Guidance Clarity Act of 2020 This bill requires federal agencies to state on the first page of guidance documents that such guidance (1) does not have the force and effect of law, and (2) is intended only to provide clarity to the public about existing legal requirements or agency policies. Excluded from this requirement is guidance directed to the issuing agency or other agency that is not intended to have a substantial effect on the behavior of regulated parties, as well as internal executive branch legal advice or opinions addressed to executive branch officials.

Woman's Right To Know Act This bill specifies requirements for informed consent that health care providers must obtain before performing an abortion procedure. Providers must present a woman seeking an abortion with an authorization form at least 24 hours before performing the procedure. The form must (1) include specified information concerning gestational age, associated developmental characteristics, and medical risks; (2) disclose penalties that providers may face for failing to obtain the requisite informed consent; and (3) include an affirmation that the individual signing the form understands the information. The form must be signed and witnessed in person and retained in the medical file. Providers do not have to obtain such consent if, in reasonable medical judgment, obtaining it would pose a greater risk of death or substantial physical impairment of a major bodily function, excluding psychological or emotional conditions, of the pregnant woman. The bill also establishes civil penalties for providers who do not comply with these requirements.

Comprehensive Immunosuppressive Drug Coverage for Kidney Transplant Patients Act of 2020 This bill indefinitely extends Medicare coverage of immunosuppressive drugs for kidney transplant recipients for individuals who do not have other coverage. Under current law, Medicare coverage is limited to 36 months following a transplant. Additionally, the Government Accountability Office must report on the bill's implementation, including any related program integrity issues.

Accelerate Long-term Investment Growth Now Act or the ALIGN Act This bill makes permanent the expensing of certain new business equipment. Expensing allows the deduction of the full amount of an expense item in the same taxable year.

CFO Vision Act of 2020 This bill establishes or modifies provisions to provide for standardized government-wide financial management requirements. Each agency Chief Financial Officer must oversee and provide leadership in the areas of budget formulation and execution, planning and performance, risk management, internal controls, financial systems, and accounting. The bill requires the government-wide financial management plan to include actions for improving financial management systems, strengthening the federal financial management workforce, and linking performance and cost information to budget decision-making. The bill requires (1) the development of financial management performance-based metrics, and (2) an assessment of performance by such metrics to be included in the government-wide and agency-level financial management plans and status reports.

Hazard Eligibility and Local Projects Act This bill makes an entity seeking assistance under a hazard mitigation assistance program eligible to receive such assistance for certain projects already in progress.

Pain-Capable Unborn Child Protection Act This bill establishes a new criminal offense for performing or attempting to perform an abortion if the probable post-fertilization age of the fetus is 20 weeks or more. A violator is subject to criminal penalties—a fine, a prison term of up to five years, or both. The bill provides exceptions for an abortion (1) that is necessary to save the life of the pregnant woman, or (2) when the pregnancy is the result of rape or incest. A physician who performs or attempts to perform an abortion under an exception must comply with specified requirements. A woman who undergoes a prohibited abortion may not be prosecuted for violating or conspiring to violate the provisions of this bill.

Protecting Life in Foreign Assistance Act This bill prohibits the use of federal funds for purposes outside the United States related to abortion. Specifically, the bill prohibits funding to certain foreign or domestic organizations that perform or promote abortions, furnish or develop items intended to procure abortions, or provide financial support for an entity that conducts such activities. Current U.S. policy prohibits the provision of federal funds to a foreign nongovernmental organization unless it agrees to not perform or actively promote abortions.

Teleabortion Prevention Act of 2020 This bill restricts the use of telehealth for chemical abortions (also known as medication abortions). Specifically, it requires a provider who dispenses or prescribes medication for a chemical abortion to physically examine the patient, be physically present at the location of the chemical abortion, and schedule a follow-up visit. The bill provides an exception for a chemical abortion that is necessary to save the life of a mother whose life is endangered by a physical disorder, illness, injury, or condition. The bill establishes criminal penalties—a fine, a prison term of up to two years, or both—for a provider who does not comply with the requirements. A patient who undergoes a chemical abortion may not be prosecuted.

This concurrent resolution calls for honoring the 234th anniversary of the enactment of the Virginia Statute for Religious Freedom on Religious Freedom Day, January 16, 2020. The resolution affirms that religious freedom includes the right of individuals of any faith and individuals of no faith to live, work, associate, and worship in accordance with their beliefs; all people of the United States can be unified in supporting religious freedom because it is a fundamental human right; and the American people will remain forever unshackled in matters of faith.

Advanced Manufacturing Jobs in America Act This bill requires the Department of Labor to establish demonstration and pilot projects, through the awarding of grants or contracts, to facilitate training and education in advanced manufacturing. A local educational entity (e.g., technical college, community college, or an entity that assists educationally underserved communities) in partnership with a manufacturer that employs individuals who have advanced manufacturing skills is eligible to receive such grants or contracts. The corresponding project must (1) develop skills and competencies in communities with expected growth in advanced manufacturing; (2) provide education and training for available and anticipated jobs in advanced manufacturing; (3) educate individuals about career advancement opportunities within advanced manufacturing; and (4) give priority to incumbent workers, dislocated workers, and unemployed individuals.

Bogus Bonus Ban Act of 2020 This bill directs the Office of Management and Budget, in coordination with federal departments and agencies, to issue guidance, with detailed implementation instructions, on the appropriate use of award and incentive fees in department or agency programs. The guidance shall, among other things ensure that all new contracts using award fees link such fees to outcomes (which shall be defined in terms of program cost, schedule, and performance); establish criteria for identifying the appropriate level of officials authorized to approve the use of award and incentive fees in new contracts; ensure that no award fee may be paid for contractor performance that is judged to be below satisfactory performance or performance that does not meet the basic requirements of the contract; and provide for the development of performance measures to evaluate the effectiveness of award and incentive fees as a tool for improving contractor performance and achieving desired program outcomes. Any funds intended to be awarded as incentive fees that are not paid due to the inability of a contractor to meet the criteria established by this bill shall be deobligated and made available for purposes for which the funds are otherwise allowable. The Department of the Treasury shall include award fee as a filter on USAspending.gov.

This resolution condemns the violence by the Iranian government against protesting Iranian citizens and demands that Iranian leadership be held accountable for its actions against these protestors. Further, it affirms that the Senate stands with the people of Iran and calls on all peaceful and law-abiding nations to support the protests by the Iranian people.

United States-Israel Security Assistance Authorization Act of 2020 This bill provides for security assistance to Israel and authorizes actions to further U.S.-Israel cooperation. Specifically, under the Foreign Military Financing Program, the bill makes no less than $3.3 billion annually available to Israel through FY2028. The bill also extends through FY2025 (1) authority to stockpile war reserves in Israel, and (2) loan guarantees to Israel for up to $9 billion. The President is authorized to transfer munitions from reserve stocks to Israel for its self-defense. Further, the President must report on steps to include Israel in the list of countries eligible for the strategic trade authorization exception, which authorizes exports, reexports, and in-country transfers in lieu of a license that would otherwise be required. Lastly, the President must establish and update contingency plans to provide Israel with defense articles and services necessary for its defense. The Department of State is authorized to (1) enter into memoranda of understanding with Israel with a focus on strengthening mutual ties and cooperation with nations throughout the world; and (2) establish a program between the United States, Israel, and other countries or territories to provide for cooperation in the Middle East region by financing and cooperating in programs related to innovation and advanced technologies. Further, the United States is authorized to enter into cooperative agreements with Israel and developing countries to identify and support local solutions for addressing sustainability challenges. The Department of Defense is authorized to carry out activities with Israel to establish directed energy capabilities that address threats to the United States, deployed forces of the United States, or Israel.

Strengthening Oversight for Veterans Act of 2020 This bill gives the Department of Veterans Affairs Office of Inspector General (VA OIG) the authority to subpoena the attendance and testimony of witnesses as necessary to carry out the duties of the office. The bill prohibits the VA OIG from subpoenaing the attendance and testimony of current federal employees. Under the bill, the VA OIG must notify the Department of Justice (DOJ) and the intended witness of the intent to issue a subpoena. If DOJ objects to the subpoena because it will interfere with an ongoing investigation, the VA OIG may not issue the subpoena.

This resolution calls on the President and the Department of State to (1) make the repeal of blasphemy, heresy, and apostasy laws a priority in bilateral relationships between the United States and countries that have such laws; (2) designate countries that enforce such laws as countries of particular concern for religious freedom; and (3) oppose efforts by the United Nations to implement an international anti-blasphemy norm. The resolution also calls on the governments of countries that enforce such laws to amend or repeal them and to release anyone imprisoned pursuant to them.

Stopping Overdoses of Fentanyl Analogues Act This bill adds five fentanyl analogues and the entire category of fentanyl-related substances to schedule I of the Controlled Substances Act. A schedule I controlled substance is a drug, substance, or chemical that has a high potential for abuse; has no currently accepted medical value; and is subject to regulatory controls and administrative, civil, and criminal penalties under the Controlled Substances Act.

Lawful Interstate Transportation of Firearms Act This bill revises criminal provisions related to the interstate transportation of firearms and ammunition. An individual may transport a firearm between two places (e.g., states) where it is legal to possess, carry, or transport the firearm. During transport, the firearm must be unloaded and secured or securely stored. Additionally, an individual may transport ammunition, or a detachable magazine or feeding device, between two places where it is legal to possess, carry, or transport the ammunition, magazine, or feeding device. During transport, the ammunition, magazine, or feeding device must not be loaded into a firearm and must be securely stored. The term transport includes staying in temporary lodging overnight; stopping for food, fuel, vehicle maintenance, an emergency, or medical treatment; and any other activities that are incidental to the transportation. The bill prohibits the arrest or detention of an individual for a state or local firearm or ammunition violation unless there is probable cause to believe the individual failed to comply with the provisions of this bill.

Parental Accessibility Rights for Emergency and Negligent Treatment Act This bill expands the scope of advance directive policies and related disclosures for providers under Medicaid and the Children's Health Insurance Program (CHIP). Specifically, providers (e.g., hospitals, hospice programs, and home health care providers) must have advance directive policies for minors (rather than only adults) and must disclose such policies on the provider's website and upon request. Providers must also disclose information regarding (1) an individual's rights with respect to life-sustaining procedures, including hydration and sustenance; and (2) whether parental consent is required to provide, withdraw, or deny life-sustaining procedures, or to institute a do-not-resuscitate order, for a minor.

This bill reorganizes the Department of Veterans Affairs (VA) Chaplain Service, allows chaplains to provide clinical services, and prohibits the VA from requiring chaplains to perform any rite, ritual, or ceremony that is contrary to their conscience, moral principles, or religious beliefs.

Rural Hospital Closure Relief Act of 2019 This bill allows additional hospitals to qualify as critical access hospitals (CAHs) that receive special payment under Medicare. Currently, in order to qualify as a CAH under Medicare, a hospital must either (1) be located more than 35 miles (or 15 miles in mountainous regions or areas with only secondary roads) from another hospital, or (2) have been certified prior to January 1, 2006, by the state as a necessary provider of services in the area. The bill allows a hospital to also qualify if the hospital is a small, rural hospital that (1) serves a health professional shortage area, or a high number of low-income individuals or Medicare or Medicaid beneficiaries; (2) has experienced financial losses for two consecutive years; and (3) attests to having a strategic plan to address financial solvency.

Support And Value Expectant Moms and Babies Act of 2019 or the SAVE Moms and Babies Act of 2019 This bill prohibits the Food and Drug Administration (FDA) from approving any new drug (either as a brand-name drug or a generic) intended to terminate a pregnancy and imposes additional restrictions on such drugs that are already approved. Under the bill, an already-approved drug intended to terminate a pregnancy may be dispensed to a patient only with a prescription. Furthermore, the FDA may not approve any labeling change that would authorize (1) using the drug after 70 days of gestation, or (2) dispensing the drug by any means other than in-person administration by the prescribing health care practitioner. The FDA must also impose additional restrictions on such already-approved drugs, including by (1) requiring the prescribing health care practitioner to receive a special certification, (2) prohibiting the practitioner to also act as the dispensing pharmacist, and (3) requiring the practitioner to have the ability to provide surgical intervention to the patient. The bill also rescinds any investigational use exemption already granted to such a drug if the bill would have prohibited the FDA from granting the exemption. (Currently, the FDA may grant an exemption to certain market approval requirements if a drug is intended solely for use in safety and effectiveness investigations.)

Non-Opioids Prevent Addiction In the Nation Act or the NOPAIN Act This bill temporarily establishes separate payments for certain non-opioid treatments under the Medicare prospective payment system for hospital outpatient department services and the payment system for ambulatory surgical center services. The bill applies to pain management treatments that are able to replace or reduce opioid consumption, as shown through clinical trials or data.

Ukraine Religious Freedom Support Act This bill directs the President, when determining whether Russia is a country of particular concern for religious freedom under certain federal laws, to consider incidents occurring in the parts of Ukraine controlled by Russia or Russia-affiliated non-state groups. (The United States may take certain actions, such as withdrawing development assistance, against a country of particular concern for religious freedom.)

Student Loan Repayment Freedom Act This bill authorizes a federal student loan borrower to terminate repayment under an income-based repayment plan and instead elect to repay such loan under any other repayment plan for which they are eligible. Currently, a federal student loan borrower repaying under an income-based repayment plan may only change to the standard repayment plan.

Prevent Government Shutdowns Act of 2019 This bill provides continuing appropriations to prevent a government shutdown if any of the appropriations bills for a fiscal year have not been enacted before the fiscal year begins and continuing appropriations are not in effect. The bill also limits official travel, congressional recesses or adjournments, and the consideration of legislation that is unrelated to appropriations after the beginning of a fiscal year if both chambers of Congress have not passed the appropriations bills for the year.

Improving and Reinstating the Monitoring, Prevention, Accountability, Certification, and Transparency Provisions of Opportunity Zones or the IMPACT Act This bill provides statutory authority for annual reporting requirements by qualified opportunity funds and taxpayers investing in such funds and sets forth the information required in the reports. The bill imposes penalties for failure to comply with such reporting requirements. The bill requires the Department of the Treasury to make publicly available annual reports on qualified opportunity funds, including, among other things, the number of such funds and the aggregate amount of assets held in such funds. Treasury must also provide additional information in every fifth year on the impacts and outcomes of a designation of a census tract as a qualified opportunity zone using specified economic indicators. Treasury must also establish procedures to protect against disclosure of return information that can be associated with any particular taxpayer or competitive or proprietary information.

Continuity for Operators with Necessary Training Required for ATC Contract Towers Act of 2019 or the CONTRACT Act of 2019 This bill exempts certain air traffic controllers from a required reduction in their retirement annuity payment on account of earnings from certain work performed while entitled to such annuity. Under current law, retired Federal Aviation Administration air traffic controllers receive an annuity payment during the period between the mandatory retirement age of 56 and the social security minimum age of 62. Such annuity payment is required to be reduced by a certain percentage of any excess earnings during this period. The bill exempts from such reduction in annuity payments an air traffic controller who participates in the Air Traffic Control Contract Program (a public-private partnership for air traffic control services) following mandatory retirement.

This bill modifies the authority of the General Services Administration to enter into building leases to accommodate federal agencies. Specifically, it allows any bargain-price option to purchase at less than fair market value contained in an agreement entered into on or after January 1, 2019, to be exercised only to the extent specifically provided for in subsequent Acts of Congress.

Protect Veterans' Education and Taxpayer Spending Act of 2019 This bill designates certain educational assistance funds as federal educational assistance for the purpose of determining a for-profit institution's revenue sources. Under current law, a for-profit institution must receive at least 10% of its revenue from non-federal sources (known as the 90/10 Rule). Certain federal educational assistance funds provided to students who are servicemembers or veterans are not currently counted as federal sources, which enables a for-profit institution to count those funds towards its 10% requirement. This bill designates such educational assistance funds as federal educational assistance, prohibiting a for-profit institution from counting such funds towards its 10% requirement. In addition, the bill establishes a tiered system of penalties for a school that violates the 90/10 Rule, but it also provides an appeal process that allows a for-profit institution to seek temporary relief from such penalties upon a showing that it meets certain conditions (e.g., offering high-quality academic or job-training programs and placing veterans and servicemembers in jobs after graduation). The bill also requires disclosure—on the Department of Education's College Navigator website and the Department of Veterans Affairs' GI Bill Comparison Tool website—of any for-profit institution that is not in compliance, as well as the applicable sanction on such institution. Lastly, any for-profit institution that converts to nonprofit status shall be subject to the 90/10 Rule for the two-year period after the date of conversion.

National Purple Heart Honor Mission Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue $5 gold coins, $1 silver coins, and half-dollar clad coins emblematic of the mission of the National Purple Heart Honor Mission. The bill limits the issuance of such coins to the one-year period beginning on January 1, 2022. The bill prescribes surcharges for coin sales, which shall be paid to the National Purple Heart Honor Mission, Inc., to support the mission of such organization, including capital improvements to the National Purple Heart Honor Mission facilities.

Bipartisan Congressional Budget Reform Act This bill makes several modifications to the federal budget process, including the procedures for considering congressional budget resolutions and adjusting the debt limit. Among other modifications, the bill includes provisions that require biennial congressional budget resolutions, instead of the annual budget resolutions required under current law; retain the existing annual appropriations process; require a budget resolution to specify a target for the ratio of the debt held by the public to the gross domestic product (GDP) for each year covered by the resolution; require the debt-to-GDP target to be enforced using a mandatory reconciliation process that requires deficit reduction legislation to be considered using expedited legislative procedures; provide for automatic adjustments of the debt limit and statutory discretionary spending limits to conform to the levels in the budget resolution; modify the procedures for considering budget resolutions in the Senate; allow budget resolutions that have bipartisan support and meet specified requirements to be considered in the Senate using expedited procedures; rename the Committee on the Budget of the Senate as the Committee on Fiscal Control and the Budget of the Senate; and expand reporting requirements for congressional committees, the Congressional Budget Office, and the Government Accountability Office.

Harmless Error Lesser Penalty for Small Businesses Act or the HELP for Small Businesses Act This bill prohibits an agency from imposing a civil fine on a small business for a first-time paperwork violation, with the exceptions that the agency may levy a fine for a violation that (1) interferes with the detection of criminal activity; (2) contravenes an internal revenue law; or (3) endangers public health, safety or interest.
