National Uniformity for Food Act of 2005 - Amends the Federal Food, Drug, and Cosmetic Act (FFDCA) to prohibit any state or political subdivision from establishing or continuing in effect for any food in interstate commerce: (1) any requirement that is not identical to specified FFDCA provisions (that would result in materially different requirements), including those related to adulterated foods, unsafe food additives, and new animal drugs; or (2) any notification requirement that provides for a warning concerning the food's safety that is not identical to FFDCA provisions. Allows a state to petition for an exemption or to establish a national standard regarding any requirement under FFDCA or the Fair Packaging and Labeling Act relating to food regulation. Allows the Secretary of Health and Human Service to provide such an exemption if the requirement: (1) protects an important public interest that would otherwise be unprotected; (2) would not cause any food to be in violation of any federal law; and (3) would not unduly burden interstate commerce. Allows a state to establish a requirement that would otherwise violate FFDCA provisions relating to national uniform nutrition labeling or this Act if the requirement is needed to address an imminent hazard to health that is likely to result in serious adverse health consequences and if other requirements are met. Declares that this Act does not preempt certain state and local laws relating to labeling or a consumer advisory relating to food sanitation imposed on a food establishment or recommended by the Secretary.

Advocates Dedicated to Older Child Parental Tax Credit (ADOPT) Act of 2005 - Amends the Internal Revenue Code to allow a $2,000 tax credit for costs associated with the adoption of a child who has reached nine years of age before the adoption decree becomes final. Allows the credit each year until such child attains the age of 19.

Railroad Security and Public Awareness Act of 2005 - Directs the Secretary of Homeland Security to develop and issue detailed guidance for a rail worker security training program to prepare front-line workers for potential threat conditions. Requires railroad carriers to develop a rail worker security training program that meets the Secretary's approval. Directs the Secretary to develop a national plan for public outreach and awareness of measures that the general public, railroad passengers, and railroad employees can take to increase railroad security. Authorizes the Secretary to make grants to railroads (including intercity, heavy, and light rail), hazardous materials shippers, owners of hazardous materials rail cars, universities, colleges, and research centers, and state and local governments (for railroad facilities and infrastructure) for full or partial reimbursement of: (1) rail worker security training program costs; and (2) security upgrade costs incurred by a railroad to prevent or respond to acts of terrorism, sabotage, or other railroad security threats. Directs the Secretary to: (1) develop timelines for completing the Department of Homeland Security's (DHS) framework for analyzing risks to the U.S. rail system and other transportation sectors; (2) evaluate whether the risk assessment used by the Office for Domestic Preparedness should be leveraged to facilitate the completion of such risk assessments; (3) set timelines for completing the memorandum of understanding (MOU) modal agreements for rail, mass transit, and research and development (R&D), which DHS and the Department of Transportation (DOT) have agreed to pursue; (4) develop and issue rail security standards, including a plan for how Transportation Security Administration (TSA) rail inspectors will be used to enforce such standards; and (5) study select foreign rail security practices, including the cost of implementing selected best practices not currently used in the United States.

Food Allergy and Anaphylaxis Management Act of 2005 - Requires the Secretary of Health and Human Services to develop and make available to local educational agencies a voluntary policy to manage the risk of food allergy and anaphylaxis in schools. Directs that such policy address: (1) a parental obligation to provide the school with information regarding a student's food allergy and anaphylaxis; (2) communication strategies between schools and emergency medical services; (3) strategies to reduce the risk of exposure in classrooms and common areas; (4) food allergy management training of school personnel; (5) authorization of school personnel to administer epinephrine when the school nurse is not immediately available; and (6) creation of an individual health care plan tailored to each child's risk for anaphylaxis.

Recognizes the people of the Republic of Albania on the 60th anniversary of the end of World War II for saving the lives of the majority of Jews, both native and refugee, living in Albania during the Holocaust. Encourages other countries to recognize those Albanians who took action to protect Jews during World War II. Reiterates support for close ties between the United States and Albania.

Commends the people of Hungary as they mark the 50th anniversary of the 1956 Hungarian Revolution. Expresses condolences to the people of Hungary for those who lost their lives fighting for Hungarian freedom in 1956, as well as for those subsequently executed by the Soviet and Hungarian communist authorities, including Prime Minister Imre Nagy. Welcomes the changes that have taken place in Hungary since 1989, believing that Hungary's integration into the North Atlantic Treaty Organization (NATO) and the European Union (EU), together with similar developments in the neighboring countries, will ensure peace and understanding among the peoples of the Carpathian Basin. Reaffirms the friendship between the governments of Hungary and the United States and between the Hungarian and American people.

Recognizes the 40th anniversary of the Second Vatican Council's Declaration on the Relation of the Church to Non-Christian Religions, Nostra Aetate. Expresses support for the new collaborative relationship that has grown between Jews and Roman Catholics. Requests the President to: (1) issue a proclamation recognizing the 40th anniversary of the Nostra Aetate; and (2) exert U.S. leadership toward ensuring that anti-Semitism and all forms of religious and racial bigotry are not tolerated worldwide.

Downed Animal Protection Act - States that it is U.S. policy that all nonambulatory livestock in interstate and foreign commerce be immediately and humanely euthanized when such livestock become nonambulatory. Amends the Humane Methods of Slaughter Act of 1958 to direct the Secretary of Agriculture to promulgate regulations providing for the humane treatment, handling, and disposition of nonambulatory livestock by a covered entity, including a requirement that nonambulatory livestock be humanely euthanized. Requires an entity to: (1) humanely euthanize nonambulatory livestock (while not limiting the Secretary's ability to test nonambulatory livestock for disease, such as bovine spongiform encephalopathy); and (2) not move nonambulatory livestock while such livestock is conscious, and ensure that such livestock remains unconscious until death. Prohibits an inspector at an establishment covered by the Federal Meat Inspection Act to pass nonambulatory livestock, carcass, or carcass parts through inspection. Requires an inspector or other employee at such establishment to label such material as "inspected and condemned." Defines "covered entity," "nonambulatory livestock," and "humanely euthanize."

Suburban and Community Forestry and Open Space Program Act of 2005 - Amends the Cooperative Forestry Assistance Act of 1978 to establish in the Forest Service the Suburban and Community Forestry and Open Space Program, which shall provide cost-share grants to preserve private forest land, contain suburban sprawl, and support value-added forest product industries in States in which less than 25 percent of the land is owned by the United States.

Microbicide Development Act - Amends the Public Health Service Act to require the Director of the Office of AIDS Research to: (1) expedite the implementation of the Federal strategic plan for the conduct and support of microbicide research; and (2) expand, intensify, and coordinate all activities with respect to research and development of microbicides to prevent the transmission of HIV and other sexually transmitted diseases. Requires the Director of the National Institute of Allergy and Infectious Diseases to: (1) establish within the Division of AIDS an organizational unit to carry out microbicide research and development; and (2) assign priority to ensuring adequate funding and support for the integration of basic science and clinical research. Requires the Director of the Centers for Disease Control and Prevention (CDC) to fully implement the CDC's topical microbicide agenda to support microbicide research and development. Directs the head of the Office of HIV/AIDS of the U.S. Agency for International Development (USAID) to develop and implement a program to support the development of microbicides products and facilitate wide-scale availability of such products.

Fuel Supply Improvement Act of 2005 - Prescribes guidelines to expedite federal permitting procedures for construction or expansion of a domestic petroleum refining facility. Applies such expedited permit procedures exclusively to permits under specified environmental protection statutes. Directs the Secretary of Energy, upon applicant request, to provide direct legal representation to a refining facility applicant to defend against a lawsuit regarding the permit approval procedure, or facility construction or expansion, if the Secretary believes the lawsuit is without merit, is brought solely to delay facility completion, or will have the effect of delaying facility completion in a period when U.S. domestic refining capability is insufficient. Instructs the Secretary to establish an office of regulatory assistance whose sole purpose is to assist applicants with permit applications, planning, and otherwise pursuing the construction or expansion of a domestic petroleum refining facility. Grants the Secretary contracting authority with sponsors of new large-sized petroleum refining facilities. Establishes in the Department of Energy the Refinery Standby Support Program Account and the Refinery Standby Support Grant Account to cover loan costs and costs resulting from certain construction delays. Amends the Clean Air Act to direct the Administrator of the Environmental Protection Agency to provide within new source review regulations that equipment replacement shall be considered routine maintenance and repair if it: (1) does not increase actual emissions of any air pollutant by more than 5%; and (2) does not increase actual emissions of any air pollutant by more than 40 tons per year. Directs the Secretary of the Interior to charge a discounted price in any sale to a qualified small refinery of crude oil obtained by the United States as royalty-in-kind.

Reaffirms Congress's commitment to fighting anti-Semitism and intolerance. Amends federal transportation law to direct the Secretary of Transportation by regulation to prescribe (corporate) average fuel economy (CAFE) standards for automobiles manufactured after 2008 that ensure that the CAFE achieved by automobiles manufactured after 2015 is at least 33 miles per gallon, and meets other specified criteria. Authorizes the Secretary to establish separate standards for different classes of automobiles according to size. Authorizes the Secretary to establish a CAFE credit trading program to allow a manufacturer that exceeds fuel economy standards to sell credits to another manufacturer.

Late Term Abortion Restriction Act - Prohibits knowingly performing an abortion after the fetus has become viable, unless, in the medical judgment of the attending physician, the abortion is necessary to preserve the woman's life or to avert serious adverse health consequences to her. Subjects a physician who violates this Act to a civil penalty.

Special Inspector General for Hurricane Katrina Recovery Act - Establishes the Office of the Special Inspector General for Hurricane Katrina Recovery. Places at the head of such Office a Special Inspector General for Hurricane Katrina Recovery, who shall be appointed by the Secretary of Homeland Security. Provides for the Special Inspector General to report directly to the Secretaries of Homeland Security and Defense. Requires the Special Inspector General, among other specified duties, to conduct, supervise, and coordinate audits and investigations of the treatment, handling, and expenditure of amounts made available for Hurricane Katrina recovery by the federal government, and of the programs, operations, and contracts carried out utilizing such funds. Instructs the Special Inspector General, within ten days of being appointed, to: (1) open a 24-hour fraud, waste, and abuse hotline; (2) deploy auditors and investigators to the affected Gulf of Mexico region of the United States; (3) announce a strategic plan for oversight; (4) go to the media of that region with antifraud messages; (5) liaise with Hurricane Katrina recovery federal agencies to identify vulnerabilities; and (6) coordinate interagency oversight elements through the creation of a task force. Requires the Special Inspector General to: (1) submit specified quarterly and interim reports summarizing the activities of the Special Inspector General and the Hurricane Katrina recovery activities of the federal government; and (2) publish such reports on the websites of the Secretaries of Homeland Security and Defense.

Life Insurance Fairness for Travelers Act of 2005 - Amends the Terrorism Risk Insurance Act of 2002 to make it unlawful for any insurer to: (1) deny any person life insurance, or to otherwise discriminate in the issuance, cancellation, amount of coverage, or conditions of life insurance, based upon the person's intent to engage in future lawful foreign travel; and (2) charge rates for life insurance which are excessive or unfairly discriminatory in relation to the actuarial risk associated with future lawful foreign travel of such person. Provides for administrative enforcement of this Act by either: (1) the chief law enforcement officer of a state, or an official or agency designated by a state; or (2) the Secretary of the Treasury.

American Heroes Act - Authorizes each state to provide one statue of an individual representing that state to be displayed in the Capitol Visitor Center. Specifies criteria for such statues. Requires the Clerk of the House of Representatives and the Secretary of the Senate to assign jointly to one of their employees the post of the American Hero Administrator to prepare statue guidelines. Requires: (1) a state to establish an American Hero Commission to select the individual to represent that state; and (2) the Architect of the Capitol to procure and install a statue honoring the passengers of United Airlines flight number 93 who died on September 11, 2001, for their heroic role in protecting Washington, D.C. from attack.

Gun Show Loophole Closing Act of 2005 - Amends the federal criminal code to provide for regulation of firearms transfers at special firearms events (events at which 75 or more firearms are offered or exhibited for sale, exchange, or transfer if one or more of the firearms has been shipped or transported in, or otherwise affects, interstate or foreign commerce, excluding an offer or exhibit of firearms: (1) by an individual, from that individual's personal collection, at that individual's private residence, if the individual is not required to be licensed; and (2) at events conducted and attended by permanent or annual dues paying members of private, not-for-profit organizations whose primary purpose is owning and maintaining real property for hunting activities). Prohibits any person from operating a special firearms event without notifying the Attorney General. Sets forth: (1) responsibilities of special firearms events operators and of firearms licensees and transferors other than licensees at such events, including with regard to criminal background checks; (2) special firearms event license application requirements; and (3) penalties for violation of this Act. Authorizes a state to apply to the Attorney General for, and sets forth criteria for, certification of the 24-hour verification authority of that state with respect to criminal background checks. Increases penalties for: (1) serious record keeping violations by licensees; and (2) violations of criminal background check requirements.

National Forest Roadless Area Conservation Act - Identifies roadless areas within the National Forest System set forth in specified maps as National Forest Inventoried Roadless Areas, and directs the Secretary of Agriculture to manage such Areas to maintain their roadless character. Authorizes the Forest Service to modify such maps for the sole purpose of improving their accuracy or inclusiveness. Requires any substantial modification of those maps to be made through the national forest management planning process and documented in an environmental impact statement.

Help Efficient, Accessible, Low Cost, Timely Healthcare (HEALTH) Act of 2005 -Sets forth provisions regulating lawsuits for health care liability claims concerning the provision of health care goods or services or any medical product affecting interstate commerce. Sets a statute of limitations of three years after the date of manifestation of injury or one year after the claimant discovers the injury, with certain exceptions. Provides that nothing in this Act limits recovery of the full amount of available economic damages. Limits noneconomic damages to $250,000. Makes each party liable only for the amount of damages directly proportional to such party's percentage of responsibility. Allows the court to restrict the payment of attorney contingency fees. Limits the fees to a decreasing percentage based on the increasing value of the amount awarded. Prescribes qualifications for expert witnesses. Allows the introduction of collateral source benefits and the amount paid to secure such benefits as evidence. Prohibits a provider of such benefits from recovering any amount from an award in a health care lawsuit involving injury or wrongful death. Authorizes the award of punitive damages only where: (1) it is proven by clear and convincing evidence that a person acted with malicious intent to injure the claimant or deliberately failed to avoid unnecessary injury the claimant was substantially certain to suffer; and (2) compensatory damages are awarded. Limits punitive damages to the greater of two times the amount of economic damages or $250,000. Limits the liability of manufacturers, distributors, suppliers, and providers of medical products that comply with Food and Drug Administration (FDA) standards. Provides for periodic payments of future damage awards.

South Caucasus Integration and Open Railroads Act of 2005 - Prohibits U.S. assistance to develop or promote rail connections or railway-related connections that do not traverse or connect with Armenia, and do traverse or connect Baku, Azerbaijan; Tbilisi, Georgia; and Kars, Turkey.

States that: (1) it is U.S. policy to seek justice for American victims of terrorism and to hold terrorists and their state-sponsors accountable for their actions; and (2) any provision of the Algiers Accords, entered into with Iran on January 19, 1981, that purports to bar a U.S. citizen from prosecuting any claim in any U.S. court or to limit the jurisdiction of any U.S. court is hereby abrogated and deemed nonapplicable. Directs the the Secretary of the Treasury to begin payments to a common fund to be: (1) established and administered by the certified class representatives for the former American hostages in Iran and their survivors (case number 1:00CV03110 (EGS) of the U.S. District Court for the District of Columbia); and (2) funded from the liquidation of blocked Iranian assets and from amounts in the Iran Foreign Military Sales Fund account (Foreign Military Sales Fund). Sets forth fund payment amounts for each former hostage and spouse and child identified as a class member.

Congratulates Ambassador Dan Gillerman, Israel's Permanent Representative to the United Nations, and the government and people of Israel on Israel's election as Vice-President of the 60th General Assembly of the United Nations. Supports continued expansion of Israel's U.N. role. Notes that Israel: (1) remains the object of vilification by many U.N. members; and (2) remains excluded from the U.N. Asian regional grouping. Calls upon U.N. Secretary-General Kofi Annan to work to end Israel's vilification at the United Nations and to use his good offices to support Israel's bid to join the Asian regional grouping.

Constitutional Amendment - Prohibits outlays for a fiscal year (except those for repayment of debt principal) from exceeding total receipts for that fiscal year (except those derived from borrowing) unless Congress, by a three-fifths rollcall vote of each House, authorizes a specific excess of outlays over receipts. Requires a three-fifths rollcall vote of each House to increase the public debt limit. Directs the President to submit a balanced budget to Congress annually. Prohibits any bill to increase revenue from becoming law unless approved by a majority of each House by rollcall vote. Authorizes waivers of these provisions when a declaration of war is in effect or under other specified circumstances involving military conflict.

Lifespan Respite Care Act of 2005 - Amends the Public Health Service Act to authorize the Secretary of Health and Human Services to award grants or cooperative agreements to an agency, organization, or political subdivision to: (1) develop lifespan respite care at the state and local level; (2) provide respite care services for family caregivers caring for children or adults; (3) train and recruit respite care workers and volunteers; (4) provide information to caregivers about available respite or support services; and (5) assist caregivers in gaining access to such services. Defines "respite care" to mean planned or emergency care provided to a child or adult with a special need in order to provide temporary relief to the family caregiver. Instructs the Secretary to work cooperatively with existing federal respite program officers to ensure coordination of services for family caregivers. Permits the use of funds for: (1) training programs for family caregivers; (2) other services essential to the provision of respite care; or (3) training and education for new caregivers. Limits grants to five years. Directs the Secretary to award a grant or cooperative agreement to a public or private nonprofit entity to establish the National Resource Center on Lifespan Respite Care to: (1) maintain a national database on lifespan respite care; (2) provide training and technical assistance to state, community, and nonprofit respite care programs; and (3) provide information, referral, and educational programs to the public on lifespan respite care.

Darfur Peace and Accountability Act of 2005 - Sets forth the sense of Congress with respect to the situation in Darfur, Sudan, including the sense of Congress that the atrocities unfolding in Darfur are genocide. Amends the Comprehensive Peace in Sudan Act of 2004 to direct the President, with waiver authority upon congressional notification, to block the assets and deny visas and entry to any individual (and family member) responsible for acts of genocide, war crimes, or crimes against humanity in Sudan. Authorizes the President to provide assistance to reinforce the deployment and operations of an expanded African Union Mission in Sudan (AMIS). Directs the President to instruct the U.S. Permanent Representative to the North Atlantic Treaty Organization (NATO) to advocate NATO reinforcement of AMIS, upon request of the African Union. Amends the Sudan Peace Act to include entry denial at U.S. ports to certain cargo ships or oil tankers among the measures available to the President if the government of Sudan fails to take specified peace measures in Darfur. Prohibits, with waiver authority, U.S. assistance to a country in violation of U.N. Security Council Resolutions 1556 and 1591(embargo on military assistance to Sudan). Directs the President to instruct the U.S. Permanent Representative to the United Nations to urge the adoption of a Security Council resolution supporting AMIS' expansion.

Private Property Rights Protection Act of 2005 - Prohibits a state or political subdivision from using economic development as a reason for exercising its power of eminent domain if federal funds would contribute in any way to: (1) the project for which eminent domain is exercised; or (2) the exercise and enforcement of eminent domain over the project. Renders a state or political subdivision that violations this prohibition ineligible for any such federal funds and directs the federal agency involved to withhold those funds. Prohibits the federal government from using economic development as a reason for exercising eminent domain. Defines "economic development" to mean any activity other than making private property available in substantial part for use by the general public or by an entity that makes the property available for use by the general public, or as a public facility, or to remove harmful effects.

Joint Administrative Procedures Committee Act of 2005 or JACP Act - Establishes a Joint Administrative Procedures Committee in the Congress to: (1) selectively review existing major rules of any federal agency; and (2) recommend to the congressional committees of jurisdiction that they take appropriate legislative action to amend or repeal laws within their jurisdictions sufficient to effectuate its recommendations and to such federal agency that it amend or repeal all or any part of such major rules. Requires the Joint Administrative Committee to periodically review the regulatory plan of each federal agency of its most important significant regulatory actions that the agency reasonably expects to issue in proposed or final form to the Office of Information and Regulatory Affairs of the Office of Management and Budget.

Mandatory IDEA Full Funding Compromise Act - Amends the Individuals with Disabilities Education Act (IDEA) to reauthorize part B programs of education of all children with disabilities. Authorizes appropriations in specified amounts for part B for FY2006-FY2012 and thereafter, according to a certain formula. (Provides phased-in increases of such authorized funding designed to reach a promised 40% federal share by FY2011.) Makes appropriations in specified amounts (which are less than the amounts this Act authorizes to be appropriated) for part B for FY2006-FY2012 and thereafter.

Community Restoration and Revitalization Act of 2005 - Amends the Internal Revenue Code to: (1) allow an increased rehabilitation tax credit for certain low-income buildings; (2) allow a basis reduction adjustment for property eligible for the credit; (3) increase the credit for certain smaller buildings; (4) allow property eligible for the credit to be used for lodging purposes; (5) modify placed-in-service rules for credit property; (6) modify qualification rules for credit property that is tax-exempt use property; (7) increase the credit for buildings in high cost areas; and (8) exempt certain condominium transactions from rehabilitation tax credit recapture requirements.

Religious Freedom and Respect in the Armed Forces Commission Act - Establishes the Commission on Religious Freedom and Respect in the Armed Forces to: (1) assess religious freedom, and respect and tolerance for the diversity of spiritual values, in the Armed Forces; and (2) report findings to the President and Congress.

Amends the Harmonized Tariff Schedule of the United States to suspend, through December 31, 2008, the duty on certain decorative plates, decorative sculptures, decorative plaques, and architectural miniatures.

Directs the Bureau of Customs and Border Protection to: (1) liquidate or reliquidate certain entries of roller chains without assessment of antidumping duties or interest; and (2) refund any amounts owed.
