Constitutional Amendment - Marriage Protection Amendment - Declares that: (1) marriage in the United States shall consist only of the union of a man and a woman; and (2) neither the U.S. Constitution nor the constitution of any state shall be construed to require that marriage or the legal incidents of marriage be conferred upon any other union.

Veterans 2nd Amendment Protection Act - Prohibits considering a veteran, surviving spouse, or child who is mentally incapacitated, deemed mentally incompetent, or experiencing an extended loss of consciousness from being considered adjudicated as a mental defective for purposes of the right to receive or transport firearms without the order or finding of a judge, magistrate, or other judicial authority of competent jurisdiction that such veteran, surviving spouse, or child is a danger to him- or herself or others.

Access to Air Travel Act - Prohibits the Secretary of Transportation and the Administrator of the Federal Aviation Administration (FAA) from taking actions to regulate the scheduling of airline operations at a U.S. commercial airport if such an action includes: (1) auctioning rights or permission to conduct airline operations at that airport; (2) implementing peak-period or congestion pricing at the airport; (3) withdrawing an airline's right to operate at that airport; (4) charging a fee for use of navigable airspace at the airport; or (5) requiring, or providing incentives or disincentives to, airport owners to take any such actions.

Recognizes, on the 12th anniversary of that attack, the service and sacrifice of the 19 members of the U.S. Air Force who died in the terrorist bombing of the Khobar Towers U.S. military housing compound in Dhahran, Saudi Arabia. Calls upon the people of the United States to pause and pay tribute to those brave members of the Air Force. Extends the continued sympathies of Congress to the families of those who died. Assures the members of the Armed Forces serving anywhere in the world that their well-being and interests will at all times be given the highest priority.

Calls for the Food and Drug Administration (FDA) to reverse its policy that aims to eliminate patient access to compounded medications containing estriol prescribed by physicians unless it holds a public comment period on the issue and can document evidence of adverse events and other safety issues to justify such policy.

International Space Station Payments Act of 2008 - Amends the Iran, North Korea, and Syria Nonproliferation Act to exempt from the prohibition on "extraordinary payments'' U.S. government payments made between January 1, 2012, and reentry into Earth's atmosphere of the International Space Station (ISS) at its end of life for work or services necessary to meet U.S. obligations under the Agreement Concerning Cooperation on the Civil International Space Station. (Extraordinary payments are, generally, those made for work on the ISS which the Russian government pledged to provide at its expense and those for work on the ISS, or for the purchase of goods or services relating to human space flight, that are not required to be made under the terms of a contract or other agreement that was in effect on January 1, 1999, as the terms were in effect on that date.) Specifies that such exemption shall not permit payments for: (1) cargo services provided by a Progress vehicle; or (2) crew transportation or rescue services provided by a Soyuz vehicle after the U.S. Orion Crew Exploration Vehicle reaches full operational capability, or a U.S. commercial provider of crew transportation and rescue services demonstrates the capability to meet ISS mission requirements.

Alternative Minimum Tax and Extenders Tax Relief Act of 2008 - Amends the Internal Revenue Code to extend expiring provisions relating to the alternative minimum tax, individual and business taxpayers, energy conservation, and tax administration. Extends through 2008 for individual taxpayers: (1) the offset of nonrefundable personal tax credits against regular and alternative minimum tax (AMT) liabilities; and (2) the increased AMT exemption amounts. Extends through 2009: (1) the election to deduct state and local sales taxes in lieu of state and local income taxes; (2) the tax deductions for qualified tuition and related expenses and for certain expenses of elementary and secondary school teachers; (3) tax-free distributions from individual retirement accounts (IRAs) for charitable purposes; and (4) tax rules for treatment of stock and dividends of regulated investment companies and for qualified investment entities. Extends through 2009 various business-related tax provisions, including: (1) the tax credit for increasing research activities; (2) the new markets tax credit; (3) the subpart F income exemption for active financing income; (4) accelerated depreciation for qualified leasehold and restaurant improvements, for business property on Indian reservations, and for motorsports racing track facilities; (5) the expanded tax deductions for charitable contributions of food and book inventories by noncorporate taxpayers; (6) the special rules for related controlled foreign corporations and for the tax treatment of certain payments to tax-exempt organizations by a controlled subsidiary; (7) the special rule for reductions in the basis of S corporation stock for charitable contributions of property; (8) the increase in alcohol excise taxes payable to Puerto Rico and the Virgin Islands; (9) the economic development credit for American Samoa; (10) tax incentives for mine rescue team training and advanced mine safety equipment; (11) expensing allowances for film and television production costs and for environmental remediation costs; (12) the tax deduction for income attributable to domestic production activities in Puerto Rico; (13) issuance authority for qualified zone academy bonds; (14) the Indian employment tax credit; (15) the tax credit for railroad track maintenance; and (16) work opportunity tax credit eligibility for Hurricane Katrina employees (through August 28, 2009). Extends through 2009 tax credits for: (1) production of electricity from certain renewable resources; (2) residential energy efficient property expenditures; (3) investment in clean renewable energy bonds; (4) energy efficient improvements to principal residences; (5) new energy efficient home expenditures; (6) energy efficient home appliances produced after 2007; and (7) biodiesel, renewable, and certain alternative fuels. Includes marine and hydrokinetic renewable energy as a renewable resource for purposes of the tax credit for producing electricity from renewable resources. Extends through 2016 the investment tax credit for solar energy, fuel cell, and microturbine property. Repeals the dollar per kilowatt limitation on fuel cell property. Allows the offset of energy tax credit amounts against the AMT. Allows public electric utility property to qualify for the energy investment tax credit. Extends through 2009: (1) the tax deduction for energy efficient commercial buildings; and (2) the suspension of the taxable income limitation on percentage depletion for oil and natural gas produced from marginal properties. Makes permanent IRS authority to: (1) conduct undercover operations; (2) disclose tax information to state agencies to facilitate combined employment tax reporting; and (3) disclose tax return information to the Department of Veteran Affairs (VA) for veterans benefit determinations. Extends through 2009 IRS authority to disclose tax return information related to terrorist activities.

Declares that: (1) preventing the government of Iran from acquiring a nuclear weapons capability through economic, political, and diplomatic means is vital to U.S. national security; and (2) nothing in this resolution authorizes the use of force against Iran. Urges the President to use his authority to impose sanctions on: (1) Iranian banks engaged in proliferation activities or the support of terrorist groups; (2) international banks which conduct financial transactions with sanctioned Iranian banks; (3) energy companies with large investments in the Iranian petroleum or natural gas sector; and (4) all companies which do business with Iran's Islamic Revolutionary Guard Corps. Demands that the President lead an international effort to increase pressure on Iran to suspend its nuclear enrichment activities, including by banning the importation of refined petroleum products to Iran.

Military Voting Protection Act of 2008 - Amends the Uniformed and Overseas Citizens Absentee Voting Act to direct the Secretary of Defense (the presidential designee) to establish procedures for: (1) collecting absentee ballots of military overseas voters in elections for federal office; and (2) delivering such ballots to the appropriate state election officials. Requires the designee to: (1) ensure that such ballots are delivered prior to the time established for the closing of the polls on the date of the election; (2) carry out delivery requirements through a contract with a private provider of express mail services, which shall include a mechanism for ballot tracking; and (3) take steps to ensure that such voters are able to cast their votes in a private and independent manner, and that vote contents remain private while in the designee's possession or control. Expresses the sense of Congress that the Department of Defense (DOD) should: (1) utilize existing and emerging technologies to enhance the ability of members of the Armed Forces to meaningfully participate in elections and have their votes counted; and (2) continue to closely examine the option of electronic voting, with the objective of protecting voter privacy and guarding against voter fraud.

Boy Scouts of America Centennial Commemorative Coin Act - Directs the Secretary of the Treasury to mint and issue up to 350,000 $1 coins in commemoration of the centennial of the founding of the Boy Scouts of America. Requires the coin design to be emblematic of the 100 years of the organization. Restricts issuance of such coins to February 8 through December 31, 2010. Subjects coin sales to a surcharge of $10 per coin. Requires payment of such surcharges to the National Boy Scouts of America Foundation, to be made available to local councils in the form of grants for the extension of Scouting in hard-to-serve areas.

Designates August 2008 as Digital Television Transition Awareness Month to increase public awareness and encourage consumers to learn about the government coupon program for obtaining converter boxes. Encourages consumers to make the transition well before the conversion date (February 17, 2009). Encourages local nonprofit organizations to assist households in applying for the coupons and installing converter boxes and to educate consumers about websites and other sources of transition information.

Access, Compassion, Care, and Ethics for Seriously Ill Patients Act or the ACCESS Act - Amends the Federal Food, Drug, and Cosmetic Act to require the Secretary of Health and Human Services to permit an investigational drug, biological product, or device to be made available for expanded access under a treatment investigational new drug application or treatment investigational device exemption if specified Compassionate Investigational Access requirements are met. Gives immunity to the manufacturer, distributor, administrator, sponsor, or physician from suit or liability relating to products approved under this Act. Establishes a procedure for accelerated approval of an investigational drug, biological product, or device that is reasonably likely to predict clinical benefit to a patient suffering from a serious or life-threatening condition. Requires the Secretary to establish: (1) the Accelerated Approval Advisory Committee; (2) a new program to expand access to investigational treatments for individuals with serious or life threatening conditions and diseases; and (3) a demonstration project under the Medicare program to pay for drugs, biological, products, and devices approved under this Act. Amends title XVIII (Medicare) of the Social Security Act to revise the definition of "medically accepted indication" to provide for coverage of a covered Part D drug based on the sponsor's or organization's determination that the drug is for a medically accepted indication. Requires the Secretary to consider the clinical judgment and risks to the patient from the disease or condition in evaluating the safety and effectiveness of drugs, biological products, and devices that treat serious or life-threatening diseases or conditions, including the evaluation of nonstatistical information. Requires any committee evaluating investigational drugs, devices, or biological product applications to have at least two patient representatives as voting members.

American Energy Production Act of 2008 - Amends the Outer Continental Shelf Lands Act to permit projected lines of states adjacent to the subsoil and seabed of the outer Continental Shelf to be used for oil and gas preleasing and leasing activities. Authorizes the governor of a state with a new producing area within the offshore administrative boundaries beyond the submerged land of the state to petition the Secretary of Energy to make new producing areas available for oil and gas leasing. Sets forth a lease sales program for oil and gas development within the Coastal Plain of the Arctic National Wildlife Refuge. Prescribes environmental protection procedures for the Coastal Plain. Requires Alaska to establish in its state treasury the Coastal Plain Local Government Impact Aid Assistance Fund to assist designated Alaska entities impacted by the oil and gas exploration and production. Prohibits exportation of oil or gas produced under this Act. Prescribes a refinery permitting process. Suspends petroleum acquisition for the Strategic Petroleum Reserve (SPR). Amends the Clean Air Act to include renewable biomass within its purview. Sets forth an advanced battery manufacturing incentive program. Instructs the Assistant Administrator of the Office of Research and Development of the Environmental Protection Agency to implement a research and development program for adding materials to biofuels to make them more compatible with infrastructure used to store and deliver petroleum-based fuels. Instructs the Secretary of Energy to study and report to Congress on: (1) the feasibility of increasing consumption in the United States of ethanol-blended gasoline with specified levels of ethanol; and (2) specified diesel vehicle attributes. Clean Coal-Derived Fuels for Energy Security Act of 2008 - Directs the President to promulgate regulations to ensure that covered fuel introduced into commerce in the United States on an annual average basis contains a specified volume and percentage of clean coal-derived fuel. Amends the Department of the Interior, Environment, and Related Agencies Appropriations Act, 2008 to repeal the prohibition against final regulations for commercial oil shale leasing program on public land. Amends the Energy Independence and Security Act of 2007 to repeal the prohibition against federal agency contracts for procurement of alternative or synthetic fuel. Authorizes the Department of Defense to enter into multiyear contracts to purchase synthetic fuels.

Amends the Energy Independence and Security Act of 2007 to repeal the proscription against federal agency contracts for procurement of alternative or synthetic fuel. Authorizes the Department of Defense to enter into multiyear contracts to purchase synthetic fuels.

Domestic Offshore Energy Security Act of 2008, or the DOES Act - Permits United States persons to: (1) engage in exploration and extraction of hydrocarbon resources from any portion of any foreign exclusive economic zone contiguous to the exclusive economic zone of the United States; and (2) export without license authority all pertinent equipment for such activity. Amends the Trade Sanctions Reform and Export Enhancement Act of 2000 to direct the Secretary of the Treasury to authorize travel-related transactions for travel to, from, or within Cuba in connection with exploration and extraction of hydrocarbon resources in any part of a foreign maritime Exclusive Economic Zone contiguous to the U.S. Exclusive Economic Zone. Identifies as persons authorized to travel to Cuba any full-time employees, executives, and agents and consultants of oil and gas producers, distributors, and shippers. Amends the Gulf of Mexico Energy Security Act of 2006 to: (1) repeal the moratorium on oil and gas leasing east of the Military Mission Line in the Gulf of Mexico; and (2) decrease to 45 miles within the coastline of Florida the moratorium on oil and gas leasing. Instructs the Secretary of the Interior to promulgate regulations that establish environmental safeguards for oil and natural gas exploration and production on the outer Continental Shelf. Authorizes such Secretary to inventory the oil and natural gas resources beneath the waters of the outer Continental Shelf off the coasts of Virginia, North Carolina, South Carolina, or Georgia, only if the respective state governor requests it. Amends the Energy Policy Act of 2005 to instruct the Secretary of Energy, in evaluating applications for enhanced oil and natural gas production through carbon dioxide injection, to grant priority consideration to applications carried out in geologically challenging fields. Requires the Secretaries of the Interior and of Energy (Secretaries) to suspend acquisition of petroleum for the Strategic Petroleum Reserve (SPR) during calendar 2008. Authorizes the Secretaries to resume such acquisition after the President notifies Congress that the weighted average price of petroleum in the United States for the most recent 90-day period is $75 or less per barrel.

Enhancement of Recruitment, Retention, and Readjustment Through Education Act of 2008 - Directs the Secretary of Defense to develop a plan on the coordination of current Department of Defense (DOD) educational assistance programs and the development of additional programs to enable members of the Armed Forces (members) to attain a bachelor's degree while pursuing a military career. Increases rates of educational assistance: (1) under the Montgomery GI Bill; (2) for members of the Selected Reserve; and (3) for Selected Reserve members with extended (more than 12 years) service who provide support for contingency operations and other operations. Provides an annual stipend for individuals receiving basic educational assistance and pursuing a program of education at an approved institution of higher education. Allows a member who has completed six years of service (current law allows only members who have completed six years of service and have a military skill designated as critical) to transfer to one or more dependents any unused portion of the member's educational assistance entitlement. Provides similar authority for members of the Selected Reserve. Authorizes a member on active duty and entitled to basic educational assistance to use all or a portion thereof to repay any outstanding federal student loan. Makes eligible for educational assistance an individual who, after September 30, 2009, receives a commission upon graduation of a service academy or completion of Senior Reserve Officers' Training, and completes at least five years of continuous active duty. Makes eligible for enrollment under the Montgomery GI Bill certain retired personnel originally enrolled in the veterans' educational assistance program. Requires the Secretary of Veterans Affairs to carry out a supplemental educational grant program under which a participating institution of higher education provides certain veterans with the non-federal share of a percentage of such veteran's unmet educational financial need.

Hubbard Act - Amends federal employment, armed forces, military pay, and veterans' benefits law to authorize the provision of the following benefits to a member of the Armed Forces who is discharged at the member's request pursuant to a Department of Defense (DOD) policy permitting the early discharge of a member who is the only surviving child in a family in which the father or mother, or one or more siblings, served in the Armed Forces and, incident to such service, was killed, died as a result of wounds, accident, or disease, is in a captured or missing in action status, or is permanently disabled: (1) continued payment, through the original agreed-upon service period, of any bonus, incentive, or similar benefit to which the member was entitled during service; (2) separation pay, even though the member has completed less than six years of active service before discharge; (3) transitional health care, on the same basis as an active-duty member, for 180 days after discharge; (4) transitional commissary and exchange benefits, on the same basis as an active-duty member, for two years after discharge; (5) veterans' housing loan, employment and training, and basic educational assistance; (6) federal unemployment compensation; and (7) veteran's preference for federal employment purposes. Makes this Act effective with respect to any such discharge granted after September 11, 2001.

Designates the third week of April 2008 as National Shaken Baby Syndrome Awareness Week. Commends organizations that are: (1) working to increase awareness of the danger of shaking young children; (2) educating caregivers on protecting children from injuries caused by abusive shaking; and (3) helping families cope with the challenges of child-rearing and other stresses. Encourages people to remember the victims of Shaken Baby Syndrome and to participate in educational programs to help prevent it.

National Guard and Reserve Retired Pay Equity Act of 2008 - Amends the National Defense Authorization Act for Fiscal Year 2008 to back-date to September 11, 2001, the period of active duty or performed active service, in support of a contingency operation or in other emergency situations, for which members of Ready Reserve components of the armed forces shall receive credit in determining eligibility for early receipt of non-regular service retired pay.

Amends the Internal Revenue Code to allow: (1) taxpayers who do not itemize their deductions to deduct from gross income the costs of health insurance and long-term care insurance; and (2) payments from health savings accounts for non-group high deductible health plan premiums.

Amends the Energy Independence and Security Act of 2007 to repeal provisions prohibiting any federal agency from entering into a contract for procurement of an alternative or synthetic fuel for any mobility-related use, other than for research or testing, unless the contract specifies that the lifecycle greenhouse gas emissions associated with the production and combustion of the fuel must be less than or equal to such emissions from the equivalent conventional fuel.

Small Business Health Plans Act of 2008 - Amends the Employee Retirement Income Security Act of 1974 (ERISA) to provide for the establishment and governance of small business health plans, which are group health plans sponsored by trade, industry, professional, chamber of commerce, or similar business associations that meet ERISA certification requirements. Requires the Secretary of Labor to: (1) apply the rules and standards of this Act to Alternative Market Pooling Organizations, such as unions, churches, and other groups; and (2) consult with the domicile state regarding the Secretary's exercise of authority over such plans. Allows other existing plans to be treated as small business health plans under certain circumstances. Amends the Public Health Service Act to require the Secretary of Health and Human Services (the Secretary) to promulgate Minimum Standards for premium variations and Model Small Group Rating Rules for plans under this Act. Requires the Secretary to issue the List of Required Benefits of covered benefits, services, or categories of providers that are required to be provided by health insurance issuers in at least 26 states as a result of state mandate laws. Applies covered benefit, service, or category of provider mandates from the List to states with laws requiring such mandates, but does not apply such mandates from the List to states with no such laws. Supersedes any and all state laws relating to such mandates in the health insurance market. Requires the Secretary to establish the Health Insurance Consensus Standards Board to develop recommendations that harmonize inconsistent state health insurance laws. Provides that any harmonized standards adopted by the Secretary will supersede state laws related to the areas covered by the harmonized standards.

Criminal Alien Removal Act of 2008 - Directs the the Secretary of Homeland Security to carry out a Criminal Alien Program to: (1) identify incarcerated criminal aliens (as defined by this Act); (2) ensure that such aliens are not released into the community; and (3) remove such aliens from the United States upon release. Makes a state that does not cooperate with the Secretary of Homeland Security to carry out the Program ineligible for Department of Justice law enforcement grant programs (including the criminal alien incarceration program under the Immigration and Nationality Act). Authorizes appropriate state officials to: (1) hold an illegal alien for up to 14 days after completion of the term of incarceration in order to effectuate transfer to federal custody if the alien is removable or not lawfully present in the United States; and (2) issue a detainer permitting an alien who completes a term of incarceration to be held until U.S. Immigration and Customs Enforcement takes the alien into custody. Directs the Secretary to carry out the Program as follows: (1) by December 31, 2010, identify each criminal alien incarcerated in a federal facility who will be deportable or removable upon release; and (2) by December 31, 2012, identify each criminal alien serving a term of three or more years in a state or local facility who will be deportable or removable upon release.

Security Against Foreclosures and Education Act, or the SAFE Act - Amends the Internal Revenue Code to allow proceeds of qualified mortgage bonds to be used to refinance certain residential subprime loans. Requires the Neighborhood Reinvestment Corporation to continue to award expeditiously certain funds already provided for mortgage foreclosure counseling. Amends the Code to allow purchasers of certain single-family principal residences a one-time tax credit. Amends the Truth in Lending Act to: (1) revise creditor mortgage loan disclosure requirements; and (2) increase civil damages for noncompliance with such Act. Amends the Code to: (1) allow a five-year carryback of net operating losses for certain taxable years; and (2) suspend through taxable year 2009 the 90% of alternative minimum taxable income limit for certain adjustments to the alternative (minimum) tax net operating loss deduction. Amends the Servicemembers Civil Relief Act of 1940 to expand the period of moratorium on foreclosure sales after a servicemember's service. Requires the Secretary of Defense to develop a program for mortgage foreclosure prevention counseling for members of the Armed Forces returning from service abroad. FHA Modernization Act of 2008 - Amends the National Housing Act (NHA) to: (1) revise requirements for the maximum principal loan obligation eligible for mortgage insurance, as well as the cash investment requirement; and (2) prohibit seller-funded downpayment assistance. Replaces the General Insurance Fund (GIF) with the Mutual Mortgage Insurance (MMI) Fund as the depository of all funds involved in rehabilitation loans for one- to four-family structures. Eliminates the limitation on the aggregate number of home equity conversion mortgages (HECMs) for elderly homeowners insured under the Act. Authorizes the Secretary of Housing and Urban Development (HUD) to insure HECMs. Establishes a single national loan limit for HECMs. Amends the Energy Policy Act of 1992 to raise the cap on the price of cost-effective energy efficiency improvements under the energy efficiency mortgages program. Amends the NHA to require the Secretary to establish a pilot program for an automated process to provide alternative credit rating information on mortgagors and prospective mortgagors. Amends the Housing and Urban Development Act of 1968 to revise post-purchase housing counseling eligibility requirements. Directs the Secretary to establish a pre-purchase homeownership counseling demonstration program. Places limitations on mortgage insurance premium increases. Imposes a one-year moratorium on implementation by the Secretary of certain risk-based premiums. FHA Manufactured Housing Loan Modernization Act of 2008 - Amends the National Housing Act regarding FHA housing loan insurance for manufactured homes (or lots for such homes). Increases manufactured home loan limits, requiring annual indexing. Sets forth borrower premium charges. Amends the NHA to apply the prohibition against kickbacks and unearned fees in the Real Estate Settlement Procedures Act of 1974 (RESPA) to each sale of a manufactured home financed with an FHA-insured loan or extension of credit and related services. Prescribes certain lease requirements as prerequisites for HUD insurance of any loan, advance of credit, or purchase of such a loan or credit to finance a manufactured home intended to be located in a manufactured home community under a lease.

Preserving Access to Hospice (PATH) Act of 2008 - Amends title XVIII (Medicare) of the Social Security Act to provide for a temporary moratorium, from November 1, 2005, through October 31, 2008, on enforcement of the hospice cap amount. Directs the Medicare Payment Advisory Commission (MEDPAC) to study and report on: (1) the resource effectiveness and quality of hospice care as a substitute benefit for other acute care alternatives under Medicare; (2) the optimal median and average length of stay in hospice care under Medicare; (3) the reasons for persistently low median and average length of such stays; and (4) the desirability of requiring a national coverage determination of eligibility for hospice care under Medicare.

Prohibits appropriated funds for the community oriented policing services program from being used in contravention of section 642(a) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996, which provides that a federal, state, or local government entity or official may not prohibit or restrict any government entity or official from sending to, or receiving from, the Immigration and Naturalization Service information regarding an individual's citizenship or immigration status.

Authorizes a financial institution, when verifying the identity of a non-U.S. citizen or national who is seeking to open a bank account, to accept only: (1) a Social Security number; (2) a passport number and the country of issuance; (3) an alien identification card number; or (4) any combination of such items. Prohibits a financial institution, for such verification purposes, from accepting identification documents issued by a foreign government, other than an unexpired passport.

Declares Executive Order 13166, "Improving Access to Services for Persons with Limited English Proficiency," to be null and void. Prohibits the use of funds for the promulgation or enforcement of an executive order that creates an entitlement to services provided in a language other than English.
