Safe Chemicals Act of 2010

Safe Chemicals Act of 2010 - Amends the Toxic Substances Control Act to direct the Administrator of the Environmental Protection Agency (EPA) to promulgate a rule that establishes: (1) the data that constitute the minimum data set for chemical substances (chemicals) and mixtures, which shall include information on substance characteristics and on the hazard, exposure, and use of such chemicals and mixtures; and (2) requirements for chemical manufacturers and processors to submit and update their minimum data sets. Sets deadlines for the submission of minimum data sets for chemicals placed on the priority list established by this Act and for new chemicals. Authorizes the Administrator to: (1) require the testing of, and the submission of test results for, any chemical or mixture; (2) require submission of a sample of any chemical or substance for testing; and (3) prohibit violators of testing requirements from manufacturing, processing, or distributing chemicals or mixtures. Prohibits any person from manufacturing or processing a new chemical unless the person notifies the Administrator about the person's intention to manufacture or process the chemical and the Administrator finds that the manufacturers and processors have established that the chemical meets the applicable safety standard or that it is not, and is not expected to be: (1) manufactured or released into the environment in excess of specified volumes; (2) a known, probable, or suspected reproductive, developmental, neurological, or immunological toxicant, carcinogen, mutagen, or endocrine disruptor or does not have other toxicological properties of concern; (3) persistent and bioaccumulative; or (4) found in human blood, fluids, tissue, food, drinking water, air, residential soil, or house dust at a level not naturally found in that medium. Prohibits any person from manufacturing or processing existing chemicals for uses that were not ongoing prior to this Act's enactment, at significantly increased volumes, or if the person had not previously manufactured or processed the chemicals, unless the chemicals meet the applicable safety standard and other specified requirements. Requires the Administrator to develop, publish, and update a priority list containing the names of at least 300 chemicals for which safety determinations shall be made first. Makes it the duty of: (1) chemical manufacturers and processors to bear the burden of proving that chemicals meet applicable safety standards; and (2) the Administrator to determine whether such burden has been met. Sets forth provisions concerning: (1) notification of pending safety determinations; (2) requirements for chemicals that meet safety standards; (3) conditions in safety determinations; (4) chemicals or mixtures that may present a substantial endangerment to health or the environment; and (5) polychlorinated biphenyls (PCBs), including prohibiting any person from manufacturing, processing, or distributing PCBs in other than a totally enclosed manner. Prohibits federal agencies from conveying, selling, or distributing elemental mercury. Requires the Administrator to: (1) publish a list that categorizes all chemicals distributed in commerce; (2) establish an Internet-accessible, public database of information on the toxicity of, use of, and exposure to chemicals; (3) establish a Children's Environmental Health Research Program within EPA; (4) minimize the use of animals in testing of chemicals and mixtures; (5) create market incentives for the development of safer alternatives to existing chemicals; and (6) develop and publish action plans to reduce disproportionate exposure to toxic chemicals. Revises provisions concerning the disclosure of data by narrowing the conditions under which data about chemicals may be treated as confidential business information. Authorizes the Administrator to prescribe regulations to carry out the provisions of the Stockholm Convention, the Protocol on Persistent Organic Pollutants to the Convention on Long-Range Transboundary Air Pollution, and the Rotterdam Convention.

Keep Our Educators Working Act of 2010 - Appropriates funds for an Education Jobs Fund. Allocates the bulk of such Fund for grants to states pursuant to a formula that considers each state's share of individuals age 5 through 24 and each state's share of the nation's total population. Authorizes states to reserve a portion of the grant funds for administrative costs and for retaining or creating state education positions. Requires states to use the bulk of the grant to award subgrants to local educational agencies (LEAs) and public institutions of higher education to restore the reductions in state funding for elementary and secondary education and for public institutions of higher education that remain for FY2010 and FY2011, after including the funds they received for such reductions under the American Recovery and Reinvestment Act of 2009. Requires states that receive a grant that is more than what is required to cover such activities to allocate the excess to their LEAs based on the LEAs' relative share of school improvement funds under title I of the Elementary and Secondary Education Act of 1965. Limits the use of subgrant funds to retaining or hiring new employees, or on-the-job training activities for education careers. Designates this Act's appropriation as an emergency requirement.

Campus Fire Safety Education Act of 2010 - Directs the Secretary of Education to establish a program to award grants, on a competitive basis, to institutions of higher education or consortiums of such institutions for: (1) initiating, expanding, or improving fire safety education programs; and (2) increasing fire safety awareness among enrolled students. Directs the Secretary to give priority to institutions that plan to use funds to initiate, expand, or improve fire safety education programs that include educational material specifically prepared for students with physical, sensory, or cognitive disabilities. Sets forth provisions regarding grant periods, limits on awards, and matching and other requirements. Requires an institution to use grant funds to initiate, expand, or improve a fire safety education program that: (1) reaches all enrolled students; (2) ensures maximum exposure to and increased awareness of, and that effectuates change in behavior regarding, fire safety by students through conducting outreach to students a minimum of twice per academic year and through measures that provide fire safety information to any student upon request; (3) includes minimum instruction regarding fire behavior, fire injury and death, ignition scenarios, fire safety systems and equipment, and the importance of means of egress; and (4) includes a mechanism for carrying out evaluations of program effectiveness. Requires the Secretary to publish a report of best practices for initiating, expanding, or improving fire safety education programs.

Building Star Energy Efficiency Act of 2010

Building Star Energy Efficiency Act of 2010 - Establishes in the Department of Energy (DOE) the Building Star Energy Efficiency Rebate Program of 2010. Directs the Secretary of Energy to issue rebates to building owners to offset a portion of the cost of purchasing and installing qualifying equipment or materials or undertaking qualifying services to enhance the energy efficiency of existing commercial buildings and multifamily residential buildings. Prescribes rebates for the purchase and installation of qualifying: (1) insulation, windows, and qualified high-efficiency window films and screens; (2) new energy efficient equipment, such as boilers, furnaces, and water heaters; (3) unitary air conditioners and unitary heat pumps; (4) variable speed drives for motors; and (5) interior lighting. Prescribes calculations for reductions in: (1) installed lighting power resulting from installation of qualified interior lighting; and (2) annual energy usage resulting from installation of qualified exterior lighting. Prescribes calculations also for rebates for qualified: (1) replacement chillers; (2) qualifying services to enhance the energy efficiency of buildings; (3) energy-efficient building operation and maintenance training; (4) service on space heating equipment and cooling systems, (5) energy monitoring and management systems with analog controls; and (6) HVAC testing, balancing, and duct sealing. Directs the Secretary to: (1) establish a Building Star Energy Efficiency Loan Program to make grants to states to support financial assistance provided by qualified program delivery entities for making energy efficiency and renewable energy improvements to existing buildings that qualify under the Building Star energy retrofit program. Amends the Energy Policy Act of 2005 to: (1) direct the Secretary to make guarantees for energy efficiency projects, including projects to retrofit residential, commercial, and industrial buildings, facilities, and equipment; and (2) authorize the Secretary, in the case of programs that finance such retrofitting, to offer loan guarantees for portfolios of debt obligations, and to purchase or make commitments to purchase portfolios of debt obligations.

Health Insurance Rate Authority Act of 2010

Health Insurance Rate Authority Act of 2010 - Amends the Public Health Service Act to require the Secretary of Health and Human Services (HHS) to establish a uniform process for the review of potentially unreasonable increases in rates for health insurance coverage, which shall include premiums. Directs the Secretary to establish a Health Insurance Rate Authority to advise and make recommendations to the Secretary. Sets forth corrective actions for unreasonable increases in rates. Requires a report on state authority to review rates and take corrective action, rating requests received by the state and actions taken, justifications by insurance issuers for rate requests, and a recommended definition of unreasonable rate increase. Requires the Secretary to determine: (1) for which states the state insurance commissioner will review rate increases and take corrective action; and (2) for which states the Secretary will undertake such actions based on the Secretary's determination that such states lack the authority and capability. Directs the Secretary to develop a uniform data collection system for new and increased rate information. Requires the Authority to produce annually a single, aggregate report on insurance market behavior. Directs states, as a condition of receiving a grant under this Act, to provide the Secretary with information about trends in rate increases in health insurance coverage in premium rating areas in the state. Requires the Secretary to carry out a program to award grants to states to carry out this Act. Authorizes the Secretary to enforce this Act if the state does not substantially enforce the provisions. Establishes civil penalties for violations.

Military Readiness Enhancement Act of 2010 - Repeals current Department of Defense (DOD) policy concerning homosexuality in the Armed Forces. Prohibits the Secretary of Defense (Secretary), and the Secretary of Homeland Security (DHS) with respect to the Coast Guard when it is not operating as a service in the Navy, from discriminating on the basis of sexual orientation against any member of the Armed Forces or any person seeking to become a member. Authorizes the re-accession into the Armed Forces of otherwise qualified individuals previously separated on the basis of sexual orientation. Directs the Secretary to establish in DOD the Pentagon Working Group to report recommendations regarding the implementation of this Act. Requires such report to be submitted to the congressional defense committees. Requires the Secretary to: (1) revise DOD regulations and issue new regulations as necessary to implement this Act; and (2) direct each military department Secretary to do the same. Directs the Secretary to report on the compliance of institutions of higher education with federal law concerning the denial of access by such institutions to Reserve Officer Training Corps (ROTC) military recruiting on campus, as well as a description of actions taken to effect the denial of certain federal funding to institutions that continue to prevent ROTC access.

Directs the Institute of Education Sciences to support engineering education research and an evaluation of this Act's grant programs. Requires the Secretary to use the evaluation's findings to provide information to the public and technical assistance to states on best practices and promising innovations in K-12 engineering education.

Establishes in the Office an Advisory Council on Alzheimer's Research and Treatment.

10 Million Solar Roofs and 10 Million Gallons of Solar Water Heating Act of 2010 - Requires the Secretary of Energy to establish a program to provide rebates for the purchase and installation of solar photovoltaic systems and solar water heating systems for residential and commercial properties in order to install over 10 years at least : (1) an additional 10 million solar systems with a cumulative capacity of at least 30,000 megawatts; and (2) an additional 200,000 solar water heating systems with a cumulative capacity of 10 million gallons. Establishes rebate eligibility criteria and the amount of rebates.

Act - Amends the Immigration and Nationality Act with respect to V- visa nonimmigrants (spouses and minor children of lawful permanent residents who come to the United States to wait for completion of the immigrant visa process) to include Haitian nationals whose petition for a family-sponsored immigrant visa was approved on or before January 12, 2010. Authorizes the Department of State to use secondary evidence to verify eligibility for such status or for immediate relative status. Sunsets the provisions of this Act two years after its enactment.

International Violence Against Women Act of 2010 - Directs: (1) the Secretary of State to designate an Ambassador-at-Large for Global Women's Issues; and (2) the Administrator of the United States Agency for International Development (USAID) to designate a Women's Development Advisor. Directs the Secretary to: (1) develop a comprehensive strategy to prevent violence against women and girls; (2) prepare a public report on best practices for preventing and addressing violence against women and girls internationally; and (3) determine emergency response measures to identified critical or widespread incidents of violence against women and girls in situations of armed conflict. Authorizes the Secretary and the Administrator to provide assistance to nongovernmental organizations, multilateral institutions, and foreign countries to implement such strategy and related activities. Requires that special efforts be made to award amounts appropriated under this Act to community-based and women's nongovernmental organizations in recipient countries. Directs the Secretary and the Secretary of Defense (DOD) to: (1) incorporate training on prevention and response into the basic training curricula of foreign military forces and judicial officials; and (2) ensure that U.S. assistance to units involved in regional or multilateral peacekeeping operations includes such training. Authorizes the Ambassador to provide guidance to the Administrator and the Assistant Secretary for Population, Refugees, and Migration. Authorizes the Secretary to provide guidance on preventing and responding to violence against women and girls to the Secretary of Defense when U.S. military personnel, military contractors, and military observers are to be deployed in humanitarian relief, conflict, and post-conflict settings. Directs the Secretary to make U.S. financial, material, human, and other resources available to assist U.N. efforts to: (1) implement training programs in prevention and response to violence against women and girls for peacekeeping and humanitarian personnel; (2) enhance the deployment of military and civilian women in peacekeeping missions; and (3) improve protection mechanisms at U.N. managed refugee and internally displaced persons camps.

Haiti Recovery Act - Urges the Secretary of the Treasury to direct the U.S. Executive Director to each international financial institution to advocate: (1) the cancellation of all remaining debt obligations of Haiti, including obligations incurred after the date of the enactment of this Act and before February 1, 2012; (2) the provision of debt service relief for all of Haiti's remaining payments; and (3) that new assistance to Haiti should be primarily grants rather than loans. Urges the Secretary to: (1) instruct the U.S. Executive Director of the International Monetary Fund (IMF) to advocate the use of certain proceeds to provide debt stock relief, debt service relief, and grants for low-income countries that are eligible for the Poverty Reduction and Growth Facility or any other programs to assist low-income countries, including Haiti; (2) support the creation of an Inter-American Development Bank trust fund for Haiti that would leverage U.S. contributions and promote bilateral donations for the purpose of investing in Haiti's infrastructure; and (3) direct the U.S. Executive Director of the Inter-American Development Bank to increase earnings transfer to the Fund for Special Operations, which finances programming in Haiti and other weak economies in the Western Hemisphere. Urges the Secretary and the Secretary of State to use all appropriate diplomatic influence to secure cancellation of all remaining bilateral debt of Haiti.

Secure Airport Terminal Act of 2010 - Directs the Secretary of Homeland Security (DHS) to prescribe regulations that: (1) require the use of security cameras at all screening locations and all locations where passengers exit the sterile area at airports in the United States; (2) prescribe requirements for the use, maintenance, and testing of such security cameras and other technological devices; and (3) specify that employees of the Transportation Security Administration (TSA) have access to all such security cameras and technological devices as well as data or recordings from them relating to airport security. (Under aviation security regulations: (1) "screening location" means each site at which individuals or property are inspected for the presence of weapons, explosives, or incendiaries; and (2) "sterile area" means a portion of an airport that provides passengers access to boarding aircraft and to which the access generally is controlled by TSA, or by an aircraft operator or a foreign air carrier, through the screening of persons and property.) Directs the DHS Assistant Secretary (TSA) to report to specified congressional committees: (1) recommendations for improving the security of each location at an airport where passengers exit the sterile area; and (2) an assessment of differences in location configurations and options for improving security at such locations. Prescribes a civil penalty of up to $10,000 for individuals who enter an aircraft or an airport area in violation of security requirements. Increases the criminal penalty of maximum imprisonment for such violations from one year to 10 years. Directs each U.S. airport operator that is required to establish an air transportation security program to ensure that signs meeting DHS requirements for providing notice of such penalties are displayed near all screening locations, all locations where passengers exit the sterile area, and other appropriate airport locations. Subjects an individual to such penalties, however, without regard to whether signs are displayed as required by this Act.
