjusts such increased amount for inflation, and (2) to $2 million the maximum estate tax exclusion for contributions of conservation easements. The bill requires (1) consistent basis reporting for property acquired by gift and transfers in trust, and (2) executors of estates and donors of gifts required to file a gift tax return to disclose to the Department of the Treasury, and to recipients of any interest in an estate or a gift, information identifying the value of each interest received. The bill sets forth estate valuation rules for certain transfers of nonbusiness assets and limits estate tax discounts for certain individuals with minority interests in a business acquired from a decedent. The bill expands rules for valuing assets in grantor retained annuity trusts to require that (1) the right to receive fixed amounts from an annuity last for a term of not less than 10 years and not more than the life expectancy of the annuitant plus 10 years, and that such fixed amounts not decrease during the first 10 years of the annuity term, and (2) the remainder interest have a value when transferred that is not less than the the greater of 25% of the fair market value of the trust property or $500,000. The bill also sets forth rules for the application of transfer taxes to a grantor trust (a trust in which the grantor retains control over the trust assets and has the right to receive income from the trust). The bill eliminates the generation-skipping transfer tax exemption for any trust whose termination date is not greater than 50 years after its creation. The bill modifies the gift tax exclusion for annual gifts (currently, $14,000).

Specifically, the bill prohibits a merger that materially (currently, substantially) lessens competition in more than a de minimis amount or tends to create a monopsony (a market situation in which there is only one buyer); shifts the burden of proof to the merging companies to show that their consolidation will not harm competition; requires companies that enter into a settlement agreement with the Federal Trade Commission (FTC) or Department of Justice regarding a merger to report information that allows the agencies to assess the competitive impact of the merger, and establishes the Office of the Competition Advocate within the FTC.

Keep Families Together Act This bill limits the separation of families at or near U.S. borders or ports of entry. The Departments of Homeland Security (DHS), Justice, and Health and Human Services shall not separate a child from a parent or legal guardian at a port of entry or within 100 miles of a U.S. border unless a state court terminates the parent or legal guardian's rights; a state child welfare agency or court determines it is in the child's best interests to be removed; or the child is determined to be a trafficking victim or at risk of becoming one, the accompanying adult is most likely not the parent or legal guardian, or the child is in danger of abuse or neglect. An agency may not separate a child from a parent or legal guardian solely to deter migration into the United States or to promote compliance with immigration laws. DHS shall develop (1) training related to the bill's family separation requirements, and (2) guidance for how parents and legal guardians may locate a separated child. DHS shall provide parents and legal guardians periodic status updates about a separated child. The Government Accountability Office shall report to Congress on the criminal prosecution of asylum seekers.

This joint resolution directs the President to remove U.S. Armed Forces from hostilities in or affecting Yemen within 30 days unless Congress authorizes a later withdrawal date, issues a declaration of war, or specifically authorizes the use of the Armed Forces. Prohibited activites include providing in-flight fueling for non-U.S. aircraft conducting missions as part of the conflict in Yemen. This joint resolution shall not affect any military operations directed at Al Qaeda. The President must submit to Congress, within 90 days, reports assessing the risks that would be posed (1) if the United States were to cease supporting operations with respect to the conflict in Yemen, and (2) if Saudi Arabia were to cease sharing Yemen-related intelligence with the United States.

Paycheck Fairness Act

Paycheck Fairness Act This bill addresses wage discrimination on the basis of sex. It amends equal pay provisions of the Fair Labor Standards Act of 1938 to (1) restrict the use of the bona fide factor defense to wage discrimination claims, (2) enhance nonretaliation prohibitions, (3) make it unlawful to require an employee to sign a contract or waiver prohibiting the employee from disclosing information about the employee's wages, and (4) increase civil penalties for violations of equal pay provisions. The Equal Employment Opportunity Commission (EEOC) and the Office of Federal Contract Compliance Programs shall train EEOC employees and other affected parties on wage discrimination. The bill directs the Department of Labor to: (1) establish and carry out a grant program for negotiation skills training for girls and women, (2) conduct studies to eliminate pay disparities between men and women, and (3) make available information on wage discrimination to assist the public in understanding and addressing such discrimination. The Secretary of Labor's National Award for Pay Equity in the Workplace is established for an employer who has made a substantial effort to eliminate pay disparities between men and women. The bill requires the EEOC to issue regulations for collecting from employers compensation and other employment data according to the sex, race, and national origin of employees for use in enforcing laws prohibiting pay discrimination.

Rebuild America's Schools Act of 2019 This bill provides financial assistance in FY2020-FY2029 for long-term improvements to public school facilities by allocating funds to states for school improvements, awarding need-based grants to local education agencies, and restoring school infrastructure tax credit bonds. The bill specifies allowable uses of grant funds, including making major repairs of public school facilities and making public school facilities accessible to disabled individuals. The bill requires local education agencies to adopt certain green practices (environmental standards) and use products made in the United States (Buy America). The Department of Education must establish a clearinghouse to disseminate information to assist schools in initiating, developing, and financing energy efficiency projects, distributed generation projects, and energy retrofitting projects. The bill increases funding through FY2023 for the Impact Aid Construction program under the Elementary and Secondary Education Act of 1965.

The bill directs the Department of Labor to award grants to states and certain eligible entities to assist them in transforming their business and program models to support individuals with disabilities by operating competitive integrated employment businesses, assisting disabled individuals in finding and retaining work in such employment, and providing integrated employment and integrated community participation and wraparound services for such individuals. The bill prohibits the issuance of new special certificates that allow payment of subminimum wages to disabled individuals and phases out existing certificates over a six year period. The bill directs the Office of Disability Employment of Labor to award grants to provide technical assistance to employers transitioning from special certificates to competitive integrated employment for disabled individuals. Labor must contract with a nonprofit entity to conduct an evaluation of the impact of the transitioning requirements of this bill.

Christa McAuliffe Commemorative Coin Act of 2019 This bill directs the Department of the Treasury to mint and issue not more than 350,000 $1 silver coins in commemoration of Christa McAuliffe, a teacher tragically killed in the Space Shuttle Challenger Disaster. The design of the coins shall bear an image and the name of Christa McAuliffe on the obverse side and a design on the reverse side that depicts the legacy of McAuliffe as a teacher. Treasury may issue the coins from January 1-December 31, 2020. All surcharges received by Treasury from the sale of the coins shall be paid to the FIRST robotics program for the purpose of engaging and inspiring young people, through mentor-based programs, to become leaders in the fields of science, technology, engineering, and mathematics.

Savanna's Act This bill directs the Department of Justice (DOJ) to review, revise, and develop law enforcement and justice protocols to address missing and murdered Indians. The bill requires DOJ to take the following actions: provide training to law enforcement agencies on how to record tribal enrollment for victims in federal databases, develop and implement a strategy to notify citizens of the National Missing and Unidentified Persons System, conduct specific outreach to Indian tribes regarding the ability to publicly enter information through the National Missing and Unidentified Persons System or other non-law enforcement sensitive portal, develop guidelines for response to cases of missing and murdered Indians, provide training and technical assistance to Indian tribes and law enforcement agencies for implementation of the developed guidelines, and report statistics on missing and murdered Indians. Federal law enforcement agencies must modify their guidelines to incorporate the guidelines developed by DOJ. The FBI shall include gender in its annual statistics on missing and unidentified persons published on its website.
