Reproductive Rights are Human Rights Act of 2019 This bill directs the Department of State to include in its annual reports on human rights in countries receiving U.S. development and security assistance a discussion of the status of reproductive rights in each country, including whether a country has adopted and enforced policies to (1) promote access to contraception and accurate family planning information, (2) provide services to ensure safe and healthy pregnancy and childbirth, (3) expand or restrict access to safe abortion services, (4) prevent maternal deaths, and (5) prevent and treat sexually transmitted diseases. For each country, the reports shall also contain (1) data related to maternal deaths, and (2) a description of the nature and extent of discrimination and violence against women and girls in health care settings and the relevant government's response to such actions.

American Family Act of 2019 This bill modifies the child tax credit to (1) make the credit fully refundable, (2) increase the amount of the credit and allow an additional credit for children who are under six years of age, (3) require the amount of the credit to be adjusted annually for inflation, and (4) require the Department of the Treasury to establish a program for making advance payments of the credit on a monthly basis.

Chronic Wasting Disease Management Act This bill requires the Department of Agriculture (USDA) to support state and tribal efforts to address chronic wasting disease. The transmissible disease afflicts deer, elk, and moose populations. In addition, USDA must make grants to research centers to support efforts to expand and accelerate applied research on the disease. Land management agencies of the USDA and the Department of the Interior must work cooperatively with states in researching the disease and implementing state management strategies to reduce the spread and prevalence of the disease.

Middle Class Health Benefits Tax Repeal Act of 201 9 This bill repeals the excise tax on employer-sponsored health care coverage for which there is an excess benefit (high-cost plans). The repeal applies to taxable years beginning after December 31, 2019.

Save the Internet Act of 2019 This bill updates the regulatory framework for broadband access. Specifically, the bill repeals a 2017 order adopted by the Federal Communications Commission (FCC) that classifies broadband internet access service as an information service, therefore placing it under Federal Trade Commission authority. The order also expands the public transparency rules and preempts local and state laws that conflict with the regulatory framework. The bill restores a 2015 FCC order, which classifies both mobile and fixed broadband internet access services as telecommunications services, therefore placing the services under FCC authority. Additionally, the bill would create a general conduct standard and restore regulations, including those that prohibit blocking, throttling, and paid prioritization.

Prompt and Fast Action to Stop Damages Act of 2019 This bill authorizes military departments to provide water for agricultural purposes in areas in which activities on a military installation have contaminated a water source with perfluoroalkyl or polyfluoroalkyl substances, such as perfluorooctanoic acid (PFOA) or perfluorooctane sulfonate (PFOS). The military departments may provide uncontaminated water or provide treatment for contaminated water. The agricultural products produced must be destined for human consumption. The Department of the Air Force may acquire certain real property adjacent to an Air Force base that has shown signs of contamination from PFOA and PFOS due to activities on the base. The Department of Defense must submit to Congress a remediation plan for water at or adjacent to a military base that is contaminated with PFOA or PFOS.

Removing Barriers to Colorectal Cancer Screening Act of 2019 This bill waives Medicare coinsurance requirements with respect to colorectal cancer screening tests, regardless of the code billed for a resulting diagnosis or procedure.

Stop Underrides Act This bill requires the installation of rear, side, and front underride guards on certain trucks and trailers. Specifically, the Department of Transportation must require the installation of rear, side, and front underride guards on the following: a trailer or semi-trailer that is more than 10,000 pounds, and a single unit truck for which the bottom of the carriage is greater than 22 inches above the ground and that is more than 10,000 pounds. For rear and side underride guards, DOT must require adherence to a performance standard that requires the guards to be able to prevent intrusion from the body or frame of a trailer, semi-trailer, or truck into the passenger compartment of the motor vehicle that contacts the guard while traveling at 35 miles per hour. In addition, DOT must require drivers to (1) conduct a pre-trip inspection of the underride protection system on their vehicles; (2) identify rusted metal compromising structural integrity, cracked welds, or missing or loose fasteners; and (3) complete any necessary repairs. DOT must establish a Committee on Underride Protection to oversee the ongoing underride guard rulemaking process. DOT must publish data on victims of truck underride crashes.

Stopping Abuse and Fraud in Electronic Lending Act of 2019 or the SAFE Lending Act of 2019 This bill revises requirements related to consumer financial protection and small-dollar lending, including matters concerning remotely created checks, electronic fund transfers, registration of small-dollar lenders, overdraft fees, and the collection of personal information. Under the bill, remotely created checks may only be issued by a person specifically designated in writing by a consumer and provided to the consumer's depository institution. (A remotely created check is a check not issued by the bank and not signed by the account owner.) A voluntary agreement to repay a small-dollar consumer credit transaction by an electronic fund transfer is subject to certain protections, including the right of the consumer to stop payment. Small-dollar consumer credit providers must register with the Consumer Financial Protection Bureau. Any small-dollar consumer credit transaction is subject to the laws of the state in which the consumer resides. The bill also prohibits overdraft fees on prepaid accounts.

PFAS Action Act of 2019 This bill requires the Environmental Protection Agency to designate all perfluoroalkyl and polyfluoroalkyl substances as hazardous substances within one year of enactment of this bill.

Washington, D.C. Admission Act This bill provides for admission into the United States of the state of Washington, Douglass Commonwealth, composed of most of the territory of the District of Columbia. The commonwealth shall be admitted to the Union on an equal footing with the other states. The Mayor of the District of Columbia shall issue a proclamation for the first elections to Congress of two Senators and one Representative of the commonwealth. The bill applies current District laws to the commonwealth and continues pending judicial proceedings. The commonwealth (1) shall consist of all District territory, with specified exclusions for federal buildings and monuments, including the principal federal monuments, the White House, the Capitol Building, the U.S. Supreme Court Building, and the federal executive, legislative, and judicial office buildings located adjacent to the Mall and the Capitol Building; and (2) may not impose taxes on federal property except as Congress permits. The bill maintains (1) the District as the seat of the federal government, and (2) the federal government's authority over military lands and specified other property. The bill provides for expedited consideration of a joint resolution repealing the 23rd Amendment to the Constitution, which provides for the appointment of electors of the President and Vice President.

Military Widow's Tax Elimination Act of 2019 This bill modifies the Department of Defense's Survivor Benefit Plan and how it operates in relation to other benefits. The plan currently provides a monthly annuity (based on a percentage of a service member's retirement pay) to an eligible beneficiary upon the death of the service member. Currently, if a surviving spouse is also entitled to dependency and indemnity compensation, the annuity paid under the plan will be reduced. The bill repeals certain provisions that require the offset of the plan annuity from amounts paid in dependency and indemnity compensation. Under current law, upon the request of the surviving spouse, the military branch concerned is authorized to pay an annuity to the service member's dependent children instead of to the surviving spouse. The bill restores the annuity to an eligible spouse who previously elected to transfer payment to a dependent child.

Forced Arbitration Injustice Repeal Act This bill prohibits a predispute arbitration agreement from being valid or enforceable if it requires arbitration of an employment, consumer, antitrust, or civil rights dispute.

Child Care Workforce and Facilities Act of 2019 This bill requires the Department of Health and Human Services to provide states and tribal entities with grants to increase access to licensed child care services. The grants may be used to develop and expand the child care workforce or child care facilities in locations with insufficient available child care. Specifically, grants cover 50% of the cost of programs to support the education and training of caregivers or projects to build, expand, or renovate child care facilities in these areas.

Treat and Reduce Obesity Act of 2019 This bill expands Medicare coverage of intensive behavioral therapy for obesity. Specifically, the bill allows coverage for therapy that is provided by (1) a physician who is not a primary care physician; or (2) other health care providers (e.g., physician assistants and nurse practitioners) and approved counseling programs, if provided upon a referral from, and in coordination with, a physician or primary care practitioner. Currently, such therapy is covered only if provided by a primary care practitioner. The bill also allows coverage under Medicare's prescription drug benefit of drugs used for the treatment of obesity or for weight loss management for individuals who are overweight.

ALS Disability Insurance Access Act of 2019 This bill eliminates the five-month waiting period for disability benefits under the Old Age, Survivors, and Disability Insurance program for individuals with amyotrophic lateral sclerosis (a progressive neurodegenerative disease, also known as Lou Gehrig's disease, that affects nerve cells in the brain and spinal cord). Under current law, individuals must wait five months after becoming disabled before their disability insurance benefit payments may begin.

Hidden Figures Congressional Gold Medal Act This bill requires the Speaker of the House of Representatives and President pro tempore of the Senate to arrange for the presentation of one Congressional Gold Medal to Katherine Johnson, in recognition of her service to the United States as a mathematician; one Congressional Gold Medal to Dr. Christine Darden, for her service to the United States as an aeronautical engineer; two Congressional Gold Medals in commemoration of the lives of Dorothy Vaughan and Mary Jackson, in recognition of their service to the United States during the Space Race; and one gold medal in recognition of all the women who served as computers, mathematicians, and engineers at the National Advisory Committee for Aeronautics and the National Aeronautics and Space Administration (NASA) between the 1930s and the 1970s.

Child Care for Working Families Act This bill provides funds and otherwise revises certain child care and early learning programs for low- to moderate-income families. Specifically, the bill provides funds for the Child Care and Development Block Grant program and reestablishes it as a child care and development assistance program. It also allocates program funds for states to provide services and supports to infants, toddlers, and children with disabilities. Further, it revises the program to require each state to, among other things create a tiered and transparent system for measuring the quality of child care providers, which must include evidence-based standards and payment rates that are based on a certain cost estimation model; assure that copayments are based on a sliding scale and that no family receiving assistance pays more than 7% of their household income on child care; and use quality child care amounts for certain activities, such as improving the supply of child care providers who provide care to infants, toddlers, and children with disabilities (e.g., professional development). It also provides funds and establishes grants for states to create preschool programs for low- to moderate-income children between the ages of three and five years. Finally, the Department of Health and Human Services must make grants to Head Start agencies to (1) provide children with access to full-school-year and full-school-day services, (2) provide access to additional service hours for migrant and seasonal agencies, or (3) enhance the quality of existing services.

Voting Rights Advancement Act of 2019 This bill establishes new criteria for determining which states and political subdivisions must obtain preclearance before changes to voting practices may take effect. (Preclearance is the process of receiving federal preapproval before making legal changes that would affect voting rights.) In addition, the bill expands voting access on tribal lands.

Ensuring Lasting Smiles Act This bill requires private health insurance plans to cover diagnosis and treatment services for congenital anomalies and birth defects, such as reconstructive services and prosthetics. Coverage must include services that functionally improve, repair, or restore any body part that is medically necessary for normal bodily functions or appearance, as determined by the treating physician.

Interstate Transport Act of 2019 This bill authorizes a person to transport a knife between two states where it is legal to possess, carry, or transport such knife. It sets forth conditions and limitations with respect to the lawful interstate transport of knives, including secure storage requirements.

Never Forget the Heroes: Permanent Authorization of the September 11th Victim Compensation Fund Act This bill funds through FY2090 the September 11th Victim Compensation Fund of 2001. Additionally, the bill modifies the Victim Compensation Fund (VCF): to allow claims to be filed until October 2089, to require VCF policies and procedures to be reassessed at least once every five years (currently, at least once annually), to require claimants to be paid for the amount by which a claim was reduced on the basis of insufficient funding, to remove the cap on noneconomic damages in certain circumstances, and to adjust the annual limit on economic loss compensation for inflation.

Restore Our Parks Act This bill (1) establishes the National Park Service Legacy Restoration Fund, and (2) requires 50% of all energy development revenues for FY2019-FY2023 to be deposited into such fund. Amounts deposited in the fund must not exceed $1.3 billion for any fiscal year and must be used for meeting the priority deferred maintenance needs of the National Park Service.

Buffalo Tract Protection Act This bill withdraws specified Bureau of Land Management (BLM) lands in Placitas, New Mexico, from all forms of mineral development under all laws pertaining to mineral leasing or mineral materials, including locatable minerals. Any disposal of the surface estate of the BLM lands shall be subject to the condition that the mineral estate of those lands shall remain under the ownership of the BLM, subject to the withdrawal under this bill.

Lymphedema Treatment Act This bill includes certain lymphedema compression treatment items as covered durable medical equipment under Medicare. (Lymphedema is a condition of localized fluid retention and tissue swelling that is caused when the lymphatic system is damaged or blocked.)

America's Public Land Act of 2019 This bill reaffirms that it is U.S. policy to retain public land in federal ownership unless its disposal has been authorized by an Act of Congress; to retain management authority over public land, except where a nonfederal individual or entity is authorized to exercise management authority pursuant to an Act of Congress or another applicable law; and that retention of public land and the management authority over it is in the public interest. Neither the Department of the Interior nor of Agriculture shall approve or permit the conveyance of public land or the granting of management authority over such land to nonfederal individuals or entities except as authorized by an Act of Congress.

State Public Option Act This bill allows residents who are not already eligible for Medicaid and not concurrently enrolled in other health insurance coverage to buy into a state Medicaid plan beginning January 1, 2020, at the option of the state. State Medicaid programs may set premiums and cost-sharing requirements for such coverage in accordance with specified limitations. The bill also (1) provides the enhanced Federal Medical Assistance Percentage (FMAP) to every state that expands Medicaid coverage for individuals who are newly eligible under the Patient Protection and Affordable Care Act, regardless of when such expansion takes place; and (2) requires state Medicaid programs to cover comprehensive reproductive health care services, including abortion services.

Preventing Animal Cruelty and Torture Act or the PACT Act This bill revises and expands criminal provisions with respect to animal crushing. It retains existing criminal offenses that prohibit knowingly creating or distributing an animal crush video using interstate commerce. The bill also adds a new provision to criminalize an intentional act of animal crushing. A violator is subject to criminal penalties—a fine, a prison term of up to seven years, or both. It provides additional exceptions for conduct, or a video of conduct, including conduct that is (1) medical or scientific research, (2) necessary to protect the life or property of a person, (3) performed as part of euthanizing an animal, or (4) unintentional.

Medicare at 50 Act This bill establishes a Medicare buy-in option for certain qualifying individuals and also repeals restrictions relating to prescription drug prices under the Medicare prescription drug benefit. Specifically, the bill allows individuals aged 50 to 64 to enroll in Medicare if such individuals would otherwise qualify for Medicare at the age of 65. The Centers for Medicare & Medicaid Services (CMS) must determine enrollment periods and set premiums for the buy-in option established under the bill, in accordance with specified requirements. The CMS must also award grants to states and nonprofit organizations for outreach and enrollment activities relating to the buy-in option. The bill also repeals provisions that prohibit the CMS from negotiating the prices of prescription drugs or from establishing a formulary under the Medicare prescription drug benefit.

Native American Suicide Prevention Act of 2019 This bill requires a state or state-designated entity that receives support from the Substance Abuse and Mental Health Services Administration for development and implementation of a statewide youth suicide early intervention and prevention strategy to agree to collaborate with each of the state's federally recognized Indian tribes, tribal organizations, urban Indian organizations, and Native Hawaiian health care systems regarding the strategy.

Family and Medical Insurance Leave Act or the FAMILY Act This bill establishes the Office of Paid Family and Medical Leave within the Social Security Administration. The bill entitles every individual to a family and medical leave insurance (FMLI) benefit payment for a specified benefit period and prescribes a formula for determining the individual's monthly benefit amount. An FMLI benefit payment shall be coordinated with any periodic benefits received under a state or local temporary disability insurance or family leave program. The bill amends the Internal Revenue Code to impose a tax on employers, employees, and self-employed individuals to fund FMLI benefits. It also establishes the Federal Family and Medical Leave Insurance Trust Fund to hold tax revenues.

Home Health Payment Innovation Act of 2019 This bill makes a series of changes relating to payment and coverage of home health services under Medicare and Medicare Advantage (MA). Specifically, the bill allows the home-confinement requirement (also known as the homebound requirement) for home health services to be waived under Medicare and MA. Currently, as a condition of eligibility for such services, a physician must certify that an individual has difficulty leaving home without assistance (e.g., a wheelchair, special transportation, or help from another person) due to an illness or injury. The bill also alters the payment methodology under the Medicare prospective payment system for home health services, including by eliminating the requirement that such methodology include certain behavioral assumptions regarding the implementation of specified changes to units of payment and case-mix adjustment factors.

Remote, Emergency, Medical, Online Training, Telehealth, and EMT Act or the REMOTE Act This bill directs U.S. Customs and Border Protection (CBP) to make emergency medical technician (EMT) and paramedic training available to selected border patrol agents along the southern border. Agents that complete the training or already have EMT or paramedic certifications shall receive specified pay increases. The bill imposes requirements related to (1) the percentage of agents with EMT or paramedic training assigned in each sector, and (2) minimum levels of various medical supplies in each sector. CBP shall require all border patrol agents and officers to complete online training on how to (1) identify common signs of medical distress in children, and (2) timely transfer sick children to medical care. CBP shall ensure that all remote stations, forward operating bases, and remote ports of entry on the southern border have (1) voice access to a medical command physician, and (2) access to language interpretation services.

Remote Areas Border Security Enhancements Act This bill prohibits the Department of Homeland Security (DHS) from beginning construction on any infrastructure project along the U.S.-Mexico border until (1) the Government Accountability Office evaluates the need and costs for using certain enhanced technology and other resources in rural and remote areas along the border; and (2) U.S. Customs and Border Protection acquires or increases the use of such enhanced technologies and resources, including advanced detection surveillance technology, night vision technology, and off-road vehicles. DHS shall establish the Agent Mobility Program as a five-year pilot program, which shall provide certain benefits to agents who serve at least three years in a hard-to-fill station in the El Paso Sector.

Global Health, Empowerment and Rights Act This bill establishes that a foreign nongovernmental organization shall not be disqualified from receiving certain U.S. international development assistance solely because the organization provides medical services using non-U.S. government funds if the medical services are legal in both the United States and the country in which they are being provided. Such foreign organizations shall not be subject to requirements relating to their use of non-U.S. funds for advocacy or lobbying activities, other than those that apply to U.S. nongovernmental organizations. Current U.S. policy prohibits various foreign assistance from going to a foreign nongovernmental organization unless it agrees to not perform or actively promote abortions.

America's Natural Treasures of Immeasurable Quality Unite, Inspire, and Together Improve the Economies of States Act or the ANTIQUITIES Act This bill provides for the administration of certain National Monuments and the designation of certain lands in New Mexico and Nevada as wilderness. This bill directs the National Park Service, Bureau of Land Management (BLM), U.S. Fish and Wildlife Service, Forest Service, and National Oceanic and Atmospheric Administration to administer each specified national monument in accordance with (1) the one or more presidential proclamations that apply to the monument, (2) any Act of Congress enacted before December 4, 2017, that provides for an adjustment to the boundary or administration of such monument, and (3) this bill. The bill establishes the National Monument Enhancement Fund to furnish funding (1) to such federal agencies to develop management plans for their national monuments that were designated under current federal law, (2) for federal acquisition and development of certain land and other areas, and (3) to develop and enhance recreational infrastructure on such designated lands. The bill designates specified BLM lands within the Organ Mountains-Desert Peaks and Rio Grande del Norte National Monuments in New Mexico and in the Gold Butte National Conservation Area in Nevada as wilderness and as components of the National Wilderness Preservation System. The Department of the Interior shall manage approximately 100 acres of BLM land in New Mexico identified as Lookout Peak Communication Site in a manner that preserves the character of the land for future inclusion in the National Wilderness Preservation System.

This resolution calls for the creation of a Green New Deal with the goals of achieving net-zero greenhouse gas emissions; establishing millions of high-wage jobs and ensuring economic security for all; investing in infrastructure and industry; securing clean air and water, climate and community resiliency, healthy food, access to nature, and a sustainable environment for all; and promoting justice and equality. The resolution calls for accomplishment of these goals through a 10-year national mobilization effort. The resolution also enumerates the goals and projects of the mobilization effort, including building smart power grids (i.e., power grids that enable customers to reduce their power use during peak demand periods); upgrading all existing buildings and constructing new buildings to achieve maximum energy and water efficiency; removing pollution and greenhouse gas emissions from the transportation and agricultural sectors; cleaning up existing hazardous waste and abandoned sites; ensuring businesspersons are free from unfair competition; and providing higher education, high-quality health care, and affordable, safe, and adequate housing to all.

Craft Beverage Modernization and Tax Reform Act of 2019 This bill modifies the tax treatment of certain alcoholic beverages to exclude the aging period from the production period for beer, wine, or distilled spirits for purposes of determining whether a taxpayer can expense, rather than capitalize, interest costs paid or incurred during the production period; reduce excise tax rates on beer and distilled spirits; permit the transfer of beer between bonded facilities without payment of tax; increase the amount of the small wine producer tax credit and expand the categories of producers covered by such credit; allow an adjustment to the producer credit for hard cider; and modify the alcohol content limitations that apply to certain wines for tax purposes. The Department of the Treasury must amend applicable regulations with respect to the use of wholesome products suitable for human consumption in the production of fermented beverages. The bill also increases funding for the Alcohol and Tobacco Tax and Trade Bureau.

Restrictions Against Illegitimate Declarations for Emergency Re-appropriations Act of 2019 or the RAIDER Act of 2019 This bill prohibits funds that were appropriated or otherwise made available before the enactment of this bill from being used for the construction of barriers, land acquisition, or associated activities on the southern border without a specific statutory authorization from Congress.

Native American Business Incubators Program Act This bill requires the Department of the Interior to establish a grant program in the Office of Indian Energy and Economic Development for establishing and operating business incubators that serve Native American communities. A business incubator is an organization that (1) provides physical workspace and facilities resources to startups and established businesses, and (2) is designed to accelerate the growth and success of businesses through a variety of business support resources and services. Grant applicants may be institutions of higher education, private nonprofits, Native American tribes, or tribal nonprofits. Interior must facilitate the establishment of relationships between grant recipients and educational institutions serving Native American communities.

This bill permanently authorizes the Land and Water Conservation Fund. The greater of 1.5% of the annual authorized funding amount or $10 million shall be used for projects that secure recreational public access to existing federal public land for hunting, fishing, and other recreational purposes.
