Carbon Capture Utilization and Storage Act

Carbon Capture Utilization and Storage Act This bill amends the Internal Revenue Code to extend and modify the tax credit for carbon dioxide (CO2) sequestration. The bill modifies the credit to: allow certain new industrial facilities or equipment to qualify for the credit if construction begins before January 1, 2024; allow qualified projects to claim the credit for 12 years, beginning on the date the equipment was originally placed in service; increase the separate credit amounts, with respect to projects placed in service upon or after the enactment of this bill, that apply to captured CO2 that is: (1) disposed of in secure geological storage, and (2) used as a tertiary injectant in an enhanced oil or natural gas recovery project and disposed of in secure geological storage; expand the purposes for which captured CO2 may be used; establish separate CO2 capture thresholds based on whether the facility is an electricity generating facility or used for other purposes; specify that the 75 million metric ton cap on the CO2 that may qualify for the credit applies only to projects placed in service before the enactment of this bill; and allow the credit to be transferred from the entity that owns and uses the capture equipment to the entity that disposes of or uses the CO2.

Justice for Uncompensated Survivors Today (JUST) Act of 2016 This bill directs the Department of State, with respect to covered countries, to annually include within either the relevant Annual Country Report on Human Rights, the International Religious Freedom Report, or other appropriate report an assessment of the nature and extent of national laws or enforceable policies regarding the identification, return, or restitution of wrongfully seized or transferred Holocaust era assets and compliance with the goals of the Terezin Declaration on Holocaust Era Assets and Related Issues, including: the return to the rightful owner of wrongfully seized or transferred property, including religious or communal property, or the provision of comparable substitute property or the payment of equitable compensation to the rightful owner; the use of the Washington Conference Principles on Nazi-Confiscated Art and the Terezin Declaration in settling claims involving publicly and privately held movable property; the restitution of heirless property to assist needy Holocaust survivors; and progress on the resolution of claims for U.S. citizen Holocaust survivors and family members. "Covered countries" means signatories to the Terezin Declaration that are determined by the Special Envoy for Holocaust Issues to be countries of particular concern with respect to such restitution.

Sarah's Law This bill amends the Immigration and Nationality Act to require the detention of an alien: (1) who was not inspected and admitted into the United States, who held a revoked nonimmigrant visa (or other nonimmigrant admission document), or who is deportable for failing to maintain nonimmigrant status; and (2) who has been charged in the United States with a crime that resulted in the death or serious bodily injury of another person. U.S. Immigration and Customs Enforcement shall make reasonable efforts to: obtain information about the identity of any victims of the crimes for which such alien was charged or convicted; and provide the victim, or a parent, guardian, spouse, or closest living relative of a deceased victim, with information about such alien, including name, date of birth, nationality, immigration status, criminal history, and a description of any related removal efforts.

Seniors Tax Hike Prevention Act of 2016 This bill amends the Internal Revenue Code (IRC) to extend, through 2018, the rule that permits individuals who are 65 and older to deduct certain medical expenses that exceed 7.5% of adjusted gross income. (Under current law, the rule that reduces the 10% threshold for the medical expense deduction to 7.5% if a taxpayer or a taxpayer's spouse is 65 or older expires at the end of 2016.) The bill also expresses the sense of the Senate that the reduction in revenues resulting from this bill should be offset by an appropriate amendment to the IRC.

WINGMAN Act

Working to Integrate Networks Guaranteeing Member Access Now Act or the WINGMAN Act This bill directs the Department of Veterans Affairs (VA) to provide an accredited, permanent congressional employee with read-only remote access to the electronic Veterans Benefits Administration (VBA) claims records system of a represented veteran, regardless of whether the employee is acting under a power of attorney executed by the veteran. The VA shall ensure that access does not allow the employee to modify system data. An employee must complete the VA certification process required of agents or attorneys in order to have system access. Each Member of Congress who elects to have an employee have access to the system shall bear the certification cost, which shall be paid from the Member's representational allowance. Information access by an employee shall be deemed: (1) a covered disclosure requiring prior consent, with specified exceptions; and (2) a permitted disclosure relating to the privacy of individually identifiable health information. The VA may not recognize an employee for purposes of preparation, presentation, and prosecution of VA claims by reason of such system access. "Accredited, permanent congressional employee" means an employee of a Member of Congress who assists constituents with issues regarding federal departments or agencies. "Electronic VBA claims records system" means the VA system that provides claim status information, including information about medical records, compensation and pension exams records, rating decisions, a statement of the case and a supplementary statement of the case, a notice of disagreement, and Form-9.

Family First Prevention Services Act of 2016

Family First Prevention Services Act of 2016 This bill amends Part E (Foster Care and Adoption Assistance) of title IV of the Social Security Act (SSAct) regarding: (1) mental health and substance abuse prevention and treatment services and in-home parenting skill-based programs, (2) foster care maintenance payments for children with parents in a licensed residential family-based treatment facility for substance abuse, and (3) payments for evidence-based kinship navigator programs. Part B (Child and Welfare Services) of SSAct title IV is amended regarding: (1) time limits for family reunification services for children in foster care or returning home, (2) grants for the development of an electronic interstate case-processing system to expedite the interstate placement of children in foster care or guardianship or for adoption, and (3) targeted grants to increase the well-being of children affected by substance abuse. The Department of Health and Human Services shall identify reputable model standards for the licensing of foster family homes. SSAct title IV part B is amended regarding tracking and preventing child maltreatment. SSAct title IV part E is amended regarding: (1) kinship guardianship assistance and prevention services, (2) foster care maintenance payments program and limited federal financial participation, and (3) assessment and judicial documentation of the need for placement of a child in a qualified residential treatment program. SSAct title IV part B is amended regarding procedures and protocols a state has established to ensure that children in foster care placements are not inappropriately diagnosed with mental illness, other emotional or behavioral disorders, medically fragile conditions, or developmental disabilities, and as a result placed in settings that are not foster family homes. SSAct title IV part E is amended regarding children in foster care who have been placed in a child care institution or other setting that is not a foster family home. SSAct title IV part B to reauthorize through FY2021: (1) the Stephanie Tubbs Jones Child Welfare Services Program, (2) promotion of safe and stable families programs, (3) funding reservations for monthly caseworker visits and regional partnership grants, and (4) funding for state courts. SSAct title IV part E is amended to: (1) revise the John H. Chaffee Foster Care Independence Program and related programs, and (2) reauthorize the adoption and legal guardianship incentive programs through FY2021. SSAct title IV part B is amended to delay the adoption assistance phase-in. The Government Accountability Office shall study the extent to which states comply with certain SSAct requirements relating to the effects of phasing out the Aid to Families with Dependent Children program income eligibility requirements for adoption assistance payments.

FIRE Act

Fiscal Responsibility Act of 2016 or the FIRE Act This bill requires the President and the congressional leadership to appoint members of a National Commission on Fiscal Responsibility and Reform within 180 days of the inauguration of a President. The commission must identify policies to improve the fiscal situation in the medium-term and to achieve fiscal sustainability over the long-term. In carrying out these duties, the commission must propose recommendations to: (1) balance the budget, excluding interest payments on the debt, within 10 years, in order to stabilize the debt-to-GDP (gross domestic product) ratio at an acceptable level; and (2) meaningfully improve the long-term fiscal outlook, including changes to address the growth of entitlement spending and the gap between projected revenues and expenditures. Within one year of the appointment of its members, the commission must vote on a report including the required recommendations. The commission may only issue a final report to be submitted to Congress if at least 12 of its 18 members approve the report. Each commission terminates 30 days after submitting a report to Congress. After consulting with Congress and specified agencies, the President must submit to Congress a joint resolution containing the legislative text necessary to implement the recommendations contained in a report submitted to Congress. The resolution must be accompanied by a special message that includes specified details regarding recommendations of the commission that are excluded from or included in the resolution. Congress must consider the joint resolution using expedited legislative procedures specified in the bill.

Apollo 11 50th Anniversary Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue gold, silver, half-dollar clad, and proof silver coins in recognition and celebration of the 50th anniversary of the first manned landing on the moon. Treasury may issue coins minted under this bill for only a one-year period, beginning January 1, 2019. All sales of these coins shall include a surcharge of $35 per gold coin, $10 per silver coin, $5 per half-dollar clad coin, and $50 per proof silver coin. All of the surcharges received from the sale of such coins shall be paid as follows: one-half to the Smithsonian Institution's National Air and Space Museum's "Destination Moon" exhibit; one-quarter to the Astronauts Memorial Foundation; and one-quarter to the Astronaut Scholarship Foundation, to aid its missions by providing college scholarships for the very best and brightest students pursuing degrees in science, technology, engineering, or mathematics.

Protecting Patient Access to Emergency Medications Act of 2016 This bill amends the Controlled Substances Act to direct the Drug Enforcement Administration (DEA) to register an emergency medical services (EMS) agency as an entity authorized to dispense controlled substances, instead of registering the individual practitioners or medical directors of the agency. A registered EMS agency must be overseen by one or more medical directors. The bill specifies that an EMS practitioner who is employed by a registered EMS agency may administer controlled substances under a standing order issued by a medical director. The standing order does not have to be specific to an individual patient. An EMS agency must keep the standing order on file and make it available to the DEA upon request.

Requiring Accountability and Inspections for Dining Service Act This bill directs the Department of Veterans Affairs (VA) to provide for annual inspections to ensure that VA medical facility kitchens and food service areas meet private hospital kitchen and food service area standards. The VA shall seek to enter into an agreement with the Joint Commission on Accreditation of Hospital Organizations to conduct such inspections. If the VA is unable to enter into an agreement with the Commission, the VA shall seek such an agreement with a non-federal, not-for-profit entity with comparable expertise and objectivity. If a VA facility kitchen or food service area fails such inspection, the VA shall implement a remediation plan within 48 hours and conduct a second inspection within 7 days. A facility kitchen or food service area that fails the second inspection shall be closed until: (1) remediation is completed, and (2) all kitchens and food service areas at that facility meet the standards. The Veterans Integrated Service Network of a facility in which a kitchen or food service area is closed shall enter into a food service contract with a General Services Administration-approved vendor to provide food at such facility.

Veterans First Act TITLE I--PERSONNEL AND ACCOUNTABILITY MATTERS This bill establishes in the Department of Veterans Affairs (VA) the Office of Accountability and Whistleblower Protection. The VA is required to develop criteria to promote supervisory protection of whistle-blowers. The bill revises VA authority to remove certain employees or senior VA executives for reasons of misconduct or performance. TITLE II--HEALTH CARE MATTERS Jason Simcakoski Memorial Act The bill establishes the Veterans Expedited Recovery Commission to examine the VA's therapy model for treating mental health illnesses. The VA shall require additional information about a prospective health care employee from the medical board of each state in which the health care provider holds or has held a medical license. The VA family caregiver program is expanded. The bill establishes a VA advisory committee on caregiver policies. The VA shall revive the Intermediate Care Technician Pilot Program. The VA may place a veteran requesting nursing home care in a medical foster home that meets appropriate VA standards. The bill sets forth requirements for VA hospitals with emergency departments to provide appropriate examination and stabilizing treatment for emergency medical conditions and women in labor. The VA and the Department of Defense (DOD) shall jointly update the VA/DOD Clinical Practice Guideline for Management of Opioid Therapy for Chronic Pain. The VA shall expand its Opioid Safety Initiative. The bill establishes the VA Office of Patient Advocacy. The VA shall ensure that payments are made promptly to non-VA health care providers. If the VA is unable to furnish certain hospital, medical, or extended care at VA facilities or under other authorized contracts or sharing agreements, it may enter into a Veterans Care Agreement with an eligible provider to furnish such care. The bill authorizes the VA to carry out specified major medical facility projects in California, Maryland, Kentucky, and Washington. The VA shall: (1) adopt the Federal Drug Administrations's unique device identification system to identify biological implants for use in VA medical procedures; (2) expand research and integration of complementary and integrative health services into veterans health care services; and (3) carry out a three-year program to assess the feasibility of integrating complementary and alternative medicine services for veterans with mental health conditions, chronic pain conditions, and other chronic conditions. TITLE III--DISABILITY COMPENSATION AND PENSION The VA may pay burial and funeral expenses and other benefits to a survivor of a veteran who has not filed a formal claim if the record contains sufficient evidence to establish the survivor's entitlement to such benefits. The bill increases the special monthly pension for living Medal of Honor recipients. The Veterans Benefits Act of 2003 is amended to extend VA authority to provide for persons other than VA employees (i.e., contract physicians) to conduct medical disability examinations of applicants for VA benefits. The VA shall carry out a five-year disability claims appeals pilot program. TITLE IV--EDUCATION Any member of the Armed Forces who died between September 11, 2001, and December 31, 2005, is deemed to have died on January 1, 2006, in order to make that member's surviving spouse eligible for the Marine Gunnery Sergeant John David Fry scholarship. VA educational assistance payments for a veteran who was forced to discontinue a course or who did not receive credit toward completion of an education program because of a permanent school closure shall not be charged against the individual's educational assistance entitlement or counted against the aggregate assistance period. The bill revises the process for electing Post-9/11 educational benefits. TITLE V--EMPLOYMENT AND TRANSITION Each state director for veterans' employment and training shall coordinate activities with the state's departments of labor and veterans affairs. TITLE VI--HOMELESS VETERANS The bill includes as a homeless veteran, for purposes of VA benefits, a veteran or veteran's family fleeing domestic violence, sexual assault, stalking, or other dangerous or life-threatening conditions in their current housing situation. The VA shall shall carry out case management services to improve the retention of housing by: (1) veterans who were previously homeless and who are transitioning to permanent housing, and (2) veterans who are at risk of becoming homeless. The VA shall establish the National Center on Homelessness Among Veterans. This bill eliminates the minimum continuous active duty service requirement for homeless veterans to receive certain benefits. Homeless veterans are exempted from disqualification for such benefits because of a discharge or dismissal from the Armed Forces under conditions other than honorable, except for a discharge by reason of a general court-martial. TITLE VII--UNITED STATES COURT OF APPEALS FOR VETERANS CLAIMS The bill extends the temporary expansion of the Court of Appeals for Veterans Claims. TITLE VIII--BURIAL BENEFITS The VA may, in lieu of furnishing a headstone or marker to certain deceased individuals, furnish a medallion or other device to be attached to a headstone or marker furnished at private expense. TITLE IX--OTHER MATTERS The VA may carry out specified leases at the VA's West Los Angeles Campus in Los Angeles, California.

Emmett Till Unsolved Civil Rights Crimes Reauthorization Act of 2016 This bill permanently reauthorizes the Emmett Till Unsolved Civil Rights Crime Act of 2007 (Emmett Till Act) and expands the responsibilities of the Department of Justice (DOJ) and the Federal Bureau of Investigation (FBI) to include the investigation and prosecution of criminal civil rights statutes violations that resulted in a death, regardless of when the violations occurred. (Currently, the Emmett Till Act is scheduled to expire at the end of FY2017 and such investigations are limited to violations that occurred before 1970.) The bill expresses the sense of Congress that all authorities with jurisdiction should: (1) coordinate information sharing; (2) hold accountable individuals who were perpetrators of, or accomplices in, unsolved civil rights murders; and (3) comply with Freedom of Information Act requests. In investigating a complaint, DOJ may coordinate activities with entities that DOJ determines to be appropriate. DOJ shall reopen and review cases closed without an in-person investigation conducted by DOJ or the FBI. DOJ must establish a task force to conduct a thorough investigation of Emmett Till Act cases. In an annual report to Congress, DOJ must indicate: (1) the number of cases referred by a civil rights organization, an institution of higher education, or a state or local law enforcement agency; (2) the number of such cases that resulted in federal charges; (3) the date any such charges were filed; (4) whether DOJ has declined to prosecute or participate in an investigation of a referred case; and (5) any activity on reopened cases. DOJ may award grants to civil rights organizations, institutions of higher education, and other eligible entities for expenses associated with investigating offenses under the Emmett Till Act.

Gender Advancement in Pay Act or the GAP Act This bill amends the Fair Labor Standards Act of 1938 to expand exceptions to the prohibition against sex discrimination to include payments pursuant to a differential based on expertise, shift, or a business-related factor other than sex, including but not limited to education, training, or experience. The statute of limitations under the Portal-to-Portal Act of 1947 for a charge of prohibited sex discrimination, or an action by or on behalf of an employee for such discrimination, shall be tolled until the earlier of: (1) the date on which the Equal Employment Commission or the Department of Justice brings an action or notifies the employee concerned with respect to the charge under the Civil Rights Act of 1964, or (2) 270 days after the charge is filed. Nonretaliation prohibitions are extended to cover inquiring about, discussing, or disclosing the wages of an employee or of another employee, or declining to discuss or disclose the employee's wages, with specified exceptions. An employer shall be considered to have committed an unlawful act if the employer requires an employee to sign a contract or waiver that would prohibit the employee from disclosing information about the employee's wages. Civil penalties are established for violation of prohibitions against sex discrimination. The Department of Labor, together with the Department of Education, shall conduct a multistate study, through a grant to a nonprofit research institution, that includes strategies to increase the participation of women in high-wage, high-demand occupations and industries in which women are underrepresented. The Government Accountability Office shall also conduct a multistate study to develop such strategies.

Preventing Iran's Access to United States Dollars Act of 2016 This bill prohibits the President from issuing a license that permits a person to: conduct an offshore U.S. dollar clearing system for transactions involving the government of Iran or an Iranian person, or provide U.S. dollars for any offshore U.S. dollar clearing system conducted by a foreign government or a foreign financial institution for transactions involving the government of Iran or an Iranian person. The Department of the Treasury shall report to Congress: a list of financial institutions operating or participating in an offshore U.S. dollar clearing system that conducts transactions involving the government of Iran or an Iranian person, and an assessment of Treasury efforts to prevent such transactions. The President shall block and prohibit all transactions in property and property interests of any listed institution if the property and interests: (1) are in the United States, (2) come within the United States, or (3) are or come within the possession or control of a U.S. person. The President may impose additional sanctions pursuant to the International Emergency Economic Powers Act. The National Defense Authorization Act for Fiscal Year 2012 is amended to subject to sanctions: (1) u-turn transactions (fund transfers from a foreign bank that pass through a U.S. financial institution and are then transferred to a second foreign bank), and (2) book transfers (fund transfers for the benefit of an Iranian financial institution made between accounts of the same financial institution).

Charities Helping Americans Regularly Throughout the Year Act This bill amends the Internal Revenue Code to modify several tax provisions affecting charitable contributions and tax-exempt organizations. The bill excludes from the gross income of an individual who is at least 70-1/2 years of age up to $100,000 in distributions from an individual retirement plan to a donor-advised fund (DAF). (A DAF is a fund or account that is separately identified by reference to contributions of a donor or donors. The account is owned and controlled by a sponsoring charitable organization, while the donor retains advisory privileges with respect to the distribution and investment of funds in the account.) Sponsors of DAFs must disclose in their returns specified details regarding: (1) policies on inactive or dormant funds, and (2) average aggregate contributions to and grants made from the funds during the most recent three-year period. The bill reduces from 2% to 1% the excise tax on the investment income of private foundations and eliminates a provision that reduces the rate to 1% if a foundation meets certain distribution requirements. Tax-exempt organizations must file their returns in electronic form, and the Internal Revenue Service (IRS) must make the returns available to the public in a machine readable format as soon as practicable. The IRS may delay the requirement for up to two years for certain small organizations. The IRS may determine the standard mileage rate for deducting the cost of using a passenger automobile for charitable purposes (currently set by statute at 14 cents per mile), and the rate may not be less than the rate for medical purposes (19 cents per mile for 2016). The bill exempts certain philanthropic business holdings from the tax on excess business holdings of private foundations if a foundation meets requirements for exclusive ownership, donating all profits to charity, and independent operation.

Advancing NIH Strategic Planning and Representation in Medical Research Act This bill amends the Public Health Service Act to require the National Institutes of Health (NIH) to: publish a strategic plan that addresses research, training, the biomedical workforce, and collaboration with other agencies; foster collaboration among certain clinical research projects to increase the number and diversity of human subjects; encourage improvement in research related to the health of sexual and gender minority populations; convene a working group to make recommendations to enhance the rigor and reproducibility of NIH-funded research; and develop policies for NIH-funded basic research projects to assess how differences between male and female cells, tissues, or animals may be examined and analyzed. In assessing research priorities, the NIH must publish data on clinical research study populations. The strategic plans of the national research institutes must ensure that future activities take into account women and minorities and are focused on reducing health disparities. Advisory council reports must include certain demographic data for clinical research subjects. The results of clinical trials that include women and minorities must be submitted to the NIH’s clinical trial data bank. The National Institute on Minority Health and Health Disparities may foster partnerships between national research institutes and encourage the funding of collaborative research projects. The Department of Health and Human Services must establish the Task Force on Research Specific to Pregnant Women and Lactating Women to report on issues including development of safe and effective therapies for such women.

Palliative Care and Hospice Education and Training Act

Palliative Care and Hospice Education and Training Act This bill amends the Public Health Service Act to require the Department of Health and Human Services (HHS) to award grants or contracts for Palliative Care and Hospice Education Centers. These Centers must improve the training of health professionals in palliative care and establish traineeships for individuals preparing for advanced education nursing degrees, social work degrees, or advanced degrees in physician assistant studies in palliative care. HHS may make grants to, and enter into contracts with, schools of medicine, schools of osteopathic medicine, teaching hospitals, and graduate medical education programs to support the training of physicians who plan to teach palliative medicine. HHS must: (1) provide Palliative Medicine and Hospice Academic Career Awards to individuals to promote their career development; (2) award grants or contracts to entities that operate a Palliative Care and Hospice Education Center; (3) award incentive grants or contracts to advanced practice nurses, social workers, physician assistants, pharmacists, chaplains, or students of psychology pursuing an advanced degree in palliative care or related fields; and (4) award grants to schools of nursing, health care facilities, or programs leading to certification as a nurse assistant to train individuals in providing palliative care. The Agency for Healthcare Research and Quality must provide for a national education and awareness campaign to inform patients, families, and health professionals about the benefits of palliative care. The National Institutes of Health must expand national research programs in palliative care.
