Securing Energy Infrastructure Act This bill establishes a two-year pilot program within the Department of Energy's (DOE) national laboratories to identify the security vulnerabilities of certain entities in the energy sector, and research and test technology that can be used to isolate the most critical systems of such entities from cyber-attacks. In addition, DOE must establish a working group to evaluate the technology solutions proposed by the national laboratories and to develop a national cyber strategy to isolate the energy grid from attacks. DOE must also submit a report to Congress describing the results of the pilot program, assessing the feasibility of the techniques considered, and outlining the results of the working group's evaluation.

Middle Class Health Benefits Tax Repeal Act of 2017 This bill amends the Internal Revenue Code to repeal, beginning with taxable years beginning after December 31, 2017, the excise tax on employer-sponsored health care coverage for which there is an excess benefit (high-cost plans).

This bill establishes the Commission to End Russian Interference in United States Elections as an independent commission to examine Russian cyber operations and attempts to interfere in the 2016 U.S. national election. The commission must examine attempts by the Russian government, governments or other entities associated with or collaborating with Russia, or persons or entities in Russia to: access, alter, or tamper with voting systems, voter roll information, the Donald J. Trump and the Hillary Clinton presidential campaign organizations, and the Democratic and the Republican national committees, congressional campaign committees, and governors associations; promote propaganda relevant to any election for public office held in the United States during 2016; and use electronic means to influence, interfere with, or sow distrust in such elections. The commission must: (1) report on evidence developed by federal agencies; (2) build upon investigations of executive branch, congressional, or independent entities; and (3) make a full accounting of interference attempts and the U.S. response, and government preparedness, to defend against such interference. The commission may receive classified information and issue subpoenas. The commission must report to the President and Congress with conclusions and recommendations on preventing a reoccurrence of such interference.

Declares that in the absence of such actions or specific authorization by Congress, Congress regards dealings that Donald Trump, as President, may have through his companies with foreign governments or entities owned or controlled by foreign governments to be potential violations of such clause.

Strengthening American Transportation Security Act of 2016 This bill expresses the sense of Congress that the personnel system used by the Transportation Security Administration (TSA) provides insufficient workplace protections for its workforce and such personnel should be entitled to protections under the civil service system applicable to all federal employees. The bill repeals personnel authorities of the Department of Homeland Security (DHS) and the Department of Transportation governing the conditions of employment for TSA employees, thus making TSA employees subject to the personnel management system applicable to all other federal employees. Within 60 days after the enactment of this bill or an earlier date set by DHS: (1) all TSA personnel management policies, directives, letters, and guidelines and any DHS human resources management system shall cease to be effective with respect to TSA employees; and (2) TSA employees shall become subject to labor provisions applicable to other federal transportation employees. The bill sets forth transition rules that protect the pay rates and other rights of TSA employees. DHS shall consult with the labor organization certified by the Federal Labor Relations Authority to carry out the conversion of TSA employees and positions to the civil service system. The provisions of this bill do not affect the prohibitions against disloyalty and asserting the right to strike against the federal government.

Two-Generation Economic Empowerment Act of 2016 This bill establishes the interagency Council on Multigenerational Poverty to carry out specified objectives and the 2-generation approach, including by providing guidance, and addressing questions pertaining to 2-generation programs and other programs engaging in efforts to break the cycle of multigenerational poverty. The council shall develop, make available for public comment, and submit to the President and Congress, a strategic plan to end and prevent multigenerational poverty that includes activities under the 2-generation approach and other activities consistent with specified objectives. The council shall ensure that specified information is made available to the public and displayed on the official website of the council, including the national strategic plan to end and prevent multigenerational poverty and certain information on the 2-generation program. The Government Accountability Office must study, and report to Congress and the council, on federal block grants under the jurisdiction of council participants to identify barriers and opportunities for collaboration in order to carry out the 2-generation approach. The council shall establish: (1) the 2-generation performance partnership pilot program, and (2) the 2-generation social impact bonds pilot program. The Office of Management and Budget shall designate lead agencies for purposes of carrying out the 2-generation programs.

This bill amends the Internal Revenue Code to treat the charging of an electric vehicle provided on or near the business premises of the employer as a qualified transportation fringe benefit that is excluded from an employee's gross income. The bill limits the benefit to $175 per month (adjusted for inflation) and specifies requirements for the electric vehicles.

Bureau of Land Management Foundation Act This bill establishes the Bureau of Land Management Foundation as a charitable, nonprofit organization to encourage, accept, obtain, administer, and use private gifts of money, devises, and bequests of real and personal property for the benefit of, or in connection with, the activities and services of the Bureau of Land Management (BLM). The foundation shall conduct and encourage programs and activities that support: educational, technical, scientific, and other assistance or activities to support the management of BLM lands with regard to wild free-roaming horses and burros, fish and wildlife and their habitats, National Conservation Lands, and recreation, cultural, and historic resources; and activities that support the reclamation and remediation of specified abandoned mine lands, specified orphaned oil and gas well sites, or public lands impacted by development connected to mineral exploration and development activities. Reclamation activities are to include the remediation of soil and water contamination; the restoration of wildlife habitat in order to restore the natural, scenic, historic, cultural, and ecological values of those areas; or promotion of the areas' economic potential.

No Vote No Recess Resolution Prohibits the Senate, between September 27, 2016, and the end of the 114th Congress, from adjourning, remaining adjourned, or recessing for more than two days and convening solely in a pro forma session unless, by the beginning of the adjournment or the pro forma session, it has taken action on any presidential nomination for a position as a justice of the U.S. Supreme Court by: holding a hearing and a vote on the nomination in the Senate Committee on the Judiciary, and holding a confirmation vote on it in the full Senate. Prescribes procedures for Senate adjournments and recesses during such period. Prohibits the Presiding Officer from entertaining a request to suspend the operation of this resolution by unanimous consent or motion. States that nothing in this resolution shall be construed in a manner that is inconsistent with S. Res. 296 (108th Congress) or any other Senate emergency procedures or practices.

Department of Veterans Affairs Appeals Modernization Act of 2016 This bill amends the Department of Veterans Affairs (VA) benefits appeals process to permit a claimant to request: a review of the agency of original jurisdiction's decision by a higher-level adjudicator within the agency based on the original evidence; or a Board of Veterans Appeals (BVA) review under which no BVA hearing is requested and no additional evidence may be submitted or under which a BVA hearing is requested and the appellant requests an opportunity to submit additional evidence at, and within 90 days of, the hearing (for which the BVA shall maintain two separate dockets). (The term "agency of original jurisdiction" means the activity which entered the original determination with regard to a claim for veterans benefits.) The bill prescribes additional information that must be included in the notice of a denied benefit. A finding favorable to a claimant is binding on all subsequent VA adjudicators unless clear and convincing evidence is shown to the contrary. If a claim is denied the claimant may, within one year after the agency of original jurisdiction issues a decision with respect to such claim: (1) file a request for higher-level review, (2) file a supplemental claim, or (3) file a notice of disagreement. The BVA may remand a claim to the agency to obtain a corrective advisory medical opinion. The VA shall provide for expedited treatment by the agency of original jurisdiction of any claim that is remanded by the BVA. The bill revises effective dates of awards provisions. The bill repeals a provision authorizing the BVA to secure an independent medical expert's opinion when warranted by the medical complexity or controversy involved in an appeal case. The VA's duty to assist a claimant shall not apply: (1) once the claimant is provided notice of the agency's initial decision, and (2) to higher-level agency or BVA review. The VA is not required to send notice for a supplemental claim or to readjudicate a claim that has been disallowed except when new and relevant evidence is presented or secured (currently such provision applies to reopening such claim). A claimants's notice of disagreement must set out specific allegations of error of fact or law. The BVA is authorized to dismiss an appeal that fails to do so.

Advancing Conservation and Education Act of 2016 This bill allows the states of Alaska, Arizona, California, Colorado, Idaho, Montana, New Mexico, North Dakota, Oregon, South Dakota, Utah, Washington, or Wyoming (western states) to relinquish state land grant parcels wholly or primarily within eligible areas and select, in exchange, public land within the state. The bill defines "eligible areas" as lands within the outer boundaries of units or components of the National Park, National Wilderness Preservation, National Wildlife Refuge, or National Landscape Conservation Systems, areas identified by the Bureau of Land Management (BLM) of the Department of the Interior as having wilderness characteristics, certain designated lands within the National Forest System or administered by the BLM, and sentinel landscapes designated by the Department of Agriculture, Department of Defense, or Interior. Interior shall create a process for the relinquishment of such parcels. A western state may select, and Interior may convey, lands that are mineral in character. The overall value of the state land grant parcels and the public land to be conveyed shall be equal. The bill sets forth requirements regarding hazardous materials on land conveyed, water rights, and grazing permits.

Protection of the Right of Tribes to stop the Export of Cultural and Traditional Patrimony Resolution or the PROTECT Patrimony Resolution Condemns the theft, illegal possession or sale, transfer, and export of tribal cultural items. Calls upon: (1) the Departments of the Interior, State, Commerce, Homeland Security, and Justice to consult with Native Americans in addressing this issue, to take affirmative action to stop these practices, and to secure repatriation of tribal cultural items; and (2) the Government Accountability Office to determine the scope of illegal trafficking in tribal cultural items and identify steps required to end such trafficking. Expresses support for restrictions on the export of tribal cultural items.

Condemns the attack on police officers that occurred in Dallas, Texas, on July 7, 2016. Expresses the belief that an attack upon a police officer is an affront to the rule of law and the promise of justice, domestic tranquility, common defense, and general welfare and the blessings of liberty secured by the Constitution. Offers condolences to the families, friends, and loved ones of those who were killed and expresses hope for the quick and complete recovery of those who were wounded. Applauds the bravery and dedication of the law enforcement officials, emergency medical responders, and others who offered their support and assistance. Declares that the Senate stands united against violence and hatred and in support of the police officers who work to keep the country safe.

This bill directs the Speaker of the House of Representatives and the President pro tempore of the Senate to arrange for the collective award of a Congressional Gold Medal to the troops from the United States and the Philippines who defended Bataan, Philippines, and were subsequently prisoners of war in recognition of their personal sacrifice and service during World War II. The medal shall be displayed at the Smithsonian Institution, which is urged to make the medal available for display at other locations associated with such troops.

Buffalo Tract Protection Act This bill withdraws specified Bureau of the Land Management (BLM) lands in Placitas, New Mexico, from all forms of mineral development under all laws pertaining to mineral leasing or mineral materials, including locatable minerals. Nothing in this bill prohibits the disposal of the surface estate of such BLM lands under the Federal Land Policy and Management Act of 1976 or the Recreation and Public Purposes Act. Any disposal of the surface estate of the BLM lands shall be subject to the condition that the mineral estate of those lands shall remain under the ownership of the BLM, subject to the withdrawal under this bill.

Biodiesel Tax Incentive Reform and Extension Act of 2016 This bill amends the Internal Revenue Code to modify and extend: (1) the income tax credit for biodiesel and renewable diesel used as fuel, and (2) the excise tax credit for biodiesel fuel mixtures. The bill: (1) makes the credits available to domestic producers of the fuels rather than the policy under current law of providing a mixture credit to the blender of the fuel, (2) increases the income tax credit for certain small biodiesel producers, and (3) extends the credits through 2019.

Storage Technology for Operational Readiness and Generating Energy Act or the S.T.O.R.A.G.E. Act This bill amends the Public Utility Regulatory Policies Act of 1978 to add energy storage systems to the list of strategies states should consider when developing energy plans and using its utility ratemaking authority. States are encouraged to analyze whether energy storage systems benefit their efforts to promote energy conservation and the greater use of domestic energy. To further encourage the development of programs relating to energy storage, the Department of Energy (DOE) must streamline and coordinate efforts among various existing programs conducting energy storage research at DOE to maximize efficiency of its funds and expand vital research.

Energy Storage Tax Incentive and Deployment Act of 2016 This bill amends the Internal Revenue Code to allow tax credits for: (1) energy storage technologies, and (2) battery storage technology. The bill expands the tax credit for investments in energy property to include equipment that: (1) receives, stores, and delivers energy using batteries, compressed air, pumped hydropower, hydrogen storage (including hydrolysis), thermal energy storage, regenerative fuel cells, flywheels, capacitors, superconducting magnets, or other technologies identified by the Internal Revenue Service; and (2) has a capacity of at least five kilowatt hours. The bill also expands the tax credit for residential energy efficient property to include expenditures for battery storage technology that: (1) is installed on or in connection with a dwelling unit located in the United States and used as a residence by the taxpayer, and (2) has a capacity of at least three kilowatt hours.

Safeguard Tribal Objects of Patrimony Act of 2016 This bill increases the maximum term of imprisonment from 5 years to 10 years for individuals convicted more than once of illegal trafficking in Native American human remains or cultural items. This bill bans the export of illegally obtained Native American cultural objects and sets penalties for violations of this ban. A person is immune from criminal prosecution under laws regarding Native American cultural objects if the person voluntarily repatriates to the appropriate tribe all the Native American cultural objects in the person's possession not later than two years after enactment of this bill. This immunity does not apply to a person under active investigation or prosecution relating to Native American cultural objects. The Government Accountability Office (GAO) must report on the number of Native American cultural objects illegally trafficked and the extent to which the Department of Justice has prosecuted cases of trafficking. The GAO must recommend actions to eliminate such trafficking and to secure the repatriation of Native American cultural objects. The Department of the Interior must facilitate the convention of a working group to contribute information to the GAO report and to advise on implementation of the GAO's recommendations.

Dialysis PATIENT Demonstration Act of 2016 or the Patient Access to Integrated-care, Empowerment, Nephrologists and Treatment Demonstration Act of 2016 This bill amends title XVIII (Medicare) of the Social Security Act to establish a demonstration program for the provision of integrated care to Medicare beneficiaries with end-stage renal disease (ESRD). Under the voluntary program, eligible participating providers may form organizations to offer ESRD integrated care models and serve as medical homes for program-eligible beneficiaries. Such a model: (1) shall cover medical and hospital services, other than hospice care, under Medicare; (2) must include benefits for transition into palliative care; and (3) may cover prescription drug benefits. An organization must offer at least one open network model but may also offer one or more preferred network models. An organization shall return savings achieved under the models to program-eligible beneficiaries. A beneficiary shall have the opportunity to: (1) opt out of the program, (2) make an assignment change into an open network model offered by a different organization, or (3) elect a preferred network model. The bill establishes requirements regarding: (1) benefits for program-eligible beneficiaries who are also eligible for Medicaid benefits, (2) program quality and reporting, (2) ESRD integrated care strategy, (3) program operation and scope, (4) beneficiary notification, and (5) payment.

Coal Cleanup Taxpayer Protection Act This bill amends the Surface Mining Control and Reclamation Act to prohibit the Office of Surface Mining and Reclamation Enforcement (OSMRE) and state regulatory authorities from accepting new self-bonds for coal reclamation. In addition, any existing self-bonds or corporate bonds utilized for coal reclamation are required to be converted to surety or collateral bonds. The OSMRE may approve state or federal alternative coal mining bond programs that result in no greater risk of financial liability to the federal government than a surety or collateral bond program. The bill also requires the Department of Interior to issue rules establishing limitations on surety bonds to minimize the financial liability to the federal or state government.

We the People Act of 2016 Democracy Is Strengthened by Casting Light On Spending in Elections Act of 2016 or the DISCLOSE Act of 2016 This bill amends the Federal Election Campaign Act of 1971 (FECA) to: redefine "independent expenditure" to expand the meaning of express advocacy for the election or defeat of a candidate; expand the period for treating communications as electioneering communications; repeal the prohibition against contributions by minors; and prescribe disclosure requirements for campaign-related disbursements by corporations, labor organizations, and certain other entities, including super political action committees (PACs). Stop Super PAC-Candidate Coordination Act The bill amends FECA to treat payments for coordinated expenditures as contributions to candidates under certain conditions, and set forth rules for coordinated expenditures. The bill also prohibits candidates, individual federal officeholders, agents of a candidate or an individual federal officeholder, or certain related entities from soliciting, receiving, directing, or transferring funds to or on behalf of any political committee that accepts donations or contributions that do not comply with FECA limitations, prohibitions, and reporting requirements, or to or on behalf of any political organization that accepts such donations or contributions. Real Time Transparency Act The bill amends FECA to require 48-hour notification to the Federal Election Commission (FEC) by all political committees receiving cumulative contributions (instead of single contributions) of $1,000 or more during a year from any contributor. Federal Election Administration Act of 2016 The FECA is also amended to replace the FEC with the Federal Election Administration (FEA). The Government Accountability Office shall: (1) examine the enforcement of the criminal provisions of FECA and prohibitions regarding the Presidential Election Campaign Fund and the Presidential Primary Matching Payment Account, and (2) study the adequate level of resources for the FEA to execute competently the responsibilities imposed by this bill. The federal criminal code is amended to prohibit former Members of Congress from ever lobbying a current Member in connection with any matter on which such former Member seeks action. The Lobbying Disclosure Act of 1995 is amended to revise the definition of lobbyist to mean any individual who is employed or retained by a client for financial or other compensation for services that include more than one lobbying contact over a two-year (currently three-month) period. Financial Services Conflict of Interest Act The federal criminal code is also amended regarding application of certain conflict-of-interest restrictions to a private sector employer that makes payment of compensation contingent on accepting a position in the federal government. The Ethics in Government Act of 1978 is amended to prohibit a covered financial services regulator from making, participating in making, or in any way attempting to use his or her official position to influence a particular matter that provides a direct and substantial pecuniary benefit for a former employer or former client. The Office of Government Ethics must discharge certain recordkeeping duties to implement this bill. Violators of this bill shall be subject to specified criminal and civil penalties. The bill revises and extends certain restrictions on subsequent employment on current and former procurement officers. The federal criminal code is amended to place specified time restrictions on subsequent employment for financial service regulators. The Federal Deposit Insurance Act is amended to revise restrictions on federal examiners and supervisors of financial institutions.

Organ Mountains-Desert Peaks Conservation Act This bill designates specified lands in New Mexico administered by the Bureau of Land Management (BLM) of the Department of the Interior as wilderness and as components of the National Wilderness Preservation System. Such wilderness areas shall also be administered as components of the National Landscape Conservation System. The bill designates approximately 100 acres of specified BLM land in New Mexico as a potential wilderness area, upon which Interior shall permit only those uses already permitted. When specified conditions have been met, this area shall be incorporated into the Robledo Mountains Wilderness. The bill releases from further review for designation as wilderness the public land in Dona Ana County, New Mexico, administered by the BLM and not designated as wilderness. The bill withdraws the Potrillo Mountains Complex from the Potrillo Mountains Wilderness; it closes a specified route from public access, making it available only for administrative and law enforcement uses, including border security. In implementing a management plan for the Organ Mountains-Desert Peaks National Monument in New Mexico, Interior shall include a watershed health assessment to identify opportunities for watershed restoration. Any land or interest that is within specified state trust land acquired by the United States shall become part of the monument. Interior shall convey to the state of New Mexico specified BLM land in exchange for specified parcels of state trust land within the monument.

Securing Energy Infrastructure Act This bill establishes a two-year pilot program within the Department of Energy's (DOE) national laboratories to identify the security vulnerabilities of certain entities in the energy sector, and research and test technology that can be used to isolate the most critical systems of such entities from cyber-attacks. In addition, DOE must establish a working group to evaluate the technology solutions proposed by the national laboratories and to develop a national cyber strategy to isolate the energy grid from attacks. DOE must also submit a report to Congress describing the results of the pilot program, assessing the feasibility of the techniques considered, and outlining the results of the working group's evaluation.

Merchant Mariners of World War II Congressional Gold Medal Act of 2016 This bill directs the Speaker of the House of Representatives and the President pro tempore of the Senate to award a Congressional Gold Medal to the U.S. merchant mariners of World War II in recognition of their dedicated and vital service during World War II. Expresses the sense of Congress that the American Merchant Marine Museum should make the medal available for display elsewhere, particularly at appropriate locations associated with the U.S. Merchant Marine, giving preference to locations affiliated with it.

Budgeting for Opioid Addiction Treatment Act This bill amends the Internal Revenue Code to impose a one cent per milligram excise tax on the sale of active opioids by the manufacturer, producer, or importer. The tax excludes prescription drugs used exclusively for the treatment of opioid addiction as part of a medically assisted treatment effort. The Department of Health and Human Services (HHS) must establish a program to provide rebates or discounts to cancer and hospice patients to ensure that they do not pay the tax. The bill amends the Public Health Service Act to require any increase in federal revenues from the tax after rebates and discounts are subtracted to be distributed to states under the Substance Abuse Prevention and Treatment Block Grant program to be used exclusively for substance abuse (including opioid abuse) efforts in the states, including specified treatment programs. HHS must report to Congress on the impact of this bill on the retail cost of opioids and patient access to opioid medication, the effectiveness of the discount or rebate for cancer and hospice patients, how the funds are being used to improve substance abuse treatment efforts, and suggestions for improving access to opioids for cancer and hospice patients and substance abuse treatment efforts.

Recognizes the service and sacrifice of the 19 Air Force members who were killed in the June 25, 1996, terrorist bombing of the United States Sector Khobar Towers military housing complex on Dhahran Air Base, Saudi Arabia. Extends sympathies to the families and friends of those killed. Acknowledges the anguish and resilience of the attack's survivors. Assures members of the Armed Forces and other U.S. agents serving in harm's way that their well-being will be given the highest priority. Declares that perpetrators of terrorist acts against members of the Armed Forces and U.S. agents or citizens will be brought to justice.
