Strengthening Medicare And Reducing Taxpayer Prices Act or the SMART Prices Act This bill modifies requirements of the Medicare Drug Price Negotiation Program and makes other changes with respect to the prices of prescription drugs under Medicare. Current law requires the Centers for Medicare & Medicaid Services (CMS) to negotiate maximum prices for brand-name drugs that do not have other generic equivalents and that account for the greatest Medicare spending. The CMS must negotiate the prices of 10 drugs that are covered under the Medicare prescription drug benefit in 2026, 15 drugs that are covered under the Medicare prescription drug benefit in 2027, 15 drugs that are covered under the Medicare prescription drug benefit or under Medicare medical services in 2028, and 20 drugs that are covered under the Medicare prescription drug benefit or under Medicare medical services in 2029 and each year thereafter. The bill requires the CMS to negotiate the prices of 20 drugs under the Medicare prescription drug benefit in 2026 and 40 drugs under the Medicare prescription drug benefit or under Medicare medical services in 2027 and each year thereafter. It also (1) shortens the required period of market approval from 7 years and 11 years for drugs and biologics, respectively, to 3 years; and (2) modifies the ceiling for the maximum fair price for short-, extended-, and long-monopoly drugs. The bill also repeals provisions that prohibit the CMS from interfering in negotiations between drug manufacturers, pharmacies, and PDP sponsors (i.e., noninterference clause).

Do No Harm Act This bill prohibits the application of the Religious Freedom Restoration Act of 1993 (RFRA) to specified federal laws or the implementation of such laws. Currently, RFRA prohibits the government from substantially burdening a person's exercise of religion even if the burden results from a rule of general applicability, except in furtherance of a compelling governmental interest when using the least restrictive means. Under the bill, RFRA is inapplicable to laws or the implementation of laws that protect against discrimination or require the promotion of equal opportunity (e.g., the Civil Rights Act of 1964); require employers to provide wages, other compensation, or benefits, including leave; protect collective activity in the workplace; protect against child labor, abuse, or exploitation; or provide for access to, information about, referrals for, provision of, or coverage for any health care item or service. The bill prevents RFRA from being used to deny (1) goods or services the government has agreed to provide to a beneficiary of or participant in a program or activity funded by a government contract, grant, agreement, or other award; or (2) a person's full and equal enjoyment of a government-provided good, service, benefit, facility, privilege, advantage, or accommodation. In order for a person to assert a RFRA claim or defense in a judicial proceeding, the government must be a party to the proceeding.

U.S. and Pacific Islands Forum Partnership Act This bill requires the President to appoint, with the advice and consent of the Senate, a qualified individual to serve as Special Envoy to the Pacific Islands Forum. (The Pacific Islands Forum is a regional political and economic policy organization with 18 member nations.) The Special Envoy may not concurrently serve as a U.S. ambassador to an individual country. The Special Envoy shall represent the United States in its role as a dialogue partner to the Pacific Islands Forum.

Workplace Violence Prevention for Health Care and Social Service Workers Act This bill requires the Department of Labor to address workplace violence in health care, social service, and other sectors. Specifically, Labor must issue an interim occupational safety and health standard that requires certain employers to take actions to protect workers and other personnel from workplace violence. The standard applies to employers in the health care sector, in the social service sector, and in sectors that conduct activities similar to those in the health care and social service sectors. In addition, Labor must promulgate a final standard within a specified time line.

Ending Trading and Holdings In Congressional Stocks (ETHICS) Act This bill generally prohibits Members of Congress (and their spouses and dependents) from purchasing or selling certain investments, such as individual stocks and related financial instruments that are not diversified investment funds, Treasury securities, or other specified holdings. Violations of this prohibition are subject to specified civil penalties. Members must certify their compliance with the provisions of the bill, and the applicable House or Senate ethics office must make the certifications and related information (e.g., trust agreements; descriptions of assets held in trusts; and federal loans, grants, or related benefits that the Member received) available online. Additionally, the bill restricts certain communications between trustees and beneficiaries related to investments held in qualified blind trusts. Violations of the restriction are subject to specified civil penalties. Further, the bill imposes penalties for failing to comply with existing financial disclosure requirements and requires electronic filing of those disclosures in a searchable format.

Global Health, Empowerment and Rights Act This bill establishes that a foreign nongovernmental organization shall not be disqualified from receiving certain U.S. international development assistance solely because the organization provides medical services using non-U.S. government funds if the medical services do not violate the laws of the country in which they are being provided and would not violate United States federal law if provided in the United States. Such foreign organizations shall not be subject to requirements relating to their use of non-U.S. funds for advocacy or lobbying activities, other than those that apply to U.S. nongovernmental organizations.

Seedlings for Sustainable Habitat Restoration Act of 2023 This bill provides support for the collection and maintenance of native seeds and production of tree seedlings. First, the bill expands the Infrastructure Investment and Jobs Act to allow the Forest Service to enter into contracts, grants, or agreements with state forestry agencies, institutions of higher education, and other entities for the (1) collection and maintenance of native seeds, including material from managed seed orchards; and (2) production of seedlings for revegetation. Second, the bill modifies requirements for forest landscape restoration proposals for funding under the Collaborative Forest Landscape Restoration Program. Specifically, the bill adds institutions of higher education to the list of entities that may provide employment or training opportunities under a proposal and allows the employment or training opportunities to include the collection and maintenance of native seeds for revegetation or the production of seedlings.

Background Check Completion Act of 2023 This bill prohibits a licensed gun dealer from transferring a firearm to an unlicensed person prior to the completion of a background check. Current law permits a licensed gun dealer to transfer a firearm to an unlicensed person if a submitted background check remains incomplete after three business days.

Recovering America’s Wildlife Act of 2023 This bill provides funding for the conservation or restoration of wildlife and plant species of greatest conservation need, including endangered or threatened species. Specifically, the bill establishes and funds through FY2027 a subaccount of the Wildlife Conservation and Restoration Account, which was established under the Pittman-Robertson Wildlife Restoration Act. The subaccount must be used to support efforts of states, territories, or the District of Columbia to recover and manage wildlife and plant species of greatest conservation need. The Department of the Interior must use a portion of the funding from the subaccount for grants that may be used by state fish and wildlife departments or other specified entities for innovative recovery efforts for species of greatest conservation need, species listed as endangered or threatened species, or the habitats of such species. The bill also establishes and funds a Tribal Wildlife Conservation and Restoration Account to support Indian tribes' efforts to recover and manage wildlife and plant species of greatest conservation need. In addition, the bill establishes and funds through FY2027 the Endangered Species Recovery and Habitat Conservation Legacy Fund. The U.S. Fish and Wildlife Service must use the fund to (1) implement an Endangered Species Recovery Grant Program; (2) address its interagency consultation responsibilities under the Endangered Species Act of 1973; (3) work with nonfederal entities to conserve wildlife habitat and certain at-risk species; or (4) address the development and permitting of voluntary conservation agreements under such act.

Rural Hospital Support Act This bill modifies and extends certain payment adjustments for rural hospitals under Medicare's inpatient prospective payment system. Specifically, the bill indexes payment adjustments for sole community hospitals and Medicare-dependent hospitals to FY2016 operating costs, if it results in higher payments for such hospitals. The bill also makes payment adjustments for Medicare-dependent hospitals and low-volume hospitals permanent (the adjustments currently expire at the end of FY2024).

Accelerating Deployment of Versatile, Advanced Nuclear for Clean Energy Act of 2023 or the ADVANCE Act of 2023 This bill sets forth provisions to develop and deploy advanced nuclear fuel for the United States and certain allied countries, restrict the possession or ownership of enriched uranium from Russia or China, clean up hazardous land, and establish related requirements. Specifically, the bill provides incentives for developing and deploying new nuclear technologies, such as reduced licensing fees and prize awards for deploying such technologies. It also extends through 2045 the indemnification policy under the Price-Anderson Act that limits liability related to the nuclear industry. It also requires the Nuclear Regulatory Commission (NRC) to (1) develop a process that enables timely licensing of nuclear production facilities or utilization facilities at brownfield sites, and (2) establish an initiative to enhance preparedness and coordination with respect to the qualification and licensing of advanced nuclear fuel. NRC may hire specialized staff without regard to civil service laws to address its critical licensing or regulatory oversight needs. The NRC must also coordinate certain international nuclear activities and may establish an International Nuclear Reactor Export and Innovation Branch within the Office of International Programs. The bill allows certain foreign entities to receive licenses under the Atomic Energy Act of 1954 for nuclear utilization facilities as specified by the bill. The bill also allows the Environmental Protection Agency to conduct activities to assist in cleaning up certain abandoned mining sites on tribal lands that are hazardous.

Voluntary Public Access Improvement Act of 2023 This bill reauthorizes through FY2028 and increases funding for the Voluntary Public Access and Habitat Incentive Program. This Natural Resources Conservation Service program provides state and tribal governments competitive grants to encourage owners and operators of privately-held land (i.e., farm, ranch, and forest land) to allow public access for hunting, fishing, and other wildlife-dependent recreation.

EMS Counts Act of 2023 This bill requires the Department of Labor to revise the broad description under the occupational series 33-2011 Firefighters of the 2018 Standard Occupational Classification System of the Bureau of Labor Statistics to include the following detailed occupations: Firefighters; Firefighter/EMTs; Firefighter/Paramedics; and Firefighters, All Other.

Senior Hunger Prevention Act of 2023 This bill modifies and expands nutrition programs for older adults and adults with disabilities, including the Supplemental Nutrition Assistance Program (SNAP) and the Commodity Supplemental Food Program (CSFP). Under the bill, a household's eligibility for SNAP benefits may be certified for 36 months if all adult household members are elderly or disabled, an increase from 24 months. The bill also expands the SNAP medical expense deduction. The Department of Agriculture (USDA) must establish an elderly simplified application program (ESAP). Under ESAP, a state may implement a streamlined SNAP application and certification process for households where all adult household members are elderly or disabled and have no earned income. The bill also directs USDA to authorize public-private partnerships between USDA, retail food stores participating in SNAP, and community-based organizations to provide free or low-cost food delivery under SNAP, including through the use of private funds. Further, the bill reauthorizes CSFP, provides additional funding for the program, and expands eligibility to include low-income adults with disabilities. CSFP benefits may also be certified for 36 months. Currently, benefits may be certified for not less than one year, but not more than three years. The bill also expands eligibility for the Seniors Farmers Market Nutrition Program (SFMNP) to include adults with disabilities, provide a 36-month certification period, and include minimum and maximum benefit amounts. Under the bill, USDA must also establish various grant programs; for example, USDA must establish grant programs to modernize SFMNP operations and establish new farmers' markets.

Equal Access to Abortion Coverage in Health Insurance Act of 2023 or the EACH Act of 202 3 This bill requires federal health care programs (e.g., Medicaid, Medicare, and the Children's Health Insurance Program (CHIP)) to provide coverage for abortion services and requires federal facilities to provide access to those services. Currently, coverage for such services under federal programs is generally only available in the case of rape, incest, or life endangerment. Additionally, the bill repeals certain provisions of the Patient Protection and Affordable Care Act that permit states to prohibit coverage of abortion services in plans offered through a health insurance exchange in the state. The bill also permits qualified health plans to use funds attributable to premium tax credits and reduced cost sharing assistance to pay for abortion services. The bill is not subject to the Religious Freedom Restoration Act of 1993, which generally prohibits the federal government from substantially burdening a person's exercise of religion even if the burden results from a generally applicable law.

National Plan to End Parkinson's Act This bill requires the Department of Health and Human Services (HHS) to carry out a project to prevent and cure Parkinson's disease (a progressive brain disorder that causes unintended or uncontrollable movements) and related conditions. Among other components of the project, HHS must (1) implement and periodically update a national plan to coordinate and guide efforts to prevent, slow the progression of, and cure the disease; and (2) improve diagnosis, treatment, and care of those with the disease. HHS must also annually assess the preparations for and response to the increased burden of Parkinson's disease. In addition, the bill establishes a council, comprised of federal and nonfederal stakeholders, to advise HHS on and make recommendations concerning the prevention and treatment of Parkinson's disease. The provisions of the bill terminate at the end of calendar year 2035.

I–27 Numbering Act of 2023 This bill designates the future interstate highway system portions of the Ports-to-Plains Corridor within the states of Texas and New Mexico as Interstate Route I–27. The bill excludes two portions of the Texas and New Mexico corridor. Texas Routes 158 and 349 via I–20 from Sterling City to Lamesa are designated as Interstate Route I–227. U.S. Route 287 from Dumas, Texas to the border between Texas and Oklahoma is designated as Interstate Route I–327.

Agriculture Resilience Act of 2023 This bill establishes, expands, and revises multiple programs and activities of the Department of Agriculture (USDA) primarily to reduce carbon emissions from the agriculture sector. Specifically, USDA must finalize and implement a plan to achieve net-zero emissions from the sector by 2040. USDA must periodically review and revise the plan, as necessary, and annually report on its implementation. Additionally, the bill expands the scope of various USDA research, extension, and education programs; conservation programs; and livestock programs to incorporate climate change adaptation and mitigation. Expanded activities include efforts to improve soil health and preserve farmland and grassland. Further, the bill changes programs that support renewable energy in rural areas to address carbon emissions in the agriculture sector. Among these changes, the bill provides statutory authority for the AgSTAR program for reducing methane emissions from livestock waste and requires the program to be moved from the Environmental Protection Agency to USDA. The bill also addresses food waste, for example, by (1) standardizing the voluntary labels used by food producers to indicate the date by which food should be used or discarded, and (2) making composting activities eligible for support through USDA conservation programs. Moreover, the bill establishes grants to reduce and prevent food waste in landfills and in schools.

Weatherization Assistance Program Improvements Act of 2023 This bill expands the Weatherization Assistance Program of the Department of Energy (DOE). The existing program reduces energy costs for low-income households by increasing the energy efficiency of their homes. The bill establishes a Weatherization Readiness Fund from which DOE may distribute funds to states for repairing structural defects or hazards of such homes so that weatherization measures may be installed. In addition, the bill increases the cap on the amount of funding that may be spent on (1) each home for labor, weatherization materials, and related matter; and (2) renewable energy systems in homes. The bill also eliminates a prohibition on providing funding for partially weatherized homes that have received assistance within the past 15 years. Instead, the bill applies this prohibition on fully weatherized homes.

Loan Forgiveness for Educators Act This bill expands loan forgiveness for educators by revising the Teacher Loan Forgiveness Program. The program provides loan forgiveness (up to $17,500) for teachers who are highly qualified, teach full-time in a low-income elementary or secondary school or educational service agency, and complete five years of consecutive service. Specifically, the bill renames the program as the Educator Loan Forgiveness Programs. Additionally, the bill expands the program by making additional loan types eligible for benefits under the program (e.g., parent PLUS loans). Further, the bill expands program eligibility to early childhood educators and program directors serving in early childhood education programs and school leaders serving in public high-need schools. The bill requires the Department of Education to make monthly student loan payments on behalf of the educator during qualifying service (i.e., employment as a full-time qualifying educator in a high-need school or an early childhood education program), provide complete loan forgiveness after five years of qualifying service, and take steps to notify borrowers about changes to the program.

Puerto Rico Nutrition Assistance Fairness Act of 2023 This bill sets out a process to enable Puerto Rico to participate as a state in the Supplemental Nutrition Assistance Program (SNAP). Under current law, a state receives SNAP funding based on the number of participating households in the state whereas Puerto Rico receives a block grant to fund its nutrition assistance program. The bill requires Puerto Rico to submit to the Department of Agriculture (USDA) a plan of operation to transition away from the consolidated block grant program to SNAP. USDA must provide appropriate training and technical assistance to enable Puerto Rico to formulate such plan.

Streamlining Interstate Transmission of Electricity Act or the SITE Act This bill establishes a process for the Federal Energy Regulatory Commission to authorize the construction, modification, and operation of interstate electric transmission facilities, including by exercising the right of eminent domain (the right of the government to take private property for public use).

Fair Accountability and Innovative Research Drug Pricing Act of 2023 This bill requires manufacturers to report about certain price increases for prescription drugs and biological products with a wholesale cost of at least $100 per month. Such reports must include, among other information (1) the percentage price increase, (2) a justification for such increase, (3) the price history of the drug, (4) the total cost to develop the drug, and (5) the total revenue and net profit generated from the drug. Manufacturers are subject to civil penalties for failing to comply with the bill's requirements. Additionally, the Food and Drug Administration must post the information on its website.

Abortion is Health Care Everywhere Act of 2023 This bill authorizes using certain foreign assistance funds to provide comprehensive reproductive health care services in developing countries, including abortion services, training, and equipment. The bill also removes a statutory prohibition on using such funds in developing countries to (1) pay for abortions performed as a method of family planning, or (2) motivate or coerce any person to practice abortions.

Fire Grants and Safety Act This bill reauthorizes through FY2030 the U.S. Fire Administration, the Assistance to Firefighters Grants Program, and the Staffing for Adequate Fire and Emergency Response Grant Program. The Government Accountability Office must conduct an audit of and issue a publicly available report on barriers that prevent fire departments from accessing federal funds, and the U.S. Fire Administration. The bill makes the government of China, and any entity or organization operating or incorporated in China, ineligible to be a recipient or subrecipient of federal assistance under such programs.

American Innovation and Jobs Act This bill revises and expands the deductibility of research and experimental expenditures to allow immediate expensing of such expenditures. It also allows the amortization over a period of at least 60 months of certain other types of research and experimental expenditures not treated as expenses. The bill increases the maximum amount eligible for the tax credit for new and small businesses and increases to 20% the rate of the credit for business startups.

Monarch Action, Recovery, and Conservation of Habitat Act of 2023 or the MONARCH Act of 2023 This bill provides support for the conservation of western monarch butterflies (the monarch butterfly population that overwinters along the coast of California and breeds across California, Arizona, Nevada, Washington, Oregon, Idaho, and Utah). Specifically, the bill establishes the Western Monarch Butterfly Rescue Fund. The Department of the Interior must use amounts in the fund to provide grants for the conservation of such butterflies and other pollinators within the range of western monarch butterflies. In addition, Interior must enter into an agreement with the National Fish and Wildlife Foundation to facilitate updating and implementing the Western Monarch Butterfly Conservation Plan, which was prepared by the Western Association of Fish and Wildlife Agencies.

Hello Girls Congressional Gold Medal Act of 2023 This bill provides for the award of a single Congressional Gold Medal in honor of the female telephone operators of the Army Signal Corps, commonly known as the Hello Girls , in recognition of their military service, devotion to duty, and 60-year struggle for veterans' benefits and recognition as soldiers.

Healthy Drinking Water Affordability Act or the Healthy H2O Act This bill directs the Department of Agriculture (USDA) to establish a program under which USDA awards grants for improving the quality of drinking water in certain rural areas. Grants may be given to individuals or entities, such as home owners, renters, and licensed child-care facilities, that have demonstrated the presence of one or more health contaminants in their drinking water. Grants may also be given to nonprofit organizations to help individuals and entities test their water, analyze the results of the tests, and reduce the contamination.

Secure Viable Banking Act or the SVB Act This bill increases the oversight of certain nonbank financial companies and bank holding companies by repealing Title IV of the Economic Growth, Regulatory Relief, and Consumer Protection Act (P.L. 115-174). (A nonbank financial company is a financial institution without a banking license that may be subject to supervision due to the company's size or risk profile. A bank holding company owns a controlling interest in one or more banks.) Specifically, the bill decreases from $250 billion to $50 billion the asset threshold at which enhanced prudential standards become mandatory, thereby requiring more companies to comply with these standards. These standards include stress testing, leverage limits, liquidity requirements, and resolution plan requirements (i.e., living will requirements). Under current law, the Federal Reserve has the discretion to determine the applicability of these standards to bank holding companies with assets between $100 billion and $250 billion. The bill also expands stress testing by increasing the number of board-run stress test scenarios from two to three; decreasing the asset threshold at which company-run stress tests are required from $250 billion to $10 billion; and requiring company-run stress tests to be performed annually or semiannually, depending on the amount of assets held. The bill also decreases from $50 billion to $10 billion the asset threshold for mandatory risk committees. Finally, the bill revises the supplemental leverage ratio applied to custodial banks and the asset treatment of certain municipal obligations.

M.H. Dutch Salmon Greater Gila Wild and Scenic River Act This bill designates specified segments of rivers and creeks of the Gila River system in New Mexico as components of the National Wild and Scenic Rivers System and transfers 440 acres of land from the Gila National Forest to the Gila Cliff Dwellings Monument. The Department of the Interior or the Department of Agriculture must consult with tribal governments, applicable political subdivisions of states, and the public when preparing the comprehensive management plan for such segments pursuant to the Wild and Scenic Rivers Act. Any nonfederal land within or adjacent to such a segment that is acquired by the United States shall be incorporated in, and be administered as part of, the applicable segment. No land or interest in land shall be acquired without the owner's consent. The Department of the Interior or the Department of Agriculture may authorize the construction of a native fish habitat restoration project (including any necessary fish barriers) within a covered segment if the project would enhance the recovery of a threatened or endangered species, a sensitive species, or a species of greatest conservation need, including the Gila Trout; and would not unreasonably diminish the free-flowing nature or outstandingly remarkable values of the covered segment. A native fish habitat restoration project located within an area designated as a component of the National Wilderness Preservation System shall be constructed consistent with the Wilderness Act and the applicable wilderness management plan.

Chiropractic Medicare Coverage Modernization Act of 2023 This bill expands Medicare coverage of chiropractic services to include all services provided by chiropractors, rather than only subluxation corrections through manual manipulation of the spine.

United States Foreign Service Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue not more than 50,000 $5 gold coins, 400,000 $1 silver coins, and 750,000 half-dollar clad coins in recognition of the 100th anniversary of the United States Foreign Service. All surcharges received by Treasury from the sale of such coins must be paid to the Association for Diplomatic Studies and Training to support the collection, curation, and sharing of diplomatic history in the United States via oral history, books, social media, and other means.

Prevent Interruptions in Physical Therapy Act of 2023 This bill allows a physical therapist to receive payment under Medicare for services provided to the physical therapist's patients by another physical therapist through a qualifying temporary arrangement, regardless of the geographic area or population served. Currently, physical therapists may only receive payment with respect to such arrangements for services provided in medically underserved, rural, or health professional shortage areas.
